As is explored in this chapter, resistance in the South to the post-Civil War Reconstruction Amendments to the U.S. Constitution led the victorious Union general-turned-president Ulysses S. Grant to request a suspension from his Congress in order to infiltrate the Ku Klux Klan and combat Klan violence. Studying the Reconstruction period reveals that the understanding of the constitutional privilege and suspension remained consistent with Anglo-American legal tradition. In carrying out the suspension on the ground, military officers employed their expanded powers to engage in preventive detention of Klan members and to advance the new civil rights constitutionalized in the Reconstruction Amendments, while recognizing that with the lapsing of suspension, further detention could only be justified through the criminal process. Throughout, the Reconstruction period underscores the continuing influence of the English Habeas Corpus Act on American constitutional habeas jurisprudence. Notably, however, the Reconstruction period tells a very different narrative about the ends to which the suspension power may be wielded—namely, the advancement of civil rights.

It was not until the Confederate attack on Fort Sumter on April 12, 1861, and the beginning of the Civil War that the United States witnessed its first suspension at the federal level. Within days of the attack, Lincoln authorized Union military leaders to suspend habeas wherever they believed it necessary to protect key geographic areas. Lincoln did so famously on his own and without congressional approval. As explored in this chapter, although Lincoln was wrong to lay unilateral claim to the suspension power, his understanding of the necessity of suspension to legalize arrests made outside the criminal process was fully consistent with the historical view of the suspension model and shared by Congress in the 1863 suspension legislation that it finally passed after two years of debate. Studying this period reveals the continuing influence of the English suspension framework along with the importance of allegiance with respect to the protections of domestic law.

The U.S. Constitution that emerged from the Constitutional Convention in 1787 created a stronger central government than had existed under the Articles of Confederation and for the first time established national courts. It also included the Suspension Clause, which provided: “The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.” As explored in this chapter, a wealth of evidence from the Founding period demonstrates that in the Suspension Clause, the Founding generation sought to constitutionalize the protections associated with the seventh section of the English Habeas Corpus Act and import the English suspension model, while also severely limiting the circumstances when the suspension power could be invoked.

As explored in this chapter, the Confederate experience provides further evidence that English legal tradition heavily influenced the understanding of the constitutional privilege and suspension that controlled during the Civil War period. Just as in the North, the South viewed suspension as a necessary predicate to detaining persons outside the criminal process. Further, in keeping with the ratification debates and the decisions of the Marshall and Taney Courts, the Confederacy recognized the English Habeas Corpus Act as the foundation of the American constitutional privilege. Likewise, the dominant view in the Confederacy did not view suspension as justification for military trials of civilians. The South did, however, disagree over which branch of government possesses the power to suspend. Throughout the war, Confederate president Jefferson Davis never once questioned that the power resided solely in the Confederate Congress.

Habeas Corpus in Wartime unearths and presents a comprehensive account of the legal and political history of habeas corpus in wartime in the Anglo-American legal tradition. The book begins by tracing the origins of the habeas privilege in English law, giving special attention to the English Habeas Corpus Act of 1679, which limited the scope of executive detention and used the machinery of the English courts to enforce its terms. It also explores the circumstances that led Parliament to invent the concept of suspension as a tool for setting aside the protections of the Habeas Corpus Act in wartime. Turning to the United States, the book highlights how the English suspension framework greatly influenced the development of early American habeas law before and after the American Revolution and during the Founding period, when the United States Constitution enshrined a habeas privilege in its Suspension Clause. The book then chronicles the story of the habeas privilege and suspension over the course of American history, giving special attention to the Civil War period. The final chapters explore how the challenges posed by modern warfare during the twentieth and twenty-first centuries have placed great strain on the previously well-settled understanding of the role of the habeas privilege and suspension in American constitutional law. Throughout, the book draws upon a wealth of original and heretofore untapped historical resources to shed light on the purpose and role of the Suspension Clause in the United States Constitution, revealing all along that many of the questions that arise today regarding the scope of executive power to arrest and detain in wartime are not new ones.

This article examines the power of professional sports league commissioners to discipline and suspend players for misconduct both on and off the field. It first provides a historical background on disciplinary measures for players in different professional sports leagues, including the National Football League, over the past century. It then considers the source of the commissioner’s power and authority to discipline professional athletes for misconduct as well as the rationale behind it, focusing on the adoption of personal conduct policies at the league level. It also discusses the commissioner’s authority and power to act in the “best interests” of the sport. Finally, it analyzes the limitations on the commissioner’s power and authority, including the collective bargaining agreements and some arbitration and court rulings that involved suspensions of players by league commissioners.

This chapter recaps the main themes of the volume, ie that the international law of the global economy is in a state of disorder. Claims about the justice, fairness, or benefits of the current state of international law as it relates to the global economy are fanciful. A more credible picture emerges when one considers who is protected, against what, and those relations that are valued and those that are not. Moreover, these claims above all require a suspension of a reflective attitude about what international law actually says and does. When it comes to international economic law, power is masked behind a veil of neutrality when it certainly is not neutral in the interests it protects and offends. As for international human rights law, it overlooks the ways in which it props up extreme capitalism foreclosing the possibility of transformative structural change to neoliberal capitalism. In its most radical areas, human rights norms have been blocked from making demands on the design of the global economy precisely because of their transformative potential. Among the central critiques of international law presented in this book is that international law must be justifiable to those who are subject to it.

Borrowing is a crucial source of financing for governments all over the world. If they get it wrong, then debt crises can bring progress to a halt. But if it's done right, investment happens and conditions improve. African countries are seeking calmer capital, to raise living standards and give their economies a competitive edge. The African debt landscape has changed radically in the first two decades of the twenty-first century. Since the clean slate of extensive debt relief, states have sought new borrowing opportunities from international capital markets and emerging global powers like China. The new debt composition has increased risk, exacerbated by the coronavirus pandemic: richer countries borrowed at rock-bottom interest rates, while Africa faced an expensive jump in indebtedness. The escalating debt burden has provoked calls by the G20 for suspension of debt payments. But Africa's debt today is highly complex, and owed to a wider range of lenders. A new approach is needed, and could turn crisis into opportunity. Urgent action by both lenders and borrowers can reduce risk, while carefully preserving market access; and smart deployment of private finance can provide the scale of investment needed to achieve development goals and tackle the climate emergency.
