The study of the above mentioned events and the reflection upon the attitudes and the decisions about food safety made by the European Union institutions raised many different questions. First of all I wondered if this is only a European phenomenon or if it may also apply to overseas countries like the USA. I also wanted to investigate about science regulation policies ruling the safety system born to face feared or evident risks for public health (as a consequence of BSE), i.e. to understand how scientific knowledge is used in legal and policy choices and which are the political and social consequences. In effect, the emergencies, risks and uncertainties caused by the social implementation of science have increased the gap between society and institutions both at national and community level, generating mistrust not so much of scientific and technological progress but of the institutions themselves. The public isn’t only worried about “safety” meant as the likelihood of a damage occurring, but also about the unexpected social effects neglected by the institutions. Europe expressed its concerns about these situations by trying to fill the gap from different perspectives : • new governance of science; • subsequent new regulatory and policy model of science; • expertise and its credibility; • more collective decision making processes Such steps are fundamental to generate and new idea of science governance which connects the need of a more democratic science with that of a more involving society . The Democratization of science implies the acquisition by institutions of several scientific opinions involving all of the aspects of knowledge in order to obtain decisions making processes meeting social needs and, consequently, closer to citizens.

Texto completoThe Area of freedom, security and justice has increasingly become one of the fundamental objectives of the European Union. This is often analysed for the benefits that it will guarantee to the European citizens as well as to all the individuals within its territory. However, this Area has a “dark side”, namely the limits that for its own nature it might entail to individual rights. This research aims at assessing whether the acts adopted in this Area guarantee a balance between the need of security and the need of protection of individual rights. References that have been used are the ECHR, the Charter of fundamental rights of the eu and the case law of the European Court and the Court of Justice. From an analysis of the legislation that has implications on data protection; a trend has emerged to consider the security aspect as a priority. From an analysis of the legislation on the procedural rights, a trend has emerged to develop the repressive aspect of criminal law. The absence of a complete system of judicial remedies in the third pillar is limit that the national judges and the European court can only partially overcome. A treaty’s reform is therefore necessary, also in order to limit interpillar conflicts. Only a parallel development of the needs of security and of protection of individual rights can ensure the achievement of a real Area of freedom, security and justice of EU

Texto completoQuesta ricerca è strutturata in tre parti distinte: - La Prima Parte affronta la questione chiave dei: “Mutamenti nel rapporto fra territorio e spazio nell’Europa moderna”. Un nodo teorico senza il quale non si riuscirebbe a comprendere il tentativo di costruzione di uno "spazio giuridico comune" dell’ Unione europa attuale che si deve misurare con la presenza di territori nazionali con una loro specificità geografica, storica, politica e giuridica, che ancora forniscono senso di appartenenza. Da qui' la dialettica fra territorio e spazio che mantiene e, anzi, acuisce la sua centralità come emerge dal processo costituente dell'Unione europea e in parallelo dall'esperienza derivante da sessant'anni di giurisprudenza della Corte europea dei diritti dell'Uomo. Anche da questo punto di vista, il processo di costruzione dell’Europa è intimamente dialettico, muovendo essenzialmente dalle realtà statali per intravedere la via travagliata che conduce oltre di esse: il rapporto fra Stato e territorio ha segnato la storia dello Stato e della dottrina ad esso relativa. Lo spazio comune europeo si inserisce come elemento necessario e critico di analisi. -La Seconda Parte è dedicata a: “Lo spazio di libertà, sicurezza e giustizia alla luce dei trattati dell'Unione europea”. E’ una parte necessariamente più "specialistica", che entra in un campo storico-giuridico, provando a descrivere il funzionamento dello spazio comune dell'Unione europea posto in relazione con l’insieme delle innovazioni istituzionali in cui è inserito e, quindi, cercando anche di analizzare i mutamenti morfologici in termini di sovranità e legittimazione che ne derivano. Diviene, dunque, centrale, la legittimazione attraverso i diritti, attraverso la novità del carattere vincolante della “Carta dei diritti fondamentali dell’Unione europea” e il principio di cittadinanza. -La Terza Parte si concentra su: “La legittimazione dello spazio multilaterale dell'Unione europea” e prova ad aprire lo sguardo sul rapporto fra l’Europa dello "spazio comune" e gli spazi globali, su cui tutte le entità, statali e non-statali, oggi si relazionano. In questo spazio comune, il tema della democrazia e della sovranità si trovano intimamente interconnessi. La questione centrale per sviluppare questa analisi è: quale contributo può dare l’Europa (l'Unione europea) della “sovranità condivisa” in uno spazio oltre gli Stati nazionali per la legittimazione di una visione multilaterale della governance globale. Texto completoThe article 86 TFEU estabilishes that in order to combat crimes affecting the financial interests of the Union, the Council may establish a European Public Prosecutor's Office from Eurojust. To carry out the cited norm, on the wake of the projects of “Corpus Juris” and “Model Rules”, the Commission worked out a proposal for a Council Regulation on the establishment of the European Public Prosecutor's Office (COM/2013/0534 final). On this proposal the Council wasn’t able to obtain the unanimity, anyway 20 Member States decided to establish enhanced cooperation to adopt the Regulation de quo. Waiting for the consent of the European Parliament, we wish that the expectant organ won’t be too much “weak” and that it will be able - even if without a “european criminal law” – to efficiently protect the financial interests of the EU, in the perspective of a full achievement of the european area of freedom, security and justice. Texto completoThis thesis deals with the legal analysis of the network-based model of cooperation between national authorities of the EU Member States within the Area of Freedom Security and Justice – AFSJ. The aim is to evaluate the contribution and the potential of such a model. The dissertation is divided into two parts, which are preceded by an introductory section dealing with the analysis of the notion of network and its legal value. With a view to provide a deeper understanding of this phenomenon, the first part intends to portray the emergence of networking between judicial and law enforcement authorities. In this part, also the driving factors (both legal and structure-related), which have triggered such a process are highlighted. In particular, attention is paid to both the legal instruments applying the principle of mutual recognition and those applying the principle of availability. The rationale is to identify the obstacles hindering the effective implementation of the cooperation procedures and to understand the role played by networks in this respect. The second part of the dissertation analyses the main networks operating in the justice and security fields, with a special focus on the features characterizing these flexible arrangements and their methods of operation. The dissertation is divided into two parts reviewing a) networks supporting the effective application of both the mutual assistance procedures and the legal instruments implementing the principle of mutual recognition and b) networks dealing with the informative cooperation, ensuring a faster exchange of law enforcement information across national borders. Special attention is paid to networks dealing with the economic dimension of crime. Finally, the main features of a “European network model of cooperation” are identified as well as the role played by such a model in respect to the exercise of the EU competences in the AFSJ.

Texto completoThe present work analyses the phenomenon of school dropout and the policy making of states and regions: particularly and in a comparative key, the policies of three Member States, Italy, France and Spain, involved with different reforms of the school system, and two regions for each of them, Lombardy Region, Puglia Region; Aquitaine Region, Rhone-Alpes Region, Andalucia Region and Region of Madrid. Starting from the analysis of European documents ET2010 Lisbon Strategy and ET2020 Europe Strategy, this work focuses on the second of the two documents and one of the five objectives indicated, especially the 10% reduction in the school dropout rate for young people aged between 18 and 24 years. Reference is made to the time period between the academic year 2008-2009 and 2015-2016, between the end of the Lisbon Strategy, the new ten-year phase of the Community policies launched with the Europe 2020 Strategy.

Texto completoThe present work analyses the phenomenon of school dropout and the policy making of states and regions: particularly and in a comparative key, the policies of three Member States, Italy, France and Spain, involved with different reforms of the school system, and two regions for each of them, Lombardy Region, Puglia Region; Aquitaine Region, Rhone-Alpes Region, Andalucia Region and Region of Madrid. Starting from the analysis of European documents ET2010 Lisbon Strategy and ET2020 Europe Strategy, this work focuses on the second of the two documents and one of the five objectives indicated, especially the 10% reduction in the school dropout rate for young people aged between 18 and 24 years. Reference is made to the time period between the academic year 2008-2009 and 2015-2016, between the end of the Lisbon Strategy, the new ten-year phase of the Community policies launched with the Europe 2020 Strategy.

Texto completoWhat is a nation? What is the main drive of a national state? Over the last two hundred years, millions of people have died but most of all have died for the name of their country. What has allowed this? And today, what position does nationalism have within the European Union? From the various answers on this subject, one of note is elaborated by the American historian, Benedict Anderson. In his most famous book “Imagined Communities: Reflections on the Origin and Spread of Nationalism”, Anderson investigates deeply one’s feelings regarding national belonging, their culture, their roots and their diffusion in different cultural settings, revealing the roots of nationalism and the actual national structure, not in their political and parliamentary practice, but more so within the shared practices of inhabitants and their communities. Therefore, similar to an anthropologist, he develops a revolutionary vision in his description: the renewal is in viewing the nation as a cultural product; that is an artificial construction. He proposes a new definition of the nation: “a political imagined community” and imagined as sovereign and limited. It is imagined in such that the inhabitants of the most smallest nation will never know all their compatriots, however each person feels part of a community; a nation is limited because it is seen surrounded by borders, beyond these limits there are other nations; sovereign for the fact that the idea of a nation is inspired by Enlightenment ideas of independence and liberty; finally, it is a community because it is lived within an affectionate environment, despite differences, inequalities and exploitation. On the last ten years Benedict Anderson has had a great influence within the study of individual relationships, societies and national organization. Following the birth of European Union , combined with globalization and the union of the European market, the national identities has gone into crisis. Considering the all above points, my research intends to develop a reflection on the national identity in the contemporary societies, evaluating the theoretical elements in general, and also the actual political and cultural debate within the European Union.

Texto completoThe thesis analyses the institution of the European Capital of Culture from an anthropological perspective on the basis of the ethnographical inquiry of Pafos, a small town in the south-west coast of Cyprus, that held the title during 2017. The research embraces the suggestion of the anthropology of policy; so that It intends to discover and highlight the self-legitimation discourse of the institution and its subjectivation practices. Though, the analysis focus on the point of view of the insiders of the institutions and the people related to it (bureaucrats, artists, politicians, volunteers etc.) who act as a connection between the local and European dimension of the event. The word “city” has been pinpointed as one of the major symbolic knots in the discourse of the institution, through which it describes its action and mission; in addition, it is a critical point of the self-representation of the pafians who think about their own town as a quasi-city. Therefore, we can say Pafos2017 acts specifically to turn Pafos into a proper city, so its project is told as an urban (re)generation. The transforming of Pafos play an important role into the post-colonial situation of the island. The European hegemony that affect Cypriot society, in fact put Pafos at the very last position of a chain of hegemony and subalternity relationships. This situation prevents the Pafos community from the possession of their own identity, exposing them to ne necessity of continuous confirmation of their status of modern. So, the ECoC’s goal is to redeem the city from the marginality in which it has fallen through modernization. Therefore, the model that give shape to the policy’s action is analysed. It is the one of the creative city, that serves both as category to understand the reality and as a model for the development of the Pafso2017 urban policy. The making of a new and proper city then it requires culture as a tool for impacting the perception of places and on the identity of the pafians. At first, the research analyses the placemaking practices towards the spaces of the town, that aim to change the relationship they’re having both with the citizens and the city’s imago that is being provided to the outside. The thesis shoes how Pafos2017 reshapes the relationship between spaces and the memories of the interethnic war and the partition of the island through the analysis of the renovation of the neighbourhood of the Moutallos. The history has been turned from the ground of a struggle between two opposite nationalistic narratives to a supply of cultural diversity to produce creative artefacts. At the same time, the work shows the artistic program’s polito-poietic project, that aim to turn the Pafos inhabitants into proper citizens. This process is described through the expression of “opening their minds” and consists in the removal of all the obstacles that are preventing or postponing modernity, that comes from outside, to reach Cyprus and Pafos. So, Pafos2017 makes the pafians pass through a subjectivation process that turns them into cultural consumers, in order to carry out its goal. At last, Pafos2017 is understand as part of the wider program of the EU cultural policies. Therefore, it could highlight its role in creating an European cultural space, based on the logic of “unity in diversity”. This new identity structure challenges the national one, indeed it looks at internal differences as assets for the community instead of weaknesses. From this perspective, the discourses about Europeanization and polito-poiesis can correspond to each other and becomes tool for the creation of an European semiotic community.

Texto completoIn un contesto di multi-level governance, l'impegno per assicurare una gestione efficace ed efficiente delle risorse destinate alla attuazione delle politiche per lo sviluppo e la coesione dei territori deve coinvolgere tutti gli attori, ai vari livelli decisionali, fino agli amministratori pubblici locali e ai beneficiari finali. Una generale sensibilizzazione verso un controllo accurato e una maggiore trasparenza dell'uso delle risorse pubbliche, può contribuire a creare un clima di fiducia tra gli amministratori e i cittadini, riducendo le barriere burocratiche e dando maggiore credibilità ai risultati degli interventi pubblici. A tal proposito nei contesti locali, emerge sempre più la necessità di disporre di strumenti di valutazione che forniscano informazioni più adeguate e più utili ai decisori anche su progetti di limitate dimensioni o degli interventi che riguardano aree circoscritte anche attraverso un coinvolgimento diretto, ove possibile, della popolazione locale e di tutti i soggetti pubblici e privati che sono in qualche modo "interessati". I Gruppi di Azione Locale (GAL) dei programmi europei LEADER per lo sviluppo delle aree rurali sono da sempre parte attiva nel promuovere la cultura della cooperazione e del coordinamento e la responsabilizzazione di tutte le componenti economiche e sociali di una comunità per una valutazione dell'esito degli interventi locali finanziati dai fondi strutturali europei. Questa ricerca si propone di elaborare uno strumento operativo di autodiagnosi a disposizione di partnership pubblico/private locali, del tipo dei GAL, che consenta loro di tenere sotto controllo i punti di forza, gli aspetti da migliorare nonché il grado di soddisfazione dei loro interlocutori nel territorio. La metodologia sviluppata in collaborazione con i GAL e altri soggetti ad essi afferenti vuole essere semplice e sostenibile, in termini di risorse umane e finanziarie, per far si che buone pratiche di autocontrollo siano incorporate nelle attività quotidiane di queste organizzazioni. Il sistema di autovalutazione predisposto consiste in un un regolare monitoraggio delle modalità di gestione di un'organizzazione rispetto a 7 principi chiave di "buona governance": sviluppo sostenibile g-locale; efficacia, efficienza; partecipazione, trasparenza, responsabilità e capacità. Per tale verifica sono utilizzabili un numero limitato di indicatori flessibili che possono essere ulteriormente perfezionati in modo autonomo dalla organizzazione stessa, secondo le proprie esigenze. Tale dispositivo è stato perfezionato e testato con degli operatori diretti o indiretti di GAL delle Regioni delle Fiandre (Belgio), Umbria e Veneto. L'Auto-valutazione può aiutare una singola organizzazione e i soggetti che con essa si relazionano ad avvicinarsi alla complessità della realtà e a utilizzare in modo appropriato risorse sempre più limitate. Una costante e puntuale analisi delle informazioni favorisce la conoscenza e l'apprendimento sia all'interno della organizzazione che all'esterno attraverso la condivisione di procedure e il continuo confronto con i diversi soggetti. Tale strumento consentirebbe ai GAL di misurare i risultati raggiunti nello sviluppo locale a fronte dei finanziamenti ottenuti, in relazione anche alle aspettative della popolazione e dei beneficiari. Inoltre queste misure di regolare monitoraggio e controllo interno, sono il primo passo per disporre di informazioni più adeguate ai contesti locali, più immediatamente comprensibili ai cittadini e più utili a prendere le decisioni politiche ai vari livelli di governo. Ricerche future potrebbero essere indirizzate a cogliere la sfida di individuare i valori desiderati associabili a ciascun indicatore del set da noi predisposto che consentano di pervenire a dei giudizi di valore quantitativo o qualitativo delle misure osservate nel corso dell'autovalutazione

In a progression of the European legislator's sensitivity to guarantee the market as well as the food consumers and their safety, the EU legislation on novel foods has tried to balance food innovation and the multiple needs of operators and consumers who require products with increasingly more defined characteristics and suitable to satisfy a wide range of preferences. If "the capacity of the technique is the effective power to achieve goals and to satisfy needs indefinitely" is easy to understand how the novel food turns out to be a paradigmatic case of an encounter between science, market needs and juridical rules. Furthermore, the increasing interest in the food sector raises the question of which methods of regulation of scientific innovations apply.

Texto completoWhat does it mean to be protected? To live in a constantly monitored space, or feeling heard by the institutions? Supervise the neighborhood or be involved in the design of security policies? The study analyze citizen’s active participation as a further element for an effective implementation of urban safety policies. The goal is to understand if and how social ties influence on perceived safety and what role they may have in the design and development of security policies. The reference framework is therefore to community prevention policies. In order to develop the project I used a mixed qualitative and quantitative methodology research in order to analyze citizen’s active participation through neighborhood watch, community policing and police mediation in the italian and spanish context.
