Resumen
In recent years, the economic approach to human behavior has been challenged by contributions of cognitive science. Thus two methodological strands in economics disagree with each other: the objectivistic approach favors the methods of natural science; the subjectivistic approach takes the teleological structure of human action as its cornerstone. It is argued that the position of the latter has been undermined and often degraded to a mere instrumentalist tool because it builds upon the primitive version of the teleological structure. Its deeper realist analysis is needed, which is the task for economic phenomenology: it identifies invariant pragmatic structures of human action, with various degrees of their anonymity. If the economic approach is founded on those structures adequately, then both rational choice theory and bounded rationality theories become compatible, as they differ in their degrees of anonymity only; they both belong to the body of the (subjectivistic) economic approach to human behavior. Economic phenomenology also offers a solution to the phenomenon of inconsistency of human action which is documented by cognitive sciences as a proof of human irrationality. The thesis shows that once the decision maker's description of the choice is allowed, inconsistency may disappear. Consistency is a matter of thinking, not acting. Therefore, a conceptual analysis of human thinking is needed. An example of the analysis is presented. It concentrates on the phenomenon of Self and works up the concept of the horizontality of Self. With this concept, inconsistency of human action is derived as a natural characteristic of our being-in-the-world. Inconsistency of human action is a pragmatic structure of human action, which even allows the decision maker some intentional control.

Guala, Francesco. "Economics and the laboratory : some philosophical and methodological problems facing experimental economics". Thesis, London School of Economics and Political Science (University of London), 1999. http://etheses.lse.ac.uk/836/.

Texto completo
Resumen
Laboratory experimentation was once considered impossible or irrelevant in economics. Recently, however, economic science has gone through a real ‘laboratory revolution’, and experimental economics is now a most lively subfield of the discipline. The methodological advantages and disadvantages of controlled experimentation constitute the main subject of this thesis. After a survey of the literature on experiments in philosophy and economics (chapter one), the problem of testing normative theories of rationality is tackled (chapter two). This philosophical issue was at the centre of a famous controversy in decision theory (the ‘Allais controversy’), during which a methodology of normative falsification was first articulated and used to assess experimental results. In the third chapter, the methodological advantages of controlled experimentation are illustrated and discussed with examples taken from the experiments on the so-called ‘preference reversal’ phenomenon. Laboratory testing allows to establish with a high degree of certainty that certain phenomena lie behind the experimental data, by means of independent testing, elimination of alternative hypotheses, and the use of different instruments of observation. The fourth chapter is devoted to a conceptual analysis of the problem of ‘parallelism’. This is the problem of inferring from the occurrence of a phenomenon in the laboratory, to its (possible) instantiation also in non-laboratory environments. Experimental economists have discussed parallelism at length, and their views are presented and criticised. Eventually, it is argued that parallelism is a factual matter and as such can only be established on empirical grounds. The fifth chapter provides an example of how one can argue for parallelism, focusing on the case of experimentation on the ‘winner’s curse’ phenomenon. The role of experiments as ‘mediators’ between theoretical models and their target domain of application is illustrated, and the structure of parallelism arguments analysed in detail. Finally, in the last chapter, economic experiments are compared to simulations, in order to highlight their specific characteristics.

Russell, T. "Philosophical problems with the concepts of death and brain death : a different perspective". Thesis, Swansea University, 1998. http://ethos.bl.uk/OrderDetails.do?uin=uk.bl.ethos.638727.

Resumen
The criteria and tests for death have changed throughout the history of medicine; these criteria and tests are underpinned by a variety of concepts of death. Recent advances in medicine and especially in the areas of resuscitation, mechanical ventilation and cardiac pacemakers have posed great philosophical and practical problems with the traditional concepts of death and their associated criteria and tests. The concept of brain death has been formulated in an attempt to deal with the practical decisions that have to be made in deciding whether a person is dead or alive. The original concept of brain death has been subdivided into whole-brain death, brainstem death and neocortical death in different geographical areas and by a variety of people. In addition, there are groups of people who do not adhere to any formulation of brain death. In this thesis I put forward reasons for rejecting all the present formulations of brain death. I also put forward a concept of death derived from philosophical argument. This proposed concept of death views death as death of the organism as a whole and, while I argue mainly in terms of human beings, the concept that I propose could be applied equally to other animals. I also present arguments to demonstrate that the proposed concept of death can encompass the traditional criteria and tests for death and does not entail any significant operational changes in the way in which death is diagnosed.

Resumen
Thesis advisor: Richard Cobb-Stevens
This essay addresses the problems posed by proper names in regards to their relationship to that which they name (their "reference"). This relation of a name to its reference serves as a model for how language in general relates to the world as it actually is, making the question of what a name names of vital epistemological importance. The main problem posed by proper names is whether they simply denote, or whether they connote (i.e. have some informational content), and if they connote, what picture should we give of that content? This essay critiques a variety of theories about proper names, including those of Frege, Russell, Kripke, Searle, Evans, and Sainsbury. It concludes that names of unique entities do have informational content, in the form of a yet unspecified family of definite descriptions that rigidly designate an individual, which arises out of various causal chains of communication in a community

Tubb, Christine. "War in the classroom : a philosophical treatment of the problems posed by war for educators". Thesis, University College London (University of London), 1998. http://discovery.ucl.ac.uk/10021958/.

Texto completo
Resumen
This thesis addresses the problems inherent in teaching on war in schools. The focus is on the moral acceptability of killing in war, and the issues this raises for educators. It argues that war can only properly be presented in the curriculum as a controversial issue. In the first chapter it is maintained that war is undeniably a moral matter. Beliefs about aggression are explored to show that international military conflict is not an unavoidable feature of human existence and that war is a prima facie evil. Grounds for the absolute prohibition on taking life are then examined in Chapter 2, to demonstrate that pacifism is not an uncontestable stance. Just war thinking is investigated in Chapter 3. The immunity of civilians demanded by just war theory is shown to present particular difficulties in relation to twentieth century warfare. From the analysis in the first three chapters, the controversiality of war becomes plain. Some reactions to Peace Education, explored in Chapter 4, reflect the anxieties felt by many at the prospect of the moral dilemmas of war being debated in the classroom. The problems for the educator are exacerbated by fears of indoctrination and doubts over the value of teaching on war in schools. In Chapter 5 principles which ought to inform all teaching on war are identified. It is claimed that war must be explicitly presented as a controversial issue and that the teaching should be unbiased, balanced and impartial, adhering to coherence and consistency. Application of these principles to methodology is followed by reflection, in Chapter 6, on the selection of content for teaching on war. Consideration is given to knowledge and understanding, skills, values and dispositions. It is argued that nuclear war should be included and that the value of peace can legitimately be taught.

Bak, Nelleke. "Philosophical problems and paradoxes in the concept of self-deception, with specific reference to perversions of rationality". Master's thesis, University of Cape Town, 1987. http://hdl.handle.net/11427/16339.

Resumen
Bibliography: pages 230-233.
The problem of self-deception has been described as the paradoxical state of fooling oneself into believing what one knows to be false. The epistemological paradox of believing that p and believing that not-p, the psychological paradox of intending to do what one knows one cannot do, and the ethical paradox of being both agent and victim of one's own deception arise when self-deception is based on the structure of other-deception. Traditionally the approach to these paradoxes has been either to assert that literal self-deception, as based on the structure of other-deception, is impossible and that those phenomena which we falsely call "self-deception" are merely metaphors of other-deception, or the other approach is to assert that literal self-deception, as based on the structure of other-deception, is possible with all its accompanying paradoxes. Taking as her starting point the belief that self-deception can be based on the structure of other-deception, the author aims to show that self-deception is problematic but not necessarily paradoxical and that the two traditional approaches are not necessarily exclusive. The author has placed self-deception on a sliding scale from "weak" to "hard" cases, analogous to a sliding scale of "weak" to "hard" other-deception. By means of conceptual analysis of " deception'' and the comparison and evaluation of different arguments, the author attempts to explain how self-deception, as the holding of contradictory beliefs, is possible.

Resumen
Religion
Ph.D.
The present dissertation is a case study in applied phenomenology, specifically the postcolonial phenomenology of racism theorized by Lewis Gordon and applied to scholarly studies conducted on African American Jews and their kinfolk. My thesis is the following: Presumptively ontological human natures cannot function axiomatically for humanistic research on African American Jews. A humanistic science of Africana Jews must foreground the lived social worlds that permit such Jews to appear as ordinary expressions of humanity. The basic premise here is that subaltern (or denied) humanity exists in a neocolonial social world by virtue of an ordinariness that supervenes on humanity. For example, the more historians consider Africana Jews as ordinary, the more Africana Jews' humanity will appear. And the more human Africana Jews appear, the more inhuman their extraordinary appearance appears. This symbiosis constitutes a basic existential condition. When research on Africana Jews ignores this condition, it succumbs to ontological Jewishnness and other concepts rooted in what postcolonial theorist Frantz Fanon calls the "colonial natural attitude."

Czarnecki, Jan Wawrzyniec. "Musica textualis. Word-made music in prose as a philosophical problem". Doctoral thesis, Università degli studi di Padova, 2017. http://hdl.handle.net/11577/3426320.

Resumen
Can music be made with words alone, artistically arranged? Can music be part of a novel or a short story? Can a novella realize a musical form, and does it mean it is a musical piece? Is being a piece of literature incompatible with being a piece of music as well? If so – in what way or ways? If not, for what reason? These simple questions are the conceptual starting point of the research developed in the present dissertation. It investigates the essential interrelation between music and artistic prose in cases of imitation of music within the latter. Musica textualis, its central concept, is introduced in the first part as a meeting point of two distinct traditions of study, namely Philosophy of Music, on one hand, and the Word and Music Studies, on the other. It is an aporetic field emerging organically in the course of the historical development and dissolution of the system of the arts. Mutual intermedial imitations on the level of artistic creation and appreciation are continuously counterpointed by parallel processes within the history of aesthetic thought, metaphysics of art and musico-literary criticism, influencing greatly ways of perceiving and understanding distinct artforms and the aesthetic experiences they elicit. One of the main aims of the present research was to establish the actual status of the literary incarnations of music in artistic prose. The initial hypothesis was that there are some special cases, where music is not only represented in words by means of description, evocation, allusion and other standard literary techniques, but is actually there in the text, strictly speaking. Such local cases are possible and instantiated: the paradigm example is (Mann, 1967) with its model interpretation in (Scher, 1967), but there are also antecedent cases such as (Woolf, 1921) interpreted in (Harmat, 2008) or very recent artistically outstanding realizations as (Libera, 2013), interpreted here. What emerges as a positive theory from this research is the category of musica textualis. It denotes a mixed form which unites word-made-music with literary prose in a compound whole sui generis. It is conceptually symmetrical to programme music, where the real presence of music and literature in a compound structure perceptually made solely of musical sounds without words is not contested. Through its complex nature and fragile statute, it functions as a regulative ideal for the above-mentioned eponymous aporetic field. The explanatory force, methodological and interpretative implications of this theory are significant. Especially, the very process of its historical emergence through the aesthetics of Romanticism, the development of programme music and R. Wagner’s musical drama technique and the “intermedia turn” characterizing Modernism, unveil its necessary place in the conceptual map of the complex interrelation of these two temporal allographic arts: epics and music. The dissertation takes into account the vast and problematic discussion internal to the Word and Music studies and similar branches of intermodal/interart/transdisciplinary studies in their classical Anglophone version cf. (Scher, 1970; Wolf, 1999; Petermann, 2014), as well as in their Polish counterpart, anticipated critically in the work of Tadeusz Szulc (1937), and recently developed in, e.g. (Balbus, 2004; Hejmej, 2008, 2012). Also French and other studies are taken into consideration, cf. e.g. (Pautrot, 2004; Picard, 2008, 2010). It can potentially contribute to some significant clarifications in these controversial fields, but it is methodologically autonomous. It combines some elements of conceptual analysis and argumentation typical of analytic Philosophy of Art with a broader “continental” contextual horizon and interpretative ambitions. The main source of its insight comes from the immediate aesthetic experience of prose containing crucial instantiations of what can be interpreted as musica textualis. These insights are confronted with the achievements of the classical Philosophy of Music on one hand and the Word and Music practice on the other. As far as it is known, this is a novel approach within Philosophy. This method, intended as facilitating future mutual dialogue between the disciplines, is potentially beneficial for both (and open for further dialogue with musicology, which today is keen on borrowing research tools from Literary Theory). For the philosophers of music it discovers a neglected area of study, through a meticulous polemics with the conceptualizations of music at hand in the analytic tradition. It shows that works of musica textualis are, at least in part (like operas or Lieder, for that matter) works of music, and that there are no substantial grounds for excluding them from philosophical scrutiny of music. It shows that only the most anti-essentialist, accidentalist philosopher could find a coherent reason to reject a work of musica textualis from the realm of music on contingent grounds of the communis opinio; even his reasoning, though, is ultimately proven fallacious. Other philosophers are invited to rethink the way they localize essential features of the phenomenon in question. For the literary scholars interested in the practices described as musicalization of fiction, intermedial transposition / translation / transfer, the musical novel, music in the words within the venerated tradition of the comparison of the arts on the axis Music – Literature and especially in the 20th Century born Word and Music Studies – musica textualis can become a helpful tool in the on-going methodological dispute. It helps to distinguish genuine problems of method within the Word and Music Studies from what emerges as the vital aporetical core of interart phenomena such as Mann’s Doctor Faustus. This core confronts us with questions which cannot be resolved through some consensus within the scholarly community, but are better accepted and cherished as fertile sources of artistic and intellectual inspiration. The dissertation is divided into three parts. The first part introduces the concept of musica textualis, and places it within the contemporary philosophical discussion on music, explaining in detail its Boethian pedigree as well as its relation to the state of the art within Word and Music studies, as discussed in the Introduction. In the chapter Music Beyond the Senses it offers some novel arguments against definitions of music that would exclude musica textualis a priori; it defends a slight modification of the definition of music advanced by (Kania, 2011). Problematic cases of silent music are discussed extensively and the notion of intentional calibration – inspired by stances taken by Husserl, Ingarden, Iser, Wittgenstein, Wollheim, Scruton and others – is introduced. The second part consists of three chapters consecrated to three Polish authors (Iwaszkiewicz, Libera, Bartnicki) whose work is interpreted as displaying three radically different modes of musica textualis. This choice, by no means exhaustive, is intended to illustrate the introduced concept at work in dissimilar cases, sharing though one property: all have been paid little or no attention by the international musico-literary scholarship (not to mention the philosophers of music). The third and conclusive part shows musica textualis as a genuine aporetic field.

The fact of racial injustice in the US presents the difficult question of which emotional responses are (conceptually) appropriate to the perpetration of that injustice. Given that our answer must be informed by the nature of the injustice, this paper takes up Christopher Lebron’s diagnosis of the persistence of racial injustice against blacks in the US as a problem of social value in order to analyze a candidate response on the part of black americans. If Lebron’s theory accurately describes the problem, then it seems that anger appropriately responds to the injustice. The paper’s aim, then, is to give a positive account of black anger in response to the problem of social value. The account is informed by an analysis of “angry black literature,” i.e. a selection of essays from W. E. B. Du Bois, James Baldwin, and Audre Lorde. Approaching the subject within the framework of analytic philosophy, the paper concludes that anger is appropriate in virtue of its being a response to specific moral failures, and further notes that anger offers the ameliorative benefit of pointing out where those failures have taken place, and how we can avoid them in the future.

Resumen
With the help of Kant’s Critique of Pure Reason this paper aims to investigate the very possibility of philosophical reflection. Starting from a reading of two Eugen Fink texts, a phenomenologically discovered question is posed and a critical response attempted. It will be shown how, by orienting itself upon the subjective feeling of reason’s demand for the unconditioned, critical thought is then able to restrict itself to a valid use of reason, thus securing its own possibility. The transcendental methodology employed by Kant and the concept of pure apperception will also be discussed as key components in the facilitation of philosophical reflection. The Kantian response offered here is largely centred around the concept of transcendental illusion as discussed in the ‘Transcendental Dialectic’ and by taking related concepts such as transcendental reflection into consideration it is subsequently shown that, despite being raised here phenomenologically, the question of philosophical reflection is very much of interest to critical thought.

Resumen
This thesis articulates a new account of political morality by developing a novel critique of the standard dirty hands (DH) thesis and a new interpretation of DH. Taking its cue from Machiavelli the DH thesis postulates that the possibility of harmony between morality and politics is unsatisfactorily idealistic. This thesis endorses Machiavelli's contention, but argues that the DH thesis misconstrues Machiavelli’s insights: it fails to live up to its capacity to capture the complexity of political ethics and collapses into the idealism it seeks to evade. The DH thesis is inadequately ‘static’: it conceives the conflict between morality and politics as a momentary paradox of action - an anomaly disrupting the normality of harmony. As such it misconceives both the extent and the nature of the rupture between morality and politics. For, Machiavelli does not say that one must merely ‘learn how not to act well’. Machiavelli is clear that ‘one must learn how not to be good’. By exploring this discrepancy, I demonstrate that the DH thesis’ overemphasis on action ignores the way moral character enters and jeopardizes politics. I then develop a dynamic account that captures DH in all its complexity. The key insight of that account is that approaching political ethics entails conceiving politics as a practice and a way of life. In short, DH involves a conflict between two incompatible ways of life, each with its own virtues and standards of excellence. Hence, the dynamic account captures a more crucial paradox, the paradox of character: virtuous politicians should become partially vicious and no longer innocent. The thesis then argues that the dynamic account has crucial implications for contemporary politics: democratic politicians operate in a context of perpetual conflict and dependence which renders the cultivation and exhibition of certain moral vices, including hypocrisy and compromise, necessary.

Resumen
In this thesis I define and defend the philosophy of critical philosophical anarchism and show it to be superior to alternative (anarchist and non-anarchist) approaches to the problem of justification of political institutions. In general I argue that the anarchist position within the contemporary debate on political obligation has been dismissed too easily and that the value of an anarchist approach to an understanding of (and solution to) the problem of political authority is underestimated in current thought. In particular, my thesis sets out and defends the critical philosophical anarchist approach to the problem of political obligation and contrasts this approach with traditional treatments of the problem. I advance a clearer statement of the critical philosophical anarchist position than those currently available and demonstrate the continued value of taking an anarchist approach to the problem of political authority. This thesis has seven chapters. In the introductory chapter I set out the basic problem of political obligation and the anarchist position I want to defend. The first chapter presents the main aspects of the central problem and the main argument for its solution to be developed in the following chapters. Chapter two provides an analysis and restatement of anarchist arguments against consent and contract theories of political obligation. Chapter three offers considerations against a natural duty theory of political obligation. Chapter four addresses a reciprocity-based theory of political obligation, to wit: the principle of fairness as formulated by Hart and Rawls. The fifth chapter provides a general illustration of the distinctive contribution of critical philosophical anarchism to the problem of political authority. It develops the argument set out in chapter one and references to that argument in the preceding critical chapters on alternative approaches to the problem of political obligation. In the concluding chapter I tie together my argument for critical philosophical anarchism, as developed over the course of the thesis, and set out the main aims of an anarchist approach to society in light of this discussion.

Problem Solving practices are problematized in this research in the form of a “tessiture” . They are articulated around an analytical study on the subject of Problem Solving and its philosophical tenants. Considering the lack of conceptual understanding of the theoretical - philosophical presuppositions that bear on practices in Problem Solving, we aim to carry out an analytical study of the discourses th at permeate, engender and potentiate elements as: practices , theories, theorizations and other discourses on Problem Solving both on the national and international scene , besides running them . In order to do so, we proceeded to Michel Foucault’s discourse analysis based on archaeogenealogy, as a tool box, to compose an analysis with the corpus of this research, which consists of interviews, questionnaires, articles, books, theses, dissertations and other academic materials. A guiding question to be addressed in this “ tessiture” is: How and which philosophical presuppositions work or running discourses present in the researches in Problem Solving? As well as its implications on discursive practices related to the theme. Thus, we observe that there are moments, movements, practices and discourses that have a theoretical foundation very consistent with the philosophical tenants that support them. On the other hand, there are those who do not have credible concerns with theory, residing in praxis as the structuring axis of their practices in Problem Solving. There are situations in which Problem Solving fits into the aegis of a methodology . In another scenario , it can be conceived as something broader and more complex, which aims to deal with problematic fields, elements and concepts such as subject, mathematical objects, pedagogy, mathematical knowledge, society, didactics, finally, a range of subjects can be worked from this perspective, approaching it of a Philosophy of Mathematics Education. This allows us to infer, in some way, that in order to understand Problem Solving with its principles, bases and proposals for research, educational and educative practice , it is extremely necessary to understand its theoretical presuppositions, because that will give the tone of something restricted or broad, a methodology or a philosophy. However, such a conception will always be local and regional, being validated and legitimized by the community that practices it.

Resumen
This essay proposes that theology and philosophy are not mutually exclusive or at odds with one another methodologically, but in fact that religious categories are useful in philosophical analyses, and particularly when it comes to ethics. In this essay, I examine the theological concept of sin as it is expressed in Latin American Liberation Theology (over and against the more traditional understanding of sin in Western Christianity) as the domination of the Other and the oppression of the poor through geo-political systems of power. I explore the responses to this notion from the Magisterium of the Roman Catholic Church, as well as my own critiques in terms of theoretical integrity with particular regard to claims of universalism. The essay then proceeds into a synthesis of these criticisms through the work of Josiah Royce on Community and Loyalty in

Resumen
This thesis will partly compare the approaches of two pioneers in Islamic philosophy to the soul-body problem: the philosophical psychology of Mulla Sadra (Sadr al-Muta'allihin Shirazi 975-1050/1571-1640) and that of Ibn Sina (370-428/980-1037). Our main concern will be with the former, the founder of "trancendent theosophy", particularly his ideas regarding the corporeal generation of the soul.
A brief historical background of the problem is presented in the first chapter. In order to evaluate the real philosophical value of Mulla Sadra's doctrine, the thesis will investigate the soundness of Mulla Sadra's novel psychological findings. "Substantial motion" (al-harakah al-jawhariyyah) and the "gradation of existence" (al-tashkik fi maratib al-wujud) are the two main philosophical principles formulated and implied by our philosopher regarding the elaboration of his theory on the soul's developmental process.
In our study, we discuss the nature of the soul-body relationship, the evidence which indicates their mutual interaction, and finally, the various forms of this relationship. In the final chapter, we focus on the developmental process of the soul's substantial motion up to the stage of union with the active intellect. Our analytical discussion is centered on whether or not the theory of the corporeality of the soul's generation yields a meaningful conception of the soul's evolution from materiality to immateriality.
Considering the serious challenges and unsolved difficulties that still remain, it is an open question whether Sadra's theory, particularly its emphasis on the corporeality of the soul's generation, can adequately account for the soul's developmental process up to the stage of unity with the world of intellects.

This dissertation addresses the endemic problem of unity that Psychology goes through from birth as modern science to the present day. This problem can be characterized by a lack of consensus regarding the ontological, epistemological and methodological assumptions adopted by different psychological approaches, and the growing fragmentation of the field in various completely different theories and practices. Within this broader theme, it has the specific purpose of being a description and critical analysis of how this problem is being addressed by brazilian theorists in Psychology. Here we are going to map the debate and describe the basic aspects that characterize the discussion of the unit problem in the national literature in order to subsequently evaluate it and discuss it. Lastly, it was concluded that the brazilian production is characterized by three main features: hegemonic presence of what we call theoreticians of dispersion (set of theoreticians that evaluate the dispersion of the Psychological field as irremediable and its unification impossible, adopting a skeptical strategy or positive valuation), the lack of systematic in the argumentation of the theme and poor institutional development. Regarding the theses and the arguments of these theoreticians to support their thesis and positions, we concluded that these are mostly philosophically inconsistent and under no circumstances they hinder a possible unification of Psychology, or even less, definitely settle the subject.

Resumen
Thesis (MA)--Stellenbosch University, 2013.
ENGLISH ABSTRACT: In this thesis, the South African legal system's attempt to address sexual violence is explored through the lens of the work of the French feminist philosopher, Luce Irigaray. It will be argued that the South African equality jurisprudence lays the foundation for a strongly Irigarayan approach to the transformation of sex and gender relations in so far as our right to equality can be interpreted as being underpinned by an acknowledgment of embodiment, sexual particularity and difference. Our Constitution envisions equality as a value informed by difference rather than sameness and, in accordance with Irigaray’s work, it can be said that the implication of this is that the pursuit of the transformation of sex and gender relations on the one hand, and an acknowledgment of sexual difference on the other, are not mutually exclusive, but that sex equality instead calls for a fundamental recognition of sexual difference and an authentic response to the demands thereof. However, it will be argued that our newly reformed sexual violence legislation undermines the progress made on a constitutional level by entrenching a problematic approach to sexual difference in the definition of the crime of rape. This is done through firstly, defining the crime of rape in gender-neutral terms and secondly, retaining the concept of consent as the distinguishing characteristic between sex and rape. I will argue that through these features, our sexual violence legislation reflects the most basic mistakes that Irigaray identifies with the law. It will be argued that the legislation, on the one hand, denies sexual difference in a way that is prejudicial to women through its gender-neutral language, while at the same time, through the concept of consent, (re-)introducing a hierarchical construction of masculine and feminine sexuality into the Act in terms of which femininity is construed as derivative of, and inferior to, masculinity. Furthermore, the combination of the gender neutrality of the definition and the concept of consent exacerbates the situation, in so far as the gender neutrality masks the harmful construal of sexual difference that is incorporated in the definition through the concept of consent. Accordingly, judged from an Irigarayan perspective, the South African sexual violence legislation is deeply problematic. In addition, the legislation undercuts important constitutional developments, in so far as it ignores the constitutional insights that, firstly, sexual violence is a problem of sex inequality, and that secondly, the pursuit of the transformation of sex and gender relations is served, rather than undercut by a concern with particularities. On this basis, it is argued that the South African sexual violence legislation should be amended so that the concept of consent is removed and the crime of rape is defined in sex-specific language (while still allowing for male victims and female perpetrators) that facilitates judicial understanding of the complexities of the crime of rape.

Jean-Paul Sartre is not traditionally thought of as a philosopher of the body and, until very recently, little critical attention has been paid to this aspect of his work. Nevertheless, since 2005 a number of articles have begun to appear which suggest that Sartre‘s account of the body in L’Être et le Néant may be worthy of more consideration than it has thus far received – perhaps most notably Joseph Catalano‘s 2005 article suggesting that the chapter on the body is central to a proper understanding of Sartre‘s philosophy. Simone de Beauvoir is often criticised for her writing on the body in Le Deuxième Sexe, with much of the criticism suggesting that Beauvoir‘s use of existential philosophy is to blame for her failings. Yet Toril Moi argues that Beauvoir‘s claim that the body is a situation, a claim that arises from existential philosophy, is a valuable contribution to feminism. In light of these developments, it seems pertinent to look again at Sartre‘s chapter on the body in L’Être et le Néant and at Beauvoir‘s work to try to understand exactly what is meant by the body as a situation and how this concept relates to Sartre and Beauvoir‘s well-known ideas on freedom and responsibility. The aim of this thesis is to examine the importance of the chapter on the body in L’Être et le Néant and to demonstrate its relevance to Sartre‘s philosophy as a whole, to look at how Beauvoir has used Sartre‘s philosophy in her own writing and to consider the relevance of that philosophy to more contemporary writing on the body. The thesis will focus on L’Être et le Néant, Le Deuxième Sexe, and La Vieillesse with references also made to both authors‘ fictional works, to Beauvoir‘s autobiographical writings, and to more contemporary work on the body.

Resumen
The United Nation’s mandate to engineer international peacecraft is correlated with the promotion of universal human rights. Universal human rights are held to apply consistently to everyone everywhere without conceivable exception. There is some debate as to whether universal human rights possibly exist. This debate centers around two difficulties: 1) the task of identifying a single trait or capability that all human beings necessarily share, and 2) the task of relating human rights to this trait or capability. Conventional epistemic justifications defending the existence of universal human rights attempt to address both difficulties. However, they have become the focus of numerous criticisms. By conducting systematizing and critically reviewing text analyses, I will conclude that conventional epistemic justifications are unable to refute standard criticisms satisfactorily. In their place, I will introduce an epistemic justification from the philosophy of mind. I will attempt to demonstrate that this justification is capable of 1) identifying a single trait that all human beings necessarily share, 2) relating human rights to this trait, and 3) satisfactorily refuting the standard criticisms raised against conventional epistemic theories. I have produced this paper in the hope of further legitimizing the UN’s mandate to engineer international peacecraft by providing a more philosophically optimal justification of claims affirming the existence of universal human rights.

This thesis has as its goal to study the problem of evil through literature with the aid of the literary philosophical hermeneutics. In order to develop this theme, in first place, we seek to localize this study within the religion studies. We propose that hermeneutics can be a mediator among philosophy, theology, religion studies, and their respective approaches to religion. Next, we present exemplary how the discussions of philosophy, theology, and religion studies occur inside literature. We show also, briefly, how the problem of evil is placed as a theme of interest for philosophy and theology. At the end of this part, we present C. S. Lewis, the author whose work Out of the Silent Planet is the object of our study, and we expose the methodology of this thesis. In the second chapter, we discuss panoramically the problem of evil in philosophy and theology. Then, we present a panel with the major studies that examine the interface between the problem of evil and the works of C. S. Lewis. At the end of the chapter, we list the main categories/aspects of the problem of evil which are articulated in the apologetic approach of Lewis in The Problem of Pain, and that echoes in the fictional narrative of our object of study. The main categories/aspects of the problem of evil, which relate to the first volume of the Space Trilogy are: divine omnipotence, the fall of man, the human pain and the animal pain. In order to study the problem of evil in the literature, we seek in the literary philosophical hermeneutics of Paul Ricoeur a model of analysis. We abstract from the work Time and Narrative the Ricoeurian triple mímesis as an itinerary for the study of Out of the Silent Planet. At last, we apply the resulting model to the analysis of the first volume of the C. S. Lewis’s Space Trilogy. In mímesis I, we study the fiction environment and the characters of the story. In mímesis II, we locate the chapter in the work where the narrative can be seen as a whole. Then, we describe how the categories/aspects of the problem of evil are articulated in this part of Out of the Silent Planet, we verify how the narrative shares elements of the literature body of the time in which it was produced, and how it breaks from this tradition. In mímesis III, we approach the values and the ethical practical implications that can be verified in the reading of the book. C. S. Lewis proposes in his narrative a theodicy from a theist Christian standpoint, using fiction to transmit his way of understanding the problem of evil and its implications.
No final da primeira parte, introduzimos C. S. Lewis, o autor cuja a obra Além do planeta silencioso é o objeto do nosso estudo e expomos a metodologia dessa dissertação.

This dissertation, "A pilot in his ship". The study of the union of soul and body as the fundamental problem of modernity (from Rene Descartes to Jean-Luc Nancy), aims to offer the current state of the question of the philosophical problem of the union between the soul and the body considered as a fundamental problem of modernity. In order to achieve this objective we have formulated the following hypothesis: All Modern thought is essentially the attempt to restore, ground, or reformulate the union of soul and body. The perplexity of the trust of the human body within the present thought and the meeting of the philosophy of Jean-Luc Nancy, leads me us to formulate the hypothesis of my our work, which is already outlined in Heidegger. In both cases, we find a critique of the thought of subjectivity that is confined to the more general problem of the union of soul and body. This problem that inaugurates Descartes, conforms the development of the modern thought, but according to Nancy, not from a traditional conception. Constant attempts to solve the problem of the union of soul and body are due to the forgetting of its foundation as a problem of excessive joining rather than as an unequal substantial relationship. After analysing the subject of the union of the soul and the body in the work of Descartes, we can verify that the problem of the union of the soul and the body is fundamentally due on the one hand, to the theologization of Cartesian philosophy, and on the other hand due to a partial conception of Idealism. The problem of this union becomes recalcitrant and the solution, in the late nineteenth century and during the twentieth century, establishes the point of gravity in the discourses on the . body. From this perspective they are presented to Schopenhauer, Nietzsche and Merleau-Ponty. Finally, the analysis of Nancy's proposal leads us to think the body from another metaphysical perspective that is able to take care of the problem without seeking the restitution of the union, but facing it from its own dislocated and convulsive "nature".

The study focused on the Lecture of Fundamental Philosophical Problems created and taught by Lao Sze Kwang in Philosophy Department, Huafan University, to explore the philosophical horizon reflected in the course. Although Prof. Lao’s theories are beyond the system theory, and it’s unnecessary to build a closed system for his theories, the theoretical structure and the evolution are systematic. The study explored Prof. Lao’s interest from the perspective of his Original Problem Research Method. The author believed that his philosophical care is stable which focuses on the Philosophical and Cultural Crisis although he faces different philosophical topics in different phases. On the course of Lecture of Fundamental Philosophical Problems, Prof. Lao focuses on the Philosophical Reflection on Thinking and its open character, as well as the critical, reconstruction and integration functions to show how the philosophy under such a definition deals with the common problems from the macro views of culture and philosophy, and thus hold the philosophical activities. Prof. Lao expects to arouse our critical and reflection abilities through the course. As philosophy is a kind of Task, we have to deal with the cultural and philosophical problems in the cultural and The world of meaning where we are living.

Resumen
Many of Plautus' extant plays contain identity problems, the results of comic confusions in identity. The confusion may arise from deliberate deceit through impersonation, or from mistaken identity through ignorance. While mistaken identity features in many Plautine plays, these identity problems are usually brief comical complications arising from the machinations of a crafty slave or from a twist of fate. However, the Captiui, Menaechmi and Amphitruo all contain pervasive identity problems which are complicated and extend throughout the play. Further, all three plays present an unusual identity problem which provides strong contrast to the conventional Plautine problems including the ineligible girl later being found to be of free birth and now available for marriage, or the son and his slave successfully obtaining money from the son's father by trickery and impersonation. On closer examination, it is apparent that in each of these three plays Plautus has explored these identity issues and used them as a vehicle to highlight other significant social and moral issues. In Captiui, the young man who should be eligible for marriage is instead found to be the slave of his own father who has unwittingly mistreated him. In Menaechmi, two identical twin brothers, separated as young boys, who are coincidentally in the same foreign town at the same time and are repeatedly mistaken for one another, with far-reaching consequences. In Amphitruo, two mortals are impersonated by two gods, with identity theft and depersonalisation occurring. In all three plays, the identity problems form an integral part of the play and are explored extensively by Plautus. This dissertation examines the concepts of personal identity as exploited by Plautus in these three plays in the light of concepts of personal identity and the self as found in the works of ancient and modern philosophers, and of contemporary psychologists and sociologists.

Badenhorst, Marthinus Johannes. "A critical appraisal of the problems and prospects of theological non-realism". Thesis, 2007. http://hdl.handle.net/10500/3111.

Texto completo
Resumen
This study in philosophical-theology investigates the problems and prospects of theological non-realism, as proposed and developed by the Cambridge philosopher of religion Don Cupitt. After contextualising non-realism within the worldview, epistemology and theology of pre-modernity, modernity and postmodernity, the study appraises the prospects of non-realism as a new philosophical and theologica default position for Christianity and how it relates to what has been referred to as the New Reformation. The study hypothesises and contends that, although radical in orientation and multifarious in prospect, it is a viable and valid basis for Christian reformation. After contextualising, considering some religious and theological content, as well as critique and contrapuntal positions, the study delineates theoretical and practical reformatory options. By and large concurring with Cupitt, the study also deviates from him, particularly with respect to the prospect of ecclesiastical post-Christianity. Although this is not a study in practical theology, this study nevertheless aims to move the debate about the New Reformation forward by proposing non-realism as a basis for a new Church

Olatunji, Cyril-Mary Pius. "A philosophical inquiry into the problem of democracy in Africa". Thesis, 2011. http://hdl.handle.net/10530/591.

Texto completo
Resumen
Submitted to the Faculty of Arts in fulfilment of the requirements for the degree of Doctor of Philosophy in the Department of Philosophy at the University of Zululand, 2011.
The study acknowledges that there have been attempts by scholars of African politics to explain the problems impeding the smooth running and consolidation of democracy in Africa. The acknowledgement of these previous efforts notwithstanding, the thesis sets out to show the value of a philosophical reaction to the positions of scholars on the issue, as a shift towards a better approach to it. It makes an examination, which exposes the inadequacy of the previous approach to the explanation of the problems militating against the democratic project in Africa. The thesis is not therapeutic. It is primarily diagnostic. Therefore, it did not set out to prescribe some procedural steps to change the ailing political system in Africa. Rather, it has identified the shortcomings of previous approaches to the problem of democracy in Africa, which, has portrayed Africans as mere effects of causes, and incapable of taking control of their own life situations. In the analysis, the scholars had argued that the unstable state of democracy in Africa has been caused by some internal and external factors. That is, by implication, Africa has been caused to be what it is. This study rejects the causal model of explanation taken uncritically from the Newtonian physics by the scholars of African politics in their explanations of the political challenges of Africa. This study argues that by applying the causal explanation, the scholars have implied that Africa is not more than a mere effect of causes, and therefore, incapable of a self-motivated and a free action. They have also implied that their own analyses were either caused or false Consequently, the study proposes that any reliable explanation of the problems militating against the democratic project in Africa must be non-causal in structure. That is, an explanation in which my explanations, as an African, are my own wilful actions. By so doing, the study has initiated a new consciousness of who I am as an African. It initiated the consciousness of the fact that such factors as colonialism and corrupt leadership in Africa may have had serious influences on the trajectory of my own history as an Africa, but they do not determine my situation in the deterministic cause and effect relation in the manner in which the scholars intended.
