Texto completoThe estate distribution established by the articles 1075 s. of the civil code enables a disposer to anticipate the distribution of his inheritance between the heirs apparent. During the next two centuries which followed the codification, this ability was reserved to the only ascendants in favor of their descendants. The law of the 23rd June 2006 had the effect that it was no longer limited to the direct descending line. This opening was the result of a progressive evolution of the act, which was established all along the twentieth century in order to respond to the blockings arising from the different interpretations developed during the nineteenth century. The hybridity of the ascendants’ estate distribution, situated at the confluence of inheritance and liberalities, is an established fact. As well as a medal has an obverse and reverse side, the ascendants’ estate distribution consists of a distributive element and an attributive element. The inseparable union of these two elements gives the estate distribution established by the article 1075 s. its identity. As inseparable and constituent the obverse and reverse side might be, they are yet never perceived simultaneously, even though the reverse side is generally described by its relation with the obverse: It is the opposite of the one presented as the principal, it is the supporting side of the second listing. All the interest in a historical approach to the articles 1075 s. consist of bringing to light the way the distributive element evolved into becoming the obverse of our institution leading to a notable change of the nature of these estate distributions which nevertheless remain dual acts

Texto completoChallenging the social and cultural hierarchies which are still authoritative in our contemporary Western societies has been a long-lasting concern of Cultural Studies ever since their development in the 1960s. As evidenced by the great amount of novels set in the fictional world of the Trojan War, which prove themselves to be genuine rewritings of the Iliad narrative, the Western canon and its relevance are equally scrutinized by contemporary novelists. By studying the dynamic conflicts which underlie the encounter between epic discourse and the genre of the novel, this dissertation intends to dispute the concept of a “Great Divide” between artistic and popular culture, and to prove that literature is a transcultural medium. A close study of a few contemporary novelisations of the Iliad brings to light existing shared narrative techniques and discourses undermining the legitimacy of the Western canon. Through the remodeling of the epic genre and its conventions, the novel assumes a democratic approach to society which stems from a narrative architecture hinging on a multiplicity of generic discourses and cultural references

Texto completoThis work tries to contribute to the research of a complex problem: how to study image today, and how to think its sharing. To elaborate an answer to this question, the problem was situated in a discussion about the representation and put in a connection with a triple questioning - ontological, axiological and epistemological - of the sharing of the visible, which is understood as one of the problems of the contemporary political philosophy. The method, which is used, consists to analyze the statements (texts explaining the legitimately visible images) and the visibilities (images chosen as appropriate illustrations of the textes) in the field of the archive. The study of a particular case - that consists to analyze a double official mode of working with documentary photographs taken during the period of normalisation in slovakia - reveals the fact that nor during the period of the authoritative regime of normalisation, neither during the contemporary period so called democratic, the legitimate sharing of the visible is possible without fixing certain esthetic norms which function as political limits of the vision: no sharing of the being, of the values and of the knowledge by means the image is possible without intervention of speaking and without production of representations

Among the means available, the shared gift that notaries are the strongest advocates is the keystone on which it customary to build the architecture of an early successful transmission. Located at the crossroads of the right of the donations and estates, inter vivos gift is traditional, the affair of the notary. Not only of man contract and sole practitioner entitled to receive a deed, his unquestionable competence in this area, actually trusted advisor families. Who would know better, in fact, that the notary keeper of the institution, prepare the transfer of wealth expected to give it a scope, human, legal, fiscal and economic optimum. But in this art, the technical difficulties are many. First, the path of the optimum legal and tax is strewn with many obstacles, it is not always easy to defeat, or even identify. The legislature has not provided any "instructions" to do so. Second, although recent reforms, and particularly that of 23 June 2006, notaries have offered many opportunities to achieve a transmission line with the wishes of the French, they do not carry less implementation difficulties or dangers, sometimes causing the disaffection with the mechanisms put in place. It is this observation from practice, that the idea to dedicate this study to the practice of gift-sharing in its civil and fiscal dimensions. Texto completoThe dissertation investigates both the effects of the idea and knowledge sharing forums and blogs, which foster the formation process of young readers’ literary competence, and the conditions which favor or limit these effects. This general problem has two complementary sides:- the existence of questioning about the reading skills manifested in social practices of the idea exchanging among readers but usually ignored to be implemented;- a question on skill maintenance through the reflection of the read texts by combining online work and face-to-face.To be able to form a sound opinion around these questions, we are examining a non-academic forum of teenagers as well as various hybrid teaching devices, designed and implemented by 10 high school teachers based in Île-de-France in socially varied institutions.The dissertation, taking into account the ethnomethodological approach that carefully examines the social and didactic contexts specific to each studied case, pursues three interdependent objectives. It is a question of specifying the processes by which the reader conducts an imaginarily and emotionally involved reading to distinguish the specifications of the different uses of the forums and reader blogs and to find out what maintains or inhibits the interpretative work under certain circumstances.We first propose a theoretical model of intelligibility of the output collected. Secondly, we analyze teenage readers’ idea exchanging forum to distinguish the specifications of this field and thus contributes to a better understanding of the transposition of social practices at school. Thirdly, we evaluate the effects of various school uses of forums and reader blogs on interpretive work.Three hypotheses were examined in the dissertation. On the non-academic forum of adolescent readers, we conjectured the expression of interpretative reading skills unknown or unnoticed in school context. Concerning hybrid teaching practices, on one hand we have been waiting for the maintenance of the involved and critical reading work in the digital spaces and on the other hand, in face-to-face feedbacks and on asynchronous writings. The strengths and limitations of the studied situations lead to recomendations for the implementation of hybrid approach and hereby for the training of teachers

So, If not because of the allegedly absolute right to property, at least because of its rank in the hierarchy of real rights, the right to division is contrary to any acceptance by the entitled (of the proceedings) on undesired modalities. This is equality in partition in the full sense of the word – a synonym, here, of economic neutrality of the operation. The relations between equality and partition go beyond the notion of equality as understood in partition proper. Equality, indeed, is not solely the criterium and imperative for the partition, it is also the cause and, at times, even, the mobile. It may happen that partitioning is made because a certain kind of equality is desired. In these cases, equality has not its goal limited in bringing about a partition; but partition finds its cause in equality. It can, thus, be said that partitioning sums up both the efficacy of the right to property and the enforcement of a principle of equality that far exceeds its legal technique. It is clear, indeed, that the partition can’t be reduced to the sole effectiveness of a necessarily accumulative operation. It helps acknowledge, within, the private law and the patrimonial family law, in particular, that aspiration for equality that far transcends legal procedures. In that sense, the partition agreement must not be regarded solely as a necessarily egalitarian contract; it entails that equality itself be a contract. Texto completoData from both individuals and companies is increasingly aggregated and analysed to provide new and improved services. There is a corresponding research effort to enable processing of such data in a secure and privacy preserving way, in line with the increasing public concerns and more stringent regulatory requirements for the protection of such data. Secure Multi-Party Computation (MPC) and secret sharing are mechanisms that can enable both secure distribution and computations on private data. In this thesis, we address the inefficiencies of these mechanisms by utilising results from a theoretically related rich area, erasure codes. We derive links between erasure codes and secret sharing, and use Maximum Distance Separable (MDS) codes as a basis to provide real-time applications relying on private user's data, revealing this data only to the selected group (which can be empty). The thesis has three contributions. A new class of erasure code called on-the-fly coding, have been introduced for their improvements in terms of recovery delay and achievable capacity. However little is known about the complexity of the systematic and non-systematic variants of this code, notably for live multicast transmission of multimedia content which is their ideal use case. The evaluation of both variants demonstrate that the systematic code outperforms the non-systematic one in regard to both the buffer sizes and the computation complexity. Then, we propose a new Layered secret sharing scheme and its application to Online Social Network (OSN). In current OSN, access to the user's profile information is managed by the service provider based on a limited set of rules. The proposed scheme enables automated profile sharing in OSN's groups with fine grained privacy control, via a multi-secret sharing scheme comprising of layered shares, without relying on a trusted third party. We evaluate the security of the scheme and the resulting profile's level of protection in an OSN scenario. Finally, after showing that erasure codes are efficient for real-time applications and that the security offered by secret sharing schemes can be applied to real-case applications, we derive the theoretical links between MDS codes and secret sharing to enable the implementation of efficient secret sharing scheme built from MDS codes. To illustrate this efficiency, we implement two of these schemes and evaluate their benefits in regard to computation and communication costs in an MPC application

By using two non-comprative examples, the importance of the demographic factor in the success of inheritance strategies is shown. Not all children had equal chances : in Barisey-la-Côte it was often the heir whose date of marriage was the closest to the auction sale or the donation. This closest-to-marriage rule was more to a son's advantage than to a daughter's. However it was the eldest children who perpetuated the families and it was preferably the youngest who received the house. Demography had an influence on how the ownership of a house was shared. In Bisping, where the demographic pressure was strong until the end of the ninetennth century, the market was made to invest within built property; in Barisy-la-Côte a demographic situation more favourable to multi-ownership meant sharing out amongst szveral members of the same family over one generation

Texto completoThe medical professional secret is a legal exception to the professional secret; it allows a patient's caregivers to exchange health information that is relevant to that patient's care without being punished for revealing confidential information. That caregivers discuss patient's health information with other medical professional involved in that patient's care is to the benefit of the patient. Nonetheless, there is a fine balance to be struck between a "need to know" professional exchange of information, which is essential to care of the patient, and a broad exchange of information, which may ultimately comprise the confidentiality of the patient's private life. The emergence of an electronic tool, which multiplies the potential possibilities for data exchange, further disrupts this balance. Consequently, the manipulation of this shared health information must be subject to the medical professional secret, the "Informatique et Libertés" legislation, and all of the numerous norms and standards as defined by the French national electronic medical record (DMP), the pharmaceutical medical record (Dossier pharmaceutique), or the reimbursement repository (Historique des remboursements). As the patient's health information is increasingly shared between health care providers - through means such as the DMP or DP - the patient's right and ability to control the access to his/her health information have to become more and more important. Texto completoL'argumentation est développée en trois parties. La première partie du mémoire est consacrée, pour l'essentiel, à la présentation de ma posture épistémique. Revendiquer une telle posture suppose, au minimum, une théorie de la discipline. Je développe cette théorie dans cette première partie, en défendant l'idée que l'anthropologie générale a un objet qui lui est propre : le partage. Du même coup, je dissipe mon doute épistémologique. Je le fais en répondant à la question suivante : quelle est la raison d'être de l'anthropologie ? Je soutiens qu'elle a vocation à expliciter les circonstances au premier abord toujours mystérieuses qui font que le lien social se noue (ou se dénoue) entre des individus, permettant alors l'émergence d'une culture, d'une société ou, plus modestement, de tel ou tel phénomène culturel. Ce moment-là, c'est celui du partage.
Après la prise de position théorique qui est l'objet de toute la première partie, c'est à l'ontologie et à l'épistémologie de l'objet de l'anthropologie générale, à ce qu'il est et à ce qu'on peut en connaître, que sont consacrées les deux autres parties du mémoire. Dans la deuxième partie, intitulée Fictions du partage ?, je lève (partiellement) mon embarras méthodologique. En effet, en quatre chapitres, j'y précise la manière dont nous, anthropologues, travaillons sur notre objet : le partage. J'y décris à la fois la « fabrication » des concepts qui sont supposés en rendre compte (e.g., la « mémoire collective » , l' « identité culturelle », la « communauté », le « peuple », etc.) et leur utilisation dans le cadre d'une rhétorique du partage.
Dans la troisième et dernière partie, intitulée Partage des fictions, j'essaie de repérer quelques unes des conditions objectives et subjectives du partage, en m'appuyant principalement sur les hypothèses relatives au degré de pertinence des rhétoriques holistes. Quelques unes seulement, car j'ai délibérément exclu de mon propos des phénomènes aussi importants que la possession d'une langue ou d'une histoire commune par les membres d'un groupe. A ces chemins bien balisés et largement parcourus, j'ai préféré un itinéraire plus risqué, plus hasardeux, celui qui consiste à explorer les modalités de la cognition partagée. Ce type d'exercice pose nombre de problèmes, dont la plupart restent irrésolus. Ils ouvrent néanmoins des perspectives de recherche en anthropologie cognitive que je me contente d'évoquer à la fin de cette troisième partie.

Texto completoSpirituality is omnipresent in the public space. The different activities that promote it (meditation, retreats, etc.), the numerous books that explain it (written by the Dalai-Lama or Paolo Coello), the introduction of its vocabulary in the daily language (“stay Zen”), show that spirituality has its place in contemporary societies imaginary. However, spirituality does not have a clear definition. Few are the researches that try to understand the nature of spirituality, even less study its signification for those who live it. Its popularity among youth is significant, since it encourages its installation in the contemporary imaginary. In this thesis, we first study university students’ definition of spirituality, their daily experience of it and its influence on the way they understand their place in society. We have interviewed 31 university students of different faculties in three different societies (Quebec, France, Israel). Our results show that spirituality is viewed as a personal and individual quest of meaning: its nine components will be examined. We then study the part that spiritual practices play in their daily lives. Finally, we describe the way spirituality affects the students’ social and family interactions, their personal future and their society. Indeed, it is because spirituality is shared and no longer a solitary experience, that it becomes the essence of today’s communities. It also proposes a possible response to the search of meaning that touches more and more contemporary societies.

Texto completoThe rapid evolution of multimedia and communications technologies is emerging in the healthcare field by providing new means of sharing and remote access to patient data. This plays an important role in daily medical practice since it facilitates the care of patients and improves the management of medical information. In this context, the issue of data security is particularly sensitive, in terms of integrity, authenticity and traceability. Nowadays, the most existing security mechanisms, such as cryptographic techniques and access control, provide protection to prevent unauthorized users from accessing data content; images in ours case. However, they offer only an "a priori" protection; which means that the image is only protected before the access to its content is given. Digital watermarking has been proposed as a safety mechanism complementary to these "a priori" solutions. It provides a "posterior" protection, allowing the user to access the content of the image while keeping it protected by an imperceptible "mark". Indeed, in the case of images, the watermark modifies, or modulates, the pixels values in order to encode, or insert, a message (i.e. a mark). This message can be used to check the integrity of the image, its authenticity, or for traceability purposes. Because of the sensitivity of medical images content, imperceptibility is obviously the strongest constraint to consider for watermarking medical images. Indeed, changing the gray levels of the image may introduce a doubt about its validity.The research work carried out in this thesis falls within this context. The objective is to develop new watermarking methods, more appropriate to medical images, which preserve the quality of the image. We have proposed three original solutions, which take advantage of the acquisition noise inherent in radiographic images in order to mask a mark of the same power as the noise. In this manner, the image will be protected and the information, which is useful for the diagnosis, remains unchanged. The first solution aims to globally identify the noise in the image, based on denoising techniques. Afterwards, a mark is inserted, taken in consideration the noise distribution. Updating the mark in this solution may introduce new distortions. To overcome this problem, we have proposed a second solution, which improves our system by making it reversible. Moreover, the mark's extraction will be performed without any loss of data. Our third proposed solution relies on local noise modeling in radiographic images in the purpose of locally adapting the mark in the image. We are referring here to psychovisual masking. This type of watermarking was applied in the case of natural images only. A subjective validation protocol has been performed, in collaboration with radiologists, to study the impact of watermarking on the diagnostic quality of watermarked images

Texto completoThe advance of forests in the Middle Ages bordered on a disturbing nearness with wild animals which escaped our will of control, engendering inevitable conflicts of territory. These conflicts are at the origin of the classification of certain animal species in the category of “pests”. The most studied of them remain the big predators, wolf and bear in particular. Mustelids (weasel (Mustela nivalis), stone marten (Martes foina), marten (Martes martes), polecat (Mustela putorius) and American mink (Mustela mink)) may be more discreet predators in size as in popularity, they remain not less strictly dependent on “breaths” of the human imagination there. Their night-customs and their furtive behavior are the compost on which the human perceptions grow and feed. Painting a portrait of this imperceptible scum, grouped by trappers under the collective word of “Sauvagine”, we commit a multidisciplinary reflection reconciling natural and human sciences and mixing several approaches : geography, anthropology, ecology and symbolism.The study of natural histories, associated with investigations with naturalists and with trappers in the countrysides of low mountain range of the southwest of Massif Central (Aveyron, Tarn and Tarn-et-Garonne), allows to comprehend better the evolution of the notion of “pests” and its perception by rural actors. Eternal “outlaws”, weasels frustrate our attempts to encircle them, to identify them and to assign them a territory perfectly different from ours. The originality of this work consists in an example-based approach bootstrapped by the participation of non-expert annotators through an appropriate interface. Seeking for a greater expressivity, such as observed in manual alignments, mainly motivates the whole approach. An important effort has been made to define a formal environment for this original architecture based on aligned examples. Several memories have been created using syntactic informations from parsers' outputs with reasonnable low-tech requirements. A couple of new alignment methods were compared with state-of-the-art measures and three transformational metrics were introduced

Event is one of the most important cues to recall people’s past memory. With the development of Web 2.0, many event-based information sharing sites are appearing online, and a wide variety of events are scheduled and described by several social online services. The study of the relation between social media and events could leverage the event domain knowledge and ontologies to formulate the raised problems, and it could also exploit multimodal features to mine the patterns deeply, hence gain better performance compared with some other methods. In this thesis, we study the problem of mining relations between events and social media data. There are mainly three problems that are well investigated. The first problem is event enrichment, in which we investigate how to leverage the social media to events illustration. The second problem is event discovery, which focuses on discovering event patterns from social media stream. We propose burst detection and topic model based methods to find events from the spatial and temporal labeled social media. The third problem is visual event modeling, which studies the problem of automatically collecting training samples to model the visualization of events. The solution of collecting both of the positive and negative samples is also derived from the analysis of social media context. Thanks to the approaches proposed in this thesis, the intrinsic relationship between social media and events are deeply investigated, which provides a way to explore and organize online medias effectively

This conjunction is a compelling callfor achieving, beyond the anecdotal or documentary report, a wider understanding of themateriality of acts, of their resistance to any reported lesson and, ultimately, to restesslyquestion their remainder.Furthermore, when grasping the social inclusion and exclusion as the result of cohesivenaturalization, of discrimination of natural abilities and inabilities, the actual testingof this solidarity reaches the core of the equalitarian question. Then, cynical acts draw theoutline which let consider the subjectivation within the constant withdrawal of the subjectfrom his normative or « police » assimilation. Irony relentlessly leaves its marks on this processby hiding the subject in the shadow of his acts, as the ploy of an identification to theincompetent nature of the excluded one. It is indeed by amplifying the exclusion’s naturalrepresentation, by giving it the biggest material density, that the cynicism subjectivationopens a gap between the belongings of included and excluded ones. And this gap, whichrelieves the author of any subjectivity, of the obligation to operate within the « police »regime of inequality, gives its place to the desire with no subject, that very one preciselypresupposed by the equality of subjects

Texto completoIn recent years, more and more users prefer to share their photos through image-sharing platforms. Most of platforms allow users to specify who can access to the images, it may result a feeling of safety and privacy. However, the privacy is not guaranteed, since at least the provider of platforms can clearly know the contents of any published images. According to some existing researches, encrypting images before publishing them, and only the authorised users who can decrypt the encrypted image. In this way, user’s privacy can be protected.There are three challenges when proposing an encryption algorithm for the images published on image-sharing platforms: the algorithm has to preserve image format (e.g. JPEG image) after encryption, the algorithm should be secure (i.e. the adversary cannot get any information of plaintext image from the encrypted image), and the algorithm has to be compatible with basic image processing in each platform. In this thesis, our main goal is to propose an encryption algorithm to protect JPEG image privacy on different image-sharing platforms and overcome the three challenges. We first propose an encryption algorithm which can meet the requirements of the first two points. We then implement this algorithm on several widely-used image-sharing platforms. However, the results show that it cannot recover the plaintext image with a high quality after downloading the image from Facebook, Instagram, Weibo and Wechat. Therefore, we add the correcting mechanism to improve this algorithm, which reduces the losses of image information during uploading the encrypted image on each platform and reconstruct the downloaded images with a high quality

Texto completoInspired by bruner's theoerical and enpirical fralmework, several studies have emphasizem the role of micro-format between the mother and the child for the construction of a shared topic during the first year. But how do dyads of youngopeers construct shared topics? ovr main hypothesis was that joint repeated experience in the same setting will have au positive effet on sharing topics duriong the period of language acquisition. The effect of a joint exoperience was tested during five successive ten minutes sevions with the same familiar partner and a sixth session with a new though faliliar partner. Sixteen thirty-monta-old children and sixteen forty two-old children metindyads without and adult presence and were vidertaped in an experimental setting located in their school. Each age group was divided in subgroups of four children matched on language level, age and gender. This provided sets of two similar duads and permitted an interchange oif partners on a sieth session. Results showed that joint experience permitted an increase of the duration on shared activities at forty two monthas but not at thirty months. Increasing sharing episodes promoted the development of shared verbal topics in forty two monthoud dghams. Rupture in the joint exoperience induced a signifilant increase of verbal conflicts at forty two months. Recurrence of topics was a main mechanism of sharing over the five sessions. One effect of the shared experience was the transition from concrete topics to symolic ones. Another effect was the construction of scripts for the oldest children

Texto completoVirtualization appears as a key solution to revolutionize the architecture of ossified networks, such as the Internet. By adding a layer of abstraction on top of the actual hardware, virtual networks can be managed and configured flexibly and independently. The flexibility introduced into the network provides the operator with options for topology reconfiguration, besides allowing it to play with the software stacks and protocols. Today, network virtualization has been realized in research testbeds, allowing researchers to experiment with routing. Introducing virtualization in a production network such as those of the Internet raises several challenges, in particular the performance and the sharing of the routing and switching resources. These are in particular relevant, when the network data plane is virtualized, for maximum isolation and configurability in virtual networks. Therefore, we first evaluate and analyze the impact of virtualization on the performance of virtual software routers. Then, for being able to virtualize the data plane in production networks, we propose a hardware architecture of a virtualized switch, enabling the differentiated sharing of resources such as the ports and the memory buffers. Moreover, we examine the possible applications of virtual networks and propose a service for virtual networks on demand with configurable routing and controlled bandwidth. We apply and evaluate this service in the context of virtual infrastructures

Texto completoIn this thesis, we address the problem of spectrum-sharing for wireless communication where multiple users attempt to access a common spectrum resource under mutual interference constraints. Our objective is to evaluate the gains of sharing by investigating different scenarios of spectrum access. Studying the Gaussian Interference Channel with interferences considered as noise, we found a geometrical description and several characteristics of the achievable rate region. Considering a more realistic scenario, with each user having a certain QoS, we found necessary and sufficient condition to be fulfilled for simultaneous communication over the two-user Gaussian Interference Channel. Furthermore, we proposed two lower bounds for a single-primary-user mean rate, depending on the secondary user power control scheme. Specially, we investigated an original power control policy, for a secondary user, under outage performance requirement for both users and partial knowledge of the channel state information. Finally, considering a spectrums-haring with a licensee or primary user and several secondary or cognitive users, we showed the existence of an exclusive region around the primary receiver and we characterized the effects of shadowing and path-loss on this exclusive region (or no-talk zone)
