Abuse of official position or authority is the commission of an illegal act committed in an official capacity that violates the performance of official duties. Officials who abuse their power are often corrupt. Misappropriation, abuse of trust, and fraud can take many forms. If carried out by an official, it often constitutes corruption. Abuse of power consists of using an official's authority to resolve issues that conflict with the interests of the service. Usually, for such "services," an official receives a certain reward for himself or another person. Abuse of duty means using powers related to the position held contrary to the interests of the service. In our country, as well as in other countries of the world, the phenomenon of abuse of office and corruption continues to be one of the main concerns, for which we need a strategy and laws aimed at preventing and combating this phenomenon. Our whole society is a victim when public officials violate the trust given to them.

Of all the issues facing the International Law Commission (ILC) in its work on the topic of “Immunity of State Officials from Foreign Criminal Jurisdiction,” how to define “act performed in an official capacity” is certainly one of the most difficult and important. If serious international crimes, like torture, are considered acts performed in an official capacity, then foreign officials responsible for such crimes may (unless an exception applies) be immune from criminal jurisdiction in other states for such acts even after they leave office.

Resumen
The immunities of high-rank officials regarding to the responsibility of serious crimes of international community concern are analysed in the present paper. Relevance of the topic is maintained in its consideration of the International Law Commission. Principle of the irrelevance of official capacity (Art. 7 IMT, Principle III of the Nuremberg principles, art. 27 Rome Statute of ICC) is universally recognized and has the character of jus cogens. We critically examine the state practice (Pinochet case, Georgia case). The international documents, Criminal Code of the Russian Federation and doctrine are analyzed. By virtue of the constitutional priority of universally recognized principles and norms of International law (Art. 15.4 Constitution), the provisions of the Criminal Code must be fixed in accordance with the Nuremberg principles. This concerns especially principle of irrelevance of official capacity. In case of conflict, the principle of interpretation in accordance with international law should be applied.

Abstract. Decision-making capacity (DMC) is a prerequisite for informed consent to medical treatments. However, little is known about the knowledge, attitudes, and evaluation of DMC among physicians in Croatia. A survey was conducted among 180 general practitioners and psychiatrists in Croatia. Although from a legal perspective DMC is a dichotomous concept, about 90% of physicians indicated that they understand DMC to be a gradual concept. A majority of physicians considered themselves responsible and qualified to conduct DMC evaluations, though some physicians considered themselves insufficiently qualified. General practitioners considered themselves less responsible and less qualified than psychiatrists. Almost all participants indicated that they would welcome official guidelines and training.

Background: Previous estimates of global palliative care development have not been based on official country data. Aim: The World Health Organization Noncommunicable Disease Country Capacity Survey of World Health Organization member state officials monitors countries’ capacities for the prevention and control of noncommunicable diseases. In 2015, for the first time, questions were included on a number of palliative care development metrics to generate baseline data for monitoring global palliative care development. Design: Participants were given instructions, a glossary of terms, and 3 months to complete this closed, non-randomized, online survey. Questions were developed through a consultative process with relevant technical World Health Organization departments. Setting/participants: Health ministry officials serving as noncommunicable disease focal points from 177 out of 194 (91%) of World Health Organization Member States completed the voluntary survey. Results: This survey reveals that (a) a minority (37%) of countries have an operational national policy for noncommunicable diseases that includes palliative care, (b) palliative care is least likely to have funding available compared with other core noncommunicable disease services, and (c) there is a large country-income gradient for palliative care funding, oral morphine availability, and integration of palliative care services at the primary levels of the health system. Conclusion: Palliative care for noncommunicable disease patients must be strengthened in a majority of countries. These data provide a baseline for trend measurement of official country-level and global palliative care development. A repeat assessment is taking place in the first half of 2017.

The study was developed in 2018 to know the organizational management regarding the Occupational Health and Safety Management System of the legally constituted companies of the dairy sector of the municipality of La Calera-Cundinamarca. Companies were identified from various databases, proceeding to conduct field observation and interviews with their legal representatives and officials of official entities. The investigation determined that microentrepreneurs do not have the capacity to implement such a system.

The article is prepared in continuation of development of author's dissertation researches. The paper reveals the peculiarities of objective and subjective features of cо-perpetration in torture (both on the basis of the provisions of the Criminal Code of Ukraine, and taking into account the provisions of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. When interpreting national criminal law norms in the light of convention provisions, the requirements of two-frame criminal law research are met. The authors' positions are supported by message from human rights organizations, decisions of the European Court of Human Rights, and theoretical modeling. The article contains the following conclusions. A co-perpetrator of torture may commit this criminal offense by his or her own actions or omissions, use another person as a “means” of committing a criminal offense, or delegate the commission of a criminal offense to another person. A co-perpetrator of torture may join in committing torture at any stage of the commission of this criminal offense. If, under the circumstances of complicity in torture, a public official or other person acting in an official capacity direct torture, he or she is the perpetrator (co-perpetrator) of the offense. If, in complicity in torture, a public official or other person acting in an official capacity creates the conditions for committing the offense, he or she should be recognized as the organizer, instigator or accomplice of the torture (depending on the role he or she has played). If, in complicity in torture, a public official or other person acting in an official capacity doesn't interfere of torture, he or she is the accomplice to torture. Not preventing torture should not be confused with the mental violence that can be used to torture. Article 1 of the 1984 Convention also covers cases of involvement in the torture of public official or other person acting in an official capacity.

Abstract This article focuses on the issue of statistical capacity building of official statisticians using the case of the consumer price index (CPI) as an illustrative example. Although used for indexation of salaries, pensions, and social welfare benefits, but also as an approximation of the general inflation rate, there are several unresolved methodological issues associated with CPI’s calculation. Apart from the choice among two alternative concepts, the challenge of how to include owner-occupied housing (OOH) in CPI has also not been adequately resolved yet. Analysis in the article is based on Slovenian data. The results show that accuracy of the CPI significantly improves if it is calculated using one of the superlative and symmetric formulas, and that it makes sense to include OOH in CPI using the total acquisitions approach. The analysis further indicates that the choice of the index formula for calculating CPI has a much greater impact on the CPI value than inclusion of OOH. Academic research findings such as these should not remain unknown to the wide professional community of official statisticians. Formal channels for knowledge transfer from academia to official statistics providers should be established to facilitate continuous statistical capacity building of official statisticians.

Plug-in electric vehicles (PEVs) are rapidly increasing all over the world as electromobility is being promoted to reduce the greenhouse gas (GHG) emissions. PEVs locally produce zero emissions and they are more efficient in contrast to internal combustion engine vehicles. On the other hand, the impact of the uncoordinated charging of PEVs is expected to create new challenges for the established distribution grid. This article initially evaluates the impact of uncoordinated charging on the voltage regulation and transformer loading in the city of Heraklion, Greece. Then, a coordinated charging strategy is proposed to deal with the issue of transformer capacity violation by PEVs. Two cases were considered when the transformer overloading from PEV charging was taken into consideration: (a) keeping the transformer below its nominal capacity limit and (b) keeping the transformer below 90% of its nominal capacity limit. This was achieved by distributing the available capacity (nominal capacity minus the residential loads) of the transformer to the PEV chargers in a way that the aforementioned limits were satisfied. Real-world data of the distribution grid and the hourly power consumption of the city were used to validate the proposed method. Results show that possible transformer capacity violation can be tackled by the proposed coordinated charging, without exceeding the voltage regulation limits.

Scholarship on electoral authoritarianism has increasingly recognized state capacity as an element enhancing electoral control. Building on such arguments, I examine the interaction between state capacity and regime strength in authoritarian elections. Drawing on empirical evidence from Egyptian elections under Mubarak, I show that the degree to which official regime candidates were able to profit from state penetration depended on the strength of the ruling party. In urban settings where party structures were stronger, service provision by the state helped secure the dominance of the hegemonic National Democratic Party; in rural constituencies where the party was weak, by contrast, service provision strengthened local elites who often ran and won against the party’s official candidates. This suggests that variation in regime capacity to channel political support needs to be taken into account when examining the relationship between state capacity and electoral control under authoritarianism.

This study aims to empirically investigate the effect of Science, Technology, and Innovation Official Development Assistance (STI ODA) on the innovative capacity of developing countries. Particularly, this study attempted to examine the moderating effects of R&D investment and its effect on innovative capacity. To do this, a panel fixed model analysis was carried out with ODA and macroeconomic data on 84 developing countries from 2002 to 2018. The findings indicated that STI ODA was found to have no direct positive effect on innovative capacity. However, it had a positive effect on innovative capacity when the moderating effect of R&D investment was significant and when the proportion of R&D investment increased. The findings of this study serve as a guide for policymakers in terms of having better understanding of the relationship between STI ODA, R&D investment, and innovative capacity. Hence, policy makers and practitioners are able to design a good policy to be adopted such that absorptive capacity should be prioritized for STI ODA to be effective in helping developing countries to escape poverty and achieve sustainable development goals. To the best of the authors’ knowledge, this paper is the first of its kind to analyze the moderating effect of R&D investment on the relationship between STI ODA and innovative capacity in a developing country context.

Endemic supply side constraints including fluctuating output levels, deficient trade infrastructure, rampant non-tariff barriers and incapacity to ensure international quality standards continue to thwart the gainful participation of many Least Developed Countries (LDCs) in an increasingly liberal global trade environment. At its 2005 Hong Kong Ministerial Conference, the World Trade Organization launched its Aid for Trade (AFT) initiative aimed at coordinating global financial support for strengthening trade capacity in Least Developed Countries (LDCs). This paper examined the effect of foreign aid, particularly Official Development Assistance, on Uganda’s external trade and its AFT component in strengthening the country’s trade capacity. Using time series Error Correction Modelling and the World Bank’s World Development Indicators and official national statistics, the paper finds small but positive aid influence on Uganda’s exports and imports and generally close alignment between aid and national priorities. However, given general aid volatility but more especially following the anti-homosexuality legislation and gross corruption allegations in the case of Uganda, the paper advises that external aid be treated as a supplement rather than a substitute for domestic financial resource mobilization in trade capacity development.

AbstractI analyse the relative influence of lawmakers before and after a watershed moment in the development of faction institutions: the abolition of legislative service organizations. Blocs of lawmakers in the House of Representatives were afforded official resources to advance their policy agendas between 1979 and 1995. In the wake of the “Republican Revolution,” however, these groups were categorically dismantled. Using a difference-in-difference design, I estimate the individual-level effect of losing congressional resources on relative legislative effectiveness. The results inform our understanding of faction power, legislative bargaining and evolving congressional institutions.

Abstract This article aims to challenge official statistics providers and statistics educators to ponder on how to help non-specialist adult users of statistics develop those aspects of statistical literacy that pertain to official statistics. We first document the gap in the literature in terms of the conceptual basis and educational materials needed for such an undertaking. We then review skills and competencies that may help adults to make sense of statistical information in areas of importance to society. Based on this review, we identify six elements related to official statistics about which non-specialist adult users should possess knowledge in order to be considered literate in official statistics: (1) the system of official statistics and its work principles; (2) the nature of statistics about society; (3) indicators; (4) statistical techniques and big ideas; (5) research methods and data sources; and (6) awareness and skills for citizens’ access to statistical reports. Based on this ad hoc typology, we discuss directions that official statistics providers, in cooperation with statistics educators, could take in order to (1) advance the conceptualization of skills needed to understand official statistics, and (2) expand educational activities and services, specifically by developing a collaborative digital textbook and a modular online course, to improve public capacity for understanding of official statistics.

The Land Deed Official (the PPAT) is a Public Official who is granted part of the authorities by the State in the implementation of land registration and the making of an authentic deed. The certificate must be made based on the deeds of the law by the parties. The deeds of the law based on Article 2 of the Government Regulation Number 37 of 1998, a sale and purchase, swap, gift, inbreng, granting right of building/right of use based on the land property rights, and granting of land mortgage. Based on the ordinance, the authentic deed can be used as evidence in case of dispute. In this case is usually a lot of the contempt of court. This act is called the Maladministration. Maladministration is poor management or regulation, especially in an offical capacity. Maladministration is bias, neglect, inattention, delay, incompetence, ineptitude, arbitrariness and so on and would be long and interesting list. Including abuse of power, unlawful procedures, unfairness and malfunction or incompetence. The author examines the problem using normative legal research methods supported by some interviews with some who are experts in the field of the land and maladministration. This act resulted in the existence of legal consequences. Due to the law could by law or may be cancelled. The sanctions awarded againts to the Land Deed Official who did this deed contained in Ministerial Decree of Agrarian Affairs and Spatial/Head of National Land Authority Number 112/Kep-4.1/iv/2017 Article 6 paragraph (1) include reprimand, warning, skorzing, onzetting even fired from The Land Deed Official membership.

PPP withdrawal policy is helpful to reduce over-investment in PPPs leading to sustainable development. However, little is known about the role of local governments on over-investment in PPPs. Using the PPP Project Platform Data, a unique dataset, this article is able to quantify over-investment in PPPs by coding PPP withdrawal for the first time. This research tests the influencing factors of PPP withdrawal at the municipal level, according to the centralized withdrawal policy in late 2017 as an exogenous treatment. Based on the theory of over-investment to rapid economic growth, this study develops a two-pillar framework under the combination of political man and economic man assumptions to explain the PPP withdrawal of local governments. The results show that both official tenure and fiscal capacity are significant factors. In addition, debt partially mediates the mayor tenure on PPP withdrawal, and the land revenue growth can hinder the negative relationship between mayor tenure and PPP withdrawal. It implies that over-investment in PPPs is strongly influenced by official leaders’ personal promotion incentive and official group members’ collective benefit. Thus, our findings indicate that the centralized withdrawal policy is an effective instrument to prevent over-investment in PPPs. Moreover, a match should be formed between local development planning and investment plans to promote sustainable of PPP investment.

Never has there been a more exciting time to be an official statistician. The data revolution is responding to the demands of the CoVID-19 pandemic and a complex sustainable development agenda to improve how data is produced and used, to close data gaps to prevent discrimination, to build capacity and data literacy, to modernize data collection systems and to liberate data to promote transparency and accountability. But can all data be liberated in the production and communication of official statistics? This paper explores the UN Fundamental Principles of Official Statistics in the context of eight new and big data sources. The paper concludes each data source can be used for the production of official statistics in adherence with the Fundamental Principles and argues these data sources should be used if National Statistical Systems are to adhere to the first Fundamental Principle of compiling and making available official statistics that honor citizen’s entitlement to public information.

Nutrition data and information systems (ND&IS) are critical to guide the prioritisation, collection, analysis and dissemination of nutrition data in countries. However, there is limited guidance for countries regarding how to invest in their ND&IS and little is known about current financing allocations by both countries and donors. This hinders our ability to identify the most critical funding gaps and to effectively advocate for increased financial commitments to ND&IS. To better characterise donor investments, we conducted a review of Official Development Assistance (ODA) financing for ND&IS between the years 2017 and 2019. The analysis showed overall donor financing for ND&IS is not trending up between 2017 and 2019 with the majority of funding being channelled through multilateral organisations to the health sector and spent on global initiatives and emergency early warning system and surveillance activities. Given these findings, donors should dedicate at least 5% (4%–6%) of nutrition investments, alongside country governments, to support country capacity building and strengthening of ND&IS. Donors should also consider channelling a larger part of ODA for ND&IS activities through public institutions to build their capacity to manage ND&IS strengthening.

AbstractWork on the official history of criminal justice prompted Paul Rock's interest in why it was that so many government papers, amounting to some 98% of the files produced, have been destroyed over the years. Successive crises in the accumulation of records, accompanied by only a limited increase in the shelving capacity of the Public Record Office - later The National Archives - led in the 1950s and beyond to a firm emphasis being placed on the destruction rather than the retention of papers. Officials and politicians were adamant that the unforeseeable demands which future historians might make on the archives had to be accorded less importance than the economic practicalities of what was called ‘weeding’.

The objectives of this research are to depict the shift of transitivity that happen brought about by applying interpretation strategies in the translation on the site of Indonesian Ministry of Health. This research is Transitivity Shift In The Translated Official Website Of Indonesian Ministry Of Health. The samples of the research were clauses under the classification of experiential capacity that experience a shift in transitivity. The data were gathered by using the observation strategy. This strategy specifically selects articles that regulate Covid-19 and their translations in English. It has to carefully read every provision in the source language, then finding transitivity shifts by grouping it according to the experience capacity function. This research was analyzed by qualitative descriptive method and Systemic Functional Linguistic (SFL) approach. The findings showed that there are the transitivity shifts in the articles that published on 20th July and 11th September 2020. In conclusion, the transitivity shift in the analyzed articles, there are transitivity shifts on existential to verbal, material to relational, behavioral to material, verbal to relational and relational to existential. Nonetheless, there is no shift involving mental process in the two articles.

Meanwhile, the public, individuals or legal entities may request an administrative claim for the issuance of a State Administration Decree by a Government Official to the State Administrative Court. The Court's Decision is a representation of legal considerations by the Judge which is recognized as "res judicata pro veritate habetur" which means that the judge's decision is considered to be correct and immediate. In the District Court District for Officers who do not implement the Decision, an execution will be carried out, if there is an execution from the court in this case, it is due to the trial that the implementation of the Decision is carried out in its leadership capacity in the PTUN Decision Domain, in the civil domain in the Court. If the Government Official sued loses, compensation must go through the Government Budget for the Community, Individuals and Legal Entities and vice versa. However, the Government Officials specifically against the PTUN Decision won back sometimes when they were not ready to implement the Court's Decision as it was done by force. Because the efforts carried out are contained within, as is the case, the decision cannot be carried out and handled by the law contained therein.

Dutch society is open and international-oriented. A long standing tradition of world trade has contributed to the English proficiency of Dutch citizens. This, however, brings challenges to the status of Dutch as the national official language in the Netherlands. This paper takes the framework of national language capacity building proposed by Wen Qiufang and inspects the Dutch language policy in official language promotion and standardization. Results of the research show that coming from other languages that undermines the position of Dutch as national official language is gradually increasing. The Dutch solution is to put facilitating measures in place and to develop functional tools to support language users and learners. This solution can be valuable for the building of European multilingual landscape with its facilitating feature.

The subject. The article is devoted to analysis of court practice concerning crimes in public procurement.The purpose of the paper is to solve the problem of delimitation of theft committed by the perpetrator with the use of his official position, from abuse of official powers and official forgery is topical.The methodology. General scientific methods as analysis, synthesis, induction, deduction, comparison were used. The system method allowed to consider misdemeanors and a set of rules providing for responsibility for their commission, in conjunction with public relations, which need criminal law protection. The functional approach made it possible to address the issues of qualification for official crimes against the contract system and the state de-fense order, taking into account the forms and methods of activity of the subjects of con-tractual relations.Results and scope of application. An important role in improving the effectiveness of public procurement is played by officials who, in dealing with suppliers of goods and executors, are called upon to defend public interests. The public danger of crimes committed by offi-cials in this sphere is manifested in the destruction of the material basis of the functioning of the state, undermining its defensive capacity and reducing the level of security. Judicial practice testifies to the lack of uniform approaches to the qualification of crimes committed in the sphere of execution of the state and municipal contract.The article proposes criteria for delimiting the encroachments of officials on the expendi-ture of budgetary relations, taking into account the addition of the criminal law to norms that provide for responsibility for abuse in the performance of the state defense order (art. 201.1 and 285.4 of the Criminal Code of the Russian Federation). In the qualification of crimes committed in the sphere of contractual relations, and the application of art. 201.1 and 285.4 of the Criminal Code of the Russian Federation are proposed to be guided by the recommendations of the Supreme Court of the Russian Federation on the delimitation of abuse of official powers from embezzlement.Conclusions. It is necessary to proceed from the existence of two lines of activity of the customer. The first is the acceptance of the delivered goods, the work performed, the ser-vices rendered. The second is payment for goods, work and services.

This article explores how the Mexican state gathered, archived and destroyed information. It focuses on the US–Mexico campaign against foot-and-mouth disease between 1947 and 1952, whose paper archive Mexican officials burned near the successful conclusion of the campaign. This article argues that several factors shaped the context for this documentary bonfire and made the 1940s a key point of inflection in Mexico’s history of official information-gathering: the dominant party’s system of elite power-sharing, the growth of a reading public and the regime’s drift rightward. At the same time, the nature of the foot-and-mouth disease campaign itself ensured that, despite its possible uses, the archive was particularly sensitive, providing evidence of the embarrassing gaps that began to yawn between the state’s language of revolutionary nationalism and its political practise. Indeed, the bonfire represented the culmination of practises Mexican officials had already developed throughout the campaign to reconcile the demands of legibility and deniability, hemispheric integration and nationalism, political stability and state capacity. More broadly, the case illustrates the uneven effects of US assistance on the development of state capacity, the authoritarian but institutionally weak character of the early PRIísta state, and the role of archives in maintaining a coherent image of state sovereignty.

98 winter wheat cultivars, tested by the Czech Plant Variety Office in 554 trials between 1976 and 2005, were analysed for breeding progress, yielding capacity and behaviour in particular environments. The trials were grouped by yield level, years, altitude, precipitation, temperature and ecological regions. Within each group, least squares (LS) adjusted cultivar means and variance components were estimated. The cultivar means within groups were used as primary data for the subsequent analysis across groups. Genetic variance (Vg) increased with increasing yield level while residual variance (Vr) slightly decreased. Although Vg within groups was very different, phenotypic correlations between the cultivar means of the groups were very high. The cultivar yields, plotted against environment yield, followed a funnel-like distribution, expanding from the origin. The data fitted better to the assumption of multiplicative main cultivar effects than to the assumption of additive main cultivar effects, implied by standard models. Standardised relative yields (SRY), assuming multiplicative main cultivar effects on the original scale, were therefore used to analyse the data. The SRY were obtained by standardisation of cultivar means within trial groups to the variance expected from the cultivar means across the trial groups, subtraction of additive environment effects and division by the general mean. The SRY had a smaller relative error, as measured by the Vg/Vr relation, than cultivar means calculated under the assumption of additive main cultivar effects. The SRY were surprisingly consistent over environments. G × E interactions, usually found under the assumption of additive main cultivar effects, may partly be artefacts of the assumption.

Abstract This article explores the attitudes of Canadian officials towards international conflict mediation and towards the potential for greater official Canadian involvement in the field. The study is based on extensive interviews with Canadian officials who have been involved in mediation at various points over a 20-year period. It finds that Canada, and particularly the Department of Foreign Affairs and International Trade (DFAIT), has taken a largely ad hoc approach to its involvement in the field. Prior to the initiation of this study, there had been no attempt to develop an institutional capacity in this field within DFAIT or to keep track of the personnel involved in such experiences, much less to develop a trained cadre of such individuals. This stands in contrast to the efforts of countries that have prioritized mediation as a foreign policy activity, such as some Scandinavian countries and Switzerland. Many of those interviewed pointed to these countries as potential models for Canada in this field, but it became apparent in discussions that most of those interviewees were not necessarily well-informed as to what these countries have done; there was just a general sense that these countries do it well and that Canada could learn from them. Moreover, none of the interviewees demonstrated significant familiarity with the vast literature on mediation. Those interviewed made recommendations as to how Canada might develop its official mediation capacities so as to play a more active and focused role in this field.

The data were gathered by using the observation strategy, to be specific choosing the articles managing the Covid-19 and the English interpretation, perusing cautiously every one of the provisions in the source language, that is the Indonesian language, discovering the transitivity shift by grouping the sentences as per the experiential capacity function and were analyzed by qualitative descriptive method. The findings showed that there is a few transitivity shifts in the articles. In conclusion, the transitivity shift in two articles, there are one clause on the material to verbal, three clauses on the material to relational, two clauses on verbal to material, one clause on verbal to relational, and one clause on the material to existential. Nonetheless, there is no shift involving mental process in the two articles.

The advancement of information technology is one of the driving factors for implementing e-Government. Nevertheless, the learning process in government official capacity development is now conceivably conducted online. This research aims to discover government officials' attitudes towards blended learning in a population of 40 respondents of Leadership Training Education or Diklat PIM IV in 2018. This research is conducted with a quantitative methodology approach. The T-test used to test the first research hypotheses. A one-way ANOVA was performed for examining the second and third hypotheses. The result shows there is a favorable attitude towards blended learning among the Diklat PIM IV 2018 training participants. There are significant differences in attitudes toward blended learning based on gender but there is no significant difference in attitudes towards blended learning based on age classification.

The article highlights the problems encountered by the deaf people who want to obtain a driving licence and describes the steps taken by a Consortium that run a project named GŁUSI (THE DEAF) within the “Social Innovations” Programme of the National Centre for Research and Development. The project objective was to make it more realistic for the deaf to obtain a motor vehicle driving licence by creating such examination conditions that would remove barriers preventing the access of the deaf to a success in the tests. In the regulations in force, not all examinees were equally treated by the legislator, who failed to provide a possibility of verifying the theoretical knowledge of the citizens who cannot use Polish language because of their disability. The fact that people who needed extra care from state authorities were burdened with requirements beyond their capacity was unjustifiable from social justice point of view; conversely, it made the unfair treatment of the disabled even worse. Since, according to legislator’s opinion, disabled people can obtain the right to drive motor vehicles, the depriving them of such a possibility solely because of the lack of appropriate examination tests and impossibility of communication when they drive a car is irrational. The regulations that govern the principles of examining the candidates for drivers do not provide any possibility of departure from the general rules. Thus, they limit the right of the deaf to live on their own and to move freely as the fully able people do. They also weaken the position of the deaf in the labour market and, in consequence, make it more difficult for such people to improve their and their families’ standard of living and quality of life.

Official COVID-19 mortality statistics are strongly influenced by local diagnostic capacity, strength of the healthcare and vital registration systems, and death certification criteria and capacity, often resulting in significant undercounting of COVID-19 attributable deaths. Excess mortality, which is defined as the increase in observed death counts compared to a baseline expectation, provides an alternate measure of the mortality shock—both direct and indirect—of the COVID-19 pandemic. Here, we use data from civil death registers from a convenience sample of 90 (of 162) municipalities across the state of Gujarat, India, to estimate the impact of the COVID-19 pandemic on all-cause mortality. Using a model fit to weekly data from January 2019 to February 2020, we estimated excess mortality over the course of the pandemic from March 2020 to April 2021. During this period, the official government data reported 10,098 deaths attributable to COVID-19 for the entire state of Gujarat. We estimated 21,300 [95% CI: 20, 700, 22, 000] excess deaths across these 90 municipalities in this period, representing a 44% [95% CI: 43%, 45%] increase over the expected baseline. The sharpest increase in deaths in our sample was observed in late April 2021, with an estimated 678% [95% CI: 649%, 707%] increase in mortality from expected counts. The 40 to 65 age group experienced the highest increase in mortality relative to the other age groups. We found substantial increases in mortality for males and females. Our excess mortality estimate for these 90 municipalities, representing approximately at least 8% of the population, based on the 2011 census, exceeds the official COVID-19 death count for the entire state of Gujarat, even before the delta wave of the pandemic in India peaked in May 2021. Prior studies have concluded that true pandemic-related mortality in India greatly exceeds official counts. This study, using data directly from the first point of official death registration data recording, provides incontrovertible evidence of the high excess mortality in Gujarat from March 2020 to April 2021.

The Resolution 2098 of the UN Security Council (UNSC) of March 28th 2013 authorized with originality, the creation of a Force Intervention Brigade to work in the Democratic Republic of Congo. Although the appointed Brazilian General to command MONUSCO does not operate as an official representative of Brazil but instead as an UN official, this action reinforces the interest of Brazil on UN peace operations. Stressing the Brazilian efforts to win a seat as a permanent member of the UNSC and considering its participation since 1956, in 47 UN peacekeeping missions, this article questions the Brazilian’s intention and capacity to be active in robust operations.Keywords: MONUSCO, Brazilian participation, military capability.

Payments systems generate vast amounts of naturally occurring transaction data rarely used for constructing official statistics. We consider billions of transactions from card data from a large bank, Banco Bilbao Vizcaya Argentaria, as an alternative source of information for measuring consumption. We show, via validation against official consumption measures, that transaction data complements national accounts and consumption surveys. We then analyse the impact of COVID-19 in Spain, and document: (i) strong consumption responses to business closures, but smaller effects for capacity restrictions; (ii) a steeper decline in spending in rich neighbourhoods; (iii) higher mobility for residents of lower-income neighbourhoods, correlating with increased disease incidence.

This article considers the relationship between customary law (kastom) and the official legal system in Vanuatu. It looks at the limitations of the reasons propounded for the lack of integration of customary law and the official legal system and argues that the integration should be a two-way process. The author asserts that a new methodological approach is required to assess the issue regarding the current extent of integration, desirability of integration and capacity for integration of the two systems. Rather than merely analysing case law or legislation, the author argues that the reality behind this picture needs to be investigated and empirical research undertaken.

This article examines policy towards juvenile delinquency in colonial Kenya in the interwar period, arguing that juvenile offenders were the subject of scant official interest until the 1930s, when a series of official reports was commissioned and legislation enacted which attempted to modernize the management of juvenile offenders in keeping with current metropolitan policy. This impulse for reform is placed in the context of colonial discourses on eugenics and the effects of urbanization and detribalization on young Africans, arguing that while key metropolitan principles about delinquency retained their influence on transferral to the colony, they were blended with a distinctive colonial rhetoric about African psychology and capacity for development.

The new aerotropolis era due to airport construction in Kulon Progo has stimulated regional development and changed the image of the area from rural to urban-oriented. The negative impact of rapid growth, such as the urban sprawl, can be mitigated through sustainable spatial planning. Therefore, this study aims to evaluate the carrying capacity based on the land capability of both existing and official land use planning. The matching criteria method was used to conduct the capability evaluation. According to the analysis results, 56.13% of the Kulon Progo area was dominated by moderate to low land capability classes (V-VIII) with the main inhibiting factor as slopes. Furthermore, the evaluation of conformity with land use/land cover (LULC) in 2020 showed most land uses were in not conform (NC) and conditionally conform (CC) status. The area of land use that did not conform with its carrying capacity was 8,286.44 ha which was distributed in the southern part. Meanwhile, an evaluation of the official land use planning of the area showed 57% of the plan was conform (C) with land capability. Therefore, the carrying capacity of the land in Kulon Progo is in reasonably good condition. However, planning interventions should be carried out for areas with not conform status.

The purpose of this research is to understand the level of absorptive capacity of regional expenditure budgets in Malang City and to understand the effect of planning variables, procurement of goods and services variables, and human sesource variables on the absorption of regional expenditure budgets in Malang. This type of research is quantitative research. The population in this research were 20 regional work units in Malang in the form of Agency and Department. The sample of this research is the Regional Financial and Asset Agency, Planning Research and Development Agency, Education and Culture Department, Health Department, and Environment Department in Malang City with respondents occupying positions related to the budget, namely the authority of budgets users, officials making commitments, the technical executive officer of the activity, the official signing the payment order, and the treasurer of the expenditure. The technical analysis used is multiple linear regression. The results of this research indicated that the human resources variable has a significant positive effect on the absorption of regional budgets. While the planning variable and the procurement of goods and services variable do not significantly influence the absorption capacity of the budget
