Resumen
The development of human rights in the national-cultural sphere, especially in states with multi-ethnic populations, should be aimed at the statehood strengthening, inter-ethnic interaction on a good-neighburly basis, and the maintenance of inter-ethnic peace. In the national-cultural sphere human rights are closely intertwined with the spheres of their realization and the commonality of several key components: the right to determine one's ethnic affiliation, the right to use one's native language, the “right to culture”. The following issues are considered in the article: human rights in the national cultural sphere as a synthesis of individual and collective rights, development of human rights in the national cultural sphere, dynamics of regulation of human rights in the national cultural sphere in the neighboring states. It is emphasized that the dynamics of the development of human rights in the national and cultural sphere is conditioned not by the emergence of new human rights, but by the addition of guarantees of the already implemented rights and freedoms, by the increase of the level and quality of their protection by the state and society. First and foremost, we are talking about the development of guarantees for the implementation of the right to use one's native language. It is considered to be one of the basic human rights in the contemporary world, which is created on the principles of the prohibition of discrimination based on national and linguistic criteria, multiculturalism, and respect for peoples' cultures and languages.

My predecessor, Alfred Deakin, after whom this Oration and this University are named, became Australia’s first Attorney-General in 1901. He subsequently became Prime Minister in 1903. I think it says something about Alfred Deakin that this is one of a number of lectures named in his honour. The Melbourne University Lib- eral Club established a lecture trust in his honour in 1967 -- their lectures continue today. In 2001, the Victorian Government held a series of lectures as part of the centenary of Federation celebrations and in 2005, there will be a further series of lectures named after Deakin dealing with innovation.

The State of Israel came into being forty years ago. Its Declaration of Independence proclaimed that the State “shall guarantee complete equal social and political rights to all its citizens without regard to religion, race or sex”. At the time there was a war being waged for Israel's independence, a war which is not yet over. The threat to Israel's security, both from within and without, is still very real. The struggle for security has been going on, unabated, for forty years, and it exacts a price. Among other things, it exacts a price in human rights. Freedom of expression, for example, is subject to military censorship. As a British judge once remarked, war is not waged in accord with the principles of the Magna Carta.

This article outlines and explores the arguments in favor of and in opposition to the establishment of sub-national human rights institutions (such as state and local human rights commissions, ombudsmen and the like) in nations that already possess national human rights institutions. This analysis will be based on an application of prior research findings in the broader field of administrative decentralisation as tailored to the particularities of human rights implementation. Where relevant, the article also examines the implications of institutional type for decentralisation, as well as the implication of different attributes of the relevant jurisdiction. The article concludes by setting out the circumstances under which the establishment of sub-national human rights institutions will be more or less advantageous.

Ever since the beginning of the “Asian Values” debate in the early 1990s, there have been efforts on the part of many societal actors to establish distinctively Asian human rights norms that integrate local customary values and international human rights norms. This article presents the claim that National Human Rights Commissions in Asia are well placed to play an important role in this effort to develop localized human rights norms because of their close links with local civil actors, along with their independence from government control, pluralistic make-up, and ability to address complex rights issues in detail. The article also presents a study of how the National Human Rights Commission of Korea has used its powers to prioritize and promote a particularly Korean version of the human rights of the elderly.

The article is devoted to the study of the genesis of the formation and development of the human rights in the field of national security and to clarify the future legal model of national security in the term of human rights. The purpose of the article is to elucidate historical background and genesis of human rights in the field of national security. The research methodology is based on the general scientific dialectical method of scientific cognition. In addition, for the more comprehensive research of the genesis of human rights in the field of national security special scientific methods were used, in particular, historicallegal, formal-legalistic, formal-logical, contextual method of prediction. In article argues that the degree of protection of human and civil rights and freedoms from their violation is determined by the level of guarantee of each of these rights and freedoms. In accordance with principle of guarantee of the human rights and civil rights and freedoms, their strengthening is carried out both directly in the Constitution of Ukraine and in the current legislation. Position according to which state can choose to select a course that ensure national security in order to create a favorable condition for social development and provide the protection of the vital interest of the individuals, society and the state itself from internal or external threat can be called a policy of a national security. It is emphasized that the current stage of the development of the human rights in the national security began with adopting of the Association Agreement between Ukraine, on the one hand, and European union, the European Atomic Energy Community and their Member States, on the other. It is stated that among the fundamental human rights in the context of ensuring the right of national security to its subjectivity is a right to security, which has a feature of absolute right and at the same time is a subjective right in a specific legal relation in the field of national security. The right to security in the concept of human subjectivity has axiomatic significance as the initial formula of human-centered legal reality. It is concluded, that legal norms that constitute the core of the institution of national security law should be the norms of human rights in the field of national security, and the principle of ethnocentrism should be the basis of the national security law. In Ukraine the process of reforming human rights legislation in the aspect of national security is ongoing and needs further improvement. In particular, in terms of development and adoption of the Cyber Security Strategy of Ukraine, a longterm planning document, which determines the priorities of national interests of Ukraine in the field of cybersecurity.

This essay maps how human rights have helped advance abortion rights, and it explores the relationship between human rights discourses and abortion access in jurisdictions with under-resourced health systems. The first part describes the incorporation of abortion rights in international human rights documents and in the opinions and reports of human rights bodies. The second part discusses why courts increasingly cite human rights texts in national opinions, noting courts’ invocation of universal values, consensus on limited abortion permission, and state duties to protect women’s rights. The third part examines on-the-ground obstacles to implementing court judgments and national abortion laws. This essay argues that human rights reasoning, rooted in claims to universalism and modernity, may minimize the problems that follow legal change, particularly in places with weak health-care infrastructures. The conclusion considers public health law research that keeps in view the differences among countries’ health-care systems.

The Charter draws a distinction between rights and principles. Article 51(1) of the Charter says that rights must be ‘respected’ whereas principles must merely be ‘observed’. The question is how to tell whether a provision in the Charter contains a right or a principle and what implication this has for social rights – which in a number of national Constitutions are traditionally seen as principles, not rights, and thus not directly enforceable. However, for EU citizens this is not satisfactory; why is something described as a right in fact not a right? In this article I wish to argue that while it was originally intended that social rights should in fact be principles, the Court is beginning to adopt a more nuanced approach to this question.

At the present stage of their development the Ukrainian society and the state are characterized by their pursuit to provide maximum realization of human and civil rights and to create a full-scale civil society. Obviously, in this context, a significant attention is paid to the human rights in Ukraine, however there is insufficient research systematically conceptualizing the human rights employing philosophical and legal instruments and methodology. The author highlights that particular attention in the mechanism of organizational and legal remedies is paid to judicial and extrajudicial protection of human and civil rights. In accordance with the Article 55 of the Constitution of Ukraine the judicial protection of human and civil rights is maintained through the system of general jurisdiction courts of Ukraine. The state ensures the right of every person to appeal in court against any decisions, actions or inactivity of the state bodies, local self-government bodies and government officials that violate human and civil rights. In case of exhausting all remedies of his/her rights and liberties protection in national courts the person can appeal to the international courts, e.g. to the European Court of Human Rights. At present, Ukraine holds the third position in the number of its citizens’ appeals to this distinguished international legal institution. Every person is able to appeal to the extrajudicial institutions authorized to protect the constitutional human and civil rights and liberties. In Ukraine there is a special body for this purpose — the Ukrainian Parliament Commissioner for Human Rights, whose activities are determined by the Law of Ukraine «On the Ukrainian Parliament Commissioner for Human Rights» of 23 December, 1997. In case when all extrajudicial remedies of human rights protection are exhausted, a person has the right, guaranteed by the Constitution of Ukraine, to appeal to the international human rights organizations (Art. 55). In terms of the current theory and practice of guaranteeing the constitutional human and civil rights, together with the national regulatory, organizational and legal guarantees, it is worth to distinguish the international guarantees of the constitutional human and civil rights and liberties in Ukraine. The special international legal guarantees of the human and civil rights and liberties are usually divided into regulatory and institutional ones. Key words: human and civil rights and liberties, constitutional state, national legal doctrine, international law, imitation of human rights, constitutional and legal mechanism for ensuring human rights and liberties.

Under the conditions of an armed conflict in Eastern Ukraine the level of ensuring the fundamental human right to education is being reduced. Therefore there is a need to search for additional mechanisms of the protection of the right to education, among which must be singled out such an extra-judicial human rights mobile institution as an ombudsman. All this stipulates the purpose of the article: to find out the role of the Ukrainian Parliament Commissioner for Human Rights, the Commissioner of Ukraine on the rights of the Child and the Educational Ombudsman to ensure the right to education in Ukraine. During the study, such methods as the analysis of scientific literature, normative legal acts in the field of the right to education and annual reports of the Ukrainian Parliament Commissioner for Human Rights were used. The research results of the Razumkov Center (Ukraine) regarding the attitude of citizens to the Ukrainian Parliament Commissioner for Human Rightshave been analyzed. As a resultit was discovered that the measures taken by the Ukrainian Parliament Commissioner for Human Rights and the Commissioner on the rights of the Child for the right to education are active and effective. In the society the legislative introduction of the post of educational ombudsman as an additional human rights institution in the field of education in Ukraine is positively evaluated. The conducted study shows that subsidiary, non-judicial means of protection of the right to education in Ukraine have greater authority among Ukrainian citizens than the judicial system.

Countries ratified the International Covenant On Economic, Social and Cultural Rights (ICESCR) have obligation to implementitation in national level. The purpose of this study is to construct a national food law based on a rights approach realize the right to adequate of food. The importance of this research is because Indonesian national food law is not in accordance with the standards and norms contained in the ICESCR. The research method used is normative legal research using a statutory approach, a philosophical approach and a conceptual approach. The research findings, firstly, the Indonesian national food law is oriented towards the food security paradigm so that it does not regulate rights and obligations in fulfilling the right to food. Second, the formation of a national food law in the future must emphasize the rights of the community and the obligations of the state in fulfilling the right to food, as well as special treatment for food vulnerable groups. Recommendation, the need for the Indonesian government to establish a Food Sovereignty Law in order to realize the right to adequate and adequate food.

The authors of the article have analyzed the peculiarities of human rights protection in the health care sector by national courts; in particular, they have focused on the case-law of the Supreme Court of Ukraine. The authors have indicated legal requirements for taking into account the recognized international and legal requirements of the legislation, as well as the best European experience while considering and resolving disputes. The main grounds for appealing the decisions of national courts to the European Court of Human Rights have been determined. It has been emphasized that the basis for appealing recourse to the ECHR can only be the violation of the rights guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms and its Protocols; and since the right to health care is not contained in these acts, human rights in the health care sector are protected indirectly through other rights and freedoms (right to life, right to liberty and personal integrity, right to respect for private and family life, right to a fair trial, etc.). It has been substantiated that the relevant solution to the contradictions of national and European legal enforcement is compensation for non-pecuniary damage in medical matters, protection of the rights of mentally ill persons in the health care sector, as well as ensuring the right of persons deprived of liberty, medical care. It has been established that the main areas for the harmonization of national courts’ activities with the case-law of the ECHR in the context of protecting medical rights should be: ensuring the recognition and enforcement of foreign courts’ decisions by Ukraine; the possibility of reviewing the case by national courts in case if an international court has proved the violation of the provisions of the Convention; balance and consistency of national legislation with the provisions of the Convention in order to avoid violations, the significance of the decisions of the ECHR and focus on them within legal enforcement practice.

The paper highlighted the role of national mechanisms for the protection of social rights. For this purpose its judicial and administrative remedies have been analyzed. The significance of the constitutional protection of the justice system, her legislative experience in the field of social security, legal and regulatory framework, features, procedural and substantive issues considered on the basis of scientific and theoretical considerations. Along with this, the paper considers a system of judicial protection of social rights, it’s civil, administrative and judicial properties, and shows the primary form of protection issues. Through administrative remedies and the Institute of Human Rights Commissioner (Ombudsman), the paper examined the current legal framework for the protection of social rights, and analyzed their activity in this field. As a result, the author has put forward a number of recomendations.

This brief paper highlights the perspectives of those proposing and opposing the idea of Minority Language Right (MLR). Then, the paper relates this discussion to the context of bi/multilingualism in Indonesia by referring to cases of bi/multilingualism in different contexts. In particular, it is also discussed whether MLR is relevant to Indonesian, a national language of Indonesia, seen through historical, political, social, and economic perspectives of bi/multilingualism in Indonesia. Resumen
National Human Rights Institutions (nhris) have rapidly proliferated worldwide in the last twenty years. They play an important role in the implementation of international human rights standards at the domestic level. Examples, especially from the African and Asian regions show that the Responsibility to Protect (R2P) relates to the work of nhris. Some institutions were established as one of the outcomes of peace processes in order to advance reconciliation and prevent future abuses. Where nhris already exist, the institutions may promote and protect human rights in each phase of the R2P. This paper discusses what role nhris can take up in assisting governments, the international community, and people before, during and after crisis situations. Through concrete country examples, it also highlights the challenges that the institutions must face, and summarises the limits of their influence.

Resumen
The COVID-19 pandemic is having serious and disproportionate effects on nationals abroad and their families globally. Many states have adopted positive measures including temporarily suspending forced returns as well providing visa and work permit extensions, temporary residence, or other forms of regular status to ensure that migrants are accounted for in national responses to the pandemic. Nevertheless, the human rights of nationals abroad and nationals with foreign family members have faced significant challenges. Some states have fully or partially closed entry to all of their own nationals and their foreign family members, in violation of nationals’ right to return and their right of family unification. Other states’ nationals abroad have been unable to enjoy the right to an adequate standard of living and the right to health. Many have also encountered the burdens of hate speech in both their home states and the states in which they live, the effect of which has been to undermine freedom of opinion and expression and the right to equality and non-discrimination. This essay identifies and explains these threats to human rights in the era of COVID-19. The essay encourages states to recommit to rights protection.

AbstractInternational human rights law attaches the right of health care to the person. States, however, predicate this right on membership in the national community and access to publicly subsidised health care is normally contingent on national membership. With this in mind, this article considers the significance of a human rights approach to access to health care and undertakes a comparative study of health-care provision for irregular migrants in France and the UK. Irregular migrants are ineligible for national membership because they have breached immigration laws. Consequently their right to health care may only arise from international human rights law. This comparative study, however, shows that states resist the idea of a right to health care for people they regard as a threat to national sovereignty. Yet the author posits that the exercise of the government's immigration power may be reconciled with the realisation of irregular migrants' human right to health care.

The importance of determining a learning model to achieve a goal that will be achieved optimally, the learning model is a guide for every teacher, with the right learning model, the achievement of the expected results is in accordance with what is planned, in the learning model and implementation of human rights education In the perspective of Islamic and national education, this concept has implications for at least three things.
