This Article examines and evaluates a distinctive, increasingly popular account of the Mistake of Law doctrine. The doctrine, deeply ingrained in American criminal law, is at the same time notoriously unclear in its scope, content, and application. A growing number of legal theorists have criticized the traditional interpretation of the doctrine; legal moralists in particular have argued that this account is conceptually confused. Because the doctrine’s use of a strict liability punishment regime does not incentivize individuals to learn the law as well as a negligence regime might, legal moralists argue that the doctrine cannot be explained by a desire to incentivize legal knowledge. In evaluating this argument, the Article defends the traditional account, often identified with the liberal positivism of Justice Holmes. The Article advances three main arguments. First, legal moralism’s claim that a negligence standard is more effective than a strict liability standard in incentivizing individuals to learn the law is false: the safe harbor provision of a negligence rule acts as an insurance effect, disincentivizing individuals to learn the law. Second, legal moralism assumes that the moral content of the criminal law is determinate, and that agents have perfectly rational, objective motivational sets. These are illicit assumptions that result in a flawed argument. Finally, the Article contends that legal moralism misinterprets the structural core of the traditional account: properly understood, the Mistake of Law doctrine employs a negligence–strict liability hybrid, and is thus more sophisticated than legal moralists realize. The Article concludes that, contrary to what a surprising number of criminal law theorists have come to accept, legal moralism fails to make a plausible case against the traditional account of the Mistake of Law doctrine.

The topic of this paper is the debate between political moralists and political realists. I will try to show that it is possible to find the middle ground that simultaneously satisfies the main demands of both camps while resisting objections directed against each. In the first part, I start with the view shared by both moralists and realists: that the main challenge lying before a political theory is solving the problem of legitimacy. I first sketch Rawls? moralist approach. I then move to outline the realist criticisms of such moralism. I will mainly follow one of the most detailed recent theories - Sleat?s realist theory, although I will also draw from other well-known realists. In the second part, I outline objections against realism. They somewhat similar to the same criticisms they themselves direct against moralists. The main issue is, in short, the problem of underdetermination - that is, the insufficient determination of political action by facts. Since realists hold that a political theory has to be applicable, their view is thus considerably weakened by such criticism. In the third part of the paper, I point to deliberative theory as a view that can answer both realist criticism - because its main aspect is dealing with the way things work in actual politics of concrete societies - but it can also answer criticisms directed against realists themselves, because empirical research of deliberation suggests an actual and viable way to solve the problem of legitimacy - by raising the quality of deliberation. Moreover, a deliberative theory retains autonomy of the ethical, although it doesn?t do that, unlike moralism, by encroaching on the autonomy of politics. Thus, at the end of the paper, I claim that such a deliberative approach can be accepted by both realists and moralists.

There are two goals of this paper: (1) epistemologically, to show the difference between the cognitive capacities of the concepts in the title, and (2) ideologically-critical, to recognize the group interests behind hegemonic moralisms. The moralization prescribes the good, emotionalizes, homogenizes, manipulates moral instructions or prohibitions, and reduces the autonomous judgment of individuals. The metamoralism distinguishes evaluations of states and behavior from moral judgments. The political moralism is a part of ideological consciousness and a form of a narrow cognitive perspective. The various forms of historical and contemporary political moralisms, their active emotional potential, the structure and rhetoric of neoliberal moralism and the self-reflexive metamoralism of the left are presented. The cognitive supremacy of metamoralism is highlighted, which is not an assessment of injustice from the point of view of personal morality, but a superior assessment of the legitimacy of the power on which the injustice relies.

My aim in this paper is to examine the role of legal moralism in the reasoning that underlies some high profile cases decided by the Supreme Court. In so doing, I provide a sketch of a version of legal moralism that arguably addresses the most serious concerns of some of its critics. My thesis is roughly that the decisions in Bowers and Barnes are ultimately indefensible and the decisions in Loving and Lawrence are indeed correct. But despite appearances to the contrary, legal moralism is not the culprit in Bowers and Barnes, because what might appear to be instances of legal-moralist arguments in the prevailing opinions in those cases are either variants of other types of argument or applications of untenable versions of legal moralism. Further, the arguments employed by the Court in the prevailing opinions in Loving and Lawrence are at least consistent with the most plausible version of legal moralism and would have entailed that Bowers and Barnes be decided differently. Indeed, Justice Stevens's dissent in Bowers contains important parallels with the most plausible versions of legal moralism, and Justice Scalia's dissent in Lawrence relies on an implausible version of legal moralism.

This article argues against a moralist interpretation of the purpose of statutory anti-­discrimination law. On this interpretation, there are instrumental reasons to legally prohibit discriminatory acts to achieve a collective goal that the state ought to pursue as a matter of political morality. But the fact that a discriminatory act is morally wrong according to interpersonal morality additionally gives a separate non-instrumental or moralist reason to legally prohibit it. According to moralism, the best interpretation of anti-­discrimination law’s purpose ascribes both moralist and instrumental justifying reasons for the law’s main features. Most writing in the philosophical literature on anti-­discrimination law proceeds under a dominant, yet inarticulate, assumption that moralism is true. Indeed, I explain that we might be persuaded to invoke moralist reasons to confer intelligibility on why the law prohibits directly discriminatory acts, why certain traits are included in the prohibited grounds of discrimination, why legal regulation is limited to certain spheres of private life such as employment and housing, and why the law is enforced through a mechanism of private recourse. I argue, however, that the attractions of moralism are illusory. We ought to invoke only instrumental reasons to explain these features of the law. A thoroughgoing instrumentalist account of anti-discrimination law as a tool for achieving an egalitarian political goal offers a unifying account of legal prohibitions of direct and indirect discrimination that coheres with a justification for the law’s protection of certain prohibited grounds and its application to the typical regulated spheres. I show how this conclusion has the important implication that, to the extent that anti-discrimination law’s private recourse enforcement method is inconsistent with the law’s overall instrumental purpose of reducing inequality, it ought to be reformed to place the onus of enforcement more squarely on administrative officials. In the final analysis, anti-discrimination law’s point is not to embody the morality of anti-discrimination as between private persons. It is to function as a means for realizing public justice.

The authors locate contemporary fissures in academic freedom in two interrelated macro-societal developments that intensified across the second half of the twentieth century: massification, involving the exponential expansion of higher education, and standardization, an isomorphism of structure and content in academic organization. The article develops a theoretic argument that the unfurling of higher education nationally and globally together with its sociocultural consistency creates a supranatural order endowed with unprecedented power centered in the core actors of universities. While these historical developments create for universities a dominant moral authority in the contemporary epoch, they also engender moralism—an evaluation of speech, writing, and behavior that venerates emotion. To illustrate the strategies of those who deploy moralism, a comparison is drawn between moralism’s contemporary instantiation in higher education and the early medieval Catholic church’s approach to perceived competitors. The comparison demonstrates that while displays of moralism in higher education may be comparatively new, their historical uses are well-worn. While massification and standardization have entailed individual and societal benefits, a rise of moralism obstructs the academic freedom on which institutions of higher education depend.

Abstract Fabian Wendt [20] argues that political realism is not capable of explaining how the state's moral right to rule over its subjects is generated. I believe that Wendt's criticism is not sound because his position relies on the false implicit assumption that realism and moralism ask the same philosophical questions on state authority. I contend that it is fallacious to evaluate the realist account of legitimacy by the standards of moralism, and vice versa, as these two accounts arrive at different conceptions of legitimacy by raising different sets of philosophical questions. The two sets of philosophical questions are not reducible to each other. The realist account of legitimacy does not aim to explain what the moralist account of legitimacy aims to explain.

Thomas Hobbes is usually held to have been a skeptic in matters of religion and morality. I accept the claim that there is a distinctive skeptical strain in Hobbes' thought but argue that his skepticism informs his moral vision, rather than depriving him of a conception of morality. As evidence for this reading, I situate Hobbes in a tradition of “skeptical moralism,” along with Montaigne and certain other Renaissance figures. As opposed to moral skeptics, skeptical moralists think of moral agents as divided selves, pulled in one direction by law and another by conscience. Skeptical moralists use skepticism to make people aware of this tension, and I argue that (especially in his remarks on religion) Hobbes was doing just that.

In this article we present the emergence of a consumer community resisting a national mythology that milk is a central constituent of a healthy life style. This unfolds in a contemporary consumptionscape in which the consumer body and health is the subject of a number of moralisms and counter moralisms. The case is an example of how commercial and official (moral) definitions of health and collective identity are reinterpreted in the establishment of a counter-mythology. This counter-mythology contests an alleged conspiracy between industry and public health authorities. Dairy producers have expropriated the structural mythological ties between milk and the nurturing aspects of family, a process which is underpinned by medical discourses that point to the connection between health and milk consumption. It explores the formation of a counter consumer mythology as it unfolds in the interaction between self-proclaimed experts and consumer-to-consumer communication. We detect four stages in what we suggest is a recursive, for example, non-linear, process of consumer community formation. Finally, the emergent mythologies and moralism from these processes are discussed.

Det moraliska i ansvar inom omvårdnad är en viktig del för vårdpersonal som är bristfälligt beforskat och diskuterat inom vårdvetenskapen. Moraliskt ansvar anses som självklart av vårdpersonal, därför reflekteras begreppet i denna humanvetenskapliga litteraturstudie för att få en djupare kunskap och förståelse. Syftet var att gestalta det moraliska i begreppet ansvar inom omvårdnad i nutid. Inspiration genom hermeneutiken användes för att tolka de åtta vetenskapliga artiklarna som ingick i resultatet. Studiens resultat påvisade en fördjupning om moraliskt ansvar där den fria viljan, determinism, skuld och moralisk agent framkom. Vårdpersonal är moraliska agenter där determinismen, den fria viljan och skulden påverkar det moraliska i ansvaret. Evidensbaserad forskning om det moraliska i ansvaret inom vårdvetenskapen är bristfällig. Ytterligare forskning inom området är önskvärt för att förtydliga begreppets position inom teoribildning och därmed profession och arbete.

This work analyzes the experience and moral values of the participants of the "Fora Dilma" demonstrations organized in the city of João Pessoa in 2015. Demonstrations against the federal government have been taking place in all the capitals of the Brazilian states since March 15, 2015, bringing together thousands of people who, dressed in the colors of the Brazilian flag, are asking for the Impeachment of the current President of the Republic, Dilma Rousseff. The protests were organized mainly by the social networks of anti-government groups, such as: "Revoltados Online", "Vem Pra Rua" and "Movimento Brasil Livre". Based on an analysis of the "Out Dilma" protests in the city of João Pessoa conducted by "Voltados João Pessoa", we sought to analyze how the need to combat corruption is transformed into a moralistic agenda that confirms and recreates elements of a Udenian tradition in Brazilian politics.
Este trabalho analisa a experiência e os valores morais dos participantes das manifestações “Fora Dilma” organizadas na cidade de João Pessoa em 2015. Manifestações contra o governo federal vêm ocorrendo em todas as capitais dos estados brasileiro desde 15 de março de 2015, reunindo milhares de pessoas que, vestidas com as cores da bandeira do Brasil, pedem pelo Impeachment da atual Presidente da República, Dilma Rousseff. Os protestos foram organizados, sobretudo, pelas redes sociais de grupos antigovernistas, como os: “Revoltados Online”, “Vem Pra Rua” e “Movimento Brasil Livre”. A partir de uma análise da organização dos protestos “Fora Dilma” na cidade de João Pessoa, realizada pelo “Voltados João Pessoa”, buscamos analisar como a necessidade de combate à corrupção é transformada numa agenda moralista que confirma e recria elementos de uma tradição udenista na política

This thesis shows that 'Shakespeare' (both the works and the man) was at the forefront of literary activity in the nineteenth century. By focusing on concerns about the identity of the British nation and its people it shows that Shakespeare was a constant presence in the debates of the day and that a number of agendas were pursued through what were ostensibly writings about Shakespeare's plays and the biography of their author. The Introduction first notes Shakespeare's transition from Elizabethan playwright to Victorian cultural icon and proceeds to outline nineteenth-century critical practice and changes in the social organisation of knowledge. From here the shift in how Shakespeare was considered is noted as well as the fact that, despite increasing interest in the history of the phenomenon, the nineteenth century has been largely neglected. What exploration there has been of this period has tended, by its nature as part of larger surveys or issue-specific studies, to oversimplify the complexities of nineteenth-century criticism. Further to this, the nineteenth century itself is often treated as a time of unsophisticated development and as a precursor to modern thought rather than a period of interest in its own right. A variety of what this thesis terms 'literary pursuits' during this period are then contextualised, as well as the changing role of the critic in nineteenth-century society. This is accompanied by an exploration of the community of readers and writers who would have engaged with these works. Finally, the methodological decisions which have directed this thesis are explained, including the privileging of page over stage, and the choice of those nineteenth-century writers who have been examined. The main body of the thesis is divided into two sections: Part One (Chapters One and Two) gives a broad taxonomy of ways in which nineteenth-century writers used Shakespeare as a means for addressing other issues, and Part Two (Chapter Three) uses a specific case study through which to examine these particular issues. It shows that attitudes to Shakespeare were shaped by an ongoing dialogue concerning the identity of the nation and its population. However, while there was much commonality regarding the agendas for which Shakespeare was used, the ways in which various different writers approached this was surprisingly diverse. Chapter One, 'Nationalism,' looks at how Shakespeare could be used in order to serve a nationalistic agenda: this involved either allying Shakespeare with the nation itself (by utilising Shakespeare's nationality, writing in a rhetorically charged manner, or interpreting Shakespeare's works in a certain fashion), or equating the nineteenth century with the early modern period (and highlighting various commonalities or differences with those times). The concept of nationalism is contextualised by looking at various attitudes to the nation which were driven by the challenges of the expanding Empire. Chapter Two, 'Moralism,' looks at the ways in which Shakespeare was used as a tool by those who sought to promote certain behavioural traits amongst their readers. The different ways in which writers made use of Shakespeare are situated within a discussion of nineteenth-century philosophical and moral positions. This chapter looks successively at what is termed 'Private Moralism' (a concern with abstract ideas, such as self-control and adherence to familial or religious ties), and 'Public Moralism' (that is, efforts to improve the outward or physical attributes of individuals, such as financial accumulation or class status). Part Two of the thesis focuses on how Victorian writers used Shakespeare specifically in relation to Shakespeare's Sonnets. To this end, Chapter Three, 'The Sonnets,' looks at how writings on the Sonnets pursued moral or nationalistic agendas. This chapter also seeks to draw together the strands of nationalism and moralism by showing that anxieties about the state of Britain fed into writing about the Sonnets at this time and that this involved a complex debate about the Sonnets, ancient Greece, and the nature of what would today be termed homosexuality. A significant contention of this chapter is that nineteenth-century attitudes towards the Sonnets need to be appreciated on their own terms rather than anachronistically via a modern understanding of homosexuality. The Conclusion suggests that Shakespeare was used by nineteenth-century critics and biographers as a location within which to debate certain overarching concerns of the day. How these issues were approached, however, took different forms and Shakespeare was employed for different ends, which points to a general unease regarding the identity of the nation. As the formal institutionalising of the English Literary canon was taking place during the period covered by this thesis it seems reasonable to suggest that the use of Shakespeare was related to Shakespeare's position of dominance within the canon. Finally, suggestions are made as to how the ease with which Shakespeare could be used - as well as the unavoidable difficulties which are attendant with Shakespeare - might have affected this process of canonisation.

In more recent years, the debate between political moralists and political realists has enjoyed increasing relevance within the philosophical literature, and this thesis adds another voice to that debate. I start out with an explication of both moralism and realism as they have been defined in the literature so far, with particular emphasis on the liberal moralism of John Rawls, the (radical) realism of Raymond Geuss, and the (liberal) realism of Bernard Williams. I then consider a number of moralist objections to realism, to which I argue realists have good responses. I go on to show that, notwithstanding their capacity to respond effectively to moralist objections, the realisms of Geuss and Williams fail (in different ways) to satisfy a key methodological requirement of political realism itself: that political theory must be properly sensitive to the conditions of real-world politics. I then show that the political theory of Michael Oakeshott provides us with a novel and interesting way to satisfy this requirement.

Due to the phenomenon of neo-Pentecostalism the Brazilian Protestantism was forgotten by the academy (?). As a result growth and changes of Protestantism in Brazil has gone unnoticed. Therefore this study aims to make a counterpoint to the ideal type of Protestant practice created by Max Weber and revisited by Rubem Alves called Protestantism doctrine Straight and therefore will discuss about a current Brasilian Protestantism or rather the past forties decades of this practice in Brasil. To Alves the whole of the Brazilian Protestantism was fundamentalist and moralist and troughout this text we will see that there is another Protestantism forming in Brazil and that we are calling the Rational Experience Protestantism in which the subjective experience of faith and the search for the rationality of the Christian faith are presents
Por conta do fenômeno do Neopentecostalismo, o protestantismo brasileiro foi esquecido pela Academia de estudos de ciências sociais e da religião. Em função disso, o crescimento e as mudanças do protestantismo no Brasil passaram despercebidos. Sendo assim, este trabalho se propõe a fazer um contraponto ao tipo ideal criado por Max Weber e revisitado por Rubem Alves denominado Protestantismo de Reta Doutrina , e, para tanto, irá discorrer sobre um protestantismo brasileiro atual, ou seja, das últimas quarentas décadas. Para Alves o todo do protestantismo brasileiro era fundamentalista e moralista e, ao longo deste texto, veremos que existe um outro protestantismo se formando no Brasil, e que, o chamaremos de Protestantismo de Experência Racional no qual a experiência subjetiva da fé e a busca pela racionalidade da fé cristã se fazem presentes

Resumen
Abstract This chapter provides a methodological and historical context for the study of early modern women moralists. It argues, first, that moralist writing holds philosophical significance; second, that women make substantive contributions to the genre. The chapter examines the history of the term moraliste, the relationship of moralist writing to descriptive versus prescriptive approaches, its formal properties, and the social and political landscape in which it came to prominence. Traditional histories typically frame moralist writing through the work of prominent male writers such as La Rochefoucauld, Pascal, and La Bruyère; the chapter argues for the inclusion of women in the canon of moralist writing, noting parallels with recent calls for the inclusion of women in the canon of early modern philosophy.

Resumen
Hälsa och hälsovanor skapas i tidig ålder vilket understryker vikten av tidiga insatser där hem, barnhälsovård, förskola och skola är viktiga aktörer. Enligt Artikel 6 i FN:s konvention om barnets rättigheter (1) har varje barn rätt att överleva, leva och utvecklas fysiskt, psykiskt, andligt, moraliskt och socialt. Då barnkonventionen sedan 2020 är en del av svensk lag väcks frågor om hur vi gemensamt kan sträva efter att göra det bästa för barnen. Trots en generellt god framtidstro uppger dagens unga generation att de upplever sömnbesvär, huvudvärk, nedstämdhet och andra psykiska besvär i större utsträckning än tidigare och de konsumerar mer sjukvård och psykofarmaka för dessa symtom jämfört med tidigare generationer. Därutöver rör de sig mindre och andelen barn och unga med fetma och övervikt ökar. I linje med denna problematik har antalet nya fall av depression, ångestsyndrom, självskador och ätstörningar bland barn och unga vuxna ökat under en lång tid. Förklaringar och orsaker bakom denna ökning är många och bilden kring barns hälsa är komplex. Resultaten i denna kunskapsöversikt visar att det är av yttersta vikt att frågor kopplat till både psykisk hälsa och fysisk hälsa måste prioriteras från det att våra barn föds och kontinuerligt under hela deras förskole- och skolgång. Skolan är den enda institution som möter alla barn och därför är det av stor vikt att det i skolan måste finnas förutsättningar i form av kunskap och kompetens för att arbeta hälsofrämjande och se till att barnen ges möjlighet att utvecklas fysiskt, psykiskt, andligt, moraliskt och socialt. Syftet med denna kunskaps-sammanställning är att ge förskole- och skolverksamheter en bättre och mer solid bild av det aktuella kunskaps- och forskningsläget kring barn och ungas hälsa med avsikt att bidra till ökat kunnande och fördjupade diskussioner. Ökade kunskaper om långsiktiga och övergripande behov hos barn och unga behövs för att kunna fördela resurser och genomföra träffsäkra insatser. Utgångspunkten är således att sammanställa befintliga data och forskning inom området utifrån tre områden. 1) belysa trender i barn och ungas hälsa under den senaste 10-årsperioden, 2) belysa faktorer som bidrar till barn och ungas hälsa, samt 3) belysa insatser som visat sig vara verksamma i syfte att främja barns och elevers hälsa. Några av de mest framträdande resultaten i sammanställningen är: Det finns stora kunskapsluckor när det gäller förskolebarns hälsa. Detta kan bero på att det både saknas systematiska metoder för att samla in och sammanställa hälsodata, att det råder oklarheter i hur man mäter de yngsta barnens psykiska välbefinnande och att det saknas forskning om detta. Sammanställningen visar dock att det finns initiativ på gång när det gäller att systematisera och förstå hälsa bland våra yngsta barn. Sedan början på 1990-talet har andelen skolbarn i åldern 11–15 år med övervikt eller fetma mer än dubblerats. Bland 4-åringar ökade andelen med fetma och övervikt under COVID-19 pandemin efter att legat relativt oförändrat sedan en tid tillbaka. I en nationell jämförelse redovisar skånska barn i fyraårsåldern lägst andel fetma och övervikt, vilket förändras med åldern då skånska barn i åldrarna 6–9 har seglat upp som en av de regioner med störst andel barn med övervikt och fetma. Flickor dominerar statistiken upp till 8 års ålder, därefter är det fler pojkar än flickor som lider av fetma och övervikt. Skolungdomar rapporterar att de äter mindre godis, dricker mindre läsk, äter mer grönsaker, röker mindre cigaretter och dricker mindre alkohol. Samtidigt har användningen av snus och e-cigaretter ökat och det är färre skolbarn som äter frukost dagligen. Vidare visar statistiken att den inaktiva tiden under dagen har ökat och att äldre ungdomar är stillasittande största delen av sin skoldag, även om vi kan se en viss ökning av fysisk aktivitet utanför skoltid. Inaktiviteten är lika hög på helgerna, vilket sammantaget gör att färre ungdomar når upp till rekommendationerna om fysisk aktivitet. Insatser för att främja fysisk aktivitet i skolan verkar oftare leda till ökad rörelse, jämfört med om insatserna pågår utanför skoltiden, vilket betyder att skolan har en viktig roll i detta arbete. Andelen barn (4–12 år) som dagligen vistas i grönområden har minskat betydligt över en 10-årsperiod. Jämfört med för tio år sedan vistas barn idag mer sporadiskt i grönområden. Den övergripande majoriteten av barn och unga uppger ett gott psykiskt välbefinnande och det har inte varit några större förändringar över tid. Samtidigt ökar självrapporteringen av psykiska besvär och skolstress. En oroväckande tendens är att andelen barn med nedstämdhet eller sömnbesvär i Sverige nu är bland de högsta i Europa. Det råder stora könsskillnader när det gäller hälsa. Flickor rapporterar genomgående fler hälsobesvär än pojkar, större krav i skolan och lägre skoltrivsel. De äter frukost mer sällan och rör på sig mindre. Rapporteringen av psykiska besvär och skolstress/krav i skolan har ökat i jämförbar takt sedan 2010. En högre upplevelse av krav i skolklassen bidrar till fler hälsobesvär bland elever som grupp. Stress till följd av skolrelaterade krav tenderar således att spridas bland klasskamrater och framför allt flickor upplever en ökad stress genom att de pratar med varandra om pressen att lyckas i skolan. Skolkrav har ett negativt samband med livstillfredsställelse, vilket innebär att ju högre skolkrav, desto lägre livstillfredsställelse. Samtidigt har forskning också visat att studiemotivation bland klasskamrater är kopplat till färre hälsobesvär på elevnivå, även om man själv inte upplever studiemotivation. Detta tyder på att lärmiljön och skolkamraternas påverkan på hälsan är viktig. Enligt stora internationella studier har förekomsten av psykiatriska tillstånd i form av neuropsykiatriska funktionsnedsättningar så som ADHD och autism varit relativt oförändrad över tid. Samtidigt ser man att andelen barn och unga som diagnostiseras med ADHD och autism i vården ökar. Denna diskrepans återstår att förklara. Barn vars vårdnadshavare är födda i Sverige rapporterar ett bättre hälsotillstånd än barn med utrikes födda vårdnadshavare. Däremot rapporterar barn med svensk bakgrund högre förekomst av psykiska besvär jämfört med barn med utländsk bakgrund. Det finns också tendenser som visar att elever med utländsk bakgrund rapporter ännu färre psykiska besvär när andelen elever med utländsk bakgrund i klassen är högre. Denna diskrepans behöver undersökas närmare.
