Resumen
Moral (non-patrimonial) damage in Serbian law includes physical and psychological pain and suffering, and fear of sufficient duration and intensity. This is a purely subjective concept of moral damage: the mere infringement of non-patrimonial rights, or violation of personal goods as objects of these rights, does not constitute moral damage, unless they caused the plaintiff?s physical or psychological pain, or fear, and disturbed his or her mental equilibrium. Objectivization of moral damage is a change in this paradigm, towards the understanding of moral damage as an abstract infringement of a non-patrimonial right of the injured party, irrespective of any pain or fear caused by such infringement. Moral damage exists if personal (non-patrimonial) right, or personal good, or legally protected personal interest is violated, even if the injured party did not suffer any pain or fear due to this violation. Since 2005, Croatian legislator has abandoned the long-standing subjective concept of non-patrimonial damage, and reconceptualized it as an abstract violation of personal rights, including personal rights of legal entities. The Commission appointed to draft the new Civil Code of Serbia considers several modes of either partial or complete objectivization of the concept of moral damage in the prospective codification. In this paper the author examines the reasons for such change, and offers arguments in support of the idea that Serbian legislator should decide on a mixed conception of non-patrimonial damage, that is, to adhere to the existing concept of non-patrimonial damage, but also to allow for a violation of non-patrimonial goods or legally protected interests to be recognized as a type of moral damage, regardless of any psychological suffering coming out of such infringement.

The article examines the problems of compensation for moral damage caused to the consumer by defects in goods, work performed or services rendered. The article analyzes domestic and foreign law enforcement practice on the issues of compensation for moral damage to consumers and points to the absence of clear criteria for determining the amount of moral damage both in the Republic of Uzbekistan and in foreign countries. The article points to the existing disagreements between the plaintiffs and the judges in determining the amount of compensation for non-pecuniary damage. The rights of individuals and legal entities to claim compensation for moral damage are distinguished.

State policy in the field of occupational safety is aimed at creating proper, safe, and healthy working conditions, prevention of accidents and occupational injuries. Despite this, unfortunately, in Ukraine, many injuries, as well as deaths resulting from workplace injuries and illnesses, are recorded annually. According to the requirements of the labor legislation, the owner or his authorized body shall be entrusted with ensuring safe and harmless working conditions. Moral damage caused by workplace injuries and illness issues is governed by the rules of civil law and labor law and social security law. In the event of harm to an employee, the employer has a duty to compensate for material and moral damage, whereby the latter is liable to compensation if the violations of the employee’s legal rights have resulted in moral suffering, loss of normal life ties, and require him / her extra life for organizing. Both the employer and the Social Insurance Fund are subject to compensation for material damage caused to the employee as a result of workplace injuries and illnesses, and only the employer is responsible for moral damage. There are no clear algorithms for calculating the number of moral damages, the lower or the upper limit, and the court must consider the requirements of reasonableness and fairness in determining the number of moral damages. Moral damage is compensated irrespective of the material damage to be recovered and is not related to the amount of such compensation. The amount of moral damage is determined by the court depending on the nature of the offense, the depth of physical and mental suffering, impairment of the victim’s abilities, or deprivation of their ability to realize them, the degree of guilt of the person who caused the moral harm, if the fault is grounds for compensation, and also taking into account other essential circumstances. An analysis of the case-law on claims by persons who have received workplace injuries and illnesses or their close relatives to employers for compensation for moral damage indicates that courts have applied unequal substantive law rules and a large range of amounts recovered for moral damage. This article examines the issue of monetary compensation awarded by arbitral tribunals for moral damages suffered by foreign investors in the context of investor–state arbitration. It examines the nature and the function of moral damages in international investment law as well as several controversial issues, including the proper form of reparation to remediate moral damages suffered by a state, whether proof of malicious intent is a necessary condition for a tribunal to award compensation and whether compensation should be limited to cases involving “egregious” or grave treaty violations. The article argues that particularly condemnable governmental actions toward foreign investors will have a bearing on the actual quantification of the amount of compensation to be awarded for moral damages. Desde a Constituição Federal de 1988, na qual se reconhece a “dignidade da pessoa humana” e os “valores sociais do trabalho” percorre-se um longo caminho até que isso realmente se concretize. Nesta discussão teórica, aborda-se o significado de dano moral, sua importância e seus efeitos na saúde do trabalhador, a atenção jurídica dispensada ao assunto e a banalização do conceito da ofensa à dignidade na busca de recursos indevidos. Quando a ofensa à dignidade se torna passível de indenização de dano moral? Como a justiça do trabalho mensura o dano psicológico? Objetivou-se com o estudo analisar como o dano moral afeta a saúde física e mental, desenvolvendo sintomas silenciosos e graves, podendo levar o trabalhador ao suicídio, e conhecer como a esfera judiciária trabalhista tem tratado o assunto. Buscou-se com essa problemática, por meio da pesquisa bibliográfica com o método indutivo para demonstrar os dispositivos legais utilizados pelos magistrados para julgar casos de dano moral e preservar os direitos personalíssimos do trabalhador.Palavras-Chave: Dano moral. MORAL DAMAGE: LEGAL PROTECTION OF WORKER'S HEALTHAbstract: Since the Federal Constitution of 1988, which recognizes the "dignity of the human person" and the "social values of work", it goes a long way until this really materializes. This theoretical discussion addresses the meaning of moral damage, its importance and its effects on the health of the worker, the legal attention given to the subject and the banalization of the concept of offense to dignity in the search for undue resources. When does the offense against dignity become liable to compensation for moral damages? How does labor justice measure psychological damage? The objective of this study was to analyze how moral damage affects physical and mental health, developing silent and serious symptoms, which can lead the worker to suicide, and to know how the labor judicial sphere has dealt with the subject. We sought this problem through the literature search with the inductive method to demonstrate the legal devices used by magistrates to judge cases of moral damage and preserve the most personal rights of the worker.Keywords: Moral damage. O presente trabalho visa a esclarecer o equívoco que incorrem a doutrina, a jurisprudência e os operadores do direito brasileiro, ao reproduzirem de forma acrítica e impensada o entendimento sufragado pelo Superior Tribunal de Justiça, por meio da súmula 227, de que as pessoas jurídicas podem ser indenizadas por danos morais. Os danos morais são lesões aos direitos da personalidade, inerentes tão somente aos seres humanos, fruto de lutas históricas para conseguir o seu reconhecimento e proteção, baseados no princípio constitucional da dignidade da pessoa humana. Portanto, as pessoas jurídicas não podem ser consideradas titulares de direitos da personalidade, em decorrência da dificuldade que se tem na liquidação de determinados danos patrimoniais sofridos pelos entes fictícios e por se emprestar a forma de liquidação dos danos fora do patrimônio para a resolução deste problema, haja vista a existência da diversidade de valores e princípios entre seres humanos e entes fictícios. No que se refere às associações filantrópicas e fundações, os danos serão institucionais, acarretando a perda da credibilidade perante a sociedade, com repercussão no desenvolvimento de suas atividades.

A situation that has been generated several confusions is the inclusion of person damage next to moral damage in the Civil Code of 1984, both in the national doctrine and judicial decisions.The Author analyses the problems arising from non-property damages in the Peruvian legal system, giving a brief description of its arrival to our Legislation and noting the major directions Doctrine has taken. He focuses on the old and new challenges Judges have on this matter and elaborates a list of considerations to positions seated on the Peruvian Civil Procedure.
Una situación que ha generado severas confusiones es la inclusión del daño a la persona junto al daño moral en el Código Civil de 1984, tanto en la doctrina nacional como en los pronunciamientos judiciales.En este artículo el autor examina la problemática de los daños extrapatrimoniales en el ordenamiento peruano, reseñando su génesis legislativo y las principales tendencias doctrinarias al respecto. Se enfoca en los viejos y nuevos retos de los Juzgadores en el daño extrapatrimonal y ofrece cuestionamientos a posturas mayoritarias en el ámbito procesal.

O punitive damage é uma doutrina que ganhou bastante relevo no ordenamento jurídico americano. Segundo seus ditames, ao ofensor deve ser imputado um valor indenizatório que seja considerado passível de lhe desestimular na pratica de novas condutas. Apesar da existência de embates dos operadores do direito daquele país, alguns juristas brasileiros aceitam a possibilidade de inserção desta doutrina no âmbito do direito nacional no intuito de sanar a problemática do quantum do da indenização por danos morais. Assim, o presente trabalho tem como objetivo analisar a aplicabilidade do punitive damage nas ações de indenização por danos morais no ordenamento jurídico brasileiro. Para tanto, será construído o conteúdo a partir da abordagem histórico-evolutiva da responsabilidade civil como um todo, passando pelo caminho desenvolvido pelo dano moral ao longo dos tempos, até os dias atuais. Então, serão consultadas as teorias nacionais que buscam encontrar meios para facilitar a quantificação do dano moral e em seguida a doutrina do punitive damage no intuito de se familiarizar com seus requisitos. Por fim, a partir da colheita de todos esses predicados desenvolver-se-á o estudo em torno do tema principal. A busca pela resposta ao problema em questão se faz de suma importância para uma possível mudança de pensamento no que se refere à responsabilidade civil em razão de fatos ilícitos que venham a causar danos morais ao ofendido.

The purpose of this paper is to provide a study on the possibility of recognized the injuries caused to the right of the ecological balance, collective interest that transcends the private sphere of human damage, affecting the whole community. Initially, it will be necessary to analyze the Law in Postmodernity, checking the inevitable axiological content of standards involving the law of nature, inserted as a human right third generation. We will analyze some philosophical currents that support and assist the perception of contemporary environmental law, in particular his interpretation. Also be traced an overview of the evolution of environmental law by addressing their social, economic and ecologic character; and these pillars necessary for the realization of human dignity. Then, we intend to recognize the existence of a collective intangible heritage, analyzing the possibilities and difficulties of obtaining and quantify the damage of this nature, given the basic principles that will guide the collective protection. For this, we will study the civilian view of moral damage, through the transition that culminated in the extent of injuries caused to an ecologically balanced environment damage. Finally, we see the evolution of matter in the higher courts, analyzing aspects such as the quantification of collective damages and allocation of its resources to the defense fund of diffuse rights
A proposta do presente trabalho é oferecer um estudo sobre a possibilidade do reconhecimento de danos imateriais às lesões causadas ao direito ao equilíbrio ecológico, interesse metaindividual que transcende a esfera privada dos seres humanos, atingindo toda a coletividade. Inicialmente, será necessária uma análise do Direito na Pós-Modernidade, verificando o inevitável conteúdo axiológico das normas que envolvem o direito da natureza, inserido como direito humano de terceira geração. Para tanto, analisaremos algumas correntes filosóficas que embasam e auxiliam a percepção do direito ambiental contemporâneo, em especial a sua interpretação. Ainda, será traçado um panorama da evolução do Direito Ambiental, abordando o viés sustentável em seus aspectos social, econômico e ambiental; sendo esses pilares necessários para a concretização da dignidade da pessoa humana. Em seguida, pretendemos reconhecer a existência de um patrimônio imaterial coletivo, examinando as possibilidades e dificuldades de auferir e quantificar os danos dessa natureza, diante dos princípios basilares que vão nortear a tutela coletiva. Para isso, estudaremos a visão civilista dos danos morais, passando pela transição que culminou na extensão dos danos imateriais às lesões causadas ao meio ambiente ecologicamente equilibrado. Por fim, veremos a evolução da matéria nos tribunais superiores, analisando aspectos como a quantificação dos danos morais coletivos e a destinação de seus recursos ao fundo de defesa dos direitos difusos

The new ways of existing work in the XXI century, the result of neoliberal economics and globalization, generate a reflection on the figure of the worker in the context of modern society, which is the protection of human dignity of the worker, especially regarding the intensification of work that the employee is submitted to assist the economic goals of the employer. In Brazil, the Constitution of 1988 reflects, in its Article 7, the worker protection and, as a social right, is considered as a fundamental right, supporting the idea that the capitalist system must maintain a dependent relationship with the social rights in order to the free initiative established by Magna Carta should be carried out with social justice and strengthening of the work in a fair and caring society. The practice of hard work equates to moral harassment when a worker is submitted to conditions that confront his-her physical or mental health so that his-her work activities are summarized in a presentation of positive results to the employer in order to increase the company s profit, which entails moral and social security damage as a way to seek redress against the injury he-she suffered. In this sense, this work takes the form of a investigative and bibliographic research that aims to analyze the human dignity of the worker within the neoliberalism forward to new forms of work brought by global society, focusing on the intensification of work and the need of compensation of his-her moral by the action of Judiciary granting moral and social security compensation for the injured worker, in view of the critical study of the right to work, as well as the interpretation in the social, political and economic context. Therefore, it analyzes, beyond the formal element (the rules of worker protection), also the materiality of protecting the dignity of the worker face to the Brazilian courts in order to presents some considerations about the effective legal protection of the right to work as fundamental right.
As novas formas de trabalho existentes no século XXI, fruto da economia neoliberal e da globalização, geram uma reflexão acerca da figura do trabalhador no contexto da sociedade moderna, qual seja, a proteção da dignidade humana do trabalhador, principalmente no que tange a intensificação do trabalho a qual o trabalhador é submetido para atender aos objetivos econômicos do empregador. No Brasil, a Constituição de 1988 reflete, em seu Art. 7º, a proteção ao trabalhador e, como direito social, trata tal direito como fundamental, entendendo que o sistema capitalista deve manter uma relação de dependência com os direitos sociais para que a livre iniciativa presente na Carta Magna seja realizada com justiça social e fortalecimento do trabalho, numa sociedade justa e solidária. A prática do trabalho intenso equipara-se ao assédio moral quando o trabalhador é submetido a condições que afrontam sua saúde física ou psíquica de modo que suas atividades laborais são resumidas à apresentação de resultados positivos para o empregador com o objetivo de aumentar o lucro da empresa, o que enseja o dano moral trabalhista e previdenciário como forma de buscar o ressarcimento frente à lesão por ele sofrida. Nesse sentido, este trabalho tem a forma de uma pesquisa bibliográfica investigativa que objetiva analisar a dignidade humana do trabalhador dentro do neoliberalismo frente às novas formas de trabalho trazidas pela sociedade globalizada, focando na intensificação do trabalho e a necessidade de ressarcimento de sua moral mediante atuação do Poder Judiciário concedendo indenização por dano moral e previdenciário para o trabalhador lesado, tendo em vista o estudo crítico do direito ao trabalho, bem como a interpretação dentro do contexto social, político e econômico. Resumen
Based on the recent damage done to the murals in the Centre of Lima, this article analyzes the conflict that can occur between the moral right of authors to the integrity of their work and the property rights of the holders of the support containing the intellectual creation. Criteria are provided to analyze conflicts in which murals are involved. Finally, the infringement of moral right of integrity is discussed.
Sobre la base del reciente daño efectuado a los murales en el Centro de Lima, a través del presente artículo se analiza el conflicto que puede producirse entre el derecho moral de los autores a la integridad de sus obras y el derecho de propiedad de los titulares del soporte que contiene la creación intelectual. Se brinda criterios a tomarse en cuenta en los conflictos donde estén involucrados murales. Finalmente, se examina las posibles infracciones al derecho moral de integridad.

AbstractThe use of sanctions is often associated with coercion and deterrence. The former implies that sanctions contribute to changing the behaviour of targets, while the latter suggests that the damage threatened by sanctions should discourage actors from embarking on certain policies. However, sanctions have evolved substantially over the last twenty years, thus this chapter discusses whether the emergence of targeted sanctions was enough to change the classical deterrence/sanctions relation. This chapter argues that while there are similarities with the past, there are elements of change that need to be carefully considered. On the one hand the imposition of a cost to certain policy actions, the existence of an audience and the potential impact on the wider society remain central problems for both comprehensive and targeted sanctions. On the other hand, targeted sanctions present unique features that directly interact with the concept of deterrence. First, sanctions do not target states and governments only, but also individuals and non-state actors. Second, targeted sanctions are designed to reduce their impact not only on innocent civilians, but there are clear boundaries of damage that can be inflicted on targets. Third, targeted sanctions can have a moral hazard problem, so that their imposition creates an incentive for actors to embark on the very actions that sanctions aim to deter.

The article is devoted to the study of the nature and content of the term “protection of personal non-property rights”. Based on the review of judicial practice, the author concludes that civil protection of intangible assets in the Russian Federation is carried out in the restorative and compensatory directions. The article analyzes such methods of civil protection of intangible benefits as compensation for moral damage and refutation of publicly known information of a defamatory nature. Based on the results of the study, the author concludes that it is necessary to apply innovative methods and techniques of civil law protection of personal non-property rights.

A cross modal strain energy (CMSE) damage diagnosis method, which is capable of localizing the damages and estimating their severities, is presented. The numerical study uses measurements synthesized from a finite element model of a laboratory-scaled offshore platform. Several damage scenarios are investigated, including: single/double damaged element(s), with/without measurement noise. Numerical results suggest that good performance on both damage location and severity assessment can be achieved by implementing the CMSE method.

This paper presents a feasibility study on a structural damage identification method (SDIM) developed herein for cylindrical shells. The SDIM is derived directly from the governing differential equations of motion of damaged cylindrical shells. A damage distribution function is used to represent the distribution and magnitudes of local damages within a cylindrical shell. In contrast with most of existing modal parameters-based SDIMs, which requires only model parameters measured in both intact and damaged states, the present SDIM utilizes the FRF-data in the damaged state instead of the modal parameters in the damaged state. By virtue of utilizing FRF-data, a sufficient number of equations can be derived by choosing as many sets of excitation frequency and FRF measurement point as needed. The feasibility of the present SDIM is numerically tested through some illustrative examples, taking into account the random noises in FRF-data.

Turkey, Pakistan, India, Malaysia, and Indonesia span one of the longest continuously inhabited regions of the world. Centuries of cultural infusion have ensured these societies are highly heterogeneous. As plural polities, they are ripe for the kind of freedoms that liberal democracy can guarantee. However, despite having multi-party electoral systems, these countries have recently moved toward populist authoritarianism. Populism —once considered a distinctively Latin American problem that only seldom reared its head in other parts of the world— has now found a home in almost every corner of the planet. Moreover, it has latched on to religion, which, as history reminds us, has an unparalleled power to mobilize crowds. This report explores the unique nexus between faith and populism in our era and offers an insight into how cyberspace and offline politics have become highly intertwined to create a hyper-reality in which socio-political events are taking place. The report focuses, in particular, on the role of religious populism in digital space as a catalyst for undemocratic politics in the five Asian countries we have selected as our case studies. The focus on the West Asian and South Asian cases is an opportunity to examine authoritarian religious populists in power, whereas the East Asian countries showcase powerful authoritarian religious populist forces outside parliament. This report compares internet governance in each of these countries under three categories: obstacles to access, limits on content, and violations of user rights. These are the digital toolkits that authorities use to govern digital space. Our case selection and research focus have allowed us to undertake a comparative analysis of different types of online restrictions in these countries that constrain space foropposition and democratic voices while simultaneously making room for authoritarian religious populist narratives to arise and flourish. The report finds that surveillance, censorship, disinformation campaigns, internet shutdowns, and cyber-attacks—along with targeted arrests and violence spreading from digital space—are common features of digital authoritarianism. In each case, it is also found that religious populist forces co-opt political actors in their control of cyberspace. The situational analysis from five countries indicates that religion’s role in digital authoritarianism is quite evident, adding to the layer of nationalism. Most of the leaders in power use religious justifications for curbs on the internet. Religious leaders support these laws as a means to restrict “moral ills” such as blasphemy, pornography, and the like. This evident “religious populism” seems to be a major driver of policy changes that are limiting civil liberties in the name of “the people.” In the end, the reasons for restricting digital space are not purely religious but draw on religious themes with populist language in a mixed and hybrid fashion. Some common themes found in all the case studies shed light on the role of digital space in shaping politics and society offline and vice versa. The key findings of our survey are as follows: The future of (especially) fragile democracies is highly intertwined with digital space. There is an undeniable nexus between faith and populism which offers an insight into how cyberspace and politics offline have become highly intertwined. Religion and politics have merged in these five countries to shape cyber governance. The cyber governance policies of populist rulers mirror their undemocratic, repressive, populist, and authoritarian policies offline. As a result, populist authoritarianism in the non-digital world has increasingly come to colonize cyberspace, and events online are more and more playing a role in shaping politics offline. “Morality” is a common theme used to justify the need for increasingly draconian digital laws and the active monopolization of cyberspace by government actors. Islamist and Hindutva trolls feel an unprecedented sense of cyber empowerment, hurling abuse without physically seeing the consequences or experiencing the emotional and psychological damage inflicted on their victims.
