This article confronts what has been described as the ‘ongoing self-defence controversy’ within the international military community over the legitimacy of commanders issuing orders that have the practical effect of restricting soldiers’ use of force in self-defence. Within this controversy, some argue that soldier self-defence is legally sacrosanct, a right that must invariably take precedence over any command-imposed restrictions. This article explores whether there is any legal basis for this view. It finds that there is not, and that such an absolutist approach misconstrues the basic theoretical and legal origins of self-defence. What is more, the article forewarns that reasoning in such absolute terms might actually serve to devalue rather than promote soldiers’ safety by failing to properly account for the longstanding military tradition of commands such as ‘hold fire’ orders, the central importance of these directives to the ordered application of military force and military effectiveness, and the interrelationship of the military and the state’s responsibility for national security. Cet article se penche sur la controverse qui entoure la légitime défense au sein de la communauté militaire internationale, quant à la légitimité du commandement de donner des ordres ayant pour effet, dans la pratique, de restreindre l’emploi de la force des soldats à des fins de légitime défense. Dans le cadre de cette controverse, certains soutiennent que la légitime défense des soldats est sacro-sainte d’un point de vue juridique et que ce droit doit toujours l’emporter sur toute restriction imposée par le commandement. Cet article cherche à déterminer si ce point de vue repose sur un fondement juridique. L’article conclut que non, et qu’une telle approche absolutiste dénature les origines théoriques et juridiques à la base de la légitime défense. Qui plus est, l’article met en garde qu’un raisonnement en de tels termes absolus pourrait en fait nuire à la sécurité des soldats, au lieu de l’améliorer, parce qu’il ne tient pas suffisamment compte de la longue tradition militaire d’ordres tels que «halte au feu», de l’importance de ces directives pour l’application ordonnée de la force militaire et pour l’efficacité militaire, et de l’interaction entre l’armée et la responsabilité de l’État pour la sécurité nationale. Dit artikel gaat in op wat is omschreven als de ‘voortdurende controverse over zelfverdediging’ binnen de internationale militaire gemeenschap over de legitimiteit van commandanten die bevelen uitvaardigen waarbij het gebruik van geweld door soldaten uit zelfverdediging praktisch wordt beperkt. Binnen deze controverse betogen sommigen dat de zelfverdediging van soldaten wettelijk onaantastbaar is, een recht dat altijd voorrang moet hebben op alle beperkingen die door het commando worden opgelegd. Dit artikel gaat na of er een wettelijke basis is voor dit standpunt. De conclusie is dat die er niet is en dat een dergelijke absolutistische benadering de theoretische en juridische grondslagen van zelfverdediging miskent. Dentro de esta controversia, algunos argumentan que la autodefensa de los soldados es legalmente sacrosanta, un derecho que invariablemente debe prevalecer sobre cualquier restricción impuesta por el mando. Este artículo explora si existe alguna base legal para este punto de vista. Resumen
This thesis examines socio-spatio-temporal practices in Roman military bases between the first and third centuries AD. The thesis analyses archaeological, documentary and textual evidence in order to understand how the spatial setting of the military base was underpinned by socio-temporal practices associated with those built spaces. The archaeological data consists of two case-study military bases informed by insights from two additional sites. Elginhaugh provides the best known plan of a Roman military base in the Empire and a well stratified finds assemblage. Bu Njem, at the time of its excavation, was preserved in places to the level of the first storey ceiling and is accompanied by an archive of military documents recording the activities of the troops. The analysis is complimented by insights from Inchtuthil, as the best explored plan of a legionary base and 2nd century A.D. Vindolanda, with its tablets providing a wealth of details about the society of the base. Having identified the gap in our understanding of the role of socially constructed space in the study of Roman military bases, this thesis investigates the archaeological and textual evidence for patterns of movement and presence within the base, the temporal variation in social activity in a military base and the way both community and institution of the army functioned in space. The topic of social use of space in the context of the Roman military bases has seen some attention in recent years, but has rarely been addressed as a primary research aim. No one has attempted to do it through integrating all available sources of data: literary data, the documents, the plans of sites and the artefactual record. The thesis investigates presence and movement understood as social practices; time understood as a socially constructed phenomenon and an element giving rhythm to activity within the base; and social networks, stratification and hierarchy as vital elements of the social experience of a given place. The thesis argues that these socio-spatial practices had deeper meaning. The thesis traces normative, disciplinary, ideological, hierarchical, religious and infrastructural socio-spatial practices. The thesis concludes with how these forms of socio-spatial practices encapsulated cultural concepts, social relationships and their proper spatial and temporal settings.

This thesis analyzes American basing structure in Germany, in a new political environment at the beginning of the 21st century. The end of the Cold War changed the political and strategic situation in Europe and the substance of American military presence in Europe. The War on Terrorism suggests that the current threats are dynamic and unpredictable and the idea of a permanent U.S. basing structure in the heart of Europe should be reconsidered. Specifically, this thesis describes the reasons for restructuring the large and expensive base structure in Germany and the impact of American withdrawal to the German society. Moreover, this thesis presents new challenges and opportunities for American military presence in other parts of European continent. Finally, this thesis reviews the development of U.S. policy concerning present and future base structure in Europe.

Resumen

This dissertation explores the obstacles for US formal military bases in Latin America. While in the past, the United States managed to establish bases in several countries in the region, despite Washington's efforts every negotiation to open new bases has failed since 2000, and older bases have been terminated, as in the case of Ecuador. Using evidence from Ecuador, Colombia, El Salvador, and other countries in the region, the dissertation finds that shifts in government preferences do not explain this failure. Instead, domestic challenges to host governments in Latin America systematically appear as blocking mechanisms that impede the establishment of foreign military bases, even when leaders support them.

The dissertation builds on the work of Alexander Cooley and others and develops a model of base politics to explain how domestic political calculations affect foreign basing negotiations. Furthermore, the dissertation finds that when formal bases have not succeeded, interested governments have worked around domestic constrains to establish alternative and informal arrangements that allow US military presence and operations in their countries. These alternative arrangements, or quasi-bases, have advanced US security interests in Latin America even in the absence of formal base leases, while at the same time their secrecy and informality protects Latin American leaders from domestic contestation.

The U.S. military conducts a full spectrum of contingency operations in which it provides humanitarian assistance, logistical support, peacekeeping stability functions, and reconstruction activities. It is becoming increasingly important to incorporate the concept of “sustainability” into these operations. Making contingency operations more sustainable will provide force multiplier aspects that increase operational efficiencies and reduce logistical burdens and costs. The military requires enormous energy resources to maintain its mission readiness, which contributes greatly to logistical burdens and costs. A wide range of sustainability considerations relate to the cross-functional use of energy in contingency operations, from the interface with a host nation’s infrastructure; temporary construction practices; fuel convoys; cascading material use; the handling and treatment of waste, water, and hazardous materials; logistics footprint, etc. This paper describes military issues that will affect deployed base mission requirements and future investment policies. It also describes the ongoing process to develop an Army vision for sustainable contingency operations. This vision will consider the integration of cross-functional energy uses and establish sustainable operational requirements and investment policies. These insights are also applicable to many international humanitarian situations.

Resumen
The goals of the DOD-solar study were to identify potentially economic solar-energy projects on specific military bases and to define the necessary steps to install solar projects in the near term. Five classes of mature solar technologies were investigated: crystalline photovoltaics, solar hot water, transpired collectors (solar wall), pool heaters, and daylighting. Approximately 500 military bases/facilities were screened using simple payback models that used site-specific data for insolation, conventional energy prices, and financial incentives for solar. One or more economically viable projects appear to exist at nearly every base analyzed. Most projects are for solar daylighting and solar walls. Several pool and domestic water heating opportunities exist and a number of large photovoltaic projects also appear to be possible. Approximately 30 business-case analyses (BCAs) were performed which represent the larger project potential. Government and private ownership of the solar systems were investigated in the BCAs. Though the potential is large, it appears that a new multi-year DOD program that promotes private ownership needs to be launched before the full potential can be realized.

Resumen
Blast noise from military installations often has a negative impact on the quality of life of residents living in nearby communities. This, in turn, negatively impacts the military’s testing & training capabilities due to restrictions, curfews, or range closures enacted to address noise complaints. In order to more directly manage noise around military installations, accurate noise monitoring around bases has become a necessity. Although most noise monitors are simple sound level meters, more recent ones are capable of discerning blasts from ambient noise with some success. Investigators at the University of Pittsburgh (Pitt) developed a more advanced noise classifier that can discern between wind, aircraft, and blast noise, while simultaneously lowering the measurement threshold. Here, more recent work between Pitt and the US Army Engineer Research and Development Center will be presented from the development of a more advanced classifier that identifies additional classes of noise such as machine gun fire, vehicles, and electronic noise. Additional signal metrics were explored given the increased complexity of the classifier. By broadening the types of noise the system can accurately classify and increasing the number of metrics, a new system was developed with increased blast noise accuracy, decreased number of missed events, and significantly fewer false positives.

Resumen
The Horn of Africa is one of the most important regions in the world, and the multitude of military bases in the region seems to support this fact. It is no wonder that the Bab-el-Mandeb is an important strait in international trade, serving as the true end of the Suez Canal. China’s first overseas military base in Djibouti, a small country already oversaturated with the military bases of various countries, could therefore show the increasing assertiveness of the People’s Republic of China (PRC) and its ambition in establishing itself as a global superpower. This analysis provides a brief overview of this naval base and explores what functions it has, how it compares to its neighbouring military bases, and what potential there is to it.
