Texto completoEl objetivo de este trabajo será exponer el desenvolvimiento histórico jurídico que experimentó la regulación del concepto de unidad domiciliar de los cónyuges, expresado en su contenido material y que consiste en el deber de los cónyuges de vivir juntos. Dicho análisis se sustentará en una continuidad histórica conforme a la cual podemos trazar una secuencia que se arranca desde el derecho romano y que llega hasta nuestro derecho actualmente vigente. Lo anterior hará posible que constatemos si cada una de las vertientes históricas que conforman el sustrato de nuestro derecho, recogieron, de alguna forma, la necesidad de que los cónyuges vivieran juntos, como un elemento definitorio de la realidad matrimonial. Para ello precisaremos la forma en que se abordó el tratamiento del deber de los cónyuges de vivir juntos: si se consagró expresamente o mediante normas que tendieran a su materialización en la práctica, o bien mediante normas que sancionaran su incumplimiento, o, al menos, a través de normas que precisaran los casos en que, por excepción, cesaba dicho deber no obstante subsistir el matrimonio. A su vez, la forma en que, en las distintas etapas históricas se abordó esta materia, nos proporcionaran una medida acerca del valor que en ellas se asignaba a la unidad domiciliar de los cónyuges. Por último, y partir de lo anterior, estaremos en condiciones de efectuar el mismo análisis respecto del derecho actualmente vigente. Podremos entender qué sentido tiene hoy del deber de los cónyuges de vivir juntos y qué valor se le asigna.

Texto completoThis research focuses on a study of marriage in western society, Italian in particular, and in Islamic countries, in particular in Tunisia and Morocco. In the West Canonic manage represents the prevalent model of matrimony, whereas in the near and Middle East the concept of matrimony is that outlined in the Coran. The definition of this concept has been carried out by various legal schools which have always characterized Islamic law and whose concrete regulamentation today is the competence of state law in various Islamic countries. This is because, even though it has happened later compared to other legal sectors, and has more on less importance in different countries, the phenomenon of legal modernisation has always taken into account family rights and consequently, marriage. As this is a complex event, being part of traditional customs as wells institutions, and as a consequence in linked to social change, it seems best to analyse it through a study of the discipline in a historical prospective. These reference points for the West are the Church and its relationship through the centuries with other socio-political realities: first and foremost the Roman Empire and then other phenomena and medieval, modern and contempory institutions, in particular national states which have determined a re-dimensioning of their influence on the subject of matrimony; muslim society, on the other hand starts from the point of the legal school malikita to arrive at the rules of marriage in the States of two countries in particular, Tunisia and Morocco, however, before arriving at this specific argument we look at how modernisation in general has influenced the subject in various other Islamic countries. The choice of two Maghreb states has been determined by the fact that the first, Tunisia, represents the expression a more radical reform, so that legislation in this sector has not been bettered, while in Morocco, which has recently adopted a new family code, truly innovative reforms have not been instated. The contemporary era in the historical excursus presents a religious and cultural pluralism which distinguishes italian society, in that these is a process of pluralism in the models of matrimony which coexist within the State. In particular the Islamic model, considering the growth of the muslin community in our territory is the one which brings up questions about rising conflict with civil marriage. Points of attrition have been found on the one hand between the Italian legal system and the islamic marriage discipline, and on the other hand advanced solutions, above all from the law. This study represents the conclusion of work carried; out before arriving at this issue the similarities, and differences between concepts, aspects, the terms of different marriage institutions the terms of different systems above all socio-cultural and legal have been high-lighted. The first chapter of the thesis has been dedicated, however, to illustring characteristic traits of the two confessional rights which have been taken into consideration, canonic and muslim , putting these in the right prospective for a better understanding of the real object of study, marriage. The introduction serves to report the current debate concerning the precise collocation we can attribute to the legal system with a religious basis within the legal systems described by academics of comparative law.

Texto completoThe Thesis scientifically investigates some key aspects of Pre-classical Roman private law, in particular the ancient Roman matrimonium. After some philological and historiographic premises, the principal aim is to convincingly demonstrate the historical reliability of Plautine poetic production as a possible source of knowledge of Pre-classical Roman law. Starting from the historicization of the juridical institutes, the purpose is to accurately establish the relation of the Mores with the Roman private dimension, through the examination of the archaic literary sources like the so-called ‘Varronian’ comedies. The historical focus is on the conservative political dimension and the Roman society between 3rd and 2nd cent. BC. The key role enacted by Roman law appears inevitably influenced by the Eastern world, in particular the Greek one. The lexical survey, focused on juridical terminology, convincingly demonstrates the tradition of specific occurrences and aspects of conjugal relationships in Plautus. This historical research provides new cognitive elements capable to promote additional investigations into the history of Roman law, clarifying some key aspects frequently overlooked by the bibliography.

Texto completoThe research investigates the way the Council of Trento’s decrees on marriage were applied in the diocese of Mexico City. The study mainly relies on sources obtained from the Vatican Secret Archives together with additional documents from Spain and Mexico. The research has two main analytical strands. On the one hand, it examines the extent of the Holy See’s involvement in enacting the Council’s marriage decrees in the New World. On the other hand, it analyses the concession of pontifical marriage dispensation to couples in the New Spain. The first issue is addressed through a study of the jurisdiction and intervention in the Indies of two institutions of the Roman Curia: namely, the Sacra Congregazione del Concilio and the Nunziatura Apostolica in Madrid. The second point is addressed by analyzing the specific powers that the popes bestowed on the Indian bishops for marriage dispensations in light of the fact that at the same time many Mexican couples applied directly to Rome for marital authorization. This analysis illustrates how requesting marriage dispensations directly from the Holy See was only one of several options available to Americans of the New World to regulate marriages between people related by consanguinity or affinity. Therefore, after illustrating the bureaucratic process involved in obtaining a marriage dispensation, the research focuses on the underlying reasons that spurred American believers to apply directly to the Holy See. It is suggested that they did so in aspiration of attaining an influential measure by the Church, which would either guarantee and prove their personal and familial honor or act as an acknowledgement of their virtues demonstrated during the conversion and settlement in the New World.

Texto completoIn Plautus’ theatre there are themes and stylistic criteria which come from the ancient traditional dramaturgy, and are ascribable both to the Greek Nea and to the Italian theatre of improvvisation. Furthermore, Plautus inserts in his characters’ speeches parodic variations which come from more elevated genres such as the tragedy (Euripide’s one in particolar) and the epic poem, in order to create a type of theatre scattered with literary references. Plautus’ production is indeed the result of a complex operation of contamination, original and innovative in all its parts; it operates on the structures of the plot and the dialogue, up until it determinates a proper metamorphosis in the singular personae and their way to manage relationships and interactions in which they are involved. In the analysis of the collision between two characters, in order to avoid inferential and discriminating blunders, it is required to try to understand if you are dealing with a “tout court” recall of situations which exist already in Greek scripts, or with contaminated forms, justified by dramaturgic and comical reasons, and for that created in order to make the public laugh, or again with proper and structured conflicts, which imply levels of criticality related to relationships and antropological connotations between the characters. In order to accomplish this, an in-depth analysis of the concept of conflict has been necessary, as well as trying to include within the modern categories of analysis, only those which got along with the Roman antropological code and with the perception of conflict according to the ancients; moreover, particular antropological criteria have been taken into account, those that Plautus give glimpses of from the conventional or unconventional forms of his personae. The dramatic text, ultimately, has been analized using the pragmatic of communication, whose categories allowed to give back to the theatre its performativity, shaped in different dialogic contexts, in step with the semiotic studies of the theatre. Regarding the conflict situations between Plautus’ characters, subject of this research, they are present in large numbers in Plautus’ corpus and for this reason it has been necessary to focus on the analysis of a few dialogues, which involve the main characters of one of the most important relationships of the Roman culture, the one concerning marriage, which consists of a wife and an husband as the main actors. The relationship between spouses appears rather unstable and swings back and forth between complementarity, imposed by tradition, and pseudosymmetry, determined by the new status of uxores dotatae, following the matrimonium sine manu spread in Rome. The conflictual dynamics in Plautus’ theatre, as it has been possible to deduce from the analysis of the conflictual interactions between husband and wife present in the Amphitruo, in the Asinaria and in the Menaechmi, appear to be swinging between farsical quarrels and proper conflict, which is produced by the collision between different willings and conceptions, or by the violation of the rules in the sphere of the social way of living.

Texto completoEsta tese de doutoramento tem como tema as Iustae nuptiae vel matrimonium: direito romano, cristianismo e seus reflexos no direito civil brasileiro. Inicia-se por um pequeno estudo sobre a família romana, da fase histórica ao direito justinianeu. Esse viés tem significado importante e se faz necessário para a compreensão da temática. No mundo de antanho e até em épocas recentes, o casamento era a condição para a formação da família legítima. Nesse universo familiar, destacou-se a figura majestática do paterfamilias, do qual irradiavam poderes em todas as direções. Com o passar do tempo, aquelas antigas prerrogativas domésticas do pater foram atenuadas e algumas desapareceram, restando uma potestade humanizada que encontra guarida no poder familiar de nossos dias. O casamento romano constitui o objeto principal deste estudo. Nele serão destacadas as influências recebidas do cristianismo. Ambos deixaram fortes reflexos no ordenamento jurídico civil brasileiro, nos mais diversos aspectos, destacando-se os seguintes: definição, heterossexualidade da união, consentimento, capacidade (idade nupcial), monogamia, impedimentos matrimoniais, forma da celebração, extinção da união conjugal. A análise discorre sobre o matrimônio cristão, abrangendo sua origem mais incipiente, sua expansão até chegar à sua institucionalização sob a força do império romano, iniciada por Constantino e continuada pelos imperadores cristãos. A partir de então, foi consagrado como instituição e transformou o mundo. O casamento cristão é evocado desde seus fundamentos bíblicos, encontrados no livro do gênesis e outros textos sagrados, nomeadamente, em algumas passagens do evangelho de Jesus Cristo e nas cartas do apóstolo Paulo. Passou a ser indissolúvel à luz da doutrina cristã, contrastando com o ius romanum. Os escritos de padres da Igreja, ainda no mundo de Roma, contribuíram para essa transformação do casamento. Ela vai alcançar sua mais sólida estruturação no Concílio de Trento e, posteriormente, nas encíclicas papais, no Código de Direito Canônico e no catecismo da Igreja. Por fim serão abordadas as influências acolhidas pelo direito civil brasileiro. Na lei anterior (Código de 1916). esses influxos foram mais significativos, em razão de o casamento ser a única forma de constituição da família legítima, impondo a indissolubilidade da união. O Código Civil de 2002, além de derrogar essas características, estabeleceu várias inovações: o reconhecimento de outras entidades familiares, como a união estável e a família monoparental; mais significativamente, a possibilidade da dissolução da união. Contudo, aquelas antigas características, consagradas no direito romano e acolhidas pelo cristianismo em suas legislações, permaneceram: união heterossexual, capacidade dos nubentes, monogamia, impedimentos matrimoniais, imprescindibilidade do consensus das partes. Foram ainda preservadas, embora facultativamente, aquelas formas não jurídicas consagradas por Kronos: o cortejo nupcial, as alianças, o buquê de flores, os pajens, as testemunhas e o bolo de trigo.
This doctoral thesis has as its theme the Iustae nuptiae vel matrimonium: Roman law, Christianity and its effects on the Brazilian civil law. It begins by a small study on the Roman family, from the historical stage to justinian law. This approach has important significance and is necessary for understanding the subject. On the ancient world and even nowadays world, marriage was the condition for the formation of the legitimate family. In this familiar universe, the highlight was the majestic figure of the paterfamilias, radiating his powers in all directions. Over time, the old household prerogatives of the pater were attenuated and some disappeared, leaving a humanized authority which finds shelter in the family power of today. The Roman marriage is the main object of study. In this context the influence of Christianity will be highlighted. Both left a strong influence in the Brazilian civil law, in several respects, standing out the following: definition, heterosexuality marriage, consent capacity (marriageable age), monogamy, marriage impediments, the celebration form, the conjugal union extinction. The analysis discusses Christian marriage, from the earliest possible origin to the expansion to achieve its institutionalization under the force of the Roman Empire, starting with Constantine and continued by the Christian emperors. From then on, it was consecrated as an institution and transformed the world. The Christian marriage is evoked from its biblical foundations, found in the book of Genesis and other sacred texts, particularly in some parts of the gospel of Jesus Christ and in the letters of the Apostle Paul. It became indissoluble in the light of Christian doctrine, contrasting with the ius romanum. The writings of the Church Fathers, yet in roman world, contributed to this transformation of marriage. It will achieve its most solid structure in the Council of Trent and subsequently in papal encyclicals, the Code of Canon Law and the Catechism of the Church. Finally, there will be an approach of influences received are by the Brazilian civil law. In the previous civil law (1916), these influences were more significant, because marriage was the only way of incorporation of the legitimate family, imposing the indissolubility of marriage. The Civil Code of 2002, in addition suppressed these features, established several innovations: the recognition of other family organizations such as the cohabitation and single parent family; e more significantly, the possibility of the union dissolution. However, these old features embodied in Roman law and accepted by Christianity in its legislation remained: heterosexual union, the capacity of future spouses, monogamy, marriage impediments, indispensability of parties consensus. Were still preserved, although optionally, those not legal forms consecrated by Kronos: the wedding party, the covenants, the bouquet of flowers, the pageboys, witnesses and wheat cake.
