Texto completoThe notion of substantial denial of justice is problematic because it assumes the recognition of the international responsibility of the State in its judicial national sovereign decisions and thus the review, by an international jurisdiction, of the discretionary application of internal law by national judicial authorities. Attached to the notion of denial of justice in customary law, and historically linked to a fairly large and controversial perception of the protection that is required from States to foreigners on their territories, the notion of substantial denial of justice must still assert its influence in international conventional law, not only in the field of international investment protection but also, and foremost, in the area of human rights protection, because the stakes in that field are particularly important and the questions they raise are more relevant. Besides the study of the customary notion and its assertion as a form of denial of justice, the main point of this study is to highlight the existence of a general and subjective right to reasonable judgment, of which the definition allows to point out the limits of the normative power that the implementation of a standard provides to an international judge when he is called upon to review the internal regularity of national judgments

Texto completoMarseilles is 2600 years old but seems to have preserved only a few traces of its rich past and in any case is not known as a city with a rich heritage; however we should not conclude that its heritage is poor but rather ignored. Certainly, the City was marked by a restless history, but, what makes it very specific is definitely its pure disinterest for grand and monumental architecture, until the middle of the nineteenth century, and thereafter, its negligence and lack of attention towards its architectural heritage of which it did not completely become aware of the value. The peculiarities of this harbour City, for a long period, wholly devoted to the trade and the raw material transformation, explain this situation, so as its broad propensity to be opposed to any kind of tourist development. Tourism did not develop properly in Marseilles mainly due to the City profile considered not being very advantageous for its expansion, but also because of the Natives who did not make it easier in practice the least to facilitate this activity. Moreover the bad reputation and supposed absence of heritage and monuments were getting the situation even worse. Nevertheless, after a quarter of a century of crisis, the Phocean City, for these last ten years, has frankly reversed the tendency: Attractive, Marseilles sets up henceforth as a tourist capital; but, if its monuments and old Quarters are definitely valuated and put more and more in the lights, Marseilles does not seem to found its hopes like most of the western cities with a tourism based on its heritage. But Marseilles is on the eve of an exceptional event, which can be an opportunity to fully reconcile heritage and tourism. .

Texto completoWhile criticizing the Western morality anchored, according to him, in the Delphic sentence “Know yourself”, Nietzsche develops for his part an imperative which is, in our opinion, the natural and necessary extension of the self-knowledge. It is, therefore, from the injunction to become oneself that he operates the criticism of morality itself resulting from the invitation to self-knowledge. It is not, however, a question of reducing the Nietzsche an ethics of becoming-self to the way in which one can understand this syntagm in Plato. The use that Nietzsche proposes of it is indeed, in our opinion, quite singular. It cannot be denied, however, that it also did not come out of nothing and that Nietzsche first draws lessons from Pindar, who reinterprets himself the Delphic sentence, when he writes “Becomeas you have learned to know youself”. We therefore think that Nietzsche recovers Pindar’s formula beyond Plato, to criticize the latter and, through him, the whole philosophy which made self knowledge the departure of ethics. But we would therefore also try to do justice to Plato, since his philosophy actually frees the possibility of becoming ourself

Texto completoThis thesis traces the steps of creating a projective device for exploring the self-archaic of an adult subject. Its development is the result of several former studies from various groups: adult subjects with no pathology recognized, young psychotic adults and/or borderlines, and adult paraplegic subjects. The device created for this research has evolved into an exploration and mediation tool used for many years as part of my therapeutic group of patients, mostly suffering from identity narcissistic disorders.Photographs of space, mostly taken by the CNRS or NASA with different telescopes, are used a carrier. With these photographs, the visual impact is undeniable. "What does the Universe mean to you?": The use of photographs of various celestial objects as projective medium to respond to a latent question about subjectivity, mobilizes thinking in images and comes to question the sense of self, archaic and current. The photographs offer a representation of native experiences, cosmic metaphors already presented in the psychoanalytic literature (Anzieu and formal signifiers, Aulagnier and the black hole of the psyche... These favor an imaged scene of early interactions.The EPSA device is an "attractor" seeking the projection of an "uncreated" image, an experience in default of symbolization. The EPSA malleability allows the patient to put into shape the uncreated, to tell the story of what he does not know of himself and that haunts him. The subject projects into the EPSA a psychic atmosphere, a trace of an emerging self with an operation that is sometimes problematic, in which appears "processes" of transformation.EPSA explores the reflexive capacities of the subject: the subject ability to be able to develop or not an aesthetic conflict, management and expression of conflict. It is also explores the ability to "reason" emotionally, to be in touch with his emotions, to experience them, to feel oneself, to see oneself, and "to express" his emotions (Three "degrees" of symbolization).The maturity of the archaic self and its expression (emotional maturity of the sense of self) can be defined as the tolerance and acceptance of affects, emotions, and feelings... caused by conflicts to think about oneself. In this way, the subject avoids being "overwhelmed" emotionally and inhibition. The mental and verbal elaboration of conflicts provides for sharing and communication with others.EPSA allows us to observe in adults the relationship in the early stages of development disorders: treatment of affect, early interactions, and disorders due to deficiencies in the tuning... EPSA is an exploration of an important tool in the construction of subjectivity processes, and refines our clinical look on narcissistic identity disorders, borderline condition, and disease of addiction...The EPSA device, which proposes the patient to imagine his impressions, enables the patient to put words to his thoughts. It is a creative space in which we found and create. A symbolizing device which encourages sharing and meeting. It is an "objeu", a therapeutic carrier. Finally, EPSA is a mirror of oneself, and also a tool of "transformation" of symbolization

First, we explore and present current psychoanalytic concepts and theories on the sexual life of women, either in the East or in the West. Second, we study these clinical reports in light of what we have found in literary tales, in sociological research, and in the literature on psychoanalysis, and we try to answer the following question: Why do women, who have the same family, socio-cultural and economic profiles, and who we can can call (apparently) modern, show similar failures in what regards their simple sexual lives? Hence the title of our research is: The categories of denial of sexuality for women in the Middle East

Texto completoThe main question of this thesis could be put into these words : can violence at school be considered as the result of a lack in teachers's training ? Therefore we have analyzed the different programm contents both in initial and adult training, proposed by "IUFM" (Teacher-training colleges) but also by academic training curricula. This analysis has been cross-checked with interviews with primary school teachers regarding their relation to violence and to their own training. This confrontation has shown, in systems and in speeches, a series of anthropological lacks regarding the educational relation. So we propose the hypothesis of an "institutional denial" process regarding these dimensions, since it's their very reality which is put aside. Therefore, the construction of an "aware professionalism" happens through a training which would include these dimensions, as some experiments we will describe later can show us. This thesis is composed of three parts. The first one questions violence from a multi-disciplinary point of view of definition, then suggests an interpretation of some acts of violence as institutional "analysers". The report on an instrumental act of violence will lead us to approach the issue of teachers' training about violence in the second part. The denied anthropological dimensions will be unfolded in this part. We will extend the "charges against training" to the different "formative moments" one teacher may experience in the exercice of his/her duties. This leads us, in the third part, to suggest an approach to the training under the "pathematic training" syntagm, by inspiring us from institutional methods (OURY movement)

Six experiments tested the effects of contextual factors (the order of presentation of the two modes of reduction, delayed assessment) on the use of the modes of reduction, in particular the denial of responsibility. The seventh experiment tested and supported the hypothesis that denial of responsibility reduces the negative affective state induced by dissonance. Texto completoThis thesis, which fits in the psychoanalytically-oriented clinical field of Éducationand training sciences, proposes to analyze the ways in which the pupil-self unwittingly influences the teacher in his or her professional practice. The thesis is divided into five parts.The first part is devoted to the construction of the research object. In particular, the researcher explores the concepts of pupil-self and teacher-self. The second part is devoted to the theoretical framework within which this research is embedded. In particular, the researcher describes his encounter with psychoanalytic knowledge, and then explores the question of the « scientificity » of the approach in all its singular and specific aspects. The theoretical framework thus established makes it possible to clarify the relationship between the researcher and his object-subject of research, and to show how the singular construction of his relationship to knowledge expresses itself unbeknownst to him in his professional practice.The third part presents the methodology used for data collection and analysis, i.e. the practice analysis groups, the subsequent notes, and the work in a supervision group, which, among other things, enables the elaboration of counter-transference.Using situations from groups of professionnel practices analysis groups that the researcher has led, he reports on the work of elaboration that underlies the psychoanalytically-oriented clinical approach, in order to perceive how the pupil-self unconsciously expresses itself in the teachers or trainers practices.The fourth part is devoted to a clinical research interview with a secondary school history-geography teacher. Using the analyzed material, the researcher examines the ways in which her pupil-self guides her professional practice and pedagogical choices. In the fifth and final part, the concepts that emerged during the research are explored in greater depth to thoroughly underpin the analyses, as well as to propose some perspectives for teacher training and research
