AbstractIus Constitutionale Commune in Latin America (ICCAL) is an academic endeavour that attempts to provide an account of the original Latin American path of transformative constitutionalism, comprising elements from national, transnational and international legal orders, and where the law is placed at the service of the normative trinity of constitutionalism, namely the rule of law, democracy and human rights. In this regard, ICCAL speaks of an Inter-American law that represents a new legal phenomenon, in a region where constitutionalist ideas have allegedly claimed new traction. In this article, I develop two main critiques that can be deemed challenges for an academic project that is still ‘under construction’, and provide an intellectual map of Latin American constitutionalism that could address these critiques and serve as a roadmap for studying potential Latin American contributions to debates around global constitutionalism.

Abstract In this article, we study Latin American populist constitutions and their uses, seeking to analytically understand whether populist constitutionalism is, indeed, a thing. We posit that Latin American populist constitutionalism is a particular form of mixed constitutionalism in three senses: first, as a specific combination of substantive traits that includes both empowering and (some) constraining devices; second, as a peculiar politics of constitutional change that incorporates popular mobilization against pre-existing institutions as a key trait; and third, as a particular practice of constitutional enforcement that involves weak and selective implementation, often through institutional capture. By considering not only the texts of constitutions but also the ways in which they are changed and implemented, we hope to complement legal perspectives of mixed constitutions with a sociopolitical analysis of practices and contexts. By capturing the distinctive contribution of Latin American populism to the discussion of mixed constitutions, we seek to challenge both legal conceptions of constitutionalism that reduce it to negative or constraining features, and political conceptions of populism that simply equate it to authoritarian rule.

Crisis del Estado Social en Europa: efectos en la generación del constitucionalismo social en América Latina Resumen: En Europa el Estado social se está erosionando frente a una sociedad que por un lado está perdiendo la motivación, mientras que por otro intenta resistir. Fruto de la debilidad de las disposiciones del constitucionalismo social, el modelo europeo de Estado social experimenta un proceso de transformación del que puede salir absolutamente erosionado, o puede superarse a sí mismo a través de más democracia, una Constitución más normativa y la plena exigibilidad de los derechos sociales. En América Latina, la falta histórica de experimentación plena del Estado social ha sido determinante en la aparición desde finales del siglo XX de nuevas Constituciones democráticas. Estas tienen ante sí el reto, nada fácil, de construir un modelo propio de Estado social adecuado a las necesidades de las sociedades latinoamericanas. En este contexto, el objeto del presente trabajo es analizar las diferencias en la construcción constitucional y evolución del Estado social en Europa y en América Latina, y explicar por qué en Europa podemos referirnos a una crisis del Estado social, mientras que en América Latina asistimos a diversos intentos de generación de un modelo propio de Estado social basado, en algunos países, en nuevos textos constitucionales que tienden hacia la superación de los modelos comparados de constitucionalismo social. En el primer apartado se analizan las razones de la crisis del Estado social en Europa y los retos hacia su superación. En el segundo apartado desarrollamos la problemática latinoamericana en la construcción de su propio modelo de constitucionalismo social, para concluir con el análisis conjunto de las dos experiencias. Crisis of welfare state in Europe: effects on the generation of the social constitutionalism in Latin America Abstract: The European Welfare State is falling; a part of the society is losing motivation, while the other part tries to resist. As a result of the weakness of the provisions of social constitutionalism, the European model of welfare state undergoes a transformation process with two alternatives: be finished, or be strengthened with more democracy, a more normative Constitution, and full guarantees for social rights. In Latin America, the historical lack of full experience of the Welfare state has been decisive in the appearance of new democratic Constitutions since the end of the 20th century. These Constitutions have the challenge, not easy, to construct a model of social state adequate to the needs of Latin American societies. In this context, the object of the present work is to analyze the differences in the constitutional construction and evolution of the social State in Europe and Latin America, and to explain why in Europe we can refer to a crisis of the social State, while in Latin America we attend to various attempts to generate a model of social state based, in some countries, on new constitutional texts that tend towards overcoming the comparative models of social constitutionalism. In the first section we analyze the reasons for the crisis of the social State in Europe and the challenges to overcome it. In the second section we develop the Latin American problematic in the construction of its own model of social constitutionalism, to conclude with the joint analysis of the two experiences. RESUMO:A história do direito demonstra a estreita relação do Direito com a dominação de povos subalternizados e a legitimação de atos opressores, instituídos em benefício de interesses econômicos. Diante disso, a busca por um direito descolonial mostrase urgente. Para tanto, são analisadas as origens epistemológicas do direito, do constitucionalismo, dos direitos humanos e da dignidade humana, indagando se o Novo Constitucionalismo Latino-Americano seria um passo rumo à descolonização do direito. Isso porque este movimento ainda contempla um paradigma que vai de encontro às premissas dos sistemas constitucionais tradicionalmente adotados. O Novo Constitucionalismo Latino-Americano se caracteriza por constituições que inserem epistemologias indígenas em seus textos, aportando um conceito de viver bem mais amplo que o do liberalismo. As epistemologias do Sul, ao serem constitucionalmente introduzidas, exibem potencial para lidar com os dilemas da sociedade global. A urgência de se interrogar sobre um Direito pautado nas epistemologias do Sul advém da inquietação quanto às promessas não cumpridas da modernidade, que convocam o Direito a acolher estas epistemologias como seu fundamento. ABSTRACT:Legal history established a strong link between Law, subaltern’s domination, and the legitimation of oppressive acts to the benefit of economic interests. Taking this into account, the need to decolonize Law is urgent. For that reason, we intend to analyze the epistemological origins of law, constitutionalism, human rights and human dignity, questioning whether the New Latin American Constitutionalism is a step towards to the decolonization of Law. The motivation that lies behind that question is the convergence of New Latin American Constitutionalism with the premises held by traditional constitutional systems. Latin American constitutionalism marks itself by inserting indigenous epistemologies into constitutional texts and bearing a concept of good living that surpass the liberal conception. The constitutionalization of Southern epistemologies has also shown potential in dealing with global society dilemmas. The urgency to consider a legal system based on the epistemologies of the South derives from the unfulfilled promises of modernity, which requires Law itself to account for these alternatives as its foundation.

Abstract This article focuses on Latin American constitutionalism with two goals in mind. The first goal is to identify narratives of constitutional mixity or hybridity that have been influential in Latin America, something that habilitates a comparative analysis with references to mixed or hybrid constitutionalism in other scenarios. One narrative underlines the combination of U.S.-inspired constitutionalism with background civil law systems. Another narrative highlights the way classic regional constitutional designs feature a liberal-conservative hybridation that, some claim, continue to influence constitutional dynamics up to this day. And the third narrative is associated with the establishment in regional countries of hybrid or mixed systems of judicial review. The second goal of the article, more methodological in kind, is to explore what do Latin American narratives on mixity teach in the way to clarifying the nature and implications of exercises constitutional taxonomy. As it emerges, constitutional taxonomy is a way of organizing and generating knowledge which is useful to describe, but most meaningful when addressed to provide an explanation, which is often just an antechamber to normative evaluation. Whether a particular exercise of constitutional taxonomy makes sense in a particular scenario, however, is a different matter, and the article suggests that describing, explaining and evaluating Latin American constitutions as hybrid is illuminating but also problematic in a number of ways.

O debate sobre o pluralismo jurídico no contexto político e social latino-americano não é recente, de modo que suas percepções foram renovadas a partir do movimento neoconstitucionalista operado no continente, responsável por desencadear alternativas epistêmicas para se pensar a efetividade dos direitos humanos e dos direitos de cidadania, tudo a partir da lógica de emancipação social e descolonialidade, como possibilidade de rompimento com o constitucionalismo tradicional, de cunho conservador, hegemônico e colonialista. Em termos gerais, como uma das respostas à concepção juspositivista, o pluralismo jurídico surge como modelo de pensamento para a práxis dos direitos humanos, em face de uma sociedade na qual impera a lógica das exclusões concretas em contrariedade às inclusões abstratas. In general terms, as one of the answers to the juspositivist conception, legal pluralism emerges as a model of thoughtfor the practice of human rights, in the face of a society in which the logic of concrete exclusions prevails in opposition to abstract inclusions. Thus, based on the bibliographic approach, this work proposes to offer reflections on the current state of human rights culture in Latin America, focusing on the epistemological contributions arising from the critical theory of human rights and legal Wolkmer’s pluralism.Keywords: Legal Pluralism. Since the renewal of constituent power in the 1991 Colombian constitution, various democratic constitutions in Latin American countries have undertaken important structural changes in both the organization of public powers, the democratic legitimacy of power, and the constitutional reform of rights. Among these new constitutional texts in Latin America, the 2008 Ecuadorean constitution, with sumak kawsay (living well) as its axiological basis, stands out for its originality and theoretical advances as the first case of transitional constitutionalism. All these constitutions, however, are faced with an enforcement problem that hinders their operation as instruments of social transformation. Desde la renovación del poder constituyente en la Constitución colombiana de 1991, varias constituciones democráticas en los países de América Latina han llevado a cabo importantes cambios estructurales tanto en la organización de los poderes públicos, la legitimidad democrática del poder, y la regeneración constitucional de los derechos. Entre estos nuevos textos constitucionales en América Latina, la constitución de Ecuador 2008, con el sumak kawsay (buen vivir) como su base axiológica, destaca por su originalidad y avances teóricos como el primer caso de constitucionalismo de transición. Todas estas constituciones, sin embargo, se enfrentan a un problema de aplicación que dificulta su funcionamiento como instrumentos de transformación social.

Abstract Latin America played a crucial role in furthering the cause of human rights at the nascent United Nations (UN) when great powers were mostly interested in limiting the scope to issues of collective security. Following this line of thought, this article aims to understand the Latin American contributions to the promotion of ESCRs in both global and regional debates by tracing the figure of the Chilean diplomat Hernán Santa-Cruz and his efforts as both a drafter of the Universal Declaration of Human Rights (UDHR) and founder of the Economic Commission for Latin America and the Caribbean (ECLAC). In Santa-Cruz’s silhouette we can find a vivid example of Latin American thought regarding social rights, marked by the intersections and contradictions of regional discourses such as social Catholicism, socialist constitutionalism, and developmentalist economic theories.

Thus, the 88’s Brazilian Constitution proceeded to the recognition of the fundamental rights and norms regarding theprotection of minority rights. The purpose of this work is to investigate if this supposed innovative characteristic of the 88’s Brazilian Constitution is able or not to set historicalconstitutionalism as the continuity or maintenance of the conservative processes of the politicaland social status quo in the country. This article intends to discuss the nature of constitutional changes and the impacts of these changes on the development of constitutionalism in Brazil by analyzing the extent to which political, social, and cultural latin-american processes influenced changes in Brazilian constitutionalism.

Resumo: Os países da América Latina estão regidos por uma ordem constitucional comum, especificamente a que decorre dos tratados internacionais sobre direitos humanos. Com efeito, conforme a tendência do bloco de constitucionalidade, além das respectivas constituições, vários países latino-americanos conferem aos tratados internacionais a mesma hierarquia das normas constitucionais quando têm por objeto os direitos humanos. A relevância da pesquisa decorre em razão de a supremacia constitucional ir além das prescrições constitucionais para as normas internacionais que promovem os direitos humanos. Aborda-se o conceito material de direitos humanos a partir da carga valorativa dos bens jurídicos mais relevantes para a sociedade, em especial, os valores da dignidade humana, vida, liberdade e igualdade, de modo que os direitos humanos seriam os daí imediatamente decorrentes. Analisa-se a tendência dos Estados latino-americanos de respeitarem os tratados internacionais sobre direitos humanos como se fossem normas constitucionais, com especial atenção a respeito da experiência brasileira. A pesquisa é bibliográfica, descritiva, e tem-se a finalidade de aprimorar o conhecimento sobre o tema. Ao final, conclui-se que surge na América Latina a primeira ideia de uma Constituição Internacional Comunitária, em face da prevalência dos direitos humanos no cenário supranacional.Palavras-chave: Direitos Humanos. Este trabajo tiene por objetivo analizar el agravamiento de los problemas de la administración y las políticas públicas en el Estado latinoamericano para delinear las posibles soluciones. Desde una perspectiva histórica de análisis se inicia haciendo una revisión al sistema político, el constitucionalismo latinoamericano, la evolución de la política económica en América Latina y su impacto en el crecimiento económico y el desarrollo social principalmente en las crisis financieras y presidenciales latinoamericanas. También se analizan las generaciones de reformas del Estado enfatizando los programas de ajuste estructural, estabilización económica, apertura comercial, privatización, la política de competencia en la promoción de la competitividad y se determinan los grandes desafíos de América latina y el Caribe: Pobreza y desigualdad, democracia participativa, política social y modernización del Estado Social. Posteriormente se analiza el impacto de las reformas de la segunda generación: La reforma institucional del Estado y el desarrollo de las instituciones, descentralización, implantación y fortalecimiento de mecanismos de gobernabilidad. Finalmente se analiza el rol que tiene la sociedad civil y la tutela del hermano mayor en el agravamiento de los problemas del Estado, la administración y las políticas públicas.ABSTRACTThis paper has the aim to analyze the aggravating of problems in public administration and policies in the Latin American State to draw the possible solutions. From a historical perspective of analysis it begins reviewing the political system, the Latino American constitutionalism, the evolution of the economic policy in Latin America and its impact in the economic growth and social development mainly in the Latin American financial and presidential crisis. Also it analyzed the generations of State reforms emphasizing the structural adjustment programs, economic stabilization, commercial openness, and privatization and political competition in the promotion of competitiveness and it is determined the big challenges of Latin America and the Caribbean: Poverty and inequality, participative democracy, social policy and modernization of Social State. Later it is analyzed the impact of second generation reforms: The institutional State reform and institutional development, decentralization, implementing and strengthening of governance mechanisms. Finally it is analyzed the role that has the civil society and tutoring of the big brother in the aggravating of the State problems, public administration and policies.

Diverse existing legal paradigms have dealt with the interaction of humans and Nature in different ways. We identify three main lenses through which current constitutional systems in Latin America have operated to resolve conflicts. We focus on rivers as emblematic elements of Nature that offer concrete possibilities to operationalize an emerging paradigm that recognizes legal personhood for Nature. The objective is to examine, from a critical interdisciplinary perspective, the existing paradigms, describe their limits and open the debate to alternative jurisdictional venues for favouring the coexistence of humans and natural systems. Through the comparative analysis of three case studies in Chile, Colombia and Ecuador, we outline the challenges and opportunities offered by an emerging legal tradition, ‘The New Latin American Constitutionalism’, and question what would effectively be different with a change of paradigm towards the recognition of Nature’s rights.

Resumo: As diversas dimensões que caracterizam o emergente Constitucionalismo do século XXI – política, social, econômica, ambiental e cultural – transformam em desafio as ações do Estado, que implicam os processos decisórios coletivos da sociedade contemporânea. É nesse ambiente que o presente artigo tem por objetivo levantar e discutir apontamentos interdisciplinares ao estudo da Democracia e do Constitucionalismo Latino-americano, prestigiando o pensamento crítico sobre e necessária relação entre multiculturalismo e os (novos) direitos como a educação em Direitos Humanos. Para que isso seja possível, são trabalhadas, inicialmente, as noções de multiculturalismo e tensões no Estado Constitucional. É diante de sociedades plurais que são (re)tencionadas as representaões políticas das Instituições Democráticas, exigindo-se, naturalmente, um espaço contramajoritário como exercício de soberania popular. Como resposta a estas condições, é proposto o estudo qualitativo sobre inclusão social e educação em Direitos Humanos como mecanismos viáveis de atuação de um Estado Democrático de Direito. Em outras palavras, é justamente diante do ambiente latino-americano que se pode compreender os (novos) direitos como mecanismos de enfrentamento de tensões entre democracia e constitucionalismo emergente. E mais: é preciso saber como canalizar as instituições para a promoção de mecanismos de inclusão social e construção da cidadania. Sequencialmente ao referido raciocínio, são apontados, criticamente, alguns desafios deste século, para uma educação plural e cidadã como exemplo de (novos) direitos, entre os quais se destaca a educação em Direitos Humanos. Esta análise crítica justifica-se pela necessidade do avanço do conhecimento científico no ambiente de estudo metodológico como forma de tutela estatal diante do multiculturalismo latino-americano. Abstract: The various dimensions that characterize the emerging Constitutionalism twenty-first century - political, social, economic, environmental and cultural - turn to challenge the State's actions, involving the collective decision-making processes of contemporary society. It is in this environment that this article aims to raise and discuss interdisciplinary notes the study of Democracy and Constitutionalism Latin American and prestige critical thinking about and necessary relationship between multiculturalism and the (new) rights such as education in human rights. For this to be possible, they are worked initially, the multiculturalism of notions and tensions in the Constitutional State. It is in front of plural societies that are (re) tensioned political representations of Democratic Institutions, demanding, of course, a contramajoritário space as popular sovereignty exercise. In response to these conditions, the qualitative study on social inclusion and education in human rights as viable mechanisms of action of a democratic state is proposed. In other words, it is just before the Latin American environment that one can understand the (new) rights as stress coping mechanisms among emerging democracy and constitutionalism. Plus, you need to know how to channel the institutions to promote mechanisms for social inclusion and empowerment. Sequentially to that reasoning, are singled out, critically, some challenges of this century, for a plural and citizenship education as an example of (new) rights, among which stands out education in human rights. This critical analysis is justified by the need for the advancement of scientific knowledge in the methodological study environment as a form of state supervision on the Latin American multiculturalism.

<p><strong>RESUMO:</strong></p><p><span id="docs-internal-guid-be91bd97-6d94-fd9c-591a-562fe190c315"><span>O presente trabalho pretende analisar o tratamento jurídico da dignidade da pessoa humana a partir do constitucionalismo latino americano. Num primeiro momento, verificar-se-á a essência da dignidade humana para o direito através de uma rápida evolução conceitual com base na história e na filosofia. Num segundo momento, o artigo abordará o movimento do chamado novo constitucionalismo latino-americano, a fim de verificar as possibilidades de inserção da Constituição brasileira de 1988. Por fim, far-se-á uma análise crítica da forma que a dignidade da pessoa humana vem sendo interpretada no instituto denominado Estado de Coisas Inconstitucional, especialmente nas decisões da Corte Constitucional da Colômbia e do Supremo Tribunal Federal. O desfecho da investigação pretende comprovar que há um simbolismo na decisão que adota o Estado de coisas inconstitucional em prol do respeito à dignidade humana.</span></span></p><p><strong>ABSTRACT:</strong></p><p dir="ltr"><span>The present work is intended to analyze the legal treatment of the dignity of the human being from the Latin American constitutionalism. In the first instance, an essence of human dignity will be verified for the right through a rapid conceptual evolution based on history and philosophy. In a second moment, the article approaches the movement of the new Latin American constitutionalism, objecting to verificate the possibilities of insertion of the Brazilian Constitution of 1988. Finally, it will be done a critical analysis of the form that a dignity of the human person has been interpreted, especially in the decisions of Constitution Court of Colombia and the Supreme Court of Brazil. The outcome of the investigation is intended to prove that there is a symbolism in the decision that adopts the unconstitutional state of affairs in favor of respect for human dignity.</span></p><div><span><br /></span></div>

The processes of constitutional change and resultant constitutional models initiated in Venezuela, Bolivia, and Ecuador since the late 1990s have been celebrated for offering a democratic form of constitutionalism. The new Latin American constitutionalism promises to resolve the democratic deficit in traditional constitutional theory by institutionalizing spaces for citizen-led constitutional change. However, events in which actors outside the state or without the wider support of the state have attempted to initiate similar processes of constitutional transformation suggest a problem with current theories. This is a residual bias toward state actors and a tendency to underestimate the power of extrainstitutional actors in these processes. By reconceiving the central concepts of “constituent power” and “constitutional process,” an account of the new Latin American constitutionalism is possible that both resolves remaining tensions in the literature and illustrates the relevance of this phenomenon to struggles across the continent. Los procesos de cambio constitucional y los modelos constitucionales resultantes iniciados en Venezuela, Bolivia y Ecuador desde fines de la década de 1990 se han celebrado por ofrecer una forma democrática de constitucionalismo. El nuevo constitucionalismo latinoamericano promete resolver el déficit democrático en la teoría constitucional tradicional mediante la institucionalización de espacios para el cambio constitucional liderado por los ciudadanos. Sin embargo, eventos en los cuales actores fuera del estado o sin el apoyo más amplio del estado han intentado iniciar procesos similares de transformación constitucional sugieren un problema con las teorías actuales. Este es un sesgo residual hacia los actores estatales y una tendencia a subestimar el poder de los actores extrainstitucionales en estos procesos. Al reconcebir los conceptos centrales del “poder constituyente” y el “proceso constitucional,” es posible hacer un recuento del nuevo constitucionalismo latinoamericano que resuelve las tensiones restantes en la literatura y demuestra la relevancia de este fenómeno para luchas en todo el continente.

The article aims to evaluate whether and how constitutional replacements influence the quality of democracy in Latin American countries. The fuzzy-set qualitative comparative analysis method is applied while analysing 18 Latin American countries. The objective of the article- nine new constitutions that are assigned to the new constitutionalism period. The results reveal that constitutional replacements are neither sufficient nor necessary condition for quality of democracy. On the contrary, the parsimonious solution shows that quality of democracy can be explained by both high levels of education and inversion of constitutional replacements and inversion of constitutional replacements, institutionalised party system and non-homogeneous society. Inversion of quality of democracy analysis indicated that constitutional replacements, together with other conditions, form sufficient conditions for inversion of quality of democracy.

O artigo faz uma reflexão sobre os direitos humanos, tomando como referencial de análise sociocultural o Brasil, país caracterizado pelo histórico de exclusão econômico- social e fragilidade dos mecanismos democráticos de participação popular nos processos de criação, efetivação e controle social das políticas públicas. O método de análise empregado foi o dialético-comparativo utilizando-se de pesquisa bibliográfica e documental na construção de uma abordagem interdisciplinar que tomou em consideração a complexidade dos aspectos jurídicos, sociológicos e econômicos do tema abordado. O pressuposto teórico adotado questiona o conteúdo político-jurídico universalista expresso nas declarações dos direitos humanos, por entender que as condições materiais e socioculturais que fizeram surgir a democracia representativa e balizadora dos direitos humanos, em países marcados por revoluções econômicas, tensões e conflitos de classe, como Inglaterra e França, não ocorreram no mesmo tempo e da mesma maneira em relação ao Brasil, por exemplo, país marcado por um longo processo de colonização e instabilidade democrática. As recentes experiências de democratização política e constitucionalismo latino-americano abrem perspectivas inovadoras de criação, defesa e promoção de direitos humanos.Palavras-Chaves: Direitos humanos fundamentais. AbstractThe article makes a reflection on human rights taking Brazil as historical and socio-cultural reference, a country which historic is characterized by history of economic and social exclusion and fragility of the democratic mechanisms of popular participation in the processes of creation, effectiveness and social control of public policies. The method employed was the dialectical -comparative using bibliographical and documentary research in the construction of an interdisciplinary approach that took into account the complexity of the juridical, sociological and economic aspects of the subject. The theoretical assumption adopted questions the universalist political-juridical content expressed in the human rights declarations, since it understands that the material and socio-cultural conditions that have given rise to representative democracy and are landmark to human rights in countries marked by economic revolutions, tensions and class conflicts, such as England and France, did not occur at the same time and in the same way in relation to Brazil, for example, a country marked by a long process of colonization and political instability. Recent experiences of Latin American political democratization and Latin American constitutionalism open up innovative perspectives for the creation, defense and promotion of human rights.Keywords: Fundamental human rights. El método de análisis empleado fue la comparación dialéctica mediante la investigación bibliográfica y documental sobre la construcción de un enfoque interdisciplinario que tuvo en cuenta la complejidad de los aspectos jurídicos, sociológicos y económicos del tema tratado. El supuesto teorico adoptado inquire el contenido política y jurídica universalista expreso en las declaraciones de derechos humanos, entendiendo que las condiciones socio-culturales materiales y que dio origen a la democracia representativa y balizadora de los derechos humanos en los países marcados por las revoluciones económicas, las tensiones y los conflictos de clase como Inglaterra y Francia, no se produjo al mismo tiempo y de la misma manera en relación a Brasil, por ejemplo, un país marcado por un largo proceso de colonización y la inestabilidad democrática. Las experiencias recientes de democratización política y el constitucionalismo latinoamericano ha abierto perspectivas innovadoras de creación, defensa y la promoción de los derechos humanos.Palabras Clave: Derechos humanos fundamentales. Throughout its history, the Inter-American Court of Human Rights has ruled in a significant number of cases on the state's obligations to investigate and prosecute grave human rights violations and international crimes. Regardless of the existence of this body of international jurisprudence, an important question remains unanswered: Can the Inter-American Court's decisions have any significant normative impact on national jurisdictions when it comes to the prosecution of international crimes? This article argues that such an impact is possible provided that the national courts have a specific judicial identity, better associated with the idea of neo-constitutionalism. In this context, international law and regional human rights jurisprudence becomes a relevant argumentative resource, which can be incorporated into judicial decisions in order to ensure the effective prosecution of gross human rights violations and international crimes.

Este artigo busca apresentar reflexões em torno do conceito de Buen Vivir e sua interface com a comunicação popular, como resposta à crise sistêmica atual e ao modelo capitalista, tomando como exemplo teórico e prático a Associação Latino-Americana de Educação e Comunicação Popular (ALER). A partir de revisão bibliográfica e entrevistas, este texto levanta discussões em torno do Buen Vivir, que tomam corpo com o Novo Constitucionalismo Latino-Americano; também sobre os debates em relação à comunicação popular e modelos de desenvolvimento; e, por fim, apresenta elementos e formulações construídos no interior da ALER, que tem o Buen Viver como o eixo central de sua construção política e comunicacional atual. Assim, busca-se trazer reflexões urgentes e necessárias para se pensar novas formas de vida em sociedade e de práticas comunicacionais que refletem essa demanda. <p>This article carries out an approach to the constitutional evolution of the rights of the indigenous peoples of the Peru. Also, examines how much it has advanced in the establishment of the guarantees of the cultural plurality of the indigenous peoples; in particular, the relative to the recognition of the cultural diversity of the Nation, the juridical-political status of the indigenous peoples, the protection of the territorial rights and the plural justice. Likewise, analyzes the demands of constitutionalization of rights of the Andean and Amazon indigenous peoples, and the juridical-political barriers that have not allowed the statement of their rights in the national legal system until the moment. Lastly, makes a critical reflection on the perspective of the rights of the indigenous peoples, starting from the indigenous perception on the statement of their rights and their vision on the constitutionalization of their rights in the context of the Latin American constitutionalism of the multicultural constitutionalism toward the constitutionalism plurinational.</p><p><strong>Published online</strong>: 11 December 2017</p>

Resumen: En el presente ensayo sugerimos algunas ideas preliminares para un balance de la participación y su relación con el presidencialismo en el nuevo constitucionalismo latinoamericano, con especial énfasis en el caso de Ecuador que durante la última década promulgó una de las Constituciones con mayores innovaciones en la región. Para este balance se realiza una contextualización básica del nuevo constitucionalismo latinoamericano y luego se analiza el desarrollo de la participación en Ecuador luego de promulgada la Constitución. Este análisis de la participación se lo relaciona con ámbitos claves como la política económica (especialmente minería, empresas públicas, formas cooperativas de economía) y la plurinacionalidad (especialmente justicia indígena y educación). Se describen y examinan críticamente casos hitos que por su importancia reflejan tendencias estructurales durante la vigencia de la Constitución ecuatoriana del 2008 hasta el presente.Abstract: In the present essay we suggest some preliminary ideas for a balance of participation and its relation to presidentialism in the new Latin American constitutionalism, with special emphasis on the case of Ecuador, which during the last decade promulgated one of the Constitutions with the greatest innovations in the region. For this balance, a basic contextualization of the new Latin American constitutionalism is made and then the development of the participation in Ecuador is analyzed after the promulgation of the Constitution. This analysis of participation is related to key areas such as economic policy (especially mining, public enterprises, cooperative forms of economy) and plurinationality (especially indigenous justice and education). For that, the cases that, due to their importance, reflect structural tendencies during the validity of the Constitution of Ecuador from 2008 to the present are described and critically examined.Resumo: No presente ensaio sugerimos algumas idéias preliminares para um balanço da participação e sua relação com o presidencialismo no novo constitucionalismo latino-americano, com especial ênfase no caso do Equador que, durante a última década, promulgou uma das Constituições com as maiores inovações na região. Para este balanço, é feita uma contextualização básica do novo constitucionalismo latino-americano e, em seguida, o desenvolvimento da participação no Equador é analisado após a promulgação da Constituição. Esta análise da participação está relacionada a áreas-chave como a política econômica (especialmente mineração, empresas públicas, formas cooperativas de economia) e a plurinacionalidade (especialmente a justiça e a educação indígenas). Constitutionalism in Mexico, indeed in Latin America generally, has always posed a problem for interpreters, especially for Anglo-American interpreters. It is true that adherence to a written constitution and to constitutional order has been central to Mexican political liberalism since independence. As a state-building philosophy, liberalism has functioned both as an ideology, in combat with inherited colonial and Hispanic patterns of government, and as an all-embracing myth serving to unify contending self-defined liberal factions. In both instances, liberals fought for, debated, and on occasion were able to implement basic Western constitutional principles, namely, the preservation of individual liberty and legal equality within a representative government whose powers were set out and limited in the articles of a written document. The problem of interpretation arises because of a widespread view that constitutional government in Mexico has been ineffective or, at best, that the struggle to achieve it has been arduous.

Abstract:Contemporary scholarship mainly focuses on the crisis of political representation as the key facilitator behind the emergence of populism. If so, populism urges public law to revisit and rethink institutional designs. This article addresses two possible responses to populism. On one hand, an intuitive response could be to hamper popular participation by avoiding plebiscites, referendums or any other kind of public consultation. Alternatively, it is possible to respond to populism from a structural point of view. In my opinion, to resist populism public law should take into account the lack of responsiveness and accountability of representative systems. The article puts forward a proposal in that direction; it advances a response to populism consisting of new institutional systems that generate strong participatory mechanisms to incorporate ‘the popular’. In doing so, the article uses the new Latin American Constitutionalism as an example of both the potentialities and difficulties of designing institutional systems in public law. In the wake of rising populism, it contributes to the existing debate by criticising populism and its constitutional expression, as well as developing arguments in favour of popular constitutionalism.

Resumo: Este artigo pretende avaliar a proposta do constitucionalismo latino-americano e do constitucionalismo popular como possibilidade de se repensar as democracias constitucionais contemporâneas, fundamentadas na presença da cidadania na definição da política e da Constituição. A partir disso, analisa em que medida a democracia brasileira pós- 88 obteve resultados positivos no que se refere a participação popular na vida política e na construção dos direitos constitucionais, verificando qual contexto permitiu a derrubada do Decreto-Lei 8.243/2014. Identifica, por fim, os limites institucionais existentes à participação do cidadão na política, sem deixar de perceber prelúdios de uma potencialidade democrática ainda a ser experimentada. Abstract: This article intends to evaluate the Latin-American and Popular constitutionalism proposals as possible ways to rethink contemporary forms of constitutional democracy based on the fundamental principle of citizen participation in the construction of Politics and Constitutional laws. From this, it analyses the extent to which the Brazilian democracy pos-1988 generated positive outcomes in terms of popular participation in its political life and in the establishment of constitutional rights, considering the context that led to the overturn of the Executive order n. 8,243/2014. At last, it identifies existing institutional limitations to citizen participation in politics, while considering the preludes of a democratic potential yet to be experienced.

Based on the study of some Brazilian cases submitted to the Inter-American Commission on Human Rights, this article aims to identify proposals to overcome common Latin- American challenges in the implementation of international recommendations. In the first part, in a retrospective analysis, several emblematic Brazilian cases and their domestic impacts and changes are addressed. In a second part, with a prospective view guided by the domestic contributions to which the Inter-American System is oriented, highlights the current system’s challenges. At this stage, proposals to overcome challenges are outlined, especially regarding the obstacles to implement the Commission’s recommendations, where the main results of the article arise. The reason for this study stands on the conviction that the compliance with international recommendations is the element that guarantees the exercise of the transformative potential of Human-Rights Systems. With the methodological research based on a bibliographical research and case law, the role of the Inter-American Commission is redesigned in the light of a dialogical triad composed by the organs of the International System, the States constitutionalism and organised civil society.

Resumo: Busca-se investigar acerca da existência de um novo modelo de Constituição Econômica no Novo Constitucionalismo Latino-Americano, em especial, nas recentes Constituições do Equador (2008) e da Bolívia (2009). São examinados alguns aspectos econômicos presentes nessas Constituições, em especial: o pluralismo jurídico-econômico, a democracia econômica, a soberania econômica, a distribuição socioambiental dos resultados econômicos, o desenvolvimento do mercado interno, a natureza como recurso econômico e a vedação ao monopólio e oligopólio. Num exame crítico, arremata-se que, embora essas cartas constitucionais examinadas permaneçam afirmando um modelo desenvolvimentista, de fato, elas apontam para uma nova proposta de desenvolvimento, baseada no pluralismo econômico, mediante a imposição maiores restrições de cunho socioambiental para a livre iniciativa.Abstract: It intends to investigate on the existence of a new model of Economic Constitution within the New Latin American Constitutionalism, especially in the recent Constitutions of Ecuador (2008) and Bolivia (2009). Some economic aspects in these constitutions are examined, particularly: the legal-economic pluralism, economic democracy, economic sovereignty, environmental distribution of economic results, the development of the internal market, the nature as an economic resource and prohibition of monopoly and oligopoly. In a critical analysis, it concludes that, although these constitutions remain stating a developmental model, in fact, they point to a new development proposal based on economic pluralism by imposing greater socio-environmental restrictions for free enterprise.

The 2008 Ecuadorian Constitution built a particular system for environment protection, breaking the dominant paradigm characterized by an anthropocentric and utilitarian relation with nature. The Ecuadorian Constitution raised the nature of the condition "subject of rights". Such a conception is associated to "buen vivir" (Sumak Kawsay in Kichwa), which relates to the ways of life and world view of native peoples. Therefore, this article aims at understanding the social construction of this understanding of nature in the context of the processes experienced in Ecuador and called "New Latin American Constitutionalism". To meet the proposed objective, the methodology used was based on the survey and review of references related to the rights of nature, held in university libraries and at the Supreme Court of Ecuador, as well as on interviews with indigenous leaders, which served to guide reflections. As a result, the analysis of recent legal changes experienced in Ecuador invite us to a comparative reflection on the Brazilian environmental policy.
