Resumen

Patterns of moral judgment exhibited by institutional candidates and fellows in the American Council on Education Fellows Program in Leadership for Higher Education 1988/1989 and 1989/1990 were explored in this study. The fellowship program selection process produced a group of institutional candidates with the high level of moral judgment development necessary for successful leadership in higher education administration. The goals of the program may be best served by minor improvements which will enhance a sound process. The results indicate that moral judgment development was not a significant factor in the selection of fellows. Salary and years of administrative experience, however, were related to selection. Candidates with higher salaries were more likely to be selected as fellows and tended to have lower levels of moral judgment development. The study revealed that there are variables affecting the selection and further investigation is necessary to determine which variables affect the selection and if they contribute to the goals of the fellowship program. Participation in the fellowship program did not significantly affect the fellows' level of moral judgment development as a group. The fellowship program did, however, have a positive impact on the upper third subgroup of fellows and a negative impact on the lower third subgroup. The performance of the upper third indicated that they have the potential to make a significant contribution to higher education administration. The middle third subgroup's performance indicated it is in a position to benefit significantly from program adjustments which enhance the fellows' awareness and broaden their perspective of the social milieu, within which higher education functions. Performance of the lower third indicated that the fellowship program might be adapted to meet the needs of this subgroup. Further study of other variables separating these three subgroups is needed. A longitudinal study could be completed to determine if candidates in the three subgroups went on to make the contributions in higher education administration this study implied they were equipped to make.

This dissertation considers the possibility of there being such a thing as ethical authority in the modern world, and seeks to give an account of its nature. It begins by expressing a critical stance toward the idea that authority is always dependent upon having a certain kind of theoretical expertise. It raises the suggestion that there are other forms of authoritativeness, based on tradition, the display of superior skill, or impressive discriminative/perceptual powers. The bases of these forms of authority are not primarily, or even necessarily, of an intellectual kind. The idea that ethical authority depends upon something more than intellectual foundations may be traced to Aristotle, who claimed that the practical wisdom of an ethical authority (phronimos) is a matter of being good at deliberation with regard to things that conduce to living well. The model of ethical authority provided here is not that of theoretical expertise but closer to that of practical skill and/or the possession of perceptual powers of a particular kind. Ethical authority in the Aristotelian tradition depends upon intellectual powers, but of the 'practical intellect' and not necessarily (it depends on the context) any advanced theoretical expertise. It then proceeds to argue that there is an important place for practical wisdom in modern ethical life. Many of us live today in modem pluralistic societies where diverse conceptions of goodness and ethical rationality compete. We may well find the idea of reasonable allegiance to local phronimoi, who grasp and can illuminate the value of particular practices and institutions to fellow participants of a shared life, pure anathema. Modern ethical philosophy reflects this stance, and is characterized by a certain faith in rule-centred or procedural ethical theories for guiding human conduct. The argument of the second chapter seeks to show that there is little warrant for rejecting the role of ethical authorities (phronimoi) in contemporary pluralistic societies in favour of ethical proceduralism. Thereafter, in the third, fourth and fifth chapters, it turns to exploring the nature of practical wisdom, in particular, whether or not it is best construed as grounded in a theory of right conduct, or as a form of 'ethical knowledge', or as aiming at an objective truth; and to the task of characterizing a credible conception of the insightful phronimos - or what it might be like if this model of ethical authority is to claim relevance for contemporary life within pluralistic ethical communities.

Resumen

This thesis examined the knowledge and processes that adults use to reason about moral dilemmas. Two contrasting analyses of moral reasons, Kohlberg's justice orientation and Gilligan's response orientation, were reviewed and criticized. From this a Moral Reasoning Grammar which formally characterizes the semantics of the justice and response moral orientations was developed. Specifically, the Moral Reasoning Grammar distinguished reasoning based on principles and their defense from reasoning based on narrative and social-interactive knowledge. The Moral Reasoning Grammar was applied to subjects' protocols to determine the extent to which these two orientations characterized subjects' verbal responses to moral problems. Application of the Moral Reasoning Grammar resulted in good coverage of subjects' verbalizations which reliably differentiated knowledge and processes used by subjects resolving moral problems from either a justice or response orientation. The justice orientation characterized the four male subjects' protocols and the response orientation characterized the four female protocols. The small sample precludes any generalization of this finding. The Moral Reasoning Grammar and results were discussed in terms of further psychological research, an expanded and more comprehensive philosophical approach to moral reasoning, and the potential educational implications.

Resumen

This thesis is the first major study of censorship of and in English Canadian literature. While there are several reasons scholars have focused on censorship in Europe and the United States, it is the ascendancy in quality and quantity of Canadian writing leading to its further use in institutions where censorship takes place---such as schools and libraries---that necessitates a study of censorship in Canadian literature now. This rise in censorship has prompted Canadian authors increasingly to write about the subject. In this thesis I study censorship issues raised both explicitly md implicitly by Timothy Findley, Margaret Atwood, Margaret Laurence, Beatrice Culleton and Marlene Nourbese Philip. All of these writers have been subjected to censorship attacks and have responded to these attacks and grappled with the philosophical implications of censorship in their fiction and non-fiction. My investigation of censorship in these texts sheds new light on the works of literature themselves, but the literary texts also suggest a new way of looking at censorship. Each of my chapters offers arguments challenging the traditional Enlightenment model of censorship as an oppressive government practice against its citizens, a definition resulting in the mistaken views that censorship has been largely eradicated in the West and that, when it does surface, it is to be condemned on principle. This view can be contrasted with a "constructivist" model of censorship as the delegitimation of expression by social forces. My findings support a definition which draws on both models wherein censorship is the exclusion of some discourse as the result of a judgment by an authoritative agent based on some ideological predisposition. The key word in this definition is "judgment" which, when recognized as the primary activity in censorship, must change the way we approach censorship controversies. This thesis develops a 'response-dependent' account of the objectivity of ethical judgment. It uses the Kantian device of the Categorical Imperative (CI) as the critical reflective test for convergence in judgment that is genuinely objectivity-sustaining. After a discussion of the challenges to ethical objectivism, it is argued that Wittgenstein's consideration of rule-following provides a compelling case for rejecting attempts to ground objectivity in a manner that is external to normative practices. This removes one potent source of hostility to ethical objectivity, but it does not establish the truth of this position. Within the constraints of a broadly Wittgensteinian conception of objectivity, plausible accounts of ethical objectivity will be 'response-dependent'. The key issue facing such theories is whether they can provide a model of practical rationality that delivers suitably demanding, objectivity-sustaining standards of rational criticism. I examine two approaches to this issue. The first (suggested by John McDowell) takes Wittgenstein's rulefollowing considerations as implying a virtue-centred approach to ethical deliberation. On this view, virtuous agents' uncodifiable responses determine correct judgment. But the case for this theoretically modest model of objectivity has not been successfully made, and the approach has insufficient resources to yield genuine objectivity. Instead, appeal must be made to some more articulated account of practical rationality. The second, Kantian, model delivers this because the CI test provides a mechanism for objectivity-sustaining reflective criticism of agents' reasons for action, without importing any illicit codification of rationality. The CI can also be used for critical reflection on agents' appreciation of the ethical features of their situation. In this way the model can avoid the problem of empty formalism and offer a weak form of ethical cognitivism. This model also suggests a potential route to plausible approaches to some other problematic issues in ethical theory, such as akrasia and the categorical nature of moral reasons.

This thesis is an examination of the foundations of practical reason. Building on the later work of Wittgenstein, I argue for a subjectivist view of moral judgment and of judgments about reasons for action. On this view, moral judgments and judgments about reasons for action can be true or false, but they are not objective. The argument for this view has the form of an inference to the best explanation. Using a distinction between primary and secondary qualities, I suggest that moral judgments and judgments about reasons for action should not be construed as referring to an ethical or normative reality that exists independently of us. There are ethical facts and facts about our reasons, but these facts arise as the result of our involvement in a linguistic practice. This provides a new way of accounting for these judgments that differs both from moral realism and expressivism. The view of reasons that emerges is closely related to, but not identical with, reasons internalism as described by Bernard Williams. I reject his argument in favour of internalism and provide a new and independent argument to support this view of our reasons. In the course of spelling out that argument, I show why internalism as described by Williams should be modified, and why this does not commit us to externalism. In the final chapters, I show that there is an important parallel between our practical predicament and the account of our epistemic condition as portrayed by Wittgenstein. The inference to the best explanation is completed by considering a number of objections to subjectivism that are based on the idea that a subjectivist account of moral judgment and of reasons fails to do justice to the ethical phenomena. I reject these objections, and suggest that a subjectivist can both be reflectively aware of his subjectivism and continue to live well.

In On Christian Teaching, Saint Augustine writes, “Just and holy living depends on being a good judge of things.” This brief sentence lucidly articulates the importance that judgment plays in Augustine’s thought. This thesis is the first full-length study of how he understands the distinct role of the Holy Spirit in judgment. I argue that judgment denotes both the discernment of a thing’s nature and evaluation of it; and we become good judges only as we are re-ordered by the love which is, in Augustine’s favourite pneumatological verse, “poured into our hearts by the Holy Spirit” (Romans 5:5). I analyse this transformative work of the Spirit according to two broad categories: first, the Spirit re-orders our relation to creation principally by uniting us to the Word, the second person of the Trinity, in whom all things are created, and so we are able to discern a thing’s nature and evaluate it according to God’s purposes in creation; and, second, the Spirit re-orders our relation to time, as we patiently endure this troublous life as pilgrims hoping for eternal Sabbath rest; within this eschatological horizon situated in the age between Christ’s first coming and his return, we restrain ourselves from making both unfounded and unnecessary judgments as we defer to God’s final judgement. This thesis is divided into two parts. In the first part, on the “theory” of judgment, I explicate the consistent relation throughout Augustine’s corpus between pneumatology, judgment and ethics (chapter one). I then proceed to trace out his account of how the gift of the Spirit’s love perfects our judgment by re-ordering our relation to creation, and, conversely, how lust distorts it. A right relation to creation turns on taking up our middle place: below God, next to our neighbours, and above nature (chapter two). In the second part, on the “practice” of judgment, I focus first on other-judgment, especially the role of mercy (chapter three), and then in the fourth and final chapter I turn to self-judgment, including a lengthy consideration of the nature and role of conscience (chapter four). For Augustine, then, it is only by the Spirit’s love that we are made good judges, and, simultaneously, it is only when we are good judges that our love conforms to the truth both of God’s good creation and of our in-between age.

The first overall aim of the thesis is to demonstrate why it is important to include knowledge about emotion in legal-ethical judgment and decision-making. Chapter two explains what emotions are, demonstrates how emotions involve judgment and evaluation, and how emotions are connected to moral and ethical judgment. It is argued that the ability to account for both the positive and negative influences of emotion leads to better ethical judgment. Chapter three demonstrates how emotion is involved in ‘thinking like a lawyer’. The knowledge about emotion from Chapter two is used to expand the understanding of how emotion is involved in ‘thinking like a lawyer’ and legal-ethical judgment. It is argued that including the emotional aspects of legal-ethical judgment, will make legal ethics education more comprehensive and better equip law students for the reality of making ethical judgments in practice. The second overall aim of the thesis is to demonstrate how knowledge about emotion could be introduced into legal ethics education. This aim is achieved in Chapters four and five through the case study of the legal ethics curriculum at the Law Faculty, University of Technology Sydney. Chapter four argues that educating students about the role of emotion in legal-ethical judgment is best implemented via the pervasive and incremental approaches. Chapter five argues that by using concrete examples of how emotion is involved in legal-ethical judgment and how emotion can be integrated into teaching and learning strategies, this thesis will provide academics with a framework from which they can formulate their own teaching and learning strategies with a view to achieving learning outcomes for students such as: increased awareness and understanding of their own emotional capabilities and the ability to critically reflect on and analyse the role of emotion in ethical judgment.

A dual-process framework argues that both intuition and reflection interact to produce moral decisions. The present dissertation integrated moral identity and moral judgment to explain moral behavior from the dual-process model and its account was tested by three studies. A typical everyday moral behavior of interest in the present research was honest behavior. Participants were introduced to use their intuitive ability to predict the dice number demonstrated on a computer. The reward will base on their self-reported accuracy. Studies examined cheating behavior of individuals who had a chance to lie for money. In study 1, sixty participants with diversified background were recruited in a laboratory study. The results supported that honest behavior was more an intuitive result than a reflective outcome. Honest behavior resulted from the absence of temptation and priming moral constructs increased honest behavior. Study 2 contained two parts, in the first part, the researcher developed a Chinese version of moral identity based on Aquino and Reed’s (2002) work, in the second part, fifty-eight participants’ moral identity was investigated by the instrument in the first part. Their honest behavior was measured in the same task adopted in study 1. The result confirmed that different mechanisms led different people to behave ethically. For people who had strong moral identity, honesty resulted from the absence of temptation, while for individual with weak moral identity, honest behavior resulted from the active resistance of temptation. In study 3, moral identity and moral judgment were integrated to explain moral behavior. A Web-based survey with 437 subjects showed that the relationship between moral identity and moral judgment was significant. Individuals who viewed themselves as moral people preferred formalistic ideals to utilitarian framework when making moral judgment. The follow-up experimental study demonstrated that moral identity and moral judgment interacted together to determine moral behavior. When formalism was coupled with the motivational power of moral identity, individuals were most likely to behave morally.

Resumen

In this dissertation, I examine the complex role that the body played in early modern constructions of judgment. Moving away from an overreliance on anti-theatrical texts as the authority on the body in Shakespeare's plays, my project intervenes in the field Shakespearean studies by widening the lens through which scholars view the body's role in the early modern theater. Through readings of four plays—Richard II, Hamlet, King Lear, and The Winter's Tale—I demonstrate that Shakespeare uses a wide range of ideas about the human body from religious, philosophical, medical, and cultural spheres of thought to challenge Puritan accusations that the public theater audience is incapable of rational judgment. The first chapter outlines the parameters of the project. In Chapter 2, I argue that Richard II draws parallels between the theatrical community and the community created through the sacramental experiences of baptism and communion to show that bodies play a crucial role in establishing common experience and providing an avenue for judgment. In Chapter 3, I argue that Shakespeare establishes correspondences between bodily and social collaboration to show how both are needed for the memory-making project of the theater. In the next chapter, I show how Shakespeare appropriates what early moderns perceived of as the natural vulnerability in English bodies to suggest the passionate responses associated with impressionability can actually be sources of productive judgment and self-edification. I argue the storm models this passionate judgment, providing a guide for audience behavior. In Chapter 5, I argue that the memories created by and within the women in The Winter's Tale evoke the tradition of housewifery and emphasize the female role in preservation. Female characters stand in for hidden female contributors to the theater and expose societal blindness to women's work. Through each of these chapters, I argue that Shakespeare's plays emphasize the value of bodily experience and suggest that the audience take up what I have termed "corporeal judgment."

Resumen

Ethical behavior and moral judgment are fundamental issues facing the accounting profession today. Changes in the ethical culture of accounting have brought about a crisis of ethical misconduct in the profession. External forces for better ethics in accounting, represented by Sarbanes-Oxley (SOX) legislation, and internal forces, represented by increased educational coverage encouraged by state societies and the AACSB, are attempts to influence the current crisis. Research in the field of ethics and moral judgment in the accounting profession continues as researchers continue to examine factors influencing the ethical reasoning abilities of accountants and accounting students. The results of these studies may assist accounting schools and the accounting profession in controlling and improving the ethical orientation of the accounting profession. This study examines the possible relationship of ethics education and moral reasoning of undergraduate and graduate accounting students. Limited previous research on these two variables has provided mixed results. This study examined undergraduate and graduate accounting students at six colleges and universities in the upper mid-west and southern region of the United States. The variable of ethics was measured with Rest's DIT-2 instrument and ethical education by completed ethics courses. The results of this study demonstrate a significant relationship between ethics education and the moral reasoning of accounting students. However, the results were not in the expected direction, with the accounting students completing ethics education having a significant lower level than the accounting students without ethics education. In addition, this research found that accounting students who are 22 years of age or younger possess higher levels of ethical reasoning than accounting students who are older than 22 years of age. However, the findings show that there are no significant differences in the ethical maturity levels of accounting students when grouped by gender and education level. These findings support the need for further research into determining factors influencing moral judgment in undergraduate and graduate accounting students.

The purpose of this thesis is to analyse moral judgement in Newman's theology by examining his religious epistemology of the judgement of faith which he regularly illustrates with a moral analogy. Chapter one explains the philosophical and theological parameters of his religious epistemology in the 'University Sermons', and 'The Idea of a University'. This shows the primacy of the implicit reason of faith, and the secondary, but indispensable, function of explicit reason, manifest in Newmnan's explanation of liberal knowledge. Chapter two refines this by examining the 'Grammar of Assent, to show the objectivity and normativity of his epistemology in the concrete faith judgement of the illative sense. I show the primacy of personal assent in relation to the indispensable, but secondary, function of inferential investigation. Chapter three adopts the epistemology of the 'Grammar of Assent' to explain moral judgement. I introduce the term 'illative moral judgement' to show that concrete moral judgement can be a speculative truth of implicit reason which elicits a real assent of the imagination. There is a creative tension between concrete moral judgement and the abstract moral judgement entailed by the objective existence of the moral law; this is indicated by the moral sense of conscience within the context of his theology of a religious imagination. Moral judgement, action, and progress are connected by examining the role of the will and the influence of grace. The religious dimension of moral judgement is explained by understanding conscience's sense of duty in terms of intentionality within a horizon of belief. And his religious epistemology reveals the mode of reversing concrete moral judgement. Chapter four shows the relevance of Newman's proposals for moral judgement in contemporary moral theology.

Resumen

Research in moral psychology has focused on understanding what factors assist in the development of moral action and decision making. The purpose of this study was to address whether variability in attention relates to moral judgment development. The reason for exploring moral judgment development was to further explore the research of Thoma and Bebeau (2008) who documented that the moral development scores of college and graduate students has been declining over time, with more college-aged students scoring in the lower levels of moral reasoning. Attention was chosen as a viable topic of research, based on the writings of Carr (2008a) who suggests that technology has had an impact on the way that individuals read and process information. College students from Western Kentucky University were recruited via the Psychology Department Study Board. Participants first took the Defining Issues Test-2 (DIT2) online and then scheduled a subsequent session in the laboratory to take the Test of Everyday Attention (TEA). The DIT2 assesses three levels of moral reasoning advancing by level: Personal Interests, Maintaining Norms, and Postconventional schemas. The TEA assesses four different types of attention: divided attention, attentional switching, selective attention, and sustained attention. In a sample of 79 college students, results revealed that stronger attention abilities were related to higher postconventional reasoning. However, decreases in attention were not related to lower personal interests reasoning. Attentional switching, selective attention, and sustained attention were particularly influential where postconventional reasoning was concerned. The trends observed in this study were somewhat expected as moral judgment development is regarded and verified as a cognitive intellectual process. In light of the information provided by the results of this study, future studies are recommended to determine how efforts to facilitate improved attention might ultimately translate to improved moral judgment development. Research has shown that interventions aimed at improving attention are successful (Kerns, Eso, & Thomson, 1999). In conclusion, this study supports the notion that attention does pertain to moral judgment scores as inferred by the DIT2. The effect of the TEA scores on the DIT2 postconventional scores was strong (R2 = .237).

The knowledge base of empirical psychology is more expansive than ever before. So too is the impulse to integrate this factual knowledge into political theory. But how should this psychological turn be undertaken? What would a political psychology for political theorists look like? How could psychology credibly tackle the questions that political theorists characteristically ask, especially regarding the nature and consequences of prescriptive political judgment? In this thesis, I explore this issue through the framework of recent debates between political moralists—specifically, John Rawls, G. A. Cohen, and Peter Singer—and political realists—largely Bernard Williams. Deploying the insights of political realists, I argue that moralists cannot quarantine the relevance of psychological facts through the ideal of a 'pure' normative judgment. To explore what this empirical engagement might look like, I contrast these moralist ideals of judgment with Jonathan Haidt’s social intuitionism, which proposes a more affectively laden and pluralistic model of judgment. I then redeploy the insights of political realism to critique social intuitionism, to uncover its weaknesses from the perspective of existing political theory. Finally, to stabilize this critique, I lay out the framework for a reflexive political psychology, which acknowledges the co-constitutive relationship between the discipline of psychology and its subject matter: human psychology. This reflexive political psychology offers an agenda by which we can investigate the political usefulness of psychological and political theories.

This study traces the current status of Spanish ethics as seen through the optics of historical memory. Starting from the Spanish Civil War in 1936, the thesis relates contemporary themes to their proposed origin throughout three additional distinctive eras of the 20th and 21st century in Spain: 1982-1996 (Socialist Spain), 1997-2010 (Post-modern Spain), and 2011-present (current Spain). Spanish narratives ranging from Los Abel by Matute, La magnitud de la tragedia by Monzó, "Fidelidad" of Ha dejado de llover by Barba and Las fosas de Franco by Silva are contextualized through their ethical architecture, in accordance with their socio-political context, and relationship to past historical traumas. This work proposes that the themes of anticlericalism, the pursuit of social equality, anti bureaucracy, and political distrust are trends culminating from Kohlberg's third level of morality. The thesis aims to be an exposition and legitimization of different ethical schemas that might otherwise be polarized as wrong and inferior by others.

This study constitutes an attempt to isolate and elucidate the event of personal relations in the later writings of Henry James. I argue that James' singularity rests on his treatment of personal relations in a radical and unfamiliar way. The main goal of this piece is, then, to trace the workings of personal relations, and to understand the peculiar way in which they figure and unfold in the later narratives. By reading James through the ethical philosophy of Emmanuel Levinas, I wish to reconstruct James' major phase as primarily "ethical." Levinasian ethics differs from the branches of moral philosophy in its insistence on the absolute priority and exteriority of the ethical relation between persons: its disengagement from the realms of psychology and consciousness. The ethical relation is envisioned as flourishing precisely in the absence of cognition and thought. Rather than relating to one another as potentially knowable beings, then, persons in James and Levinas relate to one another as mutually unfathomable others. I maintain that this breaching of cognition and knowledge essentially characterizes Jamesian sociality. Read through ethics, as divorced from ideas of consciousness, James' major phase finds its meaning outside the traditional reign of James studies, which takes James as the master of complex elaborations on modes of consciousness. Not consciousness but alterity is James' defining feature, and it is through the readings of alterity that the fundamental event of Jamesian sociality emerges as both primary and unique. "Ethics" thus opens up a new horizon in which the Jamesian is no longer synonymous with consciousness, a horizon which transforms the understanding, not only of James in particular, but of literature in general.
