Texto completoThis dissertation offers a study of the «liberal» and «national» nature attributed to John-Mary Mastai Ferretti, the pope Pius IX, during his first three years of pontificate. Exploiting an heterogeneous mass of sources (archival items, typing and handwritten papers, pamphlets, posters, newspapers, popular engravings and etchings, private letters, journals), this study retraces the origins of the phenomenon since the papal amnisty of 1846; its mixed transformations which come across papal policy, the status of images and devotional practices in 19th century, political as well as religious propaganda, and conspiracy theory besides; finally, its partial dissolution after the revolutions of 1848. Facing the concept of «myth» – a tool uncritically used for a long time to interpret the phenomenon –this study proceeds on questioning this category and it attains to the most operational concept of «emotional investment»: hence the figure of a «liberal» and «national» pope would be the product of a collective work – to whom Pius himself was not extraneous – which was a matter for the theologico-political worries of post-revolutional european society: namely to solve the religious and political dylemmas of modern age, in order to appeasing some ideas which are not logically (and apparently) compatible, such as freedom and order, nationalism and catholic theology. The method choised to investigate this phenomenon is the comparative one: in retracing a plural context (that is a network of sources) between the two sides of Alps, it will be possible to have a more deep knowledge of a great living utopia in the middle of 19th century

Texto completoLa mia tesi dottorale coincide con una monografia sull’"Italia liberata da’ Gotthi" di Gian Giorgio Trissino, poema eroico che si propone quale ambizioso tentativo di rifondazione dell’epos rinascimentale. L’elaborato si compone di due macro-sezioni. La prima parte, più specificamente monografica, comprende: un’analisi delle opere di teoria poetica del Vicentino e una presentazione generale del poema – con focus su genesi ed edizioni dell’"Italia", struttura narrativa, sistema dei personaggi, temi ricorrenti e simmetrie interne, geografia e cronologia delle vicende narrate – che ha l’obiettivo di rendere note ai lettori le caratteristiche di un’opera che – secoli di sepoltura "nelle librarie e nello studio d'alcun letterato" – hanno reso sostanzialmente sconosciuta ai più; una ricerca sulle fonti dell’opera, che concede grande spazio al confronto tra l’"Italia" e l’"Iliade" omerica, suo principale ipotesto classico; infine, alcuni itinerari critici su questioni di particolare rilevanza nel panorama degli studi trissiniani. La seconda sezione dell’elaborato contiene la trascrizione e il commento dello "Zibaldone autografo dell’Italia liberata", manoscritto inedito conservato nel Fondo Castiglioni della Biblioteca Braidense di Milano. Si tratta di un codice che assembla appunti autografi in vista della stesura dell’"Italia": un vero e proprio cantiere di progettazione del poema, in cui Trissino raccoglie annotazioni di vario genere (dagli schemi relativi alla struttura dei diversi libri del poema, ad elenchi di personaggi, fino alle prove di versi, l’elemento più prezioso in assoluto perché, qualora messe a confronto con la loro versione definitiva all’interno dell’opera, fanno luce sul modo di lavorare dell’autore). Lo studio dello "Zibaldone" si è rivelato di notevole interesse sotto due punti di vista: in primo luogo perché consente un ingresso privilegiato nell’officina scrittoria trissiniana. Secondariamente il codice si è dimostrato uno strumento di inestimabile valore per l’indagine delle letture trissiniane e l’approfondimento di un argomento rispetto al quale ancora non sono state avviate indagini significative: la biblioteca del Trissino.

Emblems of this universe, Ariosto and Tasso’s epic poems, imitated of Homer’s, upgraded to most popular histories of the Italians theatres of the 17th and 18th centuries. The Middle Ages’ representation in Opera between 1690 and 1730, showed a diversity of esthetics but dramatic and poetic figures too. Thanks to the Accademia dell’Arcadia, the renovation of the libretto led to consider new prospects of its exploitation. Zeno developed the new vision of Middle Ages contrary to Metastasio. Supporting by French tragedy, this renovation unified with strength poetical and musical art. The aria symbolized the meeting point of affects and their musical representations. It contributed to the celebrity of Vinci’s and Hasse’s Artaserse (1730). These two operas hastened the decline of medieval subjects and installed a new lyric model

São analisados cinco manifestos escritos por Marinetti, os quais estabelecem as diretrizes da literatura futurista, além das técnicas e dos temas a serem abordados pelos poetas. O estudo proposto visa à compreensão das mudanças estéticas ocorridas no início do século XX e de que forma o Futurismo italiano foi fundamental para a diluição das fronteiras entre literatura e artes visuais. Texto completoAs células estaminais, em particular as do cordão umbilical, são hoje responsáveis por um conjunto de novas aplicações na área da saúde. Por este facto, foram criados bancos públicos e privados para a criopreservação das amostras de sangue materno fetal recolhidas. A Itália, apesar da sua extensa rede de bancos públicos de criopreservação de amostras de sangue do cordão umbilical (SCU) dirigida à doação (18 estruturas sanitárias), proíbe a conservação para uso privado (autólogo) no seu território. Este estudo caracteriza a situação italiana em 2010, no caso das células estaminais umbilicais, através da análise das normas envolvidas, da descrição do mercado, da actuação das agências reguladoras do sector e do estabelecimento do perfil das amostras das clientes italianas de um banco privado português que armazenam as células estaminais umbilicais para uso próprio. Com recurso a pesquisa bibliográfica, apresenta-se alguns dos aspectos teóricos de Ciência Política, especificamente em relação às liberdades individuais dos cidadãos, relacionando com alguns resultados da investigação no campo das células estaminais umbilicais. Realizou-se ainda pesquisa documental para detalhar a legislação italiana, a regulação das agências internacionais e os procedimentos das empresas públicas e privadas que actuam no sector da criopreservação de células estaminais umbilicais em Itália. Foram desenvolvidas duas pesquisas exploratórias com o objectivo de descobrir o grau de conhecimento das participantes 1) sobre as células estaminais umbilicais e 2) sobre as capacidades do Estado Italiano em oferecer os meios adequados para a recolha e a conservação destas células. Estas pesquisas serviram também para caracterizar a população italiana utilizadora do serviço de criopreservação privado e para analisar os resultados das amostras criopreservadas da referida população. Com a contraposição dos dados destas fontes, constatou-se haver falta de informação por parte dos respondentes italianos quanto às estruturas estatais de recolha de células estaminais umbilicais. Adicionalmente verificou-se, na população italiana que recorreu aos serviços do banco privado português, excesso de práticas burocráticas para a conservação particular das amostras, que inclusivamente condicionam a elegibilidade de algumas amostras para criopreservação. Os parâmetros que regulamentam a criopreservação de amostras de SCU são definidos por agências internacionais. Os critérios nos quais se baseia a legislação italiana são mais restritivos do que os do banco privado português, nomeadamente o volume mínimo da amostra de sangue (100 ml) e a idade máxima das dadoras (35 anos). Efectivamente neste trabalho observou-se que amostras que seriam rejeitadas à luz da legislação italiana apresentaram um número de células CD 34 + de acordo com os padrões que viabilizam a sua utilização em transplantes. Finalmente, verificou-se que ao empregar exigências desiguais para as criopreservações pública e privada, o Estado Italiano limita aos seus cidadãos o pleno exercício da liberdade, constitucionalmente reconhecida.
Stem cells, in particular umbilical cord stem cells, may be responsible for important new applications in health sciences. Thus, public and private cell banks are now operating in criopreservation of maternal and fetal blood samples. In Italy, umbilical cord blood donation is supported by an extensive net of public banks for criopreservation (18 structures). However, autologous (private) use of these cell samples is forbidden. The present study described the Italian situation in 2010, regarding umbilical stem cells, by the analysis of the involved normatives, market description, the role of the regulatory agencies, and by characterizing part of an Italian population that contacted with a Portuguese private cell bank. Furthermore, statistical data of the umbilical blood samples preserved for autologous use in the Portuguese private cell bank by Italians clients are herein described. Firstly, a bibliographic review related Political Science principles, mostly concerning citizen’s freedom of choice, with recent findings in the field of umbilical stem cells research. Additionally, a documental survey detailed the Italian legislation, the regulatory basis of the international agencies and the legal procedures of public and private cell banks enrolled in umbilical stem cells cryopreservation in Italy. Two exploratory surveys were conducted, aiming to characterize the level of information of the respondents regarding: 1) umbilical stem cells and 2) the Italian State ability in providing the sampling and preservation of such cells. Such surveys also allowed characterizing the Italian population that used the Portuguese private criopreservation service and some statistical data of the criopreserved samples. The present results indicated that the Italian respondents lacked information concerning the public facilities for umbilical stem cells sampling. Additionally, the Italian population that used the private bank for criopreservation, referred that there were excessive bureaucratic procedures for private cells preservation, that resulted in ineligibility of some samples for criopreservation. International agencies define the parameters that regulate umbilical cord blood criopreservation. The criteria that support the Italian legislation are more restrictive that those that guide the actions of the Portuguese private bank, namely minimum blood volume of the sample (100 mL) or the maximum age of the donor (35 years). In the present work, it is shown that samples rejected facing the Italian law, have in fact a number of viable CD 34+ cells within the range that allows the use for transplantation. Finally, it is shown that by enforcing uneven demands for public and private criopreservation practices, the Italian State limits the constitutional right of the Italian citizen to the full exercise of freedom.

Dopo un’attenta osservazione degli scritti polemici cinquecenteschi redatti dagli Accademici della Crusca e delle difese del Tasso e di altri letterati, sono stati isolati i tratti linguistici discussi e ne è stata verificata la frequenza parallelamente nelle due opere e nella produzione coeva e precedente, per indagare l'origine degli interventi critici e delle nuove scelte stilistiche del poeta.

Texto completoIl presente lavoro indaga forme e fasi della poesia tassiana secondo una visione al contempo sincronica (in grado di mettere in dialogo strati testuali e momenti compositivi diversi) e diacroonica (in grado di disporre tali elementi in prospettiva temporale e quindi capace di restituire la reale qualità dell’evoluzione delle fasi stesse). Nello specifico, i materiali testuali considerati sono relativi alle forme del lirico largamente intese e alla loro intersezione formale, strutturale, tematica e stilistica con le forme dell’epos. L’obiettivo è stato quello di definire la struttura, la caratterizzazione formale e la funzione narrativa delle ‘ vicende liriche’ della Gerusalemme liberata per poi sviluppare, nell’ambito del secondo capitolo, un itinerario analitico interno al poema e alle sue stratigrafie testuali. Proprio la stratigrafia del testo epico rappresenta infatti una straordinaria testimonianza della progressiva messa a punto di equilibri testuali che si rapportano necessariamente sia alle ragioni interne del macrotesto che alle sollecitazioni dell’intero universo teorico tassiano, anche in relazione alla prima prova narrativa costituita dal Rinaldo, a cui e dedicato il terzo capitolo, e all’insieme costitiuto dalla pratica della scrittura lirica strettamente intesa, a cui è dedicato il quarto capitolo (che comprende le rime Eteree, il canzoniere Chigiano, momento transitorio ma nodale se valutato secondo un’ottica retrospettiva rivolta al poema, e alcune rime disperse circolanti negli anni precedenti la reclusione). Tutta la ricerca – dall’indagine testuale e critica interna al poema gerosolimitano alla ricostruzione della genesi testuale del compromesso, talvolta difficile ma sempre fecondo, tra lirica, e stile fiorito, ed epica, e stile magnifico, fino alla ridefinzione dell’iter, talvolta sotterraneo, che la materia lirica percorre precedendo, accompagnando e seguendo il magnum opus della Liberata – è stata condotta tenendo sempre conto del rapporto che sussiste tra teoria e prassi in un autore tanto sorvegliato come Tasso, e dando quindi ampio spazio ad un’analisi testuale tesa sia alla profondità che alla contestualizzazione intertestuale dei dati, sempre rigorosamente posti al vaglio della specola filologica.

Texto completoThis work aims at offering a new perspective from which it is possible to read the dialectic between the heathen-mythical culture and the Christian culture that runs through the whole literary Italian tradition. Transformation is the theme in common between the two visions of the world, it is the leading figure of the whole research and it assumes different forms. It takes the name of metamorphosis in the mythical culture and of conversion in the Christian culture. The novelty of this perspective consists in the attempt of a rhetorical reading of these two phenomena, in order to formalize two kinds of poetics., that could correspond to the theme of metamorphosis and conversion. Applying to the large materials offered by Divina Commedia, Gerusalemme liberata, Adone, Promessi sposi, tragedies by Manzoni and some poems from Alcyone by d’Annunzio the instruments deriving from the anthropological studies about archaic sacrifices by Girard and from the intuitions of Bottiroli about literary transposition of some logical schemes, which are typical of the Western culture, it was possible to notice a constant correspondence between forms of contents ‘metamorphosis’ and ‘conversion’ and the particular forms of the expression, with which they have been represented. Once they have been pointed out, the particular forms of expression have been codified in figures of speech, so that it was possible to indicate the overall scheme of the antithesis as the proper sing of the poetics of metamorphosis and the figure of correctio as the feature of the poetics of conversion.

Texto completoThe purpose of this legal research is the examination of the discipline of the director’s revocation of Italian limited Company “s.r.l.”, regulated by art. 2476 Italian Civil Code, after the corporate reform of 2003. Such a matter has been subject of numerous interpretations by the Doctrine and Jurisprudence, as it raises many systematic problems not yet resolved. The Art. 2476 c.c. is one of the most controversial points of Italian corporate law; the legislator of the reform, in order to maintain the s.r.l. autonomy, has joined more legal institutions in the same article, with the intention of emphasizing the partner’s figure in the social contract, the organization and management of company. Making a parallel with the same German rules, more detailed and more systematic than the Italian ones, it is possible to notice some key differences and thus take any possible ideas for future reforms. The thesis consists of six chapters. The first chapter (“Historical and normative context”) is dedicated to the introduction of the birth of “s.r.l.” and the “GmbH”. After a brief history, there is a general comparison between the company types of two different systems, analyzing the salient features of both the company reforms: the Italian one, relative to s.r.l., in 2003; the German one, relative to the GmbH, in 2008 (the so-called Law MoMiG), with particular care of the responsibility in both the legal systems. The topic of the second chapter (“Directors’ duties and responsibilities”) is the issue of legal responsibility management activity, which plays a key role in the governance of Italian and German limited liability company and it is prodromal to remove the director from his office, if he’s soiled himself with acts of mismanagement. There is an overview of the ABSTRACT II Art. 2476, comma 1, c.c. with respect s.r.l. and § 46 GmbHG of the German system, analyzing the directors’ duties, diligence executable and the legal consequences of their violation. The third chapter (“Partner’s control rights”) is dedicated to information and consulting rights granted to the s.r.l. and GmbH partners, respectively by art. 2476, comma 2, c.c. and by § 51a GmbHG. Italian law sets the topic “Partner’s control right” in the rule with regard to the responsibility and to the removal of the director, who is guilty of acts of maladministration. For s.r.l. a novelty is represented not only by the more wideness of the aforesaid control rights, but above all by the title attributed to each member, regardless of the share capital owned. Therefore the new arrangement of controls predominantly is left to the partner’s individual initiative, approaching the s.r.l. to the model of the individual companies. Here the procedures are analyzed to the exercise of the right to information and consultation of both the partners, s.r.l. and GmbH, even by trusted professionals. The directors’ power, then, is examined to withhold the release of the requested informations, in order to protect the social interest from the disclosure of corporate data deemed private. In the fourth chapter (“The action of social responsibility and the removal of the s.r.l. director”) the liability action is analyzed towards the director, guilty of misconduct, in relation to precautionary action of removal, in conformity with the Art. 2476, comma 3, c.c. In this case the legislator has abolished the previous reference to the s.p.a. and he has introduced “also” the possibility to remove the individual director by a preliminary injunction. Extensive review is dedicated to the director’s diligence and to his exemption of liability, especially with regard to the manifestation of dissent. The same chapter examines the not so peaceful question of the procedural substitution, or if the individual s.r.l. partner acts in the proceedings in his own name, but for a right of the company, that becomes necessary joinder in the liability action. Then, other procedural aspects of the liability action are examined, such as the company possibility to disclaimer or to settle the action, the repayment of the costs of litigation due to the individual partner claimant and the limitation of actions. ABSTRACT III The fifth chapter (“The precautionary action of the s.r.l. director’s removal”) examines the many issues surrounding the precautionary action of the s.r.l. director’s removal, in conformity with the Art. 2476, comma 3, c.c. The s.r.l. director’s removal, in fact, has been inserted by the 2003 reform only as a precautionary measure. In fact, the legislator is silent about the possibility of the director’s removal through extra-judicial remedies, which, however, are analyzed in the search. During the essay one notes that the Art. 2476, comma 3, c.c. is a much debated issue by the doctrine and the jurisprudence, which have highlighted the gaps left open by the provision. In the same chapter there is the review of the conditions of the precautionary action of removal, that is periculum in mora and fumus boni iuris. Then one analyzes the possible relationship between the precautionary action of the s.r.l. director’s removal and the subsequent action for liability, an issue that has generated several lines of thought, conflicting with each other. In addition, there is the examination of the possible introduction of the precautionary measure ante causam, before introducing the action for liability. Finally, one mentions the remote possibility of the director’s removal through the Judge (in conformity with the Art. 2409 c.c.), disappeared after the famous judgment of the Constitutional Court n. 481/2005, which has categorically excluded the applicability of that provision to s.r.l., even to those ones supplied with board of auditors. The last chapter, the sixth (“The GmbH directors’ removal and feedback with the Italian legislation”), relates to the director’s removal in the German law, as regulated by § 38 GmbHG, comparing it with the Italian law. The cardinal principle of the German legislature in terms of the company director’s removal is the directors’ extra-judicial free revocability, with the exception of the restrictions contained in the articles of association. One analyzes the assumptions and mode of the removal procedure, with an emphasis on practical cases. Even the German legal system, like the Italian one, knows the precautionary action of the director’s removal, which is governed by the general provisions regarding the precautionary measures of the ZPO. With regard to arbitration, one analyzes the arbitrators’ power to removal the director with a precautionary measure. Finally, completing the ABSTRACT IV comparison with the German legal system, there are the gaps of the Italian law in terms of director’s removal, highlighting analogies and differences with the matching German rules. In conclusion, attention is drawn, through some examples, to possible changes in Italian legislation regarding s.r.l. according to the GmbH, in order to make effective the protection of partner and creditors of the company, to attract investors and to avoid the dreaded generalized drain to other company models, whether Italian ones or foreigner ones.

The years between 1850 and 1918 in Britain saw the ascendancy of political Liberalism. The same period in Italy included the central years of the Risorgimento, a process of economic, social and cultural revival during which foreign rulers were expelled from the Italian peninsula, and the various Italian states unified. The aim of the thesis is to trace the Victorian debate on the Italian Question – the question of whether, if and how Italy might be united as a single nation – in order to shed new light on English Liberal culture, understood both as a system of governing values and as the common languages and media through which these were communicated.
