This chapter analyses the role and function of the Appeals Chamber of the ICC. The right to appeal under the Statute goes beyond what is mandated by human rights law. This contribution analyses the specificities of appeals in the ICC system, including the relationship of the Appeals Chamber to other Chambers, its jurisdiction over different types of appeal under Articles 81 and 82 (e.g. interlocutory appeal, and appeal against final decisions of the Trial Chamber), review and revision of sentences, and the relevant standards of review. The chapter contrasts approaches of the ICC with the practice of the Appeals Chambers of the ICTY and ICTR, which have used their first cases to clarify and develop the law. It shows that the ICC has taken an approach of judicial restraint. It argues that development of the law in small steps may be the most effective approach to building a lasting and meaningful role of the Appeals Chamber in the ICC system.

Resumen
This Introductory Note refers to the work of the International Criminal Tribunal for the Former Yugoslavia (ICTY) in 2016. During this period the Tribunal delivered three judgements, two by the Trial Chambers and one by the Appeals Chamber. The judgements of the two Trial Chambers have been appealed. The Šešelj case, in which the Chamber acquitted the accused, was appealed by the prosecutor. The appeals judgements are under the jurisdiction of the Mechanism and will be delivered in 2017 or 2018. There are still pending the Prlić case on appeal and the Mladić case in trial, both under the jurisdiction of the ICTY.

This chapter comments on Article 34 of the Rome Statute of the International Criminal Court. Article 34 consists of four paragraphs that list the principal organs of the Court. It has no other function than to identify the four organs. The Court consists of the following organs: (a) a Presidency; (b) an Appeals Chamber, Trial Chambers and [a Pre-Trial Chamber] [Pre-Trial Chambers]; (c) the Office of the Prosecutor; and (d) a Registry. Each organ has its own provision, to which reference should be made. The expression ‘organs of the Court’ is used in only one other provision of the Statute, article 45(4), concerning the employment of gratis personnel.

This chapter comments on Article 69 of the Rome Statute of the International Criminal Court. Article 69 deals with specific evidentiary issues but lacks a general provision like the one in the Nuremberg Charter. This is addressed in article 64, stating that the Trial Chamber has the power to rule on the admissibility or reliability of evidence. According to a Trial Chamber, ‘the drafters of the Statute framework have clearly and deliberately avoided proscribing certain categories or types of evidence, a step which would have limited — at the outset — the ability of the Chamber to assess evidence “freely”’. Chambers enjoy ‘a significant degree of discretion in considering all types of evidence’. Another judge has said that article 69 provides for ‘the principle of free assessment of evidence. Hence, it is up to the competent Chamber to decide on the probative value of any piece of evidence introduced for the purpose of the confirmation hearing or the trial’.

The chapter discusses the political and legal developments in Kenya, where President Uhuru Muigai Kenyatta and Deputy President William Samoei Ruto were until recently facing ICC indictments for their alleged involvement with orchestrating crimes against humanity. It evaluates whether the decisions of Pre-Trial Chamber II and the Appeals Chamber of the International Criminal Court authorizing the opening of an investigation and dismissing the admissibility challenge by Kenya are a turning point for the ICC in its relationship with national judicial systems in the wider fight against impunity. The chapter seeks to establish whether the decisions of the ICC Chambers limit Kenya’s primary responsibility to hold its citizens accountable. The chapter discusses the prosecutorial policy of ‘inaction’ adopted by the ICC judges and the effect of Pre-Trial Chamber II’s decision to authorize investigation in the Kenya situation based on a liberal interpretation of article 7(2)(a) of the Statute.

This chapter comments on Article 39 of the Rome Statute of the International Criminal Court. Article 39 sets out the organization and functions of Chambers. The Court is required to ‘organize itself’ into the Appeals Division, Trial Division, and Pre-Trial Division, as set out in article 34(b) of the Statute. In each of the three Divisions, the judicial functions of the Court are carried out by Chambers. The Statute gives judges the authority to organize the composition of the Chambers, which has proven difficult because judges are required to agree upon matters in which they may have strong personal interests. The composition of the Appeals Chamber, widely perceived as being the most prestigious, has sometimes sharply divided the judges. The provisions of article 39 are themselves ambiguous enough to allow for conflicting interpretations.

Pericardial disease leading to pericardial effusion (PEF) is a common clinical disorder. The most common causes are viral infections, metastatic cancer, renal disease, and bleeding disorders. PEF that accumulates slowly can become quite large before haemodynamic embarrassment occurs, while PEF that accumulates rapidly from trauma or aortic dissection can be small,yet cause haemodynamic embarrassment. As the PEF increases in size, the pressure in the pericardial space increases, leading to a decrease in atrial and ventricular chamber sizes, and limiting filling of the chambers. Ultimately, cardiac output is decreased,resulting in cardiac tamponade. When the limits of the pericardial stretch are reached, the volume in the pericardial sac becomes fixed. Any additional increase of PEF results in decreased cardiac size and any change in chamber size with respiration results in a paradoxical change in size of the other chambers. Tamponade is divided into three phases based on changes in pericardial and arterial pressure and cardiac output. Doppler echocardiography is the cornerstone of the diagnosis, follow-up, and management of PEF. It provides information about the presence, size, and location of the PEF, its impact on right ventricle, right atrium, and inferior vena cava size, and assesses tamponade physiology. Comorbid conditions may modify the signs of tamponade and need to be considered during the clinical assessment. Tamponade is not an all-or-nothing diagnosis, but instead should be viewed along a continuum of progressively worsening haemodynamics.
