Resumen
The Constitutional Court ruling on the third amendment to the Law on the Constitutional Court is worth discussing. In the judicial review, the justices judged a case in which they have interests. The interests are related to a requirement for being a Constitutional Court justice, term of office for Constitutional Court justices, and term of office for the chief justice and deputy chief justice. Can they be impartial? This study is aimed at three things. First, analyzing their interpretation through legal annotation. Second, identifying impacts the ruling has on the Constitutional Court. Third, providing a road map for judicial review related to Constitutional Court judges. This is mixed legal research using primary and secondary data. This study has found that the judges are not impartial due to conflict of interest. They have compromised universal principles of the judiciary. For the sake of impartiality, they should not be judges in their own cause. Instead, the Supreme Court should have the authority to review legislation on them.

The present study set out to understand the concept of collective access to the judicial system, starting from the verification of what this means in practice, how it is effected, and what mechanisms exist in the prevailing legal system that allow needy social groups to access the judicial system, as well as the legitimacy of the Public Legal Aid Service in defending diffuse, collective and homogeneous individual interests. In view of the current increase in the number of collective disputes involving the rights of consumers, protection of the environment, public health, among other demands with social repercussions, there arose a concern for the defence of the collective interests of those who, besides not having the financial means to pay the costs of a legal action, are lacking in knowledge not only of their rights, but also of the appropriate instruments for demanding these rights. Much has been spoken on access to the judicial system, but the understanding of its meaning remains unclear, particularly with regard to collective access to the system. As a result, it was decided to focus on this issue with the aim of formulating a concept capable of disclosing the true role of the state in providing a judicial service, taking as starting point a study of the legitimacy of the Public Legal Aid Service and its role as an essential organ of the judicial system, in accordance with the provisions of the Brazilian constitution of 1988, evaluating the performance of the service in collective legal actions, in both the cognitive and executory phases of the sentence. The meaning of terms such as lide (dispute), litígio (litigation), necessidade (need), interesse (interest), pretensão (claim), conflitos coletivos (collective conflicts), legitimidade (legitimacy), representação (representation) and interesses coletivos, difusos e individuais homogêneos (diffuse, collective and homogeneous individual interests), all of which contributed data for the investigation, was addressed. An assessment was made of the innovation introduced by Act n 11,448, of 15 January 2007, which extended the number of legal entities legitimated to initiate a Public Civic Action, including the Public Legal Aid Service, and of the criticisms of those opposed to the abovementioned legitimacy and of those members of the Public Prosecution Service who initiated a Direct Action of Unconstitutionality, all of these criticisms being refuted on the basis of a hermeneutic analysis of legal texts, an understanding of legal doctrine and the predominant stances adopted by judges. This paper sought to endorse the legitimacy of the Public Legal Aid Service in its defence of homogeneous individual and collective interests, and, above all, the diffuse interests of the less privileged social classes, bearing in mind the communitys basic right to legal assistance from the state, the successful provision of which depends on the effective actions of the Public Legal Aid Service, an indispensable condition for collective access to the judicial system

Resumen
Uganda has reached a peace agreement with the leaders of the LRA, indicted by the ICC, in which they would be tried by national tribunals and serve “alternative sentences”. The LRA demands the withdrawal of the ICC warrants as a pre-condition to any settlement. While this peace proposal may not satisfy the admissibility regime of the Rome Statute, this thesis argues that in certain circumstances the ICC Prosecutor could defer to accountability mechanisms falling short of formal prosecution and punishment if it is in the “interests of justice” to do so pursuant to Article 53 of the Rome Statute. The ICC OTP must however develop a policy on the application of this discretionary criterion which remains undefined, preferably in the form of prosecutorial guidelines. A pluralist interpretation of the “interests of justice” is most consistent with the objectives of the Rome Statute, the complementary nature of the ICC and the unique context of each situation of mass atrocity.

A new legal phenomenon has emerged in recent years, as plaintiffs from developing countries have begun to initiate civil proceedings against multinational corporations in the courts where these companies have their headquarters. These suits have typically claimed damages for personal injuries arising from the multinationals' activities in a developing country. While the doctrine of forum non conveniens blocked many of the earlier attempts by plaintiffs to seek justice overseas, courts are increasingly refusing to dismiss these cases to ensure the interests of justice are served. The purpose of this thesis will be to compare the application of forum non conveniens to these cases in Canada, with the approaches in the U.K., the U.S. and Australia. The thesis concludes that Canadian courts have the jurisdiction to consider civil claims against a resident for extraterritorial harm and that this jurisdiction can be appropriately exercised where the foreign plaintiff is not likely to receive justice in the alternative forum. Precedents from the U.K., the U.S. and Australia, where courts have already accepted such jurisdiction, will also be examined for their relevance in Canada.

Resumen
As a founding member of the Via Campesina (1993) and active participant in the Global Justice Movement (the altermondialiste movement in France), the Confederation paysanne (CP) - which literally stands for 'peasant confederation' - has been presented in academic and activist circles as a key player in the struggle against neoliberal globalisation, and as a contributor to the emergence of new transnational activist networks and a 'global civil society'. As a trade union representing the interests of 'peasants', the CP has been praised as an innovative form of professional organisation whose originality lies in its ability to defend farmers' interests while at the same time responding to a broader set of challenges for the planet and those who populate it (environmental degradation, cultural homogeneity, social injustice). As a result, the CP - and in particular its emblematic leader Jose Bove - was rapidly propelled to the forefront of a new progressive avant-garde whose discourse on the cultural and economic threats of neoliberalism found a positive echo in farming and non-farming circles alike. -- Yet, as I shall argue throughout the following pages, the CP's success was not only related to its successful response to the new challenges for the 'peasantry' and society but also to its re-appropriation of popular and essentialist representations of 'peasantness' as a timeless and intrinsically egalitarian condition. From the moment that we recognise this, our understanding of the union's evolving popularity changes. Many observers and activists, for example, explained the CP's disappointing result in the 2007 professional elections by arguing that the CP was ahead of its time.

The present work has the target of analyzing the procedural subjects involving the guardianship of homogeneous individual interests, while species of the gender of the interests or collective rights. From the doctrinary and jurisprudential analysis, it looks for the ideal understanding of the legal concepts that involve the studied theme, as well as the systematization of the collective guardianship and its harmonization with the general principles that govern our legal system. Without the pretension of exhausting the lifted up subjects, in reason of the present time of the theme, still unification pendant by the legislative way, and while the text promulgation is awaited that ponders all the kindred institutes, it accomplishes doctrinary research with the purpose of bringing current conclusions concerning the matter and the legal dispositions that today regulate the guardianship of collective interests. In this manner, subjects as the active legitimacy, the judged thing and its reach, the systemic interaction and the procedures to be used to reach the leading principles of the collective guardianship, above all by the way of the homogeneous individual interests, are analyzed through the points that cause larger controversies for, since then, to understand that new procedural reality. In that line, of great relief are the lessons of our doctrine, that from a long time develops studies seeking to adapt the existent procedural legislation and its traditional institutes to the new rights that were born with the mass society and started to demand more effective solutions for the great number of judicial demands that flow of the modern world. The Social State delineated by the Constitution of 1988 could not take place under foundations created exclusively for a law worried, above all, with the individual subjects, unable even of assisting to the democratic vindications of the contemporary society, reason for the law science, through the performance of combative and dedicated legal scholars, needed to present that new system of procedural guardianship of rights. The relevance of the collective guardianship of homogeneous individual interests and the created techniques for that are, therefore, the main point of the present study, that looks for in the doctrinary lessons the foundation to demonstrate the adaptation of the existent legal devices to that guardianship, considering for that the jurisdictional performance and the legislative projects now in course

The scope of the study pertains to how individual claims may result in collective (aggregated) claims. Interests are relationships between needs and the goods that can fulfill them. In this sense, interests can be conceived as a claim for a good. Collective interests relate to goods that are able to satisfy needs of a group of people. A conflict of interests takes place when the accomplishment of one precludes the other. The Law may be conceived as an ethical tool to the resolution of conflict of interests. Traditional litigation schemes were designed for the resolution of individual conflicts. With the recognition of collective rights by the Law, new civil procedure techniques were developed to allow resolution of collective conflicts. Despite that, the number of individual claims related to collective issues grows exponentially, causing a backlog of cases and the denial of justice. Structural, cultural and legal issues are factors leading to this problem. New techniques should be designed to convert individual claims into collective claims in cases where their object is indivisible and pertains to a group.

Woods, Roger. "Working in the interests of justice? : the Crown Prosecution Service and the prosecution of public order offences". Thesis, University of Leicester, 2000. http://hdl.handle.net/2381/30119.

Texto completo
Resumen
In 1985 the power of the prosecution of offences was taken away from the police. The Crown Prosecution Service was created to provide an efficient, fair and independent review of cases accountable to Parliament and the public. The importance of this separation of powers goes to the constitutional heart of the criminal justice process. This study is a comprehensive analysis of how prosecutors exercised their statutory powers in the 1990s particularly by reference to the prosecution of public order offences. The thesis provides an extensive analysis of the law relating to public order offences as well as a detailed picture of the prosecution of public order offences in the Manchester City magistrates' court through the use of three methods of case study data collection (a questionnaire, a cases survey and case files). The findings of the research suggest that the Crown Prosecution Service plays a re active rather than pro-active role in the decision-making concerning prosecutions for public order offences. The police are the dominant partner in the relationship between the police and Crown Prosecution Service who rely almost entirely on the police for the information available in prosecution cases. There is a need for change in the way public order offences are prosecuted so that the Crown Prosecution Service really does provide an effective and independent review of cases. Only then will the Crown Prosecution Service be working in the interests of justice and have earned its full trust and respect as a member of the criminal justice system.

The thesis aims to demonstrate that the systematic approach of homogeneous individual interests (rights of a fluid class member similar to those in a class action for damages of the US Law) in Brazil, as set forth on articles 95 to 100 of the Brazilian Consumer Code, is insufficient and innefective, especially vis-à-vis the characteristics of the Brazilian Judiciary, justifying, therefore, its legislative review. With such objective, a priori, it is adressed the necessity of adequating such discipline to the Brazilian social reality in order to guarantee that lawful authorities shall be able to respond to law breaks in a reasonable period of time, what, in correlation, requires improvements on the judicial services rendered in Brazil. By means of official data, the current understanding of national authors and most recent precedents of the Brazilian Supreme Federal Court and the Brazilian Superior Justice Court, the thesis investigates the existence of a relation between the so-called process crisis and class actions in Brazil, as well as to what extent the homogeneous individual interests are efficient in fostering the democratization of the access to justice in Brazil and, ulteriorly, the improvement of judicial services in the country. Finally, the systematic approach of the homogeneous individual interests in Brazil is critically assessed so to, as far as possible, identify its flaws, suggest best and major manners to enshrine lege lata, as well as formulate viable proposals of lege ferenda that can overcome such flaws and, consequently, enhance the injunctions based thereon.

The Strengthening Data Literacy across the Curriculum (SDLC) project has been developing and researching curriculum modules to build interest and skills in data science among U.S. high school students from historically marginalized groups. SDLC modules are centered on investigations of social justice questions using large-scale social science data and the Common Online Data Analysis Platform (CODAP). This paper examines the extent to which students show increased interest in statistics and data analysis, and stronger understanding of core statistical concepts and multivariable thinking, after completing a three-week SDLC module. This paper also discusses ways in which a social justice focus may contribute to students’ interests in and understanding of data analysis.

Resumen
Due to the negative effects of spatial development, the current social and environmental conditions require unified concepts of solutions aimed at reducing disparities, poverty and increasing various forms of justice. Sustainable development, as the predominant environmental discourse of modern times, has been facing the problem of implementing fundamental guidelines in practice since its establishment in the mid-1980s. The balance of socio-economic, economic and especially environmental indicators, which is still perceived as an unrealizable utopia of modern society due to the inconsistent conception of the concept and action from the position of power, influence of capital and interests of "strong" countries, through narrow economic and political interests. In the prevailing, neoliberal global order, it represents an increase in the influence of partial interests (capital, influential countries, elites) on decision-making (including individual economic and political decisions of governments), departure from original, otherwise good intentions and impulses, changes in social behavior. There are several reasons for the mentioned stagnation and unsuccessful activation of changes in space, and especially global inactivity. The fundamental problem is the lack of political justice, which is a prerequisite for ensuring all other justice (environmental, ecological or social), which leads to reducing equality and differences in society and limiting and ensuring the rights and duties of the individual or the interests of society as a whole.

Resumen
The focus on the promotion and protection of human rights in social work has enabled innovations in the field of criminal justice and opened new opportunities for the profession of social work. Accordingly, the paper seeks to consider the role of forensic social work in the application of restorative justice in the protection of human rights. In the first part of the paper a brief overview of the history of forensic social work will be presented, as well as the opportunities and challenges that accompanied it and which are current today. Bearing in mind that restorative justice is increasingly a way of thinking when it comes to sanctions and/or justice in criminal law, it will be shown how it represents the bridge between criminal justice and social work. That is, it shows how social work can potentially represent a balance between social control and social support. At the end of the paper, there is room for discussion on the challenges of forensic social work in more proactive protection of human rights, as well as in the consistent use of restorative justice in the best interests of users.

The article deals with the tendency of replacing the right with the written law. This turns the law into a legal technology that can explain any decision made in it, including against the previously adopted laws. This phenomenon deprives the modern legislation of the necessary properties of stability, legal certainty, ensuring a balance of interests, justice. There are proposed ways to overcome this tendency, the need for quality training of lawyers, including the specialization of lawmaking

Официально провозглашенные цели приватизации находились в рамках национальных интересов России, а механизмы ее проведения сохраняли видимость социальной справедливости при разделе государственной собственности. it is impossible not to touch upon the consequences of the reforms of the 1990s in Russia when analyzing the topic "Privatization" in the context of the educational process. This information will help to form a correct socio-economic view of the processes in society at that time. In terms of political and ideological characteristics, privatization became an official policy, carried out based on an approved strategy, developed legislation, under the influence of certain political interests and actors. Officially proclaimed goals of privatization were within the national interests of Russia, and the mechanisms of its implementation preserved the appearance of social justice in the division of state property.

Resumen
Noticing the conclusion of the Preliminary Objections Judgment in the case of Mauritius vs. Maldives Maritime Delimitation, this paper asks whether the Special Chamber’s decision has resolved the sovereignty dispute over the Chagos Archipelago. It re-examines the conclusion that the continued claim of the United Kingdom to sovereignty over the Chagos Archipelago is a mere assertion and the UK has no legal interest in it. This paper argues that the legal system has a self-reproducing nature by which the Special Chamber regenerates decisions already established in the legal system as the distinction between lawful and unlawful is the most fundamental determination of this system. In this sense, the confirmation of the Advisory Opinion of the International Court of Justice by the Special Chamber should be regarded as a consequence of its subjectivity and the fact that it almost distinguishes the legal system from other systems outside the law. From a perspective outside the legal system, the claim of courts that its role of “dispute settlement” is more like “case settlement”, since courts are resolving disputes after legalization, not the disputes themselves. The de facto settlement of disputes should be based on the elimination of the interests or claims of the disputing parties. In this sense, dispute settlement depends on how the legal and political systems work together in a coupling relationship.

Kelly, Luke. Evidence on the Role of Civil Society in Security and Justice Reform. Institute of Development Studies (IDS), diciembre de 2020. http://dx.doi.org/10.19088/k4d.2022.031.

Resumen
This rapid review focuses on the role of civil society in SSR in several contexts. It finds that donor driven SSR is seen to have failed to include civil society, and that such efforts have been focused on training and equipping security forces. However, in some contexts, donors have been able to successfully develop civil society capacity or engage civil society groups in reforms, as in Sierra Leone. There are also several examples of security and justice reforms undertaken by local popular movements as part of regime change, namely Ethiopia and South Africa. In other contexts, such as Indonesia, the role of civil society has led to partial successes from which lessons can be drawn. The theoretical and empirical literature attributes several potential roles to civil society in SSR. These include making security and justice institutions accountable, mobilising a range of social groups for reform, publicising abuses and advocating for reform, offering technical expertise, and improving security-citizen relations. The literature also points to the inherent difficulties in implementing SSR, namely the entrenched nature of most security systems. The literature emphasises that security sector reform is a political process, as authoritarian or predatory security systems are usually backed by powerful, skilled and tenacious vested interests. Dislodging them from power therefore requires significant political will – civil society can be one part of this. The evidence base for the topic is relatively thin. While there is much literature on the theory of SSR from a donor perspective, there are fewer empirical studies. Moreover, scholars have identified relatively few successful examples of SSR. The role of civil society is found to be greater in more economically developed countries, meaning there is less discussion of the role of civil society in many African SSR contexts, for example (except to note its absence). In addition, most research discusses the role of civil society alongside that of other actors such as donors, security services or political elites, limiting analysis of the specific role of civil society.

Resumen
The author characterized the Ukrainian national values, national interests and national goals. It is emphasized that national values are conceptual, ideological bases, consolidating factors, important life guidelines on the way to effective protection of Ukraine from Russian aggression and building a democratic, united Ukrainian state. Author analyzes the functioning of the mass media in the context of educational propaganda of individual, social and state values, the dominant core of which are patriotism, human rights and freedoms, social justice, material and spiritual wealth of Ukrainians, natural resources, morality, peace, religiosity, benevolence, national security, constitutional order. These key national values are a strong moral and civic core, a life-giving element, a self-affirming synergy, which on the basis of homogeneity binds the current Ukrainian society with the ancestors and their centuries-old material and spiritual heritage. Attention is focused on the fact that the current problem of building the Ukrainian state and protecting it from the brutal Moscow invaders is directly dependent on the awareness of all citizens of the essence of national values, national interests, national goals and filling them with the meaning of life, charitable socio-political life. It is emphasized that the missionary vocation of journalists to orient readers and listeners to the meaningful choice of basic national values, on the basis of which Ukrainian citizens, regardless of nationality together they will overcome the external Moscow and internal aggression of the pro-Russian fifth column, achieve peace, return the Ukrainian territories seized by the Kremlin imperialists and, in agreement will build Ukrainian Ukraine.

Resumen
Land reforms sacrifice property rights in the name of a fairer distribution. The trade-off they imply makes their study of interest to Economic Historians: do the benefits of reduced land inequality justify the violation of property rights? The discussion about land reforms factors in both the social and efficiency consequences of land inequality. The debate preceding the Portuguese Agrarian Reform echoes these concerns and culminated in an anti-latifundia sentiment crystallized in the legislation used to justify the land occupations of 1974 to 1976. The aim of this paper is to critically assess the efficiency arguments used to justify the occupations. Was land productivity lower in latifúndio counties? A unique dataset drawn from primary sources was specially assembled to answer this question. Through standard OLS regression, this study finds that the number of agriculture journeyman per employer landowner has a statistically significant effect on agricultural productivity after controlling for geographical and soil characteristics. It also finds that introducing literacy as a control causes the effect of land inequality to disappear leading to the conclusion that policies aimed at improving human capital would have been just as effective as a land reform. Further, this study also identifies the crop mix selected as the proximate channel of transmission. Farmers in the region with the highest levels of land inequality favoured less valuable crops, like wheat. An arid climate combined with a lack of irrigation infrastructure and wheat protectionism justify this preference.

DeMarle, David y Andrew Bauer. In situ visualization with temporal caching. Engineer Research and Development Center (U.S.), enero de 2022. http://dx.doi.org/10.21079/11681/43042.

Texto completo
Resumen
In situ visualization is a technique in which plots and other visual analyses are performed in tandem with numerical simulation processes in order to better utilize HPC machine resources. Especially with unattended exploratory engineering simulation analyses, events may occur during the run, which justify supplemental processing. Sometimes though, when the events do occur, the phenomena of interest includes the physics that precipitated the events and this may be the key insight into understanding the phenomena that is being simulated. In situ temporal caching is the temporary storing of produced data in memory for possible later analysis including time varying visualization. The later analysis and visualization still occurs during the simulation run but not until after the significant events have been detected. In this article, we demonstrate how temporal caching can be used with in-line in situ visualization to reduce simulation run-time while still capturing essential simulation results.

Resumen
This report summarizes a review of the scientific foundations of bitemark analysis conducted by the National Institute of Standards and Technology (NIST). Bitemark analysis typically involves examining patterned injuries left on a victim or object at a crime scene, identifying those injuries as bitemarks, and comparing those marks with dental impressions from a person of interest. This review specifically focuses on pattern injuries found on human skin. Over 400 sources were considered via literature searches and input from previous efforts by the National Institute of Justice Forensic Technology Center of Excellence. Our NIST review also utilized input from an October 2019 Bitemark Thinkshop organized by the Center for Statistics and Applications in Forensic Evidence (CSAFE) where experts and stakeholders associated with bitemark analysis were convened to discuss key issues. Based on this input, our study found a lack of support for three key premises of the field: 1) human dentition is unique at the individual level, 2) this uniqueness can be accurately transferred to human skin, and 3) identifying characteristics can be accurately captured and interpreted by analysis techniques. Furthermore, our review noted a lack of consensus among practitioners on the interpretation of bitemark evidence as well as thoughts on how to move the field forward. If the field seeks to advance, the key takeaways provided in this review are starting points for areas needing improvement, not an exhaustive list of specific shortcomings.
