Texto completoThe "new" discipline on complementary pensions, introduced by D. lgs. December 5, 2005, No 252, "Regulation of supplementary pensions, pursuant to authority granted by Law August 23, 2004, No 243 "rules on pensions and the government delegation in the field of public security, to support additional security and stable employment and the reorganization of security agencies and assistance required", is characterized by some typical elements of the original model of derivation (and, namely, to the D. Lgs. April 21, 1993, No 124 and above by subsequent modifications and integrations), but also by significant innovations in the past. The theme will be limited to the investigation of the role played by individual autonomy and collective autonomy in the system of complementary pension reform. Indeed, the new regulations has changed some aspects of absolute importance, the previously established balance between the role played by the individual (as a member) and the unions. Complementary pensions that with the aforementioned rules from the original D. lgs. No 124, 1993, appeared to be a phenomenon purely trade union, has gradually (and also through legislation "intermediate") went to "individualize" and, say, the Legislator has sought ever more manifest, to make "participant" the member (or potential member, since - despite the original principles expressed in the first version of the Law of delegates - even with the 243, L. 2004 and with the Legislative Decree no. No. 252 of 2005, there was "opted" for a "mandatory" additional security). The (undeniable) basic choice was made by the Legislature in 2005 with choices often little net (or at least so certainly less consistent than that established by the same 243, L. 2004) and, on numerous occasions, marked by hesitation , thoughts and contradictions. It is therefore appropriate to analyze the "current" balance the roles of collective autonomy and collective autonomy in some areas "crucial" and reform, namely, those relating to "time" establishing funds, the monitoring tasks , supervision, information and standardization of COVIP (if only because the individual can "effectively participate" only if the system is transparent) mode of financing, the "portability" of the individual position as well as in terms of performance, purchase and advances. If indeed the intention of the legislature of 2005 was to be finally "take off" (or rather groped to take off) the second pillar pension, it would seem possible at first (and perhaps approximate) reading D. lgs. No 252 of 2005, believing that "the" solution would be to invest the individual of the title role of "market". The legislator has thus given the task of individual autonomy stimulate competition and bring about an improvement of the 'offer "to" market ", operated no more (or at least not in a hierarchically higher-level) collective autonomy, but a series (rather diverse) of subjects. Besides the need to provide a "tool" more attractive to the individual (which, as mentioned, will have to decide "whether" to enter the second pillar pensions) is due to the now all too familiar crisis of basic security, since the nineties, led (according to some legal "course", according to another "necessity") to design a security system in place additional support from the public. It is perhaps this link with the public welfare (or, if you prefer, the functionalization of the supplementary pension to the basic one) not to be allowed and not even make appropriate (as, however, felt the same legislator of the reform) a mortification of the role of collective autonomy, however, should continue to act as "guarantor" of mutual purpose and solidarity which must continue to characterize the complementary pensions. If this is true, it is equally true that real risk of having "created" a discipline with strong moments of tension and contradiction between the "two" different "souls" of the supplementary pension is divided between a "spirit of solidarity and mutual (including support for public welfare) and a "calling" the most selfish and mercantile (close to an investment on an individual basis). D. lgs. 252 of 2005 acting on the balance between individual autonomy and collective autonomy has been an influence, even more sensitive about such critical background, showing even more clearly, the existence of a hybrid system and in many respects inadequate. The pair of driving guidelines relating to 'individual autonomy and collective autonomy has also significant impact on an issue that, despite the doctrine now tends to minimize, continues to be of central importance, that is, the constitutional position of the uncertain complementary pension schemes, even to define what are the tools needed to ensure means "adequate" to the needs of life. If, indeed, after the notes of the Constitutional Court decisions, the issue of constitutional position of the supplementary pension seemed (at least partially) resolved, the discipline of D. lgs. No 252 of 2005 requires further consideration, since an 'exaltation of individual autonomy (especially with reference to the possibility of "leakage" from the system through individual choices devolved autonomy) puts a strain on a structure that was inspired by a model face protection also (and especially) the collective and general. The subject of analysis on the role played collective autonomy and individual autonomy is intertwined, therefore, necessarily with that on the "nature" and "function" of the same supplementary pension. Moreover, only by accepting a complementary pension "free" will reduce "the minimum" legal constraints placed both individual autonomy and collective autonomy, and a supplementary pension "functionalized" also allows the general and collective interests (or rather : Force) regulatory intervention of the legislator certainly more invasive and to limit the spaces left to the individual (whose interest is opposed, often, the collective and general) and to invest the autonomy of the role of guarantor of the collective end mutual and solidarity within the regulatory framework. However, D. lgs. No 252 of 2005 is a discipline that undoubtedly affected all exposed weaknesses and contradictions and seeks - through a redefinition of roles of individual and collective autonomy - a significant development of the second pillar pension, without, however, succeed (but perhaps without even the ambition) to solve some problematic background of the system, a number of respects, appear to have widened even compared to previous arrangements.

Texto completoThe essay aims to analyze the main problems related to the use of individual worker’s self defense, as a measure finalized to protect his rights and to enforce their effectiveness, as an alternative to a legal action in Court. After making some general remarks about the issue in civil law, the work moves on to examine the systematic effects of self defense, whenever it is used in employment contract by the employee to justify the refusal of job performance as a response to the unlawful use of employer’s powers. The final section is dedicated to check if the contractual remedy based on article 1460 of the civil code could be a useful tool particularly to counteract unjustified demotions or the breach of the regulation of the change of tasks after the reform of the article 2103 of the civil code. The research’s goal is to find a balance between managerial prerogatives and the human dignity and professionalism of workforce, using the general clauses of good faith and fair dealing, also considering the importance of Labour protection in the Italian Constitution.

Texto completoCritical interest in the rich literary production of Johann Christian Günther has been focussing on the possibility of recognizing in his poems the first example of subjective poetry after the great rhetoric season of the 17th century. Most studies investigating the innovative value of Günther's work concentrate on his Liebeslieder or Klagelieder. The present work concentrates instead on his religious poems, and aims to demonstrate that also in his geistliche Lyrik the author is able to offer a personal, sometimes autobiographical, reading of traditional themes, despite the persistence of typical baroque elements. While his early lyrics tend to remain faithful to the scarcely original imitation of pre-existing models, his later poems show a different approach to religious material. This evolution takes the form of a personal and conscious elaboration of spiritual themes, characterized by a considerable influence of pietism. The present research examines in particular Günther's Perikopenlieder, known as Geistliche Oden uber einige Sonn- und Festtage des sogenannten Christlichen Jahres des Herrn de Sacy verfertiget, his Bibeldichtung, his Weihnachtslieder and his Bußlieder.

Texto completoThe development of the thesis intends to analyze three issues that are crucial in the role that criminal law can issue in protecting the environment: first of all, the work is focused on environmental criminal liabilities, the individual and the corporate one, in which the crime has been produced, in order to check the limits of the Italian system of environmental criminal law related to the Legislative Decree n. 231/2001. Then, the work focuses on the role of corporate compliance: structuring organized systems to detect alerts and ways to manage the crime-risk is the way in which law tries to anticipate the commission of environmental offenses that are known to have an exponential diffusivity. The third part of the work focuses on the analysis of the role played by Restorative Justice in environmental crime law: a shared paths of reparation of the damage caused to the environment by both individuals and corporations could be a way to efficiently predict (and prevent) future damages and restore victims that suffered because of that crime.

Texto completoLa psicologia positiva si occupa dello studio delle caratteristiche che possono contribuire al funzionamento ottimale dell’individuo e della società (e.g. Gable & Haidt, 2005), facilitando, per esempio, il benessere individuale o l’apertura prosociale. Una delle caratteristiche maggiormente considerate è la mindfulness, una forma di consapevolezza non giudicante rivolta all’esperienza presente, momento dopo momento (e.g. Kabat-Zinn, 1990). Più recentemente, alla mindfulness si è affiancato lo studio della self-compassion, un atteggiamento non giudicante verso le proprie inadeguatezze (Neff, 2003). Entrambe queste variabili sembrano associarsi a diversi indicatori di benessere individuale (e.g. Bernard & Curry, 2011; Keng, Smoski, & Robins, 2011). Meno chiara è invece la loro associazione con gli indicatori di apertura prosociale (e.g. Block-Lerner, Orsillo, & Plumb, 2004, Neff & Germer, 2013). Allo scopo di chiarire meglio le associazioni della consapevolezza e dell’accettazione sia con il benessere individuale sia con gli indicatori di apertura prosociale, sono stati teorizzati due nuovi costrutti. Il primo, definito “consapevolezza emotiva”, consiste in una forma di consapevolezza non giudicante rivolta verso le proprie emozioni, positive e negative, così da riuscire a provarle appieno, senza negarle o distorcerle. Il secondo costrutto, definito “self-caring”, misura da un lato la consapevolezza di avere bisogno di aiuto nei momenti di difficoltà, e dall’altro la capacità di accettarlo quando offerto. Come per la self-compassion (e.g. Birnie, Speca, & Carlson, 2010), anche per la consapevolezza emotiva e il self-caring la mindfulness è considerata essere un precursore. Scopo generale della presente tesi è indagare la relazione di mindfulness, self-compassion, consapevolezza emotiva e self-caring con diversi indicatori di benessere individuale e di prosocialità, tenendo sotto controllo gli effetti della desiderabilità sociale. In particolare, si procede a testare l’ipotesi che l’associazione tra la mindfulness e gli indicatori di benessere individuale e prosocialità sia mediata da un aumento nelle capacità disposizionali di self-compassion, consapevolezza emotiva e self-caring. Allo scopo di testare questa ipotesi, è stato innanzitutto necessario procedere alla validazione delle versioni italiane delle scale per la misurazione della mindfulness e della self-compassion, ovvero la Mindful Attention Awareness Scale (MAAS; Brown & Ryan, 2003; Studio 1), e la Self-Compassion Scale-Short Form (SCS–SF; Raes, Pommier, Neff, & Van Gucht, 2011; Studio 2). È stato inoltre necessario sviluppare due strumenti per la misurazione della consapevolezza emotiva e del self-caring e testarne le proprietà psicometriche principali (Studio 3). In seguito, attraverso un’analisi fattoriale confermativa, si è dimostrato che i costrutti indagati, pur con aree di sovrapposizione, sono distinti ed è stata controllata la loro suscettibilità alla desiderabilità sociale (Studio 4). Il quinto studio ha esplorato preliminarmente la relazione di mindfulness, self-compassion, consapevolezza emotiva e self-caring, sia con indicatori di benessere sia di prosocialità, testando per la prima volta l’ipotesi di mediazione. Infine, gli ultimi due studi hanno indagato in modo più specifico e approfondito l’ipotesi di mediazione. In particolare sono stati utilizzati rispettivamente indicatori di benessere generale, soggettivo e psicologico (Studio 6) e di rispetto incondizionato e personalità prosociale (Studio 7). In questi ultimi due studi si è testata anche un’ipotesi di mediazione a due livelli, in cui in aggiunta ai mediatori di primo livello (self-compassion, consapevolezza emotiva e self-caring), vi sono due mediatori di secondo livello, ovvero la propensione alla gratitudine, variabile che ha già dimostrato di associarsi a un maggior benessere e prosocialità, e l’inter-essere, un nuovo costrutto di derivazione orientale. In tutti gli studi, l’ipotesi di mediazione è stata testata attraverso la tecnica delle equazioni strutturali. I risultati degli studi nel complesso sembrano suggerire che la mindfulness si associ a un miglior benessere individuale e una maggior prosocialità attraverso soprattutto un aumento in consapevolezza emotiva, gratitudine e inter-essere. Vengono discussi punti di forza, limiti, implicazioni degli studi e prospettive future.

Texto completoIn the "Automatic Society" technology is crucial. The defining notion of "pharmakon", according to Bernard Stiegler, implies a double meaning: on one hand technology is a useful "remedy" to support individuals and increase their abilities, on the other hand it is a poison, a threat to human agency. Automation in Manufacture has been introduced since decades, however, the range of applicability of Artificial Intelligence is currently widening in every industry, potentially undermining the role of human beings in all contexts. It is therefore necessary to analyse the nature and the value of those human capabilities that cannot be borrowed or replicated by technological devices. The first section of this work is focused on the discourse about scientific-technical progress and the thought of Bernard Stiegler. Part Two is about the rediscovery of Human Capabilities, starting from the notion of Intelligence up to the "capability approach". The case study was carried out at the consulting firm Deloitte US and the Interfaith Ministries of Greater Houston, Texas, with the aim of exploring the implementation of a HR project named "Enduring Human Capabilities", an innovative methodology for managing and evaluating personnel, based on the assessment and development of intangible human capabilities rather than quantitative parameters.

Texto completoThe research investigates the meaning and the scope of the concept of exploitation in Italian criminal law, particularly by addressing if a notion of exploitation characterized by the presence of the victim's consent (that we call “strictly speaking” exploitation) has an autonomous relevance in this legal field. Therefore, the research – in the light of an analysis of national and supranational doctrine and jurisprudence – focuses on the concepts of "vulnerability" and “taking advantage/abuse of others' condition of vulnerability", which are pivotal to define the disvalue of the human exploitation and to justify why the consent given by the victim to her/his exploitation can be considered irrelevant; it also analyzes critically the different positions emerged in doctrine and jurisprudence in this field, suggesting some solutions consistent with the proposed interpretative model. The criminal relevance of consensual exploitation is then compared with the principles of the Italian legal system (legality, offensiveness, subsidiarity and proportion, effectiveness).

Texto completoThe most important treatment to prevent conditions such as being overweight and obesity, is regular exercise which increases daily energy expenditure and consumption of lipids. Numerous studies have described the relationship between exercise intensity and fat oxidation, the most recent in particular focused on FATmax. The first study verified the reliability of the software Polimedicus and the effects of aerobic training to FATmax. 16 overweight subjects were enrolled, about 40-55yrs old, and underwent incremental test until they reached an RER of 0.95, and from that moment the load increased of 1km/h every minute until exhaustion. Subsequently, it was checked if the values extrapolated from the program were those that may occur during a constant test of an hour. The subjects after 8 weeks did another incremental test. The final data has shown Polimedicus is not very reliable, especially the HR. In the second study new program was developed, Inca, and the results were compared to the data obtained from the first studies by Polimedicus. The final date have shows Inca is more reliable than Polimedicus. In the third study, we wanted to verify the accuracy of the calculation of the FATmax with Inca with the FATmaxwork test. 25 overweight subjects, between 40-55 yrs old, were enrolled and submitted to a FATmaxwork test. Subsequently, it was checked if the values extrapolated from INCA were those that may occur during a constant test load of an hour. The analysis showed accuracy of the calculation of FATmax during the workload. Conclusion: The difficulty of determining this parameter was highlighted, due both to the large inter-individual and intra-individual variability. In the future we need to improve INCA to allow us to obtain even more valid training protocols.

Texto completoThis thesis provides an analysis of the pertinent aspects of the liability of corporate directors for breach of their fiduciary duties in case of collegial functioning of an Italian s.p.a.'s board of directors. The liability of the directors must be determined on an individual basis and whether they are exculpated from liability for a breach of their duties can vary for each director based on his specialized skills and on the role he plays in the board (independent director, president, member of a committee), regardless of the entering of the dissent from the board's action into the corporate records. The liability is joint and several where two or more directors jointly participate in the same breach of a fiduciary duty with a right of contribution inter se. The corporation ( S.P.A. ) may waive to the protection secured by the joint and several liability rule either (i) by opting for a proportional liability regime with respect to the directors' liability vis-a-vis the corporation and except for the cases of directors' fraud or gross negligence or (ii) by entering into partial settlements with one director (or more directors) for the portion of the damage attributable to his (or their) personal fault.

Texto completoIn complex networks, information transfer is ensured by an efficient topological architecture. A methodology to causally validate this structure-function relationship is represented by Transcranial Magnetic Stimulation (TMS), a form of noninvasive brain stimulation that can act on the neural mechanisms underpinning cognition. The aim of this project was to study the topographical properties of the individual connectome, determine its response to external perturbations and use this information to tailor the selection of stimulation targets in the brain. To achieve these aims, we conducted a series of studies employing graph theory and network theory analyses to determine interindividual differences in the brain information flow and cognitive efficiency. In Study 1, we investigated how interindividual differences in brain topology account for differences in executive functions (EF) and how genetic factors might shape such a relationship. The neuropsychological and resting state functional magnetic resonance imaging data of 453 twins from the Colorado Longitudinal Twins’ Study and 463 twins from the Human Connectome Project (HCP) were analyzed. Through an approach of step-wise in silico network lesioning of the individual functional connectome, we showed that interindividual differences in EF are associated with different dependencies on neural networks at rest. In Study 2, we further addressed the heritability of brain resilience to in silico network lesioning, following the removal of either brain nodes or connections. Evidence of moderate heritability was found for inter-networks, interhemispheric links and for additional topological indices. In Study 3, we moved to investigate if personalized neurostimulation results in enhanced protocol’s reliability and efficacy. Twenty-four subjects underwent single pulse TMS over two nodes belonging to the Dorsal Attention (DAN) and Default Mode (DMN) Networks, respectively. Across visits, the stimulated target for both networks was chosen either based on group-derived networks’ maps or personalized based on individual anatomy and functional profile. All stimulation visits were conducted twice, one month apart, during concomitant electroencephalography recording. Preliminary results suggest higher reliability of the results following individualized protocols, especially for the DAN stimulation. Finally, in Study 4, we tested network control theory approaches for the prediction of the optimal stimulation target(s) in TMS interventions. Simulations were run on 400 HCP participants, with test-retest data available for 45 of them. Ideal stimulation nodes were defined as the ones able to guide the system from an initial state to a desired target state. We modeled the efficacy of stimulation applied to traditional stimulation sites compared to input nodes derived from network control theory (NCT) predictions. Results suggest that the amount of network engagement following stimulation of NCT-derived cerebral sites is significantly higher compared to traditionally employed neuromodulation sites, suggesting NCT as a useful tool in guiding brain stimulation. This project aims at studying interindividual differences in brain topology as a proxy to understand inter-subject variance in high order cognitive functioning and the impact of genetic and environmental influences in shaping this relationship. Furthermore, it represents a first attempt in addressing the importance of personalization of care in consideration of the benefit/cost ratio. Overall, this project highlights the strengths of applying network sciences to the understanding of the continuum between brain topology and cognitive functioning, of the modeling of information transfer in the brain, and in the neural pathways underpinning brain stimulation.

The thesis is divided into three papers and the fil rouge is the use of experimental design as research methodology. Recognizing creativity as a strategic competence and a measure of individual or team performance, the first paper compares the effect of three leadership styles – transformational, transactional and laissez-faire – on individual creativity, thus showing which leadership behavior is the most suitable for enhancing it. Positive and negative moods are included in the research design as mediators and individual intrinsic motivation is included as moderator. The second paper is an extension of the first one and investigates the same relationships at a team level of analysis. Furthermore, not only leaders are relevant for the organizations, but followers too. Talents are the life-bloods of organizations and their behaviours have to be detected for attracting them, but also for retaining and managing them. The third paper untangles the job seekers’ behaviors in looking for a job and choosing a company rather than another one basing their choice on the screening of social media and social network pages.

Texto completoThe principle of individual criminal responsibility plays a crucial role among all the different strategies to face the manifold criminal phenomena which currently undermine cultural heritage. Against the recent historical background, where the cultural heritage has been intentionally injured because of iconoclastic waves, the present research pursues a main objective, which can be summarized into the following query: is it possible to affirm the consolidation of the principle of the individual criminal responsibility vis-à-vis the intentional destruction of cultural property committed during peace time? In order to solve this question, the research follows the reasoning adopted by international criminal courts in order to affirm the principle of individual criminal responsibility for violations of international law. In particular the present work, which consists of two parts, aims to ascertain the fulfillment of the three criteria enunciated by the international criminal courts: (a) the existence of rules of international law laying down a specific obligation to protect cultural property; (b) the production of serious consequences in case of violation of such rules; (c) the generalized criminalization, into national legal systems, of a such offence. Consequently, the first part of the work – of an introductive character – is addressed to a systematic overview of the relevant legal framework, whose evolution highlights how the international tools have been characterized by either a progressive extension of cultural good notion, or an evolution of the pursued ratio legis. Therefore, the analysis takes moves from the ius in bello norms which have granted an immunity to cultural property, based on its civilian character and aiming to prevent those damages which are typically caused by armed conflicts. Finally, and especially, it considers those norms of a wider scope which – embracing the broader notion of cultural heritage – have interpreted the cultural property protection as a constituent part of the human rights protection system. Thus, addressing the attention on the most recent achievements of this evolutional process, the research turns to those legal instruments – such as Article 27 of the Universal Declaration of Human Rights (1948) and Article 15 of the International Covenant on Economic, Social and Cultural Rights (1966) – whereby the international obligations related to cultural property could be interpreted as tools to defend a humankind interest, namely the peaceful enjoyment of the cultural rights: i.e. the right to take part to cultural life, as well as the right to have a cultural identity. However, the pivot of the present research is its second part, which is focused on the consequences deriving from the violations of the relevant international rules protecting cultural property and, consequently, from the cultural rights infringements. Indeed, the second part intends to establish whether the Rome Statute provisions has been overtaken by new rules of customary international law, according to which the intentional destruction of cultural heritage constitutes, besides a war crime, even a crime against humanity. To this scope, the analysis deals with the reactions that international actors have implemented for facing the iconoclasm plague. In order to ascertain the criminalization degree, the work firstly focuses on the pertinent case-law of the international criminal tribunals: indeed it is known that the International Criminal Tribunal for the former Yugoslavia before, and the Extraordinary Chambers in the Courts of Cambodia then, have already condemned the intentional attacks directed against cultural sites as crimes against humanity sub specie of persecution. Ultimately, the object of the last part is represented by the national legal systems, whereby it is given to retrace the criminal relevance degree which is recognized to the destruction of cultural heritage.

Texto completoA distância psicológica é um conceito que tem sido amplamente estudado e analisado no âmbito de estudos relacionados com o fenómeno da internacionalização das empresas. Investigadores da Universidade de Uppsala, na Suécia, avançaram na década de 70 com um modelo comportamentalista que pretendia explicar a forma como as empresas tendem a se comportar no decorrer de um processo desta natureza, considerando ser consequência do grau de distância psicológica, definindo-a como “a soma dos factores que interferem no fluxo de informação entre países” (Vahlne e Wiederheim-Paul, 1975; Johanson e Vahlne, 1977). Desde então, muito se tem dito e escrito, sendo que uma das principais correntes (Sousa e Bradley, 2005, 2006 e Evans e Mavondo, 2002) defende a operacionalização através do que eles consideram ser os dois elementos mais importantes do conceito: “psychic” e “distance”, ou seja, aferindo as percepções das diferenças entre países dos gestores. Os valores individuais têm sido objecto de interesse nas mais diversas áreas do conhecimento relacionadas com o comportamento humano, desde a gestão, psicologia, sociologia ou a antropologia, sendo o trabalho de Shalom Schwartz reconhecido como um dos mais proeminentes. O seu estudo é essencial para se compreender o pensamento e a acção humana e, por consequência, o comportamento dos gestores e das organizações. Neste trabalho discute-se o relacionamento entre os valores individuais identificados nos estudos de Shalom Schwartz e a distância psicológica quando analisada ao nível das percepções individuais. Após uma revisão da bibliografia e formulação de hipóteses tendo como alvo o objecto do nosso estudo, obteve-se um conjunto de resultados significativos tendo por base uma amostra de 121 gestores portugueses, dos quais destacamos os seguintes: - O modelo de distância psicológica individual não é um construto unidimensional mas sim detentor de várias dimensões, devendo-se, quando analisamos as percepções face a um determinado mercado externo aplicar uma análise factorial. - Os resultados obtidos permitem especular sobre a hipótese (a confirmar em estudos posteriores) de a interpretação dos valores de Schwartz ser influenciada quando o objecto avaliado represente valores opostos aos seus. - As variáveis constantes do modelo de distância psicológica individual: - condições climatéricas; PIB per capita; língua e os valores culturais, crenças, atitudes e a tradição – são as que têm maior tendência a serem influenciadas pelos valores individuais. - Tal como verificado por Sousa e Bradley (2006), os gestores conservadores são mais renitentes a avançar para um processo de internacionalização, visto percepcionarem as diferenças entre países de forma mais acentuada. - Os valores individuais influenciam mais as percepções dos homens que as das mulheres.
