Texto completoThe interweaving of divine and religious, on one hand, of law and noticeably of international law on the other hand, is a matter which topicality hits the observer. After decades during which secularisation and the end of History may have hidden such an interweaving, the latter suddenly came back to appear to the Western eye at the beginning of the 21st century. A more careful examination demonstrates that the withdrawal of divine and religious from the law field was an impression mainly felt in the last two centuries West: it did not affect identically all state and, inside, all of the states. If it is insisted in this work on the Bible, more than in the sacred texts of other religions, it is precisely because the Bible influenced the West, which is the geographical and intellectual area where the secularisation movement was born. It is in this area that central concepts of international law, as state and sovereignty, dawned. Both two concepts are influenced by the reading of the Biblical text, and the Christian viewpoint is presented here as well as the Jewish viewpoint. Both those viewpoints have fed debates, of which one opposed controversially two of the major 20th Century law philosophers. This controversy illustrates the limits of the intellectual movement of secularisation, which interests first and foremost national public law and international law. As a matter of fact, secularisation does not prevent state to figure itself as a new shape of divinity, which goods offered to the citizens are called welfare (“providence” in French). The main expression of the social contract, the Constitution, includes in numerous cases explicit references to divine and to religion. Those are even more underlined in the particular case of the relations between Israel and the Holy See, two states owe much to the Bible, though in different scales and in interpretations that have long lastingly prevented the recognising of one by the other. There again, divine and religious go on imprinting public and international law

Texto completoThis work deals with three related philosophical problems : logical fatalism, the dilemma of divine foreknowledge and human freedom, and the ground of providence. These questions are handled through the analysis of Leibniz and some of his precursors, most notably the Jesuits. We insist on Leibniz's twofold attitude – of both continuity and rupture – toward the scholastic tradition. In the light of these general questions, other concepts, like the interpretation of modalities, the nature of time and its relation to eternity, etc. We adopt an analytical method according to which the rational reconstruction of arguments is preferred to the presentation of philosophical systems. From an historical point of view, this work tries to account for the way perennial philosophical topics found their birth place in theologically orientated discussions. This is especially clear in the case of an understanding of counterfactuals and the device of possible worlds in modal theory: both topics receive an original treatment in the context of the theory of Middle knowledge

Texto completoJohn Philoponus (c. 490 - 575 CE), an influential commentator on Aristotle and Christian thinker, holds an important place in the history of science and philosophy. Trained at the Neoplatonic school of Ammonius in Alexandria, Philoponus moved away from pagan philosophy to adopt and develop a creationist philosophical framework. This transition from an eternalist thought inherited from the Greek tradition to a Christian creationist perspective constitutes the apparent tension in his work. The main objective of this thesis is to examine how Philoponus integrates the principles of natural philosophy within a Christian theological framework, thus seeking to harmonize his principles with biblical revelation. Through the De Opificio Mundi, a commentary on the creation narrative in Genesis, Philoponus develops a cosmological system where creation ex nihilo and divine providence play a central role. This thesis explores how Philoponus articulates this synthesis. We follow the phases of creation outlined in the De Opificio Mundi, traditionally referred to as days. The thesis highlights the originality of Philoponus's project, which does not merely juxtapose Greek and Christian ideas but creates a truly unified system. The analysis shows that Aristotle's commentator proposes a continuous re-evaluation of Aristotelian principles in light of Christianity. Concepts inherited from the Hellenic tradition, such as the notion of motion, substrate, place, or the composition of celestial bodies, are adapted to fit a creationist framework. In this way, Philoponus resolves the discrepancies between these two traditions by transforming them into a coherent philosophical system. In summary, this thesis argues that Philoponus's work is not divided between a philosophical phase and a Christian phase. On the contrary, it reflects a continuity in his thought, where pagan cosmological doctrines are reinterpreted and integrated into a Christian theological framework
