The budget, having expenditure and receipts, is elaborated, carried out and controlled according to a certain number of principal which, parallel to their universal characters, present certain originality linked to the very nature of the country and its political regime. Thus, unlike most countries including france whose budget is largely fiscal, the iraq budget is largely based on oil receipts ; tax almost appeaurs as a marginal resource. The carrying out of the budget is achieved beyond a clear specialization of the agents. The rule concerning the separation of the production managers and the accountants is not acknoxledged by the texts, the 1940 law of which is the mainspring. At last, if iraq has system of both internal and external control (in the traditional meaning of these concepts), the juridiction control of public accounts, on the other hand, remains unknown to the iraqi financial law

Texto completoThe PhD works concern public spending in “poor districts” in comparison with other districts. By making up districts accountings, public spending has been mesured on the case of two districts, one consist of social low classes (and named “poor district” in the paper) and one other consist of social middle classes (named “mean district”). The subject concerns a spatial description of poverty on territories : we didn't search to know if unequalities increase or reduce in time, if unequalities cause additional externalities or what is the intervention's level to reduce unequalities. The work consisted in drawing up a balance sheet, a photograph of public action on two districts. In this frame, a database has been built to measure public spending on the scale of districts. The PhD works concern public spending of education, housing, social, family, health and citie policy. The results show that public spending globally favors mean districts in comparison with poor districts. Whereas we know that to reduce a delay in education or housing comfort, public spending has to be more important for people who live in “poor districts”

The stakeholders in the junction of these two policies are always oblige to take into account the opposite logics if these two policies. Our aim is to analyze the acting of stakeholders in the junction of these two policies. This analyze involve many issues. In the origin and host countries, the bonds between these two policies question's the migration of patients living with AIDS in search of the last therapeutic projections or treatments essential to their survival. In the countries of origin particularly in Sub-Saharan Africa, the link between health and migration question's the push factors of "health tourism". The social and political contexts in those countries encourage people to leave their own countries. Some of them know their Aids status before leaving their countries but a lot of them ascertain their Aids status in host countries. What is the scope of health tourism concerning Aids in France? Who are these patients who emigrate (statute, sex, level of studies. . . ) which is the place of health in their migration project? In the host countries the arrival of foreign patients living with Aids in efficient health. Systems but nevertheless in crisis, also question's the Universalist aiming of the health system particularly in France. These issues and the debates which they cause are often put, at the political agenda by politicians, in terms of costs of their health care and the increase of the number of new recipients in medical benefits. On the level of the implementation of the policy against Aids, the issue of migrants living with Aids also question's the working and logics of the health services witch are not adapted to these immigrant populations in terms of cultural and social issues? Which are the problems raised by health care of migrants living with Aids in the France? Which are the strategies and programs implemented to improve health care among migrants living with AIDS? The inscription on the political agenda of the issue of migrants living with AIDS and in precarious situation, requires an important social and medical treatment? How this specific care is organized in hospitals? How the social professionals are integrated in care for migrants living with AIDS? Which are the resources mobilized for this socio-medical care? The care of migrants asks also the question of cultural dimensions of health care among these populations. Some organizations recruit cultural mediators to improve the health care of migrants. How those professionals are integrated in health services? Which are their roles? ln this context of development of immigration policy control, the health and AIDS sector seems to escape from the restrictions of foreigners rights

Texto completoThe design and implementation of a recent tool for managing accounting at the Bank of France have included many adaptations depending on the restructuring of the organization that were deemed necessary. Like other institutions, it is an obligation to account for the emergence of such LOLF, the European Central Bank and the transformation of organizations that are increasingly oriented towards a culture of results, productivity, and therefore performance, these three concepts are seen through the prism of cost control. The use of semi-structured interviews with a population of 36 agents proved appropriate and possible to consider a content analysis designed to measure levels of ownership, if we consider a "good" Ownership is a guarantee of efficiency. However, the examination of the analytical framework of activities emonstrates, firstly a process of appropriation for the least perceived differently according to the different categories of stakeholders interviewed other hand, a difficult measurement across multiple indicators in this research, which appears to interfere with optimal efficiency of the tool. These are the findings of our exploratory study. The theoretical model developed multidimensional allowed us to highlight the main variables that affect the tool life management, the process of appropriation from the existing definition of the strategy to the assessment tool and promoting the creation of permanent sensemaking. Due to the difficult determination of indicators to measure the process, improving the process demands to find solutions on managerial, strategic, communicative and technical level as the many impacts on human resources management are considered at a time when organization experiencing new profound changes

Texto completoThe historiography of the general headquarters of the gendarmerie during the Occupation is void. Its chain of command is the great absentee of an institutional history, and also missing in the university research works, even though the units and the gendarmes of the years 1939-1945 have been the subject of numerous research works. This subject is however essential to understand how a military institution such as the French gendarmerie, and the men who command it, civilians and soldiers, adapt to an unprecedented crisis situation. The higher command is primarily a central administration. This administration experienced an unprecedented growth during the years 1940-1944, particularly from June 1942 thanks to the empowerment of the gendarmerie. It is supplemented by an inspection for the occupied zone, gradually extended, from 1942, to the southern zone. In charge of developing and implementing the operational strategy, senior gendarmerie officials were confronted with the French State's policy of collaboration and the demands of the occupier, particularly in terms of repression and economic policing. They must deal with these constraints to guide the action of the gendarmes, while preserving their anchorage in the territories. While running the human resources, the higher command of the gendarmerie must also solve the difficult equation of adapting its human resources policy to the contingencies of the moment, and the need to maintain the identity of the gendarmerie. To achieve this purpose, it develops constant hierarchical control, with particular attention to the officer corps, and to the selection and training of new recruits

Texto completoThe public management reforms that have been under way over the past thirty years are based on the widely held belief that the welfare state is at least partially lacking in efficiency, both in its so-called bureaucratic organization and in its actions, which are considered to be unsuited to the user’s needs. Regularly disputed in its objectives, its methods but also in its results, the Civil Service is since subjected to a “crisis of legitimacy” which makes necessary an overall modernization of its organization and its way of operating. The recent introduction of PRP (Performance-Related Pay) in the public service hospital reflects the wish to reform human resources management practices carried out until now. The aim of this thesis is to question the foundation of this individualization of remunerations which are based, on a theoretical point of view, on the principles of the New Public Management. Our approach aims to show that work design is at least as important, and perhaps more, than the introduction of PRP as a mean to manage motivation and satisfaction of hospital doctors. Beyond, we show that PRP could contradict the intrinsic determinants of motivation and job satisfaction of the hospital doctors, which are, in reality, widely affected by the characteristic of their job. We propose a research model that we then validate on a sample of 2 502 hospital doctors

Texto completoWhile research in the field of education sociology has hitherto mainly focussed on the vast topic of the teaching profession and its members, this thesis explores the less well-trodden but equally central question of national recruitment procedures. My chosen starting point is an analysis of national competitive examinations for the recruitment of state secondary school teachers in the light of a case study based on social and economic science teachers. This case study is centred on all the national competitive examinations, internal and external, statutory and non-statutory, organised by the French Ministry of Education since their creation or bearing on a significant period of thirty years. I intend to open up the ‘black box’ relative to these modes of recruitment, carry out a complete statistical analysis on the ground, meet members of the various examining boards and candidates, and gather their testimonies. The research for this thesis, which required the compilation of a substantial data base, is notable for being the first of its kind, as it was not carried out by an administrative service. In a second phase, I attempt to examine the profound changes which have marked my profession as administrative director of national competitive examinations in terms of both technical processes and strategy. The period covered extends back to 1992, when I took office. Challenging our established practices, a process due in great part to the constraints created by the Organic Law governing Finance Acts (LOLF) and the development of new technologies, makes it possible to measure what has been achieved over the past, to anticipate new working methods whereby the expectations of our interlocutors may better be satisfied and to guarantee the regularity and security of competitive examination management operations. This second part leads me to envisage a number of sociological perspectives specific to professional relationships at work, in education and within organizations. The interactionist paradigms will be foregrounded here

Through this legal device, France has begun a process of modernization of its public finances dedicating a new conception of the State’s budgetary and accounting management inspired by techniques of the private enterprise. Decree n ° 2012-1246 of 7th November, 2012 on the public budget and accounting management confirmed the accounting reform which is part of the global approach of public finances of French State. From now on, the new conception of budgetary management leans on a budgeting centered on the performance, dedicating a transition from logic of means to logic of results in the public spending. In parallel to that, Parliament sees itself confided an important place and role. Texto completoA new approach to the vision of human resources in the public service of State tends to develop over the past fifteen years. The GPEEC has appeared with the stated desire to reform the traditional approach of public management. Since 2006, LOLF new financial constitution also appeared to be a lever GPEEC. How these two strategies they impacting the HR administrations? The strategic vision developed to support this new deal is it compatible, realistic, applicable in the French government. How the combined weight of the LOLF GPEEC and is it perceived operatively? The status of the public can live with this development? On this issue, a working basis was chosen for the analysis of an administration and immersed in the GPEEC LOLF: French Customs. Approached from three angles, missions, recruitment and training, mobility, it will consider how this administration or suffered accompanies these developments? What are the pitfalls, opportunities, achievements and up to how blocking can we go? Evolving missions require a streamlined and sustainable approach to understand the first part of the GPEEC: The appearance of estimates of numbers and skills. The recruitment and training must be re-engineering to integrate the second part of the GPEEC: appearance matching skills to needs. Mobility implies a revaluation to match the third installment of the adaptation GPEEC ie geographical and functional needs of the administration. Given this approach, the articles of the civil service and the concept of career but also the organizational and weight of the multi-mission does not favor it seems a good practice GPEEC. The impact of LOLF dimension in performance and efficiency may become an obstacle to GPEEC when they should be the engines of the new vision of public management. Texto completoThe modernization of the public sector requires an HRM accompaniment, for the evaluation competencies of the supervisory staff. This approach relies on the necessity of having an adapted management tool, requiring NICT, and allowing the aggregation of qualitative data. To achieve our objectives, we used an innovative, internal, interference engine based on artificial intelligence, namely the “fuzzy logic”. It would seem, at the conclusion of the realization of our Computer-Aided Evaluation tool, that it must possess particular qualities allowing it to carry out the most objective and fairest evaluation as possible. Its use in real conditions indicates that it must, to be accepted and an appropriation, at once by the managers and the estimated staffs, be credible and effective. The realized tests allow us to assert that the essential perception of its role, its utility, and its facility of use, are a necessity which will be the corollary of ensuring its continual existence

Texto completoThe Military Administrator belongs to structures based on military administration principles, which are established since 1882 on the fundamental difference between commanding and administering. As a consequence of these concepts, the authorities in charge of providing the armed forces with equipments and other support services are responsible of implementing financial functions. These authorities are named Military Administrator. They play a major role in handling financial resources allowed to the Ministry of Defence by annual Budget Act. Their functions are carried out in accordance with French public accounting rules based on the separation between authorizing officers and public accountants. Military Administrator deals with diverse military structures, such as regiments, naval and air bases, to deploy financial procedures adapted to the traits of military operational activity. Since the entry into force of the Constitutional Bylaw on Budget Acts (LOLF - 1 August 2001), these financial procedures have become more and more similar to those of budgetary and accounting rules used by others State administrations. Texto completoThe administration of the King's Buildings in the 18th century is an institution in the service of the King under administrative supervision of Maison du Roi. It administers the building, the maintenance and upkeep of the King's residences and properties such as the Château de Versailles, Fontainebleau, Saint-Germain, Marly, and Compiègne. In this respect, some academies like those of architecture, painting and sculpture, depend on it. One can also quote as examples the Manufacture des Gobelins and de la Savonnerie. The administration also includes the Departments of the Machine de Marly, of the drains in Trappes and in Saclay, those of the marbles and the plants nurseries. The evolution from the Superintendency to the Direction under the Duc d'Antin (1708-1726) has consequences on the power of the Director mainly, who loses his financial prerogatives in relation to the superintendent. Even if the bureaucratic organisation is strengthened and rationalised indeed, the modifications are mostly due to the budget problems met by the monarchy that urged for savings and impeded the initial missions of the administration. This thesis studies the way a central administration works in the age of the Enlightenment, focusing on the administrative, economic, politic and social areas. Through a study of the accountancy, it puts forth the functioning and organisation of an administration that is becoming a bureaucracy as well as a political tool, particularly for the Directors who work for the King. The dissertation also sets forth a study of the personnel and their daily tasks, having to deal with administrative procedures, the influence of the Court and financial difficulties

Texto completoThis research consists in a comparison between the legal instruments of human resource management in the French and Italian public service sector. The objective is to evaluate their efficacy and uncover the main problems linked to their implementation. In the Italian public service sector, the manager is assimilated to the employer found in private firms. The link between the public servant and the administration is first regulated by a specific law, then by collective bargaining and labour law. In the French system, labour law isn’t applied to the public service sector. However, labour law has an influence on it, and vice versa. Collective bargaining doesn't have any formal rule because the civil servant must accept conditions imposed by the administration. Despite appearances, throughout their evolution the two systems seem to increasingly resemble each other, particularly in the realm of human resource management legal instruments, the use of temporary jobs and the rule of collective bargaining. It seems that flexibility in human resource management isn’t necessarily associated to the nature – public, private or mixed - of the link between the public servant and the administration. The choice between unilateralism and negotiation, administrative law and labour law doesn’t matter so much. Though French statute law is flexible, there are some political and administrative customs which are damaging. In both Italy and France, public administrations do not need to ignore - respectively - privatisation and statute law in order to become more effective. It seems that public administrations do not use all the possibilities offered by existing laws. They have to invest in human resources in order to transform office directors into real managers, rather than to continuously work on useless or damaging radical reforms

Two items of legislation provide for the director’s liability according to whether the matter is being heard before the civil courts (Article L. 267 of the LPF tax code) or the criminal courts (Article 1745 of the CGI tax code).Although those two provisions are independent from one another since they have neither the same legal basis, nor the same purpose and the person bringing the action is different, it is appropriate to question their respective scope, underline their pitfalls and present avenues for reform of the corporate manager’s joint liability for tax liabilities.The aim is both to make the revenue authority’s action for recovery more effective and to secure the corporate manager’s rights. The current situation requires pragmatism, for recovering tax liabilities resulting primarily from VAT and for suspending joint liability for intentionally causing tax liabilities from the time of the procedure of the determination of the tax base

Texto completoFocusing on the crossroads of the socioloogy of the State, the sociology of work and professions, and the sociology of science and statistics, this thesis aims at clarifying the making of State "numbers" through the Statistics Department and the Ministry of Labour and Employment between 1945 and 2008. Using an ethnographic approach combining direct observation in the Department, interviews, consultation of archives and a survey by questionnaire, we show that official statisticians lead their action in a specifically codified, institutionalized and constrained field. By analyzing the characteristics of state-employed statisticians (INSEE civil servants and contractual employees trained in scientific research), official statistics institutions and the making of numbers (statistic surveys, registers, indicators, publications, controversies), we uncover the transformation of scientific and statistical tools used by State administrations. We thereby highlight policy changes that concern employment and work and the forms of appropriation of State reforms in the years 1990¬-2000. This way, we show to what extent statisticians have invested in new institutional roles and reinforced their position in the Ministry of Labour and Employment. These statisticians contribute to the definition and functioning of public action, responding to both administrative and political logics. However, according to their habitus and positions in the institution, these agents must negotiate and maintain relative autonomy in their work. This is all the more necessary as it is essential to their scientific legitimacy as well as the specificity of statistic activity

Texto completoThe perpetual evolution of public accounts in France, particularly with the integration of accounting rules inspired by private law, could hardly be an isolated act. On the contrary, it is part of a universal approach driven by a common desire to make the financial statements of states and nations a real means of helping decision-making. State accounting standards, which are inspired by the private model, have become part of the French accounting landscape and are gaining more and more place by pushing back an accounting model that has not undergone major changes since its establishment. Public financial law is thus enriched in accounting matters by new provisions since the advent of the LOLF in 2001. From now on, it is expressly stipulated that the accounts of the state must be regular, sincere and give a faithful image of its heritage and its financial situation. A provision enshrined in the constitutional review of July 23, 2008. Therefore, this is not without consequences on the law and budgetary practices in their broadest sense

Texto completoFrench archives are ruled by several laws and decrees. First of them go back to French Revolution : it is the law of Messidor 7, year II, by which the idea of free access to archives for citizens is brought out. This idea is nevertheless still quite far from the French Freedom of Information act taken in 1978, in the general context of « laws of 3d-generation rights of men ». The Messidor law is amended during the 19th century to take into account the necessary protection of the interests of State and families. It is repealed by the law n°79-18 of January 3d, 1979 ; this law establishes for the first time the principle of terms for accessing to archives. It is in turn repealed by the law n°2008-696 of July 15th, 2008, which comes after decade-long controversy about access to Second World War archives in particular: even if the mere existence of secret is well accepted, the terms themselves under which these secrets should be held expired are a public issue.Despite a well-shared idea, restrictions on archives'accessibility keep getting stronger. Specific access regimes such as classified informations or medical secrecy gradually become conflicting with the general right of access to archives.The 2008 law arouses many practical interrogations among archivists, confronted with a modification of the communicability terms as well as a deep change in method, these terms being now determined by the degree of sensibility of the information rather than by the nature of the document itself

Texto completoStemmed from a democratic will of emancipation of the citizen and of working out of a new society, the public Theater, in France as well as in Italy, seems again to be a prey to a triple crisis (political, structural and artistic), since the turning point of 2000. This allows to question the political and symbolic connections which are at stake between art and society within institutional limits led by a public service mission. Through the examples of the “Théâtre National de Strasbourg” (TNS), Villeurbanne’s “Théâtre National Populaire” (TNP) and Milano’s “Piccolo Teatro”, the point is to consider the public Theater with the whole of its participants and constituents (esthetic, political, economic, symbolic, architectural and social) via the prism of their respective managers’ process and strategies of justification, in order to determine and explain the evolution of the institutions and the transformation of the duties they assume and implement. By distinguishing between the various strategies elaborated by the managers, we can give shape to the positions, held by the artists and the authorities towards the neo-liberal society and the institutional issues. These positions are linked and answer a contamination of the cultural sphere by the economic sphere. They reveal a division, increased by the role given to the audience, between the institutions, which try to compensate this contamination by ways of interactions and experimentations with the society, and those, which deplore this situation and answer it by standing aloof from reality and focusing on their conception of dramatic art

Texto completoCommissioners of the Navy had been, until 2010, the officers in charge for logistical support and financial services in the French Navy. These areas of responsibility are merely a remainder of their former competences, which they had been exercising until the eve of the First World War. As a matter of fact, commissioners of the Navy were not only in charge for administrative services of the French Navy, but also for all maritime affairs, such as maritime navigation, marine fisheries, the professional status of sailors, and the colonies. They intervened within the field of competence of the Ministry for the Navy and the colonies. This situation is a legacy of the Monarchy and demonstrates the influence of Colbert’s doctrine with regard to the administration of maritime affairs. When he became Secretary of State for the Navy, he did not set up a ministry only concerned by naval warfare, but an administration in charge of the development of French maritime activity. For this purpose, he relied on commissioners of the Navy. This situation ceased only in the 19th century with the emergence of steamships
