Texto completoThe objective of the research is to define an organization ensuring the semantic operability inside an e-government platform. The solution involves several actors from different domains : ontology expert, domain expert, users, and managers). The objective is achieved thanks to a multilingual ontology supplying semantic data required by each module of the platform. Two issues had to be overcome : the building of an ontology representing the complex processes of the public administration and the multilingual aspect of each concept definition. The building of the ontology followed a general methodology enhanced by the support to platform and users. We defined a specific formalism for representing knowledge in the system, taking into account the issue of class and property instantiation in a knowledge base. We proposed an original solution based on rules. We applied the formalism to the dynamic categorization of elements in a knowledge based and we developed specific tools in order to check the robustness of the formalism

Texto completoAffirmative action programs in the field of public procurement Systems are one of the clearest forms of quota Systems, one of the highest federal spending and one of the most common causes of legal disputes about the validity preferential treatment. However, until 1989, this form of affirmative action had been of little interest to researchers. These programs were originally created by the Nixon administration to address the consequences of decades of discriminatory practices in employment, especially in the construction sector where such practices were particularly widespread and documented. These programs were later extended to the field of public procurement by introducing for the first time in 1977, under the plan of Philadelphia, a quota System in favor of businesses run by minorities. In this study, will respond to four basic questions: What was the impact of federal initiatives on the mode of development of black businesses? Did Affirmative Action programs in the field of public procurement result in parity between minority and non minority in public contracting? What were the consequences of the new legislation imposed by the Supreme Court on the mode of public contracting and the black businesses? Finally, Is Affirmative Action still necessary?

They communicate extra financial data, since they are under more and more legal and regulatory pressure, on the one hand and more frequent "moral" pressure from their direct or indirect partners (stakeholders), on the other. Company directors are therefore forced to implement optimal corporate governance taking into account the interests of all stakeholders- They also provide information about the form of governance they implement. Companies feel obliged to display a responsible attitude and they communicate in the name of corporate ethics via different extra financial documents. All these instruments together form a corporate ethics statement. They take on various forms: reports, charters, codes, memberships to responsible business combinations, etc This "answer to pressure" may be interpreted as a company's attempt to auto regulate its commitment to social responsibility. By putting forward a certain number of "standards", companies provide solutions to the pressure exerted on them, However, by producing such documents, they act as a substitute to a certain extent for the legislator and they demand a status more in keeping with the responsibilities required of them. The corporate ethics statement is therefore a form of social regulation along the same lines as the minimum legal framework

Nevertheless, the identification of the attributes of sovereignty under the material meaning is never justified. The purpose of this thesis is to study the relationships between these different meanings of the concept of sovereignty, focusing on one of the attributes of sovereignty : the right to coin money. To better isolate it, this work focuses on currency unions using a historical and comparative method. At the end of this study, it appears that the three uses of the concept of sovereignty can only be linked to each other from a teleological point of view. This reveals the justificatory character of the concept of sovereignty, which is therefore not purely descriptive

It is characterized by socialization, predominance of informal practice and non market factors. It constitutes a recation of the firm towards its evolutive and turbulent institutional environment. In Ukraine, the relations between the firm and the authorities are based on clientelism through an exchange of resources. The firm deploys their political resources represented by votes of their employees in favor of political parties. It obtains form policymakers a favorable regulation through a rent provided via subventions.This thesis seeks to prove the existence of the relation between corporate political and economic resources. The firm invests available resources to obtain benefits. Political activity can be seen as profitable. Rent-seeking constitutes modus operandi of the clanic governance that allows to the firm to operate efficiently in a specific business environment. This mode of governance is also characterized by informal practices. The exchange of resources with policy-makers is made through informal networks whose configuration defines the perimeter of clanic structures

Texto completoThe ideas proposed in this thesis emerge from a dialogue threading theater studies, cultural history and research on the imagination. The main question addressed is the relationship between theater and the period of the political transition from dictatorship to democracy in Chile.During the first elected government post-dictatorship (1990-1994) Chilean theater experienced an unprecedented creative renewal. Numerous plays were presented in all kinds of locations, not just in theaters. It gained great social importance and enjoyed broad public support as well as mass press coverage, becoming a key element in the articulation of Chilean society.However, the themes explored had nothing to do with the political transition. There was a wide gap between what the theater was talking about and the importance of the political and social processes in development at the time. In fact it was the political process itself that seemed articulated dramatically. President Alywin and Pinochet were the protagonists of a drama that put Chilean society as a whole in danger. Every action taken by President Alywin entailed a reaction by Pinochet that threatened the process of transition.By nature a dramatic conflict needs to be resolved, however, during the '90s in Chile all the secondary characters - Ministers, Members of Parliament and Advisors – centered their mission on ensuring that the it did not explode. Due to the lack of a resolution, the narrative of the transition could not be formulated.An in-depth analysis of four iconic performances during this period through dramaturgical research sources, the reconstruction of the creative process and a detailed description of the shows similar to what Geertz called "thick description, elucidates how Chilean theater embedded itself in the present during the process of constructing a scenic presence, which also served as an affirmation of its right to be.The Chilean theater of the transition period invented collaborative forms of creation, built spectacular stories and, unexpectedly, reinvented the art of staging. The revival of Chilean theater in the 90s is thus explained by its relationship with the political transition

Texto completoThe dissertation focuses on the filmic representations of the War of Liberation(1964-1974) and of the revolution (1975-1987) in Mozambique, and aims to analyse the aesthetic and political issues of Mozambican revolutionary cinema. To understand this question,the various logics that guided the positions of anti-colonial theory with regard to culture are examined in the first instance, while the State cinema policy and its contradictions are reassessed in the second instance. The filmic representations of these two historical processes were an essential instrument for the construction of national identity, within an epistemic historiographical apparatus. By reconstructing the principles of a culture of transnational liberation, the dissertation intends to consider the political, ideological, and technological conditions which led to the foundation of Mozambique’s National Institute of Cinema (INC) inMarch of 1976, and the orientation that the Mozambique Liberation Front (FRELIMO) attempted to ascribe to cinema.The identification of three phases of Mozambican revolutionary cinema will highlight the discrepancy between the coexistence of a project for the collectivisation of film production,formal experimentation and the premises of the State programme. The notion of ‘form-event’will allow us to reconcile two dimensions of the aesthetic production: one, which considers art as a reflection; another, which considers it in terms of its outcomes. Through the formal aestheticand historical analysis of a set of singular films produced between 1966 and 1987, we will seekto problematize the positions adopted by the filmmakers, the points of resistance, as well as the succession of contradictory forms of relation between collective, auteur and State cinema. Anarchaeological and critical knowledge of the Mozambican political and cultural programme will emerge from the comprehensive analysis of Ruy Guerra’s Mueda, Memória e Massacre(1979-1980).The dissertation purports to replace Mozambican revolutionary cinema in its historicaland cultural context by drawing a cartography of the Cinema of Liberation in relation to the political situation of the 1960s and 1970s. The concept of ‘Cinema of Liberation’ is sited in a historical, geographical and categorial framework with respect to the history of political, avantgarde,and experimental cinema, and to the history of cinema in general. Still little known by historians the Junta brought change into the way of governing and of understanding politics in Spain at the transition from the XVIth to the XVIIth century. Being inserted between the several stages of consultation and the royal decision, and by placing the action of its members at the heart of the daily management of cases, its influence deeply modified the way in which the traditional conciliar structure tried to respond to the uncertain stream of politics.The daily confrontation of the members of the Junta with the most diverse cases also gives the historian an overview of the government of the Monarchy. The multiple negotiation processes, the management of wide projects and the several reactions to contingencies reveal a political action more dependent on tensions and balances of power between the actors than on a firm will of the monarch. The Junta thus constitutes a valuable observatory of the construction of political choice at the end of the reign of Philip II. Aiming at emancipating itself from both the studies on governing institutions and the prosopographical approach, this work explores new paths of interpretation focused on the practices of government. Texto completoSince the beginning of the 1980s, the Algerian economy has undergone a vast programme of restructuring and reform. Curiously, after three decades of implementing measures designed to bring the economy in line with the rules of competition and profitability, the reality of Algerian economic performance has changed very little. In fact, apart from the recovery of the macrofinancial balance, due to rising international oil prices, the Algerian economy is far from the dynamics of capital accumulation. Clearly, neither internal constraints nor the conditions or recommendations of the IMF have been able to fight against the current of ‘Algerian reality’. In this thesis, I aim to define the conditions for a successful transition to a market economy based on the Algerian experience of reform. I will also consider obstacles to reform in periods of transition. My starting point for reflection on the question of transition will be an analysis of the political system, its constraints and contradictions. My purpose is also to examine the importance of Algeria’s past in terms of its determining influence on the transition from one economic system to another

Texto completoWhether they highlight a historical figure or a fictional character, the Memoirs of Courtilz de Sandras, published between 1687 and 1758, mark the emergence of a type of fiction based upon the pretence of memorialist writing. These novelistic works assume the form of memoirs whose fictitious authors are individuals from the reign of Louis XIII or well-known contemporaries of Courtilz. Far from misleading the readers, the fictional origin of these narratives, which justifies their being called apocryphal, did not prevent the literary critics of the seventeenth and eighteenth centuries from detecting behind the purported authors an anonymous novelist. Between illusion and truth, these so-called memoirs written in the first person, mixing biographical veracity, historical accuracy and fictional invention, urge to redefine the notions of authenticity and fiction, in the light of the tacit pact between the writer and the reader, united in a common awareness of pretence. Studying the complex relationship that these novels share with authentic memoirs and history permits to situate them in the evolution of the works of fiction in the French classical age. The fiction of memorialist writing allows the mixing of the voices, which reveals the plurality of the discourses used by Courtilz: to the voice of the fictitious memorialist, the voice of the novelist is superimposed if not opposed. Through the narrative, the novelist implicitly expresses a satirical speech about the world, irrelevant with the one of the characters. A real instrument of controversy, the interweaving of the two discourses partakes of a pessimistic fictional world which emphasizes the existential failure of the heroes

Texto completoPrivatization is a complex phenomenon, much debated since the middle of 1970's. This persistent controversy in economics and more recently in management is mainly due to the empirical ambiguity about the fundamental relationship between nature (state-owned or private) of ownership and performance. A critical survey of the traditional analysis on state-owned and private ownership characteristics concludes to a necessary renewal of the approach. From a stakeholder perspective of organizational dynamics, we question the link between privatization and performance. How does privatization influence organizational architecture, at both levels of decision-making process and corporate governance system ? What is the impact of this dynamic on the appropriable value by different stakeholders ? We use the positive agency theory framework and the specific corporate governance literature, based on a stakeholder approach, to construct our organizational model of privatization. The question of organizational processes implied by privatization suggests an empirical investigation based on qualitative aspects of the phenomenon. We have tested our model on two case studies, Air France privatization (French airlines transport firm, the 4th worldwide firm on this sector) and DSM privatization (Dutch firm from fine chemicals). These case studies show that privatization is a progressive organizational process. In both cases, positive implications on the decision-making process of value creation and allocation illustrate the explanatory power of corporate governance theory in a stakeholder perspective. Whatever the state-owned, private, national or European governance system analysed, a stakeholder corporate governance theory represents a powerful framework to understand how firms evolve. This emergent theory could participate to many research programs such as organization, efficiency levels and institutions

The revival of Islam is not only a sign of piety or devotion. Also, the revival of Islam shows that Uzbek society wants to discover his own culture. The connections between the Uzbek and Islam are not only devoted connections. The Uzbek consider Islam beyond the limits of the dogma. Thus, Islam becomes secular in the Uzbek society. However, rural masses keep a deep piety, and islamic clergy stays traditionalist. Regarding ethic, the Uzbek consider society must be in harmony with the moral values of Islam. Regarding religion, they stay traditionalist. In Uzbekistan, Islam doesn't affects by the spirit of religious reform and moral progress. However, regarding politic, the Uzbek consider that religion and State power must be disconnected. The Uzbek reject islamic republic and islamic law. In addition, in Central Asia, the context of political burden, socio-economic depression, spiritual and cultural search (dictatorship, taliban, fundamentalism, Uzbek islamic opposition, IMU, strategic ambitions of Pakistan where madrasa support the diffusion of fundamentalism), and economic and cultural globalisation (liberalism, moderate and secular Turkish Islam, Saudi orthodoxy and fundamentalism) generate change of Islam in area. Texto completoThey say our time is the age of the victim. The importance of his/her role in establishing the criminal facts, his/her testimony against mass crimes, his/her intolerable suffering, seem to underpin the path of rebuilding a new humanity united around the rejection of unjust pain. The figure of the victim, which originated in the judicial sphere during the development of insurance law, is nowadays more than just the subject of reparation for harm. This overflowing of the judicial scene seems to be the effect of an "anthropological reversal" consisting in the rejection of the pain of the sacrifice of "one" in the name of "all" and the assumption of suffering as a pre-eminent political object. Crimes against humanity, as well as domestic aggression, war crimes and street violence are rejected. Through the recognition of the victim, we have become more empathetic towards others through their suffering. This is the anchor for a new humanity based on the rejection of the unjust. The victim appears as a figure that goes beyond the purely legal framework when he or she comes to occupy a specific place in the spaces of politics, as the bearer of a message from the past for the present and for the future. In this sense, it engages a form of governing: it introduces the problem of "fragility" and suffering as ways of reconstructing a humanity already too torn apart by its differences. In this sense, it does not represent any overthrow: it is the development of a mode of power that has its privileged objects in life. Our work tries to show, first of all, that the victim, more than an individual recognized as such, is a way of taking charge of life, as a political object, from its productive aspect (making a life a liveable one) but also from its unproductive aspect: to stop, fix, block the possibility that in the results of violence new forces can be deployed. We wanted to return to the point where the powers of state, war and the economic totalisation of life take up the question of victims to make them a factor of accumulation. Basically, it is a question of highlighting the point where the "recognition of victims", by conjuring up the subjective effects of violence, borders on the processes of ascent towards the destruction of politics itself. Our contribution seeks to highlight the fact that fragility is not on the side of the victims, but on the side of voluntarist theoretical positions towards them, as well as on the side of the false path of consensualism. Our privileged example is the Colombian conflict. The specificity of this "place" of problematization allows us to link the most expressive aspects, present in this political novelty that is the victim. Texto completoThe purpose of this thesis is to analyse how the relationships and mutual interactions between political and managerial government operate. Taking France and Renault since the end of the 19th century as the field for study, the thesis identifies two successive shifts which reflect, on the one hand, changes in the practices of those who govern or manage companies and, on the other hand, changes in those being governed/managed and who are the subject of said practices. In the political field of relationships between those in power and those being governed, the developments noted are the result, in the 1930s, of the crisis in liberalism. This crisis in the liberal form of government led initially, in the period after the First World War, to government planning practices based on a calculable person and then, from the middle of the 1980s, to neo-liberal practices in terms of government based on the self-manager person. At Renault, changes in senior management practices contribute to the emergence of successive types of person in the workplace. The transformations that take place are based on management practices and, in particular, on management control apparatus which aim to modify day-to-day management practices and the subjectivation methods in use. These transformations are developed and implemented by the State's managers, described as parresiastic in so far as they put into practice a social strategy that is the result of their hermeneutical reflection centred on an analysis of the situation in the light of enlightened changes to contemporary society and the latter’s ability to become more mature

Texto completoIn the archives of the royal justice system of the 14th and 15th centuries, madness was distinguished by two distinct judicial attributes: full incapacity in civil proceedings and the exception from penal responsibility in judicial matters. Dementia (furor) was summarily defined as an illness, stemming from the laws of nature, which deprived the subject of his ability to express any valid intent. Within this legal framework, whether or not conduct was deemed mad depended in large part on the specific circumstances of each law suit. The insanity plea could be used, for example, to acquit a crime, to nullify a contract or a testament as well as to prevent a relative from squandering the possessions of the family line by either having him barred and/or placed under guardianship. Those who were regarded as insane found themselves placed, primarily, under the authority of their relatives who thus deprived them of the ordinary privileges associated to adulthood and, should they prove dangerous, kept them at home. If customary law was generally used to arbitrate these situations, more and more appeals to the royal courts and to the opinions of legal scholars were made during this period. Even if the king did not pass judgment on such family matters, he did deputize certain mid-level actors, such as the burghers, to take these vulnerable subjects in their custody. In turn, these lawmen remained particularly attentive to appeal systematically to his sovereign authority

Texto completoSince the beginning of the 1990's, the intercommunity nature of projects has developed constantly in France ; in particular this is illustrated by the spectacular increase in the number of municipality communities ("communautés de communes"). The emergence of these more integrated cooperation practises is witness to the transformation of the French state model. Although local authorities proposed to plan a political project for a perimeter, they were obliged to submit to rules which varied over time, and of which the State has caused the corpus to evolve. This encounter between ascendant and descendant geographical arguments has resulted in the validation of cooperation perimeters which may progress and which are based on permanent comprises between State representatives and local proponents. Therefore, the issue is to query the creation of these perimeters, to understand the resulting territorial justifications and the terms of the course of cooperation processes from a geo-political point of view, at both national and regional level (Haute-Normandie). It is advisable to support such organisations to further develop participative and transverse governance thanks to inter-group cooperation. The case study of interfaces among the different working groups of a Consultancy company highlights the major dimensions, obstacles and/or vectors of change for the governance mode. This company is striving to implement a new matrix and organisational structure. The transverse management requires changes in the work organisational modes that challenge the type of autonomy at work, social regulations, “subsidiarity”, trust as well as group micro-culture. Changes require a learning process related to new interactions that goes naturally along with a revision of authority stratums and modes of social regulations of the organisation

Texto completoEvery year in France, about 700 administrative officers (French attachés) get hired thanks to a competition. They are neither street level bureaucrats nor top civil servants, but these civil servants constitute most of the intermediate administrative staff of public services. Yet, they remain mostly invisible to citizens and little known to social scientists. Since 1970, Regional Administration Institutes (IRA) have been designed to merge and homogenize the recruitment, training, and practices of these public agents. The study of those educational institutions sheds light on the process through which the State assigns these middle managers a specific mandate.Combining sociological approaches of public administration and of socialization, three perspectives related to the middle managers’ training are being developed. First, a socio-historical analysis of the reforms of the IRA sheds light on hardships encountered by the administration in establishing an inter-ministerial “corps”. This approach allows us to understand compromises between ministries that allow the stabilization of the training’s organization. Then, within the IRA institution, the study of prescribed and taught knowledge enlightens the different activities entrusted to middle managers during their training. These skills shape various figures of the public services' middle managers. Finally, an ethnographic approach of processes of socialization within the IRA institution shows that the mandate of the attaché also stems from various modes of appropriation and discrepancies from institutional expectations.These three sites of investigation constitute an interesting vantage point of two type of deep-seated tensions among middle management. First, the tension between the unification of the group and its scattering. Then, that between the attachés’ autonomy and their participation in the “dirty work” chain of delegation. Both manager and managed, both technician and non-specialist, both legal expert and team leader, the mandate of these middle managers fluctuates depending on what the State wants to achieve with its administration

Texto completoAntisemitism may be polymorphous. It is present in many spheres of society, whether po-litical, economic, or civil. However, beyond its clear and unambiguous manifestations in writings, violence or crimes, it can also be implied and unconfessed. England, despite its image of democracy, its openness towards its minorities, its religious freedom, is not exempt from this phenomenon deeply rooted at the heart of its political world. Antisemitism can be hidden behind what, at first glance, appears as philosemitic or, at least, not Judeo-phobic. Nevertheless, it may actually reveal itself. Whether it be anti-capitalist, Judeo-Bolshevik, exclusionist or racial, it is the intrinsic peculiarity of this liberal society unwilling to admit its antisemitism that has produced this new kind of Judeo-phobia. It is this antisemitism, hidden and understated in statements that could seem neutral at first glance, that we have studied and theorized as "apophasic discourse" in this thesis. The antisemitism of the establishment, in the newspapers and in the world of the exclusionist movements of the early 20th century will be used as a political weapon. Ashkenazi immigrants from Eastern Europe arriving “en masse” on the English shores would be the target of open, sometimes hidden, anti-Semitism. It is this second category that we will reveal

Texto completoIn recent years, several states have introduced new corporate forms into their commercial law, which requires the commitment of shareholders towards a “mission”. By stipulating their purposes in their documents, these companies appear as a paradox for literature on corporate governance: would such a commitment not hamper strategic flexibility and undermine the monitoring of management? Is it not likely to deter shareholders' investments? The aim of this thesis is to explain the emergence of "mission-driven companies", to understand their motivations, but also to characterize the alternative model of governance they draw and the significance of this model in management science.First, the analysis of the process of emergence and design of these mission-driven forms in the United States enables us to enrich the classical model of the corporate contract, by showing that such a contract can have restrictive effects on the collective purposes if it only contains a commitment on invested resources, or provisions on the distribution of decision rights or value created to stakeholders.The thesis proposes, in a second step, a model of the "mission": by specifying desirable, yet potentially inventive, properties of the upcoming collective action, the mission calls for the design of novel strategies aiming at building new commons and collective interests. This model reveals, beyond the new legal forms, a wider class of “mission-driven” organizations, of which we can observe numerous variations both historically and currently.Finally, the thesis examines the systems of governance of mission-driven companies. A study of contrasting cases shows original devices combining control of the strategic exploration and solidarity mechanisms. The mission thus opens fruitful perspectives to explore new possible systems of solidarity

Texto completo1. L’approche générale et des étapes de la recherche
En s’intéressant des réformes de l’État roumain postcommuniste nous, en voulant étudier pourquoi, comment et par qui sont entamées les réformes de l’État dans un pays d’Europe Centrale et Orientale, notre question de recherche a été ciblé seulement après notre exploration des théories de l’État et des données analysées.
Ainsi, dans une première étape de la recherche, dans le chapitre 1, nous avons exploré les théories de l’État le plus importantes dans la science politique : les définitions de l’État donnée par les courants de recherche importants dans l’étude de l’État depuis les années ’80 et les théories dominantes sur le changement au niveau de l’État. La définition de l’État que nous apportons montre un choix ontologique qui est celui d’un « constructivisme modéré » selon l’expression de Pierre Muller. Nous suivons la critique des études sur l'État des années ’80-’90, déterminé par les défis de la définition wébérienne de l'État, utilisée par ces études et la sphère très (ou trop) large du concept et les superpositions avec d’autres concepts de la science politique. Toutefois, nous estimons, en suivant les auteurs poststructuralistes, que la notion d’« État » est tellement forte dans le discours politique que l’étude des discours sur l’État a une valeur euristique pour l’évolution des institutions, des relations politiques et des politiques publiques.1 Ainsi, pour lier les discours sur l’État à la transition de l’État, notre démarche s’encadre dans l’analyse cognitive des politiques publiques.
Dans le contexte de cette première analyse de théories de l’État, que nous présentons en détailles, dans la première partie de la thèse, nous avons problématisé notre recherche. Notre question de recherche porte sur le rôle des élites politiques dans l’émergence et le développement des transformations de l’État dans le postcommunisme roumain.
Jusqu’au présent la réponse donnée à notre question de recherche a été directement inspiré par la théorie du développement des partis et de l’État de Shefter. Cette réponse mettait en évidence la relation entre le patronage, le clientélisme, l’intérêt personnel d’enrichissement et de prestige des hommes politiques et l’incapacité des États postcommuniste. Pour des chercheurs comme Conor O’Dwyer2, Anna Grzymała-Busse3 ou Venelin Ganev4, les élites politiques ont l’occasion et la possibilité d’exploité les ressources de l’État pour eux-mêmes ou pour les partis et elles profitent de cette occasion. Mais ces auteurs n’expliquent que l’échec des réformes et ignorent le trajet sinueux des transformations et la réussite des restructurations de l’État postcommunistes pour leur succès européen dans les années 2000. C’est pourquoi, en prenant en compte notre perspective cognitive sur les politiques publiques, nous avons choisi notre hypothèse principale centrée sur les idées et les idéologies qui donnent une cohérence minimale aux politiques de transformation de l’État et peut expliquer leur succès. Notre hypothèse de recherche a été que les élites politiques postcommunistes ont joué un double rôle : la définition et la mise en œuvre des idées et des idéologies qui ont guidé les transformations de l’État roumain postcommuniste. En tenant compte que les idées des élites politiques sont exposées dans les discours dans les cadres des institutions politiques classiques les variables explicatives dans notre hypothèse sont les idéologies politiques développées dans le contexte particulier des partis politiques roumains.
Dans une deuxième étape de la recherche, dans le chapitre 2, nous avons mené une analyse des partis et élites politiques5, pour comprendre comment les personnes et les institutions qui participent à la décision politique acquissent leurs compétences, connexions et valeurs. Premièrement, nous avons considéré la question des partis politiques roumains : leur définition idéologique et leur institutionnalisation. Nous voulons comprendre comment ils peuvent devenir des agents de socialisation politique et quelles sont les compétences et les valeurs transmises aux personnes recrutées pour des dignités publiques au Parlement. Deuxièmement, nous nous penchons sur les élites politiques. En regardant dans une perspective double nous avons examiné l’influence des partis et d’autres instances de socialisation politique sur les élites et la possibilité des élites de participer à la définition des idéologies politiques.
Il faut comprendre que seule la conjuration des instances de socialisation et leurs relations avec l’environnement politique peuvent générer des discours et des actions politiques. Cependant, quelques instances et agents de socialisations s’avèrent plus influents. Premièrement, les trajectoires politiques dans les partis des élites politiques et les fonctions élues au niveau local où national ont un impact significatif sur les élites. Deuxièmement, pendant le processus d’intégration européenne, les partis roumains prennent et institutionnalisent au niveau national des normes, des croyances, des règles de conduite et des procédures spécifiques aux partis européens dans les différentes familles politiques. Alors que l’appartenance à un parti peut s’avérer pertinente pour les idées socialisées par les élites politiques. Troisièmement, la formation pendant le communisme et le début de la carrière dans la même période influence les idées des élites politiques postcommunistes.
Dans une troisième étape, suite à l’étude des théories et des définitions de l’État nous avons identifié les dimensions de l’action politique qui déterminent notre définition opératoire des réformes de l’État. Ces dimensions sont : la réforme de l’État-nation, la décentralisation, les transformations des fonctions de l’État et la consolidation de la capacité de l’État. Pour chaque dimension nous avons entame une analyse des discours parlementaires qui ont introduit les réformes étatiques. Puisque nous avons cherché à démontrer le rôle des idées des élites politiques, nous avons dû examiner ces idées et leur mise en pratique. Ainsi, nous avons analysé les discours parlementaires et leur mise en pratique dans les décisions du législatif.
Dans tous les chapitres empiriques nous avons développé, premièrement, une description des changements, des transformations du référentiel de l’État et des politiques publiques. Cette description identifie la présence des discours dominants, qui représentent le référentiel des politiques6, et des discours minoritaires. Du point de vue de la stratégie de la recherche empirique et de la structure des quatre chapitres empiriques, premièrement, nous avons fait une analyse diachronique des discours afin de souligner les transformations des représentations sur l’État et des projets de l’État dans la période postcommuniste roumaine. Ensuite nous avons mené une enquête transversale, des discours dans des moments différents. Nous avons suivi trois dimensions dans notre analyse de discours. La première dimension est la narration : le discours qui exprime le positionnement des élites politiques. La deuxième dimension est la voix de l’acteur qui parle : son appartenance à un groupe et l’identification dans son discours de sa position avec la position du groupe. La troisième dimension est une dimension critique : nous avons suivi les contextes et les déterminants qui peuvent faire un discours devenir dominant.7
Dans un second temps, nous nous sommes penchés sur les variables qui peuvent déterminer le rôle et l’action des élites : la « médiation » entre les idéologies des partis politiques et les politiques de transformation de l’État (l’hypothèse principale), la représentation des intérêts des partis, la poursuite des intérêts propres en fonction de leurs les trajectoires, la transposition des conditionnalités européennes, la représentation des recommandations de la société civile au nom du peuple/des citoyens.
À la suite de ces étapes de la recherche, l’étape finale de notre recherche peut être mise en œuvre. De l’ancrage théorique de la première étape, nous allons relier le contexte sociologique et anthropologique de la deuxième étape – qui s’intéressait de la socialisation politique des élites politiques – aux résultats empiriques de la quatrième étape et ainsi expliquer le lien qui peut être fait entre idéologies des élites politiques et les réformes qui ont transformé l’État roumain postcommuniste.
2. La présentation des résultats de la recherche empirique dans le cas roumain. Les conclusions par chapitres
La recherche de l’influence des idéologies politiques des acteurs au niveau de la prise de décision, en tant que possible variable intervenant dans l’explicitation de transformations de l’État roumain postcommuniste, ne dévoile pas un modèle unique. Dans le cas de chaque thématique débattue et analysée dans les quatre chapitres empiriques de la thèse les conclusions sont différentes. Toutefois, il y a quelques traces communes qui peuvent nous permettent de répondre à notre question de recherche.
Dans le chapitre 3, nous entamons l’analyse du rôle des idéologies politiques des élites parlementaires dans l’élaboration et l’adoption des politiques qui portent sur les relations établies entre les citoyens et la communauté des citoyens, d’un côté, et l’État de l’autre côté. La définition opératoire de ces relations nous amène à l’étude du concept d’État-nation et la notion d’État national dans la Constitution de la Roumanie. Une étude de cas porte sur le rôle des élites politiques dans la définition de la politique d’octroyer la citoyenneté roumaine et de la loi de la citoyenneté roumaine.
Pour conclure l’analyse des politiques nationales et envers les minorités, nous pouvons évaluer le nationalisme roumain promu dans le Parlement comme un nationalisme culturel, conservateur en 1991 et comme un nationalisme libéral depuis 20038. Il résulte de la dynamique des idées des élites. Ces idées sont fortement influencées par l’imaginaire national-communiste au début des années 1990, quand les roumains et les minorités nationales se trouvent en opposition. Pendant les années 2000 les idéologies des partis sont les moteurs des débats, en opposant les nationalistes aux libéraux, démocrates et socialistes, tous ayant une vision assez cosmopolite. Entre 1991 et 2003 les discours sur la Constitution changent radicalement, en suivant les idées des élites politiques et les changements des idéologies des partis. Néanmoins, l’appui électoral pour les partis ne change pas d’une manière aussi significative au cours de cette période. En outre, quoique l'attitude des élites politiques soit désormais modérée et elle est reflétée dans les politiques, elle n'a pas changé l'attitude du public.9
La prééminence des références idéologiques dans les débats, les congruences entre les familles politiques des élites et les idées qu’elles mettent en avant, après 2003, confirment notre hypothèse. Toutefois, les alliances politiques des partis, notamment avec l’UDMR, sont très importantes dans le choix du moment quand les élites promeuvent leurs idées. Cette conclusion s’ajoute à notre hypothèse.
Une importance particulier dans le cas des politiques nationales et envers les minorités ont les modèles et recommandations internationales, qui ont dans ce cas un statut ambigu et un rôle purement instrumental. Tous les intervenants dans les débats trouvent un modèle qui peut appuyer sa position et, de l’autre côté, il y a dans la plupart des discours une fierté manifeste pour l’originalité des solutions roumaines pour intégrer à la fois les minorités nationales et les roumains à l’étranger qui peuvent, sous certaines conditions, accéder facilement à la citoyenneté.
Dans le chapitre 4, nous examinons le rôle des idéologies politiques des élites parlementaires dans l’élaboration et l’adoption des politiques territoriales de l’État, dans les restructurations de l’État par la décentralisation. L’objet de cette analyse est la régulation des transformations des relations construites entre l’État et son territoire dans la Constitution et dans les lois spéciales. Cette analyse inclut la problématique de la relation entre l’État, le territoire et les minorités nationales.
Le discours dominant résulte au vote des articles de la Constitution, des lois et des amendements proposés. Il est cohérence avec les politiques adoptées. L’État roumain qui résulte de la transposition de ces référentiels dans les politiques est un État centralisé. La décentralisation est valorisée par la plupart des discours sur les principes, mais au moment des décisions des mécanismes de coordination entre le centre et le local, les discours et les votes privilégient le contrôle de l’État sur les autorités locales. Comment peut-on expliquer ce phénomène ?
Une analyse attentive nous permet voir qu’au-dessous des discours sur l’importance de la décentralisation – pour un État plus efficace – au niveau technique, toutefois, les représentants des partis au pouvoir, au moment de débats, sont les avocats d’un contrôle assez fort des organes locaux par les préfets, représentants de l’État. Ces discours sont cohérents avec les idéologies des partis – affirmées par les labels/les noms et par les documents programmatiques des partis – à la fois dans le cas des partis au pouvoir et dans le cas des partis en opposition. Ainsi, l’hypothèse de la recherche peut être partiellement confirmée : les élites parlementaires définissent un référentiel des politiques de la décentralisation qui guide les réformes. Cependant, seules les élites au pouvoir peuvent promouvoir leurs idées et les discours marginaux des libéraux ou magyares ne sont pas mises en œuvre. Ainsi, la dynamique de la compétition partisane semble avoir une valeur euristique plus grande que notre hypothèse initiale. De ce point de vue le rôle des élites est marginal, parce que la compétition des partis joue le rôle dominant dans les choix des alternatives des politiques publiques.
En outre, à côté de la dynamique de la compétition partisane pour le gouvernement, les discours des élites politiques en soutenant plus ou moins de décentralisation sont, dans la plupart des cas, cohérents avec les structures des partis et la distribution du pouvoir dans les partis. Ainsi, l’UDMR est le partisan de la plus forte décentralisation ce qui est en concordance avec son pouvoir dans le système de partis, son appui électoral et sa structure interne. L’autre parti qui promeut la décentralisation est le PNL. Il est, pourtant, un parti centralisé dans sa structure, mais avec une idéologie et un appui électoral qui soutient la décentralisation. Le FDSN/PDSR/PDS est le seul parti qui change d’une manière substantielle son approche dans l’organisation interne, en 200310. C’est le moment d’une forte croissance du poids des organisations et des leaders locaux dans les décisions du parti, y compris dans le recrutement des candidats et l’élection du président et des vice-présidents.11 C’est aussi le moment du monté de l’attention pour la décentralisation financière dans le discours du PSD et dans les politiques adoptées dans la période 2000-2004.
Dans le chapitre 5, nous présentons notre analyse du rôle des idéologies politiques des élites parlementaires dans la définition des fonctions de l’État. Pour étudier ce champ très vaste nous avons pris en tant que matériel de recherche les débats parlementaires sur les programmes des gouvernements. Ils ont l’avantage de reprendre ou d’anticiper en résumer, d’une manière synthétique, les grands débats sur les réformes initiées par un gouvernement. Dans ce chapitre nous avons commencé notre recherche dans ce chapitre avec l’hypothèse spécifique que les élites politiques postcommunistes ont joué le rôle de sélection des choix des politiques possibles et d’emprunt des modèles disponibles. La principale hypothèse concurrente était que la démarche de légitimation des partis est plus pertinente pour expliquer les transformations de l’État en ce qui concerne ses fonctions, notamment la privatisation et les politiques sociales.
Au fil des années ’90, jusqu’en 1999, l’opposition discursive principale entre les partis roumains est l’opposition entre les maximalistes de la réforme – les avocats d’un retrait rapide et net de l’État de l’économie et de la société – et les minimalistes de la réforme – les avocats d’une transition graduelle des rôles de l’État vers le marché. Ce clivage est pertinent, au niveau discursif, pour une période aussi longue parce que la transition même fut plus longue en Roumanie que dans les autres pays de l’Europe Centrale. Finalement, les minimalistes ont dominé, à la fois, le discours et les politiques gouvernementales. Néanmoins, cette conclusion ne signifie pas un rejet de la réforme, mais l’option pour une approche double : la réforme économique est toujours conditionnée par l’offre des garanties de l’État pour diminuer les risques sociaux. L’opposition est prolongée dans une dispute entre la droite et la gauche dans les années 2000. La cohérence interne est aussi renforcée par une corrélation assez forte entre l’affiliation politique internationale et européenne des partis et leurs discours.12 L’exception notable de la constance du discours est le Parti Démocrate, devenu Parti Démocrate Libéral, qui change sa famille politique entre 2005 et 2006. De la sorte, le changement de la famille politique et de l’affiliation aux organisations internationales des partis déterminent un changement discursif.
Ainsi, la recherche nous amène à la conclusion que le discours et les décisions des représentants des partis politiques sont déterminants pour les décisions politiques, mais que le rôle des élites est subsumé au rôle des partis. D’une manière générale, il est possible d’observer une constance du discours idéologique des partis politiques roumains, une correspondance entre la famille politique des partis, leurs discours dans des moments symboliques clés de la vie politique et les électorats des partis. Plusieurs options de réforme ne sont pas débattues et ces politiques semblent directement déterminées par les recommandations des institutions internationales. De l’autre côté le retard de certaines libéralisations dans l’économie et notamment de la privatisation met en avant un processus politique plus complexe. Même si les discours sont souvent congruents, guidés par le discours officiel de l’Union européenne, les actions de tous les gouvernements furent inconsistantes et fortement influencées par les stratégies politiques du moment et les intérêts particuliers.
Dans le chapitre 6, nous présenterons l’analyse du rôle des idéologies politiques des élites parlementaires dans l’élaboration des politiques de consolidation de la capacité de l’État roumain postcommuniste. Le nombre des lois et des débats sur la capacité de l’État roumain postcommuniste est incommensurable. Par conséquent, il faudrait trouver des débats porteurs, qui ont la vocation de synthétiser et de systématiser les discours des élites politiques sur les questions clés. Nous avons choisi alors d’étudier les débats parlementaires généraux sur les budgets d’État dans les années 1993-2011, en tenant compte de la valeur fondamentale des allocations des ressources sur la construction de la capacité administrative.
Nous avons commencé notre recherche dans ce dernier chapitre empirique avec une hypothèse double : (1) l’instabilité du système partisan et la présence durable du patronage dans la politique roumaine détermina une extraction des ressources de l’État et des retards dans la consolidation de sa capacité dans les années ’90 et (2) le rôle des élites politiques changent et, au nom de l’intégration européenne, elles deviennent des catalyseurs de la réforme, dans les années 2000. La première hypothèse peut être confirmée par l’analyse de discours des élites politiques sur l’incapacité chronique de l’État et par l’analyse des politiques menées pour consolider cette capacité, corroboré avec les conclusions de notre examen du système des partis politiques, leur financement formel et informel. Même quand ils reconnaissent les problèmes, les élites politiques n’adoptent pas en temps et sans pressions des décisions qui peuvent consolider la capacité de l’État (comme les politiques anti-corruption ou l’abandon des politiques d’exonérations fiscales qui ont endommagé le budget jusqu’à l’adhésion à l’UE.)
De l’autre côté, la deuxième partie de notre hypothèse est plus difficilement à confirmer. Nous ne trouvons pas dans les discours analysés des indices d’une participation active des élites politiques parlementaires à la conception et à l’adoption des politiques de consolidation de la capacité de l’État. Les solutions politiques sont empruntées, suite aux recommandations européennes13 et le rôle des parlementaires dans l’adoption de certains politiques est passif, car le gouvernement utilise des ordonnances d’urgence et la procédure de l’engagement de sa responsabilité. Ainsi, une consolidation de la capacité de l’État est corrélée premièrement avec les négociations pour l’adhésion à l’UE.
3. La présentation des résultats de la recherche empirique dans le cas roumain. Les conclusions par période et par secteur des politiques
Tout en tenant compte des différences que nous pouvons observer au niveau de chaque ensemble de réformes et de politiques publiques, nous pouvons tirer quelques conclusions générales de cette recherche doctorale.
Au début des années 1990, ce sont plutôt les idées des élites, les relations personnelles et les ressources du passe qui jouent un rôle décisif dans la promotion des politiques publiques de réforme de l’État. Surtout les débats de 1991 sur la Constitution sont animés par les idées les plus diverses des élites politiques. Devant une faible contrainte manifestée par l’organisation partisane et dans le contexte d’une structure institutionnelle encore jeune – qui favorise l’influence politique du Parlement face au Gouvernement et des influences personnelles des élites face aux règles bureaucratiques14 – le rôle des élites est important et elles promeuvent leurs idées influencées par leur socialisation politique sous le communisme et par leur ouverture vers l’occident au moment du changement du régime. Le national-communisme roumain, le centralisme démocratique doctrinaire et le savoir-faire accumulé dans des structures de pouvoir de l’ancien régime sont des sources des certaines idées véhiculées et même dominantes au début des années ’90. De même, l’histoire roumaine d’entre les deux guerres, la Convention Européenne des Droits de l’Homme et des modèles européennes différents, choisis selon les besoins de l’argument par l’orateur. Les idées et les intérêts personnels dominent la prise des décisions dans les premières années du postcommunisme.
La période 1996-2000, semble plutôt une phase de transition. Il y a un équilibre entre l’influence des élites et des entrepreneurs des politiques, d’un part, les partis en tant qu’organisations, d’autre part, les conditionnalités étrangères, finalement. Le rôle des élites politiques face aux contraintes partisanes est variable, dans le contexte de la faiblesse des partis au gouvernement, par opposition à un parti d’opposition fort (le PDSR). Également, les entrepreneurs des politiques et les recommandations des organisations internationales rencontrent les intérêts des élites pendant la crise économique grave, accentué par le retard des réformes de l’administration étatique et de la privatisation. Toutefois, nous pouvons remarquer déjà en 1996 – quand le premier-ministre présente son programme – et 1997 – quand le ministre des finances publiques présente le budget pour 1997 – une forte opposition discursive entre la droite et la gauche qui traverse la plupart des discours et qui organisent les prises de positions. Nous avons ainsi des indices importants des contraintes manifestées par l’organisation partisane, non seulement au niveau du vote, mais notamment dans les idées présentées à la tribune du Parlement. Par ailleurs les partis comment définir une identité idéologique indépendante de leur rôle dans le changement du régime et de leurs relations avec le parti communiste. C’est une idéologie définie déjà par rapport à leur rôle dans la transition de la société, de l’économie, de l’État.
Si l’étape 1996-2000 peut être considérée plutôt comme une période de passage, à partir de l’année 2000 nous avons identifie une cohérence inattendue au début entre les familles auxquelles les partis adhèrent, les discours des élites de chaque parti et les décisions prises au niveau des réformes de l’État.
Ainsi nous pouvons conclure que, malgré leur instabilité structurelle, les partis politiques roumains développent et suivent des idéologies qui sont de plus en plus stables et claires, qui offrent aux électeurs et aux chercheurs la possibilité d’anticiper d’une manière générale les directions des politiques publiques, au moins dans les domaines étudiés.
Au niveau des politiques nationales de l’État, nous pouvons identifier un discours dominant commun des partis démocratiques parlementaires d’après 2000. Les représentants du PSD, du PD (plus tard PDL) et du PNL sont tous les partisans d’un nationalisme libéral qu’ils transposent dans les politiques : l’État refuse d’offrir des droits collectifs aux minorités nationales, mais il est prêt à offrir des droits individuels larges (et qui ne peuvent pas être exercés que par les communautés : la représentation au parlement, l’enseignement dans les langues des minorités). Nous pouvons identifier deux discours minoritaires : le discours de l’Union Démocratique des Magyares de la Roumanie qui pousse vers un État multiculturel, et le discours du Parti la Grande Roumanie qui soutient un nationalisme plutôt culturel.
Au niveau des politiques territoriales de l’État, Le Parti de la Démocratie Sociale de la Roumanie, héritier du Front Démocratique de Salut National et devenu après 2004 le Parti Social Démocratique et le Parti Démocratique, héritier du Front du Salut National et devenu après 2007, le Parti Démocratique Libéral sont les partis qui soutiennent un État plus fort au centre. Les représentants de ces partis soulignent l’importance de la décentralisation pour un État plus efficace et pour le bien-être des citoyens, mais c’est l’intérêt d’augmenter l’efficacité de l’État qui dirige leurs discours. De l’autre côté, au niveau technique, ils sont les avocats d’un contrôle assez fort des organes locaux par les préfets, représentants de l’État. Cependant, la position des représentants du Parti Démocratique depuis 2005, et notamment après 2007, quand le parti devient membre du Parti Populaire Européen. Apparemment ils promeuvent plus la décentralisation, notamment au niveau sectoriel, par la promotion des initiatives législatives entre 2004 et 2007 et entre 2008 et 2012 quand le parti est au gouvernement. Mais les initiatives sont de nature à renforcer l’État central dans trois directions : en premier lieu, par l’accent mis sur les normes minimales, les procédures et méthodologies standard établies au centre pour tous les organes de l’administration locale ; en deuxième place, en cohérence avec le premier point, dans les projets des lois proposées, mais aussi pendant les débats, les représentants du PD soutiennent un contrôle élevé de l’administration locale par le préfet. Finalement, les propositions du PD vont plutôt vers une décentralisation administrative sans décentralisation financière ou avant la décentralisation financière. Cette succession : la décentralisation administrative et plus tard une décentralisation financière, n’encourage pas le développement du gouvernement local et de l’autonomie locale.
Au niveau des discours dominés, les représentants du PNL réclament toujours une plus forte décentralisation et une diminution du rôle de l’État, notamment du rôle du préfet au niveau local. L’Union Démocratique des Magyares de la Roumanie est la formation politique qui soutient le plus la décentralisation. Pour l’UDMR l’autonomie locale est le principal objectif du statut de la formation politique depuis 1991. Le Parti de la Grande Roumanie est, pendant les deux décennies postcommunistes, le parti d’un discours nationaliste et étatiste en accord avec sa position sur l’unité historique et culturelle du peuple et de l’État roumain.
Au niveau des politiques économiques et sociales de l’État, le clivage gauche-droite est très marque dans les discours. Les politiques publiques adoptées pour redéfinir le rôle de l’État dans l’économie et dans la société suivent des modèles européens, mais le modèle choisi par chaque parti (quand il est au pouvoir) et appui par ses représentants au Parlement est toujours en accord avec son positionnement à la gauche ou à la droite. Les représentants du PSD sont constamment et exclusivement les partisans des politiques de gauche modérée. Après 2000, en répondant aux recommandations européennes qui poussaient vers la libéralisation des marchés encore contrôlés par l’État, les sociaux-démocrates adoptent un discours et des décisions assez proches de la doctrine de la troisième voie théorisée par Anthony Giddens15, mais ils rejettent toujours les politiques de la droite. La PGR ne développe pas une idéologie cohérente au niveau des propositions économiques et sociales. Les prises de parole des parlementaires de ce parti sont plutôt populistes. Ce discours populiste dans les domaines économique et social s’ajoute au discours nationaliste pour définir l’idéologie du PGR.
Les représentants de l’UDMR sont constamment et exclusivement les partisans des politiques de droite – proche de la chrétien-démocratie – en soutenant le rôle-clé des communautés locales dans les politiques sociales et le développement économique, avec l’intervention minimale de l’État en tant que garant du respect des droits des citoyens. Les deux autres partis à droite ont les discours les plus instables. Le Parti Démocrate devient le Parti Démocrate Libéral et il change sa famille politique entre 2005 et 2006. De la sorte, le changement de la famille politique et de l’affiliation aux organisations internationales des partis déterminent un changement discursif. Dans le cas des libéraux, l’alliance de 2003 du PNL avec un parti de gauche à l’époque, le PD, et puis avec le PSD, et l’apparition d’un concurrent très fort à la droite (de PDL après 2006) détermine un adoucissement du discours de droit des libéraux, visible après 2004. En fait, de cette façon, les libéraux roumains s'approchent plus de la famille libérale européenne16 et il faut souligner que le changement discursif n’est pas radical.
Au niveau des politiques pour la consolidation de la capacité de l’État, il est le plus difficile d’observer une cohérence idéologique des partis. Les élites politiques de tous les partis ont les mêmes discours et les mêmes attitudes vers les réformes administratives, de la justice, vers les politiques de lutte contre la corruption. Dans ce contexte, quand tout le monde identifie le problème de la faible capacité administrative de l’État, il n’y a que deux partis qui ont un discours cohérent en proposant des solutions : le Parti National Libéral et l’Union Démocratique des Magyares de la Roumanie. Il est possible d’observer dans ce cas la présence d’un référentiel libéral des politiques fiscales dans l’introduction de l’impôt à taux unique, soutenu par les libéraux depuis 2002 et adopté finalement en 2004. L’UDMR demande une réforme structurelle de la décentralisation pour renforcer à la fois la capacité administrative de l’État et des communautés locales. Toutefois, comme nous avons montré dans le chapitre dédié à la décentralisation, l’UDMR ne réussit pas à promouvoir ces solutions.
4. Conclusions générales
Ainsi donc, la cohérence idéologique stable des discours et des propositions et des décisions des élites politiques et la présence des clivages qui structurent à longue terme les oppositions entre les partis nous permet de conclure que les idéologies partisanes promues par les élites politiques ont une valeur dans l’explicitation de transformations de l’État roumain postcommuniste. Mais quel est le rôle des élites dans la définition idéologique des partis et quels sont les autres facteurs qui interviennent pour ce processus ?
La thèse selon laquelle les idées des élites constituent les principaux éléments de la construction des idéologies des partis est bornée par les réalités empiriques qui dévoilent l’impact des facteurs structuraux, institutionnels et sociologiques dans la limitation des possibilités d’influence et d’action de ces acteurs. Ces facteurs sont : les alliances des partis pour arriver au pouvoir, les recommandations et les contraintes internationales et la recherche de la légitimation nationale (par l’adaptation des politiques au profil de l’électorat) et internationale (par l’appropriation des doctrines directrices des fédérations européennes des partis).
Malgré ces encadrements dressés par des déterminants du système politique et les efforts d’intégration européenne, les discours des élites en exprimant des idées qui évaluent les politiques roumaines et proposent des solutions adaptées au cas roumain constituent, pourtant, une variable intervenante dans la compréhension de la prise de décision politique sur les réformes de l’État. Les principales idées que nous avons pu examiner dans les discours des leaders du FSN/FDSN/PDSR/PSD, de l’UDMR, du PGR et de PNL sont constantes et ils ne changent pas significativement en fonction de la dynamique de la compétition partisane. Le timing de leur promotion est dépendent de la configuration politique du gouvernement, d’un autre côté. Donc, le développement des idéologies sui generis des partis roumains est, à la fois, le résultat des adaptations discursives à la dynamique des alliances partisanes et des agrégations des idées des élites.

Texto completoTaking the pronatalism of Ceausescu’s regime as a case study, this thesis is an an ethnography of the memory-formes of a recent delicat past, such as the banning of abortion in a totalitarist regime. From 1966 to 1989, the communist regime imposed extreme policies of controlled demography in Romania, as it was imputed, for ‘the good of the socialist nation’. A construction of maternity as ‘Romanian tradition’ was developed in parallel to the banning of abortion on request and the making of contraception almost inaccessible. The social remembering of such a difficult past is still a taboo in contemporary Romanian society. This law-remembering, which is maybe playing an important role in the current situation of Romania’s reproductive health, is influenced by the intersubjectivities devellopped between the different forms of pronatalist memory, i.e. its official memory, its cultural memory and its social memory. The analysis of those memory-formes and their intersubjectivities is based on an anthropological fieldwork (2004-2009) on the memory of abortion in Communist Romania, and is theoretically informed by the interdisciplinary field of Memory Studies

Texto completoDefeated at the elections to the legislature in November 1962, centrists tried to create a large party, from Socialists to Christian Democrats and Liberals, a party able to compete with the Gaullism. "Centre démocrate" was created following Lecanuet's success at the presidential elections in December 1965 ; it united MRP, Independents and some Radicals near Maurice Faure, but couldn't resist to increasing influence of bipolarisation. Divergences separated centrists, as early as 1967, and appeared brightly at the presidential election in 1969. Jacques Duhamel, Joseph Fontanet, René Pleven, supported Pompidou and created "Centre Démocratie et Progrès" ; they partly succeeded in reorientating the majority in accordance with centrist ideas. On the contrary, "Centre démocrate", following Lecanuet, supported Poher and persisted in its strategy of opposition and third party. "Mouvement réformateur", due to an alliance with the Radicals November 1971, didn't succeed either in being the third political pole. 1974 all centre was united in Giscard's majority, it left both opposition and its status of independent party. May 1976 Centre démocrate and CDP merged, creating "Centre des Démocrates sociaux" (CDS). Studying evolution of centrism during the years 1962-1976, structures of Centre démocrate and CDP, specific characteristics of centrists (leaders, militants, electors), centrist ideology, local settlement and electoral geography, we can establish that centrism was, from 1962 to 1976, a real political force, based on a consistent doctrine, as a conjunction of three currents - Christian democracy, liberalism, reformist left -, based too on a specific strategy, original practices and significant behaviour. Centrists however remained for a long time divided, dispersed in several small parties. Fifth Republic's majority system didn't put an end to centrism, it only meant a modification of its place and function : bipolarity isn't a bipartite system. Thus can be substituted for the right-left-split a subtler division, which expresses better the diversity of political ideas and the variety of sensibilities

Texto completoThe 1990s saw the birth of so-called 'conditional cash transfers', assistance programs for poor families on the condition that they encourage their children to seek education and attend health centers. In order to reduce poverty and ensure a better future for tomorrow's « poor », these policies represent a new type of social protection with different principles and modes of operation for traditional programs. The analysis of their origins reveals a progressive structuring marked by institutional contexts and different paths that have generated similar results. The objective of this study is to identify one or more variables that might explain their emergence and expansion in Brazil and Mexico in the 1990s and 2000s and to highlight how the evolution of these policies could generate more or less strong opposition from some actors as well as the institutional constraints these policies face. We can observe group structures centred on "causes" - notably the cause of human capital - that have largely determined the development and implementation of these policies. This paper seeks to show the nuances of the idea of consensual reforms in Mexico and Brazil, without denying the extent to which these transformations have occurred. This means that institutional change in Brazil is operated by adding new features to existing institutions; while in Mexico, in the first instance, the process of change and consolidation of conditional cash transfer programs has occurred as an institutional shift and then the defenders of the status quo actors marginally modified the program to keep their interests. As monetary instruments to combat poverty, these programs are the subject of an ambiguous consensus and actors from different coalitions end up supporting them. Finally, "interests", necessary at different times, were constituted as a key variable to understand the permanence and strengthening of these policies through locking phenomena
A década de 1990 assistiu ao nascimento das chamadas « transferências condicionadas de renda » : programas assistenciais para famílias pobres à condição de que elas incentivem seus filhos a prosseguirem os estudos e que frequentem centros de saúde. Com o objetivo de reduzir a pobreza e assegurar um futuro melhor para os « pobres » de amanhã, essas políticas representam um novo tipo de proteção social com princípios e modos de operaçäo diferentes dos programas tradicionais. A análise de suas origens revela uma estruturação progressiva marcada por contextos institucionais e trajetórias distintas que geraram resultados semelhantes. O objetivo deste estudo é identificar uma ou mais variáveis que possam explicar a emergência e expansão no Brasil e no México nas décadas de 1990 e 2000, examinando a maneira como suas evoluções suscitaram oposições mais ou menos fortes de atores e os constrangimentos institucionais enfrentados. Nós podemos observar uma estruturação de grupos reunidos em torno a « causas » - notadamente a causa do capital humano - que influem na elaboração e na implementação dessas políticas. Esse trabalho busca matizar a ideia de reformas consensuais no México e no Brasil, sem negar a dimensão das transformações ocorridas. A mudança institucional no Brasil é operada por meio da adição de novos recursos às instituições existentes; e no México, em primeira instância, o processo de mudança e consolidação da política de transferência de renda ocorreu como um deslocamento institucional e, posteriormente, os atores defensores do status quo modificam marginalmente o programa para manter os seus interesses. Assim, esses programas são objeto de um consenso ambíguo, uma vez que atores de diferentes coalizões passam a reivindicar eventualmente esses instrumentos. Finalmente, os « interesses » constituíram-se como uma variável chave para entender a permanência e o reforço das condicionalidades dessas políticas por meio de fenômenos de lock- in

Texto completoThe presence of the United Nations (UN) peacekeeping forces on the territory of the Democratic Republic of the Congo (DRC), from 1960 to 1964, and then later from 1999 to date, witnesses not onlythe political and security crises that shake the country but also the atrocities raging in it. As a consequence, there has beensuch a human and humanitarian toll that particularly caused the death of more than five million Congolese people and the worst crimes ever committed against humanity since the end of the Second World War.From 1960 to 2020, how have peacekeeping operations (PKOs) improved in relation to outcomes on the field? How did the interventions and actions of the UN in the DRC get the international community to envisage a doctrinal and operational transformation of such external interventions?The atypical case of UN interventions and presence in the DRC has forced the UN to many reviews of its intervention and peacekeeping doctrines as supported by article 39 of its charter.Having known almost all types of intervention, the DRC can be considered as the best case of testing groundof UN PKOs - their foundations, evolution and future through a necessary transformation.The use of a transversal methodology involving historical, legal and sociological methods leads to the apprehension and complex understanding of PKOs and is the basis for considering a modeling and a new doctrinal approach.The study of these PKOs with the substantial resources deployed in the DRC by the United Nations - up to nearly 20,000 peacekeepers and officials stationed and more than fifteen billion US dollars spent - shows, in view of the results on the field, the limits of the means policy.The study of PKOs in the DRC leads, by questioning the effectiveness of these interventions in view of the persistence of deadly and still unresolved conflictsby the international community, to revisit the forms of intervention, to initiate a new doctrine of PKOs, “the fourth generation PKOs”.This is one of the objectives of this thesis besides that of building a Congolese memory on peacekeeping operations in the DRC

Texto completoThis study focuses on how an actor justifies its actions in heterogenous and fragmented environments. It aims at proving that in the absence of a principle of agreement constraning the actors’ actions, the relations between equal partners of action turn into polyarchy whilst those between inequal ones end in arrangement, contention and finally, violence. To this end, this research concentrates on the British mandatory policies in Iraq through the management of Kurdish nationalist movement in the wilaya of Mosul from 30rd October 1918 to 5th 1926. The 30rd October 1918 is the date of the signature of Armistice of Mudros between the Allies and the Ottoman Empire at the end of the First World War. It is in the aftermath of this armistice that the British occupied Mosul. In 5th 1926, Turkey and Great Britain signed the Treaty of Angora which settled the question of frontier between Turkey and Irak, a question which is also known as Question of Mosul

Texto completoUnderstanding of the changes in corporate governance lies at the heart of contemporary debates about transformation of capitalism. Asia is no exception to this phenomenon. Asia’s corporate governance has undergone significant changes since the financial crisis of 1997. Our study, based on the theory of institutional change, seeks to examine current transformations. The concept of corporate governance is viewed as being dependent on institutional environments in which the firm evolves. The analysis of the changes in corporate governance is therefore needed to understand institutional change.On this basis, we argue that the current transformation is experiencing a process of hybridization and we suggest a framework to understand ongoing corporate governance reform. Hybridization carries two opposed forces: drivers for change and resistance to change. But the dynamic process of adaption of newly imported practices leads to new model adapted to local conditions. Our empirical analysis allows us to apprehend the diverse pattern of corporate governance in the region of Asia even within the current context of adherence to the Anglo-Saxon model: we find three hybrid models and one other model which has not committed to the reform. We also study the sources of change and the factors that give rise to resistance. We provide an overview of the recent changes in corporate governance practice in Asian countries

Texto completoThis research focuses on the interaction between environmental scanning and innovation. The research question is the following: Does the implementation of the environmental scanning or its specific type contribute to innovation in organizations?Under a qualitative prism, this work is based on action research in a company of the catering sector in Armenia.According to the research results, the environmental scanning is a tool contributing to innovation even in an unstable context with low social protection. The informal environmental scanning conditioned by company’s internal culture is a source of performance if it is included in the strategic vision of the company. The combination of external and internal environmental scanning is essential for the development of business through innovation.The informal human resources scanning have a central role in the detection of internal conflicts, in the discovery of the potential of the employees and in the capture of the employee profiles in adequacy with the culture of the company. It contributes to the development of the employer brand of the company and to innovation. Moreover, the types of environmental scanning specific to the catering sector, as customer service and franchise network scanning, contribute as well to innovation, more particularly if they are linked with human resources scanning. This research also shows that political scanning is essential to ensure the sustainability and development of businesses in uncertain political contexts such as in Armenia, a country in transition

Texto completoThe international community and the international law are facing a great challenge: find the solution to end the Israeli-Palestinian conflict. The study of the Israeli-Palestinian conflict in light of international law shows many difficulties related to the emergence of a Palestinian state. Indeed, this conflict is a source of violation of international law specifically a violation of human rights that continues to strike in this area. Violations against international law go back to the time of the British mandate and are finally characterized by the impunity towards the entities that have committed them. Therefore, this allows us to highlight the weaknesses of international law, more specifically those of the United Nations that is confronted with the constant breach of its principles and decisions. We have tried to overcome this infernal situation by using the techniques offered by the international law that aims to put an end to a conflict. There is a technique that seems to be the most appropriate for the Israeli-Palestinian conflict known as the negotiation. However, the peace process that began in 1990 is now almost forgotten.Despite all this, the creation of a Palestinian state is the base to the solution of the Israeli-Palestinian conflict. This present study aims to demonstrate, based on the definition of the State under international law, that Palestine has, on one hand, confirmed elements/components that are imperfect, allowing the latter to constitute a State under international law, and on the other, that it can’t achieve statehood to the extent that certain elements necessary for statehood remain questionable.
