Texto completoThe recognition of unmarried unions, the opening up of marriage, and the redefinition of family overall that have occurred in the late XX and earlier XXI century challenge the legal transposition of heteronormative value systems. The research tackles the reforms towards gender-neutral institutions under the perspective of legal theory. The issue is firstly situated in a postmodernist consideration of diversity and in the historic evolution of same-sex unions and marriage. Then, the legal clarification of the constituent elements of the claim for legal recognition and the economic analysis of same-sex couples outline the characteristics of contemporary debate. The research conclusively suggests the idea of the negative eudaemonistic State as the background of the paths towards recognition and surveys international and constitutional law in the light of a board paradigm shift in favour of gender-neutral family institutions
