Texto completoEurope of universities is a well-known topic. It has a historical background dating back to the Middle-Ages. However, by nationalising the university, there remain but traces of a myth. Since over a decade, within the framework of the European Union, there has been a revival of a university Europe, which is in fact available to all higher education institutions, and has reached the stage which we could call a European Community university space. That space is based both on a community policy in higher education and on legal rights facilitating university co-operation. The actual community policy relies on well-established legal structures and does specifically give rise to several measures which can be found in programs such as Socrates and Leonardo. As regards the legal rights, dominated by the non-discrimination principle, they are revealed both at the mobility level such as such (conditions of residence, admissions policy) as well as recognition of qualifications (academic and professional). The stimulus from the European Community has given the Europe of universities a head start, but its future really seems dependent on active participation of all institutions

Texto completo@The promotion of good administration through EU law contributes to the consolidation of a common frame of reference amongst the public administrations of the European administrative space. As a source of obligations imposed upon the administration, the principle of good administration has been progressively built through the interaction of various sources of the european administrative space. It has been later recognized as a general principle of law, thereby increasing its importance for the EU legal system. This recognition confirms its importance for the consolidation of the European administrative space. Its application, however, does not lead to an uniform model of administration. The features of good administration, in particular its flexibility, and the limits which are inherent in the European project, preserve the room for maneuver of the administration authorities. Nevertheless, the principle of good administration contributes to the development of the European administrative space in that it contributes to reinforcing the effectiveness and legitimacy of the shared (national and European) administration

Texto completoLa costruzione di uno spazio giudiziario europeo costituisce uno dei nuovi cantieri del processo di integrazione comunitaria europea. Ispirandosi di modelli sviluppati in economia del diritto, e di lavori di economia pubblica (in particolare, il federalismo fiscale), il lavoro quì realizzato propone un' analisi economica della formazione di uno spazio europeo di giustizia in materia civile. L'organizzazione della coesistenza di diversi sistemi nazionali di giustizia sul territorio europeo pone differenti questioni agli economisti. In particolare, interroga la pertinenza del livello nazionale come spazio di riferimento per la produzione di giustizia. I concetti di concorrenza e cooperazione giudiziarie sono costruiti in base alle forme che rivestono in Europa. Un' analisi economica della concorrenza giudiziaria, sviluppata alla luce dei modelli di competizione giuridica, è proposta. Tuttavia, non permette di analizzare le due forme di concorrenza giudiziaria (competenze giudiziarie concorrenti, problemi di riconoscimento ed esecuzione extra territorium delle sentenze giudiziarie), e di spiegare le poste in gioco della cooperazione tra i giudici nazionali nell'Unione europea. Quindi l'analisi è completata con una riflessione, da una parte, sui comportamenti dei ‘consumatori di giustizia' in un contesto di pluralismo giudiziario, e dall'altra, sulle strategie dei giudici nazionali come produttori dei servizi di giustizia. Texto completoThe succession of catastrophic events that have occured in Europe and in the world during the last fifteen years has fostered a reflection at the European level. The Union has to address a growing request for an action in order to cope with crisis of important scale. This evolution implies a deep questioning on its ability to handle this type of phenomenon. The legal and institutional architecture of the EU was essentially designed to set up and organize an internal market. Thus, the impressive diversification of the mechanisms aiming to ensure the safety on the European territory is facing important structural limitations. Nevertheless, using the notions of "emergency" and "crisis management" the European institutions are structuring the basis of a competence regarding the protection of citizens against human vulnerability. In terms of subsidiarity, this new field of public action must be distributed between, on the one hand, sensitive national prerogatives and, on the other hand, supranational institutions that are trying to gain a new role in this area. This share of powers must be operated on a renewed and rigorous conceptual framework. The Union has to establish a genuine European protection space grounded on a reconfiguration of its internal solidarity and aiming to manage crisis of European scale

Texto completo1. A question was at the beginning of my thought : will a banking integration be favoured or is the ecc condemned to become only trade area within the worldwide market ? 2. A banking integration process has begun. It aims to create a banking common market by the means of services furnishing liberalization, free establishment and regulations harmonization concerning loan activity access. 3. However, european banking systems interpenetration is very low because of bank's monetary specificities and worldwidist strategies. 4. So, as the financial integration exists throughout all the world, how could we differenciate the community from the worldwide market ? 5. Two ways of differenciation appear then : on one hand, backwards the banking activity, i. E. In relation to the bank's monetary role. The matter of monetary perequisite appears in this integration process. This could abolish risks of exchange, in particular, and be favourable to a dynamic convergence of economic policies. On another hand, fowards the banking activity, for the banking risks increase makes a monetary and banking regulation reform necessary ; this, in the community regulation way and applying to products, and not to only bank establishments (in their statutory designation) any more. This could help to pass from an institutional regulation to a functional one. Then, one could unforesee an european banking insurance system in order to have risks importance squared with "re-adjustment"s' one. Such are the two ways for studying thoroughly an european banking space which cannot be based any more only on the liberalization principle. Therefore, the space concept must be distinguished from the market concept : the whole analysis and the results of the present research are based on this hypothesis

Texto completoThe convention on jurisdiction and enforcement of the decisions in civil and commercial matters was concluded in Brussels on September 27, 1968. Its territorial application was reserved to the European economic community and did not allow any territorial extension. Thus in 1981, the idea of a convention which could cover EEE and EFTA and other states outside these two organisations. The result of this idea was the Lugano convention, signed on September 16, 1988, kept the main part of the Brussels text but took into account all the jurisprudence developed by the European court of justice and the opportunity to reform this text. The contributions of the Lugano text integration into San Sebastian convention on May 26, 1989 is the starting point of our two part study. The first part is devoted to the mechanism of the European conventional system in matter of jurisdiction and enforcement of the decisions. We try to demonstrate the interest of the Lugano convention (chapter I) in its function of judicial tool in the European juridical greater space as well as its function as a parallel convention to the San Sebastian text. Beyond this intrinsic interest, we have to demonstrate the extrinsic interest of this convention (chapter II). First through the problems of juxtaposition of the Brussels convention and San Sebastian convention. Then through the relations between the Lugano and San Sebastian conventions and special conventions, as well as conventions concluded with outside states or even with the European law. We also analyse the future of the Lugano and San Sebastian conventions and the probabilities of an extension of the application of the parallel convention and of a creation of a universal convention. The second part deals with the most important contribution and the gaps of these two conventions in matter of jurisdiction, recognition and enforcement of the judgements. We divide these two scopes of rules into two chapters rules of jurisdiction (chapter I) and rules of recognition and enforcement (chapter II). We suggest some better solutions and we introduce some criticisms to the present system and imagine an alternative to these conventions in real free circulation of the judgements
