This chapter advances two main claims. First, that the distinction between consequentialism and deontology, although widely adopted, is illusory and only serves to obscure some of the genuine disputes underlying central debates in distributive justice. Second, that although luck egalitarianism and democratic egalitarianism are often presented as rival conceptions of justice—in particular, as offering competing accounts of the grounds of distributive justice—this may be a mistake, since this construal makes each view less plausible than it otherwise might be. Instead, the chapter proposes an alternative view where luck egalitarianism and democratic egalitarianism can be understood as complementary answers to different questions. Luck egalitarianism identifies one of the fundamental grounds of justice and injustice, whereas democratic egalitarianism is better conceptualized as offering a contractualist account of what it is for something to be just or unjust.

This article discusses various aspects of corporate governance and initial public offerings (IPOs). It begins with an analysis of agency theory that addresses IPOs and corporate governance research, together with the impact of governance on investors. It then considers three aspects of corporate governance that are relevant to outside investors to the IPO: the IPO firm’s board of directors, executive compensation, and ownership concentration. It also examines how national institutions affect corporate governance worldwide and looks at two types of IPOs backed by private equity (PE): venture capital backed IPOs of entrepreneurial firms and PE-backed buyouts of companies that subsequently launch an IPO. The article also analyzes the link between information asymmetries and IPO performance before concluding with an outline of directions for future research that focus on important issues relating to IPOs and corporate governance.

Few religious leaders feel well equipped to respond to the needs of families impacted by abuse, and neither do recent seminary graduates. There is a chasm between the needs of pastors for preparation to respond to this critical social issue and current levels of training and preparation. This chapter explores the process and content of training religious leaders to respond compassionately and with best practices to abuse in their congregations and the communities in which they serve, with reference to both empirical data and experience in offering such seminars and workshops. The chapter also examines the factors associated with the reluctance of many seminaries to equip their students for this area of ministry.

U.S. historians have long considered the Civil War and its Reconstruction as a second American revolution. Literary scholars, however, have yet to show how fully these years revolutionized the American imagination. One marker of this was the postwar search for a “Great American Novel”—a novel fully adequate to the breadth and diversity of the United States in the era of the Fourteenth Amendment. The debate over what full representation would mean led to a thoroughgoing reconstruction of the meaning of “literature” for readers, writers, politics, and law. Legal Realisms examines the transformation of the idea of “realism” in literature and beyond in the face of uneven developments in the racial, ethnic, gender, and class structure of American society. The ideal of equality before the law conflicted with persistent inequality, and it was called into question by changing ideas about accurate representation and the value of cultural difference within the visual arts, philosophy, law, and political and moral theory. Offering provocative new readings of Mark Twain, Henry James, William Dean Howells, Helen Hunt Jackson, Albion Tourgée, and others, Legal Realisms follows the novel through the worlds of California Native American removal and the Reconstruction-era South, of the Mississippi valley and the urban Northeast. It shows how incomplete emancipation haunted the celebratory pursuit of a literature of national equality and explores the way novelists’ representation of the difficulty of achieving equality before the law helped Americans articulate the need for a more robust concept of society.

Chapter 5, “Cyril of Alexandria: The Twelve as Christian Scripture,” considers the meaning Cyril draws from the Minor Prophets as Christian scripture. For Cyril, the texts of the Twelve ground the identity of the church in Christ’s work, identifying those within the church as the single beneficiaries of the restoration effected in Christ’s incarnation, death, and resurrection. Through his commentary, Cyril further calls the church to its mission of extending Christ’s victory through true doctrine and virtuous lives, and equips his readers for this mission through the doctrinal and moral teaching of the prophets—most significantly, offering moral interpretation from the plain sense of prophetic admonitions. The Commentary on the Twelve Prophets warrants an expanded account of Cyril’s Old Testament interpretation, acknowledging the prominence of moral and ecclesial exegesis as well as Cyril’s ecclesiology as the necessary context for his supersessionism.

In India, elite law firms offer a surprising oasis for women within a hostile, predominantly male industry. Less than 10 percent of the country's lawyers are female, but women in the most prestigious firms are significantly represented both at entry and partnership. Elite workspaces are notorious for being unfriendly to new actors, so what allows for aberration in certain workspaces? This book examines how a range of underlying mechanisms — gendered socialization and essentialism, family structures and dynamics, and firm and regulatory histories — afford certain professionals egalitarian outcomes that are not available to their local and global peers. Juxtaposing findings on the legal profession with those on elite consulting firms, the book reveals that parity arises not from a commitment to create feminist organizations, but from structural factors that incidentally come together to do gender differently. Simultaneously, the book offers notes of caution: while conditional convergence may create equality in ways that more targeted endeavors fail to achieve, “accidental” developments are hard to replicate, and are, in this case, buttressed by embedded inequalities. The book examines whether gender parity produced without institutional sanction should still be considered feminist. In offering new ways to think about equality movements and outcomes, the book forces readers to critically consider the work of intention in progress narratives.

This chapter presents a thematic analysis of official Church discourse on sex and gender—issues central to Catholicism and, beyond religion, publicly salient to contemporary questions of personal identity and social relationships. Focusing on abortion, same-sex relationships, and women’s ordination, it assesses the postsecular attunement of the Church’s respective arguments, and it notes the continuities between its reasoning on abortion and on social justice. The chapter argues that Pope Francis is symbolically disrupting Church discourse by recalibrating the Church’s public priorities, moving them away from sexual issues, offering a more compassionate framing of abortion, and using a more inclusive vocabulary, as well as meaningful silences on gay sexuality. His stance on women’s ordination, by contrast, especially the continuing ban on its discussion, defies postsecular expectations. The chapter probes the tensions in Francis’s construal of women’s equality and concludes by highlighting how clericalism may perpetuate Church officials’ biased understanding of women.

According to a now familiar narrative, in the middle of the twentieth century, political philosophy was “dead,” but it has since been resurrected in a new form. Credit for the death certificate is given to Peter Laslett, who bemoaned the absence of major philosophers writing in English, like the tradition of thinkers from Thomas Hobbes to Bernard Bosanquet. According to many theorists, responsibility for the revival of political philosophy belongs to John Rawls. One of Rawls's most important contributions is the method of “reflective equilibrium.” In A Theory of Justice (1971), Rawls attempts to reconcile freedom and equality in a principled way, offering an account of “justice as fairness.” Three years after publication of Theory, Rawls's Harvard colleague Robert Nozick published Anarchy, State, and Utopia (1974), which is, after Theory, probably the most celebrated and widely discussed work in political philosophy in recent decades. This article explores contemporary Anglo-American political philosophy, the evolution of Rawls's thought, communitarianism, feminism and liberalism, multiculturalism, and global justice.

Sophie de Grouchy (1764–1822), published her Lettres sur la Sympathie in 1798, together with her translation of Adam Smith’s The Theory of Moral Sentiments. This short text is presented as her critical commentary on Smith, but also offers original analyses of the relationship of emotional and moral development to economic, institutional, and political reform. Like Smith, Grouchy believes that sympathy is fundamental to social well-being. She improves on his theory by offering an account of its origin; and she argues it is the result of early relationships of dependence. The political conclusions Grouchy draws from her analysis are in tune with her republican views: social equality can only be the result of recognizing that we depend on each other. Deepening Smith’s position, Grouchy argues that inequality hinders the growth of sympathy and renders fruitful cooperation between the different strata of society unlikely or impossible. This new translation of the text is presented with an introduction divided into three chapters. Chapter 1 covers Sophie de Grouchy’s life, times, and sources. Chapter 2 discusses Grouchy’s work, with a special emphasis on the relationship of the Letters to Smith’s The Theory of Moral Sentiments, which the Letters were a response to, as well as a discussion of other writings by Grouchy. Chapter 3 touches on three main philosophical themes present in the Letters: political philosophy, with an emphasis on the republican aspect of Grouchy’s thought; her legal philosophy and political economy; and her aesthetics.

For all their unquestionable importance, the Holocaust and the founding of the State of Israel now loom so large in modern Jewish history that we have mostly lost sight of the fact that they are only part of—and indeed reactions to—the central event of that history: emancipation. This book seeks to reorient Jewish history by offering the first comprehensive account in any language of the process by which Jews became citizens with civil and political rights in the modern world. Ranging from the mid-sixteenth century to the beginning of the twenty-first, the book tells the ongoing story of how Jews have gained, kept, lost, and recovered rights in Europe, North Africa, the Middle East, the United States, and Israel. Emancipation, the book shows, was not a one-time or linear event that began with the Enlightenment or French Revolution and culminated with Jews' acquisition of rights in Central Europe in 1867–71 or Russia in 1917. Rather, emancipation was and is a complex, multidirectional, and ambiguous process characterized by deflections and reversals, defeats and successes, triumphs and tragedies. For example, American Jews mobilized twice for emancipation: in the nineteenth century for political rights, and in the twentieth for lost civil rights. Similarly, Israel itself has struggled from the start to institute equality among its heterogeneous citizens. By telling the story of this foundational but neglected event, the book reveals the lost contours of Jewish history over the past half millennium.

In the twentieth century, Americans have increasingly looked to the schools--and, in particular, to the nation's colleges and universities--as guardians of the cherished national ideal of equality of opportunity. With the best jobs increasingly monopolized by those with higher education, the opportunity to attend college has become an integral part of the American dream of upward mobility. The two-year college--which now enrolls more than four million students in over 900 institutions--is a central expression of this dream, and its invention at the turn of the century constituted one of the great innovations in the history of American education. By offering students of limited means the opportunity to start higher education at home and to later transfer to a four-year institution, the two-year school provided a major new pathway to a college diploma--and to the nation's growing professional and managerial classes. But in the past two decades, the community college has undergone a profound change, shifting its emphasis from liberal-arts transfer courses to terminal vocational programs. Drawing on developments nationwide as well as in the specific case of Massachusetts, Steven Brint and Jerome Karabel offer a history of community colleges in America, explaining why this shift has occurred after years of student resistance and examining its implications for upward mobility. As the authors argue in this exhaustively researched and pioneering study, the junior college has always faced the contradictory task of extending a college education to the hitherto excluded, while diverting the majority of them from the nation's four-year colleges and universities. Very early on, two-year college administrators perceived vocational training for "semi-professional" work as their and their students' most secure long-term niche in the educational hierarchy. With two thirds of all community college students enrolled in vocational programs, the authors contend that the dream of education as a route to upward mobility, as well as the ideal of equal educational opportunity for all, are seriously threatened. With the growing public debate about the state of American higher education and with more than half of all first-time degree-credit students now enrolled in community colleges, a full-scale, historically grounded examination of their place in American life is long overdue. This landmark study provides such an examination, and in so doing, casts critical light on what is distinctive not only about American education, but American society itself.

Justice Across Ages is a book about how we should respond to inequalities between people at different stages of their lives. Age structures our social institutions, relationships, obligations, and entitlements. There is an age for voting, an age for working, and an age when one is expected (and sometimes required) to retire. Each stage of life also corresponds to specific forms of social risks and vulnerabilities. As a result, inequalities between age groups and generations are numerous and multidimensional. And yet, political theorists have spared little time thinking about how we should respond to these disparities. Are they akin to those patterned on gender or race? Or is there something relevantly distinctive about them that mitigates the need for concern? These questions and others are answered in this book and a theory of justice between co-existing generations is proposed. Age structures our lives and societies. It shapes social institutions, roles, and relationships, as well as how we assign obligations and entitlements within them. There is an age for schooling, an age for voting, an age for working, and an age when one is expected (and sometimes required) to retire. Each life-stage also brings its characteristic opportunities and vulnerabilities, which spawn multidimensional inequalities between young and old. How should we respond to these age-related inequalities? Are they unfair in the same way that gender or racial inequalities often are? Or is there something distinctive about age that should mitigate ethical concern? Justice Across Ages addresses these and related questions, offering an ambitious theory of justice between age groups. Written at the intersection of philosophy and public policy, the book sets forth ethical principles to guide a fair distribution of goods like jobs, healthcare, income, and political power among persons at different stages of their life. Drawing on a range of practical cases, the book deploys normative tools to distinguish objectionable instances of inequalities from acceptable ones and in so doing, critically assesses a range of policy remedies. At a time where young people are starkly under-represented in legislatures and subject to disproportionally high unemployment rates, the book moves from foundational theory to the specific policy reforms needed today. As moral and political philosophers have noted, it can be tempting to assume that age-based inequalities are morally trouble free, since over the course of a complete life, a person moves through each age groups. Yet, Justice Across Ages argues that we should resist this assumption. In particular, we should regard with suspicion commonplace and widely tolerated forms of age-based social hierarchy, such as the infantilization of young adults and older citizens, the political marginalization of teenagers and young adults, the exploitation of young workers through precarious contracts and unpaid internships, and the spatial segregation of elderly persons. If we ever are to live in a society where people are treated as equals, we must pay vigilant attention to how age membership can alter our social standing. This position carries important implications for how we should think about the political and moral value of equality, design our social and political institutions, and conduct ourselves in a range of contexts that includes families, workplaces, and schools.
