Resumen

Discussing the study of comparative law in Indonesia, this paper is interested in focusing on the issue of why comparative law studies are declining both in quantity and quality. Using Charles Tilly’s theory of social history, this paper concludes that comparative law studies in Indonesia are currently in a stagnant position and fewer people are concerned with the quality of this academic study. This paper reveals that the comparative law that began during the Dutch Rechtshoogeschool in Batavia in 1924 basically did not develop until the present day. Both in terms of epistemology, subject of the study, postulate to method and approach illustrate how comparative law studies have stagnated when compared to the development of this study abroad. Comparative law in Indonesia is only focused on substantive studies without paying attention to this scientific development on the epistemological and methodological side. Improvements can thus be proposed in dealing with this situation, namely by increasing the number of sources of writing and discussion of comparative law from outside, especially those in English, and making this comparative study a core science in legal studies. Abstrak Membahas kajian perbandingan hukum di Indonesia, tulisan ini tertarik untuk memfokuskan diri pada persoalan mengapa kajian perbandingan hukum semakin merosot baik kuantitas maupun kualitasnya. Dengan menggunakan teori sejarah sosial dari Charles Tilly, tulisan ini sampai pada kesimpulan bahwa kajian perbandingan hukum di Indonesia saat ini pada posisi yang mandeg dan semakin sedikit orang yang perhatian dengan mutu dari kajian akademik ini. Tulisan ini mengungkap bahwa perbandingan hukum yang dimulai sejak masa Rechtshoogeschool Belanda di Batavia tahun 1924 pada dasarnya tidak mengalami perkembangan hingga masa sekarang. Baik sisi epistemology, subject of the study, postulate hingga method and approach menggambarkan betapa kajian perbandingan hukum itu mengalami stagnasi bila dibandingkan dengan perkembangan kajian ini di luar negeri. Perbandingan hukum di Indonesia hanya terpusat pada kajian substantive saja tanpa memperhatikan perkembangan keilmuan ini pada sisi epistemologis dan metodologisnya. Perbaikan dengan demikian dapat diusulkan dalam menghadapi situasi ini yaitu dengan semakin memperbanyak sumber tulisan dan bahasan perbandingan hukum dari luar, khususnya yang berbahasa Inggris, dan menjadikan kajian perbandingan ini sebagai ilmu yang inti dalam kajian hukum.

AbstractThis paper expounds some critical reflections on Pierre Legrand's recent account of James Gordley's and James Whitman's comparative methodologies. Pushing his unconventional writing style to the limits and labelling Gordley's ‘positivist’ and Whitman's ‘cultural’ comparative law, Legrand's piece appears to be taking the first step towards a new, more sensitive phase for the comparative study of law and legal cultures. The paper argues that, contrary to what might be first thought, Legrand's ‘sensitive epistemology’ cannot act as a gateway to cultural otherness. This is because it is wholly in line with the constructivist objectification of life that characterises the study and practice of law both within and outside the comparative-law dimension.

Resumen

The study of Usul Fiqh only feels essential when it deals with different problems whose orders it executes not involve in the offer of the old Fiqh. Besides that, with the rising number of participants of comparative school legislation alike to discover out which idea is more powerful, since closely as the effort to transform Islamic rule, it will increase appeared in how urgent the role of Ushul Fiqh is. The paper tries to present this discussion to suggest the relevance of this idea of Fiqh in dealing with legal issues dealt with by Muslims who sometimes put on nonessential issues. The author organized research with a comparative descriptive analysis. This study organized a view of the works of Usul Fiqh along with the rules contained there in along with the development of Usul Fiqh and its benefits from time to time. The authors identify that Ushul Fiqh plays a highly considerable position in the improvement of Islamic law. Not merely that, Usul Fiqh, the essential function of Usul Fiqh, is to improve someone to find out the rules they take based on syar'i arguments, so that they do not rely very often on considering other people whose bases they do not have. There are not a few obstacles in the Islamic world community with the presence of discoveries by scientists who require answers and confidence of Islamic law.

Resumen

The political effectiveness of legal expertise in the United States has rested on the ability of a peak association to present itself as representing the opinion of the profession as a whole. It has also relied on a broad epistemology in which lawyers claim to know the right thing to do. However, the effectiveness and placement of such expertise is a comparative issue. This article argues that organizations other than peak associations can muster the support required for legitimacy in the modem state. The legal profession's epistemology could lead it to narrow rather than broaden its claims in order to effectively claim expertise in something. The ability of the central state to shape a profession's mandate and to reject its advice will also influence the deployment of legal expertise. The article explores these issues in the context of the reform of administrative law in England and Wales. In England and Wales, an expertise-based commission mimicked the processes expected of a peak association. In anticipation of rejection by the central administration, it constrained rather than broadened its policy recommendations.

AbstractIs there a stable set of practices or assumptions surrounding dignity, and would these necessarily denote a single foundation sustaining that stability? Two contemporary debates offer contrasting approaches to these questions. In the first, two jurists, who share agreement over the appearances of dignity in post-1945 jurisprudence, disagree as to whether these appearances form an emerging ius commune or a contingent set of conceptions. The second, comparative, debate explores the functional consequences of dignity’s aristocratic resonances. One position posits a continuing relationship between dignity and aristocratic nobility; the other, a functional division between dignity-within-aristocracy and dignity-within-democracy. This article insists that clarification of these debates depends upon a distinction between the epistemology and ontology of dignity, and, further, a distinction between dignity’s genealogy and its grammar. It concludes that a complex genealogical inheritance is at the heart of much disagreement, and that attention to dignity’s use clarifies its deficiencies and its continuing appeal.

Hanifi's essay addresses issues relevant to the comparative study of Afghanistan, namely, epistemology, class, culture, and empire. It explores how urban Persianate state elites in Kabul exploited imperial opportunities, especially educational opportunities, over the century since constitutional independence.

Este artigo tem por objetivo investigar possibilidades de acesso à justiça e promoção dos direitos humanos no Sistema Interamericano a partir da criação de uma Defensoria Pública Interamericana. A base teórica é estruturada no campo de uma epistemologia do Sul que analisa a relevância do contexto cultural e das relações de poder na produção e reprodução do conhecimento e das práticas coloniais. O problema de pesquisa recai sobre o aprisionamento do conhecimento científico no centro-hegemônico, cujo reflexo, no Direito Internacional dos Direitos Humanos, redunda na dificuldade de acesso das vítimas de violações de direitos humanos aos tribunais internacionais. As técnicas de pesquisa utilizadas são a pesquisa bibliográfica transdisciplinar e a pesquisa documental focada no estudo comparativo das instituições de promoção dos direitos humanos em diversas constituições dos países da América Latina. A metodologia de pesquisa é a hipotético-dedutiva e, a partir de uma análise crítica da epistemologia tradicional e dos direitos humanos na região latino-americana, questiona novos mecanismos de garantia de acesso à justiça no Sistema Interamericano de Direitos Humanos. El problema de la investigación radica en el encarcelamiento del conocimiento científico en el centro hegemónico cuya reflexión, en el Derecho Internacional de los Derechos Humanos, resulta en la dificultad de acceso para las víctimas de violaciones de los derechos humanos. tribunales internacionales Las técnicas de investigación utilizadas son la investigación bibliográfica transdisciplinaria y la investigación documental centrada en el estudio comparativo de instituciones para la promoción de los derechos humanos en diversas constituciones de países latinoamericanos. The theoretical basis is structured in the field of an epistemology of the South that analyzes the relevance of the cultural context and the power relations in the production and reproduction of knowledge and colonial practices. The research problem lies in the imprisonment of scientific knowledge in the hegemonic center whose reflection, in International Human Rights Law, results in the difficulty of access for victims of human rights violations at the international courts. The research techniques used are transdisciplinary bibliographic research and documentary research focused on the comparative study of institutions for the promotion of human rights in different constitutions of Latin American countries. The research methodology is hypothetical-deductive and, based on a critical analysis of traditional epistemology and human rights in the Latin American region, it questions new mechanisms to guarantee access to justice in the Inter-American Human Rights System. Perkembangan hukum Islam yang mencapai kemuncak kegemilangan pada zaman kerajaan Abasiyyah telah menarik perhatian sarjana Barat dalam menghasilkan pelbagai kajian dan teori terhadap Zaman Keemasan hukum Islam atau The Golden Age of Islamic Jurisprudence. Penglibatan Ignaz Goldziher, Joseph Schacht, David Powers dan Wael Hallaq telah menghasilkan pelbagai kajian terhadap perkembangan usul fiqh dan sebahagian daripada karya mereka telah mendapat pengiktirafan daripada sarjana Barat sebagai The Sacred Book of Islamic Law, dan The Father of Islamic Studies. Teori Evolutionism merupakan rumusan pemahaman Barat yang merupakan garapan pemahaman umum orientalis Barat terhadap Zaman Kegemilangan hukum Islam yang didakwa terhasil akibat wujudnya elemen asing (Foreign Elements). Artikel ini dihasilkan untuk menganalisis karya penulisan Goldziher, Joseph Schacht, Wael Hallaq dan beberapa pandangan daripada orientalis kontemporari dalam menilai variasi pandangan mereka terhadap perkembangan hukum Islam yang didakwa berasaskan dogma daripada Barat. Kajian ini berasaskan kajian kualitatif dan penganalisisan data menggunakan metodologi historis dan komparatif. Hasil penganalisisan dapat dirumuskan bahawa dakwaan Goldziher dan Schacht terhadap epistemologi usul fiqh yang berasaskan dogma Barat adalah tidak tepat dan ia menafikan Teori Evolutionism dan teori The Legal Transplant yang telah diperkenalkan oleh orientalis Barat terhadap epistemologi usul fiqh. The development of Islamic Law during the Abbasid period, known as The Golden Age of Islamic Jurisprudence has attracted the attention of western scholars and their contribution in Islamic Law. Many books and articles on usul fiqh written by Ignaz Goldziher, Joseph Schacht, David Powers, and Wael Hallaq were acknowledged by the Westerners and some of their contributions were known as The Sacred Book of Islamic Law and The Father of Islamic Studies. The Theory of Evolutionism was a stigmatism of Orientalists writing on the zenith of Islamic law during the third century, which derived from foreign elements. This article is to analyze the writing of Goldziher, Joseph Schacht, Wael Hallaq, and other Orientalists on their assumption of western dogma in Islamic Jurisprudence. This study used qualitative, historic, and comparative methodologies. The findings verified the invalidation in Schacht and Goldziher allegation on the foreign elements in usul fiqh. Thus, the Legal Transplant and the Theory of Evolutionism evolved by the Westerners in the methodology of usul fiqh are rejected.

Resumen

This study aims to compare the teaching of the philosophy of law in Universities in Indonesia. The approach used in this article is a comparative study. The results of this study indicate that in general the teaching of legal philosophy in Indonesia is dominated by the content of the European-Western legal philosophy. This study also finds that the schools of Islamic legal philosophy comprehensively discuss aspects of ontology, epistemology, legal sources and methodologies, and legal axiology through various themes that are also studied by Western European legal philosophy without separating but placing them in certain parts. In this regard, it is necessary to add a school of Islamic legal philosophy as part of the disciplines taught by law faculties in Indonesia, especially to treat equally between the Faculty of Islamic Law and the Faculty of Western Philosophy of Law, moreover, Islamic Law is part of the Indonesian legal system.Keywords: Law, School, Teaching, University, Philosophy

Resumen

In order to best understand judicial decisions following evidentiary findings supported by testimony, it is necessary to start with two questions: In the case of an acquittal verdict, why was the defendant acquitted? In the case of a guilty verdict, how should the defendant be punished? The first prejudice lies in this. The witness, who is aware that his or her word may affect these two outcomes, is in turn judged without bias by the assessors. The second prejudice stems from the function of punishment: to educate by punishing, or by infringing the rights of all does not conform to the canons of social reintegration of the possible convict. This contribution, therefore, aims to find the scientific degree of moral certainty that is based on the use of rational methods of research and evaluation of evidence, oriented towards the discovery of the truthfulness of the incisive facts of the case. La réception de l’œuvre de Ronald Dworkin en France constitue un objet énigmatique à plusieurs égards. Son étude suppose non seulement de dépasser les contraintes générales inhérentes à la réception transnationale d’une pensée, que les contraintes spécifiques, emportées par l’œuvre dworkinienne elle-même. Nous nous proposons de surmonter ces contraintes à l’aide d’une enquête méthodologique permettant de mettre en évidence le caractère relatif des concepts juridiques, et plus particulièrement des concepts d’œuvre et de réception. Ce préalable nous conduira à analyser pragmatiquement les phénomènes de réception de l’œuvre de Ronald Dworkin afin de montrer en quoi l’œuvre et la réception s’influencent réciproquement. Une telle analyse, entendue statiquement, permettra de classer la réception, suivant ses formes ou son contenu ; alors que, comprise dynamiquement, elle mettra en lumière les effets des discours de réception, sur l’œuvre dworkinienne elle-même, mais également sur son auditoire
The reception of Ronald Dworkin’s work in France is a complex issue. Several methodological questions arise before conducting its study. First, I point out the challenge offered by the difference between two intellectual and legal cultures. Then, I emphasize the particular concerns involved by Dworkin’s own theory. These preliminaries lead us to a pragmatic analysis of the reception of Dworkin’s work, eager to show the deep encroachments between the author’s work and its reception. On one side, such a method will enable to classify the reception, in accordance with, respectively, its form and its content. On the other side, it will bring to light the impacts of the reception on Ronald Dworkin’s work as well as on its audience

Cette thèse propose une réévaluation des modèles traditionnels de justice constitutionnelle par le biais d'une approche comparative et empirique. La distinction classique entre les modèles américain et européen, confrontée à la diversité croissante des systèmes de justice constitutionnelle dans le monde, révèle d'importantes limites conceptuelles. Pour dépasser ces frontières, deux orientations analytiques émergent : l'une visant à élaborer de nouveaux modèles théoriques basés sur des critères renouvelés, et l'autre visant à développer des outils d'analyse novateurs, mieux adaptés à la complexité actuelle. C'est cette seconde approche, moins explorée, qui constitue le coeur de ce travail. À partir d'une analyse empirique des systèmes de justice constitutionnelle à l'échelle mondiale, en utilisant la méthode des analyses de correspondances, un outil d'analyse multidimensionnelle a été conçu. Cet outil permet de représenter la diversité des systèmes juridiques dans une perspective fluide et évolutive, en prenant en compte les variations contextuelles ainsi que les interactions multiples influençant le contentieux constitutionnel. Plutôt que de classer les systèmes selon des critères rigides, il les positionne dans une dynamique ouverte, reflétant la complexité de leurs interactions. L'objectif central est de mieux comprendre le rôle du juge constitutionnel, en analysant son intervention au regard des normes de référence du contrôle de constitutionnalité, des modalités d'accès à la justice et des compétences des Cours constitutionnelles. En adoptant une méthodologie empirique et multidimensionnelle, ce travail transcende les cadres traditionnels pour embrasser la complexité et la multiplicité des réalités juridiques contemporaines tout en créant un outil didactique
This thesis proposes a reassessment of traditional models of constitutional justice through a comparative and empirical approach. The classical distinction between the American and European models, when confronted with the growing diversity of constitutional justice systems worldwide, reveals significant conceptual limitations. To address these challenges, two analytical pathways emerge: one aimed at developing new theoretical models based on revised criteria, and the other focused on creating innovative analytical tools better suited to contemporary complexities. It is this latter, less explored approach that forms the core of this work. Drawing on an empirical analysis of constitutional justice systems globally, and employing correspondence analysis methods, a multidimensional analytical tool has been developed. This tool allows for the representation of the diversity of legal systems in a fluid and evolving framework, accounting for contextual variations and the multiple interactions influencing constitutional litigation. Rather than classifying systems according to fixed criteria, it positions them within an open dynamic, reflecting the complexity of their interactions. The central objective is to better understand the role of the constitutional judge by examining their participation in the decision-making process, with a focus on constitutional review standards, access to justice, and the competencies of Constitutional Courts. By adopting an empirical and multidimensional methodology, this work seeks to transcend traditional frameworks in order to embrace the complexity and multiplicity of contemporary legal realities while creating a didactic tool

This thesis is a genealogical inquiry into law’s conditions of possibility for political critique as/and resistance. Questioning law’s claim to normativity, it argues that law is a performative discourse that generates and presents its normative materiality through performative iterations. From the constitution of sovereignty to the formation of the legal subject; from the rituals of legislation to ceremonials of adjudication, there is a performative logic that contingently conditions law’s generation of the normative reality of the present. Arguing that law’s normative representation and expression of sovereignty, the subject, and politics closes the possibility for change and becoming; contesting law’s claims to rationality, objectivity, neutrality, autonomy, and universality; it puts forth a performative epistemology of law that is attentive to power and discourse; and to the production of knowledge’ and the ‘generation of truth.’ Calling attention to law’s entanglement with power and the violence of exclusion and domination; it brings historical inquiry into the orbit of law and legality. The thesis presents the political trial both as: (1) a moment that subverts law’s normative claims to rationality, autonomy and value-neutrality; and (2) as a power-knowledge formation capable of accommodating fresh articulations of hegemonic norms. Drawing on Foucault’s conceptions of power and resistance, I will offer strategies and tactics that: (1) formulate and circulate strategic knowledge of power in law; and (2) open up new sites of struggle for what I call a performative-genealogical intervention.

this article analyzes the causal element of torts from the perspective of comparative law, focusing on the field of tort liability. Thus, it specifies both the particular aspects of the investigation as well as each legal system studied. then, the article discusses the differences and similarities of each system. Later, it stops on the dominant approaches examining its success on facing the tort phenomenon in order to highlight the essential characteristics that determine the various approaches tort liability can assume.
El presente artículo analiza el elemento causal de la responsabilidad civil desde una perspectiva de derecho comparado, haciendo énfasis sobre el campo de la responsabilidad aquiliana. Así, precisando tanto los aspectos particulares de la propia investigación como de cada Ordenamiento Jurídico estudiado, el artículo aborda las diferencias y similitudes de cada Ordenamiento. De esta forma, se detiene sobre los enfoques dominantes examinando la capacidad de los mismos. Ello con la finalidad de evidenciar las características esenciales que determinan los diversos alcances que puede asumir la responsabilidad aquiliana.

In this thesis I searched for an Underground Man in Nietzsche and Marx. My search depends on an epistemological ascertainment. Kant&rsquo
s argument that the human mind cannot achieve knowledge of the thing-in-itself lies in the background of my thesis. I think that this argument is connected with the origins of modern philosophy. My thesis is concentrated on the 19th century. I perceived that with Kant&rsquo
s argument the fact that we can know this world within a subjective framework is emphasized especially in this century. The emphasis on a subjective framework is grounded on Kant&rsquo
s philosophy. This emphasis has a significant role in the epistemological arguments of Nietzsche and Marx. They also insist on the role of subjective contribution in knowledge. However their attitude towards epistemology is different from Kantian philosophy in that they emphasize social, historical and economical conditions. Thus, I call attention to the fact that they transpose epistemology into a social and historical context. My conception of the Underground Man is born in this social context. My thesis aims at making room for an analysis of the Underground Man who is conceived in opposition to the Kantian understanding of the subject, in the context of are Nietzsche&rsquo
s and Marx&rsquo
s social and epistemological analyses.

This thesis explores the epistemology and theology of a Sufi theorist Ibn al-ʿArabī (d. 1240) and one of the most controversial Muslim scholars Ibn Taymiyya (d. 1328) comparatively. Although scholars have long emphasized the differences between these two influential and significant figures, the purpose of this thesis is to focus on their potential similarities. The present work at the outset shows that both Ibn al-ʿArabī and Ibn Taymiyya regard revelation, the human intellect, and inspiration – unveiling (ilhām – kashf) to be the main epistemological means for acquiring religious knowledge. However, they differ over the relative value of these means or tools. Both Ibn al-ʿArabī and Ibn Taymiyya place revelation at the top of the hierarchy, but after that Ibn al-ʿArabī places inspiration – unveiling ahead of reason while Ibn Taymiyya reverses the order. The other main subject elaborated in this thesis is the theological issue of the divine names and attributes. This subject is connected to many other theological problems, and both Ibn al-ʿArabī and Ibn Taymiyya pay considerable attention to it. Just as many similar approaches, ideas, and interpretations may be seen concerning their epistemological stances, it is possible to see similarities in their theological positions although there are crucial distinctions as well. The unique way of finding out this similarity is to keep in mind the existence of the duality found in the thought and expression of Ibn al-ʿArabī. Briefly, the main finding of the thesis is that Ibn al-ʿArabī and Ibn Taymiyya are more similar in their epistemologies and theologies than many scholars have thought. They are benefitting from the same epistemological means while putting them in different order. Also, they share similar theological points concerning the divine names and attributes, creation, the divine will, and the incomparability of God while expressing them through different conceptions and styles.

Resumen

Women�s inheritance rights in biblical and European contexts are complex topics that have been extensively studied by scholars in various fields such as history, theology, and social studies. In both contexts, women�s inheritance rights were influenced by cultural norms, religious beliefs and legal systems. Biblically, women�s inheritance rights are emphasized in the Old Testament, especially in the laws of Moses found in books such as Deuteronomy and Numbers. These laws provide clear guidelines for the distribution of property among family members, including daughters. However, interpretations of these laws vary between different religious traditions and academic perspectives. In Europe, the influence of Roman law and the feudal system reinforced patriarchal approaches to inheritance, with significant variations between common law and civil law traditions. Early common law systems severely limited women�s rights, but later reforms led to increased recognition of these rights. [1] Comparative study of women�s inheritance rights in biblical and European contexts provides valuable insights into the historical treatment of women as owners and inheritors of property.

Resumen

This text is the result of a comparative research on local government in Brazil and Switzerland, with emphasis on the themes of creation and merger of municipalities and inter-municipal cooperation. The first chapter contains a theoretical study on the relationship between local government and federalism, as well as a brief analysis of the constitutional profile of municipalities in various countries. In the second and third chapters are explained profiles of municipalities respectively in Brazil and Switzerland. In the fourth chapter a comparison is made between these profiles, especially in the chosen subjects (merger and inter-municipal cooperation). In the conclusion, taking the precautions needed in any study of comparative law, are exposed some ideas for improvement of local government in both countries.

This paper examines the state of minority rights in Uzbekistan, focusing on three significant ethnic groups: Tajiks, Russians, and Koreans. It explores the historical context of these minorities, the cultural and linguistic challenges they face, socioeconomic issues, and their political representation. Under the authoritarian rule of Islam Karimov, Uzbekistan emphasized a unified Uzbek identity, often marginalizing minority cultures and languages. Despite President Shavkat Mirziyoyev’s reforms aimed at improving human rights, including the establishment of a Human Rights Ombudsman and the Development Strategy for 2017-2021, significant challenges remain. Legislative initiatives such as the draft Law on the Protection of the Rights and Interests of National Minorities and efforts to enhance cultural policies have had mixed success. This analysis highlights the need for comprehensive measures to ensure robust legal protections, equitable resource allocation, and genuine political inclusion for all ethnic minorities in Uzbekistan. The international community’s role in advocating for these rights is also discussed, emphasizing the gap between policy and practice in protecting minority rights in Uzbekistan.

Taxpayers sometimes engage in complex transactions with uncertain tax treatment, such as mergers, acquisitions, demergers and spin-offs. With the rise of global value chains and proliferation of multinational corporations, these transactions increasingly involve transnational financial arrangements and cross-border dealings, making tax treatment even more uncertain. If improperly structured, such transactions could have costly tax consequences. One approach to dealing with this uncertainty is to create a private rulings regime, whereby a taxpayer applies for a private ruling by submitting a statement detailing the transaction (proposed or completed) to the tax authority. The tax authority interprets and applies the tax laws to the requesting taxpayer’s specific set of facts in a written private ruling. The private ruling offers taxpayers certainty as to how the tax authority views the transaction, and the tax treatment the taxpayer can expect based on the specific facts presented. Private rulings are a common feature of many tax systems around the world, and their main goal is to promote tax certainty and increase investor confidence in the tax system. This is especially important in a developing country like Uganda, whose tax laws are often amended and may not anticipate emerging transnational tax issues. Private rulings in Uganda may be applied for in writing prior to or after engaging in the transaction. The Tax Procedures Code Act (TPCA), which provides for private rulings, requires applicants to make a full and true disclosure of the transaction before a private ruling may be issued. This paper evaluates the Ugandan private rulings regime, offering a comparative perspective by highlighting similarities and contrasts between the Ugandan regime and that of other jurisdictions, including the United States, Australia, South Africa and Kenya. The Ugandan private rulings regime has a number of strengths. It is not just an administrative measure as in some jurisdictions, but is based on statute. Rulings are issued from a central office – instead of different district offices, which may result in conflicting rulings. Rather than an elaborate appeals process, the private ruling is only binding on the URA and not on the taxpayer, so a dissatisfied taxpayer can simply ignore the ruling. The URA team that handles private rulings has diverse professional backgrounds, which allows for a better understanding of applications. There are, however, a number of limitations of the Ugandan private rulings system. The procedure of revocation of a private ruling is uncertain. Private rulings are not published, which makes them a form of ‘secret law’. There is no fee for private rulings, which contributes to a delay in the process of issuing one. There is understaffing in the unit that handles private rulings. Finally, there remains a very high risk of bias against the taxpayer because the unit is answerable to a Commissioner whose chief mandate is collection of revenue. A reform of the private rulings regime is therefore necessary, and this would include clarifying the circumstances under which revocation may occur, introducing an application fee, increasing the staffing of the unit responsible, and placing the unit under a Commissioner who does not have a collection mandate. While the private rulings regime in Uganda has shortcomings, it remains an essential tool in supporting investor confidence in the tax regime.

Resumen

The Brazilian continental dimensions and diversified natural resources are proportional to the challenges to develop its infrastructure sustainably and supply proper public services to more than 200 million inhabitants. Energy consumption has doubled since 1990, fostered by economic growth and the expansion of middle class. In this context, promote energy efficiency, in a broad sense, is urgent and rational. Brazil has a relatively long history in promoting energy efficiency at final user level. A landmark of this process is the Brazilian Labeling Program, launched in 1984, as direct consequence of high prices of energy at that time. This program was coordinated by the National Institute of Metrology, Standardization and Industrial Quality, which sets standards for evaluation, ranks the performance of energy equipment and imposes a classificatory labeling to inform consumers, with a label similar to other countries. The National Electricity Conservation Program was created in 1985 by MME and is executed by ELETROBRÁS. The energy saving induced by this program in 2013 is equivalent to 2.1% of the total electric energy consumption in the period, corresponding to the annual energy consumption of about 5 million Brazilian households. In 2001, Federal Law 10,295, also known as the Energy Efficiency Law, was approved to reinforce those energy efficiency programs, allowing the Brazilian government to establish Minimum Energy Performance Standards for appliances and energy equipment, prohibiting the commercialization of low efficiency models and promoting the progressive withdrawal of low-efficiency models. According to the National Energy Plan 2030, up to 15.5 GW of electricity generation could be saved as a result of energy efficiency in the next 20 years. The Smart Grids, adopting modern technologies in electricity distribution has been proposed in Brazil improve the quality provided in the low voltage service, reduce losses, and reduce operating costs, among others. Several regulations related to this subject, dealing with grid connection for distributed small-scale generation, the establishment of the 'hourly tariff', with the regulation of the use of PLC; and with the compulsory use of Geographic Information System. Currently, dozens pilot projects on Smart Grids are underway in the country. Two projects are presented in detail: CEMIG and AES Eletropaulo, two Brazilian power utilities.

Resumen

This peer-reviewed research and policy paper draws on analysis of how women influence decision making in Indonesia's multi-level governance structure under the new Village Law in Indonesia. The analysis identifies the ways that women, through different causal processes, influence development priorities, spending, projects, policies and policy actors, as well as social norms in communities. The analysis draws from a large, qualitative comparative study conducted in different places throughout Indonesia, providing an analytical framework for understanding variation in social and politico-economic contexts in terms of the constraints and opportunities for gender inclusion and women's empowerment. The research also explains variations in the processes by which women exercise voice and influence in these differing contexts, providing considerations for policy makers and others concerned with gender inclusion, women's empowerment and everyday wellbeing.
