Texto completoPersonnel policy in the public service and in public firms has noticeably developed; the differences between the state as an employer as opposed to the private sector have become less pronounced. By and large, unilateral decisions by the state in the general interest have given way to relations marked by more give and take. Even in the public service, authorities can no longer set up or lead personnel policy without at least referring to the personnel. As personnel policy is marked by strong conflicts of interests, it tends to be relatively independent from external objectives set by the state. The bureaucratic system, which still largely prevails in the public sector, has lost its original meaning: the system is bureaucratic because of the formal aspect of the organization; the system is no longer the sign that the personnel is considered as an instrument but that they defend themselves concerning the employer. Thus the state has seen its sphere of activity being reduced, because it is obligated to abide by the rules it edicted itself, in agreement with the personnel

Texto completoWhat does the power to organise the public service consist in ? Is it actually a power to implement regulations characterised by that very purpose ? The study deals with three main elements. First of all, we will show that the source of this power can be found in the Fifth Republic Constitution (art. 20 and 72, for national and local public services). Then, it can be shown that the administrative authorities which are able to organise public services are the ones which have the power to implement regulations, although the Parliament can also pass laws dedicated to public services. Finally, we will examine the practical methods of implementing regulations to organise public services. On the one hand, it proves that the authorities which organise public services issue normalising unilateral and contractual decisions of impersonal and general scope, that is to say real regulations. On the other hand, it appears that the degree of freedom to implement these regulations is determined by the principles that usually rules public services and also by the laws concerning trade and consumer's protection

At last, afp is not only the main french news agency and a key institution french press regime, it is also one of the three world news agencies providing news to the mediasall over the world and ensuring the international free flow of information. But if afp constitution helped the news agency to live since 1957, it does not appear anymore so efficient to meet the international competition in a world where medias and telecom are widely deregulated. Through methodology of law, economy, history and sociology, this research tries to identify conditions and limits of the independance of afp as well as strengths and weaknesses of the company and to precise its ability to elaborate and develop a strategy for the future

Texto completoPublic enterprises appeared in France and Niger to support the economic activities of the state, and their primary purpose was to expand and consolidate the public sector. They materialized the action of a commercial State. For this reason, they have always benefited from a special regime, which has resulted in the protection of their assets. Over time, their activities have evolved. The maintenance of privileges for structures that are increasingly similar to private market actors has led to a condemnation of the legitimacy of this protection. Criticism of the protection regimes for public enterprises has gradually turned into a questioning of the existence of public enterprises. However, even if the question of the disappearance of these structures has arisen, they must be maintained in the legal and economic landscape, because of the missions they accomplish. For this to happen, their protection regimes must evolve. They seem to be in discordance with the current era. The present research considers these different elements in order to propose a new protection regime for public enterprises. Indeed, the evolution of the protection will depend, in part, on the sustainability of public enterprises

Texto completoPublic-Private Partnership is a tool for modernization and renewal of public intervention, its main goal is to achieve very high levels of performance. This doctoral work is therefore in the context of public management that focuses on studying the impact of public-private modes of governance on the technical efficiency of ski lifts. To answer our questions, an empirical study was conducted among 68 ski lift companies over five years (2006-2010). These data have been processed using a quantitative confirmatory study using a statistical model. To test the validity of the two models proposed by the literature, a quantitative research has been conducted. The first stochastic frontier model consists of three variables (capital productivity, labor productivity and power momentum), and three control variables (size, altitude and staff) and a dependent variable (the skier day). The second model of technical inefficiency consists of two explanatory variables (“time and materials » and SEM) and an explanatory variable (technical inefficiency). The results of this research outline, among other things, the importance of modes of governance (“time and materials » or SEM) in the process of increasing the technical efficiency of ski lifts. The second empirical study (2011-2013) which approaches the competitiveness of the French winter sports resorts by the measure of the productivity of the operators of ski lifts. By means of the indication of productivity of Malmquist and its two constituents, we look to arrest the changes of productivity then, this productivity is decomposed into two elements. Texto completoIn 1957, the State is the organiser of the public postal service in France through its central administration. That same year, a treaty was signed in Rome between six European States around the idea of a common market with a delegation of sovereignty. At first, the public postal service and the Europe of the Treaty of Rome develop separately. But in the early 1980s, the political, economic and technological context evolves and Europe decides to take an active interest in the matter of the postal service. After a phase of disinterest in postal matters, we enter in a phase of confrontation; Europe submits the postal service to the competition law: monopoly, the traditional organisation of the postal service, is challenged. Moreover, the French public postal service is transformed: La Poste, independent public operator is born. Following the period of confrontation, a period of dialogue follows, bringing together the Europe of the Treaty of Rome and the States members to write the postal law. Several guidelines are adopted, focused in particular on the universal postal service. By 2012, the process of liberalisation of the postal service is complete: there is no legal monopoly in Europe. This new openness is concomitant with the digital era. The postal service must now continue to adapt to this new ideological, technological and economical context: in its form – La Poste becomes a public limited company – as well as in its mission to serve the public interest, the raison d’être of the public service, so the public postal service is reconfigured

Texto completoAs a representation of the undertaking in the form of a publicly owned establishment, the French publicly owned industrial and commercial establishment disappoints, to such an extent that the question of its durability arises openly. Under its banner, undertaking in the form of a publicly owned establishment undergoes two kinds of assaults. First, the use of the publicly owned industrial and commercial establishment for the sake of administrative activities management convenience was a decisive blow to its undertaking identity. Moreover, the heaviness of its legal status questions its legitimacy to serve as a support for an economic activity. Second, if competition law has so far merely neutralized its statutory benefits, it now seems to be simply excluding it from the market. In fact, it considers that with its legal status goes an implied guarantee, which it regards as prohibited State aid. The thesis then takes advantage of the decay of the publicly owned industrial and commercial establishment to suggest a new model of undertaking in the form of a publicly owned establishment: the merchant publicly owned establishment. On the one hand its very existence is justified by the difficulties of the model of the commercial society to stand in for the public establishment as much as by the potentialities offered by the latter in terms of competition for the market. On the other hand, the coming of the publicly owned merchant establishment presupposes a cultural revolution in the way in which administrative law contemplates the economic intervention of public persons. It is essential to suggest a regime of the merchant publicly owned establishment worthy of its vocation as a market and, at the same time, in conformity with European Union law

Since the 1980's, edf has had a strong productivity policy and now is about to enter a freed european energy sector. In france, the context of high unemployment has focused on the concept of local development. Through this concept, the local population attempts to develop its identity by building and sharing projects. The french government has asked edf to contribute to local economic development and to also show social care in areas of bad economic structure. Beyond its public-owned status, edf also wants to act as a commercial company, saying that growing local economies could enhance its own business. However, edf involvement was very selective and frequently revealed commercial goals. Facing some difficult local situations, edf has sometimes used its economic development policy to get an simpler development at local level. Instead of benefiting from the communities projects, edf focused on its own development. Finally edf talked as a public-owned company and frequently acted as a private-owned company. Thus, edf regularly surprised and sometimes irritated the local political environment. The us energy utilities have officially combined their local development policy with their own development and have had a very commercial attitude. Gaz de france, the french public-owned gas utility, also considers that its role in this economic development is part of its core business. At last the vivendi group asked its own foundation for support in some local job creation. These examples have used both their industrial and cultural identity in building a suitable policy concerning local involvement. Finally, edf should officially connect its local economic development policy to its core business. Through a more receptive local organization, edf could develop its important human resources and then would consider that its employees are the best contact between company and local environment

Texto completoBased on a material composed of archives, specialized books, grey literature and interviews, this thesis explores the transformations of the process of making and thinking the railway economy in France. Our socio-historical analysis reveals the rearrangements of the rail policy and the evolution of the company’s management strategy in the medium and the long term. While during the 1820’s-1830’s the growth of railways is left to the discretion of private entrepreneurs, starting from the mid-19th century the state controls the sector, financing the expanding of the network and strongly shaping large regional monopolies. The nationalisation of the French railways in 1938 and the transport planning policy after World War II represent the climax of the state control. The last half-century challenges the traditional definition of public service in the sector and gives rise to a more market-oriented regulation, symbolised by the opening to competition of the railway market and the new trade policy of the state-owned company SNCF. Changes in the sector are driven by the transformation of mindsets and practices within the “state field”, the balance of power in the rail companies, as well as the material properties and benefits of railways as compared to other existing means of transport. These three dimensions altogether define the space for possible and probable of the rail economy

It analyses how output and resource allocation methods are affected by exposure to competition. The particular model traditionnally used is one of administered resource allocation usually based on a single product model produced and offers in quantity, with a context which is specific to the principle of service public in he framework of a monopoly. La the telecommunication field both the scale and variety of product is extensive as is rapid technological change permanent allow which added to the exposure to competition presents a need for a new growth model based on variety and adaptability which raises +tensions ; reflecting the merging of the need for managing the complexity of the new with the durability of the elements of the old model. The + administered ; model of resource allocation is contrasted with the new model of output allowing the identification of the critical dysfonctional aspects of the old model. The response is to decentralize and subcontract. These two concepts are analysed theorically to show that their termes of reference are varied which then need the resulting complex of new realities to be addressed. Analyses of types decentralization and subcontracting which establish the distinction between hierarchical decentralization and participative decentralization are undertaken. When cross referenced with the typologies of different contractual forms which have also been developed the two analysed features taken together allow for a more lucid examination of the difficulties of putting the new resource allocation methods into operation

Texto completoThe first part of the dissertation addresses questions related to the procurement decisions of private and public organizations. In particular it focuses on how the anticipation of renegotiating the contractual terms during the execution of a procurement contract affects the initial arrangements between the parties. Renegotiation may involve the design itself of the goods which are procured, and not just their price or the time of their delivery. A plausible explanation for its pervasiveness is the existence of transaction costs which prevents contracts from being complete. This is especially true for more sophisticated and customized goods, such as new infrastructures or cars' and aircrafts' parts or components. Ex-post these goods may fail to fit the buyer's specific needs and/or may exhibit flaws unforeseen at the planning stage.
In the first two chapters, I show that the anticipation of ex-post adaptations has critical implications for many procurement choices, such as that of the contractual agreement, the award mechanism, and the delegation of the design task to the suppliers. Therefore, a proper inclusion of design failures into the analysis of procurement contracts can help broaden our understanding of the wide variety of procurement modes and outcomes observed in the real world. My analysis offers an explanation for the procurement practices adopted in complex manufacturing and construction industries. Moreover, it can provide useful guidance for public procurement. Governments face tight restrictions in their choices of the procurement modes and for this reason they should carefully evaluate whether or not to adopt the best practices of the private sector.
The second part of the dissertation concerns the optimal design of an organization. In many organizations the task of evaluating an agent's performance is delegated to a third party, a supervisor, who can opportunistically misreport information. The question of how the provision of incentives in hierarchies is affected by the supervisor's opportunism is of great importance since it can improve our understanding of the internal organization of firms and can have broad applications to regulatory design.
The third chapter of the thesis, co-authored with Luca Livio (ECARES, FNRS), contributes to this line of research by studying the optimal task a supervisor should be charged with in the presence of corruption concerns. We highlight the existence of a trade-off between monitoring the agent's effort choice and auditing it ex-post, which arises when the two faces of corruption, collusion and extortion, are present.

Texto completoBecause of the extraordinary means to which the public sector has access, public competitors often occupy a stronghold on the market. This privileged increases the risk of anticompetitive practices being adopted by public actors and therefore obliges the public and juridical authorities in charge of market competition to keep a particularly keen watch on this sector's activities. In this context, the abuse of a dominant position, as defined in article 102 of the TFUE, is a central issue. Far from overlooking the specificity of the public sector, the European Law on the abuse of a dominant position constitutes a model, which deserves to be upheld. The scope of this model, which is know to be particularly broad, includes the case of public actors, which is explicitly addressed in article 106 of the TFUE. Public competitors easily meet the criteria defining those in a market power, and the rules on abuse of a dominant position enable the authorities to control these players' market activities extremely closely. The regulatory approach adopted in the European model for competition can be explained in terms of the ordo-liberal intellectual background. It is in the public sector that this model has been expressed most effectively. However, article 102 of the TFUE has not been spared by the wave of modernisation which has pervaded competition law. The theoretical concepts underlying these widely used regulatory tools, which have been criticized for being too strict and too rigid, are being completely revised. National authorities and the European Commission, inspired by the latest economic analyses, are now tending to judge the anti-competitive behaviour of the most powerful firms in terms of its concrete effects on the market. Consumer welfare is becoming the ultimate goal. However, the European Court of Justice still maintains its traditional approach to preventing the misuse of competitive power: it supports a legal system designed to protect competitive structures. This model is still highly relevant when it comes to examine the public sector conducts. Since its premises are sufficiently flexible to be able to support both public privileges and general welfare, this model seems to provide an efficient means of regulating competition in the public sector

Texto completoThe French telecommunications sector, previously part of the postal administration (Ministère des PTT), has been within the State reform framework in France, detached from the department by the July 2 1990 law, which would eventually lead to its privatization.Reducing public expenditure was the main point of the reform, the burden of which was mainly borne by the staff. As tenured civil servants, they were employed under an integrated statutory law, a position that had been guaranteed, and forbade direct layoffs. But the tenures were gradually replaced by fixed-term contracts, using a blurred pattern of ranks ; and management by the raking over company, France-Télécom/Orange, was soon notorious for its various and at times lifeendangering forms of workplace violence, aimed at enticing voluntary resignation. The harassing management targeted, and is still targeting, mainly those employees who had mainly voiced their attachment to the public service. The reform had more goals, such as creating an open market, improving and enlarging public telecommunications service. Were these actually- fulfilled ? One may doubt. Modernization and enlarging of services, and integration of technological advances did rake place. But despite the fact that there were now many network operators, the market remained only partly open. Companies benefited, but nor the public, as rates did not drop as much as expected . As for the availability of the telecommunications public service, one may wonder to what extent its main features - notably equality of all users - survived, as the traditional fixed line communications system is currently being replaced by dematerialized networks, a process that eventually broadens the gap of social exclusion. Reform in French telecoms sector testifies to the general decline of the state's role in French economy and Society , and to the gradual compliance of the country to European standards. One can question the management of the process. Laws, decrees and regulations have been unclear and blurred ; and jurisdictional authorities have been using them in a most elastic way. This leads by the way to questioning the place and legitimacy of a specifically French institution, the “justice administrative”, and to wonder at the evolution of the legal system in France, in this case surprisingly “pliable”

Texto completoInitially, Public Law was the law applicable to the State, organic or subjective criterion of Public Law. Later, within the postmodern era, the Public Law will not be the only law capable of regulating the State, and the State will not be regulated totally by the Public Law neither. This is because public space will be taken by the Common Law. Therefore, the criterion for the application of Public Law had to be replaced by one material that took care of the developed activity. The main reason for that change is the strategic turn of state intervention in the economy, concretely to render public services. The fiscal crisis of the Welfare State in the 80s will impel transformations and privatizations of public enterprises in order to reduce the fiscal deficits. This displacement of the State causes it to be converted into a regulator instead of an actor of the economy. The Law, like one of the State instruments to regulate the economic actors, will have several challenges in reframing the Public Law in the economy, which must include how to balance its control objective of the State activity with the international exigencies derived from the free competition principle. Being that there exists a bi-directional relation between State and Public Law, a change in these relations will have repercussions in the form in which the State is put under the Law (Rule of Law). This is not only a change of limits in the Law applicable to the postmodern State, but also a challenge that the State of Law must exceed to maintain himself. This situation that exits in the majority of countries that belong to the administrative regime, such as Costa Rica, presents some particularities. To understand these particularities in the Costa Rican case will be the main purpose of this thesis

Texto completoIn order to apply the services that come under their competences, regional authorities are, in principle, free to take the method of administration of their choice and, consequently, to opt either for a direct administration or a delegated one. However, having the desire to entrust the realization of some projects to a third party while keeping the control, regional authorities sometimes plan to use a legal entity in which they are members and that we suggest to be identified under the words “satellite organization”. In this case, regional authorities have to build relationships with the satellite organizations so as they have tools to work and to get projects. These organic, material and functional relationships show, on the one hand, the participation of regional authorities in the satellite organization and, on the other hand, the awarding of projects to the satellite organization. But the legal framework around regional authorities seems to be opposed to the setting up of these relationships and compromising the apparent faculty for the regional authorities to use a method of mixed administration of their services

Texto completo“In-house providing procurements” concern contracts awarded by contracting authorities without application of the procedures laid down in european secondary law. They thus have to be first considered as a derogation, which reveals their stakes but also the way they’ve been shaped. To make sure that it would’nt be used to abuse european law, european institutions have paid special attention to in-house operation’s conditions. In-house contracting parties have to prove the existence of particular conditions relating to the functioning of the contractor and its relations with its holders. Through those characteristics lies the particularity of in-house providing, which can be distinguished from other notions, such as “transparent associations” or “artificial schemes”. This is also a way to affirm in-house procurements’ legitimacy and to make it a real legal construction. This naturally leads to its qualification. Studying its manifestations in french public law makes clear that this construction is not complete. In-house contractor may take many legal forms, which brings to light in-house providing’s flexibility. It also prevents financial and fiscal french law to seize this derogation. In house-contracts can’t therefore be described as a an intermediary governance mode, between outsourcing and internal governance (in-house operations stricto sensu). Nevertheless, in-house providing procurements embody a type of special contracts, “les contrats interorganiques”, which implies particular rules relating to their passation and admits a certain particularity concerning their execution

Texto completoIn a context of contemporary reflections on the sustainability of urban water utilities, we focus on Lyonnaise des Eaux’s corporate social responsibility strategy as a contribution to putting into words and implementing sustainable development in this sector. This work aims at analyzing on the one hand the causes, processes, goals of Lyonnaise des Eaux CSR strategy and understanding on the other hand the impact of these strategies on the company’s territorial embeddedness. CSR's territorial impetus is expressed via a global-local interaction process leading to the regionalization of Lyonnaise des Eaux CSR strategy and, its local embodiment through sustainable development projects. Based on the example of water management in the Bordeaux metropolis, we have studied and conducted two sustainable development projects within the company, one focused on water poverty management and the other focused on sustainable management of domestic water consumption. Exploring the feasibility conditions of these CSR projects highlights the opportunities for the company to meet the challenges of the territory by limiting the impact associated with its business or generate specific resources necessary for its integration into local innovation systems. The territorial approach of corporate responsibility strategy shows that it also appears as a negotiated interface used by Lyonnaise des Eaux for its adaptation and action at different scales

Texto completoIs it “Europe” that ordered the privatisations ? Is it in “Brussels” that the crisis of the “service public à la française” has been played out ? Starting from the political and legal conflicts surrounding the categories of “public undertaking” and “service of general economic interest”, this dissertation illuminates the precarious forms of recognition of a “public economy” at the level of the European Union. Assuming that the failure to bring out a separate status refers to the impossible aggregation of a European network of professionals and knowledge of the public economic sector, it reveals an historical process of “problematisation” of the public economy at European stage. Born as an institutional counter-mobilisation aimed at curbing the risks of European dirigisme, the competitive program first asserts itself in political and doctrinal controversies that place the public sector in a “derogatory” position. It then unfolds on various bureaucratic, judicial, professional and academic fronts that contribute to a principle of equal application of the competitive imperative to all economic agents. The transnational re-mobilisation enterprise, launched in the 1980s and 1990s by the political and professional networks of the public sector, led by Electricté de France, provides a test of the social and institutional anchoring of this new acquis communautaire. Following this historical trajectory, one can grasp the conditions of the stowage of the competitive paradigm to the Common Market and its consequences for the articulation of the public sector with the European project

Texto completoMalgré ces mutations, le droit public économique n’en présente pas moins une structure permanente qui s’articule autour de cinq grandes relations existant entre les institutions juridiques de l’État et de la propriété :1/ l’État dessine les régimes de propriété ;2/ l’État est lui-même propriétaire ;3/ l’État police et régule les usages de le propriété ;4/ l’État soutient selon les circonstances certaines catégories de propriétaires ;5/ l’État redistribue certains fruits et influences tirés de la propriété.
Si la thèse porte essentiellement sur la période qui court de l’Indépendance à la veille de la sixième réforme de l’État, d’une part, et alors que la Belgique connaît une crise des finances privées et publiques enclenchée en 2008, d’autre part, elle offre à la fois une histoire inédite de la législation économique et un examen minutieux des grandes questions contemporaines qui agitent le droit public économique. Elle aborde ces mouvements longs en trois grandes parties (de 1830 à 1919 aux temps du suffrage restreint ;de 1919 à 1980 de l’avènement du suffrage universel à la crise de la fin des Trente Glorieuses ;de 1980 à nos jours, soit depuis l’installation concomitante du fédéralisme et du primat de la concurrence).
S’intéressant au mouvement communal comme au droit colonial, au sauvetage des secteurs jugés systémiques comme à la fondation de grands organismes d’intérêt public, à la régulation comme à la soi-disant subsidiarité fonctionnelle de l’État, la dissertation vérifie l’hypothèse selon laquelle un droit qui a pour objet la politique économique repose sur l’ensemble des cinq grands rapports identifiés que nouent l’État et la propriété. Elle permet ainsi de mieux appréhender ce qu’est la vraie "Constitution économique" de la Belgique, laquelle est loin d’être portée par sa seule Constitution écrite.

Texto completoBetween 2011 and 2022, dematerialization was the subject of numerous communications from public authorities. Becoming the default policy of the New Public Management strategy, it would - according to reformers - simplify work, improve the quality of public service and keep the public expenditure under control. Based on this subject of study, the thesis aims at understanding how public employment services deployed the dematerialization in their administrations and the consequences on labour organization. For this purpose, the thesis is focusing on Pôle Emploi and social services, showing that dematerialization is not just a management tool, but also a key driver for activation policy purposes. Drawing on an ethnographic survey of job counsellors, social workers and unemployed people, the thesis highlights that the dematerialization technology introduction into the workplace/workspace is reconfiguring the labor division between professionals and the unemployed, but also between professional groups working in local agencies. Standing on either side of the counter, we show that workers and the unemployed people free themselves from certain tasks and each make an autonomous use of the rule, initially aimed at making them active in a context of strengthening activation policies. Focusing more specifically on professionals, the thesis demonstrates finally that, despite competing standards of professionalism which structure their conceptions of work, employment counselors and social workers are embracing dematerialization process
