Confidentiality is considered an integral component of medical practise, yet there has been debate within the medical community as to whether there should be exceptions to the obligation to protect patient’s confidences. In the cases involving medical patients with deadly sexually transmittable disease like HIV/AIDS, physicians feel caught between two basic principles – keeping of medical confidentiality and public safety. Bioethicists would favour breaking of confidentiality when the public safety and the life of someone are endangered. However, considering the complexities and discrimination in connection with HIV/AIDS in Nigerian context, many would be tempted to discourage the notification of partners who risk being infected, through the moral obligation of 'duty to warn', but some others would argue that not notifying people of such threat to life would only help in spreading the virus to ignorant partners of an index patient. I argued that there is an overridden utilitarian principle to save others from harm, but some others cite the negative effects the breaking of medical confidentiality would have on the healthcare system as a reason not to favour partner notification. Nevertheless, people would appreciate the value of breaching confidentiality in HIV/AIDS related cases when various forms of discrimination and stigmatisations are criminalised and policies to protect the fundamental rights of people living with HIV/AIDS (PLWHA) are strictly adhered to.

It does this by examining the responsibility of those entities to warn. It considers whether they are likely to be held legally accountable for their acts or omissions when using social media. The thesis also seeks to provide good practice principles for the use of emerging communication technologies.

Jusqu’à ce jour, le conseil patrimonial immobilier n’a pas fait l’objet de travaux particuliers, à notre connaissance, en droit français. Cette thèse est dédiée plus particulièrement à une étude d’ensemble du devoir de conseil en matière immobilière. L’objectif est de démontrer l’indépendance du devoir de conseil, c’est-à-dire de prouver son autonomie en tant que notion juridique. La principale difficulté réside dans sa définition. Traditionnellement qualifié comme un degré plus poussé du devoir d’information et présenté comme différent du devoir de mise en garde, ce devoir se caractérise essentiellement par la qualité exclusive de son débiteur qui doit obligatoirement être un professionnel spécialisé dans un domaine spécifique ayant trait à l’immobilier. Par conséquent, en dehors de cette qualité, un tel devoir de conseil ne se retrouve pas. De prime abord, ce travail est limité à l’opération de vente d’immeuble. A ce titre, le débiteur est tenu d’orienter et de guider son client que ce soit dans le cadre d’un contrat principal de vente d’immeuble, source du devoir de conseil, ou d’un contrat de prestation de service, qui a pour objectif principal la conclusion de la vente d’immeuble. En théorie, la définition de ce devoir de conseil semble être claire et précise. En pratique, toute la difficulté réside dans la détermination de ses frontières qui le distinguent des autres degrés de l’information. Pour mener ces travaux de rechercher, il a été procédé d’abord à une analyse des arrêts de la Cour de cassation qui démontrent les différentes dimensions de ce devoir en fonction de son contenu extensible et de son intensité variable. Cette analyse a mis en évidence la fonction constante du devoir de conseil qui se fortifie en raison de son essence. Ce procédé a permis ensuite de déterminer les critères principaux qui caractérisent ce devoir du professionnel et d’examiner sa portée dans les différentes étapes de la vente d’immeuble. Ce procédé permet de s’interroger sur l’émergence d’une conception autonome du devoir de conseil qui changerait de dimension lorsqu’il porte sur toute la matière immobilière
Until now, as far as I know, no particular work has been carried out on real estate advice in French law. This thesis is intended for in particular to an overall study of the duty of advice in real estate matters. The objective of this thesis is to demonstrate the independence of the duty of advice and to prove its autonomy as a legal concept. The main difficulty lies in its definition. Traditionally referred to as a higher level of information and presented as a different level of warning, which is also considered a level of information. This duty is essentially characterized by the exclusive quality of its debtor who must be a professional specialized in a specific field relating to real estate. Therefore, we cannot speak of such duty apart from this quality. At first sight, this work is limited to the operation of sale of building. As such, the debtor is required to direct and guide his client, whether in the context of a main contract for the sale of property, the source of the duty to advise, or a contract for the provision of services, which has as its main objective the conclusion of a contract for the sale of real estate. In theory, the definition of the duty of advice, in particular that inherent in the sale of real estate, seems to be clear and precise. In practice, all the difficulty lies in determining its boundaries that distinguish it from other degrees of information. To do this research works, it was first proceeded to a preliminary analysis of the judgments of the Court of Cassation, which demonstrates the different dimensions of this duty according to its extensible content and its variable intensity. This analysis has made in evidence the constant function of the duty of advice which can be fortified more and more because of its essence. This process then made it possible to determine the main criteria that characterize this professional’s duty and examine its scope in the different stages of the building sale. This same process allows to wonder about the emergence of an autonomous conception of the duty of advice which may change its dimension when it covers all real estate matters

Higher education has a long-standing relationship with veterans. Under the auspices of federal funding such as the 1862 Morrill Land-Grant Act and the 1944 GI Bill, scores of veterans and active duty personnel have used their educational benefits to earn a college degree. In the 21st century, the 2009 enhancements to the post-9/11 GI Bill amounted to $53 billion in education benefits for servicemembers and their families. In addition, the military is increasing its education plan for servicemembers to include more frequent and more specialized training since the demands of 21 st century warfare requires agile tactical teams to be able to act independently from large troop mobilizations or command centers. Both higher education and the military are increasingly gravitating toward online learning. Therefore, Gulf War II-era student veterans—individuals who served after 9/11—are more likely than any previous student veteran cohort to have undergone extensive military education by the time they return to civilian life and pursue college degrees. Although Gulf War II-era student veterans pursue educational opportunities as much or more than earlier cohorts, they also struggle with transitioning to civilian life.

The purpose of this exploratory, qualitative study was to explore the intersection of military education, postsecondary education, online learning, and transitioning in one context. The overarching research question was: What are the lived experiences of student veterans who have engaged in online learning in two capacities: (a) during active duty within the military education system, and (b) after separation within higher education? The study employed Knowles, Holton, and Swanson’s adult learning theory and Schlossberg’s transitioning theory. The study used a phenomenological approach to examine the lived experiences of Gulf War II-era student veterans who have engaged in online learning while on active duty and after separation. A purposeful sample of 16 student veterans was used, and open-ended interviews were conducted to answer the research questions. Using the Modified Van Kaam method of data analysis proposed by Moustakas (1994), the interview data yielded 14 emergent themes.

The study revealed that participants had different experiences with online learning during their active duty service than they did as civilian student veterans in public colleges and universities. Participants found that the military education system’s online courses were repetitive, but they had clear objectives and structures. Failing online military courses was nearly unheard of and could lead to direct reprisal or loss of life. As civilians, many found online learning to be overwhelming and alienating. College online courses were of better quality but were easier to fail. Participants also reported that online learning was not a direct part of their transitioning experience, but their prior experience with it had provided them basic technological literacy that was useful. The research findings were reflective of transitioning theory but did not fully support adult learning theory. The findings suggest that a deep-rooted military persona or identity is probably developed by active duty military personnel and that such an identity is likely related to a military-specific learning style that does not align to traditional andragogy within higher education (e.g. group versus individual learning). The findings also posit that a new theory should be developed that centers on military learners, their styles and their unique system of postsecondary education.

Large-scale humanitarian crises in foreign countries raise the question of whether or not other countries have a duty to alleviate that suffering. In extreme cases, humanitarian intervention, that is: military intervention for the purpose of alleviating human suffering, is sometimes advocated as the morally required course of action. This thesis suggests that while the international community has a general moral responsibility to prevent and ameliorate humanitarian crises there is no simple duty of military humanitarian intervention. Hitherto, the question has typically been treated as a matter of either moral or legal principle. This thesis argues that empirical factors, which affect the international community's ability to carry out interventions effectively, have not been given their due weight in the debate. On the basis of evaluations of international responses to crises in Somalia and Rwanda, 1992 - 1994, it is suggested that a range of factors undermine the efficacy of humanitarian interventions. These factors include the impact of state interests, the effects of domestic politics in intervening states and, contrary to expectations, the role of humanitarian considerations in decision making on intervention. By showing the limitations of a simplistic view of a duty of humanitarian intervention the thesis seeks to contribute to reconciling idealism with realism in international crisis-responses. Based on sound moral and political judgment military interventions in humanitarian crises would hopefully be less ambitious and ultimately more effective.

This thesis examines and explores twentieth century literary representations of American masculinity at war. It aims to demonstrate the manner in which American novels responding to the First and Second World Wars and the Vietnam conflict reflect symbolic, mythic and material anxieties regarding America‟s masculine identities. The thesis examines in particular the pervasive myth of the American Adam and its influence on behaviours, ideologies and narrative. Each text and each conflict operates under the influence of Adamic myth. I argue that prose fiction offers a space in which to scrutinise, engage and ultimately resist such mythic singularity. The incorporation of gender theory into such a study provides an original critical perspective with which to read crucial artistic responses to major events of the American twentieth century. Its central arguments engage with anxieties existing between ideological representations of hegemonic American masculinity and the graphic truth of experience for the corporeal and psychological subject. As well as thematic aspects of the literature, the thesis analyses shifts in narrative technique and the manner in which they reflect the growth and pluralising of wider narratives within the fields of modernism, American naturalism and postmodernism. The contemporary era is marked by commemoration and reflection regarding twentieth century conflict and by anxiety regarding the unstable post 9/11 world. In addition to this, there is resurgence in scholarly, political and popular interest in gender and its representation. These factors mean that this is a timely and vital study that reflects on literary history and current literary debates. The authors and their work in this thesis are considered in chronological order and cover a significant part of the American twentieth century. Chapter one examines John Dos Passos‟ Three Soldiers and Ernest Hemingway‟s A Farewell to Arms. Chapter two engages with two Pacific war novels; Norman Mailer‟s The Naked and the Dead and James Jones‟ The Thin Red Line. Chapter three explores post-war existential angst and early postmodernism in Joseph Heller‟s Catch-22 and Kurt Vonnegut‟s Slaughterhouse-Five. The final chapter offers analysis of Larry Heinemann‟s Close Quarters and Paco’s Story and Tim O‟Brien‟s Going After Cacciato and The Things They Carried.

This thesis examines the career of Maurice Papon from his appointment as secretary-general of the prefecture of the Gironde in 1942, through his terms as a prefect in Morocco and Algeria, to the end of the Algerian War in 1962 when he was prefect of police in Paris. Throughout this period, Papon's career was marked by controversy: in the Gironde on account of his involvement in the detaining and deportation of Jews, which led to his conviction in 1998 for crimes against humanity; in North Africa on account of the use of torture and summary execution by units of the army within his jurisdiction; and in Paris on account of the harsh methods used by the police to suppress the Algerian nationalist movement. Papon, who was extensively interviewed for the thesis, regarded himself as a loyal civil servant who was simply doing his duty. The thesis carefully examines his relations to the State, his actions and the circumstances in which he carried them out. In doing so, it presents an historical portrait of Papon and the State which employed him, and an assessment of what both understood by the concept of a civil servant's duty to obey.

Introduction. Today women comprise 15% of the U.S. active-duty military, but are often overlooked in research of the Armed Forces. While some of the challenges faced by women are similar to men, they encounter unique stressors related to childcare while deployed, sexual harassment and assault, and gynecological needs. Women are also more likely than men to develop post-traumatic stress disorder (PTSD). Both stress and PTSD have been linked to the development of chronic hypertension and some adverse birth outcomes. We hypothesized that post-9/11/2001 era military women who deployed or who had indicators of PTSD would be at greater risk of developing a hypertensive disorder of pregnancy (HDP) than non-deployed or non-PTSD military women. Methods. We conducted a retrospective cohort study using a U.S. Department of Defense database comprised of all active-duty women who gave birth to their first, live-born singleton infant using Tricare from January 1, 2004 to December 31, 2008. The database included maternal and infant birth hospitalization records, maternal mental health visits, and post-9/11/2001 deployment information which included Post-Deployment Health Assessment (PDHA) and Reassessment (PDHRA) screening responses. HDP was defined with ICD-9-CM codes in the maternal birth hospitalization record. We evaluated the risk of HDP associated with overall deployment and timing of deployment ending compared to non-deployed women, in addition to cumulative months of deployment. We also conducted Classification Tree Analysis (CART) to determine appropriate cut-points for categorization of deployment variables among mothers who deployed: cumulative weeks of deployment, percent of study time spent deployed, and dwell time between two most recent pre-birth deployments. We explored effect modification by covariates postulated to potentially modify the relationship between deployment history and risk of HDP. New variables were defined and used in multivariable logistic regression models for each deployment measure. Women fit into four PTSD case-definition categories: confirmed (ICD-9-CM diagnosis), probable (possible plus endorsement of “high risk” items on the PDHA), possible (endorsement of ≥3 PTSD items on the PDHA), or none (no PTSD indicators). We compared mothers with PTSD to non-cases using multivariable logistic regression to quantify the risk of HDP, and repeated the analyses using a ≥2 PTSD item endorsement case-definition criteria. All logistic regression models were adjusted for known confounders and important covariates. Results. There were a total of 36,675 births, 13.4% of mothers experienced at least one HDP, and 35% of mothers deployed. No increased risk of HDP was observed for deployment overall (OR=1.02, 95% CI: 0.95-1.09), but black mothers who deployed were 13% more likely to develop an HDP (OR=1.13, 95% CI: 1.00-1.27). CART revealed an important cut-point for cumulative deployment length of ≥1 year, which was statistically significant among mothers <35 years old. Mothers with ≥1 year cumulative deployment were 17% more likely to have an HDP than mothers deployed <1 year (OR=1.17, 95% CI: 1.01-1.36). The prevalence of confirmed PTSD was 1.6% in the overall cohort. The prevalence of any PTSD among deployed mothers who completed a PDHA was 6.2%. Overall, PTSD was not significantly associated with HDP except among probable PTSD cases using the ≥2 item criteria (OR=1.30, 95% CI: 1.01-1.67) and among confirmed PTSD mothers identifying as “other” race (OR=6.62, 95% CI: 1.72-25.47). Conclusion. Results are suggestive of an elevated risk of HDP among the military population among women who deployed for a year or longer and for black mothers. Although PTSD did not clearly confer additional risk in the overall cohort, there is evidence to support further research using more thorough screening especially across racial/ethnic groups. Our study likely underestimated PTSD and possibly attenuated results since individuals may purposely report inaccurately on the PDHA in order to go home sooner after deployment. Future studies should include information related to deployment-specific experiences and screen all participants for evidence of PTSD.

In 1961, a series of uprisings exploded in Angola, Portugal’s largest colony in Africa. A struggle for the independence of all the Portuguese colonies in Africa followed, organized by the national liberation movements: the MPLA, FNLA, and UNITA in Angola, FRELIMO in Mozambique, and the PAIGC in Guinea-Bissau. The wars would end in 1974, following a military coup d'état in Lisbon and the dissolution of the Portuguese dictatorship during the Carnation Revolution. This thesis explores fourteen years of anti-colonial campaigns: the people who led the liberation movements in the Portuguese colonies, the cadres these leaders encountered in Moscow, East Berlin, Prague, Sofia, and Warsaw, and the international environment they faced. It begins by looking at contacts forged between Soviet cadres and African nationalist leaders from Portuguese colonies in the late 1950s, before offering detailed analysis of why the Soviet Union and Czechoslovakia offered assistance to the MPLA and the PAIGC in 1961, the same year Angola erupted into spasms of racial violence and the Soviet Union and the United States locked horns over the status of West Berlin. The subsequent chapters analyze the evolution of Soviet relations with the liberation movements during the 1960s and 1970s, the role this relationship played in shaping Soviet attitudes and policy in Africa, and the significance of Soviet bloc assistance in anti-colonial campaigns. This thesis also looks at the diplomacy of the liberation movements and their ideological and organizational transformations over fourteen years of guerrilla war. The final chapter evaluates the Soviet role in the decolonization of Portuguese Africa following the fall of the Portuguese dictatorship and investigates why the Soviets decided to intervene on behalf of the MPLA in the pivotal event of this thesis – the beginning of the civil war in Angola in 1975.

During the post-9/11 era we have witnessed the rise of war-themed digital games, which are increasingly produced and distributed on a massive global scale. This new form of 'militainment' re-formulates ‘the military-entertainment complex’ industrial model, and by repeatedly simulating historical/present/fictional war events and adopting militaristic stories, creates an adrenaline-pumping interactive gaming experience that the global gamers find very difficult to resist. Before 2011 the most iconic war-themed first-person-shooter (FPS) digital game, Call of Duty: Modern Warfare 2, achieved a new milestone of more than 20 million copies sold globally. After the release of Call of Duty: Black Ops, the Facebook COD group became one of the top 20 fastest growing Facebook communities in 2010. At the time of writing this thesis, this network community had already attracted more than 10 million fans worldwide. Besides the well-known Call of Duty series, other FPS titles like Medal of Honor, Fallout, and Battlefield series are all fed into the global gamers’ growing appetite for this so-called ‘shoot’em’all’ genre. Within academia, scholars from different research disciplines also realized the importance of gaming and have been trying to approach this conflict-based digital game culture from various angles. The war-themed genre FPS is frequently challenged by people’s negative impression towards its unpleasant essence and content; questioning its embedded political ideologies, the violent sequences involved in the gameplay and its socio-cultural influences/effects to individual and community etc. However, the wide range of critical debates in this field has reflected the growing interest of scholars in the complex political relationship between military and entertainment sectors and industries, and the embedded P.R. network that is running behind the games’ industrial structure and cultural production (see Wark 1996, Herz 1997, Derian 2001, Stockwell and Muir 2003, Lenoir and Lowood 2005, Leonard 2007, Turse 2008, Ottosen 2009). Despite widespread academic interests in the subject, few researchers have paid attention to the gamers who are the ones truly engaged themselves to this genre. If we look at the research within game studies today, less analysis is primarily focused on this unique shooter-gamer culture. In this regard, this research adopts qualitative research methods to explore the gamers’ feelings, attitudes, and their experiences in the war-themed FPS genre. In terms of the research methods used, an online questionnaire was launched to collect responses from 433 gamers across different countries, and 11 in-depth face-to-face interviews with a community of COD gamers were also conducted in Taiwan between 2010 and 2011. The data which has emerged from the two research methods reveals gamers’ perceptions about war games’ time narrative and realism. Based on the interviews, the research analyses East Asian gamers’ construction of meanings in this ‘western genre’ and provides some theoretical reflections about their transnational FPS gameplay experience.

Mot bakgrund av den tidigare forskning och kritik kring ämnet digitala krigsspel har denna studie identifierat omfattningen av internationell humanitär rätt (IHL) i speltitlarna Call of Duty: Modern Warfare och This War of Mine samt diskuterat de etiska synpunkter som uppenbarats genom närläsning. Resultaten visar att dessa speltitlar skiljer sig i sin skildring av krig sett utifrån IHL. This War of Mine avbildar krig genom ett civilt perspektiv och genom sitt narrativ tar spelet ingen ställning till någon sida utan förmedlar, genom sina porträtteringar av brott mot IHL, den allvarsamma realiteten av krig. I kontrast till detta ställer sig Call of Duty: Modern Warfare på en sida av rättfärdigande av krig mot de makter som hotar den fria världen genom våldshandlingar som brott mot IHL, detta porträtteras genom både ett militärt och därtill civil perspektiv. Vidare har denna studie identifierat frågor vi anser vara av stort intresse för framtida forskning inom digitala krigsspel.
In the light of previous research and criticism on the subject of digital war games, this study has identified the scope of international humanitarian law (IHL) in the game titles Call of Duty: Modern Warfare and This War of Mine and discussed the ethical views revealed through close reading. The results show that these game titles differ in their depiction of war seen from the IHL. This War of Mine depicts war through a civilian perspective and through its narrative, the game takes no position on either side but conveys, through its portrayals of crimes against the IHL, the serious reality of war. In contrast, Call of Duty: Modern Warfare stands on one side of justifying war against the powers that threaten the free world through acts of violence as a crime against the IHL, this is portrayed through both a military and a civilian perspective. Furthermore, this study has identified issues we consider to be of great interest for future research in digital war games.

This dissertation investigates how personal military service, which during the immensely popular Crimean War of 1854-6 was regarded as the business only of an abstract and lowly soldier-class, had by the eve of the Great War taken on the aspect of a clear and universal citizenly duty in London press discourse. It utilises text-searchable digitised newspaper archives to exhaustively review the whole body of relevant press debate in thirteen key London periodicals, identifying key shifts and trends in press conceptions of civilian military obligation over the six decades between the outbreak of the Crimean War in 1854 and the eve of the Great War in 1914. The analytical narrative that emerges highlights the importance of key events, including the Crimean War, Indian Mutiny, wars of Prussian expansionism, and Boer War, in promoting and shaping the coherent conception of citizenly duty towards military service that would go on to underpin not only the mass enlistments of 1914 but also the acceptance of conscription in 1916. It suggests also the important role of broader cultural and political trends – in particular, the advent of militarist Imperialism, the growing legitimacy of the state, the shift towards a more collectivist ‘social democratic’ liberalism, and the emergence of ‘contractual’ theories of citizenship – in facilitating a reconciliation between the military imperative towards mass civilian military participation and existing liberal values and ideologies. This dissertation reveals that the societal consensus on the duty to enlist in 1914 was by no means a foregone cultural conclusion, nor indeed the relic of an earlier heroic age, but rather the dynamic product of evolution and contestation over six decades. The present study not only provides vital context to our understanding of the ‘rush to the colours’ of 1914, but also represents the first historical investigation of an important and much-neglected aspect of the relationship between war and society.

This thesis analyses States’ duty to investigate grave breaches of humanitarian law and how it applies to deep reinforcement learning autonomous weapons. It identifies basic technologic intricacies related to deep reinforcement learning and discusses what issues may arise if such software is used in weapons systems. The thesis applies a legal doctrinal method to study how the technology could frustrate the grave breaches regime and hamper States’ ability to investigate suspected incidents. Furthermore, investigative standards under humanitarian law and human rights law are examined in the context of autonomous weapons systems.  The main argument is that deep reinforcement learning algorithms create a black box that is virtually impossible to investigate and consequently causes accountability issues.

The world of journalism is becoming increasingly dangerous, as figures published by international media organisations demonstrate. But the Western news media suggests, that particularly Western foreign correspondents are facing incredibly high risks and cases of abducted, tortured and murdered foreign correspondents are reported regularly. The question arises “Have they become targets?” Foreign correspondence has been a dangerous occupation since it first emerged during the Crimean War, when the first consistent war reporting was established. Ever since then, foreign correspondents have had to face opposition, criticism and harsh realities. However, they have also always been highly valued journalists and well-respected for their courage to travel overseas, often into conflict-riddled areas, to report important news to their audiences back home. Sometimes they have even lost their lives in the pursuit of truth. Daniel Pearl, Christian Struwe and Karen Fischer or Trent Keegan are just a few examples of the many correspondents and journalists who have died as martyrs for their profession. As the actual data published by international media organisations, such as Reporters Without Borders, the Committee to Protect Journalists or Freedom House, suggests, it has rapidly become worse for all journalists in the last 20 years and there is worse to come. It appears as if the factors leading to their deaths are increasing and will be contributing to even higher death tolls in the future. The thesis will consider such questions as: Who is there to protect journalists and foreign correspondents? Independent media organisations are trying their best. The international press is bemoaning the many deaths and governments have promulgated laws to protect their reporters, but does that actually help? Will those attempts make it better in future? And can the Western news media apparatus itself be held partly responsible for some of the deaths?

In 1898, H G Wells published The War of the Worlds, a scathing indictment of colonialism from the perspective of the colonized. The following year, Rudyard Kipling penned The White Man’s Burden, describing colonial conquest as driven by duty, for the sake of the subjugated. They shared a vantage point from the literary pedestal of fin-de-siècle London, but what they saw was very different.            The War of the Worlds can be read as an allegory of colonialism where the tables are turned and the colonial masters are suddenly exposed to a ruthless and technologically superior power. What can be inferred about the Martians’ motives? Can they be perceived as driven by duty, by wishing to take care of or serve their captives’ needs? With the information provided in the The War of the Worlds, could a Martian Kipling write “The Green Man’s Burden” to motivate the invasion of the Earth?           Using postcolonial tools of analysis, this essay digs into the britishness of Wells’ colonizers and colonized, as well as into the britishness of Wells’ own perspective. Some postcolonial theorists argue that representatives of the colonial powers cannot represent the subjugated. Does his background and nationality disqualify Wells to describe the effects of colonialism? I argue that it does not. Staying in the social space of the West helped Wells erode the ideology of colonialism by tailoring it to be received and understood by his target audience, his contemporary countrymen.

This essay will focus on video and computer game violence. We hope to uncover, with the help of semiotics, according to Barthes design, if this kind of violence can have a negative effect on youth and adolescents. How intense is the violence and how graphic is it?. PEGI is the European measurement for game age limits. In our essay we will analyze five different games, each game in its own PEGI-value, except two games that share the limit of 18+ were we instead will try to uncover what differences in the two games that puts them on the same age limit. The games we will be investigating are “Pokemon Black Version”, “Megaman X: Command Missions”, “World of Warcraft Cataclysm”, “Call of Duty: Black Ops” and “Gears of War 2”, “Gears of War 2” and “Call of Duty: Black Ops” are the games which shares the age limit of 18+. With the help of our semiotic findings and various studies from researchers C A. Anderson, Jesper Juul and Clive Thompson we hope to be able to categorize the different types of violence in said games, according to the amount of violence, how intense it is, the amount of blood and death, how realistic the violence is and what kind of messages the different games contains and compare our findings to PEGI´s own guidelines.

This thesis aims at the investigation of how the issue of conflicting memories about the participation of the Brazilian Expeditionary Force (BEF) during World War II is configured today . To accomplish this goal, it was necessary to take into account not only the political players that act in this process – among others: State, Army, Veteran's Associations and society – as well as the fluctuations and appropriations of their memory. Traumatic memories of the veterans about this event arise through different ways of self-writing – with special emphasis on journals, letters and interviews – and lead to the notion of the duty of memory in the fight for reparation and recognition.
O presente trabalho procura investigar como se configura atualmente o campo da disputa memorial sobre a participação da Força Expedicionária Brasileira (FEB) durante a Segunda Guerra Mundial. Para isso, foi preciso levar em conta não apenas os sujeitos políticos que atuam nesse processo – entre outros: Estado, Exército, Associações de veteranos e sociedade – como também as flutuações e apropriações de memória das quais se valem. As memórias traumáticas que os veteranos guardam desse episódio ganham voz através das diversas modalidades da escrita de si – com destaque para os diários, as correspondências e entrevistas – e remetem à noção do dever de memória na luta por reparação e reconhecimento.

Resumen
Different people can have different cultural interpretations of the person—atomic versus embedded—and these may affect health care decision-making. This study examines both the ethics of variations in personhood as well as their implications for the doctrine of informed consent and the duty to warn of genetic disease risk. It argues that variations in personhood are consistent with the ethics of the Principle of Autonomy and the Canadian stand on informed consent, though autonomy and consent play out differently in practice on the two models. Also as a result of different interpretations of the person, the duty to warn of hereditary risk is found to be relevant to the atomic conception but unnecessary among embedded individuals.

Com o avanço da tenologia em genética, os testes genéticos preditivos são cada vez mais usados, quer no diagnóstico pré-natal, quer no diagnóstico pós-natal. Os testes levantam uma série de implicações psicológicas, sociais e legais, como por exemplo, discriminação na relação laboral, sendo um desafio para ética, especialmente no sigilo e confidencialidade na relação médico-paciente. O dilema especifico de se poder manter em confidencialidade a relação entre geneticista e paciente quando os interesses familiares estão em jogo é também um problema significativo em outros países, como na França, Espanha e Canadá. O teste genético preditivo ajuda os médicos a diagnosticar e tratar certas doenças, mas estas informações genéticas não são apenas relevantes à pessoa que foi testada, são também para os seus familiares. Com estas informações poderiam, pelo menos, impedir os graves prejuízos iminentes ou os riscos de ter a mesma doença genética de pessoa que foi testada. Aliás, a proteção de direito de privacidade não é absoluta em Portugal, como também não acontece em outros sistemas jurídicos. Tal a revelação aos seus familiares pode ser justificada no ordenamento jurídico português? A presente dissertação dedica-se ao estudo de obrigação ética mais fundamental de confidencialidade na relação médico-paciente e a discutir as questões jurídicas suscetíveis de serem levantadas em relação aos atuais paradigmas jurídicos, nacional e internacional. Para além disso, discute sobre o direito a saber e o direito a não saber dos familiares, através da compreensão da relação entre o conceito de autonomia e de privacidade. Por fim, elaboramos uma proposta para equilibrar a situação.
With the advance developments in genetics, predictive genetics testing has grown in incidence, both in prenatal as in postnatal diagnosis. Such testing raises a number of psychological, social and legal implications, For example, discrimination in employment, with ethical and legal concerns, in particular, the duty of confidentiality of the physician-patient relationship. The specific dilemma in maintaining confidentiality of the patient-geneticist relationship when familial interests are at stake is also a significant problem in other countries, such as, France, Spain and Canada. The predictive genetic testing help medical doctors diagnose and treat certain illnesses, not only on the people who was tested, but also on her or his blood relative. This could at least prevent serious imminent harm or risk of the same defect to the relative. The protection of such privacy rights is not absolute in the legal system in Portugal, just like in others legal systems. So, can such disclosure be justified within the current legal framework? This paper aims to give emphasis to the ethical obligation of confidentiality in the area of medical practice and to discuss the legal issues likely to be raised in relation the current legal paradigms, both nationally and internationally, and the discussion about the right to know and the right not to know, through an understanding of the relationship between notions of personal autonomy and privacy. Finally, we try to provide a preposition to balance the interests at stake.

Resumen
Modern democracies rely on civic participation, namely through voting. In this work, I use rational choice theory and the paradox of voting to analyse individuals’ voting motivations using data of the Portuguese electorate, collected and built by me (1200 observations). As a novel contribution to the discussion, I conduct a randomized controlled trial using two treatments. One tests the importance of the act of voting while the other tests the probability of being pivotal in an election. I find individuals vote because they value the act of voting – warm glow voting. Finally, I find evidence suggesting that providing information about the importance of voting increases turnout while there is no impact of information about the probability of being pivotal.

This study utilizes correspondence, memoirs, and secondary sources to explore the lives and careers of six Continental Navy captains?Esek Hopkins, Joshua Barney, John Paul Jones, Hector McNeill, Lambert Wickes, and John Barry?and reveal the motivational factors of patriotism, a desire for fame and professional advancement, and financial stability which underlay their decisions to seek commissions in the Continental Navy, and influenced their conduct while in the service. Additionally, it suggests that prewar interactions in an "Atlantic World" context influenced the ideological and personal motivations that formed the foundations for service in the Continental Navy. All three motivations played a role in each captain's career and affected their conduct in relation to their understandings of duty, but the degree to which they influenced the captains varied. Although the promise of a steady income helped motivate initial service, financial considerations played a larger role throughout Barney's and Barry's careers than they did for other captains. The desire for fame and personal prestige also affected the conduct and service of all six men, though Jones and Hopkins provide more concrete examples of its influence. Finally, experiences interacting with West Indies and Atlantic trade networks before the war likely influenced the captains' development of revolutionary principles, and their dedication to the United States. In addition to patriotism, Jones professed a devotion to universal principles of liberty and rights, and McNeill perceived the Revolution as an attempt to establish God's Kingdom of the Just. The degree to which each captain succeeded in achieving his goals, and the affect his Continental service had on employment after the Revolution, also varied significantly. Hopkins failed as the navy's commander-in-chief, but his performance did not negatively impact his social and political standing in his native Rhode Island. Unlike McNeill, Captains Barry, Barney and Jones also utilized their networks of friends and acquaintances well, helping them find prestigious and stable employment in other seagoing capacities after the war. Wickes died in 1777, but his brief service also suggests he would have achieved success had he survived.

In this dissertation, we discuss the humanitarian interference in the context of the legal regulamentarion of war, in the assistance role. This subject which is so important and nowadays very outspoken, belongs to the humanitarian international público law. The humanitarian interference it is an institute used in war conflicts and or natural disasters. It is aimed at saving human lives, under UN Resolution 45/100. This intervention can be conducted through humanitarian assistance, our main focus here, or by the use of armed power. It is our opinion that, following the literature review that we consucted, that interference it is not only a matter of law but also a duty. This development as a new paradigm, has begun from activists Mario Betatti, Bernard Kouchner and other authors that put pressure on the United Nations to look at the issue of interference as a duty which is above all structures. With the Paris first International Conference in January 1987, on Law and Humanitarian Morality, the need to break the principle of non interference to assist victims of war and natural disasters, by NGO’s.
Abordamos o tema da Ingerência Humanitária no Contexto da Regulamentação Jurídica da Guerra, na sua vertente de assistência. Este tema tão candente e actual, faz parte do Direito Internacional Humanitário, dentro do campo do Direito Internacional Público. A Ingerência Humanitária é um instituto usado para intervir em situações de conflito armado e/ou desastres naturais. Visa essencialmente salvar vidas humanas, ao abrigo da Resolução 45/100 das Nações Unidas. Esta intervenção pode consistir na assistência humanitária, que é o caso que estamos a tratar, ou no uso da força. Ousamos dizer, juntamente com a literatura visitada, que ingerência não é só uma questão de direito mas de dever. Este salto enquanto mudança de paradigma deve-se, em grande parte, aos activistas Mario Betatti, Bernard Kouchner e outros autores, que pressionaram as Nações Unidas para se olhar para a questão da ingerência, como um dever que está acima das estruturas. Com a realização, em Janeiro de 1987 em Paris, da Primeira Conferência Internacional de Direito e Moral Humanitária, surgiu a necessidade de quebrar o princípio da não intervenção para prestar assistência às vítimas de guerra e de desastres naturais pelas Organizações não Governamentais.

In this diploma thesis, I deal with the everyday life of military personnel stationed in the main American bases in South Vietnam during the Vietnam War (1965-1973). The research is based on the analysis of oral history interviews with veterans that served in various occupational specialties in the rear of American armed forces. I'm describing specifics of the military service of witnesses from their entry to the armed forces, training, Vietnam experience, to their homecoming. I'm trying to analyze specific topics that are connected with the experience of military life in Vietnam, especially off duty hours of personnel.
