Texto completoThe aim of this research is to compare Christopher Marlowe’s play Doctor Faustus (1604, 1616) with the first French translation by Jean-Pierre Antoine Bazy (1850) and the first Italian translation by Eugenio Turiello (1898) in search of the changes that are symptomatic of the cultural and ideological context of translation production. The case of Doctor Faustus represents the epitome of the instability of a dramatic source text. Two main versions of the play (the A-text and the B-text) differ in structural, thematic and doctrinal terms. At the same time, neither version delivers a coherent vision. The research seeks to examine whether Bazy’s and Turiello’s translation, belonging to different yet related geographical, historical and literary traditions, further multiply the potential readings of the original or whether they display a more consistent framework. In addition, we will analyse the causes of textual variation, commonly labelled in Translation Studies as shifts. First, we identified a pattern of shifts manifested in the target texts in question. Then, we discussed the ways in which the identified patterns of shifts affect the general meaning and the structure of the texts. Finally, adopting a socio-cultural approach, we showed how certain shifts are conditioned by the translators’ ideology and their interpretation of the original. This in turn reveals the positions they occupy within the political and ideological space of each target culture and the main cultural and translation norms operating in the recipient systems

Texto completoThis work articulates the images constructed by Thomas Manns novel Doctor Faustus with the theoretical framework developed by the Frankfurt School, in order to compose a philosophically invested interpretation of the novel, as well as achieve a better understanding of Critical Theorys ideas. The life of the composer Adrian Leverkühn, Manns Faustus, is narrated by his friend and biographer Serenus Zeitblom, and this narrative reveals the fundamental identity between the musician and Germany, relating their characteristics and histories. Our approach on the novel specially studies the questions of the salvation or the damnation of Fausts soul, trying to precise these possibilities within the work. We develop a notion of myth common to the novel and to that frankfurtian theoretical framework, pointing its totalizing strength, as well as its insertion in a dialectical dynamic. Next, we propose to consider that all the novels elements that instigate the mythification would point to the condemnation of Faust, while, conversely, the novels aspects that reveal the limits of the myth or contradict it would announce the possibility of the mans salvation. The notion of suffering is especially important, as it appears in both perspectives. This means that suffering can be interpreted both as the disclosure of fate as if Adrians pain and sadness would anticipate the condemnation as can be understood as a symptom that denounces the myth as if it would reveal the lie of the apparent destination and the possibilities of future. Finally, the inquire on músic, a central theme of the novel, also reveals its ambivalente, for it can either strengthen the myth, as it can exercise a critic of the mythologized world.

Texto completoIn England the dawn of the "Scientific Revolution" coincided with the Renaissance. It is therefore no accident that dramatists like Marlowe and Shakespeare seized on the figure of the "scientist" in Doctor Faustus and The Tempest. Science is even more present a theme in Bacon's works : in New Atlantis he describes an ideal society whose prosperity and comfort depend on a scientific institution which he calls the "House of Salomon. " The "scientist" was certainly not a "natural" feature of the social or cultural environment. One may say, however, that "natural philosophers", as they were sometimes called, shared a number of common characteristics. While still very much influenced by the humanist tradition, they expressed a very strong interest in technology. They also believed in magic and tried to legitimize its use in the face of the theologians' strictures. All three aspects – humanism, magic and technology – found their way into Doctor Faustus and The Tempest. On the whole, the popular image of the scientist was poised between rejection and mockery. He was seen either as a dangerous atheist or as a melancholy man detached from reality. Yet the literary depiction of the scientist was by no means a uniform one. Scientific treatises reveal the scientists' growing sense that they belonged to a learned community. They stopped emphasizing their isolation and gave prominence to their links with other scientists. Science remained an ambivalent pursuit until the end of the period. Bacon's enthusiasm is profoundly at odds with Shakespeare's or Marlowe's more ambivalent depiction which prefigures the later literary representations of science as a potentially destructive activity

O presente trabalho tem como tema a possibilidade de controle lógico-racional do juízo fático por meio da incidência da teoria dos standards probatórios, a qual é problematizada no contexto da responsabilidade civil do médico. Tem por objetivos centrais refletir acerca de qual standard de prova deverá incidir em ações de responsabilidade civil do médico, bem como observar se há um grau de suficiência de prova sendo exigido pelo TJMG e TJRS para aceitar como racionalmente comprovada a culpa nesse tipo de demanda. Esse estudo foi realizado não apenas mediante averiguação bibliográfica de doutrina nacional e estrangeira, mas também por meio de uma pesquisa empírica de natureza qualitativa das decisões cíveis dos Tribunais de Justiça do Estado de Minas Gerais e do Estado do Rio Grande do Sul que lidam com a prova da culpa e dos demais elementos ensejadores da responsabilidade civil do médico para que, assim, fosse possível compreender, através da análise do grau de prova das narrativas jurisprudenciais, como os juízes estão aferindo a suficiência do conjunto probatório quanto à comprovação da hipótese fática, diante dos elementos de juízo disponíveis. Adota-se como referencial teórico o princípio da persuasão racional, conceito construído gradativamente pela doutrina ao longo dos anos e interpretado, segundo a concepção atual de racionalidade que lhe subjaz, como liberdade relativa de valoração das provas, realizada dentro de parâmetros lógico-racionais entre os quais se incluem os standards probatórios. Essa pesquisa é de grande valia social e acadêmica, na medida em que traz uma perspectiva inovadora ao terreno da prova e da convicção judicial, proporcionando inegável desenvolvimento jurisprudencial e doutrinário em nosso país, o que nos torna assim, mais próximos de alcançar decisões mais justas. Conclui-se, sob a ótica do referencial teórico previamente estabelecido, que a pesquisa teórica e a visão crítica sobre o resultado da pesquisa empírica confirmaram a hipótese no sentido de que ao julgamento fático em ações de responsabilidade civil médica incidirá o standard da prova clara e convincente enquanto critério de julgamento, o qual não apenas indica o grau de prova a ser necessariamente satisfeito para comprovar a culpa do médico, como também proporciona maior controle da motivação judicial sobre os fatos, dotando assim de maior legitimidade e racionalidade as decisões judiciais.
The present study has as its theme the possibility of logical-rational control of the phatic judgment through the incidence of the standard of proof theory, which is problematized in the context of medical civil responsibility. It aims are to reflect on which standard of proof should be involved in actions of medical civil responsibility, as well as to observe if there is a degree of sufficiency of proof being required by the TJMG and TJRS to accept as rationally proven the fault in this type of demand. It was carried out not only through a bibliographic examination of national and foreign doctrine, but also through a qualitative empirical research of civil decisions of the Courts of Justice of the State of Minas Gerais and of the State of Rio Grande do Sul that deal with the proof of fault and other elements that give rise to medical civil responsibility, so that it would be possible to understand, through the analysis of the degree of proof of these jurisprudential narratives, how the judges are assessing the sufficiency of the probative set to prove the factual hypothesis, in view of the available evidence. It adopts as theoretical reference the principle of rational persuasion, a concept built gradually by the doctrine over the years and interpreted, according to the current conception of rationality that underlies it, as relative freedom of evaluation of the tests, carried out within rational-rational parameters between which include the standards of proof. This research is of great social and academic value, since it brings an innovative perspective to the field of proof and judicial conviction, providing undeniable jurisprudential and doctrinal development in our country, which makes us closer to reaching fairer decisions. It concludes, from the perspective of the previously established theoretical framework, that the theoretical research and the critical view on the result of the empirical research made possible the confirmation of the hypothesis that the standard of proof to be applied to the factual judgment in medical civil responsibility is the clear and convincing one, as a criterion of judgment, which will not only indicate the degree of proof to be necessarily satisfied to prove the doctor's fault, but also will provide better control of the judicial motivation on the facts, thus giving greater legitimacy and rationality to judicial decisions.

It is a fairly common experience for modern audience to come away from the performance of Marlowe's Doctor Faustus in perplexity. What puzzles modern audience is the undue insertion of farcical scenes in Doctor Faustus. From the fact that Doctor Faustus had enjoyed great popularity in the Elizabethan age, it comes to the conclusion: to the Elizabethan audience, that undue farce in Doctor Faustus was never an obstacle to understanding of the tragic play. Because the inserted farcical scenes are either completely left out or vaguely interpreted as manifestations of the hero's such conditions, what puzzles modern audience still remains moral degeneration, in unsolved. As a complement to the criticism of Doctor Faustus, this thesis tries to justify the validity and significance of the farcical subplot in terms of the comedy of evil. The first chapter sketches the intellectual background of the Elizabethan age, together with Marlowe's ingenious rendi- tion of the medieval Faust legend in his tragedy. Chapter two illustrates the treaditional Christian definition of evil, the formation of the comedy of evil, and features of the comedy of evil in medieval arts and letters. Chapter three focuses on investigating the thematic importance of the farcical scenes. Chapter four illustates what theatrical effective- ness the comic scenes contribute.

This thesis probes the principle of ambiguity that prevails itself throughout Thomas Mann’s novel, Doctor Faustus: The Life of the German Composer Adrian Leverkühn as told by a Friend, concerning the themes of music, religion, history, and textual relations. Mann endeavors to revitalize and redirect the general attitude toward the world and man after the collapse of morality and bankruptcy of humanity, and the key to it lies in the notion of ambiguity, which aims to subvert the traditional thinking that has dominated the Western civilization. Mann’s idea of ambiguity is illustrated in the eternal dialectical swing between a thesis and its antithesis in which a synthesis is an impossibility, and the borderline between the two is overthrown. In the endless to-and-fro movement produces various relationships and interpretations that one has no need to be satisfied with only one. The dynamics along with the confusion challenges the traditional epistemology and renew the relationship between man and the world, which characterizes Mann’s modernity, prefiguring the coming of postmodernism. The thesis is divided into four chapters separately to reexamine how Mann abides by ambiguity to reinterpret the essence of music and musical history, to redefine transcendence and salvation in Christianity with respect to the oneness of God and Devil, and to offer a new understanding of history in modern times after Nietzsche and WWII, all with the aid and basic idea of parody and montage.

The Tragical History of Doctor Faustus successfully dramatizes the perennial questions concerning the essence of human nature. Though interpretations differ greatly, most of the critics see in the play the spirit of a great tragedy. In Taiwan, there is still much to be done before this timeless tragedy gains more extensive attention in both of its text and performance. I hope that the translation and introduction of the play in this thesis will contribute to that goal. In the Introduction, I will discuss the play according to the text of the 1604 edition (the A-Text). In the course of the discussion, I will often relate the play to the main productions in the latter half of the twentieth century by such directors as Jerzy Grotowski (1963), John Barton (1974), and Christopher Fettes (1980). The Introduction consists of five parts: the Pivotal Question, Principal Characters, Structure, the Mighty Line, and Dramatic Devices. The questions about the sources, the authorship, and the texts will be expounded in the Appendix. As to the translation, in addition to the main body which has been translated according to the A-Text, there is a translator''s note in which the purpose and some characteristics of the translation are indicated.

Christopher Marlowe’s The Tragical History of the Life and Death of Doctor Faustus has seemed to many modern readers an intriguing yet perplexing play about life and death. The protagonist’s understanding of redemption is much related to the Protestant Reformation in Marlowe’s England. I propose to explain why Doctor Faustus refuses to repent from a non-Christian perspective. I suggest that the damnation of Faustus should be questioned from a more popular, worldly, and secular aspect inherited from the medieval times. The first part examines the causes of the fall of Doctor Faustus. I divide Faustus’s damnation into five stages. The first and second stages show how and why the protagonist degrades himself from a scholar of noble studies to a trickster of dark magic with a special attention to his contract with the devil. The second part explores the protagonist’s magic tricks as staging props, one of the important staging techniques in Elizabethan drama, to highlight the third and fourth stages of Doctor Faustus’s damnation. Finally, I conclude Doctor Faustus’s secular concept of life and death with a focus on Faustus’s tragic death in the final scene. The tragic death of Faustus gives a profound meaning about humanity. With all its distinct capabilities, talents, worries, problems, and possibilities, humanity was, I conclude, the center of Marlowe’s interest in a tragic character like Doctor Faustus.

To mortgage his soul to the devil for the sake of omniscience and omnipotence in twenty-four years is the key theme in the Faust legend. However, Faustus in Christopher Marlowe’s The Tragical History of Doctor Faustus and Faust in Johann Wolfgang von Goethe’s Faust: A Tragedy experience different encounters. The attempt of this thesis is to narrate the oscillation and the inversion in Faustus’ and Faust’s minds. Faustus and Faust confront their respective journeys of life, which leads to diverse circumstances at the last gasp. Chapter One is the introduction to the historical contexts, the definitions of egoism and altruism, and Freud’s theory of division of the mind and Maslow’s hierarchy of needs. Chapter Two deals with Faustus’ degradation. In the beginning, Faustus is the archetypal Renaissance man. He wants to pursue all kinds of knowledge. However, after he signs the contract, he seems to forget his omniscient and omnipotent aspirations and sometimes behaves like a clown. He is decadent in his ambition. The oscillation and the degradation of Faustus’ mind are analyzed in Freud’s and Maslow’s theories. Chapter Three covers the process of the sublimation of Faust’s mind. In the beginning, Faust is only in his microcosm to associate with Gretchen and Helena. After witnessing Euphorion, Faust’s son by Helena, plunge at his feet and Helena’s corporeal substance vanish, Faust sublimates himself from an egoist to an altruist and has the more aspiring aim for the public. He wants to fulfill his ideal to build the free land for the free people. The process of the sublimation of Faust’s mind is explained not only in Freud’s and Maslow’s theories but in the concept of Friedrich Nietzsche’s Superman. Chapter Four draws a comparison between the last scenes of the two plays. Faustus is terrified and remorseful, while Faust is content with the foresight of his altruistic enterprise. Because Faust feels satisfied, according the contract, he must give his soul to Mephistopheles. Chapter Five is the conclusion. After acquiring assistance from black magic, Faustus and Faust behave contrarily, which of course induces different finises: Faustus plunges into hell; Faust ascends to heaven.

This paper introduces the related judges and cases in common law of wrongful birth, wrongful life in Taiwan by analyzing related cases in England and the United States. The topic of wrongful birth will be discussed by collecting, comparing and commenting on this kind of action and integrating the involved public policy questions such as right to abort, burden of economic to the family, reception of the medical personnel, disabilities protection, religion, eugenics, moral and justice resources. Prenatal care is thought as to belong to medical behavior in this thesis. The suitability of medical behavior using the consumer protection law Article 7 is also be mentioned. By probing into the torts, the civil liability of the fault of prenatal care can be separated into two parts. One is negligent, which means the medical negligence of medical personnel and the guilt of medical system. The former discuss the Medical Negligence in the law of our country and common law. The latter takes the rights of patients into account. The theory promoted by a Germany scholar should be quoted. That the more authority of office one has, the more responsibility should one takes. And the need of proving the negligence of medical personnel should be reduced. The other is causal relationship and damage. How a woman having a baby and her mate suffer injury of rights body, health、right to abort ,right of privacy、right of equal、right of freedom of religious belief is also be discussed. Last, if the infant can ask the doctor for compensate liability because the wrongful life is expounded . If doctors need to take the responsibility for compensating, does the indemnification range include all the damage of property such as medical expense, cost of care by nurse, cost of special education and alimony ?And how will the standard and amount will be? On the other side, the claim for a reasonable compensation in money even if such injury is not a purely pecuniary loss is also be discussed. In consideration of such new medical actions, hospitals and doctors always afford so much damages that once medical negligence happens, they go into bankruptcy. To ensure the injured parents can get over certainly, to avoid too much expense in economy, the liability insurance of medicine is recommended in this research to look for a prevention of the nervous relationship of doctor and patient in the present day.

As English has become the lingual franca for international communication, in order to pursue academic achievements, nonnative-speaking researchers are required to have adequate communication competence in English. In Taiwan, doctoral students’ deficiency in English has been widely considered as a serious problem, which might hinder their academic development. However, limited English courses or related resources have been provided for them. To bridge the gap, a well-conducted needs analysis should be necessary and helpful. Therefore, the present study aims to investigate doctoral students’ English needs in terms of listening, speaking, reading and writing skills. Needs here are defined as necessities, lacks, and wants, which have been conventionally referred as target needs or product-oriented needs. This study surveyed 148 doctoral students and 56 teachers in a research-oriented university in Taiwan, regarding: (1) importance of English, (2) contexts of English use, (3) evaluation of doctoral students’ English ability, (4) expectations of curriculum design, and (5) other help on English. The quantitative data of the questionnaires were analyzed through descriptive statistics, t-test, ANOVA, and Chi-square analysis, while the qualitative data was examined by the author, and categorized into proper groups for further analysis. Results show that reading and writing skills were more important and more often used in doctoral study, while listening and speaking ability were in greater demand in students’ future career. In addition, due to doctoral students’ relatively poor performance in listening and speaking, more training on these two skills were highly suggested by the students. The issues of graduation requirement in English and lecturing content courses in English were also discussed. To conclude, findings of this study should help academic institutes design new or modify the existing English curriculum and learning resources for doctoral students.

Abstract Christopher Marlowe, in The Tragical History of Doctor Faustus, explores the struggle between the Roman Catholic Church and the Protestantism, two main religious sects in the Christendom in the sixteenth-century Reformation. He also explores people’s attitude toward religious belief and humanism, and their anxiety and struggle. In the play, Faustus quests for self-realization, knowledge and free will, and Marlowe uses the hero as a satire that human with free will yet without faith in God is doomed to destruction. By contrast, if human has faith in God but lacks free will, his desire for knowledge cannot be satisfied and his anxiety cannot be eased. The play is an epitome of the society in reflecting its piety and humanity in English Renaissance, and Marlowe writes the play to provide the relief and answer for people in the swaying religious attitude. The purpose of this thesis is to perform a research on multiple voices and ideologies in the play and further to reveal the play’s voice, as a whole, to the contemporary Reformation movement. The research draws on M. M. Bakhtin’s dialogism and heteroglossia, two basic ideas in the philosophy of language. The thesis has five chapters. Chapter One introduces the religious and political attitudes in English Renaissance, critical reviews on the play, and Marlowe’s university life. Also, my motivation to apply Bakhtin’s theory to the play and the structure of the thesis are given. Chapter Two illustrates Bakhtin’s dialogism and heteroglossia and his application to Christianity. In Chapter Three, as a self, Faustus quests for his own identity in his dialogue with other characters, bearing certain perspectives to him. Marlowe employs the play as an utterance to utter his own voice to humanism and the Protestant dilemma. Chapter Four elaborates numerous voices throughout the play and their relation to existence and interaction, and it exemplifies the idea of salvation. The concluding chapter includes a brief summary of the thesis and my reflections on Bakhtin’s philosophy of language.

Texto completoNowadays the growth of Internet usage is quite visible. Everyday the number of devices connected to the Internet increases, everything may be a smart device capable of interacting with the Internet, from smartphones, smartwatches, refrigerators and much more. All of these devices are called things in the Internet of Things. Many of them are usually constrained devices due to it’s size, usually very small with low capacities such as memory and/or processing power. These kind of devices need to be very efficient in all of their actives. For example, the battery lifetime should be maximized as possible so that the necessity to change each device’s battery could be minimized. There are many technologies that allow communication between devices. Besides the technologies, protocols may be involved in the communication between each device in an IoT system. Communication Protocols define the behaviour that is followed by things when communicating with each other. For example, in some protocols acknowledgments must be used to ensure data arrival, while in others this feature is not enforced. There are many communication Protocols available in the literature. The use of communication protocols and communication models bring many benefits to IoT systems, but they may also benefit from using the cloud. One of the biggest struggles in IoT is the fact that things are very constrained devices in terms of resources (CPU and RAM). With the cloud this would no longer be an issue. Plus, the cloud is able of providing device management, scalability, storage and real time transmission. The characteristics of the communication protocols were studied and an innovative system architecture based on micro-services, Kubernetes and Kafka is proposed in this thesis. This proposal tries to address issues such as scalability, interoperability, fault tolerance, resiliency, availability and simple management of large IoT systems. Supported by Kubernetes, which is an open-source technology that allows micro-services to be extensible, configurable and automatically managed with fault tolerance and Kafka, which is a distributed event log that uses the publish-subscribe pattern, the proposed architecture is able to deal with high number of devices producing and consuming data at the same time. The proposed Fault-Tolerant and Interoperable IoT Architecture is a cluster composed of many components (micro-services) that were implemented using docker containers. The current implementation of the system supports the MQTT, CoAP and REST protocols for data incoming and the same plus websockets for data output. Since the system is based on micro-services, more protocols may be added in a simple way (just a new micro-service must be added). The system is able to convert any protocol into another protocol, e.g., if a message arrives at the system through MQTT protocol, it can be consumed using the CoAP or REST protocol. When messages are sent to the system the payload is stored in Kafka independently of the protocol, and when clients request it, it is consumed from Kafka and encapsulated by the client protocol to be sent to the client. In order to evaluate and demonstrate the capabilities of our proposal a set of experiments were made, which allows to collect information about the performance of the Communication Protocols, the system as a whole, Kubernetes and Kafka. From the experiments we were able to conclude that the message size is not so much important, since the system is able to deal with messages from 39 bytes to 2000 bytes. Since we are designing the system for IoT applications, we considered that messages with 2000 Bytes are big messages. Also, it was recognized that the system is able to recover from crashed nodes and to respond well in terms of average delay and packet loss when low and high throughput are compared. In this situation, there is a significant impact of the RAM usage, but the system still works without problems. In terms of scalability, the evaluation of the system through its cluster under-layer platform (Kubernetes) allowed us to understand that there is no direct relation between the time spent toconstant. However, the same conclusion is not true for the number of instances that are needed at high layer (application layer). Here, time spent to increase the number of instances of a specific application is directly proportional to the number of instances that are already running. In respect to data redundancy and persistence, the experiments showed that the average delay and packet loss of a message sent from a Producer to a Receiver is approximately the same regardless of the number of Kafka instances being used. Additionally, using a high number of partitions has a negative impact on the system’s behaviour.

Texto completoThis study examines asylum seekers’ practices within medical humanitarian structures on Lesvos island, Greece. Maintained inside the border-zone constituted by the island, asylum seekers live in Moria camp, which is known for its extremely bad living conditions. In the context of their asylum process, they undergo a medical procedure, the vulnerability assessment, the result of which influences their trajectories. As part of an ethnographic fieldwork conducted on the island in the summer of 2018, I carried out observing participation as an interpreter in a humanitarian clinic, a space where volunteer doctors and asylum seekers negotiate the power attributed to the vulnerability assessment. This study analyses the practices of asylum seekers through the concept of circumscribed agency, which effects are unpredictable. I first show that asylum seekers set up strategies to negotiate the inhuman situation in which they find themselves, as well as to obtain recognition. Their strategies are structured around a reappropriation of the logics of the humanitarian device, notably the stereotypes assigned to refugees. The second part extensively examines an element of these strategies central to the care interactions taking place in the humanitarian clinic: the medical documents. I show that these documents act as a flexible technology and that their function is reconfigured by asylum seekers’ practices, who use them as resources and proofs. Finally, I highlight the different ways in which volunteer doctors react to these practices, along with their consequences on access to medical care. These elements provide a nuanced description of the effects of the humanitarian device established at Europe’s borders following the 2015 refugee crisis.

Texto completoThis work deals with medical contractual liability under Portuguese private law. It is divided into four parts. In the first, which corresponds to the introduction, the relationship between law and medicine is analysed, a brief note is provided with regard to what medicine is today, in all its diversity and complexity, with reference to so-called evidence-based medicine (EBM), due to its significance to the issue of liability, the current paradigm of the physician-patient relationship is defined, as opposed to the paternalistic model of the past, the role of ethics and medical ethics is examined, and the object of the study is indicated and its plan outlined. The second part references the many contributions regarding this matter, highlighting, almost always individually, what each author said, either within the scope of legal doctrine or within that of medical doctrine. This work is indebted to all of them. At this point, attention is given, as detailed as possible, to the case law of Portuguese higher courts - Courts of Appeal and Supreme Court - on cases of medical liability in private law, from 2000 to 2014, grouping them by different medical specialties and by the most common types of events. In the third part, the state of the matter as it currently stands under Portuguese law is analysed; doctrinal and jurisprudential contributions that were previously referenced are critically analysed; and an attempt is made to provide a personal contribution. Finally, in the fourth and final part, the main conclusions of the study are listed.
