Texto completoThe object of this thesis consists in the analysis of the level of justiciability of social rights in the EU context, especially after the entering into force of the Lisbon Treaty. The research first presents a brief overview of different welfare states within EU national systems. The investigation focuses on national constitutional provisions enshrining social rights. From the results obtained, it is possible to determine which social rights are considered as being part of a common European tradition, and which, on the contrary, are differently recognized and protected from different Member States. The individuation of a nucleus of social rights, justiciable under the Member States legal orders, offers a good key for reading the evolution of European social policy during the last sixty years. Indeed, the second chapter focuses on the jurisprudence of the ECJ, in particular the one applying the principle of solidarity and non-discrimination within the field of social rights ´protection. Further, still within the field of social protection, this chapter also analyses the Union´s politics, with a special attention to the cross-border access to economic social services of the different member States. From this analysis, it is possible to determine the impact of the Charter of Fundamental rights on the protection of social rights in terms of their justiciability in the acquis communautaire. The third chapter deals with the problems connected with the future accession of the EU in the ECHR, in particular it shows the different approaches of the two Courts in the determination of the level of protection of social rights under the two judicial orders. The thesis concludes with a reflection, on one hand, on the present economic situation in Europe and its impact on the effectiveness and justiciability of social rights, and on the other, on the welfare states of member States.

Texto completoThe legal, political, and economic debate on the protection of social rights in the context of the European integration process dates back to the very origins of this process. The Charter of Fundamental Rights of the EU acquired binding character in December 2009, and most notably it acquired the same legal value as the Treaties. Roughly ten years later, it seems possible to carry out a first assessment draw of the promises kept and the promises broken as for the justiciability of the fundamental social rights enshrined in Title IV which directly or indirectly relating to the employment relationship (Articles 27-34). To this end, the thesis is comprised of three parts. This tripartite structure allows combining two research methods, namely a case law analysis, in relation to the post-Lisbon case law of the Court of Justice of the EU (Chapter III), and a historical and theoretical analysis (Chapters I and II). The major goal of the research is to demonstrate that both the most interesting developments in the CJEU’s case law as well as the most significant open issues can be better understood by taking due account the trajectory and the role of each of these rights within the European integration process. In short, it is argued that the ‘constitutionalisation’ of social rights analysed in this thesis undoubtedly has an ‘added value’. The latter, however, reflects the sui generis nature and goals of the Union, its system of competences, and the ultimate function of the EU system of fundamental rights protection. Despite the fact that these characteristics may eventually change over time.
Le débat juridique, politique et économique sur la protection des droits sociaux dans le contexte du processus d’intégration européenne remonte aux origines mêmes de ce processus. Une dizaine d’années après l’attribution à la Charte des droits fondamentaux de l’UE de la même valeur juridique que les traités, il semble possible de dresser un premier bilan en termes d’attentes avérées et d’attentes non satisfaites en ce qui concerne la justiciabilité des droits sociaux fondamentaux contenus dans son Titre IV et directement ou indirectement liés à la relation de travail (articles 27 à 34). À cette fin, la thèse a adopté une structure tripartite capable de combiner une méthodologie d’analyse pratique, en rapport avec la jurisprudence de la Cour de justice de l’UE post-Lisbonne (Chapitre III), avec une analyse ayant un caractère plus théorique-reconstructif (Chapitres I et II). La recherche vise à montrer comment autant les développements les plus intéressants que les limites relevées dans la jurisprudence de la CJUE peuvent être mieux compris en prenant dûment compte du parcours et de l’importance de chacun de ces droits dans le contexte du processus d’intégration européenne. En somme, il est soutenu que la “constitutionnalisation” des droits sociaux analysés présente certainement une «valeur ajoutée» qui, toutefois, reflète la nature sui generis et les objectifs de l’Union, son système des compétences, et la fonction du système de protection des droits fondamentaux de l’UE. Ce qui précède n’implique pas que ces caractéristiques ne puissent pas éventuellement changer à l’avenir.

Texto completoQuesto elaborato prende in esame la maggiore dottrina nazionale e internazionale sulle cause della crisi del Welfare State e sui suoi effetti in termini di difficoltà di garantire la tutela dei diritti sociali in modo universalistico. La strada che si delinea per il futuro del problema pubblico in materia di diritti sociali richiede quanto meno un ripensamento del ruolo dello Stato e dei cittadini all’interno della società, intesi non solo come destinatari di servizi, ma anche come protagonisti nel processo di produzione e godimento del bene comune. In questo senso il principio di sussidiarietà può rappresentare la chiave di volta per una ridefinizione dei rapporti sociali, civili e politici. Nella prima parte, il primo capitolo ripercorre l’evoluzione dei diritti sociali, così come elaborati dalla teoria giuridica e dalla prassi politica, secondo lo sviluppo dei sistemi di Welfare State dal secondo dopoguerra fino alla loro crisi. Il capitolo II approfondisce le origini della sussidiarietà attraverso l’individuazione di importanti affinità fra il pensiero cattolico e quello laico, con particolare attenzione alle più recenti interpretazioni del principio. Il capitolo III prende in esame le nuove politiche di welfare adottate in Italia e in Europa, in particolare quelle di natura fiscale. Nella seconda parte di questo elaborato si documentano le riforme del welfare in corso in Italia, Francia, Gran Bretagna e Stati Uniti nei settori della sanità, dell’istruzione e dei servizi sociali. Il capitolo I si sofferma su alcune importanti misure sociali adottate in Italia, nell’ambito della nuova suddivisione delle competenze fra Stato e Regioni, disegnata dalla riforma del titolo V della Costituzione, a partire dai livelli essenziali delle prestazioni. Vengono esaminati i casi dei buoni scuola regionali, dell’accreditamento e della certificazione per le strutture private nel settore sanitario e del buono lavoro. Il capitolo II espone le recenti riforme adottate in Francia per la tutela e lo sviluppo dei servizi alla persona. In particolare, vengono esaminate le maggiori implicazioni derivanti dall’introduzione del buono lavoro CESU. Il capitolo III affronta l’evoluzione del sistema di welfare britannico, dalla formulazione della teoria della Terza via, fino alla recente idea di Big Society lanciata dal premier Cameron, passando attraverso l’analisi di modelli innovativi di governance, come quello dei quasi-mercati, che ha trovato una rilevante diffusione nei settori dell’educazione e della sanità. Il capitolo IV prende in esame il tema delle Intergovernmental relations nel sistema federale degli Stati Uniti d’America. L’analisi sugli strumenti di governance elaborati dalla dottrina americana per spiegare la complessità del sistema di welfare statunitense, porta alla luce la teoria della New Governance, che introduce una nuova prospettiva nel rapporto fra centri di governo e gli altri attori. A conclusione di questo elaborato si osserva come alla base dei modelli esaminati si ponga innanzitutto una precisa idea di uomo e del valore della sua iniziativa, la stessa idea che ispira il principio di sussidiarietà: non più l’individuo, ma la persona inserita e concepita all’interno dei gruppi sociali cui appartiene. La Big Society della Gran Bretagna richiama allora l’idea italiana di Welfare Society proposta dal recente Libro Bianco sul Welfare, mentre negli Stati Uniti prende le sembianze della New Governance, elaborata quasi trent’anni fa.

Texto completoThis study deals with the issue of workers’ social rights in the background of the economic crisis. The economic crisis has highlighted a set of problems about the sustainability of social rights, in a period in which the worrying level reached by public debts of many European States has led EU to reinforce the economic governance, imposing upon the States to respect some unflexible measures. As is known, in Italy, since 2011, some reforms are being adopted in the field of the work market and pensions, in the perspective both of tackling the high level of the unemployment and to decrease public expenses, as recommended by EU. Above all, during the period of the economic crisis, many criticisms have been addressed against Europe, because of its lacking level of democracy and, also, of an almost exclusive interest on economic and monetary aspects. Which space is reserved to social rights inside the European legal system? What kind of role has been conducted by the Charter of Nice on the protection of workers’ social rights, recognised by that document? In order to find a answer to these questions, it has been chosen to examine the Court of justice’s jurisprudence, after the Treaty of Lisbon’s came into force, with regards to the European social policy. The results of this research allow to prove that workers’ social rights are enhanced in a more satisfying way when they are functional to the growth of the historical fundamental principles of the EU, as, for example, the formal equality principle. The road of workers’ social rights seems uncertain, but not interrupted. Nevertheless, more satisfying results could be pursued if the Court considered those rights as a means for the fulfillment of the human being and not, instead, of the market.

Texto completoThe first chapter focuses on the historical development of the social rights, their emergence in the European continental constitutions and the peculiar relation of these rights with the public financial resources intended to foster them, assuring a natural closer scrutiny of the Italian Constitution. The same chapter includes the inquiry of the balanced budget amendment as resulted from the 2012 constitutional reform and its “European” roots. The definitions are completed with the study of the balancing test and its particularities in the decisions dealing with public financial demands and social rights. The following chapter targets specifically the constitutional case law and its singularities in terms of uncertainty and variability of the results of all the decisions regarding public budget dispositions. In order to ensure a correct balance between the aforementioned claims, these decisions present innovative techniques and the use of specific concepts such as the so called “essential core” of rights, with debatable consequences and questionable coherence. The study of the case law shows a tight connection with the issue of regional autonomies: the Italian regions have to respect strict budgetary constraints and are responsible for the supply of the main and most expensive social right: healthcare. The chapter provides an analysis of concepts such as “coordination of the public finance” and “harmonization of the public budgets”, all included in constitutional provisions. The dissertation shows how the most recent constitutional case law deemed public budget as a “public good”, thus as an essential instrument to ensure democracy and political accountability. The expansion of the role of the Court of audit and the aforementioned theme of healthcare regard the point of the regional autonomies and were worth a specific disquisition. The last chapter of the dissertation considers the issue under the European perspective, regarding both the Council of Europe, hence the case law of the European Court of Human Rights, and the European Union. An interesting new approach of the EU institutions can be inferred from the way the most recent pandemic crisis was faced, that is with a growing care for social rights rather than a mere concern for the balance of the budgets of the member States.

Texto completoQuesta tesi di dottorato si propone di offrire un contributo conoscitivo rispetto a due aree di indagine, tra loro connesse: come il volontariato organizzato interpreta oggi il proprio ruolo di tutela dei bisogni delle persone più svantaggiate, di promozione e difesa dei loro diritti, e che supporto ne trae, o potrebbe trarne, dalla valutazione dei risultati degli interventi realizzati, soprattutto per quanto riguarda la loro efficacia e il loro impatto sociale. Inoltre, il lavoro intende portare un contributo alla riflessione sui metodi di valutazione in ambito sociale, attraverso due applicazioni degli “esperimenti di scelta”. L’obiettivo è duplice: da un lato, approfondirne le condizioni di utilizzo in campo sociale, esplorandone potenzialità e limiti; dall’altro, ottenere informazioni aggiuntive sui valori che orientano l’azione dei volontari e comprendere se simulazioni di scenario - intese come valutazione prospettica - possano favorire lo sviluppo di ipotesi da sottoporre a successiva verifica (contributo in termini di valutazione preventiva di impatto). I risultati provengono da tre studi, realizzati nel 2009-2010, che offrono una lettura dei temi oggetto di indagine da un triplice punto di osservazione: quello dei testimoni privilegiati del mondo del volontariato; quello dei volontari; quello dei Centri di servizio per il volontariato, che a loro volta hanno valutato l’impatto dei progetti finanziati attraverso la rilevazione e il confronto dei punti di vista di tre soggetti: le organizzazioni di volontariato beneficiarie dei finanziamenti, i destinatari dei servizi realizzati dalle organizzazioni, i rappresentanti del welfare locale. Per la rilevazione dei dati si è fatto uso di metodi e strumenti quantitativi e qualitativi e degli esperimenti di scelta. I risultati ottenuti suggeriscono che per riaffermare la centralità dell’interesse generale e del bene comune e riportare al centro dell’attenzione la dimensione dell’uguaglianza, della solidarietà e dei comuni diritti di cittadinanza, il volontariato deve interagire con le istituzioni, fungendo da stimolo e coscienza critica rispetto alle situazioni di emarginazione, partecipando attivamente alla programmazione dei servizi e agendo in rete per aumentare la propria forza operativa e strategica, sempre nel rispetto del proprio ruolo e della propria autonomia, evitando rischi di strumentalizzazione o di istituzionalizzazione. I risultati mostrano anche come nel volontariato non ci sia ancora una diffusa consapevolezza dell’importanza di valutare gli esiti del proprio operato, con metodi e strumenti idonei, sebbene l’esigenza cominci ad essere avvertita, soprattutto dalle punte più avanzate del volontariato, ma anche dai soggetti finanziatori. Fare valutazione delle attività realizzate in termini di efficacia e di impatto sociale qualifica l’azione delle associazioni sul piano dell’operatività, della trasparenza e della responsabilità, perché permette loro di identificare le priorità di intervento, programmare le risposte in base ai reali bisogni delle persone e delle comunità, rafforzare la propria credibilità, creare sistemi di fiducia con le istituzioni e gli altri attori del territorio, ampliare gli spazi di influenza sociale. Per quanto concerne la riflessione metodologica, il percorso avviato con il contributo degli esperimenti di scelta appare positivo sia dal punto di vista dei risultati ottenuti, per la loro portata informativa, sia per quanto riguarda la trasferibilità del metodo ad ambiti di applicazione non consolidati, sia per l’apporto in termini di valutazione preventiva di impatto. Permangono invece alcune riserve in relazione alla fruibilità dello strumento, che risulta complesso e di difficile comprensione per alcune categorie di persone. Anche per questo sono auspicabili ulteriori riflessioni e approfondimenti che proseguano la strada intrapresa.

Texto completoQuesta indagine propone una lettura del sistema- rifugio italiano partendo dal paradosso della inclassificabilità del rifugiato, non più cittadino del proprio Paese di origine e non ancora cittadino del Paese di approdo, focalizzandosi su quello spazio liminale – a cavallo tra lo status di rifugiato e lo status di cittadino – in cui prendono vita le pratiche quotidiane tipiche del contesto del rifugio. Una componente del contesto italiano è la precarietà del confine tra protezione e abbandono che si rispecchia nella instabile possibilità di inserimento nei progetti nati per svolgere a vario titolo azioni di facilitazione nell'accesso ai diritti sociali dei rifugiati. Sono molti i rifugiati che nonostante l'esistenza di tali progetti si trovano in molti casi costretti a vivere in contesti marginali. Le categorie della cittadinanza e del rifugio non sono qui considerate come sole categorie giuridiche, ma come processi attraverso cui l'individuo si relaziona con il proprio sé e con i soggetti che incontra, e a seconda dell'ambito di potere in cui si trova. Tramite l'osservazione e la raccolta di testimonianze di chi quotidianamente si muove lungo la linea immaginaria che collega il mondo dei progetti a quello dei potenziali ospiti, questo lavoro di ricerca permette una rilettura del sistema rifugio ponendo in rilievo le sue contraddizioni nell'ambito delle relazioni tra la dimensione del terzo settore e delle istituzioni, tra le politiche e le pratiche afferenti a tali dimensioni e quotidianamente messe in atto nella relazione tra gli operatori e i rifugiati “dentro ai progetti” e nelle quotidianità al di “fuori dei progetti”. La lente attraverso cui si è scelto di procedere in questa osservazione, nella specifica esperienza della Toscana, è quella dei percorsi di accesso al diritto all'accoglienza e alla salute nel passaggio dalla loro titolarità alla effettiva esigibilità. Particolare attenzione è rivolta alle dinamiche che riguardano quelle persone rifugiate che appartengono alle cosiddette “categorie vulnerabili”. Il lavoro si interroga su quale sia e quale dovrebbe essere il ruolo dei progetti, e di chi vi opera all'interno, nell'accesso ai diritti dei rifugiati in generale e in particolare di quei rifugiati considerati in una condizione di prioritaria necessità di inserimento in percorsi di supporto nell'accesso ai propri diritti. In particolare, la ricerca viene a verificare se nel corso degli ultimi venti anni di esperienze nell'ambito del rifugio, in cui le “emergenze” si sono avvicendate all'ideazione di esperienze ad hoc e a momenti di riflessione sulle problematicità del processo, si sia effettivamente venuta a creare una “cultura del rifugio” a livello nazionale, che nella sua ipotetica coerenza interna risponda in maniera adeguata alle richieste del contesto

Texto completoThis work aims to demonstrate how the choice of methods of financing the public pension system has a direct impact on the adequacy of social benefits. The topic has a close connection with the legal conformation of social rights in contemporary Constitutions. Such a nature implies that social rights, considered within their variegated and constant expansion, are payable and can be executed. Their recognition should not be conditioned by the cost of the benefit. However, economic crisis that Italy and other European countries have faced during the last years has led domestic constitutional jurisprudence, as well as austerity policies, to adopt with particular caution decisions that would have produced uncontrollable and unsustainable costs. The need to reflect about the topic at hand arises from the recent events affecting the Italian pension system, among which there is the umpteenth decision to raise the retirement age operated by the Monti/Fornero Government. Subsequently, the same Government had to adopt safeguard measures for individual categories of workers to find a temporary remedy for the impasse created by the so-called "Esodati" category. All this has forced a question about the effectiveness of similar regulatory measures that make changes to the structure with the only purpose to meet the need of liquidity of public welfare administrations.

Texto completoThe thesis explores the theme of multifunctionality applied to agriculture as a means to reactivate the abandoned territory, degraded, at the risk of misuse or new construction. Agriculture has always had a fundamental relationship with the man and with the settlements. The relationship between urban and agricultural areas has been a relationship of union and opposition. In the transition from subsistence farming to intensive and specialized agriculture, have been involved spaces, techniques, tools, architectures related to agricultural activity and, finally, the relationship with the land. Agriculture, although produce essential goods, in the past decades has been considered a secondary element for economic reasons. There are clear cultural, scenic, ecological, social and economic values of agriculture but this is becoming less profitable and today agriculture is in serious difficulties involving the production, the sustainability , the role of the landscape and the social issues. The difficulties of agriculture also cause the inability of the areas to "defend" itself from the logic of land rent and use linked to immediate profit, as occurs in case of energy plants from renewable sources. All these issues should make territory planner to be careful so that he can find tools to enhance the potential of the agricultural areas. Clearly, the causes are not only economic but also linked to cultural patterns and lifestyles. Addressing the issues of rural areas, their productivity, land use and misuse, it is necessary to carry out a proper planning and sustainable points of view: not only the economic, ecological, historical and social but all of these together. The thesis explores the different European policies adopted to curb the crisis of agriculture. Studies and European documents identify the principle of multifunctionality in agriculture the tool to make the strongest agricultural land. Is useful to investigate, therefore, on the relationship between multifunctional agriculture and regional planning. In particular, we wanted to focus attention on the social aspects as a form of revitalization of the territory and, therefore, on agriculture as a service and social activity that creates cohesion. The questions that the research has set are two: multifunctional agricultural activities and their declination in particular social ones, can be a tool for economic revitalization, cultural and social development of rural areas, periurban and urban areas in a state of abandonment, deterioration, at the risk of misuse or new construction? Through what instrument or instruments such as the regional planning can use and exploit the potential of multifunctional agriculture? To answer these two questions we can't overlook the fact that, from the point of view of spatial and economic, agriculture is measurable in a relatively simple way. It is more difficult to measure the social aspects of the landscape and, therefore, need to refer to the qualitative analysis systems. In addition, the social farming purposes have rehabilitative, educational and business purposes but also related to spatial planning (environmental, economic, historical, cultural and social) and this has greatly been taken into consideration. Another aspect analyzed is the different European approaches to the forms of multifunctional and social agriculture, in the Italian context, and it investigates national and regional instruments that enhance agricultural activities multifunctional. It also explores the relationship between particular forms of social agriculture and areas confiscated from organized crime. The review of examples of multifunctional activities and the deepening of the case studies selected, showing how forms of multifunctional agriculture can revitalize the rural areas, periurban and urban areas. Finally, we arrive at the proposal of actions related to the integration of tools of territorial government, the integration of policies with traditional instruments, the spatial logic necessary to enable the potential of multifunctional agriculture can be considered service to the area and inhabitant.

Texto completoThe last decade of global economic and financial crisis has put a strain on the endurance of the continental democracies, which have had to counter the increasing public debt and the recession of their economies. The response of the EU's institutions, from the Ordoliberal point of view, so far, had been to tighten further the financial constraints to ensure the maintenance of public accounts. This tightening of restrictions has reverberated its (negative) effects also on welfare systems. The EU has a great challenge ahead of it. Starting again in the "after crisis" from the construction of an European social model that puts people at the center, trying to create an "European Pillar of social rights". In order to do this, it will be essential to give the European institutions new and greater skills and more relevant intervention capacities that have been unknown hitherto. This process of transformation follows the natural evolution of the process of European unification. If this path were interrupted, the same permanence in life of the Union would be at risk. The protection of social rights and in particular of the right to health, understood in a broad sense as protection of the person and of his psycho-physical wellbeing, is the path to greater integration between peoples and one of the fundamental elements for the creation of a united Europe that the European Founding Fathers had in mind. It is essential to "review" the economic policies at the supranational and national level with a view to preventing them from impinging on the level of protection of social rights. Finally, it was intended to offer a range of concrete measures that the European legislator can adopt with the primary purpose of creating a genuine European health policy and actively protecting the right to health of European citizens.

Texto completoThis thesis highlights the reasons why the current structure of the European Economic and Monetary Union has not been able to cope effectively with the effects of the global financial and economic crisis that broke out in the USA in 2008. In particular, since the introduction of the euro as single currency, there have been significant trade imbalances in the balance of payments of the EU Member States. However, until the outbreak of the crisis, these imbalances were concealed by the substantial break-even of Target 2 balances. Nevertheless, once the crisis broke out, a so-called sudden stop caused the collapse of the most important credit institutions of the peripheral States, which showed a clear over-exposure to credit. The rescue of these banks by public finances turned the private sector debt crisis into the so-called sovereign debt crisis. The procedure for macroeconomic imbalances, provided for by EU Regulations 1174/2011 and 1176/2011, was therefore established with the aim of monitoring also the imbalances relating to the private sector in Member States. However, certain thresholds of the indicators used for the scoreboard of this procedure show a clear underlying asymmetry. In this respect, the indicator on the current account balance is particularly significant. While the threshold for surpluses is set at 6%, the threshold for deficits is set at 4% proving that, compared to the former, the latter are considered more dangerous for the macroeconomic stability of a State. It follows, however, that, by considering debts and credits symmetrically, the procedure ends up attributing the greatest efforts at macroeconomic correction to the debtor Member States. This asymmetry therefore seems to contrast to the principle of equality among the Member States of the Union, as enshrined in Article 4 of the TEU and provided for in Article 11 of our Constitutional Charter. Moreover, the executives of PIGS Member States in adopting the most important national reforms post-2011 seem to have mainly complied with the recommendations of the procedure. This correlation therefore has two different implications, both of which are relevant from a constitutionalist point of view: on the one hand, the relationship between the political community and constitutional bodies has been affected, with repercussions on the functionality of political representation understood as a relationship and not merely as a position; on the other hand, there has been a surreptitious extension of the competences of the Union institutions, beyond the limits outlined by the principle of attribution pursuant to Article 5 TEU. With reference to this principle, it can therefore be seen that MIP recommendations relate to areas which would fall within the exclusive competence of the individual Member States, such as public administration, research and development, social security, taxation, health and social policy, and even go so far as to provide judgment on constitutional reforms. On the other hand, MIP recommendations do not seem to have significantly conditioned the political-legislative bodies of the surplus states, Germany above all, in developing their national policies. In this regard, there is the clear failure of the German governments to implement the repeated recommendations calling for greater public investment and a general increase in wages, in order to rebalance the relative national trade balance. This situation can probably be ascribed to the different political weight of the French-German axis compared to the much weaker one of the peripheral states. It therefore seems possible to conclude that the enforcement of the Procedure is intrinsically political, as the coercive degree of the recommendations, which are legally on the same level, seems to be linked to the credit or debt exposure of the various Member States.

Texto completoThe study shows the existence of an European constitutional dimension of values and principles including the CEDU and the national constitutions, establishing the presence of an European public order underlining the display of a constitutional European system. The research tries to prospect the existence of an European integration at juridical level, granting the European juridical pluralism, highlighting the identity of each system, unifying the process of integration and the defense of pluralism, showing a defective juridical situation related to the granting of fundamental rights. The study appeals to the concept of public order that states the unity of juridical systems defining the concept of European constitutional pluralism through the mutual acknowledgment and achievement of a constitutional dimension. Among both the concepts of formal constitution and real constitution, it is preferred that of Verfassung ,real constitution. The concept of public order retains and gives values to the differences and conflicts and becomes the result of the conflict between the retention and promotion of values and fundamental principles. It is added the concept of public economic order as a variable category that marks the beginning of a new law that prevents and settle social conflicts. The public economic order oppose the abstract nature of old orders through the legislation of social categories where the contract is subject to rules of contractual typology and to the legal entity of the parts. The conceptual innovation that brings to the distinction between the two concept of public order and public economic order is the statuale base : the concept of public economic order is based on the forms of social State where the social justifies the public intervention in economy, becoming a legal notion of political and social economy. The relationship between law and economy appears important to better understand the meaning of the category of public and economic order: it is marked the need to create real and non-abstract conceptions of the system and to recover the experience of human relationships and that of the interpersonal communication. The proposal of a general theory in an economic setting reveals the deficiencies of an abstract method together with the need of a “new anthropology” upon which the subsidiary concept is based. The new typology gives value to the autonomy and to the ability of the individual and it is consequence of the natural auto govern of the human person. An analysis of the relationship between the economic order and the juridical system follows: social rules join the subsidiary role of institutions that provide for the deficiencies of procedures. There is a communication between the two subjects through which the concept of communication gains importance, thus supposing a system upon which the subsidiary intervention of institutions that work for the welfare of community life is based. The new concept of public economic order becomes a category that mediate the interrelations among the principles of the Community system and the rules of the Community market. The economic development and the social progress are the two cornerstones of the category, always tending towards a balance between the two purposes , identified at European levels as fundamental values and interpreted from the law of the Court as basic for its decisions. It is underlined the fulfillment of the concept in the Community setting in which the need of defending economic freedom has been associated to the protection of other values. The balance for the achievement of the public economic order lacks in many areas of international law where the concept of free trade prevails over social values and human person.

Texto completoLa ricerca ricostruisce la nascita e l’evoluzione dell’associazionismo politico femminile nel Veneto dalla Resistenza agli anni Sessanta, con particolare riferimento alla storia delle due maggiori organizzazioni, l'Unione Donne Italiane e il Centro Italiano Femminile. Due sono gli obiettivi di questo studio: delineare un profilo dell’associazionismo femminile, per cogliere continuità e rotture con il più ampio contesto nazionale e, al contempo, analizzare l’impegno nel settore della tutela della maternità e dell’infanzia e del lavoro delle donne. Questi temi hanno lo scopo di analizzare e inquadrare la ridefinizione della cittadinanza politica femminile che prende avvio in questi anni. In particolare, l’analisi evidenzia come, malgrado le due associazioni siano mosse da presupposti e obiettivi differenti, vi siano invece tentativi di avvicinamento delle donne dell’Udi al movimento cattolico fin dagli anni Quaranta, e negli ultimi anni Cinquanta si giunga alla convergenza, o comunque alla costruzione di relazioni trasversali tra le due associazioni. La ricerca, inoltre, evidenzia l’importanza dell’affermarsi di un protagonismo femminile pubblico, e il suo peso nella modernizzazione del Paese e nell’anticipazione e nell’elaborazione di riforme complessive nel settore dei diritti civili e delle politiche sociali.

Texto completoAfter the outbreak of the food price crisis in 2007 – 2008 a new practice, known as land grabbing, has emerged on the international scene. The race to land is generally understood as the phenomenon of large-scale investments in land by foreign investors, which include both States and private companies, especially in developing countries. Driven by the necessity to attract foreign capital and finance infrastructure projects, developing countries have implemented favorable Foreign Direct Investment (FDI) policies, thus allowing the purchase or lease of fertile land lots, for rather meager rental prices and long terms (usually ranging from thirty to ninety-nine years) . Formally, these investments are directed towards the production of raw materials, necessary to address food and energy requirements, in particular for those countries which are net importers of agricultural products. The host State may well then decide to conclude lawful deals with the investors towards this aim. Prima facie, therefore, the conclusion of investment contracts in land apparently reflects the host country’s exercise of permanent sovereignty over its natural resources, which has the full right to regulate the exploitation thereof. Nevertheless the analysis of the phenomenon of land grabbing raises some doubts in relation to the compatibility of this practice with current international law norms. Such investments potentially carry a number of high risks to the population of the host country, in particular in terms of access to land and food supply. It is likely, in fact, that on the land subject to a given investment, there may already exist crops or herds of rural communities, who use the land by virtue of custom or usage rights, usually granted a lower level of protection if compared to the formal titles of ownership, rare at best in most developing countries. In some regions of the world, the holders are therefore particularly vulnerable to displacement, given the difficulty to exercise their uncertain land rights and to obtain, as a result, adequate judicial protection. Equally worrying, environmentally, is the implementation of investment contracts aimed at exploiting land to farm biofuels or realize large plots of monoculture, thus reducing the possibility to keep adequate land biological diversity. After the analysis of the juridical significance of land grabbing and the identification of its autonomous legal characterization, the thesis examines the question of the legitimacy of the race to land with regards to the exercise of permanent sovereignty over natural resources by the host country, especially in those cases where the alienation of land generates considerably negative externalities on the local population: sovereignty cannot, in fact, be exercised without due regard to the specific obligations incumbent upon States under international law, related, in particular, to the protection of human rights and the environment.

Texto completoThe study explores and discusses the specific national framework of Labour Law and Labour relations system in the agricultural sector. The study reveals that the country has a quite exhaustive structure of labour legislation and collective bargaining but practically the labour laws and contractual protections are inappropriate in terms of effective tutelage of workers' needs and does not reflects the evolution of the agricultural sector and its heterogenity of products and markets.
