Resumen
This chapter examines Article 40 of the Vienna Convention on Diplomatic Relations which provides an outline of the duties of third states during diplomatic missions. The Article states that if a diplomatic agent, together with his family, passes through or is in the territory of a third State, the third State shall accord them inviolability and such other immunities as may be required to ensure their transit or return. The Article also states that in similar circumstances, the third State shall not hinder passage through their territories. Also, third States shall accord to official correspondence and other official communications in transit, including messages in code or cipher, the same freedom and protection as is accorded by the receiving State. Lastly, the Article states that the obligations of third States written in this Article shall also apply to the persons mentioned, and to official communications and diplomatic bags, whose presence in the territory of the third State is due to force majeure.

This chapter considers the first sentence of Article 27.1 of the Vienna Convention on Diplomatic Relations which discusses the freedom of communication given to all members of the diplomatic mission. According to the Article 27.1, the receiving State shall permit and protect free communication on the part of the mission for all official purposes. Representatives from the sending State may employ all appropriate means, including diplomatic couriers and messages in code or cipher, in communicating with their Government and the other missions and consulates. However, if the mission wishes to use a wireless transmitter, it must first have consent of the receiving State. Without the right of free communication, the mission cannot effectively carry out two of its most important functions—negotiating with the government of the receiving State and reporting to the government of the sending State on conditions and developments in the receiving State.

The modern doctrines of State responsibility and reparation are the result of more than 2,000 years of human thought. This chapter traces the history of some of the most important components of State responsibility and reparation. The origins of these concepts are found in the historical roots of the civil law doctrines of extra-contractual liability and the remedy of restitutio in integrum, from Roman times until their entry into European civil codes. It explains how the private law notions discussed entered into international law and how, from the fusion of these notions and concepts with those supplied through the evolving doctrines of reprisals, denial of justice, and diplomatic protection, the modern doctrines of State responsibility and reparation were born.

This chapter examines how Korea adapted Chinese cultural, political, economic, and diplomatic models to fit the peculiarities of the peninsula. Detailed records on people inhabiting the Korean peninsula appear in Chinese histories from the third century AD. Until the mid-fifteenth century, Koreans did not develop their own script but either wrote in Chinese or adopted individual Chinese characters to write Korean. Such mastery of a radically different language also brought with it a fluency in Sinitic civilizational codes that could be used or ignored to fit local circumstances. However, the use of Chinese does not mean that the content always or even sometimes obeyed Chinese historiographical and social norms. Purposeful violation of those norms offered the peoples on the Korean peninsula the room to develop their own identity.

In late imperial China, interpersonal relationships played a crucial role in Chinese officials’ reactions to international law in 1900. Shaped by Confucianism, interpersonal relationships significantly influenced Li Hongzhang in his internal relations with his rivals and his relations with foreign diplomats. They determined his strategy for dealing with the West more than the contents of any Confucian code. However, there was nothing mysterious about the Chinese system. The British ambassador, Ernest Satow was fully competent to penetrate Chinese bureaucracy and could work to uphold a British understanding of the balance of power, which included maintaining the unity of China. Satow formed partnerships with many other senior Chinese officials besides Li. So, neither the ideologies nor idea systems of Confucianism and Western international law as bodies of rules played a significant role. Everything depended upon the individual skills and sense of responsibility of particular persons such as Li and Satow.
