Texto completoThe research aims to provide a framework of the different stages of development of the relations between the Court of Justice of the European Union and the European Court of Human Rights, which appear, at present, still subject to further definition. The study of case law focusing on convergences and divergences between the two European Courts is the analysis tool more appropriate to observe this interaction. Though the analysis of the most important case law of the two supreme European Courts gives account of a well-established dialogue between the Court of Justice of the European Union and the European Court of Human Rights on the protection of fundamental rights, is not completely averted the risk of different interpretations of the same rights: the different approach regarding ne bis in idem principle represents a clear demonstration of this contrast. In this context, the need for a cooperative relationship between the two courts emerges clearly, for the first time expressis verbis, from Declaration n. 2 on Article 6, par. 2 TEU, which provides that “The Conference agrees that the Union's accession to the European Convention for the Protection of Human Rights and Fundamental Freedoms should be arranged in such a way as to preserve the specific features of Union law. In this connection, the Conference notes the existence of a regular dialogue between the Court of Justice of the European Union and the European Court of Human Rights; such dialogue could be reinforced when the Union accedes to that Convention”. Therefore, it is inevitable the “institutionalization” of the judicial dialogue, to resolve permanently problems arising from the continuous and persistent convergences and divergences between the two European Courts. This institutionalization will introduce an external review of the European Court of Human Rights on the Court of Justice of the European Union as a “bastion” for the protection of fundamental rights in the European Union system. In this perspective, the solution of the problems of coordination between the case law of the two Courts is ensured by the future (or futuristic) agreement on the accession of the European Union to the European Convention on Human Rights. The debate has become more than ever actual thanks to the latest developments that have affected the process of the accession of the EU to the ECHR in the aftermath of the Opinion 2/13 of the Court of Justice (Full Court) of 18 December 2014. It has temporarily blocked the process of EU accession to the ECHR and, therefore, the “formalization” of the dialogue between the courts of Luxembourg and Strasbourg and has clearly shown that there are still some obstacles to the “institutionalization” of relationships between the two courts. Texto completoThis PhD thesis explores the mental health’s legislation and attempts to identify ways of redirecting the Italian model. We can affirm that the constitutional rights constitute guarantees orientated to protecting certain values or fundamental goods to reach a worthy life; being the maximum expression of the dignity it humanizes. In this respect we will raise the first axis of analysis with the relation between mental health and constitutional rights in the strict field of the investigation. Based on personalist model, will be proposed an analysis of the psychiatric deinstitutionalization process carried out in Italy, from the decade of the 80s, after the approval of the Psychiatric Reform. Based on the right to health, it is proposed to speak of “right to have rights” (diritto ad avere diritti), that is to say, the right of mentally ill people to be helped, day after day, in the enterprise to reconquer the own personality, the honor, the privacy, the image and the personal identity. The Mental Health Act, adopted in Italy in 1978, is considered as point of renew and strengthen opportunities, obligations, duties, which may fulfill the purposes set out in the regulatory framework, which has as its foundation and the human recipient and thus the satisfaction of all their needs and rights, so that in this form, is integrated into their life experience, benefit and personal, social and cultural experiences aiming to progress and achievement.
Esta tesi doctoral examina la legislación en materia de salud mental en Italia y intenta discernir los medios para reorientar el modelo italiano. Podemos afirmar que los derechos constitucionales constituyen garantías orientadas a proteger ciertos valores o bienes fundamentales para alcanzar una vida digna; siendo la máxima expresión de la dignidad humana. En este sentido plantearemos un primer eje de análisis con la relación entre salud mental y derechos constitucionales en el campo estricto de la investigación. Partiendo del modelo personalista, se realizará un estudio sul proceso de desinstitucionalización psiquiátrica llevado a cabo en Italia, a partir de la década de los años 80, tras la aprobación de la Reforma Psiquiátrica. Partiendo del derecho a la salud, se propone hablar de los “derechos al derecho” (diritti al diritto), es decir, del derecho de los enfermos mentales a ser ayudados, día a día, en la empresa de reconquistar la propia realidad, el decoro, la intimidad, la imagen y la identidad personal. La Ley de Salud Mental, expedida en Italia nel 1978, ha servido para renovar e reforzar oportunidades, obligaciones, deberes que han logrado los propósitos establecidos en el marco normativo, que tiene como fundamento y destinatario al ser humano y con ello, la satisfacción de todas sus necesidades y derechos fundamentales, para que de dicha forma, se integren a su experiencia vital, beneficio e integridad personal, social y cultural en vivencias encaminadas a el progreso y la realización.

Texto completoThe research aims at investigating the interaction between technical-scientific knowledge and law, adopting the perspective of technical legislation. Having defined technical rules as those rules, binding or voluntary, which are elaborated on the basis of technical-scientific facts, the research consists in an analysis of three sectors of the legal system which are characterized by a high impact of scientific knowledge (clinical trials, industrial emissions, product safety standards). The technical rules operating in each of these sectors have been identified and investigated, both from a formal perspective (in which legal sources are they incorporated? Which is their nature?) and seeking to highlight the decision-making process leading to their adoption. The results of the empirical analysis are then systematized from two complementary perspectives: primarily from a dogmatic standpoint, pointing out the mechanisms through which technical-scientific facts enter the domain of law (incorporation within the legal rule, general clauses, reference), and the tensions they determine in relation to the system of the sources of law. Secondly, the analysis of the decision-making processes aims at highlighting the different factors of legitimacy that come into play in the adoption of a technical rule, and in particular the interaction between political-constitutional legitimacy and technical-scientific legitimacy.

Texto completoThe present research aims to studying Christian arbitration in the American legal system, as a method of alternative resolution of civil disputes between private parties, which is implemented through the application of biblical precepts and the pronouncement of an arbitral award binding on the parties. The analysis starts from an historical premise, illustrating some notes on the ‘episcopalis audientia’, an institution that from about the third century A.D. was configured as a means of resolving private disputes of the faithful entrusted to the bishop’s knowledge. Further, advancing on contemporary grounds and outlines the discipline dictated by the U.S. system in both terms of arbitration and religious freedom, as an essential basis to fully understand the institution of Christian arbitration and the attitude of the court system before such a phenomenon. The research outlines the formulation of the Christian arbitration clause and the procedural rules drawn up in English by the Institute for Christian Conciliation, the most authoritative of the bodies currently offering the possibility of that type of arbitration. Finally, the critical issues arising in connection with this institution will be taken into consideration, which will be illustrated on a case-by-case analysis and with the help of the prescribed doctrine. This will make it possible to bring to light some conclusive reflections on the legitimacy and convenience of this instrument and on the possibility of implementation of a similar initiative within the Italian legal system.

Texto completoThis research work, in examining the political thought of Mohamed Talbi, proponent of a model of contemporary Islam that, in the universe of countless Islam, is characterized by its propensity for dialogue and openness with other cultures, aims to combine the author's contribution with the history of the Maghrib, the humus in which this thought is born and has its roots. An argument developed recognizing the importance of the role of the past in defining the present of Islam in an attempt to provide a historical framework to the religious, cultural and political perspective proposed by Talbi. The underdeveloped Arab historiographical tradition of the contemporary Maghreb and, at the same time, the need to identify an interpretation not contaminated by the Western lens that allows to combine the reflection on Islam religion within the framework of Islamic society, have led to the examination of the historical period opened by European colonialism. In the first part of the research, from a methodological point of view, it was considered appropriate to focus attention on authors belonging to the Maghrib area, including the most significant contributions of a literature that stands on the border between the non-Western matrix and the influences of the Western world. In the analysis of the historical interpretations of the period taken in consideration, from the years of colonialism to the dawn of independence in the states of the Maghrib area, in Morocco, Algeria and Tunisia, it have been identified studies and sources that contributed to the work of deconstruction. Particular attention was dedicated to the scientific production of Abdallah Laroui and to the work published in 1970 entitled "L’histoire du Maghreb: un essai de synthèse", in which a deconstruction of colonial historiography is initiated. The historical excursus contributes to providing tools for understanding the roots of the serious identity crisis in the Maghrib and Islam and the relationship between a West perceived as an entity that promotes reformist demands often interpreted as external impositions. In the second part, the historical analysis is intertwined with the thought of Mohamed Talbi and with the contribution for the development of a new contemporary Islamic thought that combines the sacredness of the Quran with the needs of the current world through the abandonment of a literal interpretation and the adoption of a discretion that takes into consideration the specific temporal circumstances in respect of the divine word. A view of universality of the message of the Quran through an exegesis that the author defines as "finalist". From the reinterpretation of Islamic sources to the Islamic-Christian dialogue between the two shores of the Mediterranean, passing through the eradication of violent extremisms and the right to freedom of conscience, Talbi elaborates a paradigm that aims to free us from all those hidden sediments that prevent from founding our societies on dialogue and mutual respect beyond any religious and cultural peculiarity.

Cold war scenery and nuclear threat are analyzed as specific situations that cause humanity to face a pantoclastic perspective for the first time. The end of the cold war, post-colonialism and new kinds of conflict allow globalization challenges to peace to be taken. The way pedagogical reflection has interiorized these changes is thus analyzed in order to propose non anachronistic educational programs that enable people to cohabit with contemporary complexity, using it in a proactive way. Analysis about practical strategies such as conflict resolution, memory and reconciliation conclude the research.
