Resumen
This paper deals with the constitutionality of involuntary treatment of opiate addicts. Although the first laws permitting involuntary treatment of opiate addicts were enacted in the second half of the nineteenth century, addicts were not committed in large numbers until California and New York enacted new civil commitment legislation in the 1960s. Inevitably, the courts were called upon to decide if involuntary treatment was constitutional. Both the California and New York courts decided that it was. These decisions were heavily influenced by statements made by the United States Supreme Court in Robinson v. California. The Robinson case did not actually involve the constitutionality of involuntary treatment; it involved the question of whether it was constitutional for a state to make addiction a crime. Nevertheless, the Supreme Court declared (in a dictum) that a state might establish a program of compulsory treatment for opiate addicts either to discourage violation of its criminal laws against narcotic trafficking or to safeguard the general health or welfare of its inhabitants. Presumably because the Robinson case did not involve the constitutionality of involuntary treatment of opiate addicts, the Supreme Court did not go into that question as deeply as it might have. The California and New York courts, in turn, relied too much on this dictum and did not delve deeply into the question. The New York courts did a better job than the California courts, but their work too was not as good as it should have been.

In 2012, families in California filed a lawsuit alleging that five state statutes governing teacher tenure, dismissal, and seniority together violate the state constitution’s requirements for equal protection. Central to the case were competing narratives about the relationship between these statutes, the work of teachers, and the achievement of students. This article analyzes those narratives utilizing the trial court transcripts and judicial opinions in Vergara v. California. We find that despite reaching divergent rulings, the trial and appellate courts provided highly typified accounts of the case—ones that emphasized individual agency and dismissed or deemphasized the importance of the social and political context of schooling. These findings are important for understanding how complex policy debates become transformed within legal proceedings and for understanding the capacity of courts to engage complex evidence and narratives—a major issue given that courts remain an important venue for school reform.

Architect Clifford Ham served as the Project Director and Principal Architect for the Judicial Council of California Administrative Office of the Courts. He was responsible for overseeing more than 450 court facilities throughout California. Projects ranged from renovations and small single court buildings in remote locations to new multistory (31 and 71 multiple purpose courtrooms) in dense major urban areas. As an architect, with courtroom design experience, he was able to efficaciously support all aspects of design, engineering, and specialty consulting. Throughout the process, projects were implemented to effectively meet the needs of various stakeholders. California Trial Court Facilities Standards, covering all aspects of architectural design and engineering, had been developed when the program began in 2006, with minor revisions leading up to the new 2020 edition. Revisions gained from first-hand experience emphasized changes in the guiding principles and updated technical areas which influenced the design and cost of courthouses. This presentation will review the discuss significant aspects of the overall courts program with specific emphasis on acoustics. Case study examples will present some interesting subtleties in the planning and design process that should be realized to avoid costly follow-up repair solutions after occupancy.

When the duty to protect of Tarasoff was imposed upon psychotherapists by the Supreme Court of California, therapists in other states wondered whether or not other courts would adopt the legal reasoning and apply the Tarasoff Principle to them. Resulting court decisions have been much more complex and contradictory than this early question would suggest. Even the legal underpinnings of the Tarasoff Principle, where it has been adopted, are diverse: it is as amorphous and plastic as any principle can be, molded so differently by various courts. This updated review argues that the trend toward diversity and inconsistency has become greater with the increase in Tarasoff-like cases in recent years, beclouding any real moral value that may be present. Given the conflicting social values involved in this kind of public policy, it is best crafted in statutory law, not by the courts.

This paper discusses the rather blurred distinction between fees and taxes, particularly for states like California where enactment of a tax requires a two-thirds vote while fees can be enacted with a simple majority. We discuss the California Supreme Court decision in Sinclair Paint wherein the Court adopted a broad definition of a fee. Many taxpayers feared that this would open the flood gates for enactment of fee legislation both in California and nationwide. We examine recent legislative and judicial trends in enactment of fee legislation and court interpretations following Sinclair Paint. The data shows that the Legislature is actively pursuing all types of fee legislation as budget dollars do not stretch far enough to cover program expenditures. Courts are continuing the Sinclair Paint trend of broadly defining fees. The result seems to be an ever increasing fee burden on businesses and taxpayers.

According to the Department of Homeland Security, Office of Immigration Statistic, California accounts for approximately 2,600,000 illegal immigrants in 2009. This number represents about 25 percent of the entire estimated illegal immigrant population in the United States, which is roughly 10.8 million. Between 2003 and 2008, the U.S. government removed 1,446,338 noncitizens from the United States. This rise in deportation is a result o the changes that have been enacted by the federal government over the years that transformed the nature of immigration enforcement. This thesis explores the California Immigration Enforcement system from the programs established to apprehend illegal aliens in the United States, the rights illegal aliens are granted, the detention facilities where they reside and the immigration courts that ultimately decide their fate. The question that is being asked is whether the current system established works or if reform is needed.

Since the passing of Proposition 47 in California in 2014, drug court programs across the state have invariably undergone changes. In my thesis, I evaluate the drug court programs of three counties in Southern California: Orange County, Los Angeles County, and Riverside County. Through a qualitative analysis of the drug court programs in these counties, via interviews, data collection, and courtroom observation, I provide insight into the functionality of each county's program, as well as an analysis of the effects of Proposition 47. This paper aims to address the key factors involved in maintaining a functional and successful drug court system.

Over the last fifty years, California has become one of the largest jailers in the world, incarcerating nearly 128,000 men and women on a $10.5 billion budget. The prison population has rapidly risen over this period, resulting in overly crowded, chaotic prisons and jails that became increasingly difficult to manage. As correctional officers and officials lost control over the prison social order, inmates looked to themselves and created a new set of social norms through race-based gangs. What began with the formation of the Mexican Mafia in 1957 now dictates prison social life, where racially segregated cells, cafeterias, yards, and gyms are the new norm. In an attempt to manage this new social structure, the California Department of Corrections and Rehabilitation unofficially employed the use of racial segregation during the intake process for prison housing. The practice was challenged and eventually overruled in the 2005 Supreme Court decision Johnson v. California, but the State continues to struggle with compliance on multiple fronts. This thesis examines the history and development of race-based gangs in California in an attempt to understand how to manage the racially segregated world of prisons today. It finds that tensions between the courts, the State, and the inmates are ultimately perpetuated by the continuance of racially segregation policies, and it will ultimately take the political will of Department officials to eliminate race-based gangs and enact cultural change.

Resumen
The state of California has one of the largest and most violent gang populations in the United States. Although there have been a variety of anti-gang measures and policies enacted by local and state governments, none have been more effective than the Civil Gang Injunction (CGI). This civil action prohibits certain street gangs, and their members, from participating in activities that would otherwise be considered lawful. In order to obtain an injunction a prosecutor must demonstrate to the court that the gang is engaged in ongoing criminal conduct and represents a public nuisance to a geographically defined area. When a neighborhood is under an injunction, not only is police presence in the area increased but officers are also given more freedom to investigate and apprehend gang members who are suspected to be in violation of the terms. As this thesis will argue, injunctions, when used correctly, have proven to be an effective weapon in diminishing the influence of territorial street gangs on community well-being. When used incorrectly, however, they often only provide a temporary fix to a long-lasting problem. They also have been known to contribute to an increase in crime in neighboring areas, an increased number of wrongful arrests, and in some cases they have promoted criminality amongst young people. To explore the efficacy of injunctions, this thesis will focus on three empirical studies that cover a period from 1993 to 2003, when the rates of gang-related violence were at an all-time high and injunctions became the primary tool for City and District Attorneys to combat the nuisance. Two of these studies argue that injunctions have a positive impact on violent crime statistics, whereas the third concludes that they do not. By comparing these conflicting pieces of quantitative evidence, this thesis aims to gauge the actual effect of injunctions on crime rates and weigh the perceived benefits of this measure against its unintended negative effects.

Resumen
The purpose of the project is to develop and evaluate a writing unit that could be used to teach adult students in a drug court program. The project is based on theories behind narrative therapy, its use in the treatment of persons with addiction problems, and how the reframing of students' own life stories through writing can bring about change. By using writing prompts as both therapeutic and educational tools, the author hoped to improve the students' life-coping skills and their writing abilities. The unit consists of paragraph writing, essay writing, reflective writing that focused on past events, and using computers to compose and format texts. The author evaluated a preliminary draft of the unit by submitting it to four education professionals with a questionnaire. Data was also collected from the author's students by means of surveys, interviews, and writing samples. Feedback from the professionals and the students guided the revision of the unit. The questionnaire, survey, and interview questions used in the project and the preliminary and final revised drafts of the teaching unit are included.

This chapter discusses the rebel effort to construct a Palestinian state, a project that reached its height in 1938. It details the extent to which competing rebel commanders were able to set aside their differences and come together for the greater national good. In addition, the chapter discusses the proliferation of a rebel court system, which was integrated under a high court and operated throughout Palestine. These courts conducted their business in the stead of the mandatory courts, which the Arab Palestinian population had abandoned en masse. The chapter further discusses the tendency of scholars to gloss over this rebel state-building effort and also to underplay the British role in crushing the nascent Palestinian state.

This paper describes a multinational program aimed at teaching processes and methods for sustainable product development using multidisciplinary project-based teams. The foundation course teaches processes for designing sustainable products and services, metrics and evaluation methods through a combination of lectures, project work, and examination of actual business cases. It is to be followed by courses on green manufacturing and pre-commercialization planning. The program features bi-national collaboration between the U.S. and Mexico, motivated by our shared vision for the development of sustainable solutions in a global context. The exploratory foundation course of the program, Design for Sustainability, was taught in Fall 2007 at the University of California at Berkeley with students and faculty members from 14 disciplines and three institutions: University of California at Berkeley (UCB), the California College of the Arts (CCA) in San Francisco, and the National University of Mexico (UNAM) in Mexico City. This paper describes the course content, project experiences, faculty evaluation and student lessons learned from the foundation course as well as a proposed three-phase strategy for future program development.

This paper presents the results of a study conducted by Itron, Sustainable Conservation and Bowen & Associates for the Sacramento Municipal Utility District (SMUD) to investigate the status and costs of controls for reducing emissions of oxides of nitrogen (NOx) from small (100 to 300 kW) reciprocating engines operating on biogas from dairy digesters. During the course of the study, it became apparent that simultaneous environmental policies have created a fundamental “catch 22” situation for California’s biogas industry. On one hand, California air quality regulations require distributed generation (DG) technologies to achieve aggressive emission limits for control of oxides of nitrogen (NOx). At the same time, California’s Governor and Legislature have passed landmark legislation calling for GHG emissions to be reduced by twenty-five percent to 1990 levels by no later than 2020. A “catch 22” occurs because while DG technologies, particularly biogas fueled technologies, can play a key role in reducing GHG emissions, NOx control technologies needed to meet the required NOx levels have not matured to commercial readiness. This requires project developers to take substantial risks on both the financial and technical front without the likelihood of recouping their investments. The result creates an impasse that potentially deprives California not only of forward progress in reducing GHG emissions but forestalls significant interim NOx reductions that could otherwise be achieved. However, the situation highlights a problem that extends beyond California’s borders and the biogas industry: how to simultaneously achieve aggressive air quality targets while making significant reductions in greenhouse gas (GHG) emissions. This paper presents the findings of an investigation into proposed NOx emissions limits for biogas to energy applications and how those requirements interact with policies to reduce GHG emissions.

Aim/Purpose: To investigate anxiety in online courses and its relationship with overall online courses satisfaction as it may vary with online courses experience. Background: Delivering online courses in higher education institutions continue to increase. Anxieties seem to be persistent. Although there are many technology and internet related anxieties studies, online courses anxieties are relatively scarce. The cause for this anxiety has not been resolved or addressed sufficiently. This study takes part in this quest. Methodology: A fully online course with not face to face interaction was used for the study. A survey methodology approach was used for the anxiety scale measurements. Over 1400 students participated in the survey. Contribution: Students taking online courses continue to be challenged with anxieties. Their experiences (number of courses taken) with online courses may influence their anxieties and satisfaction levels, but that has not been studies. We contribute to this body of literature. Findings: One third of students reported to continue to experience anxiety while taking their online courses. The effect of their anxieties on their satisfaction does not seem to be influenced by their online course experience. Recommendations for Practitioners: Focus on the various elements that may influence anxieties and satisfaction of students while taking courses. For IT designers, interface and point of interactions may be the aspect to pay attention to, while professors would need to consider course pedagogy and its interaction within the IT learning environment. Recommendation for Researchers: Anxiety in online learning should take front stage as it represents an underlying stream of influence on all research in the field. Further study of the effect of online course experience on satisfaction and anxiety is necessary. Impact on Society: Anxiety in learning has many detrimental effects that last a student’s career and personality over their entire life. The impact of reducing anxieties while online learning is significant and tangible especially that online learning is at its initial stages of an exponential growth and will change the world sooner than later. Future Research: Pedagogy for efficient and effective online courses to reduce anxieties and in-crease satisfaction.

This presentation provides an overview of conversion technologies, their potential benefits and applicability to solid waste management, and the efforts to develop conversion facilities around the country and specifically, California, including Los Angeles County’s model for development. The Southern California Demonstration Project spearheaded by Los Angeles County is a unique project that proposes to develop up to four conversion technology demonstration facilities throughout Southern California, potentially the first of their kind anywhere in the U.S. These facilities will be collocated with material recovery facilities and will be designed specifically to process municipal solid waste residuals.

This paper documents the process, the outcomes and the lessons learned from two design courses aimed at incorporating environmental, economic and social concerns during the product development process. These courses are co-taught by professors of the Engineering and the Industrial Design Schools of the Universidad Nacional Autónoma de México (UNAM). Each course lasts one academic semester and includes engineering graduate and undergraduate students from industrial design and engineering. The two courses are “New Product Development” (NPD) and “Design for Sustainability” (DS). The NPD course runs in collaboration with the University of California at Berkeley (UCB) and it has been taught at UNAM since 2008. The course fosters the development of product concepts that address particular user needs related to sustainability issues and enhance user’s experience and innovation. The DS course is aimed at introducing students to the most representative approaches, methodologies and tools related to sustainability. DS takes the NPD process as a background, i.e. takes the NPD product concept produced by students and evaluates its environmental impact, and its technical and economic feasibility. Some issues on entrepreneurship and social responsibility are also covered. For both courses design projects are paramount. Some of the projects carried out by the students during the courses are proposed by students themselves and some others are put forward by companies. The first part of this paper includes some background information on representative sustainability courses reported in the literature. Then the complete process model comprised by the NPD and DS courses is presented. Some details of the actual courses contents and lecture activities are also described. Representative projects developed within the courses, one of which is now a startup company, are presented. Finally, insights and lessons learned are discussed.

In the 1980’s, California faced landfill siting problems and a projected shortage of landfill capacity that could impact the health and safety in California. To address this issue, the California Integrated Waste Management Act was passed in 1990 and established a framework to limit reliance on landfills. This framework gives greater emphasis to recycling, waste prevention, source reduction, and composting. The Integrated Waste Management Act required each city and county to implement plans to divert 25% of solid waste by 1995 and 50% by 2000 from landfills. Although we have achieved a 47% diversion rate and have 170 composting facilities, we still have approximately 30 millions tons of material being landfilled. This may be an untapped resource for energy and alternative fuels production.

Aim/Purpose: [This Proceedings paper was revised and published in the 2018 issue of the journal Issues in Informing Science and Information Technology, Volume 15] This paper investigates the new technical skills that are needed for Data Engineering. Past research is compared to new research which creates a list of the 20 top tech-nical skills required by a Data Engineer. The growing availability of Data Engineering jobs is discussed. The research methodology describes the gathering of sample data and then the use of Pig and MapReduce on AWS (Amazon Web Services) to count occurrences of Data Engineering technical skills from 100 Indeed.com job advertisements in July, 2017. Background: A decade ago, Data Engineering relied heavily on the technology of Relational Database Management Sys-tems (RDBMS). For example, Grisham, P., Krasner, H., and Perry D. (2006) described an Empirical Soft-ware Engineering Lab (ESEL) that introduced Relational Database concepts to students with hands-on learning that they called “Data Engineering Education with Real-World Projects.” However, as seismic im-provements occurred for the processing of large distributed datasets, big data analytics has moved into the forefront of the IT industry. As a result, the definition for Data Engineering has broadened and evolved to include newer technology that supports the distributed processing of very large amounts of data (e.g. Hadoop Ecosystem and NoSQL Databases). This paper examines the technical skills that are needed to work as a Data Engineer in today’s rapidly changing technical environment. Research is presented that re-views 100 job postings for Data Engineers from Indeed (2017) during the month of July, 2017 and then ranks the technical skills in order of importance. The results are compared to earlier research by Stitch (2016) that ranked the top technical skills for Data Engineers in 2016 using LinkedIn to survey 6,500 peo-ple that identified themselves as Data Engineers. Methodology: A sample of 100 Data Engineering job postings were collected and analyzed from Indeed during July, 2017. The job postings were pasted into a text file and then related words were grouped together to make phrases. For example, the word “data” was put into context with other related words to form phrases such as “Big Data”, “Data Architecture” and “Data Engineering”. A text editor was used for this task and the find/replace functionality of the text editor proved to be very useful for this project. After making phrases, the large text file was uploaded to the Amazon cloud (AWS) and a Pig batch job using Map Reduce was leveraged to count the occurrence of phrases and words within the text file. The resulting phrases/words with occurrence counts was download to a Personal Computer (PC) and then was loaded into an Excel spreadsheet. Using a spreadsheet enabled the phrases/words to be sorted by oc-currence count and then facilitated the filtering out of irrelevant words. Another task to prepare the data involved the combination phrases or words that were synonymous. For example, the occurrence count for the acronym ELT and the occurrence count for the acronym ETL were added together to make an overall ELT/ETL occurrence count. ETL is a Data Warehousing acronym for Extracting, Transforming and Loading data. This task required knowledge of the subject area. Also, some words were counted in lower case and then the same word was also counted in mixed or upper case, thus producing two or three occur-rence counts for the same word. These different counts were added together to make an overall occur-rence count for the word (e.g. word occurrence counts for Python and python were added together). Fi-nally, the Indeed occurrence counts were sorted to allow for the identification of a list of the top 20 tech-nical skills needed by a Data Engineer. Contribution: Provides new information about the Technical Skills needed by Data Engineers. Findings: Twelve of the 20 Stitch (2016) report phrases/words that are highlighted in bold above matched the tech-nical skills mentioned in the Indeed research. I considered C, C++ and Java a match to the broader cate-gory of Programing in the Indeed data. Although the ranked order of the two lists did not match, the top five ranked technical skills for both lists are similar. The reader of this paper might consider the skills of SQL, Python, Hadoop/HDFS to be very important technical skills for a Data Engineer. Although the programming language R is very popular with Data Scientists, it did not make the top 20 skills for Data Engineering; it was in the overall list from Indeed. The R programming language is oriented towards ana-lytical processing (e.g. used by Data Scientists), whereas the Python language is a scripting and object-oriented language that facilitates the creation of Data Pipelines (e.g. used by Data Engineers). Because the data was collected one year apart and from very different data sources, the timing of the data collection and the different data sources could account for some of the differences in the ranked lists. It is worth noting that the Indeed research ranked list introduced the technical skills of Design Skills, Spark, AWS (Amazon Web Services), Data Modeling, Kafta, Scala, Cloud Computing, Data Pipelines, APIs and AWS Redshift Data Warehousing to the top 20 ranked technical skills list. The Stitch (2016) report that did not have matches to the Indeed (2017) sample data for Linux, Databases, MySQL, Business Intelligence, Oracle, Microsoft SQL Server, Data Analysis and Unix. Although many of these Stitch top 20 technical skills were on the Indeed list, they did not make the top 20 ranked technical skills. Recommendations for Practitioners: Some of the skills needed for Database Technologies are transferable to Data Engineering. Recommendation for Researchers: None Impact on Society: There is not much peer reviewed literature on the subject of Data Engineering, this paper will add new information to the subject area. Future Research: I'm developing a Specialization in Data Engineering for the MS in Data Science degree at our university.

In this position statement, the authors write in support of Ebonics (also known as African American Vernacular English, Black English, Black Dialect, and African American Language) as a legitimate language. The linguistic and cultural origins of Ebonics is traced, along with its legitimacy by professional organizations and the courts. CABE asserts that the role of schools and teachers is therefore to build on students’ knowledge of Ebonics rather than replace or eradicate Ebonics as they teach standard English. This position statement has implications for teacher training.

California’s Local Control Funding Formula (LCFF), signed into law in 2013, centers equity as a key to increased and improved services for three targeted student subgroups, including English Learners (ELs), low-income students, and foster youth. As a component of LCFF, districts develop Local Control and Accountability Plans (LCAPs) to specify their goals and strategies for using LCFF funds for equity and continuous improvement purposes. The California Model Five by Five Grid Placement Report (Spring 2017 Dashboard) included the Five by Five Placement Grid, a key function of which is to identify the needs of diverse ELs. The Dashboard and the LCAPs are two policy mechanisms with great promise in combining school finance and accountability reform to promote equity and coherent state-wide. In this report, Lavadenz and colleagues review the EL policy context and examine the connection between the two contemporary policy mechanisms in California, namely the Year 4 LCAP and the California Department of Education’s Accountability Model (Spring 2017 Dashboard). The authors use a sample of 26 California school districts with high numbers/percentages of ELs and conclude that California’s current accountability system diminishes the urgency to respond to educational needs of the English Learner subgroup and undermines the equity intent of the LCFF. Few promising practices and assets-based approaches were identified in the LCAPs, and there is minimal mention of metrics focused on EL outcomes. The authors provide recommendations at state, county office of education and district levels.

California is aggressively moving forward with efforts to deploy zero-emission transportation technology to fight climate change, especially the Greenhouse Gas (GHG) emissions from the high-impact transportation sector. However, to date, the investments California has made with Cap-and-Trade funding have focused on ground transportation and some marine sources and not the aircraft at the over 140 airports in the state. Through a California-focused comprehensive GHG emissions analysis, this research project seeks to determine how RAM using electric/hybrid electric aircraft can provide new high-speed transportation for high-priority passenger and cargo movement within Fresno County and connections to coastal urban centers. Using VISION, a model developed by the Argonne National Laboratory Transportation Systems Assessment Group, the research team identified and compared the emission per mile and emission per passenger mile between different modes of transportation using traditional petroleum fuel and other sustainable alternatives at an individual level and within the context of the transportation sector, by comparing different modes of transportation. With this estimation on hand, it becomes more viable for the state of California and other states, as well as the federal government, to establish guidelines and goals for transportation policies and investments.

Given a growing asset-based approach to equipping English Learners (ELs) with the knowledge and skills to enter and succeed in postsecondary education, this brief examines ELs’ college readiness and postsecondary education outcomes in California. It includes a brief summary of relevant literature on college readiness among EL students. Researchers then present data retrieved from the California Department of Education on college readiness and postsecondary education. The results show that EL students lack access to college preparatory courses, have a low rate of meeting the state’s College/Career Indicator, and enroll in postsecondary education at lower rates than other groups. This policy brief concludes with recommendations for state-, district-, and school-level improvements for ELs’ college readiness and postsecondary enrollment.

The California Freight Mobility Plan 2020 lists the Los Angeles-Inland Empire trade corridor region as a prominent industrial hub experiencing an increase in freight flows. The California Freight Mobility Plan also regards automated truck platoon (ATP) as an emerging opportunity to minimize congestion on the trade corridor routes. Percentage change in accessibility from 2022 (“without” ATP) to 2040 (“with” ATP) is calculated for the eighteen industry sectors of the Los Angeles-Inland Empire trade corridor. The application of the accessibility formulation was carried out with data on travel time from I-710 and I-10 within Los Angeles County. The findings suggest that all the industry sectors have a very high positive percentage change in accessibility by transforming from “without” to “with” ATP deployment-based accessibility. In the vicinity of the prominent freight corridors of I-710 and I-10 within Los Angeles County, notably, the largest increase in accessibility above 90% will be observed for the industry sectors of Agriculture, Forestry, Fishing and Hunting, Health Care and Social Assistance, Finance and Insurance, Transportation and Warehousing, and Retail Trade of the Los-Angeles-Inland Empire. Thus, these findings suggest the deployment of ATP on specific freight routes to enhance and sustain economic activity across the Los Angeles-Inland Empire trade corridors.

The US Congress codified the National Historic Preservation Act of 1966 (NHPA), the nation’s most effective cultural resources legislation to date, mostly through establishing the National Register of Historic Places (NRHP). The NHPA requires federal agencies to address their cultural resources, which are defined as any prehistoric or historic district, site, building, structure, or object. Section 110 of the NHPA requires federal agencies to inventory and evaluate their cultural resources, and Section 106 requires them to determine the effect of federal undertakings on those potentially eligible for the NRHP. Fort Hunter Liggett is in Central California, entirely within Monterey County. It was first established as the Hunter Liggett Military Reservation in 1941. The post was renamed Fort Hunter Liggett in 1975. This report provides a determination of eligibility for nine properties (Buildings 172, 179, 196, 197, 291, 2199, 723, and 914 and facilities 0301BS and radio-controlled aerial target [RCAT]) constructed between 1956 and 1972 and recommends that none are eligible under the NRHP and the California Register of Historic Resources (CRHR) criteria. Two other properties (Buildings 177 and 178) were found to be covered by the Unaccompanied Personnel Housing (UPH) Program Comment of 2006. In consultation with the California State Historic Preservation Officer (CASHPO), this work fulfills Section 110 requirements for these buildings.

In 2022, the Klamath Inventory and Monitoring Network (KLMN) of the National Park Service implemented the 14th year of a long-term landbird monitoring protocol. Klamath Bird Observatory, in partnership with the KLMN, developed the protocol and completed this 14-year effort. Multiple standard avian sampling methods were implemented, including variable circular plot point counts, area search surveys, mist netting, species checklists, and habitat surveys. In 2022, a fifth year of point counts was completed, along with corresponding species checklists and habitat surveys, at 35 locations within Crater Lake National Park, 4 locations within Oregon Caves National Monument and Preserve, 24 locations within Lassen Volcanic National Park, and 30 locations within Whiskeytown National Recreation Area. Unlike in previous years, 4 rather than 2 national park units were monitored. This change in survey effort was made to compensate for surveys that were missed during 2020 when no monitoring was conducted due to the emergence of the COVID-19 pandemic. The operation of an ongoing constant effort monitoring station, which included mist netting, point counts, area searches, species checklists, and habitat surveys, continued at Oregon Caves National Monument and Preserve during the breeding and fall migration seasons. Relative abundance (birds/station), as measured by point count and area search methods, was calculated for all survey sites combined within each park. Total captures, by season, were calculated using constant effort mist netting data. Species of conservation importance were among the most abundant species at each park. Results are presented along with conservation status of individual species based on Partners in Flight state and continental plans and Oregon and California Wildlife Conservation Strategies. This 14th year of implementation of the KLMN landbird monitoring program continued to lay the groundwork for improved understanding of landbird status and long-term trends in each park. When analyzed in the framework of the Klamath Bird Monitoring Network, the contribution of KLMN parks to bird conservation in this region will help inform landbird conservation in the West.
