This chapter explains that contracts are read in the context of their background facts. These are the facts reasonably available to the parties which are relevant to establishing how a reasonable person would understand what the parties intended by the contract when it was entered into. It discusses the different approaches to context. Some judges are keen to use the context fully. Others would rather limit the extent to which external factors can influence the words of the contract. This is an important practical issue on which there are divergent views, and the chapter discusses the issues concerned and suggests a way forward. It discusses the limitations on the use of context, including the use of prior negotiations and subsequent conduct in interpreting contracts. It also discusses the effect on third parties of a contextual reading of contracts.

Continuing the book’s analysis of the Indus water negotiations in the context of Cold War development politics, this chapter identifies a shift from supposedly “technical” negotiations to talks that had an increasingly ‘political’ tenor. After 1954 the allocation of whole rivers to either India or Pakistan – equating a river’s passage through national territory with sovereign ownership of the watercourse – became the key principle of the Indus settlement. During this period, Western diplomats became more closely involved. It contends that the confluence of Cold War geopolitics and a moment of historical opportunity in South Asia was critical to bringing about the Indus Waters Treaty. It argues for the importance of understanding historical context, rather than relying on international relations models that predict the “inevitability” of conflict or cooperation on international rivers.

Migrations abroad for a better life take place within the context of complex lifelong trajectories. While Ghanaians coming to the United States are usually motivated by specific aspirations, frequently having to do with education or professional opportunities, their aspirations often change over time and in response to opportunities and setbacks. They are constantly revising their aspirations while also negotiating their identities along dimensions of race, ethnicity, and nationality. Furthermore, this process is deeply embedded in the relationships they hold on to from home and the new ones they form abroad. In that sense, revisions of aspirations and negotiations of identity are embedded in social networks. This chapter steps slightly away from the topic of religion to the more general issues of aspiration and identity, in order to support the ultimate argument that religious-based relationships of personal trust influence such revisions and negotiations.

Despite the importance of secret negotiations during the Northern Ireland conflict there is no full-length study of the use of back-channels in repeated efforts to end the ‘Troubles’. This book provides a textured account that extends our understanding of the distinctive dynamics of negotiations conducted in secret and the conditions conducive to the negotiated settlement of conflict. It disrupts and challenges some conventional notions about the conflict in Northern Ireland, offering a fresh analysis of the political dynamics and the intra-party struggles that sustained violent conflict and prevented settlement for so long. It draws on theories of negotiation and mediation to understand why efforts to end the conflict through back-channel negotiations repeatedly failed before finally succeeding in the 1990s. It challenges the view that the conflict persisted because of irreconcilable political ideologies and argues that the parties to conflict were much more open to compromise than the often-intransigent public rhetoric suggested. The analysis is founded on a rich store of historical evidence, including the private papers of key Irish republican leaders and British politicians, recently released papers from national archives in Dublin and London, and the papers of Brendan Duddy, the intermediary who acted as the primary contact between the IRA and the British government during key phases of engagement, including papers that have not yet been made publicly available. This documentary evidence, combined with original interviews with politicians, mediators, civil servants, and republicans, allows a vivid picture to emerge of the complex maneuvering at this intersection.

While Chicago has been long described as a city of Latinidad, there has been very limited academic attention paid to the lives of second-generation Intralatino/as—MexiRicans, MexiGuatemalans, DominiRicans among other rich combinations—who embody Latinidad in their multiple nationalities and ethnicities. Based on twenty interviews, this book documents the presence of Intralatino/as in Chicago and critically analyzes their everyday negotiations with their multiple national identities within the context of their nuclear and extended family stories. Proposing the concept of “horizontal hierarchies” as a theoretical framework for examining the power dynamics among diverse Latino/a ethnic communities, and analyzing rich and compelling anecdotes about the inclusion and exclusion of Intralatino/as in their family lives, the book attempts to bring into representation the everyday ways in which these second-generation Latino/as experience transnationalism within the domestic space of home while they engage affectively with, and against, the national boundaries and imaginaries produced by their loved ones.

Abstract Everyone negotiates. Whenever we need someone else to help us achieve our goals we negotiate. This book introduces theories of negotiation, including assumptions of scarcity and competition, or possibilities of integration of parties’ needs and interests and problem-solving approaches to achieve both joint and individual gain. The book provides analysis and guidance on how to assess what is at stake in each negotiation and how contexts vary to help us choose appropriate behaviors, including different strategies and tactics for achieving both joint and individually preferred outcomes. Illustrations and examples come from historical, diplomatic, international, legal, employment, relationship, business, family, and everyday negotiations. Drawing on the varied disciplines of game theory, economics, psychology, sociology, law, political science, and anthropology, negotiation is described as a multi-disciplinary process, involving both cognitive analysis and behavior. The book looks at modern applications of negotiation in complex multi-party, multi-issue situations, with cultural, racial, class, ethnic, and gender differences and use of negotiation processes in new dispute resolution and transactional settings, like mediation, facilitation, deliberative democracy, decision making, and restorative justice. Challenges to good negotiations in ethical dilemmas, legal enforcement, and behavioral barriers are explored.

This chapter reviews India’s foreign policy on climate change, arguing that while it is marked by tactical virtuosity, it increasingly exhibits strategic vacuity. The chapter traces the evolution of India’s role in international climate negotiations, noting particularly India’s key role in highlighting equity and enshrining the concept of ‘common but differentiated responsibilities and respective capabilities’ as a cornerstone of the negotiation process. The chapter then examines the turbulent phase from 2007 onwards, when India, along with other large developing country allies, experimented with new articulations of climate policy. This discussion explores the emergent drivers of Indian climate policy, including international pressures, shifting domestic political context, the emergence of ‘co-benefits’ as a framing concept, and the role of key personalities. The chapter concludes by suggesting that an exclusive emphasis on an equitable climate deal should transition to an approach that provides equal attention to equity and effectiveness in international climate outcomes.

This chapter considers the relevance of international cooperation to the governance of global energy and climate issues and the restricted way in whichthese issues are framed. It provides an analysis of the development of the international climate change regime from the negotiation of the UNFCCC to the implementation of its Kyoto Protocol and the search for a new but very different agreement, achieved at Paris in late 2015. The Paris outcome reflected the intersection of national economic interests and seismic structural changes in the global political economy that vastly altered the distribution of emissions in the context of the increasing competitiveness of renewables. Meeting demands for climate justice with a new emphasis on development funding and adaptation was critical to the achievement of an agreement. As ever, what might seem to be functional and technical negotiations were permeated by international politics and assertions of national sovereignty, recognition, and prestige.

The aim of this book is to examine the distinct policy debate surrounding the climate change and human mobility nexus, in particular the construction of these two related concepts as a distinct phenomenon that requires policy responses.

This chapter studies several of Dulac's early narrative Impressionist films, and her ideal of cinema as a spatiotemporally complex universe of symbols—one in which meaning is created through an intertextual network of figurative associations, such as pictorial and rhythmic gesture. Dulac's integral approach, based on life, movement, and rhythm, exemplified in a surviving extract of what is considered the first Impressionist film, La Fête espagnole (1920), is used in a particularly innovative and feminist manner in one of her earliest extant films, La Belle Dame sans merci (1921). Dulac's use of dance as a discursive metaphor disrupts a heteronormative, monogamous, and linear narrative structure, creating a queer subtext in her later films, both commercial and avant-garde.
