Texto completoL’avvento delle tecniche di sequenziamento di nuova generazione ha reso recentemente disponibile l’opportunità di analizzare su scala genomica e trascrittomica organismi non modello, anche nel caso in cui virtualmente non sia disponibile alcuna informazione pregressa. Il mitilo mediterraneo Mytilus galloprovincialis è un organismo di grande importanza economica ed è considerato un utile bioindicatore, ma nonostante ciò fino a questo momento gli studi molecolari sono stati fortemente limitati proprio dalla limitata conoscenza genomica di questo importante bivalve. In questa tesi sono state utilizzate tecniche di sequenziamento di nuova generazione per analizzare la risposta del mitilo a biotossine algali paralitiche (PSP) su scala trascrittomica a livello della ghiandola digestiva. L’enorme mole di dati di sequenza ottenuti ha permesso di studiare in modo approfondito alcune famiglie di geni di grande importanza nella risposta immune del mitilo. In particolare sono state individuate e descritte l’ampia famiglia di lectine C1q-like, coinvolte nel riconoscimento dei patogeni, e due nuove famiglie di peptidi antimicrobici, le big defensine e le mitimacine.

Texto completoMy research activity focuses on different types of liability stemming out from the various range of GMOs damages, in the light of the entry into force of the Directive no. 2015/412/EU. The Regulation of GMOs has always been considered a 'hot' topic for the required balance between scientific and industrial research and freedom of economic initiative on the one hand, and protection of health and the environment, on the other hand. Starting from both the legal definition of GMOs, and the analysis of the European legislation concerning them, the reserach focuses on the cases of GMOs damages, with a final focus on the changes by the Directive of 2015. The doctrine in fact has indicated a three-fold partition of GMOs damages, based on the type of juridical right protected: the damage to human health, to the environment and to genetic contamination. On the first hypothesis, having highlighted the importance of health both in our legal framework and in the European one – since GMOs are potentially harmful non only for the individual injured but also for the entire community –the research proceeds to a subdivision, attempting to explore which rules can be relevant in case of damage by GMOs to human health: on the one hand, the approach based on the civil liability system – art. 2050 cod. civ. or the rules on product liability –, on the other hand the approach based on the precautionary principle. Highlighting the weaknesses inherent in both of the systems, a compromise solution achieved through a reconciliation of the precautionary principle with the traditional civil liability, is proposed, re-evaluating the insurance contract, in order to be able to manage potential risks, such as those arising by the market placement of GMOs. The last part of my dissertation analyses the damage rising from genetic contamination, a specific type of damage caused to agricultural production – wether traditional or biological – by genetic pollution. After considering the meaning and the normative evolution of the co-existence principle, both under European and Italian law, and analyzing the main case-law concernig the damage to genetic contamination, the research emphasises that the recent modification (with the introduction of Article 26 bis, paragraph 1 bis in the Directive 2001/18/EC) opens new horizons in the configuration of damage caused by genetic contamination. According to the new provision, Member States in which GMOs are cultivated shall take appropriate measures in border areas of their territory with the aim of avoiding possible cross-border contamination into neighbouring Member States in which the cultivation of those GMOs is prohibited. As a consequence of that, the structure of damage to genetic contamination has been modified on the EU level to (essentially) a transboundary damage. In the light of the aforementioned considerations, the research will single out the rules applicable to the liability of a certain Member State for cross-border contamination towards another Member State, while noticing the differential treatment of cases depending on whether the contamination takes place between two both EU member States or not.
