Texto completoConfronted to an increasing environmental concern, consumers are now offered opportunities to reduce the negative impact of their consumption on the environment. They can make environmentally responsible consumption choices: green products, recycling, biologically grown products. However, consumer motivation towards green consumption remains unclear, as environmental attitude is surprisingly not significantly related to these behaviors. Here, consumer motivation is considered to be reflected in the goal structures related to specific green consumption behavior. Means-end chain theory is used to uncover consumer goal structures. Several goal orientations related to green consumption, as well as consumer segments are identified. The results reveal that green consumption goes beyond environmental protection, an intermediate goal leading in turn to more abstract goals such as hedonism, health concern, preservation of the quality of life, respecting others or expressing one's values. Detailed results deepen the understanding of the motivations underlying glass recycling and green purchases, and underline their diversity. As a conclusion, managerial implications are derived on the use of goal structures to create persuasive messages targeting the consumer segments identified in the analysis

Texto completoThe purpose of this thesis is to analyze the determinants of demand for green products, and in particular, eco-friendly seafood. In the first chapter, we summarize existing literature on the demand for green products and highlight the characteristics that are specific to seafood. In the second chapter, we use survey data to study the demand for ecolabeled seafood products in Europe. Our econometric results show that there are links between the acceptance of an ecolabel and purchasing criteria, type, age and education level. In the third chapter, we analyze the determinants of consumption of seafood with three different labels: an eco-label, a health label and a fair-trade label. With the data from a French survey, we use an econometric analysis to show that consumers with positive attitudes towards ecolabels and consumers with positive attitudes towards fair-trade labels are similar, and can be distinguished from consumers with positive attitudes towards health labels. In the fourth chapter, we study the influence of social interactions on the demand for green and standard goods. Through a public goods model, we show that these interactions can cause a crowding out effect on the demand for a better environment. In the fifth chapter, we analyze the role of social interactions on the probability of being willing to pay more for ecolabeled seafood. We show through a matching model that being a part of a social circle with positive attitudes towards ecolabels raises this probability. This finding is valid for women while men do not seem to be influenced by their peers

Texto completoConsumer skepticism towards companies is on the rise. However, studies on the determinants and the consequences of this phenomenon on organic /green products are lacking. In order to partially fill this gap, this thesis focuses on green skepticism by exploring and comparing consumers from three different cultural backgrounds. The first essay investigated the relationship between, green skepticism and the purchasing behaviour of organic cosmetics, based on the attitude-behaviour- context (ABC) theory. The second essay aimed at providing a better understanding on the psychological effect of skepticism on green consumption behaviour. The third essay demonstrated whether organic food skepticism could partly explain the gap” or discrepancy between the great deal of positive attitudes towards organic food expressed by consumers and their actual choices. Based on data collected from consumers in Tunisia, Italy and France, we conducted a cross-country comparison adopting the structural equation modeling approach. Results revealed that green skepticism is strong inhibitor towards adoption of organic and green products among consumers in the three countries. Together, the three essays contribute to the literature by highlighting the importance of the psychological determinants and inhibitors of the adoption of organic and green products

Texto completoThe current environmental and economic context implies a need to manage energy demand. In order to do this, understanding completely the determinants of energy demand is first required. Also, there is a need to find tools to reduce energy consumption. In this thesis, we are interested in the consequences of a household’s choice of location on energy consumption and on the role of the green value to promote the adoption of energy-efficient buildings by households. The first chapter analyzes an urban microeconomic model of residential choice of location and energy consumption. In order to complete this theoretical analysis, we estimate the energy demand of the residential sector. The second and third chapters study the green value and its role in the promotion of green buildings. In chapter 2, we present a meta-analysis of the literature estimating the green value. In chapter 3, we use a spatial hedonic model to estimate the residential green value for the urban area of Dijon. Finally, in the last chapter, we study the residential choice of households concerning the energy performance of their dwelling. To do so, we estimate the probability of households to live in an energy-efficient building or not. The results of these estimates and the results of the previous chapters are then mobilized to discuss the efficiency of the public policy used for managing energy demand

Texto completoWater scarcity is a major problem, even in Europe with climate change. Hemodialysis (or artificial kidney) is a therapy with a high economic and ecological impact, especially with regard to water consumption. The reject from the reverse osmosis (RO) system in the water treatment loop is approximately 250 liters per dialysis session. This slightly salty water is usually wasted. According to the literature, very few solutions are proposed to recycle water effluents from dialysis centers. We therefore conducted a survey among dialysis center staff in France and Morocco, to collect qualitative and quantitative information on water consumption, as well as recycling ideas. The survey revealed that it was also necessary to clarify the applicable regulations for cleaning up or reusing these RO rejects, which was the subject of a special chapter. From the physicochemical analyses of the RO rejects from the dialysis center of the polyclinic Saint Come, we found that the increase in salinity is due to significant concentrations of sodium, nitrate, sulfate and chloride. After comparing the advantages and disadvantages of seawater desalination techniques, we chose to study electrodialysis which seems to be the best compromise between efficiency and energy consumption. We first applied this technique at the laboratory scale on a model NaCl solution. An experimental design allowed us to determine the effect of the main operating parameters (voltage, concentration and flow rate) on the demineralization rate and the specific energy consumption. Then, we applied the optimal operating conditions to treat the RO rejects taken from the dialysis center. The physicochemical analyses on the dilute along the electrodialysis process confirmed that this technique is a good choice to reach the compositions fixed by the standards or recommendations to reuse the treated water for watering green areas, washing surgical instruments before sterilization or rehabilitation pools

Texto completoThis thesis deals with the main challenges that we need to address to foster the private financing of a low-carbon energy transition. A massive amount of investment in low carbon assets is needed and most of the effort must come from final energy consumers such as households. Their ability as well as the ability of the financial intermediation institutions (that is banks in Europe) to valorise low-carbon investments and risk profile is the key for a successful low-carbon energy transition in France and in every industrialized country. These researches focus more particularly on the housing sector which represents 44% of the final energy consumption and 21% of the total greenhouses gases emissions in France. The first chapter of this thesis takes the viewpoint that only a disaggregated approach can actually permit macroeconomic and nationwide objectives to reduce final energy consumption match microeconomic arbitrages regarding energy spending in the private residential housing sector. Using segmentation and decision tree growing econometric techniques, the chapter proposes a typology of energy spending and a segmentation analysis and of the energy transition “market” in the housing sector. The second chapter uses frontier functions estimation technique on a local French private housing market to determine if selling prices contain a “Green Property Value”. An empirical analysis is then conducted to determine if this value can offset the upfront cost of energy retrofit. The last chapter takes the prism of the financial institutions. It attempts a first evaluation of the impact and exposition to climate related risks, those are physical, transition, liability and systemic risks, on the banking system and its prudential regulation framework

Texto completoLocated in midst of river and land courses, Lyon-Lugdunum, capital of the Three Gauls, had a prominent position for trade and distribution of glass objects during the Earlier Roman period. Glass archaeological studies had only unraveled a limited part of Lyon’s glassware, hence not fully exploiting the richness of this source of information.The discovery of several workshops on the left river bank of the Saône, in the Saint-Vincent quay, shows that Lyon had an important role in the production of glass, as it did for pottery. This study investigates the structure and operating modes of four of these workshops and of another one located in the area of the Croix-Rousse. Careful analyses enabled a better understanding of their production. A parallel study of local consumption centers allowed comprehending how this production was distributed and differentiating it from imported glassware from other regions of the Empire. The latest developments in preventive archaeology, in addition to data collected from excavations, led to the discovery of several glassware sets. Glass objects from ten domestic sites, mainly located in the Fourvière area and Lyon’s peninsula, were thoroughly studied. Furthermore, glass pieces from eleven funerary sites, located in the city’s suburbium (the Vaise plain and the Point du Jour plateau) were analyzed. The review of all collected data, from both production and consumption sites, allows suggesting a specific chronotypology for Lugdunum during the Earlier Roman Empire. This model enables a deeper understanding of product diffusion on a local scale and provides hints on glass trading of the Three Gauls with the rest of the Roman Empire

Spirituality, both in terms of how people spend their money and lead their lives, appears to be a matter of concern for certain consumers and particularly for those in search of meaning, personal development and well-being. This theme is gradually being introduced into different product ranges and store concepts with, as a backdrop, a return to the approaches of experiential marketing. This research aims to understand and measure the experience of spirituality in consumption. More specifically, the question of how marketing can be relevant and contribute to its development will be asked. Using as a starting point a research paper dealing with the experience of spiritual consumer purchasing associated with the brand names Biocoop, Nature & Discoveries and in shops selling religious articles, this doctoral thesis will show the role of spiritual experience on the perceptions and attitudes of consumers. Two dimensions characterise the experience of spirituality in consumer purchasing: existential reflection and self-examination. Moreover, the fact is that an experience of spiritual consumption has a positive influence on the well-being of the consumer, on his perceptions with regard to that experience, and finally, on his willingness to relive the same experience. Overall this research will make operational suggestions to managers by focusing on the areas concerning product offers and the different methods for creating atmosphere

Of course, there is nothing new in this disconnection of the acts of buying and paying. What is new is the fact that credit practices have turned into a market. I show that : ·The history of this economic activity is an history of attainment of autonomy for the credit activity from the sales activity. I study this process through three case studies : the firms Cetelem and Cofidis, and the revolving credit.·If credit prices are the same for all the clients of a credit offer, it appears that lower class households always pay more their indebtness. I propose an analyse of the indebtness practices and their costs. ·Finally, I study the revolving credit sales. I highlight the fact that if sociologists have always studied embebedded credit transactions, desembedded credit transactions can also be analysed. This research is based on 42 interviews of top executives of credit firms and other actors of the market, two months of in situ observations have been done, credit firms’ archives have been analyzed and INSEE inquiry “Patrimoine” has been used

Texto completoOur thesis provides an analysis of consumer preferences for green products that have the specificity to mix private charactéristics with environmental ones. Our work provides insights on how consumers may contribute to environmental protection by their purchase decisions and addresses the question of the empirical measure of consurmers' values. Chapter 1 presents the main theoretical concepts providing tools to study the green consumption phenomenon. Chapter 2 discusses the methodologies used to elicit consumer values in the empirical analysis of preferences. Chapter 3 is an experimental study of consumer preferences for products deriving from a remanufacturing process. An experimental auction mechanism shows that consumers' willingness to pay for a remanufactured camera result from important tradeoffs between its environmental and quality attributes. Consumers nevertheless express environmental preferences by undervaluing, or even boycotting, a conventional - brand new - and thus more polluting product. Chapter 4 explores consumers' choices for roses associated with two independant environmental characteristics : an environmental certification of environment-friendly cultivation practices and a carbon footprint indicator. We implement a real choice experiment for a non food product whose consumption cannot bring any sanitary benefit to the consumer. Not driven by any private motives related to possible health benefits, consumers nevertheless exhibit positive willingness to pay for both environmental attributes of the roses. Our results give strength to the hypothesis of altruistic motivations in consumers' choices for green products

Texto completoIf the presence of a glass activity seems known only from the 14th century on in the South-West of France, it's truly in the 16th century that it spread and reached its peak, given the numerous workshops established at this time. Comparing the written archives and « ground archives », this study aims to shed light on the evolution of glass production between medieval times and modern times, and on the connections between glass-blowers, merchants and producers of raw materials necessary to the production of glass. The trade flows springing from this glass activity highlight the significant economic activity generated from local plants near forest ressources necessary for the working of glass ovens. These local plants supply regional economy favouring trade and developing an ecosystem based around transport, banking and bartering. One of the main characteristics of this trade is that it linked up two maritime areas, the Mediterranean sea and the Atlantic Ocean, on an axis from La Rochelle to Narbonne. The study of the glass objects made in this geographical area tends to show that the production is varied, both in terms of the types of objects and of the shapes created. Only a few particular local productions seem to be destined to a local or regional market

Texto completoWhile the influence of lighting and temperature on consumer behavior in retail outlets is of conceptual and managerial importance, they are understudied aspects of store environment. Based on a multidisciplinary literature (social psychology, psychiatry, ergonomics, medicine) and on Stimulus-Organism-Response models, our research aims at studying (1) the effect of these stimuli on affective and behavioral responses in retail outlets, (2) and the effect of uncomfortable levels of temperature as well. The moderating effects of season, optimal stimulation level and gender have been studied. From this perspective, two experiments have been conducted, one with digitally manipulated pictures and one in laboratory. The findings of the two experiments are convergent considering the main hypotheses and the influence of key variables. Managerial and conceptual implications are discussed

To do so, a muldisciplinary method has been developed, combining archaeological data with archaeometrical and technological approaches. lt allowed us to reconstruct, step by step, the commodity chains analysis of this craft, only dedicated to jewelry productions, from the raw material production, its transformation into items of adornments but also its distribution and its consumption processes by La Tène societies. The analysis on La Tène Glass characterization (done by LA-ICP-MS), including more than seven hundred glass abjects, permitted to distinguish sands from different origins used to make the imported natron base glass. It also highlighted different recipes according to the chemical features of the glasses. The technological approach, combining ethnoarchaeological and experimental referentials, shown the high-Ievels of expertise required to produce these objects. Moreover, glass abjects production required Near-Eastern raw material, implying transport over long distances and specialized and trained craftsmen. At the end of La Tène period, the observed increase and simplification of production couId be linked with a choice of efficiency in response to new population categories' needs. Glass beads and bracelets are luxury productions and their consumption evolves alongside the hierarchisation of La Tène societies. This study reveals conspicuous consumption practices depending on the networks organization of goods, specialized craftsmen and production structures only dedicated to the production of objects used for distinction

Texto completoSince the last decades, environmental issues are becoming among the major concerns for most human activities, including the Information and Communication Technologies sector. This will surely influence upcoming networking technologies, architectures and usage practices. New approaches and methodologies are required in order to evaluate and to reduce the Carbon Footprint toward what is commonly denoted as Green Networks. Within the ICT sector, the main efforts are related to energy saving techniques. These efforts started in early stages within wireless technologies, mainly because of energy limitations on mobile devices such as mobile phones and wireless sensors. Additionally, because of health considerations, standardization bodies and government had set stringent policies and limits on electromagnetic radiation levels that can be emitted by radio stations. For these reasons, many academic and industrial research and development activities had led to a number of relatively energy efficient solutions. In this thesis, we consider energy efficiency in the context of Heterogeneous Wireless Access Networks. These are composed of multi-standards wireless network solutions, with non uniform topologies and cell sizes and Multi-Modal mobile terminals able to manage simultaneously different connections. The main contributions of our studies include the proposal of new optimization solutions regarding user association and scheduling techniques at both flow and packet levels for multi-homed mobile terminals. An overall context-based solution is also proposed in order to provide end-to-end energy efficient networking solutions

Texto completoThe Law prior to the 1804 codification is ruled by the principle that agreements are not sufficient to establish and transfer real rights: in order to reach this result, an additional modus of acquisition, like the delivery of the thing, is required. When it is not the case, the real right, established or transferred by mere agreement, is nevertheless established and transferred erga omnes. However, since the civil code and the successive legislative reforms, the situation is no longer the same: the principle adopted is the establishment and the transference of real rights sola conventione. Nonetheless, the study of laws and regulations as well as the nineteenth century scholars’ opinions reveals that the change initiated in 1804 is much deeper: if the agreement is sufficient to establish and transfer real rights, these rights are established and transferred to the parties only. For example, in current French Law, the sale of a boat transfers its property regarding to the seller, but not towards to third parties and, in particular, not regarding to the seller’s unsecured creditors or to the State. As long as the registration of the deed of sale is not completed, these third parties may ignore the transfer of property resulting from the sale. A lot of questions can be raised: has the sale really settled a transfer of property? Is a property regarding only to the seller still really a property? Similarly, in current French Law, an agreement may establish a mortgage, but this right is not enforceable against third parties as long as this act has not been registered. Thus, the unsecured creditors of the settlor may ignore the right of the mortgagee. But does it make sense to consider a mortgage without a preference right?This thesis describes how the legislator and nineteenth century scholars, in reducing the acquisitive modus into the acquisitive titulus and in distinguishing between inter partes effect and extra partes effect, have built a myth : the one of the agreements establishing and transferring real rights. Unlike formulas generally used by law and textbooks, in current French Law, real rights are established and transferred by agreement and delivery or registration

Texto completoIn today's retail environment, the salesperson is confronted with a competent customer displaying evolving consumption behaviors (showrooming, cross-channel, etc.), but also with physical store environments that are increasingly experiential and digitalized. In this context, ou general problem is to understand how the role of the salesperson is altered in the delivery of the customer experience within a digitalized store ; and know the effects of mindset and achievement goals on the behaviors and attitudes of the salesperson. To answer this problem, we undertook three different types of data collection: a non-participant observation of 187 customer visits; 35 interviews with salespeople, store managers, and experience experts; and 27 flash customer interviews. The results of thèse two data collections show, among other things, the existence of achievement goals among customers and that they can modify the nature of the exchange with the salesperson. We also note that the physical environment of the store can be misunderstood, the low autonomy of the customer to explore the store and use digital tools thus obliging the sales assistant to accompany them in thèse steps. In a third (quantitative) study with 300 salespeople, we suggested testing a conceptual model to determine the motivation (achievement goals), behaviors (adaptive selling, customer orientation and attitudes (engagement and job satisfaction) of the salesperson through the theories of mindset and achievement goals. Results expose, among other things, that the mindset has a positive relationship with the mastery approach goal and a negative one with the performance avoidance goal. In addition, the mastery approach goal has a positive relationship with work engagement, customer-oriented and adaptive selling behaviors; the performance avoidance got has negative relationships with thèse latter variables. Finally, we propose managerial recommendations for companies to improve salesperson motivation and customer experience delivery

Specifically, we uncover the effect of trade-offs between innovative features and eco-friendly benefits on consumer responses and shine new light on the moderating role of consumer beliefs about eco-friendly product effectiveness (Study 1). Our results also show that different types of eco-friendly attributes in new product designs trigger different consumer responses (Study 2). Moreover, this dissertation sheds light on the nature of eco-friendly consumer innovativeness and its interaction effects with perceived trade-offs in eco-innovative product designs on consumers’ product evaluation and purchase intentions (Study 3). We also document consumers’ associations between detachability of an eco-friendly attribute on consumer responses (Study 4). Finally, we highlight that consumers’ evaluations of eco-innovation hinge on ecological country of manufacture and its congruence with product eco-friendliness (Study 5). Texto completoOur research, grounded in Social Development Theory (Vygotsky, 1934, 1962, 1978) aims to understand the shopping experiences lived by children between the age 4 and 12. Based on the 'scapes' (Appaduraï, 1996), the 'foodscapes' (Brembeck and Johansson, 2010 ; Wenzer, 2010) and the French Theory (Deleuze et Guattari, 1980 ; Deleuze, 1993), our research develops the concept of 'shopscapes' as the imaginary geographies each person or group of people builds based on his or her daily experiences and practices with reference to retail environments and activities. Built on a comprehensive approach, our research has based on data collected from 15 pairs of siblings during interviews where the children collectively produced a draw of a shop they chose. The drawing was a support for the verbal exchange and doing it in pairs encourages each child to clarify his or her intentions about the drawing, whatever his or her drawing skills are. The findings of our research confirm that commercial spaces are spaces made for adults. Even if shops are places where children can learn and implement their consumption skills and scripts, appropriation of the commercial spaces seems difficult for children, and this affects the quality of their shopping experiences. Our research leads to some recommendations to the retailers in order to improve children's experience in their stores

This will surely influence upcoming networking technologies, architectures and usage practices. New approaches and methodologies are required in order to evaluate and to reduce the Carbon Footprint toward what is commonly denoted as Green Networks. Within the ICT sector, the main efforts are related to energy saving techniques. These efforts started in early stages within wireless technologies, mainly because of energy limitations on mobile devices such as mobile phones and wireless sensors. Additionally, because of health considerations, standardization bodies and government had set stringent policies and limits on electromagnetic radiation levels that can be emitted by radio stations. For these reasons, many academic and industrial research and development activities had led to a number of relatively energy efficient solutions. In this thesis, we consider energy efficiency in the context of Heterogeneous Wireless Access Networks. These are composed of multi-standards wireless network solutions, with non uniform topologies and cell sizes and Multi-Modal mobile terminals able to manage simultaneously different connections. The main contributions of our studies include the proposal of new optimization solutions regarding user association and scheduling techniques at both flow and packet levels for multi-homed mobile terminals. An overall context-based solution is also proposed in order to provide end-to-end energy efficient networking solutions

As they formulate criticisms toward the regime which dominates food provision, alternative phenomena have, for over twenty years now, suggested that the sustainability, quality, and transparency of food provisioning could improve by shortening relations between producers and consumers. The discourses, practices, and innovations of such Alternative Food Networks (“AFN”) generate, through multiple oppositions to the industrial food provision regime, frictions among the latter. Having witnessed spectacular developments these past few years bringing quite a heterogeneous variety of AFN to the fore, this regime has begun to undergo a series of internal questionings and takes on local food. The theorization of these frictions can benefit advantageously from the Multi Level Perspective (“MLP”), a theoretical and methodological framework for research in transitions studies, which enables an evolutionist read on sociotechnical regimes, in particular regarding their relations with alternative, innovative niches. With the help of robust sociohistoric analysis and fieldwork, it then becomes possible to reflect upon the modalities which could bring about a food provision regime transition through the shortening of links between producers and eaters.The thesis thus proposes two analytical foci: the food provision regime; and Alternative Food Networks. It calls upon a composite methodology to address data which are very heterogeneous in nature and stem from distributed empirical fields: discourse analysis through lexicometrics, the analysis of digital traces, the study of institutional displays, in-depth interviews, and ethnography-inspired observations. Aiming at meso-level theorizations, the thesis targets – as they question themselves on local food issues – key actors representative of several competencies, which fulfill major functions in the provision regime: retail; fruit and vegetable supply; institutional food fairs. The alternative objects report, through their study, a multiplicity of forms of existence. Because these alternatives are partially intertwined with certain devices from the dominant regime, this leads the thesis toward the in-depth study of one of these AFN, which is very particular in that (i) its architecture stems from a hybrid between food alternatives and digital-material networks enabled through technological platforms, and (ii) the dataset which it offers is of unusually high standard.Through this distributed empirical approach, the thesis contributes to the characterization of a transition toward a digital-material provision regime based on prosumption through transparent customization. Dating the regime’s inflection point to the late 2000s, the conjunction of a crisis in the provision model with the explosion of digital flows as well as the continuous expansion of claims and practices in the realm of alternatives, appear to be able to quicken the pace of a transition pathway through a reconfiguration of the regime. The premise of this reconfiguration manifests itself through multiple evolutions in discourse which can be scrutinized within the regime, as well as the incorporation and the redisplay, in the realm of the regime, of alternative phenomena which participate increasingly in the characterization of new priorities which now redefine food specifications, provision practices, and provision flows. The accrued value of food products enriched with new alternative specifications which are conveyed through new virtual and material proximities thus intimate the regime to interrogate itself on the potential offered by the shortening of provision. Bridging three investigative fields (transitions; Alternative Food Networks; prosumption) which are, as of yet, relatively disconnected, the thesis thus opens research perspectives on the capacities through which such shortened markets may be able to capture the attention of food prosumers who likewise, are very much thriving

Texto completoIn sales law, there are many provisions that have limited personal scope of application, for instance special rules for so-called B2C (Business-to-Consumer) or B2B (Business-to-Business) contracts. Those personal differentiations, that make the application for judges, contracting parties as well as legal practitioners very complicated, are often due to historical reasons (for example the transposition of European Directives in the field of consumer law), but not justified by substantial arguments like differences between those personal categories.The present comparative study aims at finding out where these differentiations are useful and justified by substantial reasons and at what point it is preferable to provide a uniform rule for all personal configurations. In order to answer this question, this work examines the German and French sales law as well as European and international regulations and principles of soft law (CISG, CESL, UNIDROIT Principles, CFR) and analysis the rules using, apart from legal argumentation, the functional method of comparative law as well as the law and economics approach
Insbesondere im Kaufrecht findet man immer wieder einzelne Vorschriften, Gesetzesabschnitte oder ganze Gesetzbücher mit eingeschränkten personalen Anwendungsbereichen (z.B. beschränkt auf Business to Consumer Verträge, B2C, oder auch auf B2B-Verträge. Jedoch scheint dieses komplizierte Netz aus personalen Differenzierungen keiner bestimmten Logik zu folgen und basiert häufig auf rein historischen Gründen (z.B. der Umsetzung von europäischen Verbraucherrichtlinien) oder auf beschränkter legislativer Kompetenz.Die vorliegende Arbeit untersucht daher, an welcher Stelle derartige personal differenzierende Vorschriften tatsächlich durch materielle Gründe gerechtfertigt sind und wo es besser wäre, die Differenzierung zu beseitigen, um das Kaufrecht zu vereinfachen und für dessen Adressaten und Anwender zugänglicher zu machen. Texto completoThe building consumer is, what is called, a legal oxymoron. The oxymoron is a figure of speech which is defined as the result of a combination of seemingly contradictory words. Behind this figure appears to illustrate a relationship game between consumer law and real estate law. The building and consumer law have relations based on the exclusion of one by the other. The purpose of this study is to first specify the scope and modalities of this exclusion. It is appropriate, then, to focus on the various causes that give rise to such a release. The building has a specificity that excludes the subject of a report of consumption, and vice versa, the consumer report contains features that differentiate the real estate contract. However, a second analysis can show the influence of consumer law on the status of the building. First, housing has become, in the evolution of society, an object of consumption, leading to the application of a specific housing consumption regime. The legislator introduced in real estate matters, the consumerist inspiration provisions, while adapting them to the specific nature of the building. Furthermore, the building is in contact with the consumer law. The transformation of the building in single cash reserve and interdependence of consumer contracts and real estate contracts appear as confirmation of the mutual influence between consumer law and real estate law. Texto completoIn a context where the gang phenomenon has become omnipresent in our neighbourhoods and represents a growing problem in several large cities in Quebec and Canada, paying particular attention to drug trafficking by members of street gangs is undoubtedly of great interest. The media strongly influences the image of gang phenomenon. As information conveyed by newspapers and news channels focus on the stereotypes associated with gangs and their behaviour, it enhances the fear that society has regarding street gangs. That being said, to shed light on gangs and their activities is an interest. We chose to focus on drug trafficking which is common in street gangs. The main objective of this research is to obtain the most accurate description and knowledge of drug trafficking from present and former street gang members related to their knowledge of drug trafficking as a result of their membership and their involvement in street gang activities. Drug trafficking is addressed through interviews with gang members. In total, fifteen semi-directive interviews were conducted among present and former gang members. All respondents but one were from the Centre jeunesse de Montréal-Institut universitaire. Overall, this study allows us to understand that in addition to drug trafficking, gangs or gang members indulge in polymorphic criminal activities; drug trafficking is rarely the sole source of income. Moreover, drug trafficking is not an activity exclusive to street gangs. Thus, even if a number of members are involved in drug sales as a structured gang activity, it is possible for a member to sell drugs on a freelance basis while being affiliated with a street gang. It appears that most respondents are part of a clique, identify a color or a district and buy drugs from older and higher ranked members that respondents identify as veterans. Regarding the veterans, respondents indicated the importance of being trusted by the highest ranked if they wish to evolve in the drug sales market. When trust is present and the new seller begins his activities, either he takes over a turf, usually within his area, or the veteran provides a place where the new seller can "work". The presence of a family member already affiliated to a gang seems to facilitate the process of access to new trafficking activities. There are several dimensions associated with the territory aspect according to the interviewees such as: competition, conflict, interactions with rival gangs and violence, to name a few. Members indicate selling a variety of drugs, cannabis and crack representing the two most commonly cited drugs. The profit margin varies among the type of drugs sold, the district and of customers’ characteristics. The customers, although diverse in nature, have something in common: addicted customers, as several interviewees have mentioned, are desperate to ensure their consumption. These are typically homeless, prostitutes, bars’ employees, partygoers and foreigners/ travellers. Respondents also indicate the presence of undercover police officers, which may arise as customers. Thus, it is essential to develop skills allowing them to distinguish the undercover police officers from regular customers. Regarding drug use, respondents assert themselves using mostly alcohol and cannabis. However, several admitted to having used a large variety of intoxicants during their lives.
