Texto completoThroughout its history, the network of the Chambers of commerce and industry has demonstrated its capacity to support the enterprises and the economic development of territories. Aware of the profound changes of their environment, the Chambers of commerce have been part of an important reforming process for years, completed with the passage of the Act of July 23, 2010 regarding Chambers of Commerce and Industry, Trade, Crafts and Services. Anyhow, the Act of July 23, 2010, expected to be rationalizing the functioning of the Chambers of commerce and industry network, is a compromise borne out of difficult and complex negotiations. The reform remains incomplete, with its share of difficulties and inconsistencies. At the time of the streamlining of global public policies, the fact that the consular network has been unwilling to pay greater attention to the concepts of mutualizing or merger could appear to be detrimental. Indeed, many of our European neighbors have already adopted a rational consolidation strategy of these consular structures - the Chambers of Commerce & Industry, the Chambers of Trades and Crafts and the Chambers of Agriculture - in a single structure. Therefore, it seems fair to question the relevancy of such an unachieved reform

Texto completoAt first glance, the title refers to the judicial activity of the Cour des pairs (1814-1848) and the Senate of the Third Republic (1875-1940). These are the most striking involvements of French legislative bodies in rendering justice. The trials of the ending Restauration ministers, and the one of Louis Malvy seem to be well known, but in reality these are only imperfectly so. In both cases, the upper house has turned away from its initial mission of legislator and supervisor of the government to transform itself, in a very incomplete way, into criminal courts. However, study only these two cases is not enough to define the mission of a parliamentary jurisdiction. The concept of Haute Cour de justice must therefore be understood in its entirety and in its history. A history which, like many others, is marked by the Revolution, which will influence the 19th and 20th centuries, and set a French prototype of political court. These Hautes Cours possess special competencies: ratione personae et ratione materiae. They judge politicians, but since the Revolution one foresees the difficulty of doing so with criminal law, which is hardly suited to the resolution of political disputes. Finally, the French Haute Cour is also a tribunal for major political crimes, namely, serious attacks on sovereignty. It is thereforce a question of recount the history of the “Tribunal supreme” in order to reveal the concept of political justice as an aporia

Texto completoIn the collective imagination, Quebec’s 19th-century electoral campaigns are associated with violence, intimidation and dubious practices by political parties in order to get votes from illiterate and unpoliticized voters. However, is it really the case? The first objective of this thesis is to analyze electoral irregularities through the petitions challenging the legality of some elections tabled in the Legislative Assembly of the Province of Canada and of Quebec between 1871 and 1875. The second one is to study the control of the legitimacy of these disputed elections by parliamentary administration. To do so, the election process during public votes and the contested elections laws are carefully examined. Petitions are analyzed in order to reveal the various reasons raised by the protestors. Then the parliamentary process is examined to demonstrate how members of the Legislative Assembly arbitrate the disputed ballots. Simultaneously, the role of the various actors involved – voters, political parties, protesters and members of parliament – is presented, as well as the evolution of the legislation about controverted elections. Finally, the analysis of the 108 petitions tabled in the House between 1841 and 1875 suggests that this "mythical past" of corruption and electoral violence is real, but deserves to be qualified. The political culture evolves a lot during this short period. Those dubious practices are not only free of consequences during the elections, they also have the endorsement of the members of parliament, who reject petitioners’ grievances in more than 90% of the cases.

Texto completoBy conceiving of any society as having two dominant cleavages, one ‘social’ and one ‘partisan’, this dissertation develops a theory on institutional change. The initial hypothesis that social groups created by the former will act to restrain institutional change and that change will occur when a partisan group emerges that can cross the social cleavage was tested by processes tracing the changes which were proposed and which occurred to the appointed councils established in British North America. These councils were modified a number of times, becoming second chambers in the provincial legislatures, and were eventually each abolished. The evidence found supports the hypothesis, though it is not sufficient to have a partisan group that can cross the cleavage drive change, a partisan debate over the change was necessary. This also challenges the prevailing theory that social cleavages lead to political party formation, suggesting the benefit of using these two cleavages for the study of institutions.
