1.1 Background: Despite growing recognition of the negative impact of ever stringent asylum employed by western governments, psychological conceptualisations of distress in these populations remains dominated by traumamodels. 1.2 Literature Review: A systematic literature review was conducted to collate and critique findings from studies relating postmigratory stress to asylum seeker distress. The 44 reviewed studies suggested asylum seekers endure a range of postmigratory stressors relating to acculturative challenges, social isolation, material deprivation and restrictive asylum legislation. Difficulties associated with conducting research with these populations are acknowledged. It is concluded that restrictive asylum policies greatly inhibit asylum seekers’ abilities to negotiate challenges resulting from displacement. Smail’s (2005) social materialist perspective is suggested as a framework for findings. 1.3 Research Report: No known British empirical research has focused on exploring relationships between postmigratory-stress and asylum seeker mental health. Based on established methodologies (e.g. Silove et al.,1997) a cross-sectional study was undertaken to explore the relative relationship with distress of postmigratory-stressors and premigratory-trauma exposure. An opportunity sample of 98 asylum seekers completed measures of postmigratory-stress (the PLDC: Silove et al., 1997); premigratory-trauma exposure (HTQ-TE; Mollica et al.,1992) and distress (HTQ-PTSD: Mollica et al.,1992; HSCL-25: Hesbacher et al.,1980; Winokur et al.,1984). High levels of exposure to premigratory-traumatic events, postmigratory stress, and distress were reported. Regression analyses revealed ‘Feeling a burden to others’ and being denied asylum to be the strongest predictors of distress. It is concluded that a range of postmigratory stressors impact negatively on asylum seeker wellbeing. Those denied asylum experience more restrictions and poorer mental health. Limitations are acknowledged. 1.4 Implications: The literature review and research report conclude that present asylum determination processes are damaging to those seeking refuge. Psychotherapeutic interventions directed at the intra-psychic level may be of limited effectiveness given the more primary social and material needs of these clients. 1.5 Critical Appraisal: Reflections on the research process are presented alongside key learning points.

asylum story is a short literary novel set in South Africa in the year 2019. The protagonist is infected with a deadly new respiratory disease and being held in a quarantine facility near a fictional town in the Karoo. The novel spans a six-month period during which the protagonist becomes involved in an ultimately failed attempt to escape. The novel is partly inspired by the Department of Health's decision in 2007 to place patients with drug-resistant strains of tuberculosis into quarantine. Many patients died in this enforced captivity. Conditions in some facilities were reportedly very poor and in 2008 there was a high-profile escape from the Jose Pearson quarantine facility. Though the disease in the novel is not drug-resistant tuberculosis, it is something similar, and the response to the fictional disease is comparable in some ways to the real-life medical response to the TB scare. The novel is set in a universe that is similar but different to our own, allowing the exploration of universal themes without the constraint of a rigid representation of current reality.

In this thesis, I examine the theoretical and practical implications of understanding asylum as a form of reparation. My basic contention is that offers of asylum potentially constitute a means through which states can discharge their special obligations towards refugees for whose flight they are responsible. Asylum, on my account, is an institution that can contribute to the rectification of the unjustified harms that states may have caused refugees by forcing them to flee. The thesis is divided into three main parts. In Part I, I lay out a basic theory of asylum as reparation, explaining my conception of asylum and its potential moral functions in Chapter 1, and demonstrating the ways in which asylum may act reparatively in Chapter 2. In Part II, I seek to identify the conditions under which states owe asylum as reparation to refugees. Over the following three chapters, I argue that states have such an obligation when they bear outcome responsibility for unjustified harms experienced by refugees as a result of their flight, and when asylum is the most fitting form of reparation for those harms that is available. In Part III, I apply my theory to the case of Iraqi refugees generated since the invasion of Iraq in 2003, and explore some of the practical implications of my approach. In Chapter 6, I argue that the US and UK owe asylum as reparation to large numbers of Iraqi refugees. In Chapter 7, I examine the implications of my approach for domestic asylum politics, questioning how states should prioritise refugees to whom they owe reparation vis-à-vis other refugees, and exploring its potential impact on debates over asylum. In Chapter 8, I identify its implications for the international politics of refugee protection, anticipating some of the incentives that it might create for states.

Stigma has been seen as a barrier to the adaptation and reuse of buildings and for historic former asylums, the fear of the "madhouse" has been argued to have transferred to the buildings themselves. They are buildings which are both socially and historically challenging. However, as these sites have closed and have begun to be converted into residential accommodation, the negative perceptions of the asylum appear to have eased, to be replaced by an appreciation of their built form through their architectural and heritage features. Research into the reuse of historic former asylum sites is limited, as is research exploring the subjective or emotional influences on property development decisions. This research addressed this gap by investigating the phenomenon of reuse of historic former asylums. It did so through the examination of the intersecting factors involved in that process; the perceptions of the stakeholders in respect of place attachments, stigmas, and values ascribed to the sites. It also investigated the perceptions that stakeholders had of themselves, each other and the re-development process. Three historic former asylums in the North of England were identified to provide context to this research: St Mary's in Stannington, Northumberland, St George's in Morpeth, Northumberland and Lancaster Moor Hospital in Lancaster. Within the context of each of these sites, interviews were carried out with the different stakeholder groups involved in the redevelopment of these sites. These stakeholders were planners, developers, heritage bodies, former staff members and the owners of the sites. The public was also surveyed in Morpeth and Lancaster through questionnaires, as were new residents of converted former asylum sites. Through the analysis from this data collection, it was found that an acceptable level of stigma surrounding these sites persisted; any stigma that remained did not prevent the reuse and redevelopments from taking place. The buildings were viewed as heritage buildings but predominantly from an age or aesthetical value perspective rather than being valued for their specific history. However, this history was not simply forgotten or erased, it was often incorporated or used in subtle ways within the developments, the level to which depended on the individual developer and site concerned. This research brought together two areas of research in the built environment which are not often combined: heritage and real estate. The examination of the reuse of historic former asylum sites showed more fully the valorisation process of a historic iii building through the redevelopment and reuse process. In doing so, it highlighted that the reuse and redevelopment process of historic former asylum sites was a complex one. The valorisation of the sites through their age and aesthetics was connected to their perceived economic value which enabled the sites to be converted by developers; as the sites become reappraised as heritage and therefore valued as such, this consequently created a perception of economic value and therefore a demand for the properties. This research project also highlighted that as well as a perception of value, people were attached to these sites, including some of the professional stakeholders involved in the development process. Former staff members were strongly attached due to the length of time they had spent working and living on the sites. Some of the development professionals also expressed attachment or a sense of responsibility for sites that they worked on. This was an unexpected finding as they only worked on the sites for a relatively short time and were seen by themselves, as professionals, to be objective in their working lives. This revealed an interesting juxtaposition in that the professionals felt that they were objective experts in the process, unhindered by the emotions those non-development stakeholders were thought to feel. In fact, many of those non-development stakeholders held pragmatic views about the need for something to happen with the empty sites, something not anticipated by the development stakeholders.

Having embarked on a vast journey of asylum construction from the 1860s, Scottish mental health care faced uncertainty as to the appropriate role of the asylum by the 1880s. Whereas the mid century was dominated by official efforts to lessen the asylum's custodial image, late Victorian asylum culture encompassed both traditional and new themes in the treatment and care of patients. These themes included hospitalisation, traditional moral approaches, and wider social influences such as the poor law, philanthropy, endemic disease and Victorian ethics. In an age of medical advance, Scottish asylum doctors and administrators introduced hospitalisation in a bid to enhance the status of asylum culture. The hospitalisation of the asylum was attempted through architectural change, transitions in mental nursing and the pursuit of laboratory research. Yet as a movement, hospitalisation was largely ornamental. Although hospitalisation paved the way for impressive new buildings, there was little additional funding to improve asylum infrastructure by raising nursing standards or to conduct laboratory research work. While the Commissioners in Lunacy proclaimed `hospitalisation' to be a distinctive part of the Scottish approach of mental health care, the policy's origins lay not with the policy makers but with individual medical superintendents. Although hospitalisation became an official approach by the General Board of Lunacy, like any other theme in asylum culture, the extent of hospitalisation's implementation relied on the support of individual doctors and local circumstance. Despite this attempt to emulate modern medicine, moral management rather than hospitalisation methods continued as the fundamental approach of treatment and control in most institutions. The main components of moral management were work and a system of rewards (implemented through liberties and accommodation privileges). The process of mental recovery continued to be linked to industriousness and behaviour. The thesis acknowledges the impact of local forces and wider society upon attitudes towards mental health care, such as the economically driven district lunacy boards and to a lessening extent the parochial boards and philanthropy. In viewing the asylum within the wider context of Scottish society, the asylum shared some characteristics with other Victorian institutions. Finally, although the patient's autonomy within the system should not be overplayed, the asylum doctor was also affected by the patients' co-operation with treatment and the involvement of family and friends in admission.

The main theme of the thesis is the legal protection of unaccompanied asylum-seeking and separated children in the United Kingdom asylum and social care systems. The thesis investigates if the standard of legal protection conferred upon unaccompanied asylum-seeking and separated children in the United Kingdom asylum and social care systems including durable solutions meet international law standards, protect and safeguard separated children and young persons. The research achieves this by carrying out documentary research of pertinent literature, public documents, international human rights, refugee rights and child rights treaties; and United Kingdom domestic legislation. Qualitative semi-structured interviews were conducted to generate data on the inner workings of legal protection in the United Kingdom, with specific focus on the childhood experiences of asylum and the impact of legal protection or its lack on the childhood experiences of unaccompanied children in the United Kingdom. The research involved interviews with former separated children, experts and professionals who implement the legal protection regime and policies. The thesis analyses the international treaty benchmark standards and norms for the legal protection of unaccompanied asylum seeking and separated children and examines the compliance of the UK with their legal provisions. It establishes the domestic legal standards of legal protection, and practice of child asylum determination and social care. The thesis argues for the international legal protection of unaccompanied and separated children based on a holistic system of international protection found in key international treaties chiefly the international bill of rights, the refugee Convention, the child rights Convention and the subsidiary protection framework in Europe. This results in obligations on the part of State Parties to the above international and regional treaties in this case the United Kingdom. It argues that the asylum and social care systems are equally responsible for the international legal protection obligations and should attain the objective through a best interest determination procedure that secures legal protection that is durable, while maintaining the human dignity of the unaccompanied child throughout the entire process.

The 1951 Refugee Convention aims to provide international legal protection to all asylum seekers. Individuals making asylum claims based on persecution which relates to their sexual orientation however are not explicitly represented in Article 1A (2) of the Convention. As a consequence, cases based on sexual orientation are usually argued under the ‘membership of a particular social group' category, a classification which has long remained the most contested of the Refugee Convention grounds for granting asylum. This thesis focuses on the experiences of lesbian women as they navigate the UK asylum process. The research explores how sexuality is constructed and performed as women seek asylum as well as how this impacts upon their social and sexual identity. A theoretical framework for the study is principally (though not exclusively) drawn from the works of Judith Butler (1990, 2004, 2006) and Michel Foucault (1978, 1979), as well as Ken Plummer's (1995) ‘telling sexual stories'. The research draws upon in-depth, repeat interviews with eleven lesbian asylum seekers and refugees in the UK. These women all reported to have experienced physical and sexual violence in their home countries as a consequence of their homosexuality and all had sought international protection in the UK on the basis of their sexuality. The analysis presented in this thesis reveals that the experience of going through the UK asylum process was, for the women in this study, an emotionally challenging and confusing experience. As a consequence of women's traumatic experiences in their home countries, they were often over familiar with secrecy which added to the difficulties of self-identifying as a lesbian in the UK. The legal requirement to evidence and ‘prove' one's sexual orientation was considered problematic and frequently left women feeling compelled to ‘perform' their sexual identity in order to be believed as a credible lesbian. In addition the analysis presented demonstrates that the requirement to share intimate narratives on demand and in an open and public way had a range of significant implications on women themselves. This included how women felt that their sexuality was persistently judged and the devastating impact of not being believed. This thesis also shows how navigating complex legal procedures impacts upon women's social and sexual identity. The study demonstrates that living in limbo, without permanency and stability exacerbated women's experiences of social isolation and rejection and left them occupying a distinct social space, excluded from British, asylum seeking and migrant groups. Despite these struggles however, the data presented in the thesis also reveals women's ability to recognise, fight and campaign for their legal citizenship and to enjoy the freedom to express their sexual identity and sexual self-esteem. The desire to create a safe space, to understand their sexuality and to re-construct a sense of belonging was paramount as women fought for their sexual entitlements.

This thesis is an exploratory study of the way perceptions and emotions shape the agency of asylum seekers. Using Eritrean asylum seekers that travel to Italy and their perceptions of the Italian asylum system as a case study, it explores how perceptions of Italy and its asylum system shape the strategies of Eritrean asylum seekers at different stages of their migration journey. This research went some way towards developing a notion of agency that also takes into account dimensions (such as the importance of perceptions and emotions) that are sometimes overlooked in forced migration studies, thereby contributing (or so I hope) to a more informed and subtle view of asylum seekers’ movements and of their interaction with their surrounding environment. My fieldwork demonstrates that perceptions and emotions play an important role in shaping asylum seeker agency, and that perceptions are heavily influenced by the circulation of rumours among migrants. The first part of the thesis explores the way perceptions about Italy are produced and re-produced in Eritrea (thereby leading to a set of recurrent expectations), as well as the way the identity formation process happening in Eritrea has led to the emergence of peculiar characteristics that are relevant in explaining Eritrean asylum seekers’ strategies for coping with the challenges of the asylum system. The second part of this project focuses on asylum journeys, and specifically on the various trajectories developed by asylum seekers, on the circulation of rumours and on the way perceptions about destination countries evolve. The last part examines the Italian asylum and reception systems and provides some examples of the strategies adopted by asylum seekers to overcome problems and obstacles; it also explores the factors that shape the agency of Eritrean asylum seekers, especially in relation to the Italian asylum system and to the rules of the Dublin Procedure.

This thesis explores the relationship between refugee protest and the politics of asylum governance through the case of a 2005 protest in Egypt. It challenges prevalent views of refugees as victims, of the bodies that host and assist as benevolent, and of the relationships between them as apolitical. In a 2005 sit-in in Cairo, Sudanese demonstrators took collective political action as refugees – but found their action countered and undone by host states and humanitarian institutions. Drawing from this case, the thesis develops existing understandings of the politics of asylum governance, and political activism concerned with it, along three lines. First, it takes an inductive approach to understanding the politics at play, developing concepts that allow for comparison across contexts. Second, it integrates analysis of both protester and institutional accounts of a refugee protest. Third, it explores three hitherto understudied aspects of the politics of asylum governance: the political activity of asylees regarding the rules of asylum within host countries; the effects of political struggles within asylum governance on refugee political participation; and the interactions between refugees and asylum governance in an urban, southern context. This thesis argues that refugee protest and the politics of asylum governance are related in causal, discursive, and epistemological ways: that the politics of asylum governance play a causal role in refugee protest; that protest and governance concerned with asylum share a discursive repertoire, which may be mobilised agonistically; and that the study of refugee protest is a compelling approach through which to gain insight into the politics of asylum governance. Through this study, the thesis opens new dimensions within existing scholarship on the depoliticisation of refugees, and of humanitarianism as a dominating force.

This study examines the asylum process in Europe from the perspective of unaccompanied refugee children affected by the Dublin Regulation. The aim is to explore whether these children get access to a legally certain asylum process in the Common European Asylum System by comparing the experiences of the children with legal documents, directives and guidelines on how the procedure should be implemented. The study has been conducted as a multiple case study where information has been collected from previous research, published stories and reports, news articles, legal documents and an interview with a representative from a local network supporting asylum seekers living in clandestinity. The study uses the theory of Hannah Arendt regarding the right to have rights, examining whether the children’s experiences of the asylum process in Europe compared to legal documents show signs of them being excluded from a legally certain process and what that may mean for their human rights to be implemented and protected. International human rights law states that children, and especially unaccompanied refugee children shall always receive special protection due to their vulnerable status and the European Union should guarantee a legally certain asylum procedure for all refugees in all member states. This study illuminates difficulties for unaccompanied refugee children affected by the Dublin Regulation to get access to a legally certain asylum process in Europe and in accordance with the theory of Arendt their functional statelessness tend to exclude them from getting human rights, advocated as universal, fulfilled.

Asylum claimants regularly arrive in the UK without corroborating evidence to support their request for refugee protection. Consequently, an assessment of the credibility of the applicant’s account of persecution tends to become the focal point of asylum decision-making. In order for an applicant’s asylum claim to be assessed as factual, and therefore, credible it must be prepared in a way that conforms to the narrative models in legal discourse and meets the evidential requirements for showing past persecution and a future well-founded fear of persecution. It is for this reason, in part, that the role of legal practitioners becomes crucial. This thesis explores the ways that asylum solicitors deal with the issue of credibility in their daily working practices. It also examines the structural and procedural constraints which affect the working practices of solicitors when representing asylum clients in this way in asylum appeals. Based on ethnographic research conducted in Glasgow over an eighteen-month period, this thesis considers the ways that asylum solicitors approach credibility when representing asylum clients. This thesis explores the different forms of paid and unpaid labour undertaken by asylum solicitors and analyses how external factors such as legal aid funding arrangements affect the morale and working practices of solicitors who represent asylum claimants. It seeks to argue that a criminalising discourse exists in the asylum and immigration processes in Glasgow. Moreover, it demonstrates that such discourses extend to a cohort of asylum solicitors working in Glasgow and that the culture of disbelief which exists among these solicitors results in them regularly disbelieving their asylum clients’ accounts. Finally, by considering proposed changes to funding arrangements in Scotland, which would bring them in line with those in place in England and Wales, this thesis contends that were these arrangements to be introduced this would result in the underrepresentation of, and limited access to justice for, asylum applicants in Scotland.

This research uses the records of the Hampshire County Asylum (HCA) between its opening in 1852 and the end of the nineteenth century to offer a different perspective on asylum history. Though it discusses the asylum in legal, medical and social welfare contexts it focuses on the experience of individuals and their families and the part played by the HCA in their lives. The perspective and methodology of the research reflect the recognition of the importance of individual experience in the construction of historical exposition. In the course of the research a database of patients' personal information was constructed from asylum records. The resulting analysis of individual experience of admission to the HCA suggests that, for many patients, admission was short-term and temporary, caused by a combination of symptoms and events that erupted into crisis. For others the HCA provided a level of care that could not be sustained at home and for some an asylum admission was only part of a wider and continuing strategy of care which enabled troubled families to continue to function. The thesis concludes that, although the county asylum was a potent symbol of many aspects of Victorian society, it should be seen, not as defining those who encountered it, but as a part, sometimes essential but often small, of their personal and family narratives.

Asylum seekers often experience stressful and traumatic experiences throughout the asylum journey (in country of origin, in ‘flight’ and in re-settlement in the UK), shown to be linked to psychological difficulties. A systematic review of the literature demonstrates a paucity of high-quality qualitative research exploring the experiences of asylum seekers across the asylum process. Research with this population has been dominated by quantitative research examining the psychopathological sequelae resulting from exposure to traumatic events. Resilience is an emerging concept in psychotraumatology, though no studies have examined resilience and coping in asylum-seeking populations. The aim of this research was to address this gap in the research by using a qualitative methodology to understand the ways asylum seekers make sense of, and cope with their experiences across the asylum journey. Using an interpreter, semi-structured qualitative interviews were conducted with eleven asylum seekers in South Wales accessing a third sector mental health project and / or a primary care service. A constructivist grounded theory approach was used, and a theory emerged from the data highlighting four themes spanning the asylum journey; ‘Before Asylum’, ‘Displacement’, ‘What it means to be an asylum seeker’ and ‘thinking about the future’. The stressors of involvement with the asylum system and adaptation to a new environment are core aspects of the theory, along with an exploration of how asylum seekers cope with these circumstances, via a range of internal psychological and external support sources. Prior experiences (including the development of ‘inner strength’) impacted upon how participants conceptualised their everyday experiences, and this shaped how they thought about the future. The findings have numerous clinical implications for services providing support for this population, which are discussed along with recommendations for future research. The study increases the research base around how asylum seekers understand and cope with the asylum journey.

This thesis employs discourse analysis to examine the human rights contradictions contained in the Common European Asylum System (CEAS). It follows the development of the CEAS since its inception in 1999. However, the principal emphasis of the thesis falls on the scope for realising a rights-based asylum regime in the post-Lisbon context. The research takes the form of policy analysis, and is grounded in a human rights framework of inquiry. This human rights perspective is used to examine the normative and legal inconsistencies inherent to the EU’s securitised approach to asylum, and to put forward suggestions for an approach to asylum in the EU, which engenders a rights-based approach to protection. The analysis of contemporary EU asylum policy and practice demonstrates the extent to which securitisation is present in EU asylum policymaking. It shows that, until the security paradigm in this policy area is supplanted, the realisation of a rights-based asylum system in the EU will not be possible. It also addresses the further challenges to the realisation of the EU as a ‘single asylum space,’ which stem from the limitations in the current instruments of the acquis, most notably the absence of burden-sharing mechanisms to ensure that the EU’s humanitarian obligations are shared equally amongst Member States. The recent ratification of the Treaty of Lisbon holds significant potential for the development of a rights-based asylum regime in the EU. However, it remains in question whether Member States have the political will necessary to accomplish this.

The United Kingdom’s acceptance of lesbian, gay, bisexual, and transgender (LGBT) refugees has been heralded as a progressive shift in asylum law. Indeed, the scope for the protection of sexual minorities under the Refugee Convention has expanded. The interpretation of the Convention definition of refugee in Article 1A(2) has been continuously adapted, especially the “particular social group” (PSG) category as well as the recognised scope of “well-founded fear of being persecuted.” This thesis interrogates how “gay” refugees have been accepted under the Convention. The analysis considers the ways judicial decision-making has constructed the PSG and persecution of sexual minority asylum seekers. The sample consists of 22 appeals from 1999-2011 which were identified as major legal developments, beginning with the first significant recognition of “homosexual” refugees. Several additional tribunal determinations and key international cases are also considered. A socio-legal approach is taken to study the tensions between fluid sociological images of gender and sexuality and the fixed notions of identity found in the law (whether arising from individual cases, formal practice, or state imperatives). Through an examination of the legal discourse in the texts examined, the research deconstructs the jurisprudential debates in order to assess their impact on sexual minorities seeking asylum. This contextual, rather than doctrinal, approach reveals how the jurisprudence often obscures sociologically problematic assumptions made by adjudicators. This analysis offers an original contribution, concluding that UK protection is grounded on the assumption that sexual and gender identity are “immutable.” Far from opening the UK to persecuted sexual minorities, the prevalence of this assumption significantly narrows the apparently “inclusive” construct of the refugee. Building on the findings, the thesis proposes that adjudication should focus on the persecutory intent to suppress non-conforming acts and identities (or norm deviance) in order to identify sexual minority refugees rather than the categories of LGBT. Additionally, framing determination in the terms of relational autonomy develops a better understanding of the conditions necessary to realise a non-conforming sexual and gendered life free of persecution. The concept of norm deviance decentres the assumption of a knowable truth of identity, and relational autonomy asserts that the deprivation of self-determination and rights to relate may constitute a well-founded fear of persecution.

The Kew Asylum has been a dominant feature of Melbourne’s built environment for over 100 years. In addition to the visual impact it has made on Melbourne’s skyline it has been very much a part of the psychological landscape of the collective imagination of the city’s inhabitants. Despite this, comparatively little has been written about its impact on society, and almost nothing has been recorded in any comprehensive sense, about its occupants or inmates. This dissertation aims to go some way towards redressing this, not with a broad sweep institutional biography, but with an intimate portrait of the asylum’s earliest days. Covering a time frame of less than 50 years, this thesis adopts a multi-theoretical approach in order to illuminate the different facets of asylum life with the maximum clarity. The thesis contains several themes, some of which overlap and interweave in order to examine the complexity of institutional life.

The topic of this thesis is justice and asylum. The central argument in the thesis is that citizens of all states have a moral right that entitles them to asylum in certain circumstances of deprivation. The right to asylum can be understood as a general derivative right, and it is grounded in the more fundamental entitlement to basic needs. More specifically, I argue that all persons whose basic needs are insufficiently protected in their home states have the right to asylum when they cannot be assisted with other remedial instruments by the international community within a reasonable timeframe. By using the right to asylum as a normative evaluative standard, I also argue that the existing refugee protective institutions are morally unsatisfactory, and that a 'moral refugee regime' should be established to replace the current protective institutions. Then the questions becomes, what specific form these institutions should take. In the thesis I focus primarily on one institutional proposal, 'the tradable quota scheme', and its ethical dimensions. I defend the tradable quota scheme against several lines of criticism, and suggest that the scheme constitutes a normatively viable alternative for the existing institutional framework. Finally, I examine obligations in the protection of the right to asylum in circumstances of partial compliance. I conclude that the citizens of complying states have the obligation to 'pick up the slack' and assist those bearers of the right to asylum who are unjustly denied assistance by the non-complying states.

This thesis offers an investigation into the social construction and social control of the asylum 'problem' in the UK. It explores how asylum came to be constructed as a key social problem, how this process of problematisation influenced the development of a range of social control strategies and how their imposition has shaped subsequent developments. Asylum has been associated with a range of contemporary social problems and has become an issue through which wider insecurities are articulated. This study is based upon qualitative research combining semi-structured interviews with a range of actors involved in various ways in the asylum debate, along with documentary analysis of materials integral to the construction of the issue. This involved the analysis of accounts and the types of discourses that have been used to promote particular knowledge claims regarding asylum seekers. The findings of this research show that the problematic status of asylum is not an inevitable consequence of large numbers of recorded applications for political asylum, as is often postulated. Rather, it is the result of a range of claims making activities and interventions from a diverse body of actors and institutions. Integral to these findings is that the social control responses implemented to provide solutions to the problem themselves further contribute to asylum being viewed problematically. As such, the findings of this research are situated within a wider body of academic literature, including social constructionism and social control. The analysis of this study builds upon such works to provide an insight into how it is that contemporary social problems are constructed and how this can be directly related to the specific conditions of late-modern societies.

Unaccompanied minor asylum seekers and refugees are a unique population, who have experienced multiple traumas and loss. A summary of trauma and risk factors faced by these youngsters during pre-migration, flight and resettlement periods is presented. The potential impact of such experiences is evaluated in relation to psychological well-being. Social support is widely accepted as playing a protective role in psychological well-being following stress and trauma (Joseph, 1997). The potential benefits of social support for unaccompanied youngsters seeking asylum in the UK are considered in relation to the stress buffering model and main effect model. Challenges to accessing and utilising social support, such as insecure attachment relationships are discussed in relation to this population. Implications for service providers and future research are also explored.

The thesis explores lived experiences of sexual minority asylum seekers and refugees in the UK and the analysis emerges from a two-year long ethnography with 60 people. I chose to focus on sexuality in the context of asylum in order to trace parallelisms and differences amongst the conditions of subalternity to which non-heteronormative subjects can be exposed in different geo-political locations. In the process I seek to: i) understand the specificity of the experiences of identification and belonging of people claiming asylum for fear of persecution in their countries of origin because of their sexual orientation and/or gender identity, and ii) to elicit and examine the migratory experience from the asylum claimant's standpoint within the structural constrictions emerging from the current UK migration regime. The thesis consists of two main analytical trajectories. First, I examine how the migratory experience of the studied sexual minority migrants is located within a set of humanist discourses that privileges suffering and trauma as the most potent way for the subject to receive state protection. In this regard, I introduce a critique of humanitarianism insofar as sexuality (as a rights-claim object) comes under scrutiny in the context of migration control practices and discourses. Further, by examining UK law I ask how non-heteronormative lives are construed in the asylum determination process, from the initial stage of a claim to the end of it, and how sexuality travels, namely how it is translated, in such sites. Second, I elaborate on the structural discourses explored throughout the thesis by putting them into direct dialogue with the findings arising from the ethnography. Within this space respondents' biographical accounts highlight how being situated in liminal socio-political and legal interstices produc.es precarious forms of life. The study contributes to current migration and sexuality scholarship by offering a critique of recent formations of neocolonial political discourses with the emergence of sexuality as a legitimate field for claiming rights in the realm of international relations. In this regard, my analytical endeavour is not dedicated solely to exploring respondents' supposed subalternity in their countries of origin, rather my focus is to examine the situations that produce states of subalternity whilst living in Britain. I seek to highlight that the passage from oppression in one's country to liberation in the UK is much more complex than how it is dominantly portrayed in the current global ethical-political stage.

Over the past two decades, the European Union has taken important steps towards the establishment of a common European asylum policy. The question of the impact of this cooperation on domestic asylum policy has so far received surprisingly little attention. Most explanations have focused on how an agreement on restrictive policies was achieved at EU level, and assumed a relatively unproblematic implementation of these measures domestically. More recently, some scholars have contested these explanations by emphasizing the rights-enhancing effects of recent EU asylum policy legislation. This thesis argues that rather than focusing on the question of whether EU cooperation increases or decreases domestic asylum policy standards, we should focus on explaining how EU asylum policy affects domestic asylum policy. The question can only be addressed satisfactorily if the inter-related processes of arriving at these policies at EU level and implementing them domestically are taken into account. The theoretical account proposed here conceives of preferences as the crucial variable connecting the processes of uploading and downloading. The main argument of this thesis is that governments try to project their policy preferences which reflect their desire to change or retain domestic status quo and to download policies in accordance with these preferences. At the EU level, governments seek to upload or support policies in line with their domestically-shaped preferences and oppose those which contradict them or at least seek flexibility allowing them to maintain existing policies. At the national level, states download EU policy selectively, in line with their domestically-shaped preferences, leading to over-implementing, under-implementing or not implementing certain provisions. In addition, the thesis locates the sources of these preferences on asylum policy in public opinion, party ideology, and the number of asylum seekers. The dissertation shows that issue salience in the media and among the general public affects the relationship between these variables. Depending on the political-institutional context, the factors identify above interact with each other, resulting in differential impact of EU asylum policy on domestic policy. The thesis distinguishes between simple and compound polities, and shows how they differ in their responsiveness to the variables identified above, in the frequency and stability of reforms, and in the way they use the EU to facilitate domestic change. It also demonstrates that in compound polities preferences are mostly influenced by party ideology while in simple ones they are more likely to reflect public opinion. In order to trace the impact of EU cooperation in asylum policy on domestic policy, this dissertation employs process tracing and a three-step analytical framework which encompasses preference formation, EU-level negotiations and implementation. The entitlement of lesbian, gay and bisexual (LGB) individuals to claim asylum on the basis of their sexual identities has been a contentious matter, as sexual identity was not a ground of claim explicitly recognised under the 1951 Refugee Convention. Nonetheless, the United Kingdom (UK) has incrementally recognised the ability of LGB asylum-seekers to claim such protection over the last twenty years. This thesis undertakes a socio-legal investigation of the British asylum system from the perspective of LGB asylum-seekers. Using evaluation theory, it examines the fairness with which LGB asylum claims are treated in the UK, and the standards to which they are entitled. As the starting point, this thesis explores the legitimacy of using fairness as its standard, and examines the content of this standard. From this, it advances ‘structural principles’ that are used to examine the British asylum system since the UK Supreme Court’s seminal decision in HJ (Iran). Investigating the British asylum system through the framework provided by the structural principles is supported by qualitative data obtained from interviews conducted with legal practitioners, activists, academics, decision-makers and asylum-seekers, and from replies to the Freedom of Information requests addressed to the Home Office. This has helped to conduct a substantial analysis of the British asylum system, as experienced by LGB asylum-seekers today. It offers tangible praise, critique and recommendations with respect to their treatment regarding matters of procedural fairness, i.e., that relating to the asylum process itself, and substantive fairness, i.e., matters pertaining to the outcome of the claim for protection. This thesis submits that intersectionality and the diversity of sexual identity should be at the core of an asylum system that deals fairly with LGB claims for asylum in the UK. LGB asylum-seekers require access to an asylum system that is sensitive and empathetic to their experiences, and which avoids essentialising sexual identities and conducting ‘single-axis’ analyses. The system must operate with flexibility, in line with the unique needs and experiences of LGB asylum-seekers, and with respect for their fundamental rights.

A Cultural Study of Asylum in the UK Under New Labour critically explores the meaning and significance of an 'asylum crisis' constructed within British public discourse since 1997. Drawing upon the discourse theory of Laclau and Mouffe and the work of other poststructuralist, deconstructionist and Cultural Studies theory, the research opens a range of questions about how the dominant hegemonic discourse on asylum has been articulated, using examples in the analysis drawn from across a number of discursive sites, focusing primarily upon examples drawn from the national news media, the rhetoric of mainstream national politicians and policy and other official documents. In the first three chapters the study seeks to explain how theory is important to understanding the role of asylum in contemporary culture and politics. Here, a genealogy of ideas concerning the 'othering' of migrants in the UK is developed, and in relation to asylum, an elucidation of some key concepts for discourse theory and Cultural Studies. The analytical approach of the study is constructed through a critical appraisal of Laclau and Mouffe's discourse theory in relation to asylum as an object of analysis and via an engagement with the work other poststructuralist scholars. Case study chapters then examine how a dominant asylum discourse has been constructed in relation to particular 'crisis' issues, how these discourses have shifted and changed under New Labour, and the technologies of control through which asylum seekers are excluded from the mainstream, 'law abiding' citizenry. Through these are explored the conditions of possibility for the articulation of asylum as a threat to the security and well being of the British nation, and concomitantly for the rearticulation of liberal democratic values such as 'human rights' as a potential threat to national security.

The UK, along with most European countries, has implemented deten-ent policies including, but not limited to, compulsory dispersal that, arguably, aim to deter potential economic migrants from entering its territory. This study of dispersed governance of asylum in the UK is organised into eight chapters. The first two provide, respectively, a review and analysis of the literature and a discussion of the methodology employed. Chapters 3,4 and 5 provide an analysis of the policy and practice of dispersal of asylum seekers in the UK and examines their impact on some of the most ssential needs of asylum seekers; accommodation, employment and legal services. Chapter 6 explores the effects of dispersal on integration and community cohesion, while Chapter 7 investigates the impact of dispersal on the government's capacity to manage asylum under partnership. The study's main findings are summarized in Chapter 8.

The hypothesis of this thesis is that hidden behind the European legal approach to issues of Immigration and asylum is the deeply embedded European philosophy of exclusion. The thesis argues that exclusion has its roots in historical interpretations of Difference and Otherness. It is cyclical in nature, and the identity of groups targeted for exclusion changes over time. The thesis argues that the practice of exclusion has been honed and perfected into a societal norm from which exclusionary law claims legitimacy. It goes on to develop the idea that exclusion is a reflection of a deeper societal unease rooted somewhere in European history culture and philosophy, the influence of which continues to have a deleterious effect on contemporary attitudes towards immigration and asylum, and on the corresponding laws of the European Union and its member states. Whilst law indicates the methods and grounds of exclusion it does not indicate the philosophy and psyche behind the law. In order to test the hypothesis, the thesis explores the social and legal history of exclusion in Europe from the 19th century to the present time. It strives to establish the identities of the excluded in the pre-first World War European Empires, and suggests that they were essentially defined by their Europeanness, and often based on internecine conflict. The thesis goes on to look for similarities in the identities of the excluded of the interwar years, and notes how issues of race resurfaced to form a new ideology. The chronology continues by exploring the post Second World War period, and notes how the identities of those who occupied the symbolic space of exclusion evolved from an essentially European identity, to new non-European characteristics, linked to the rise of non-European immigration. The thesis therefore suggests that Difference, Otherness and Exclusion have evolved into a societal norm from which exclusionary law claims legitimacy. It suggests that the concepts of Difference Otherness and Exclusion continue to influence contemporary society, and suggests that Europe remains preoccupied with issues of identity and of responding to these issues in a traditional exclusionary manner. Finally the thesis begins to consider whether the animosity and mistrust previously reserved for the European Jewry is now being re-focused on Europe’s Muslim community. It asks if the restrictions on the entry into Europe of those fleeing conflict in the Middle East, and of those who hail from the Indian sub-continent and who wish to settle in Europe, are an expression of a new cycle of exclusionary practice where only the identity of the excluded has changed. Therefore the thesis aims to contribute to knowledge by re-visiting some of the ambiguities inherent in European history, law and society; and challenge assumptions of what gives rise to pejorative attitudes towards immigration and asylum. Through the exercise of independent critical analysis it aims at a new interpretation of known facts. By applying theoretical interpretations to historical and contemporary narrative, the thesis seeks to demonstrate that the identity of the excluded is seldom static, and advances the idea that exclusion, based on ethnicity or religion or gender - the list is not exhaustive – has cyclical characteristics. In terms of law and scholarship it is of societal benefit to understand who were the excluded of the past – and why; who are the currently excluded – and why; and how, given an understanding of the past and the present, it may be possible to forecast who are to be the future excluded, and why this might be so.

Resumen
The main aim of this research is to holistically analyse the content and critically assess the development of EU’s ‘Common European Asylum System’ (CEAS). It is pursued in three consecutive steps. The research first offers a deeper understanding of the CEAS, a notion that despite its centrality to EU’s asylum policy lacks a precise definition. This gap forms the natural starting point of this study. The study advances its own substantial understanding, which includes the modes of implementation of the policy. Hence, it retraces the main modes of implementation in the initial policy design. As a second step, the research focuses on a principle that should be central to the design and implementation of this policy, the principle of solidarity and fair sharing of responsibility. It argues that this principle unsettles the initial administration paradigms. The third step is to analyse an element that has not been explored so far by legal literature, namely the administrative governance of CEAS, as it pertains to its implementation. On this basis it examines the institutionalisation of practical co-operation, people-sharing arrangements and EU funding. It is a study of the European administration in action in the area of asylum. I critically assess the adaptations made to the policy design since its inception, including those catapulted by the so-called refugee crisis. On this basis, the research proposes potential avenues for the future development of the asylum policy.

The refugee crisis is currently a major world event. However, not much is known about the technology adoption and digital skills of those fleeing these conflicts and seeking asylum in foreign countries. To study this, a qualitative study was conducted in Umeå, Sweden. Data was collected through interviews, written responses and observations. The results show that refugees and asylum seekers have positive attitude towards digital technology adoption. However, they perceived digital technology primarily as tools to fulfil their recreational needs. A strategic use of technology for improving productivity was not evident. While formal internet skills were generally common among every user, most interviewees were not able to carry out more complex tasks, such as finding facts online, as they found it particularly challenging to select appropriate search systems and to construct meaningful queries. This research wants to contribute to the literature in IT and social inclusion. The findings reported here suggest that digital divide can be conceptualized as digital illiteracy because of lacking awareness over data management and information processing capabilities. Moreover, identifying the digital practices of these minority groups could be extremely meaningful for the digital inclusion strategy efforts of Sweden and for a better design of public services.
