Abstract Most discourse related to refugees has been and continues to be related to humanitarian issues. Yet, humanitarianism as a theoretical framing is no longer sufficient for understanding refugee-fuelled migration. The politics of such migration currently dominate policy discourse and Hong Kong is no exception. Asylum seekers continue to seek refuge in a city that neither wants them, nor is sympathetic towards them. The study reported here seeks to understand this context from the point of view of asylum seekers and their supporters in the community and offers an alternative theoretical framework that reflects Hong Kong asylum seekers’ experiences. A qualitative methodology was employed to understand the contexts and asylum seeker experiences. Results indicated that extraordinary institutional pressure is exerted on asylum seekers who cannot settle in Hong Kong but who, in the meantime, are forced to rely on inadequate social protection to survive.

Resumen
Several studies have described the condition of asylum seekers as being on the threshold or in-between structures. Victor Turner’s concept of liminality and Agamben’s state of exception have been used extensively to analyse this condition, mostly to show the negative implications of the ambiguous legal (non-) status. This article argues that the condition of liminality provides an intensified doubleness of impossibility and possibility for action, which casts a different light on conceptualizing agency. Without disregarding the downside of this liminal, in-between condition, the article shows that the lack of ‘normalized’ connectedness to the new structure combined with physical distance from the past structure, enables reflection and feeds the power of imagination. This can lead to alternative (yet conditional) forms of agency, such as delayed agency and agency from marginal positions. Through the narratives of asylum seekers living in Dutch asylum seeker centres, the article shows the potential of transforming non-places, such as asylum seeker centres, into those in which existential meanings can emerge (even if partial). Considering these sources of agency has great implications for the short-term well-being of asylum seekers and the long-term inclusion of refugees in their countries of residence.

The narrative that grounds the asylum policy of the United States portrays asylum seekers as passive objects of external forces. This narrative emerges from the complex interplay of exceptionality and victimization that characterizes the legal status and popular perception of the refugee. It is then read back onto the asylum seeker through a supereroga- tory asylum policy that is unable to recognize the moral demand made by the asylum seeker. The project this essay is drawn from seeks to challenge the policy of asylum as charity by interrogating alternative narratives grounded in the Hebrew Bible story of the Exodus and the Qu’ranic story of the Hijra. In these narratives, flight from oppression is portrayed as an act of moral agency, and the asylum seeker’s capacity as Other to make a moral demand on the Self emerges. Thus, I argue that an asylum policy informed by these alternative narratives needs must question its supererogatory assumptions.

There has been much focus on the increased influx of asylum seekers in Norway and in Europe in general. This article investigates links between the influx of asylum seekers and developments in asylum policies in Norway. In focus are the immigration trends of the four largest groups of asylum seekers in Norway in the period 2006–2012. It is assumed that developments in the arrival of asylum seekers are to a large extent influenced by the ways in which the four groups were treated by migration authorities in Norway. This analysis is based on policy survey and available statistics. The longitudinal analysis indicates that changes in rejection, approval and deportation rates correspond to a large extent with subsequent fluctuations in annual arrivals of asylum seekers. It is also maintained that the restrictions in social rights result in deteriorating living conditions, but as a tool of migration control such restrictions do not work in accordance with the intention. The findings are of clear relevance for on-going discussions on asylum seeker mobility and discussions on minimum standards for reception of asylum seekers.

During the current period of immigration to Western Europe, national healthcare systems are confronted with high numbers of asylum seekers with largely unknown health status. To improve care taking strategies, we assessed healthcare utilization in a large, representative cohort of newly arriving migrants consisting of n = 1533 residents of a reception center in Northern Germany in 2015. Most asylum seekers were young, male adults, and the majority came from the Eastern Mediterranean region. Overall, we observed a frequency of 0.03 visits to the onsite primary healthcare ward per asylum seeker and day of camp residence (IQR 0.0–0.07, median duration of residence 38.0 days, IQR 30.0–54.25). Female asylum seekers showed higher healthcare utilization rates than their male counterparts, and healthcare utilization was particularly low in asylum seekers in their second decade of life. Furthermore, a significant correlation between time after camp entrance and healthcare utilization behavior occurred: During the first week of camp residence, 37.1 visits/100 asylum seekers were observed, opposed to only 9.5 visits/100 asylum seekers during the sixth week of camp residence. This first data on healthcare utilization in a large, representative asylum seeker cohort entering Western Europe during the current crisis shows that primary care is most needed in the first period directly after arrival. Our dataset may help to raise awareness for refugee and migrant healthcare needs and to adapt care taking strategies accordingly.

This thesis is an exploratory study of the way perceptions and emotions shape the agency of asylum seekers. Using Eritrean asylum seekers that travel to Italy and their perceptions of the Italian asylum system as a case study, it explores how perceptions of Italy and its asylum system shape the strategies of Eritrean asylum seekers at different stages of their migration journey. This research went some way towards developing a notion of agency that also takes into account dimensions (such as the importance of perceptions and emotions) that are sometimes overlooked in forced migration studies, thereby contributing (or so I hope) to a more informed and subtle view of asylum seekers’ movements and of their interaction with their surrounding environment. My fieldwork demonstrates that perceptions and emotions play an important role in shaping asylum seeker agency, and that perceptions are heavily influenced by the circulation of rumours among migrants. The first part of the thesis explores the way perceptions about Italy are produced and re-produced in Eritrea (thereby leading to a set of recurrent expectations), as well as the way the identity formation process happening in Eritrea has led to the emergence of peculiar characteristics that are relevant in explaining Eritrean asylum seekers’ strategies for coping with the challenges of the asylum system. The second part of this project focuses on asylum journeys, and specifically on the various trajectories developed by asylum seekers, on the circulation of rumours and on the way perceptions about destination countries evolve. The last part examines the Italian asylum and reception systems and provides some examples of the strategies adopted by asylum seekers to overcome problems and obstacles; it also explores the factors that shape the agency of Eritrean asylum seekers, especially in relation to the Italian asylum system and to the rules of the Dublin Procedure.

Unaccompanied minor asylum seekers and refugees are a unique population, who have experienced multiple traumas and loss. A summary of trauma and risk factors faced by these youngsters during pre-migration, flight and resettlement periods is presented. The potential impact of such experiences is evaluated in relation to psychological well-being. Social support is widely accepted as playing a protective role in psychological well-being following stress and trauma (Joseph, 1997). The potential benefits of social support for unaccompanied youngsters seeking asylum in the UK are considered in relation to the stress buffering model and main effect model. Challenges to accessing and utilising social support, such as insecure attachment relationships are discussed in relation to this population. Implications for service providers and future research are also explored.

1.1 Background: Despite growing recognition of the negative impact of ever stringent asylum employed by western governments, psychological conceptualisations of distress in these populations remains dominated by traumamodels. 1.2 Literature Review: A systematic literature review was conducted to collate and critique findings from studies relating postmigratory stress to asylum seeker distress. The 44 reviewed studies suggested asylum seekers endure a range of postmigratory stressors relating to acculturative challenges, social isolation, material deprivation and restrictive asylum legislation. Difficulties associated with conducting research with these populations are acknowledged. It is concluded that restrictive asylum policies greatly inhibit asylum seekers’ abilities to negotiate challenges resulting from displacement. Smail’s (2005) social materialist perspective is suggested as a framework for findings. 1.3 Research Report: No known British empirical research has focused on exploring relationships between postmigratory-stress and asylum seeker mental health. Based on established methodologies (e.g. Silove et al.,1997) a cross-sectional study was undertaken to explore the relative relationship with distress of postmigratory-stressors and premigratory-trauma exposure. An opportunity sample of 98 asylum seekers completed measures of postmigratory-stress (the PLDC: Silove et al., 1997); premigratory-trauma exposure (HTQ-TE; Mollica et al.,1992) and distress (HTQ-PTSD: Mollica et al.,1992; HSCL-25: Hesbacher et al.,1980; Winokur et al.,1984). High levels of exposure to premigratory-traumatic events, postmigratory stress, and distress were reported. Regression analyses revealed ‘Feeling a burden to others’ and being denied asylum to be the strongest predictors of distress. It is concluded that a range of postmigratory stressors impact negatively on asylum seeker wellbeing. Those denied asylum experience more restrictions and poorer mental health. Limitations are acknowledged. 1.4 Implications: The literature review and research report conclude that present asylum determination processes are damaging to those seeking refuge. Psychotherapeutic interventions directed at the intra-psychic level may be of limited effectiveness given the more primary social and material needs of these clients. 1.5 Critical Appraisal: Reflections on the research process are presented alongside key learning points.

The refugee crisis is currently a major world event. However, not much is known about the technology adoption and digital skills of those fleeing these conflicts and seeking asylum in foreign countries. To study this, a qualitative study was conducted in Umeå, Sweden. Data was collected through interviews, written responses and observations. The results show that refugees and asylum seekers have positive attitude towards digital technology adoption. However, they perceived digital technology primarily as tools to fulfil their recreational needs. A strategic use of technology for improving productivity was not evident. While formal internet skills were generally common among every user, most interviewees were not able to carry out more complex tasks, such as finding facts online, as they found it particularly challenging to select appropriate search systems and to construct meaningful queries. This research wants to contribute to the literature in IT and social inclusion. The findings reported here suggest that digital divide can be conceptualized as digital illiteracy because of lacking awareness over data management and information processing capabilities. Moreover, identifying the digital practices of these minority groups could be extremely meaningful for the digital inclusion strategy efforts of Sweden and for a better design of public services.

This thesis is an analysis of the integration of dispersed asylum seekers in Glasgow. It is a qualitative case study that uses data from participant observation with community groups, interviews with asylum seekers and those involved in service provision and policy, and documentary analysis. It examines the impact of policy within a local context, and the difficulties of defining and promoting integration for asylum seekers. The research makes both an empirical and theoretical contribution, building on the knowledge of the impact of dispersal and asylum policy, with a Scottish perspective analysing the issues when implementing reserved asylum policy within a devolved context. The research contributes to debates on integration with an analysis of the conceptual and practical difficulties of promoting integration for asylum seekers. The research findings are structured around three key analytic themes, the impact of policy on asylum seekers and other stakeholders, defining and promoting integration, and challenges. The research indicates tensions between devolved and reserved responsibilities in relation to asylum. The different approaches to integration create difficulties for those working within devolved services, but implementing a reserved policy. Promoting integration for asylum seekers is seen as beneficial for both asylum seekers and host communities in Scotland, but there are both conceptual and practical challenges. There are difficulties of how far and in what ways temporary integration can be measured, which are analysed in relation to existing frameworks for integration. Practice related debates have formed the basis of a shift to a more strategic platform for integration work. Contexts and procedures continue to change, however, bringing fresh challenges. The concept of social capital has been influential in the structures that have been set up to facilitate the processes of integration and dispersal within Glasgow. Yet there are difficulties with the usage of a social capital based framework. Whilst social capital is a useful concept, there is a risk that its usage may mask issues of inequality and exclusion, and the fundamental difficulties of the asylum process remain.

The purpose of this thesis is to describe the asylum seekers that reside in Turkey temporarily, from their own standpoint and from the viewpoint of workers and representatives working in the agencies and institutes involved in the field. This work focuses on the inconveniences experienced by asylum seekers and refugees during their stay in Turkey and the reasons of these inconveniences, in the context of social exclusion. The research for this thesis is based on the analysis of the in-depth interviews that were done with the asylum seekers, representatives and workers in UNHCR, government and in several NGOs. Relevant report by the UNHCR, and the scholarly literatures on migration and asylum and on transit migration and asylum seeking through Turkey was examined. The results of the study can be sorted as follows: Firstly, there is an increasing and visible reluctance to accept refugees in the world. Secondly, it is seen that Turkey does not have an effective asylum policy and legal arrangements on this issue. Thirdly, not only the asylum seekers but also the officers who are dealing with them face some problems. Lastly, it had been observed during the interviews asylum seekers are being excluded different ways during the period of living in Turkey.

There is an ongoing argument that the settlement services provided to asylum seekers in Canada are inadequate. However, the contribution of these services in general and that of shelter services has not been researched. This study sought to examine the contribution of emergency and temporary shelter services to the independent living of asylum seekers in Montreal. Using a qualitative approach, data was generated from 10 participants (service providers and former service users) of Montreal shelter. The major contribution of the Montreal shelter services was the development of social networks which former residents used to access employment and housing. Although the services contributed to the independent living of former residents such as accessing permanent housing, employment etc other external factors impeded their successful settlement in Montreal. The most important factor was employment related discrimination in the job market based on language ability, foreign academic qualifications and work experience.
Les services d’intégration inadéquats offerts aux réfugiés demandant le droit d’exil suscitent un perpétuel débat. Toutefois, peu de recherches ont été effectuées sur la contribution de ces services en général et sur les services d’hébergement.Cette étude vise à examiner la façon dont contribuent les services d’urgence et temporaires offerts par les centres d’hébergement à l’autonomie des demandeurs d’asiles à Montréal. Une approche qualitative a été utilisée pour recueillir les données provenant de dix participants qui étaient soit des fournisseurs de services, soit des anciens usagers des maisons d’hébergement de Montréal. La principale contribution des services d’hébergement de Montréal a été le développement du réseau social qui facilite, pour les bénéficiaires des services, l’accès à l’emploi et à l’hébergement. Même si les services ont contribué à l’autonomie d’anciens résidents en les aidant à se trouver un hébergement permanent, un travail, etc., des facteurs externes ont contré la réussite de l’intégration à Montréal. Pendant la recherche d’emploi, le facteur le plus marquant a été la discrimination liée au niveau de langue, à la reconnaissance de la scolarité étrangère et à l’expérience de travail.

Resumen
Restrictions on freedom of movement, in particular the detention of asylum seekers as the most severe form of such restrictions, constitute an interference with fundamental human rights and must be approached with particular care. In view of the migration and refugee crisis, the Republic of Hungary has begun to amend its asylum legislation, thus tightening the conditions for the detention of asylum seekers. The introduction of the provision establishing that asylum may be sought only in transit zones has also led to the gradual detention of asylum seekers in transit zones, which Hungary did not consider as detention. This issue was brought before the Court of Justice of the European Union (hereinafter: CJEU), which drastically changed the path taken by the Hungarian government when it comes to detaining asylum seekers. What the CJEU has found is that leaving people in transit zones without the right to free movement is to be considered detention, even though they are not specialized detention facilities. The CJEU ordered that such a practice must cease immediately. Therefore, this paper will examine the Hungarian practice following the judgment of the CJEU. The CJEU has taken a major step towards protecting the rights of asylum seekers as regards detention, and the EU recently adopted amendments as part of the new Pact on Migration and Asylum aimed at improving the existing asylum system. The second part of the paper analyzes the provisions of the new Pact on Migration and Asylum related to detention in order to determine whether the proposed amendments contribute to the Common European Asylum System and the protection of the human rights of asylum seekers or represent a step backwards.

Resumen
Social media plays an important role in the lives of refugees. In this study, we explored social media usage among Turkish refugees and asylum seekers settled in Norway. The relationship between social media usage and demographic variables has been examined. An online survey was used for data collection. The most commonly used social media platforms among participants are WhatsApp, YouTube, and Facebook. Among demographic variables, only age was found to have a significant relationship with social media use among participants. A significant negative correlation was detected between age and social media use.

The paper analyses the influence that the Covid-19 pandemic has had on the functioning of the European asylum system. The analysis is divided into three parts and addresses problematic issues associated with different stages of the pandemic. In the first part of the paper, the author outlines the asylum practices of EU Member States in the initial stage of the Covid-19 pandemic during which the pandemic was perceived as a state of emergency. By exploring the legal possibilities to derogate both from the EU asylum rules and international human rights standards, the author offers conclusions as regards limits of derogations and the legality of Member States’ practices, especially their failure to differentiate between rules that are susceptive of being derogated in emergency situations and those that are not. The second part of the paper analyses the current phase of the pandemic in which it is perceived as a 'new normal' and focuses on making the EU asylum system immune to Covid-19 influence to the greatest extent possible and in line with relevant EU and human rights rules. The author insists on the vulnerability as an inherent feature of persons in need of international protection and researches upon the relationship between the two competing interests involved – protection of asylum seekers and ensuring public health as a legitimate reason for restricting certain asylum seekers’ rights. The final part of the paper analyses the prospects of the future EU asylum system, as announced by the New Pact on Migration and Asylum in September 2020, to adapt to the exigencies of both the current Covid-19 crisis and pandemics that are yet to come. With an exclusive focus on referral to Covid-19 and provisions relevant for the current and future pandemics, the author criticizes several solutions included in the instruments that make up the Pact. It is concluded that the Pact failed to offer solutions for problems experienced during the Covid-19 pandemic and that, under the pretext of public health, it prioritizes the interests of Member States over the interests of applicants for international protection.

Resumen
How do refugees and asylum seekers experience wellbeing and placemaking in urban contexts? The Displacement, Placemaking and Wellbeing in the City (DWELL) project explored this question through interviews with people working for non-governmental and community organisations in southeast England. It found that the current asylum system negatively impacts wellbeing and placemaking for asylum seekers, and that access to urban spaces is key to building community connections. Non-governmental organisations and faith groups play an important role in sustaining a sense of wellbeing and place for refugees and asylum seekers.

Since the “long summer of migration” in 2015, the reception of asylum seekers in France has increasingly depended on non-metropolitan areas, which have expanded their reception capacities. These areas, often considered ‘left-behind places’ with more fragile capacity for action, are playing an increasing role in the reception of asylum seekers. This paper explores how the territorial diversity in these areas leads to a variety of the local reception dynamics at the municipal level. Our analysis is based on both quantitative and qualitative methods, using an unprecedented database provided by the Auvergne-Rhône-Alpes Regional Directorate for the Economy, Employment, Labour, and Solidarity in 2023, along with semi-structured interviews with local actors. The research reveals that, the reception of asylum seekers outside metropolitan areas is far from homogeneous, varying according to the specific characteristics of each municipality.

In 2018, a team of University of Sussex undergraduate law students working under the supervision of academic staff, conducted the Migration Law Clinic Pilot Study. This was in response to growing and grave concerns about the lack of availability of legal support and services for those seeking asylum and other forms of leave to remain in the UK. These concerns have only heightened in the intervening period: most recently, in response to the government’s publication of a draft Bill of Rights to repeal and replace the Human Rights Act 1998, which would make it much more difficult for potential deportees to rely on Article 8 of the European Convention on Human Rights (ECHR) to prevent removal and might have a wider impact on the rights and status of vulnerable groups of migrants in the UK; and, among other initiatives, the government’s intention to involuntarily relocate asylum seekers to Rwanda, which will then be responsible for processing the asylum claim and for providing asylum in successful cases. The purposes of the study were: i) To better understand some of the challenges faced by asylum seekers and vulnerable migrants living in Brighton and Hove when applying for asylum, and other forms of leave to remain and leave to enter. ii) To identify the extent and reasons for any shortfall in cost-free immigration and asylum law advice and representation in Brighton and Hove. iii) To gauge whether there was demand for additional free legal advice in the form of a university law clinic, specialising in immigration and asylum law. The team undertook a review of the legal framework that governs the provision of legal aid for immigration and asylum law matters and of relevant academic commentary on its impact. The team also gathered new empirical data based on interviews with a range of local stakeholders. This report sets out the team’s findings, describes how it informed the development of the clinic, and makes recommendations both for the further development of the Clinic and for changes to the provision of legal aid. Finally, it offers advice to other universities contemplating setting up their own clinic in this area.

Migrants and asylum seekers often flee unspeakable acts of gender-based violence (GBV) at home such as human trafficking, sexual assault, sexual slavery, kidnapping, harassment, and other trauma. In trying to seek safety in the US, many endure further atrocities and exploitation at the US-Mexico border. Drawing on interviews and surveys of social and legal service providers working at the US southern border, this report documents how migrants and asylum seekers experience gender-based harm in two different but related ways as a consequence of seeking safe haven in the US. This report focuses on the experiences of women, girls, and lesbian, gay, bisexual, transgender, queer, and intersex (LGBTQI+) individuals.

Putting migrants and asylum seekers into detention for administrative reasons is a common practice in Greece, despite this policy contravening human rights. Greek authorities are using detention and the new EU-funded closed compounds as a way to discourage people from seeking asylum in Europe. Detention, as outlined in Greek law, should only be used as a final resort and only then in specific instances. Detention carries with it not only a financial cost, but also a considerable moral cost. Detention without just cause violates basic human rights, such as freedom of movement, the right to health and the right to family life. Alternatives to detention exist and must be prioritized.
