In this dissertation I argue that art projects are sites of interconnected social spaces where the work of transnational practices, neoliberal politics and identity construction take place. At the same time, art projects are "nodal points" that provide entry and linkages between communities across the Atlantic. In this study, based on multi-sited ethnographic fieldwork in Canada and Iceland, I explore this argument by examining ethnic networking between Icelandic-Canadians and the Icelandic state, which adopted neoliberal economic policies between 1991 and 2008. The neoliberal restructuring in Iceland was manifested in the implementation of programs of privatization and deregulation. The tidal wave of free trade, market rationality and expansions across national borders required re-imagined, nationalized accounts of Icelandic identity and society and reconfigurations of the margins of the Icelandic state. Through programs and a range of technologies, discourses, and practices, the Icelandic state worked to create enterprising, empowered, and creative subjects appropriate to the neoliberal project. At the same time these processes and practices served as tools for reawakening and revitalizing ethnic networking on a transnational scale. As enactments of programs initiated by the Icelandic state, the art projects studied here are approached in relation to neoliberal governmentality in a transnational context in order to explore how the operations of states and the new global economy are translated into local cultural practices, such as visual displays. This is a study of cultural circuits and transnational networking where art projects are the formative "nodes"-local sites of cultural production, neoliberal politics, multiple threads of truth claims in battles of cultural politics, identity formation, and conflicted notions of the value of art and the idea of creativity.

Resumen
This thesis analyses a series of threshold states located within contemporary culture. It investigates the effects of technology on spatial relations and human conditions in recent centuries, with a specific interest in the rise of virtual phenomena and the ongoing process of virtualisation. Key to the discussion is measuring the extent to which America and its narratives have influenced the virtual layer attached to contemporary global technological culture. Prevalent within this framework is the idea of the frontier as an idealised outpost, a lingering threshold state that is scrutinised in terms of its metaphoric power and socio-historical relevance. The research examines the points of interaction between the frontier, the virtual, and recent technology, as well as the areas in which technology has been produced, distributed, and consumed, as a means of building on ‘virtual frontiers’ and the ‘technological state’ as original critical concepts. Chapter one, from a socio-cultural and historical perspective, develops the idea of California as the location where the frontier spirit dispersed, transferring to an extent from land to body. Rich in posthuman ambience, the state functions as a hub from which to negotiate the position of the body in relation to the frontier: to look at the body as a frontier in itself, its virtualisation, and the now perennial dialectic between the positive and negative effects of technology on human/non-human interactivity. From the ashes of the 1960s, pockets of urban youth living in America’s inner cities gave birth to a subculture that is now globally recognised as Hip Hop. Despite Hip Hop always being a potent reflective surface, chapter two assesses its development and continuing capacity as a virtual and technological form of expression. In the decades between Malcolm X’s assassination and the election of President Obama, how has Hip Hop changed as a virtual arena and mode of resistance, as it has simultaneously been incorporated into the American mainstream? Indeed, as a cultural object and virtual space with the potential to carry evocative messages across thresholds, did Hip Hop even survive this transition? And what were the ramifications of its transformation? The third chapter examines the shadows emanating from the terrorist attacks on the US in 2001. The narratives from 9/11 are considered while investigating a diverse selection of transnational texts that touch on the subject, including works from Don DeLillo, Amy Waldman, Martin Amis, and Frédéric Beigbeder. Also considered is the day’s social and historical significance, and its power as a virtual event. More specifically, the impact on time, perception, and narrative structure is observed, each element appearing in the shadows that stretch out from the decades before and beyond the events of that clear blue September morning. Through characters in recent fiction by William Gibson and Hari Kunzru, the final chapter scans American consumption and the representations projected out from its brands and advertising. Within technological states now transmitted globally, the chapter reflects on the consequences of consumer culture as we venture further into the virtual and its realities, drawn through what Jean Baudrillard calls an irreconcilable conflict between ‘total integration’ and the ‘dual form’.

Seit ungefähr den 1960er Jahren migrieren Thailänder nach Deutschland, und es ist statistisch belegt, dass die Feminisierung der thailändischen Migration bis heute anhält (Bundesamt für Statistik, 2016). Frauen machen 87 Prozent aller in Deutschland lebenden Thailänder und Thailänderinnen aus. 94 Prozent aller Ehen mit thailändischer Beteiligung in Deutschland bestehen zwischen thailändischen Frauen und deutschen oder ausländischen Männern, während in nur 6 Prozent der Fälle thailändische Männer mit deutschen oder ausländischen Frauen verheiratet sind. Im Jahr 2005 waren 58.784 thailändische Staatsangehörige in Deutschland gemeldet, aber nur 43 Prozent davon waren nach dem deutschen Gesetz als „erwerbstätig“ registriert. Die vorliegende Arbeit untersucht das Beschäftigungsdilemma thailändischer Heiratsmigranten seit dem Inkrafttreten des neuen Aufenthaltsgesetzes im Jahr 2005. Zunächst beleuchtet sie die zugrundeliegenden Probleme, wegen derer die thailändische Heiratsmigranten ihr Potential als Vollzeit-Arbeitskräfte nicht ausschöpfen können, und erklärt, warum sich hochqualifizierte thailändische Heiratsmigranten nicht voll in den deutschen Arbeitsmarkt integrieren können. Dann untersucht sie die thailändische Diaspora und den Transnationalismus thailändischer Heiratsmigranten in Deutschland, und schließlich versucht sie, anhand Pierre Bourdieus Theorie von Kapital, Habitus und sozialem Raum die Berufsentscheidungen thailändischer Heiratsmigranten im deutschen Umfeld zu erklären. Qualitative Interviews, welche zwischen 2016 und 2017 durchgeführt worden sind, stellen mit 38 Informanten und einem quantitativen Fragebogen, der von 125 Befragten ausgefüllt wurde, bislang eine der umfangreichsten Forschungen über thailändische Ehemigranten in Deutschland dar.
Thais started to migrate to Germany around the 1960s, and it is statistically evident that the feminisation of Thai migration through marriage to Germans has continued to the present day (Federal Statistics Office of Germany, 2016). Women account for almost 87 percent of all Thais in Germany. Marriages of Thai women to German or foreign husbands account for 94 percent of marriages in Germany involving Thai nationals, compared to only six percent of Thai men married to German or foreign wives. In 2005, the total number of Thais in Germany was 58,784; however, only 43 percent of Thais were registered as “labour” under the German employment system. This paper investigates the employment dilemma of Thai marriage migrants after implementation of the new Residence Act of 2005. First, it sheds light on the underlying problems that hinder Thai marriage migrants’ potential as full-time labourers and provides better understanding of why highly-educated Thai marriage migrants cannot fully integrate into the German labour market. Second, it examines the Thai diaspora and explores the present-day trans-nationalism of Thai marriage migrants in Germany. Finally, it applies Pierre Bourdieu’s theoretical concept of capital, habitus and social space to better understand Thai marriage migrants’ career choices in the German milieu. Qualitative interviews with 38 informants and a quantitative questionnaire filled out by 125 additional respondents were conducted between 2016 and 2017, providing one of the most comprehensive researches on Thai marriage migrants in Germany to date.

This thesis is an exploratory study of the lives and experiences of international students who apply for and gain permanent residency (PR) after completing tertiary study in Australia. The thesis uses sociological theories and methods to focus on the ways that students-turned-migrants maintain transnational connections, and negotiate their memberships and sense of belonging across Australia and other countries. This research is important because there is negligible extant literature that connects the international study experience and the skilled migration experience as two steps in the same process. Furthermore, research that does address this phenomenon tends to look at students-turned-migrants as a 'policy problem', usually focusing on their labour market integration. In contrast, this thesis foregrounds this distinctive group of contemporary migrants' subjective experience of the migration process and their ongoing transnational connections. The research used cultural probes (packages of mixed media materials such as diaries, maps and disposable cameras, which participants used to document aspects of their lives) and in-depth interviews to provide a rich understanding of the multiplicity and breadth of participants' individual experiences, with various reflective representations of the individuals' narratives at the core of the study. The analysis covers two aspects of the student-turned-migrant experience: the acquisition of memberships, such as PR and citizenship, and the maintenance of mobilities, including virtual mobility through media and communications technology, and corporeal mobility through forms of travel such as return visits. The analysis reveals that students-turned-migrants undergo a distinct migration experience, characterised by three sequential gates of membership: their entrance as transient students, their acquisition of residency and their decisions about citizenship. Transnational consciousness diffuses their decision-making at each stage of this process, as they negotiate the memberships available to them as a means to balance their desires and obligations across home and host countries. The analysis reveals that student-turned-migrant choices and experiences are often affected by macro-political forces. Choices about citizenship are heavily influenced by global regimes of mobility and the media, and their acqu isition of residency is negotiated through the institutions and regulations of the immigration regime. The analysis also reveals that students-turned-migrants engage with a diverse range of transnational practices, many of which are closely grounded in the use of technology to maintain transnational connections. The findings reframe students-turned-migrants as more than just a policy problem, but rather as a unique group of contemporary migrants, with several key features that set them apart from previous waves of Australian migrants. While they are less integrated into established local ethnic communities, they maintain very strong connections overseas. They maintain regular contact through virtual mobilities and display a high propensity for return travel. They value mobility highly and display an acute awareness of both the advantages and challenges of sustaining mobile lives. The study of their experiences not only reveals a great deal about the nature of transnationality and mobility in an increasingly globalised world, but also suggests that if this type of migration continues in the future, it may have implications for Australia's patterns of cultural diversity and international integration.

The goal of this study is to generate a more holistic picture of the diffusion and assimilation of universal human rights norms in diverse cultural and political settings such as the Middle East and North Africa (MENA). The overarching question to be investigated in this thesis is the relationship between the evolving international human rights regime and the emerging human rights normative and legal culture in the Middle East. This question will be investigated in detail with reference to regional human rights schemes such as the Arab Charter of Human Rights, as well as local human rights developments in three Middle Eastern states, Egypt, the United Arab Emirates, and the Islamic Republic of Iran. Having gauged the take-up of human rights norms on the ground at the local and regional levels, the thesis examines in full the extent of socialisation and internalisation of human rights norms across the Middle East region at large.

Au cours des années quatre-vingt-dix, un réseau d'art contemporain se structure en Thaïlande. Comment et pourquoi ce réseau s'est institutionnalisé et , contrairement aux mouvements d'avant-gardes s'épanouissant depuis les années soixante, a ravi le monopole détenu jusque là par l'académie? L'analyse montrera que cette pratique a obtenu une légitimité locale grâce aux liens mis en place par ses acteurs avec la scène internationale. Les modalités d'existences de ces liens seront examinées en vue de questionner , à partir de la situation taïlandaise, les enjeux de la participation des artistes non occidentaux au monde de l'art contemporain international. S'ils conservent une position périphérique ne leur permettant pas de prendre part pleinement aux luttes internationales de classements, la nouvelle dynamique des années deux mille montre qu'ils tentent de renverser ce rapport de forces en diversifiant leurs actions vers d'autres types de relations transnationales
During the nineties a network of contemporary art was developped in Thailand. How and why this network has been able to institutionalize itself and has taken away the monopoly of the academic unlike the avant-gardes movements blooming since the sixties? The analysis will show that this practice has obtained a local legitimacy thanks to th links set up by local actors with the international scene. The ways of existences of these links will be examined to question, from the Thai situation, the stakes of the non Western artist's participations to the international world of contemporary art. If they keep a peripheral position which enable them not to take part in the struggle of international classifications, the new growth after the year two thousand show that they try to knock down the balance of power by diversifying their actions towards other types of transnational relations

Cette thèse se focalise sur la circulation et l’intégration de l’impressionnisme français aux États-Unis entre 1870 et 1915. Afin d’apporter un éclairage nouveau sur la propagation du mouvement outre-Atlantique, une méthodologie pluridisciplinaire a été développée. D’une part, une base de données des collectionneurs et des expositions tenues aux États-Unis vise à discerner les grandes tendances de la propagation du mouvement dans le pays. L’homogénéité géographique de la dispersion des œuvres du mouvement est ainsi abordée. En effet, si le Nord-Est du pays demeure le foyer central de diffusion artistique, des œuvres du mouvement circulent à l’Ouest dès la fin du XIXe siècle. D’autre part, des études de cas précises d’acquisitions et de circulations d’œuvres permettent de mettre en lumière des dynamiques propres au goût américain et à cette appropriation. Ces exemples précis visent à souligner certains acteurs clés – aussi bien des critiques d’art, des commissaires d’expositions, que des universitaires – dans l’intégration de l’impressionnisme français à la culture américaine. Ce travail cherche donc à développer une histoire transatlantique de l’impressionnisme, cette approche étant indispensable pour comprendre la réception de ce mouvement, ainsi qu’à mettre en évidence les acteurs et les circuits qui en ont permis son entrée dans le patrimoine culturel des États-Unis
This dissertation focuses on the circulation and spread of French Impressionism in the United States between 1870 and 1915. In order to shed new light on the movement’s integration in the United States, a multidisciplinary methodology was developed. On the one hand, a database of collectors and exhibitions held in the United States aims to identify major trends in the movement’s spread. Whether or not French Impressionist pieces as well as ideas were distributed and discussed evenly throughout the nation is thus addressed. Indeed, if the North-East remains the central hub of artistic distribution, French Impressionist pieces circulated in the Midwest and on the West Coast during the last decades of the nineteenth century. On the other hand, specific case studies of acquisitions and circulations of works serve to emphasize significant trends in American taste and ownership. These specific examples aim to highlight some of the key actors—art critics, curators, and academics—in the integration of French Impressionism into American culture. This study therefore seeks to develop a transatlantic history of Impressionism, a scale that is essential to understand the reception of the movement and to shed light on the actors and circuits that have enabled its entrance into the United States’ cultural heritage

Les mécanismes de soft law ont joué un rôle central dans le développement de la notion actuelle de la responsabilité des entreprises transnationales en droits de l’homme telle qu’elle est définie dans les Principes directeurs relatifs aux entreprises et aux droits de l’homme, une initiative approuvé par le Conseil des droits de l’homme des Nations unies en juin 2011. La responsabilité des entreprises de respecter les droits de l’homme, telle qu’elle a été conçue par le Représentant spécial, repose sur les attentes de la société plutôt que sur une obligation juridique. Cela signifie que les entreprises « devraient éviter de porter atteinte aux droits de l’homme d’autrui et remédier aux incidences négatives sur les droits de l’homme dans lesquelles elles ont une part ». Les limites de cette approche sont importantes à moyen et à long terme. Même si l’approche pragmatique adopté par le Représentant spécial a permis de surmonter le débat au sein de la communauté internationale autour du Projet de normes sur la responsabilité en matière de droits de l’homme des sociétés transnationales et autres entreprises, elle a aussi éloigné la possibilité d’élaborer un instrument international imposant aux entreprises transnationales des obligations contraignantes en droits de l’homme. Construire la notion de la responsabilité des entreprises transnationales en matière de droits de l’homme uniquement sur les attentes de la société semble insuffisant et dangereux face aux victimes des abus de ces acteurs économiques. La responsabilité de respecter les droits de l’homme, telle que définie aujourd’hui, renforce l’acceptation d’un système international où les entreprises transnationales sont encouragées mais pas obligées à respecter les droits de l’homme, une solution qui laisse les victimes des abus dépourvues de toute action en justice et de réparation. L’objet de cette thèse est de présenter de manière succincte l’évolution de la problématique complexe de la responsabilité des entreprises transnationales du secteur énergétique en matière de droit international des droits de l’homme et de droit international humanitaire depuis son origine jusqu’à nos jours, ainsi que de comprendre les principales limites de l’approche actuelle à la question, afin d’envisager des potentielles solutions
Soft law mechanisms have played a central role in developing the current notion of the responsibility of transnational corporations in human rights as defined in the Guiding Principles on Business and Human Rights, an initiative approved by the United Nations Human Rights Council in June 2011. Corporate responsibility to respect human rights, as defined by the Special Representative, is based on social expectations rather than on legal obligations. It means that companies should “avoid prejudice to the rights of others and to address adverse impacts on human rights in which they are involved”. The limitations of this approach are important in medium and long term. Although the pragmatic approach adopted by the Special Representative has closed the international community debate on the Draft Norms on the responsibility for human rights and transnational corporations and other business enterprises, it also ends the chances of developing an international instrument requiring binding obligations in human rights for transnational corporations. Setting the notion of the responsibility of transnational corporations in human rights exclusively on social expectations seems unsatisfactory and dangerous towards victims of violations committed by these economic actors. Responsibility to respect human rights as defined today reinforces the acceptance of a system where transnational corporations are encouraged but are not compelled to respect human rights, a solution that leaves victims of abuse devoid of any legal action and redress. The purpose of this PhD thesis is to present briefly the evolution of the responsibility of transnational corporations in the energy sector in human rights and international humanitarian law from its origins to our days, as well as to understand the main limitations of the current concept in order to explore potential solutions

The U.S. citizenship application process is a legal and symbolic journey shaped by many cultural processes. This research project aims to bring to light the experiences of immigrants and citizenship applicants living in Dallas, Texas, to promote a better understanding of Dallas' increasingly diverse population. In addition, the purpose of this project is to provide insights to a specific client, the office of Dallas Welcoming Communities and Immigrant Affairs, about Dallas' lawful permanent residents who are eligible for citizenship and their reasons for pursuing citizenship status. The data for this project was collected through observation at various citizenship workshops and community events, as well as through semi-structured interviews with 14 U.S. citizenship applicants. Reasons for applying for U.S. citizenship discussed in this project include a desire for membership in U.S. society, access to better educational and economic opportunities, improved ease of travel and the desire to vote. Barriers to the citizenship process discussed in this project include the amount of time one must dedicate to the application, lack of clear knowledge about the process and the financial cost of the application. Other themes include the effects of capital on applicant's experience with the citizenship process, symbolic meanings of citizenship, transnationalism and ideas of deserving and undeserving surrounding the issues of residency and U.S. citizenship.

Toujours plus visibles sur les scènes occidentales de la musique classique, les musicien-ne-s japonais-e-s évoluant en Europe constituent un phénomène social intéressant. Adoptant deux perspectives complémentaires - celle des «mondes de l’art» et des trajectoires d’artistes d’un côté, et celle des mobilités et des migrations de travailleurs d’un autre -, cette thèse vise à examiner la construction des carrières artistiques des musicien-ne-s japonais en Europe étudiées comme des trajectoires «transnationales» de professionnel-le-s qualifié-e-s. Comment se fait-il que des personnes socialisées dans une culture particulière, déménagent dans un environnement socioculturel hétérogène pour étudier et construire leur vie professionnelle et individuelle à l’étranger ? Est-ce que leurs trajectoires nous permettent de les classer comme des « artistes cosmopolites » ? Ou bien la construction sociale de leur carrière ressemble-t-elle davantage à celle des «migrants»? L’analyse s’appuie sur un matériau de 50 entretiens semi-structurés conduits avec des musicien-ne-s japonais-e-s dans leur langue maternelle et 20 interviews/conversations menées avec des experts/informateurs. En comparant deux environnements très différents, la France et la Pologne, j’ai cherché à neutraliser l’impact que diverses idiosyncrasies environnementales, structurelles et socioculturelles peuvent exercer sur la dynamique des carrières de ces musicien-ne-s. En conclusion, l’examen des modes d’insertion dans l’éducation musicale mis en rapport avec l’origine sociale des répondant-e-s m’a amené à distinguer quatre profils professionnels : (1) les héritier-e-s professionnel-le-s, (2) les héritier-e-s des rêves parentaux, (3) les ancien-ne-s élèves de brass band et (4) les pratiquant-e-s avocationnel-le-s. En outre, le matériel recueilli au cours de mes recherches a montré que les carrières des musicien-ne-s japonais-e-s opèrent sur plusieurs niveaux et que la "transnationalité" supposée – que j’associe au concept de « double absence » de Sayad (1977, 1999) – a été conditionnée par une combinaison de différents déterminants sociaux (origines sociales, genre, spécialisation instrumentale, systèmes éducatifs et possibilité de conversion du capital ainsi que les politiques migratoires, les marchés du travail, ou encore les arrangements de l’État de providence). Ces éléments ont en effet largement influencé et, dans certains cas, fait dérailler les parcours professionnels étudiés
Japanese musicians arriving to Europe for the purpose of studies and work have become more and more visible in the context of classical art scenes, and they do not constitute a niche sample anymore. Combining two perspectives – that of the “art world” on the one hand and that of labour mobility and migration on the other, – this thesis examines the dynamics of Japanese musicians’ artistic careers establishing themselves in Europe in the context of “transnational” trajectories of skilled professionals. How do people, socialized in one particular culture, relocate to a disparate socio-cultural environment to study and then to build their professional as well as individual lives abroad? Shall these musicians be conceived of as “cosmopolite” artists? Or does the social construction of their careers bring them closer to “migrants”? This study is based on 50 semi-structured interviews conducted with Japanese musicians in their mother tongue as well as 20 interviews/conversations led with experts/informers. Comparing two substantially disparate environments, the French and the Polish ones, I aimed at distilling the impact that various structural as well as socio-cultural environmental idiosyncrasies have on career dynamics. In conclusion, examining modes of insertion into music education against the background of respondents’ social origins led me to distinguish four main career trajectories: (1) professional heirs; (2) inheritors of parental dreams; (3) brass band alumni and (4) avocational practitioners. Furthermore, the collected material unveiled that their careers are multilayered. Consequently, the presupposed “transnationality” – that I associate with Abdelmalek Sayad’s concept of “double absence” – has been conditioned by a combination of various social factors (i.e., social origins, gender, specialization, education systems and the possibility of conversion of capitals be it social or cultural; as well as migration policies, labor markets or structure of the welfare state in the hosts societies), which largely influence, and in some cases, derail the studied professional paths

The purpose of this thesis was to explore how Christian networks enable strategies of transnational alliance, whereby groups in different nations strive to strengthen one another’s leverage and credibility in order to resolve conflicts and elaborate new possibilities. This research does so by analyzing the case of the Presbyterian Church of Colombia (IPC). The project examines the historical development of the IPC from the initial missionary period of the 1850s until the present. Specifically, the purpose of the study was to consider how the historical struggle to articulate autonomy and equality vis-à-vis the U.S. Presbyterians (PCUSA) and paternalist models of ecclesial relations has affected recent political strategies pursued by the IPC. Despite the paternalism of the early missionary model, changing conceptions of social transformation during the 60s contributed to a shift in relations. Over time the IPC and PCUSA negotiated relationships in which groups both acknowledge a problematic history and insist upon an ethnic of partnership and respect. Today, PCUSA groups, in concert with the IPC, collaborate on a range of transnational political strategies aimed at strengthening the IPC’s leverage in local struggles for justice and peace. A review of this case suggests that long-established Christian networks may have an advantage over other civil society groups such as NGOs in facilitating strategies of transnational alliance. Although civil society organizations often have better access to important resources needed for international advocacy initiatives, Christian networks, such as the one established between the IPC and U.S. Presbyterian communities, rely on a history of negotiating power-disparity in order to elaborate relationships based on listening and partnership. Such findings prove important not only to how we conceptualize transnational alliance but also to the ways that we think about the history and future of Christian networks.

Contemporary transnational literature presents a unique interpretive problem, due to new methods of language and culture negotiation in the information age. The resulting condition, transnational compositionality, is evidenced by specific linguistic artifacts; to illustrate this I use three American novels as a case study: Nowhere Man by Aleksandar Hemon, Absurdistan by Gary Shteyngart, and The Brief Wondrous Life of Oscar Wao by Junot Díaz. By extension, many conventional literary elements are changed in the transnational since modernity: satire is no longer a lampooning of cultures but a questioning of the methods by which humans blend cultures together; similarly, complex symbolic constructions may no longer be taken at face value, for they now communicate more about cultural identity processes than static ideologies. If scholars are to achieve adequate interpretations of these elements, we must consider the global framework that has so intimately shaped them in the twenty-first century.

L’acte administratif unilatéral transnational est un acte unilatéral qualifié d’administratif par son droit national et qui produit directement un effet de droit contraignant dans l’ordre juridique d’un ou de plusieurs État(s) de réception. À rebours du principe de territorialité du droit public, le constat de l’existence et du développement croissant de ce type d’actes vient interroger la transformation de l’action administrative face à la mondialisation et à la déterritorialisation que celle-ci entraîne. L’étude de cette nouvelle notion fonctionnelle conduit à établir une typologie des différents actes répondant à la définition donnée afin d’en comprendre le fonctionnement qui peut reposer sur une méthode conflictuelle oubliée : le conflit d’autorités. De plus, l’Union européenne propose à la fois des moyens institutionnels et juridiques encourageant la prolifération des actes administratifs transnationaux qui participent bien souvent à l’administration indirecte spécifique à son fonctionnement.Tous ces éléments justifient de l’intérêt de la création de cette nouvelle notion dont le régime est également exploré par la suite. Ainsi, l’analyse de la naissance, de l’exécution et de la fin des actes administratifs transnationaux aboutit au constat que ces actes partagent en grande partie le régime normalement applicable aux actes administratifs purement nationaux et ne comportent des spécificités qu’en ce que celles-ci découlent nécessairement de leur caractère transnational. Cependant, la question se complexifie lorsqu’il s’agit d’assurer le droit au recours des individus face à ce type d’actes qui peuvent, en particulier, intervenir dans des procédures administratives transnationales complexes. De même, la capacité de protection des États de destination est très hétérogène selon les actes et le contrôle de leur juge national est en principe exclu sauf à de rares exceptions. Face à ces considérations, le présent travail s’achève sur la proposition de solutions uniformes visant à répondre à ses questions et qui pourront notamment prendre la forme d’une directive européenne
The transnational administrative act is an act, qualified as administrative by its national law, which products directly a legal effect in the legal order of another or other State(s). Against the principle of territoriality of public law, the observation of the existence and the growing development of this type of act questions the transformation of the administrative action facing globalization and the deterritorialization it implies. The study of this new functional notion leads to establish a typology of the different acts answering the given definition in order to understand their functioning which might rest on a forgotten conflictual method: the conflict of authorities. Moreover, the European Union provides for institutional and legal means favouring the spread of transnational administrative acts which often participate to the indirect administration of the Union.All these elements justify the interest of the creation of this new notion which the legal regime is later studied. Therefore, the analysis of the birth, the execution and the end of transnational administrative acts reveals that these acts mostly share the regime applicable to regular administrative acts. They show specificities only when they arise from the needs of their transnationality. However, the question is more complex when the right of individuals to have access to trial is involved, especially when this type of act intervenes in a transnational administrative procedure. Also, the ability for states of destinations to protect themselves is very diverse depending on the transnational act considered and the control by their national judge is in principle excluded, even if there are some exceptions. Facing these observations, this study ends on the proposition of unified solutions aiming to answer these questions and which could be implemented by a European directive

The past three decades have witnessed the extraordinary emergence of several global cultural realms for the crossborder flow and consecration of cultural goods (e.g., in the visual arts, music, or literature). Scholars have debated whether such accelerated dynamics of the globalization of culture are leading to the worldwide dominance of cultural goods from a few Western countries--and in this sense to growing cultural homogeneity--or whether they facilitate the increasing transnational dissemination and recognition of cultural creations from other non-Western contexts, such as Asia, Latin America, or Africa--and thus entail increasing cultural diversity. Focussing on the case of the contemporary visual arts and elaborating Pierre Bourdieu's theory of the field of cultural production further from a national to a global scale, the dissertation specifies the conditions under which artists from non-Western regions become visible and recognized in a global cultural realm. In contrast to the established theoretical models in the globalization of culture literature--the political economy model of cultural imperialism, the global flows and networks model, or the global culture strategies model--a field approach extended to the global scale has the principal advantage that it permits to differentiate between the hierarchical structures, transnational networks, and cultural rules of different subspaces in the same global cultural universe. From this perspective, the dissertation develops an alternative argument that goes beyond approaching cultural homogeneity or diversity as an either/or problem. Drawing upon a rich array of sources and combining interpretative and quantitative methodologies, I argue that there are systematic differences in the conditions of worldwide artistic recognition and diversity in globalizing cultural circuits that are based on a logic of intellectual prestige and charisma on the one hand, and those that are ruled by a commercial logic on the other. Hence, I make the case that, in order to capture the complexities of cultural diversity in a period of accelerated globalization, it is necessary to take into account and theorize more fully the institutional diversity of global cultural realms themselves. The dissertation is divided into four parts: the first part clears conceptual ground by discussing aspects of Pierre Bourdieu's theory of the field of cultural production that have to be modified or added when the framework is moved beyond national boundaries to a transnational or global level. The second part investigates the worldwide diffusion of contemporary art institutions across more than 140 countries, and it also examines discourses of artistic globalization and global art and additional historical sources, in order to illuminate the institutional formation of a global cultural field in the contemporary visual arts since the 1980s that is transcontinental in geographic scope and cultural orientations. The third part asks how these global transformations have affected the recognition of artists from different parts of the world. Drawing upon encompassing data of the transnational careers of leading artists in the global exhibition space and global auction market, I show that the contemporary visual arts are structured around a dual world economy of recognition, and that, correspondingly, dynamics of artistic diversity have evolved in systematically different ways with regard to global symbolic capital or global economic artistic success. Building on the insights from this broader structural account, the third part engages with an in-depth case study comparison of the biographies of outstanding artists from China and Mexico (Yue Minjun and Gabriel Orozco), who have achieved either high economic success or symbolic recognition in the global art field. They are representatives of the first artistic generation in the history of the contemporary visual arts that might be termed global. By explaining how these artists rose to worldwide leading artistic positions, the dissertation brings to light additional different historical, social and cultural preconditions for the inclusion and consecration of artists from non-Western regions at the intellectual and commercial poles of the same global cultural realm. Overall, by expanding insights of one of the classical studies in the sociology of culture, Pierre Bourdieu's The Rules of Art, the dissertation advances an understanding of the `global rules' of art, that is, the core-periphery structures, transnational networks, cultural practices as well as classificatory schemes of interpretation and valuation that are intertwined with the making of worldwide artistic reputations and careers in a global cultural realm. It thereby offers a window onto the making and dynamics of what I designate as a "dual world economy of recognition." In addition, through the substantive lens on worldwide artistic recognition and careers, the dissertation develops further a new theoretical approach to the globalization of culture that goes beyond certain polarities among established theoretical models, as between cultural homogeneity vs. diversity, structures and meaning, macro vs. micro, or structure vs. agency. By comparing transnational and global processes at both an intellectual and commercial pole of the same global cultural field, it elaborates a theoretical model that is multi-dimensional and multi-leveled. It permits to study processes associated with the globalization of culture--as, for example, cultural crossborder flows and exchange, cultural inequalities or cultural diversity--by linking different macro and micro level factors. Lastly, the dissertation also offers a step toward advancing general global field analysis as an emerging new theoretical paradigm in global and transnational sociology vis-à-vis more established broader theoretical approaches, such as world-systems analysis or world polity theory. By theorizing and substantiating the institutional core-periphery configurations of a whole global field, involving both its autonomous and heteronomous pole, it develops a template for reconstructing the institutional making of a field at a global scale both in its structural and cultural dimensions.

De manière générale, ma thèse examine les mécanismes des processus sociaux, économiques et politiques ayant contribué, souvent de manière contradictoire, à la (re)définition des critères d’adhésion au sein de la nation et de l’Etat. Elle le fait par le dialogue au sein de deux grands corps de littérature intimement liés, la citoyenneté et le transnationalisme, qui se sont penchés sur les questions d’appartenance, d’exclusion, de mobilité et d’accès aux droits chez les migrants transnationaux tout en soulignant la capacité accrue de l’Etat à réguler à la fois les déplacements de personnes et l’accès des migrants aux droits. Cette thèse remet en question trois principes qui influencent la recherche et les programmes d’action publique ayant trait au transnationalisme et à la citoyenneté des migrants, et remet en cause les approches analytiques hégémoniques et méthodologiques qui les sous-tendent. L’étude a été menée à deux niveaux distincts d’analyse empirique et analytique. D’une part, nous examinons les « technologies de la citoyenneté » (Ong 2003, Fujiwara 2008) qui ont été développées par le gouvernement pour transformer l’Argentine en une nation latino-américaine diverse et inclusive pendant la dernière décennie, en nous intéressant particulièrement à la création, par le Kirchnerisme, d’une « nouvelle légalité » pour les Paraguayens, les Boliviens et les Péruviens résidant dans le pays. D’autre part, nous analysons la « dimension horizontale des processus de citoyenneté » (Neveu 2005, Pickus and Skerry 2007, Gagné and Neveu 2009) chez ces migrants dans des aires urbaines, périphériques et rurales du partido de La Plata. Plus spécifiquement, nous examinons dans quelle mesure les conditions socioéconomiques des migrants ont changé suite à leur nouveau statut légal (en tant que ressortissants du MERCOSUR en Argentine, dont les droits sont égaux à ceux des citoyens) et aux politiques de « citoyenneté inclusive » déployées par le gouvernement. Cette thèse se penche particulièrement sur les fondations et l’incarnation (« embodiment ») des droits en examinant comment le nouveau statut légal des migrants se manifeste au quotidien en fonction de a) où ils vivent et travaillent, et b) leur statut social perçu par les autres migrants et non-migrants. D’une part, nous examinons les aires urbaines, périphériques et rurales de La Plata en tant que « zones de souveraineté graduée » (Ong 1999), où des régimes de gouvernementalité locaux spécifiques se sont développés en lien avec l’installation de groupes ethniques souvent distincts, et dont les droits et devoirs diffèrent de ceux d’autres zones. D’autre part, nous étudions la façon dont le statut social est produit à travers les interactions sociales quotidiennes en transposant des distinctions construites socialement telles que race, classe, genre et origine nationale, en systèmes d’exclusion formels (Gregory 2007). Notre analyse ethnographique de ce que nous appelons les « expériences de légalité » des migrants démontre que leur égalité formelle vis-à-vis des Argentins, loin d’être simplement donnée comme un nouveau statut légal uniformément garanti pour tous, est à la fois inégalement vécue par les divers migrants, et différemment respectée dans les zones géographiques dirigées par divers régimes de gouvernementalité (Foucault 1978).
Broadly speaking, my thesis examines the workings of grounded social, economic and political processes that have contributed, often in a conflicting manner, to the (re)definition of membership criteria in both the nation and the state. It does so in dialogue with two broad, interrelated bodies of literature, those on citizenship and transnationalism, which have examined issues of belonging, exclusion, mobility and access to rights among transnational migrants, while highlighting the renewed capacity of the state to regulate both people’s movements and migrants’ actual access to public entitlements. My dissertation challenges three sets of claims shaping research and policy agendas on migrant transnationalism and citizenship, and questions the hegemonic analytical and methodological approaches underlying them. My research has been carried out at two distinctive analytical and empirical levels. On the one hand, I examine the “technologies of citizenship” (Ong 2003, Fujiwara 2008) deployed by the government to transform Argentina into a diverse, inclusive and Latin American nation over the past decade, paying particular attention to Kirchnerismo’s creation of a “new legality” for the Paraguayans, Bolivians and Peruvians in the country. On the other hand, I analyze the “horizontal dimensions of citizenship processes” (Neveu 2005, Pickus and Skerry 2007, Gagné and Neveu 2009) among these migrants in urban, peripheral and rural areas of the partido of La Plata. Namely, I study the extent to which migrants’ socio-economic circumstances have changed in tandem with their new legal status (as nationals of the MERCOSUR in Argentina with rights equal to those of its citizens) and the “inclusive citizenship” policies deployed by the government. My dissertation pays particular attention to the grounding and embodiment of rights by examining how migrants’ new legal status translates into everyday life depending on a) where they live and work, and b) their perceived social status by other migrants and non-migrants. On the one hand, I look at urban, peripheral and rural areas of La Plata as zones of graduated sovereignty (Ong 1999) where particular governmentality regimes have emerged in tandem with the settlement of often ethnically marked groupings, whose entitlements and obligations differ from those in other zones. On the other hand, I examine how social status is produced through everyday social interaction by transposing socially constructed distinctions, such as race, class, gender and national origin, into formal systems of exclusion (Gregory 2007). My ethnographic analysis of what I shall call limítrofes’ experiences of legality demonstrates that their formal equality vis-à-vis Argentinians, far from being merely given as a new legal status evenly guaranteed to all, is both unequally experienced by diverse migrants and differently enforced in geographic areas governed by distinctive governmentality regimes (Foucault 1978).

In recent years, Sikh Punjabi migration to Portugal has started gaining attention. While it was estimated that the first migrants started to move to Portugal in the early 1990ies, the community has long time stayed unnoticed. Sikhs in Portugal are predominantly young and male and a large part of them has at some point been in an irregular administrative situation. Drawing on a multi-sited ethnographic research using participant observation in different cities of Punjab and the Great Lisbon between 2017 and 2019, this dissertation aims to look at how gender roles are maintained and negotiated within Punjabi migrants’ transnational families in Lisbon and Punjab. First, it investigates the crucial role of gender in scoping migration projects to Portugal. While migration restrictions have the power to encourage or dissuade transnational family practices such as family reunification and transnational marriages, this work looks at how kinship rules and social norms operate across borders. Secondly, this work looks at the gendered division of labor in Sikh Punjabi transnational families. It examine the work of women both in origin and abroad. This dissertation establishes that at the present moment, transnational family practices have not led to a more egalitarian division of roles within the Sikh Punjabi family living between Lisbon and Punjab and that while new challenges are faced by, both men and women, caring expectation perpetuate conventional gender norms of the family even in the transnational context.
Nos últimos anos, a migração dos Sikhs Punjabi para Portugal começou a ganhar atenção. Embora se estimasse que os primeiros migrantes começaram a mudar-se para Portugal no início da década de 1990, a comunidade tem permanecido durante muito tempo despercebida. Os Sikhs em Portugal são predominantemente jovens e do sexo masculino e uma grande parte deles tem estado, a dada altura, numa situação administrativa irregular. Com base numa investigação etnográfica multisituada utilizando a observação participante em diferentes cidades do Punjab e da Grande Lisboa entre 2017 e 2019, esta dissertação visa analisar a forma como os papéis de género são mantidos e negociados no seio das famílias transnacionais dos migrantes Punjabi em Lisboa e no Punjab. Em primeiro lugar, investiga o papel crucial do género na delimitação do âmbito dos projetos de migração para Portugal. Embora as restrições à migração tenham o poder de encorajar ou dissuadir práticas familiares transnacionais, tais como o reagrupamento familiar e os casamentos transnacionais, este trabalho analisa a forma como as regras de parentesco e as normas sociais funcionam para além das fronteiras. Em segundo lugar, este trabalho analisa a divisão do trabalho em função do género nas famílias transnacionais Sikhs Punjabi. Examina o trabalho das mulheres tanto na origem como no estrangeiro. Esta dissertação estabelece que, atualmente, as práticas familiares transnacionais não conduziram a uma divisão mais igualitária dos papéis no seio da família Sikh Punjabi que vive entre Lisboa e Punjab e que, embora novos desafios sejam enfrentados tanto por homens como por mulheres na família, a expectativa de cuidado perpetua as normas convencionais de género da família, mesmo no contexto transnacional.
