The discussions cover the principle of direct effect and national procedural autonomy; why there has been relatively little antitrust litigation in the EU; the relationship between public and private enforcement; the Commission's policy towards private enforcement, the initiatives it has taken to encourage private litigation, and mechanisms for cooperation between the Commission and national courts; and the obligations of national courts when dealing with cases that raise the issue of whether a contract in violation of Article 101 or Article 102 is enforceable and whether, and if so when, damages and injunctions should be available to remedy such violations.

This book provides a comprehensive and practically oriented account of EU competition procedure and the European Commission’s role in enforcement, coordination, and policy-making, from the perspective of EU enforcers. It explains the Commission’s approach to each aspect of enforcement: its investigatory practices and powers, interactions with parties under investigation and third parties, compliance with fundamental rights, process by which it adopts decisions, and application of sanctions and remedies for anticompetitive conduct. Publication and judicial review of Commission decisions is also be discussed. In particular, the book provides a complete view of the Commission’s role in enforcement and coordination at the international level. Following the implementation of the Damages Directive, the book examines cooperation between the Commission and national courts, with regard to the increasing role of private enforcement actions. It emphasises the importance of cooperation between the Commission and national competition authorities (NCAs) of the Member States and consider the impact of the forthcoming Directive on empowerment of NCAs (‘ECN+’), as well as the Commission’s engagement with NCAs in third countries and the instruments which facilitate this.

This monograph presents a detailed, lively, and original chronicle and analysis of New Zealand’s competition law. The modern era began with the Commerce Act 1986 and since then a steady corpus of case law has traversed all the major areas of antitrust law: cartels, resale price maintenance, exclusive dealing, tying, monopolization, predatory pricing, mergers, private and public enforcement, and so on. The volume explains the rationale for the major reforms of the Commerce Act and traces the development of key concepts such as effective competition, efficiency, market power, market definition, entry barriers, wealth transfers, and public benefit over the last 34 years. The book provides an extended critique of the landmark cases and legislative amendments. It assesses the desirable, and undesirable, aspects of competition law’s interpretation and doctrinal development by the courts and Commerce Commission. Systemic issues are explored such as: how well has New Zealand moulded its own competition law, whilst, nonetheless, selectively drawing upon the policy prescriptions, case law, and wisdom from foreign jurisdictions?
