O reconhecimento do poder do jornalismo como atividade constitutiva, isto é, como prática que age sobre o curso da história, conduziu a uma necessidade crescente de refletir sobre a ética dos procedimentos de recolha e tratamento da informação. Alvo de críticas frequentes enunciadas por escritores e intelectuais que, no século XIX, encaravam o jornalismo como uma literatura rafeira, os jornalistas passaram, a partir da segunda metade do século XX, a estar sob o olhar escrutinador da sociedade. Se a sua condição sempre foi, de algum modo, a de “vigilantes” dos poderes instituídos, a de uma espécie de “novos cães de guarda”, no dizer de Serge Halimi (1998), com o tempo, a consciência de que a vigilância também pode ser encarada como o exercício de um poder contribuiu para uma ideia de que também seria necessário “vigiar os vigilantes”. Quer na perspetiva profissional quer na perspetiva científica, desenvolveu-se então um discurso profundamente normativo em relação ao jornalismo e aos jornalistas. A definição de um estatuto profissional específico arrastou consigo a fixação de códigos de ética e deontologia que atribuíram a esta atividade um sentido de dever ser. Em consequência, alargou-se a toda a opinião pública a perceção de que tanto a conduta dos jornalistas como os efeitos da produção jornalística e da ação dos média se inscrevem num conjunto de normas reguladoras que explicitam os limites da atividade. Neste artigo, revisitamos o percurso que conduziu a uma perspetiva normativista do jornalismo. Por outro lado, reconhecendo que o jornalismo ganhou progressivamente valor-notícia, retomamos o conceito de metajornalismo para explorar uma via alternativa ao discurso convencional da norma. Com efeito, ao considerar o jornalismo sobre o jornalismo como uma prática autorreferencial, tomamo-lo no avesso do exercício normativista, deslocando o paradigma dos estudos jornalísticos de uma ética transcendental para uma ética situacional. The recognition of journalism’s power as a constitutive activity—that is, as a practice that shapes the course of history—has heightened the need to reflect on the ethics of the procedures involved in the collection and construction of news. Whereas, in the nineteenth century, journalism was the target of criticism from writers and intellectuals who considered it as coarse literature, from the second half of the twentieth century onwards, journalists began to be scrutinized by society. If the role of journalists had always been, as it were, to monitor the powers that be, to act as kinds of “new watchdogs” in the words of Serge Halimi (1998), it appeared over time that surveillance could also be considered as an exercise of power, and as such, that the “watchers” needed to be “watched.” In this regard, a deeply normative discourse developed in both professional and scientific circles. A specific professional status was defined, bringing along codes of ethics which garnered journalistic practice with a sense of duty. As a result the general public perception is that the role of journalists, the effects of journalistic production and the way media act are all accountable to regulatory norms that set the boundaries of the activity. In this submission, we revisit the history that led to the emergence of a normative perspective of journalism. While acknowledging that journalism has gained progressively in “news value,” we propose a return to the concept of meta-journalism in order to explore an alternative to the classical discourse of the norm. Indeed, by considering “journalism on journalism” to be a self-referential practice, we adopt an inverse approach to the normative exercise by shifting the paradigm of journalism studies from a transcendental ethos to a situational one. La reconnaissance du pouvoir du journalisme comme activité constitutive, c’est- à-dire comme une pratique qui agit sur le cours de l’histoire, a fait croitre la nécessité de réfléchir sur l’éthique des procédures de collecte et de traitement de l’information. Cibles de critiques fréquentes énoncées par des écrivains et des intellectuels qui, au XIXe siècle, considéraient le journalisme comme une littérature bâtarde, les journalistes sont passés, à partir de la seconde moitié du XXe siècle, sous le regard scrutateur de la société. Si le rôle des journalistes a toujours été, en quelque sorte, celui de ‘vigie’ des pouvoirs institués, une espèce de « nouveaux chiens de garde », selon les mots de Serge Halimi (1998), une prise de conscience du fait que la surveillance peut également être considérée comme l’exercice d’un pouvoir, et qu’en cela, elle rend nécessaire de « regarder les vigies » est apparue. Tant dans les perspectives professionnelles que scientifiques s’est développé un discours profondément normatif par rapport au journalisme et aux journalistes. La définition d’un statut professionnel spécifique a entrainé la mise en place d’une éthique et de codes de déontologie qui ont associé à cette activité un sens du devoir être. En conséquence s’est répandue la perception, dans toute l’opinion publique, que tant le rôle des journalistes que les effets de la production journalistique et de l’action des médias font partie d’un ensemble de normes réglementaires qui régissent les limites de l’activité. Dans cet submission, nous revisitons l’histoire qui a conduit à l’émergence d’une perspective normative du journalisme. Tout en reconnaissant que le journalisme a gagné progressivement en « news value », nous proposons de revenir au concept métajournalisme afin d’explorer une voie alternative au discours classique de la norme. En effet, lorsque l’on considère la pratique du journalisme sur le journalisme comme une pratique autoréférentielle, nous adoptons la démarche inverse de l’exercice normatif, en faisant glisser le paradigme des études du journalisme d’une éthique transcendantale à une éthique situationnelle.

This article presents the capability approach as an alternative conceptual and normative framework to assess the impact and relevance of existing labour market regulations. In this perspective, what matters is not GDP growth or the overall employment rate, but the development of people’s real freedom to choose a job or an activity they have reason to value. The two key notions of ‘capability for work’ and ‘capability for voice’ are presented in detail, as well as the way to use them as a framework for scientific analysis and empirical research. The article strongly emphasizes the significant difference that the use of such tools makes when it comes to assessing the impact and relevance of collective regulations in the field of work. Cet article présente l’approche par les capacités comme un cadre conceptuel et normatif alternatif pour évaluer l’impact et la pertinence des réglementations existantes du marché du travail. Dans cette perspective, ce qui importe, ce n’est pas la croissance du PIB ou le taux global d’emploi, mais le développement de la liberté effective des individus de choisir un emploi ou une activité qu’ils ont des raisons d’apprécier. Les deux notions essentielles de « capacité à exercer un travail » et de « capacité à faire entendre sa voix » sont présentées en détail, de même que la manière d’utiliser ces notions comme cadre d’analyse scientifique et de recherche empirique. L’article souligne fortement la différence considérable qu’entraîne l’utilisation de tels outils quand il s’agit d’évaluer l’impact et la pertinence des réglementations collectives dans le domaine du travail. In diesem Beitrag wird der Ansatz der Verwirklichungschancen als alternativer konzeptueller und normativer Rahmen vorgeschlagen, um die Auswirkungen und die Relevanz der bestehenden Arbeitsmarktvorschriften zu bewerten. Unter diesem Gesichtspunkt ist nicht das BIP-Wachstum oder die Gesamtbeschäftigungsrate von Bedeutung, sondern die Entwicklung der realen Freiheit der Menschen, eine Arbeit oder Tätigkeit zu wählen, die sie wertschätzen. Die beiden zentralen Konzepte der “capability for work” (Verwirklichungschance im Arbeitsleben) und der “capability for voice” (Chance, für Arbeitnehmerbelange einzutreten) werden ausführlich beschrieben, und es wird erklärt, wie diese als Rahmen für die wissenschaftliche Analyse und empirische Forschungsarbeiten dienen. Der Beitrag unterstreicht den bedeutenden Vorteil, der sich aus der Verwendung derartiger Konzepte bei der Bewertung der Auswirkungen und der Relevanz kollektiver Regelungen im Arbeitsbereich ergibt.

Abstract: This contribution is, first of all, a reflection on the distribution of power in relation to private law in the context of multilevel government, on the one hand, and relativization of this power by a so-called law market, on the other hand. It is also a reflection on the notion that law is a balancing activity (balancing values or interests). The author argues in favour of maintaining a normative perspective instead of recognizing as law everything that pretends to be law. He also argues in favour of the classical separation of powers and discusses the legitimacy of lawmaking by the different branches of power. Notions like pluralism and diversity tend to hide political choices that undermine classical values as equality before the law and the application of the law of the land. After an analysis of the arguments in favour of or against a centralization of lawmaking power on the European level, the author argues in favour of a reversal of the actual principles of division of power between the European Union and the Member States and thus in favour of a European Civil Code (ECC) that may be amended by the Member States. Résumé: Notre contribution constitue d'abord une réflexion sur la distribution des pouvoirs en matière de droit privé dans un contexte de gouvernance à plusieurs niveaux d'une part et de relativisation de ce pouvoir par un soi-disant marché du droit d'autre part. C'est aussi une réflexion sur l'idée du droit comme activité de pesage (de valeurs ou intérêts). L'auteur défend le maintien d'une perspective normative plutôt que de reconnaître comme droit tout ce qui prétend l'âtre. Il défend une conception classique de séparation de pouvoirs et discute la légitimité de la production de normes juridiques par les différentes instances. Des notions comme pluralisme ou diversité tendent plutôt à cacher des choix politiques qui sapent des valeurs classiques comme l'égalité devant la loi ou l'application de la loi du territoire. Après une analyse des différents arguments pour et contre une centralisation du pouvoir de légiférer en droit privé au niveau européen, l'auteur défend une inversion des principes actuels de division de pouvoir entre l'Union et ses Etats membres, et dès lors en faveur d'un Code Civil Européen laissant aux Etats membres le pouvoir d'y apporter des variations.

In the given article the issues concerning normative resolutions which are given by the Supreme Court of the Republic of Kazakhstan according to criminal cases are pointed out. The structure and mechanism of normative resolutions are discussed. Correlation of normative legal acts are investigated. Normative legal acts consist of legal norms, they regulate and manage social relations. It means that, as the normative legal acts play an important role on the judicial sphere, they create, change the norms and even can stop their activity. Here we may include constitutional laws, codes, laws, all charters of the President of the Republic of Kazakhstan which have legal power. Normative resolutions are equal for all, according to definite cases it is used not for one person, but for several people. Also, normative resolutions are used in accordance with legal acts, and until the used norm loses its power it can have definite power.

En tant que concept économique, la distorsion de concurrence désigne l'effet de l'intervention de l'État dans l'économie. Si cette notion a été formellement transposée en droit de l'Union européenne, elle est néanmoins perçue comme imprécise sur le plan juridique. En effet, son sens demeure flou et les multiples acceptions qui en découlent rendent sa conceptualisation délicate. Cependant, malgré cette diversité interprétative, il est envisageable de concevoir la distorsion de concurrence comme un concept juridique opérationnel. Pour y parvenir, il était nécessaire d'élaborer une théorie générale de la notion de distorsion de concurrence. Ainsi, cette thèse ambitionne d'identifier la signification et la portée juridiques de la distorsion de concurrence telle qu'elle se manifeste en droit positif, afin d'en proposer une définition unitaire. Une fois sa conceptualisation effectuée, il est alors possible de déterminer le régime juridique applicable à la distorsion de concurrence et de préciser les conditions dans lesquelles celle-ci doit être sanctionnée ou, au contraire, autoriséeAs an economic concept, the notion of distortion of competition refers to the effect of State intervention in the economy. Although this notion has been formally transposed into European Union law, it is nevertheless perceived as ill-defined in legal terms. Indeed, what it designates remains unclear, and the multiplicity of meanings that can be construed from this expression makes its conceptualization difficult. However, despite the diversity of potential interpretations, it is possible to conceive the notion of distortion of competition as an operational legal concept. To reach that point, it was necessary to develop a general theory of the notion of distortion of competition. Thus, this doctoral dissertation aims to identify the legal meaning and scope of the notion of distortion of competition as it manifests itself in positive law, in order to suggest a unitary definition of the notion. Once conceptualized, it is then possible to determine the legal regime applicable to the notion of distortion of competition, and to specify the conditions under which it should be banned or, on the contrary, permitted

Ce travail de recherche a pour objectif de proposer des recommandations pour la mise en place d'évaluations d'interventions en ergonomie.Pour instruire cette question de recherche, nous avons décidé d'explorer comment les ergonomes utilisent l'évaluation : pour proposer des repères pour la conception, pour suivre l'évolution des projets avec des indicateurs de gestion ou pour augmenter les connaissances sur l'intervention qui s'est déroulée. Nous avons également exploré les modèles d'évaluation proposés par la littérature et détaillé particulièrement les démarches et buts visés par l'évaluation normative, la recherche évaluative, l'évaluation sommative et l'évaluation formative en général et dans le cadre particulier des actions en santé et sécurité au travail. Enfin, nous avons caractérisé l'objet de l'évaluation : l'intervention en ergonomie afin de mettre en évidence des dimensions d'évaluation.
L'analyse de 3 cas d'intervention, a permis de montrer l'importance de la prise en compte d'un système « contexte‐opportunités‐arbitrages‐décisions » pour appuyer les démarches d'évaluation sur la mise en évidence d'écart entre stratégies d'intervention prévues et interventions réellement mises en oeuvre. This study examines the European Union normative power in Sub-Saharan African countries. It is based upon theoretical researches on normative power and official publications about EU’s normative power in Africa. The aim of the thesis is to analyse the EU’s role in Africa as normative power. The following questions are posed: What are the reasons of exercising normative power by the EU in Africa? What are the main areas the EU acts as normative power in African continent? And what are the results of EU normative power activity in Africa? The theoretical approach assumes that the EU is no longer a normative power. But, nevertheless, it can exercise normative power. The study is conducted with a qualitative method research. The results show that the EU as a normative power pursues egoistic motives in Africa. But its normative power becomes limited by some factors: growing economic development of Africa, growing EU military power. The main purpose of the study was to answer how body-positive movement on Instagram is portrayed by female influences. The aim was also to understand how young women relate to body ideals and how they challenge the normative female body. To answer these questions, the study has been inspired by a narrative analysis method. My intention for this essay was to draw attention to the women's story about their experiences. To understand and be able to carry out an analysis of the empiric, previous research was used about social media and Instagram, the term influences, body ideal on social media, what impact social media can have on women's self-image, what body positivity means and fat phobia in society. The starting point for the literature search has been to map the research field and to strengthen my research question. To analyze the extracted empire, different theories were chosen. The theories I considered most suitable were feminist theory, the dramaturgical perspective, the mirror self and the social comparison theory. The result was divided into 7 themes which were: imagery of body positivity, feminism and body activism, influencers´ responsibilities to their followers, society's view of fat people, Instagram vs. reality, the concept of taking care of oneself as well as sisterhood and role models. The result shows that the female influences, with their body activism, wants to challenge the normative assumptions about how a woman should look and be. They want to create a platform to help in the normalization process of women with a larger body shape, as well as highlight the complications you as a woman with a non-normative body can encounter in society. The influencers hope that with their body activism they can strengthen the self-esteem of fat women.Studien hade som huvudsyfte att besvara hur kroppspositiva rörelsen på Instagram framställs av kvinnliga influenser. Syftet var även att förstå hur unga kvinnor förhåller sig till kroppsideal och hur de utmanar den normativa kvinnokroppen. För att besvara studiens frågeställningar har studien inspirerats av en narrativ analysmetod. Min avsikt för arbetet var att rikta uppmärksamheten på kvinnornas berättelse om deras upplevelser och erfarenheter. För att förstå och kunna föra en analys kring empirin användes tidigare forskning av sociala media och Instagram, termen influenser, kroppsideal på sociala medier, vilken påverkan sociala medier kan ha på kvinnors självbild, vad kroppspositivitet innebär samt fettfobi i samhället. Utgångspunkten för litteratursökningen har varit att kartlägga forskningsfältet samt att styrka min forskningsfråga. För att analysera den utvunna empirin valdes olika teorier. De teorier jag ansåg vara bäst lämpade var feministisk teori, det dramaturgiska perspektivet, spegeljaget samt social jämförelseteorin. Resultatet delades upp i 7 teman som var: bildframställning av kroppspositivitet, feminism och kroppsaktivism, samhällets syn på tjocka människor, influensers ansvar gentemot sina följare, Instagram vs. reality, begreppet ta hand om sig själv samt systerskap och förebilder. I resultatet framkommer att de kvinnliga influenserna vill med sin kroppsaktivism utmana de normativa antagandena om hur en kvinna ska se ut och vara. De vill skapa en plattform för att hjälpa till i normaliseringsprocessen av kvinnor med större kroppsform, samt belysa vilka komplikationer man som kvinna med en icke normativ kropp kan stöta på i samhället. Influenserna hoppas att med sin kroppsaktivism kunna styrka tjocka kvinnors självkänsla.

Depuis le début des années 1990, on a assisté à un essor et un développement des services militaires privés. Aujourd'hui, de nombreux États ont recours aux services de SMP pour accomplir certaines tâches traditionnellement dévolues aux armées nationales. Des organisations internationales et non gouvernementales et des entreprises privées font aussi appel aux services de SMP. La participation d'acteurs privés dans les conflits armés n'a cependant rien d'inusité. Elle a pratiquement toujours existé. Toutefois, l'activité des SMP s'inscrit dans un contexte juridique qui traite l'activité militaire comme une prérogative de l'État ou, à tout le moins, de groupes prétendant au contrôle de l'État, et qui organise le cadre normatif régissant les hostilités autour de cette prémisse. L'application pratique de certaines des règles du droit international aux activités des SMP soulève de nombreuses questions. Le DIH, bien qu'il ne prévoie pas de règles spécifiques pour les employés de SMP, s'applique à ceux-ci lorsqu'ils opèrent dans le cadre de conflits armés Cependant, dans les faits, le statut ou la situation juridique de ces personnes peut s'avérer difficile à déterminer. Les activités des SMP dans les zones de conflits posent moins de difficultés au niveau des mécanismes de mise en oeuvre que sont la responsabilité internationale des États et le droit international pénal. En effet, ceux-ci peuvent relativement facilement prendre en compte ces acteurs de nature privée. Cependant, elle ne trouvent application qu'a posteriori, c'est-à-dire lorsque le DIH n'a pas été respecté. Ainsi, elles ne permettent pas, du moins pour le moment, de pallier les difficultés d'établir a priori et dans l'immédiat d'un conflit le statut parfois changeant et incertain des employés de SMP de même que d'établir avec certitude la protection à laquelle ceux-ci ont droit. La question sous étude est au coeur de plusieurs des changements que connaît présentement la structure de l'ordre juridique international et dont le recours de plus en plus fréquent aux SMP par les États est un exemple probant et extrême. De plus en plus d'acteurs de nature diverse se côtoient sur la scène internationale, et même sur les champs de bataille, l'ordre juridique international se doit d'en prendre acte.

Cette thèse examine l’impact de l’octroi de titres miniers sur les dynamiques politiques ayant cours dans des territoires affectés par le conflit armé colombien. Du point de vue théorique, elle reprend les questions classiques que la philosophie politique formule au sujet du rapport entre normes et communauté politique, c.-à-d., autour du rapport dialectique entre politique et droit. Elle les reformule cependant au regard des transformations induites par la globalisation: la multiplication et la superposition de différents régimes normatifs, qui remettent en cause la cohérence de la sphère normative et, par le fait même, le rapport assumé entre droit, démocratie et souveraineté. M’appuyant sur les réflexions de chercheurs de l’École de Bruxelles de philosophie du droit, je propose le modèle « d’écosystème normatif » pour analyser les rapports qui s'établissent entre des régimes normatifs a priori incommensurables, allant du droit aux stratégies contre-insurrectionnelles, de la Responsabilité sociale des entreprises (RSE) à la morale; et des relations contractuelles à la violence politique.
Sur la base d’études de cas menées dans deux régions de la province d’Antioquia, cette thèse démontre que l’octroi de titres miniers favorise des configurations particulières de l’écosystème normatif. En d'autres mots, l’octroi de titres miniers induit une certaine stabilisation des relations entre droit public, RSE, contractualité et gouvernementalité, que j'appelle « écosystème normatif minier ». Ma thèse conclut que l’écosystème normatif minier colombien est peu propice à l'articulation de communautés politiques et empêche la conduite délibérée et rationnelle des affaires publiques ainsi que l'organisation démocratique du territoire. L’écosystème normatif minier favorise au contraire des rapports sociaux utilitaires, la corruption, le clientélisme et la violence politique.
Cette recherche démontre en outre que les « solutions » normatives mises de l’avant pour traiter les conflits suscités par l’activité minières remettent parfois en cause certaines catégories fondamentales de la pensée politique et juridique moderne. En Colombie, une politique d’institutionnalisation de la RSE, menée conjointement par l’État et les titulaires miniers, induit ainsi des changements profonds dans les rapports entre communautés, entreprises et gouvernements.
Ma thèse clarifie ainsi certains des défis que la société colombienne doit surmonter, étant donné les nombreux titres miniers octroyés sur une grande proportion de son territoire, pour mener à bien le processus de paix initié en 2016.
Summary
This thesis examines the impact of granting mining titles on political dynamics in the territories affected by the Colombian armed conflict. From a theoretical point of view, it takes up the classic political philosophy interrogations about the relationship between norms and political community, i.e., the dialectical relationship between politics and law. Those questions are updated by taking into account the transformations induced by globalization: indeed, the multiplication and superimposition of different normative regimes undermines the coherence of the normative sphere and, by the same token, the assumed relationship between law, democracy and sovereignty. Based on the reflections of researchers at the Brussels School of Philosophy of Law, I propose the notion of “normative ecosystem” to analyze the relationships that are established between presumably incommensurable normative regimes, from law to the counter-insurgency strategies, from Corporate Social Responsibility (CSR) to morality; and from contractual relations to political violence.
Based on case studies conducted in two regions of the province of Antioquia, this thesis demonstrates that the granting of mining titles favors particular configurations of the normative ecosystem. In other words, the granting of mining titles induces a certain stabilization of the relations between law, CSR, contractuality and governmentality, which I call the “mining normative ecosystem”. My thesis concludes that the Colombian mining normative ecosystem is not conducive to the articulation of political communities and prevents the deliberate and rational conduct of public affairs as well as the democratic organization of the territory. On the contrary, the mining normative ecosystem favors utilitarian social relations, corruption, clientelism and political violence.
This research also shows that the normative “solutions” put forward to deal with conflicts in the mining sector call into question certain fundamental categories of modern political and legal thought. In Colombia, a policy of institutionalization of CSR conducted jointly by the State and mining title holders induces profound changes in the relationships between communities, companies and governments.
My thesis thus clarifies some of the challenges that Colombian society must overcome, given the numerous mining titles granted over a large part of its territory, to successfully carry out the peace process initiated in 2016.

Dans l'histoire des idées, les débats sur les savoir-faire ont été minorés, malgré des enjeux épistémologiques majeurs. Dans une première étape, depuis les premiers écrits homériques jusqu'en Grèce classique, s'est progressivement affirmé l'idée d'un savoir technique qui échappe aux ambitions d'un logos omniscient. Dans une seconde étape, amorcée chez les Ingénieurs du Moyen-Âge, puis enrichie suivant un héritage qui va de F. Bacon à Diderot, en passant par Descartes et Leibniz, il devient possible d'unir les efforts de la science, de la technique et de l'art dans une même visée critique. Nous identifions une troisième étape, issues de réactions face à l'industrialisation de masse entamée au XIXe siècle, qui sépare socialement et épistémologiquement la science et la technique. À partir des épistémologies de Canguilhem ou de Wittgenstein, mais aussi de certaines observations faites par les managers du savoir, nous proposons de penser l'activité comme le creuset de tensions entre le savoir et le faire, mais aussi entre les normes et les valeurs qu'institue toute vie humaine.

Cette recherche se donne comme défi de retracer les enjeux normatifs liés au développement du sous-domaine de l’intelligence artificielle appelé machine learning. Bien que celui-ci connaisse un impressionnant regain d’intérêt depuis le début du XXIe siècle, et ce à travers un nombre croissant d’activités sociales, son émergence remonte au moins à la première moitié du XXe siècle. En effet, l’idée de concevoir des machines capables de modéliser l’apprentissage organique est largement concomitante au projet cybernétique de fonder une science du contrôle et de la communication. A force de modéliser l’apprentissage, il devient progressivement possible d’envisager à partir des années 1940 et 50 que les machines elles-mêmes seraient capables d’apprendre. C’est par l’observation des comportements des machines qu’une formalisation algorithmique de l’apprentissage s’impose. A partir de cette mise en scène, nous chercherons à montrer en quoi l’apprentissage algorithmique n’est pas nécessairement une question d’automatisation de l’apprentissage et que le comportement permet, au contraire, de problématiser la normativité des algorithmes apprenants en ce qu’ils participent activement à certaines activités sociales (travail, enseignement, guerre, etc.). Il s’agira, à partir des philosophies de Georges Canguilhem et Gilbert Simondon, de montrer en quoi les effets normatifs induits par l’apprentissage algorithmique, comme mode de gouvernement au sein d’activités sociales données, peuvent se comprendre à l’aune du concept de "répertoire de comportements potentiels".Doctorat en Philosophie

The list of normative legal documents regulating the activity of an educational psychologist (psychologist in the field of education) is presented. Goals and objectives, main types and directions of teacher-psychologist’s activity are given. Forms of reporting documentation based on the results of the professional activity of an educational psychologist (psychologist in the field of education) are presented. The algorithm of interaction between an educational organization and a psychological-medical-pedagogical commission, the algorithm of interdepartmental interaction in case of an emergency involving minors are described.
The recommendations make it possible to develop unified approaches to psychological and pedagogical support for participants in educational relations and to optimize the activities of an educational psychologist (psychologist in the field of education) by enriching and standardizing methodological tools. Interaction algorithms can be used to organize joint activities of various experts in order to guarantee the legitimate rights and interests of students and other participants in educational relations.

McDowell holds that our thinking, in order to have intentional content, must stand in a normative relation to empirical reality. He thinks that this condition can be satisfied only if we adopt “minimal empiricism”: the view that beliefs and judgements stand in rational relations to perceptual experiences, conceived as passive. I raise two complementary difficulties for minimal empiricism, one challenging McDowell’s view that experiences, conceived as passive, can be reasons for belief, the other challenging his view of experience as presupposing conceptual capacities. I go on to argue that minimal empiricism is not necessary for satisfying the condition that thinking be normatively related to the empirical world. There is another way of understanding the relation between thought and reality which construes it as normative without being rational: we can understand it as the world’s normative constraint on the activity through which empirical concepts, and hence empirical thinking, become possible.

His basic proposal is that a rule normatively sustains a practice when the value achieved by following the rule explains why agents continue following that rule, thus establishing and sustaining a pattern of activity. He applies this model to practices of belief management and identifies a substantive normative connection between knowledge and belief. More specifically, he proposes one special way that knowledge might set the normative standard for belief: knowing is essentially the unique way of normatively sustaining cognition and, thereby, inquiry. In this respect, his proposal can be seen as one way of elaborating a “knowledge-first” normative theory.

AbstractThis chapter delves into one of the ways in which scholars strive to make their work matter, namely, through the practice of scholar-activism. It becomes evident that the concept of scholar-activism is multifaceted and lacks a universally established definition. The objective of this chapter is to gain an insider’s understanding of scholar-activism by exploring its conceptualization and intellectual foundations. To achieve this, a conceptual review of literature authored by scholar-activists is conducted, complemented by scientometric analysis of co-wording and co-citation. The findings of this study reveal two key insights. First, the concept of scholar-activism can be viewed as comprising three interconnected components: criticality, active engagement, and normative orientation. These elements inform one another, shaping the overall practice of scholar-activism. Second, the review identifies four primary intellectual influences that underpin scholar-activism: critical geography, feminist thought, popular education, and critical social theory. It becomes apparent that, based on the accounts of scholar-activists in this review, a conceptual reconciliation between scholarship and activism is feasible. Nevertheless, the practical challenges of navigating institutional and contextual barriers to bring about this alignment remain a significant obstacle for scholar-activists, warranting further exploration.

AbstractThis chapter presents the main features of how teachers are educated in Sweden, including current reforms due to teacher shortages and criticism of teacher quality. It based on from the notion of teacher education as a societally critical activity, orienting around tensions, balances and difficulties in teacher education. It is argued that teacher education is a complex activity that policy and practice unfortunately do not pay adequate attention to. Teacher education in Sweden is profoundly varied. Recurrent top-down reforms complicate teacher education, as an understanding of the central aspects of teacher education has not been agreed upon or endorsed. The continued criticism of teacher education, despite many reforms and changing practices, might indicate that recurring political demands to reform teacher education rest on unclear or inadequate grounds or incomplete information, or they might be conditioned by overarching political motivations. As teacher education is central to education in general and to the advancement of democracy, this is particularly worrying. It is through an analysis of the full complexity of teacher education that it becomes possible to design adequate reforms that result in transformative work on how to ‘get better at getting better’, a feature that applies to both organizations and professionals.

AbstractThis chapter investigates the role of axiological drivers in solidarity activism with refugees. It examines how universal value orientations denote normative and relational orientations of care and posits that refugee solidarity activism is driven by the activists’ universal caring orientations to all vulnerable groups. Overall, the chapter illustrates how universal value orientations and moral commitments shape and orient political activism with refugees based on common ideational solidarity projects. These conclusions are based on the analysis of data from a cross-national EU survey conducted in 8-EU countries between 2016 and 2017. Findings substantiate that axiological drivers, namely, universal value orientations and moral commitments, increase the predicted probability for engagement in refugee solidarity activism. Lastly, this chapter supports that in addition to attitudinal affinity and organisational embeddedness, refugee solidarity activism is a product of axiological drivers.

AbstractThe paper investigates the phenomenon of vitalism through the lens of vital normativity as expounded by Maurice Merleau-Ponty and Georges Canguilhem. I argue that the two authors independently developed complementary critiques of the mechanical-behaviourist conception of life sciences, which culminated in a surprisingly similar notion of life construed as a normative (polarized) activity, i.e., an activity that is not indifferent to its own conditions of possibility. Such an alternative conception of life has far-reaching consequences for the epistemology of life sciences, for it requires it to reconsider not only its object of inquiry - the nature of (the relationship between) an organism and its environment -, but also, since scientists themselves are living beings, the nature of its epistemic practices. What I call the truth of (a specific variety of) vitalism is thus reflected not only in how life is cognized, but also in how life cognizes (itself). This last point is of particular philosophical importance, as it paves the way towards a more dynamic conception of reflection (tentatively called ouroboric thought), which takes seriously that we, as cognizers of life, at the same time live the lives of cognizers.

AbstractOcean governance comprises the law of the sea as well as all related policy and normative dimensions that relate to the regulation of human activity at sea and increasingly places a strong focus on marine environmental protection and the conservation of marine resources, with the aim of ensuring a healthy and productive ocean while sustaining a resilient ocean-based economy. Premised on this observation, this chapter aims to reflect on the past, present and future of ocean governance using three case studies as snapshot examples, namely, fisheries at sea, marine area-based management tools and international seabed mineral resources. Put together, these three case studies will demonstrate how the law of the sea has evolved when considered from the dimension of ocean governance, particularly with respect to the challenge of protecting and preserving the marine environment through the sustainable use of marine resources.

AbstractThis chapter examines the argumentative and rhetorical structure of the regulatory techniques used to deal with the SARS-CoV-2 pandemic in Italy. The first part of the chapter aims to clarify the connection between law and rhetoric, in order to provide a framework in which the legislative activity has operated. After analyzing critical aspects of the chosen regulatory tools, we will focus on the three most innovative elements of the pandemic legislation: the frequent use of images, the sporadic presence of sanctions, and the relevant role of experts. In the second part, an analysis of the fundamental traits of visual argumentation will be presented to highlight the fact that the use of images, during the pandemic period, has become a political-normative technique, which is never a neutral tool, but is always subject to interpretation and endowed with a notable rhetorical value. Given the sporadic presence of sanctions, the second section will analyze the argumentative strengthening applied by the legislator in order to promote the obedience of the recipients of the measures. Finally, we will examine the involvement of experts in the justificatory activity of the legislator, and the need for them to acquire legislative legitimacy through a rhetorical-argumentative relationship with citizens.

This chapter explores what motivates and sustains anti-austerity activism within the context of continued austerity. It affirms the centrality of the affective and normative dimensions of political engagement by demonstrating that anti-austerity activism is motivated and sustained by three core elements; emotion, morality and relationship. Individuals are motivated by an emotional response to perceived injustice combined with normative ideals about how society should be and how we should act in relation to others. They utilise notions of humanity and empathy to combat the dehumanising effect of neoliberal capitalism and its focus on individualism and competition. Participants translate such abstract, universal concepts into concrete, particular actions through a focus on everyday activism and individual choices. Rather than an outright rejection of individualism, participants seek to redefine it in ways that move away from the dominant neoliberal understanding and towards reconciling the individual with the wider collective and common good. Here, activism is conceptualised as a moral duty. Participants therefore suggest that everyone and anyone can and should do activism, with small acts making a difference. This chapter begins to unpick the ways in which activists resist, subvert and sometimes unwittingly reinforce neoliberal capitalism, as well as questioning the problematic distinction drawn between ‘non-activist’ and ‘activist’.

The expansion of the mining basin inevitably leads to a significant transformation of the area, resulting in substantial changes in both the natural environment and the socioeconomic sphere of the population's life. The Bor mine, established in 1904, has been synonymous with copper production in Serbia and Europe for 120 years. Surface copper mining takes place in the Veliki Krivelj and Cerovo mines. The Veliki Krivelj surface mine opened in 1983 in the cadastral municipality of Krivelj, encompassing the open-pit mine and the copper ore flotation plant. Over the years, the expansion of the mine has caused numerous changes within the settlement. This article focuses on Krivelj, the mining settlement 10 km north of Bor. Krivelj has been facing various challenges for decades, directly resulting from expanding the former Bor Mining and Smelting Basin, now known as the "Serbia Zijin Copper" company. Since 1970, relocation plans have existed, primarily targeting parts of the settlement directly affected by mining activities. Although planned relocation has been partially implemented in different phases, the idea of complete resettlement has not been abandoned. The Veliki Krivelj mine, owned by the Chinese company Zijin, continues to expand towards the Krivelj settlement, subjecting the population to numerous difficulties in terms of housing and health. This study provides an overview of the population relocation process, including the underlying principles, modalities, and scope of the process itself. The research aims to comprehensively examine the impact of the Veliki Krivelj mine on the past and recent displacement of the Krivelj settlement, as well as its effects on the environment of the settlement and surrounding areas. The overarching goal is to understand the contemporary socio-geographical changes, as well as the pressures and challenges faced by the population of this settlement.

Terror is a weapon that has been widely used throughout history, whether for military, strategic, political or ideological purposes. Of Latin origin, this term, although dear to international relations, derives from a relevant and difficult-to-define theme: terrorism. In order to conceptualize it, we initially sought answers in its different guises in space-time. In order to analyze the phenomenon of modern terrorism historically, we will base ourselves on the assumptions of David C. Rapoport, based on the four waves of terrorism. From the perspective that waves are cycles of activity, characterized by their expansion and contraction in a given period. In common, these waves have international characteristics, occurring in different countries, and are differentiated by marking "the predominant energy that shapes the participating groups"9 , they are: anarchist, anti-colonialist, new left and religious. It is worth noting that the waves are made up of organizations, but there is a big difference between the rhythms of the two, and one organization can even extend into other waves.

This brief aims to inform activists, policymakers, lawyers, and the judiciary of the key challenges and makes recommendations relating to legal reform, better implementation of the PCMA ensuring accountability and promoting access to justice for girls in child marriages.

The article reflects the results of the research of the information component of the concept “the reputation of the regional (executive) power” on the basis of the normative approach. The interrelation between the evaluation indicators of the regional executive power activity efficiency and the power reputation content is shown, based on the mass questionnaire survey of the population of 6 regions of the Central Federal District (sample of 1,500 people). The conclusion about rather low potential of influence of existing at the moment normative system of evaluation of efficiency of regional executive authorities on the process of formation of its reputation among the population is made.

The paper clarifies the process of a mining engineer training in terms of the innovation system of Ukraine. The authors analyze a number of normative documents concerning innovative activity in Ukraine in general and mining business in particular. In the process of implementation of innovations into mining industrial complex urgent problems are defined. The methodology of information and communication technologies (electronic, distance and mobile studies) usage in engineers training within the conditions of university education is offered. It is marked that the worked out methodology finds its practical introduction: e-learning involves creation of the portal "Electronic mentor"; distance learning is presented in the study of professional disciplines as an example of the course "Сomputer Technologies in Mining"; mobile learning is considered as an example of discipline "Computer Science and Engineering".
