This chapter discusses the variety of mechanisms available to propose changes to state constitutions. Amendments or revisions of state constitutions can be accomplished through legislative proposal, constitutional convention proposal, constitutional commission proposal, and the initiative in states that permit it. In all states other than Delaware, the electors must approve changes to the state constitution. The chapter reviews the use of limited state constitutional conventions, and constitutional commissions. Constitutional revision processes in a variety of states during the 20th century are discussed, together with general lessons that can be derived from those experiences. The chapter describes difficulties faced in modern times with state constitutional amendment and revision, including popular distrust of constitutional conventions and other constitution-making processes. Several proposed improvements to the initiative process for state constitutional change also discussed.

Many theorists hold that an agent’s blameworthiness for unwitting wrongful conduct must stem from—or trace back to—her blameworthiness for something else. And appeals to tracing in these cases lead some writers to a highly revisionist view, on which people are blameworthy for wrongdoing much less often than we ordinarily think (and our mistake, unfortunately, is not about how much wrongdoing there is). This chapter sets out the main claims of an argument for such a view and responds to it. It offers grounds for retaining a good many of the judgments that the revisionist would have us reject. The defense rests to a significant extent on commonsense views about the psychological capacities and abilities to act that people ordinarily possess, views that, as far as the author tell, revisionists have not shown to be mistaken.

This chapter reevaluates the use of remilitarization in order to understand the contemporary trajectory of Japanese security policy and to demonstrate its strengths. The application of the term “remilitarization” can provide a powerful analytical and theoretical framework to discern the nature and significance of Japan's changing security policy. First, the concept of remilitarization assists in identifying those military components present in all societies, including Japan, that are subject to contestation and thus open the way to substantive change in military security policy. Second, the concept of remilitarization as a dynamic process over time is an important reminder to search for the possibilities of significant change in a society's military stance.

Connected with textual unfinishedness are several concepts. Chapter 3 explores two such concepts and their connection to the idea of textual stability and authorial intentionality: accidental publication and postpublication revision. Unfinished texts often became what Larsen calls “accidentally published.” Publication was notional and social in antiquity, as the form of a published text would not necessarily differ from an unfinished one. The idea of accidental publication did a lot of different kinds of work for different writers. Moreover, even if a text was intentionally published, it could undergo substantive postpublication revision. All of the above calls into question what it means to talk about a “final” version of a textual tradition.

Fixing Language is a book about ways in which language (and other representational devices) can be defective and improved. In all parts of philosophy there are philosophers who criticize the concepts we have and propose ways to improve them. Once one notices this about philosophy, it’s easy to see that revisionist projects occur in a range of other intellectual disciplines and in ordinary life. That fact gives rise to a cluster of questions: How does the process of conceptual amelioration work? What are the limits of revision (how much revision is too much)? How does the process of revision fit into an overall theory of language and communication? This book is an effort to answer those questions. In so doing, it is also an attempt to draw attention to a tradition in twentieth- and twenty-first-century philosophy that isn’t sufficiently recognized as a unified tradition. There’s a straight intellectual line from Frege (e.g. of the Begriffsschrift) and Carnap to a cluster of contemporary work that isn’t typically seen as closely related: much work on gender and race, revisionism about truth, revisionists about moral language, and revisionists in metaphysics and philosophy of mind. These views all have common core commitments: revision is both possible and important. They also face common challenges: how is amelioration done, what assumptions need to be made, e.g., about the nature of concepts, and what are the limits of revision?

Inchoate offences are where the full offence is not completed. The law governing all inchoate offences is in a state of flux; the common law offence of incitement was replaced with new offences under the Serious Crime Act 2007. The law governing conspiracy and attempts was the subject of a Law Commission Report in December 2009.

The intervention of equity in land law can be seen in two key areas: the development of new equitable interests in land, and the availability of equitable remedies to enforce interests in land. To be legal, the interest must be listed under s 1(2) Law of Property Act 1925 (LPA 1925) and certain formalities must be met in its creation, notably being granted by deed (s 52 LPA 1925). Where these formalities are not met, the interest may have equitable status instead, but only where equity can find a specifically enforceable valid contract to create the interest. All other interests in land can only ever be equitable (s 1(3) LPA 1925). The status of an interest in land as either legal or equitable traditionally determined the rules of enforcement of that interest against third parties: legal interests bound all third parties, whereas equitable interests would only bind third parties who were not bona fide purchasers for value of a legal estate without notice.
