From Chinese Communist Party’s 16th Congress in November 2002 till the end of 2004, there were three characteristics in the transformation of Cross-Strait relations. First, short smooth relations ended up with serious deterioration. The polarized changes in the last two years have not been seen since 1990. Second, after the deterioration, tension escalated and the debate became directly targeted at the basic issue known as “No independence, no forces used”. Third, before the deterioration, US-Taiwan relations liked the ebb and flow of the sea in the Taiwan Strait while US-China relations were continually under competition and cooperation. It is also rare that these two bilateral relations became a clearly non-zero game. This background helps explain the difference between the current escalation and those in 1996 and 1999, in which the main reason for the conflict stemmed from either Beijing or Taipei assuming that the United States was playing favorites. Based on the changing relations across the Taiwan Strait in the last two year, the characteristics mentioned above, and dynamic interactions among Taipei, Beijing, and Washington, this study tries to achieve the following four goal: 1. Finding the reason why mutual trust transformed from weak to none on the Cross-Strait relations? 2. Investigation of the reasons regarding Taiwan’s lack of consensus which has led to the current tension, and how to overcome it. 3. Analysis on whether the increasing Taiwanese identity will lead to even stronger anti-independence actions from China or eventually war. 4. Investigation of the uncertain US factor which may lead to the change of US-Taiwan relations and the damage of cross-strait relations. After the closing of Chinese Communist Party’s 16th Congress on November 14, 2002, Hu Jintao succeeded as General Secretary of the Party. After the 9th National People’s Congress, Hu succeeded the National President and Jiang Zemin remained as Chairman of the party and state’s Central Military Commission. The two-year interaction between Hu and Jiang began since then. After the end of the Communist Party’s 4th Session of 16th Congress in September 2004, Hu succeeded Party’s Chairman of Central Military Commission. During the 3rd Session of 10th People’s Congress in March 2005, Jiang resigned and Hu succeeded as state’s Chairman of Central Military Commission. It marks the arrival of The Hu Jintao Era. On March 4, 2005, in the National Political Consultative Conference, Hu proposed the “Four Absolute No’s” that is viewed as a replacement for Jiang’s “Eight Points” and a new policy on the relation across the Strait. The purpose of Hu chose to bring up the “Four Absolute No’s” and released the main points before the anti-secession law passed on March 14th 2005 is aimed at showing good will to the Taiwan people and to contain the pro-independence forces. From the full text of Anti-Secession Law which consists of ten articles with more than a thousand words, it is not hard to understand China is showing its utmost sincerity, making its greatest efforts, and expressing its strongest meaning. Facing the formidable Anti-Secession Law and ensuring national security, Taiwan should consolidate internally, confront calmly, and seek support internationally.

Previous studies have found a robust link between legislative efficiency and the party caucus negotiation; however, successful negotiation is based upon communicative rationality. Since the Nationalist Party (KMT) has held an absolute majority of seats in the 7th Legislative Yuan (since Feb. 1st, 2008), the conflicts between ruling and opposition parties might become more intense, resulting in irrational communication. After examining the outcomes, methods and directions of cross-party negotiation, the current study found that the effects of negotiation on legislative efficiency may have weakened or even become negative in Legislative Yuan. The negative effects of negotiation may lead people to question the value of negotiation as documented in previous studies. One possible explanation is that the lack of trust may make cross-party cooperation difficult, endanger rational communication, and subsequently curb the process of reaching consensus. Legislative bodies in modern societies like the U.K., U.S., and Germany have long histories in the practice of negotiation. These countries have not only accepted the importance of negotiation in resolving political conflicts but have also successfully implemented negotiation in the process of legislation. Taiwan, however, has just started learning democratic practices and might only know the majority rule. The current study suggests that “negotiation first, majority rules” may bridge the gap between democratic ideals and the current political situation in Taiwan. An ideal democratic society may heavily rely on negotiation to resolve conflicts, suggesting that negotiation should come first when facing conflicts but that majority should rule when dealing with negotiation deadlock in order to make progress. On the one hand, the minorities can voice themselves through negotiation, which is in accordance with the value of respecting the minority in democratic systems. On the other, minorities should not boycott meetings but follow the decisions made by the majority after negotiation has provided the channel for mutual communication. Therefore,“negotiation first, majority rules” may be one possible solution to reach consensus during legislative process. The mechanism of cross-party negotiation is made for mutual communication among parties. In addition, the transparent negotiation process may give the minority party a right to express its appeals in public, which may decrease the chance of boycott during legislative meetings. Negotiation may not only manifest minority rights in democratic representation but also legitimate majority rule in legislative practice, through which legislative efficiency can be maintained. In order to discover the factors which predict the outcomes of negotiation, I analyzed legislative processes of the general budget proposal for central government (2009), Assembly and Parade Act, Renewable Energy Development Act, and Rural Renewal Regulations. Several suggestions about resolving political conflicts, enhancing rational communication, and facilitating successful negotiation were made through a series of examinations of negotiation process in each case. This study applied the frameworks of communication behaviors to examine cross-party negotiations; however, negotiation may be adopted by parties as a strategic behavior for political appeals, which is different from rational communication as discussed in this study. Future research may approach the issues of negotiation via the applications of political strategies for broadening our understanding.

The study starts out from the internal and external environment after the 16th NCCPC (National Congress of Communist Party of China) to explore the background of the Reform toward Regime for Cultural Administration and with the following discoveries made after deducting revolutionary objective, process, and performance. The achievement of the Reform toward Regime for Cultural Administration is in generating profits, changing governmental functions, promoting cultural construction, reinforcing regulatory construction, promoting cultural business department and increasing employment population, and opening up cultural market that help reinforce cultural energy and competitiveness. However, it has not yet helped resolve the issues of party and governmental organization overlapping, ambiguity between cultural industry and cultural business, and integrity of cultural regulations. The impact of the Reform toward Regime for Cultural Administration: In terms of politics, the success of reformation will affect the political life of Chairman J.T. Hu and the stability of Chinese politics; moreover, the way to internationalized political system throughout the reformation. In terms of economy, the reformation helps improve national economic growth and increase national tax income. In terms of society, the reformation helps increase employment opportunity, improve labor protection, minimize difference between urban and rural, and impact the value of countrymen and social stability. The study finding, the Reform toward Regime for Cultural Administration is extended from the reformation in the past and it is in conformity with that reformation; moreover, it has made the national reformation unique. The said reformation includes the tasks of: (1) Integrating organizational functions, reducing trade cost, and consolidating national cultural construction in a scientific way; (2) Reforming cultural review system (review approval), establishing law and order, and freeing cultural business (loosening up the control over culture business) through liberation (transferring government control over to business entities). Propose strategic suggestions to government for policy planning and cultural business reformation.

Institute: Graduate Study of China Study; Tamkang University Degree & Date Conferred: Master, June of 2004 Name of candidate: Lin, Hsien-Chin Advisor: Dr. Pan, Shi-Tang Summary: This dissertation research focus mainly on the development and changes of PRC’s “Taiwan Policy” from December 1978, when “Open Policy”, under the “One Country, Two systems” was adopted up until the Communist Party’s 16th Congress held in November 2002. The structure of this dissertation is based on “The Political System” theory authored by Professor David Easton. Chapter One: Introduction Chapter Two: Appraise the history behind China’s “Taiwan Policy” prior to CCP 16th Congress from both a strategic and tactic point of view. Strategically, the formation of “One Country, Two System” and how it evolved into Jiang Zemin’s eight point toward Taiwan. Tactically, belittle Taiwan politically in world forum, isolation of its diplomacy; military threat and cross-strait economic and trade exchanges opportunity are the so called “4 in 1” approach China used against Taiwan. Chapter Three: “The effect of 16th Congress’s on China’s “Taiwan Policy” examines both the domestic and international environment of China and the level of comprehension of its decision makers. Limitation such as economics and political changes domestically and internationally; U.S.’s China-Taiwan policy and the effect of the 911 terrorist attack. Chapter Four: To appreciate the essence of China’s Taiwan Policy after the 16th Congress, the “Political Report on Taiwan” from the 16th Congress, “Government Working Report” from the 10th Congress and government policy on personnel assigned on Taiwan relation related jobs are all cautiously analyzed and reviewed. Chapter Five: China’s “Taiwan Policy” faces the need for modification in light of the effect of Taiwan’s democratic movement and the change of ruling party, from KMT to DDP. For Taiwan, issues as its Independence, business migration to China and practicing elastic diplomacy; where as, for China, the development of western China’s, party and military’s relationship, and finally on the international front, WTO, ASEAN and US-China policy. Chapter Six: Conclusions are consolidated and summarized based on two separate findings of this research, the initial research result and its follow up substantiation.
