Autorka przybliżyła postać Marii Kostrzewskiej, jednej z wielu konspiratorek AK i podziemia antykomunistycznego, które mimo upływu wielu lat nadal nie mają swoich grobów. Kostrzewska urodziła się w 1901 r. w Krakowie, była absolwentką Akademii Handlowej w Krakowie. W czasie wojny była związana z krakowskim Zgrupowanie Armii Krajowej Żelbet. Po zakończeniu działań wojennych kontynuowała wraz z synem działalność konspiracyjną w ramach Zrzeszenia Wolność i Niezawisłość. Była członkinią Brygady Wywiadowczej oraz szyfrantką Obszaru Południowego Zrzeszenie WiN. Po aresztowaniu i skazaniu przez Wojskowy Sąd Rejonowy w Warszawie przebywała w więzieniu w Fordonie, gdzie ciężko chorowała. Zmarła 25 marca 1951 r. Jej synowi, Andrzejowi do tej pory nie udało się odnaleźć grobu matki.

Abstract:
Artykuł podejmuje problematykę bezpośredniego stosowania przepisów Konstytucji RP. Główny nacisk został położony na weryfikację w jaki sposób na przestrzeni ostatnich kliku lat kształtował się mechanizm stosowania Konstytucji RP w polskiej praktyce orzeczniczej. Analiza zagadnienia bezpośredniego stosowania Konstytucji RP została dokonana w oparciu o aktualne orzecznictwo sądów i trybunałów polskich oraz międzynarodowych, z jednoczesnym wyodrębnieniem dwóch głównych obszarów tematycznych dotyczących odpowiednio: ustroju sądownictwa oraz ochrony konstytucyjnych wolności i praw człowieka oraz obywatela. W pierwszej części artykułu rozważania oscylują wokół zagadnienia zmiany ustroju sądownictwa, w kształcie nadanym uchwaloną w 2017 r. ustawą o Krajowej Radzie Sądownictwa. Zmiana ta przyczyniła się do stopniowego wzrostu zainteresowania sądów i trybunałów mechanizmem bezpośredniego stosowania Konstytucji RP w sprawach o charakterze instytucjonalnym, dotyczących tak ważnych w demokratycznym państwie prawnym kwestii, jak niezależność sądów, czy niezawisłość i bezstronność sędziów. W drugiej części opracowania problematyka bezpośredniego stosowania Konstytucji RP została skonfrontowana ze stosunkowo rzadko identyfikowanym w praktyce orzeczniczej wykorzystywaniem tej instytucji w sprawach dotyczących ochrony konstytucyjnych wolności i praw człowieka oraz obywatela. Znaczącym tego przykładem jest niewielki dorobek orzeczniczy sądów powszechnych i administracyjnych w zakresie omawianego zagadnienia. Artykuł ten prowadzi do wniosku, że na przestrzeni ostatnich kilku lat dochodzi co prawda do wzmożonego, lecz nie równomiernego zainteresowania judykatury bezpośrednim stosowaniem Konstytucji RP. Jednocześnie aktualne pozostaje pytanie, czy stosunkowo marginalne traktowanie bezpośredniego stosowania konstytucji przez sądy, nie sprzyja postrzeganiu tej instytucji jako stanowiącej tylko erudycyjny argument wykorzystywany w związku z bezpośrednim przedmiotem rozpoznawanej sprawy. The article explores the issue of direct application of the Constitution of the Republic of Poland. The main emphasis is placed on the verification of how the mechanism of direct application of the Constitution has evolved over the last few years in the Polish jurisprudence. The analysis of direct application of the Constitution has been made on the basis of the recent jurisprudence of Polish and international courts and tribunals. At the same time two main thematic areas have been distinguished concerning respectively: the judicial system and the protection of constitutional freedoms and rights of a human being and a citizen. The first part of the article revolves around the issue of the change in the judicial system in the form given by the Act on the National Council of the Judiciary passed in 2017. That change contributed to a gradual increase in the interest of courts and tribunals in the mechanism of direct application of the Constitution in cases of institutional character, concerning such important issues in a democratic state of law as the independence of courts or the independence and impartiality of judges. The second part of the paper confronts the problem of direct application of the Constitution with using this institution in cases concerning the protection of constitutional freedoms and rights, relatively rarely identified in the jurisprudential practice. A remarkable example thereof is the sparse judicial decisions of common and administrative courts in the scope of the issue at stake. Finally, the article concludes that over the last few years there was an increased, but not equal, level of interest in the direct application of the Constitution. At the same time, the question remains whether courts’ relatively marginal approach to the direct application of the Constitution means that it is an institution constituting only an erudite argument used in connection with the direct subject matter of the case considered by the court.

The article presents their conspiracy activity during the Second World War and their post-war experiences: interrogations, imprisonment, numerous relocations, and problems with finding employment.

Księża katoliccy narodowości polskiej i niemieckiej – Johannes Wohlert, Józef Dydymski i Józef Waląg – w latach 1933–1989 pełnili posługę duszpasterską w Pruszczu (Gdańskim) w trudnej rzeczywistości dwóch totalitaryzmów – narodowosocjalistycznego i komunistycznego. Każdy z duchownych, w innych okolicznościach, miejscu i czasie, doświadczył szykan i represji będących skutkiem niezależnej postawy wobec oficjalnej wykładni proponowanej przez oba totalitaryzmy. Ksiądz Johannes Wohlert miał odwagę otwarcie wystąpić przeciw hitlerowskiej ideologii. Po wojnie, decyzją komunistycznych władz, został deportowany z Polski Ludowej. Ksiądz Józef Dydymski bronił polskości na terenie Wolnego Miasta Gdańska, za co w konsekwencji został ukarany podwójnie – bezpośrednio przez nazistowskie i pośrednio przez komunistyczne władze. Ksiądz Józef Waląg, jako kapelan Armii Krajowej, a później Zrzeszenia „Wolność i Niezawisłość”, także rzucił wyzwanie dwóm totalitaryzmom. Ze względu na swoją wojenną i powojenną niepodległościową aktywność niemal do końca PRL pozostawał pod obserwacją komunistycznych służb.

Abstract:
The purpose of this article is to analyze the child's right to freedom of thought, conscience and religion guaranteed by the Convention on the Rights of the Child, in the background of the parental authority. This topic in Poland is ambiguous. Poland has ratified the Convention on the Rights of the Child with reservations and declarations. The declarations concerned on the rules on children's religious freedom. According to Poland, the exercise of these rights "is performed with respect for parental authority, in accordance with Polish customs and traditions, concerning the place of the child within and outside the family". Moreover, there is a certain gap between Polish Family Law and the provisions of the Convention. The Polish legislator places emphasis on the right of parents to raise children in accordance with their own beliefs, while the provisions of the Convention prioritize the child's autonomy. An additional problem in this matter is also the lack of detailed national regulations that would guarantee religious freedom for children, and also ensure the possibility of exercising these rights in practice. The legislator did not include any practical guidelines on how the child's religious freedom should be exercised and how to determine the moment when the child will be mature enough to take advantage of these guarantees. The basic research method that I used was the analysis of legal acts. I also relied on monographs and collective works devoted to family law. Due to the specific nature of the subject, Poland lacks case law of common courts on this subject.

<p>Artykuł porusza problem stosunku kierownictwa Delegatury Sił Zbrojnych oraz I Zarządu Głównego WiN do lokalnego porozumienia zawartego między polskim poakowskim podziemiem a ukraińskim (OUN-B, UPA) podczas spotkania przedstawicieli obu stron, 21 maja 1945 r., w okolicach Rudy Różanieckiej. Bez wątpienia zawarte wówczas zawieszenie broni obejmujące obszar południowo-wschodniej Lubelszczyzny i rozszerzone następnie na teren Podlasia przyczyniło się do zaprzestania trwających od wiosny 1944 r. walk polsko-ukraińskich. Autorka wykorzystując nieznane do tej pory dokumenty pokazuje, że wbrew temu co niejednokrotnie pisali świadkowie tamtych wydarzeń, zostało one zaakceptowane przez kierownictwo DSZ w formie lokalnego paktu o nieagresji. Przywódcy polskiej konspiracji od początku godzili się na zawieszenie broni, choć jednocześnie nie chcieli zawierania umów i nie widzieli możliwości bliższej współpracy i współdziałania z OUN-UPA czy reprezentowania sprawy ukraińskiej na forum międzynarodowym. Powstanie zaś Zrzeszenia Wolność i Niezawisłość, które proponowało cywilny model konspiracji i odcinało się od zwierzchnictwa Rządu na Uchodźstwie, przyczyniło się do tego, że strona ukraińska jak i polska były coraz mniej zainteresowane współpracą.</p>

Abstract:
In the article the linguistic image of the terms “homeland”, “nation” and “freedom” in Jacek Kaczmarski’s songs has been analysed. The image of these values in the poet’s texts reflects his attitude to the communist homeland, as well as to the country, which has changed as a result of democratic transformations. The disappointment with the home country, nation living there and questionable freedom are expressed in Jacek Kaczmarski’ engaged poetry through characteristic words or expressions. The analysis of the linguistic image of the world consists in capturing lexemes and phrases being an interpretation of an average language user. This a tool for cognitive linguistics research. It has helped to demonstrate the poet’s negative opinion about the homeland, nation and freedom. The image of these values left by Jacek Kaczmarski dispels the myth of “the bard of Solidarity” which accompanied the poet from the beginning of his career. Captivity is shown by means of lexemes connected with dog’s life: kennel, chain, belonging to a certain group of people (we) in which the uniqueness of an entity disappears, as well as the fact that freedom needs guards. The homeland described by the poet is red, that is communist. According to the lyrical subject appearing in Jacek Kaczmarski’s songs, Poland is an illegitimate child of Versailles or gentry’s private patrimony. As regards nation, it has been divided for centuries as can be seen from the division of Polish people by axis they-we which was used by the poet. The soldier of Armia Krajowa [the Home Army] is not able to trust the representative of Armia Ludowa [the People’s Army] in spite of the fact that they have the same enemy. Jacek Kaczmarski also presents the megalomania of Sarmatians who describe other nations with pejorative and stereotypical expressions. The linguistic image of the world as a set of subjective judgements about the world is a linguistic interpretation of understanding words or sentences by an average language user. Studying the image of the world created by poets is useful in an analysis of social concerns of a given epoch, as well as in the interpretation of individual linguistic signs, which is necessary in cognitive research into language.
