Abstract:
The idea that a police officer can park in a low-income neighborhood, pull someone over because of their race, frisk everyone in the car, let them go if their pockets are empty, and do the whole thing over and over again until the officer finds something illegal seems deeply upsetting and violative, to say the least. And yet, pretextual traffic stops are constitutional per a unanimous Supreme Court in Whren v. United States, 517 U.S. 806 (1996), as is seizing obvious contraband during a frisk per Minnesota v. Dickerson, 508 U.S. 366 (1993). In the thirty years since these cases were decided, their disproportionate impact on minority communities has become clear, and yet courts have struggled to place meaningful limits on officer discretion. Amid the growing national conversation on police practices, this Note analyzes the role of Dickerson’s plain feel doctrine, which permits an officer to seize contraband during a frisk so long as the illicit nature of the item is immediately apparent upon “plain feel.” First, it reviews the doctrine as it was established in Dickerson and traces its roots to understand the rationale behind the ruling. Second, it identifies the key factors state and federal courts consider when applying Dickerson and demonstrates that courts presented with similar facts routinely come to conflicting conclusions. Third, this Note assesses the ways modern plain feel doctrine is in tension with core Fourth Amendment principles and argues that, in the thirty years since Dickerson, it has quietly become an ever-broadening loophole enabling the ongoing targeting of minority populations. As calls to address inequitable policing grow louder, the plain feel doctrine is a crucial site for reform.

The subject of this Article is people who have been civilly committed under a state's parens patriae authority to care for those who are unable to care for themselves. These are people who, because of a mental illness, are a danger to themselves. Even after they have been determined to be so disabled by their mental illness that they cannot care for themselves, many are nonetheless found to be competent to refuse medical treatment. Competency to make medical treatment decisions generally requires only a capacity to understand a proposed treatment, not an actual or rational understanding of that treatment. This Article proposes that in cases of parens patriae civil commitments, an actual or rational understanding should be required. A test of competency that requires actual or rational understanding of a proposed treatment is needed in these cases given the lack of insight commonly experienced by people with psychotic disorders, the potential of psychotic symptoms to interfere with rational decision-making, and the immense harms-both immediate and long-term-that can result from untreated psychotic symptoms.

Each year, thousands of children become wards of the state when a court terminates the legal rights of their parents. Between 2010 and 2014, more than 307,000 children lost their legal relationships to their parents in Termination of Parental Rights (TPR) proceedings. A growing percentage of child welfare cases involve older children. At the same time, too many young people lose their legal relationships with their parents without a family waiting to adopt them. The stakes are high for children in TPR cases; nonetheless, many children—even older children—cannot meaningfully participate in proceedings. Moreover, TPR cases threaten parents’ and children’s rights to familial association. Nonetheless, courts have struggled with how to incorporate the perspectives of older children in TPR cases. Children infrequently attend court proceedings, and the court may receive competing narratives regarding the child’s position. Children are not always represented by lawyers in TPR proceedings, and when they do have legal representation, it may only be by a guardian ad litem (GAL) who presents her position on what is in the child’s best interests, rather than advocating for what the child actually wants. This Article explores how courts should address an older child’s objection to TPR and ensure meaningful consideration of the child’s perspective. A small minority of states give courts the discretion to decline to terminate parental rights when an older child objects to termination. In states with such an exception, how should courts handle older children’s perspectives? What is the proper weight to give an objection? How should courts decide whether to terminate parental rights when an older child objects? This Article addresses these questions in three parts. First, the Article describes the state statutes that create exceptions to TPR when an older child objects and analyzes the case law relating to those exceptions. Second, the Article outlines why consideration of a child’s objection makes sense from legal and social work perspectives, especially in light of our current understanding of child development and legal decision-making in other contexts. Finally, the Article argues that states should adopt a hybrid version of the objections to termination currently in place in Virginia and Iowa. It also considers concerns of practical implementation.

This Note argues that courts should interpret 28 U.S.C. § 1441, which permits removal from state court to federal court, to allow removal from state administrative agencies when the agency performs “court-like functions.” Circuits that apply a literal interpretation of the statute and forbid removal from state agencies should adopt this “functional” approach. The functional approach, which this Note calls the McCullion-Floeter test, should be modified to comport with legislative intent and public policy considerations: first, state agency adjudications should not be removable when the adjudication requires technical expertise, which federal courts cannot obtain because they adjudicate cases in a variety of subject areas; second, they should not be removable where an agency’s authorizing statute demonstrates a clear legislative intent to prefer plaintiffs. Absent either of these features, however, court-like agency adjudications should be removable.

This Article explores the intersection of race and disability in the context of employment discrimination, arguing that people of color with disabilities can and should obtain more robust relief for their harms by asserting intersectional discrimination claims. Professor Kimberlé Crenshaw first articulated the intersectionality framework by explaining that Black women can experience a form of discrimination distinct from that experienced by White women or Black men, that is, they may face discrimination as Black women due to the intersection of their race and gender. Likewise, people of color with disabilities can experience discrimination distinct from that felt by people of color without disabilities or by White people with disabilities due to the intersection of their race and disability. Yet often our legal and cultural institutions have been reluctant to acknowledge the intersectional experience, preferring instead to understand people by a singular trait like their race, gender, or disability. While courts have recognized the validity of intersectional discrimination claims, they have offered little guidance on how to articulate and prove the claims, leaving compound and complex forms of discrimination unaddressed. This Article thus offers an analysis of how courts and litigants should evaluate claims of workplace discrimination based on the intersection of race and disability, highlighting in particular the experience of Black disabled individuals. Only by fully embracing intersectionality analysis can we realize the potential of antidiscrimination law to remedy the harms of those most at risk of being denied equal opportunity.

If a virtual-world-game character is cast upon real-world property without the consent of the landowner, inducing or encouraging players to trespass, is the virtual-world creator liable for damages? The United States Supreme Court has recognized that digital technology presents novel issues, the resolution of which must anticipate its further rapid development. It is beyond dispute that protective legislation will be unable to keep up with rapidly evolving technology. The burden of anticipating and addressing issues presented by emerging technologies will ultimately fall upon the businesses responsible for generating them. This duty was most notably adopted by the creators of Pokémon Go in settlement of nuisance and trespass claims brought by a nationwide class seeking injunctive relief from the placement of virtual Pokéstops and Pokémon Gyms (“Gyms”) on real property. This article is the first to address this landmark settlement and proposes that future developers and creators seeking to avoid similar liability exposure implement self-regulatory practices, such as Value Sensitive Design, to create human values-based frameworks within which they can create and advance technologies. The societal need and social impact of such self-regulation is clearly illustrated by emerging litigation seeking to hold virtual-world actors responsible for real-world consequences utilizing common law tort theories. In the absence of legislation, as case law develops, self-regulatory frameworks like Value Sensitive Design are essential to create constructs within which creators can develop technologies that consider human values, address civic concerns, and avoid lawsuits, while still achieving commercial and technological objectives.

Extrassístoles ventriculares são um achado frequente na prática cardiológica. Quando ocorrem em corações normais, habitualmente têm uma evolução benigna, no entanto, sua presença em corações com cardiopatia estrutural pode estar associada a risco aumentado de morte súbita. Avaliar a presença de sintomas e a densidade da arritmia é uma etapa fundamental no seguimento desses pacientes. Em suas apresentações mais graves, podem resultar em disfunção ventricular e insuficiência cardíaca. A presença de múltiplas morfologias sugere um pior prognóstico. O tratamento farmacológico apresenta resposta limitada em muitos pacientes. A ablação por cateter das arritmias ventriculares é uma área em rápido crescimento dentro da eletrofisiologia, e técnicas modernas de mapeamento e ablação podem resultar na cura dessa arritmia em mais de 90% dos casos, a depender da sua localização e da experiência do intervencionista. Abordaremos nessa revisão aspectos de relevância clínica ao cardiologista e como a ablação por cateter pode se estabelecer como a primeira linha de tratamento desses pacientes quando bem indicada, compreendendo suas limitações e potenciais no tratamento definitivo dessa condição clínica

Abstract:
This paper examines whether there are multiple explosive bubble episodes in international food market by employing the Generalised Supremum Augmented Dickey-Fuller (GSADF) test. This method is particularly suitable for practical application of time series and provides an innovative consistent date-stamping strategy for the origination and termination of bubble episodes. Our results show that there are four explosive bubble episodes mostly accompanied by huge price volatilities during 1990–2017, which is largely in line with the asset pricing model (Gürkaynak 2008). The exuberance and collapse of bubble episodes can be explained by imbalance between supply and demand, depreciation of U.S. dollar, financial crisis and speculation. Our findings also provide supporting evidence for the Masters hypothesis that tremendous buying pressure from index investments contributes to substantial bubble episodes. The authorities should accurately identify bubble episode and monitor its evolving process, which is propitious to achieve the effective stabilisation of global food system. Particularly, restrictions on excessive speculative trading should be arranged under extreme market situations in order to forestall the explosion of multiple food bubbles.

En los últimos años, el uso de la Inteligencia Artificial (IA) ha supuesto cambios muy significativos en distintos ámbitos de la vida de los seres humanos. La medicina es uno de esos sectores donde más han repercutido dichos cambios. El objeto del presente trabajo es el análisis de herramientas basadas en eHealth y neurorobótica que pueden reducir la carga de trabajo humano y contribuir a una mejor gestión de la salud pública, considerando determinados problemas ético-jurídicos que deben ser tenidos en consideración. En este sentido, se lleva a cabo un estudio sobre la cuestión de la responsabilidad en caso de daños causados por el uso de sistemas de IA a través de determinadas herramientas de soft law, llevadas a cabo por el legislador europeo. A este respecto, se analiza, la nueva propuesta de Directiva COM (2022) 496 final del Parlamento Europeo y del Consejo, relativa a la adaptación de las normas de responsabilidad civil extracontractual a la IA (Directiva sobre responsabilidad en materia de IA), por considerar que puede dar lugar a innovaciones muy significativas.

‚Dear health services researchers, we have finally achieved what we have been working for.‘ With these enthusiastic words, Prof Dr Wolfgang Hoffmann, Chairman of the German Network for Health Services Research (DNVF), opened the 22nd DKVF, which took place at the Urania in Berlin at the beginning of October. The reason for his delight was the fact that - Hoffmann continued - the Innovation Committee recommends the transfer to standard care for 17 projects from the first and second funding waves of the new forms of care, but above all that the results of care research - including those of the ‚WiZen‘ innovation fund project, which was able to demonstrate the superiority of initial therapy in the primary treatment of cancer patients in certified centres - form an evidence base for the recommendations of the government commission for hospital reform. However, this is also precisely what the DNVF Chairman reminded the research community gathered at the German Congress for Health Services Research. Since health services research is now systemically relevant, this not only entails growing responsibility, but also has serious consequences: ‚Health services research now has critics.‘ Because, according to Hoffmann: ‚Our results, recommendations and priorities are now more likely to have consequences, they affect care providers, shift the balance of power and change financial flows.‘

En Chile, las comunidades indígenas han señalado a los museos antropológicos y arqueológicos como lugares que conservan la memoria de la colonización occidental. Estos señalamientos acrecientan una crisis de representación y han impulsado procesos de descolonización ideológica en estos espacios. En el marco de las funciones básicas del museo, algunas instituciones han explorado nuevos modelos museológicos y han cuestionado sus políticas de adquisiciones; la forma en que la investigación, la comunicación y la exhibición, eran abordadas dentro de sus establecimientos. Sin embargo, conservar ha sido la función menos debatida, porque preservar las colecciones para asegurar su transmisión a futuras generaciones parece un acuerdo inamovible. Mediante la exposición de tres casos de interés indígena, este artículo problematiza la conservación y señala cómo esta disciplina se rige por concepciones eurocéntricas que resaltan la dimensión material de las colecciones sin dar cabida a epistemologías indígenas donde, generalmente, materia y espíritu no están escindidos. _____ In Chile, indigenous communities have identified anthropological and archaeological museums as places that preserve the memory of Western colonization. These accusations exacerbate the crisis of representation and have driven processes of ideological decolonization in these spaces. Within the framework of the basic functions of a museum, some institutions have explored new museological models and have questioned their procurement policies; the way in which research, communication and exhibitions were approached within their establishments. However, conservation has been the least debated function, because preserving collections to ensure their transmission to future generations seems an immovable agreement. Through the exposition of three cases of indigenous interest, this article questions conservation and highlights how the discipline is governed by Eurocentric conceptions that emphasize the material dimension of collections without allowing for indigenous epistemologies where, in general, matter and spirit are not separated.

Abstract:
Цель исследования – изучение формирования техногенного ландшафта при добыче россыпного месторождения золота в бассейне р. Колоромо Северо-Енисейского района Красноярского края. Река Колоромо является правым притоком р. Чапа. Рельеф района месторождения среднегорный, интенсивно расчлененный с абсолютными отметками водоразделов от 350 до 982 м – г. Гаревский Полкан и относительными превышениями водоразделов над поймами рек 150–400 м. Все хребты и реки вытянуты в северо-западном направлении. Долина р. Колоромо асимметрична, на правом крутом борту широко развиты осыпи, курумы, а на левом пологом – широкие террасо-увалы, перекрытые делювиальными шлейфами мощностью 2–8 м. Ширина долины колеблется от 120 до 650 м, ширина русла реки 3–10 м, характерно быстрое течение, большое количество перекатов, шивер. Глубина плесов составляет 0,5–1 м. При анализе состояния техногенной территории был использован картографический подход, маршрутные полевые исследования. Представлены результаты исследования формирования техногенных ландшафтов. При отработке россыпных месторождений происходят значительные нарушения естественных территорий в границах нарушаемых участков, сопровождающиеся коренными изменениями ландшафтов по пространственной структуре, и их литогенной основы. Территории, нарушенные разработками месторождений россыпного золота, представлены карьерными выемками (выработанное пространство), траншеями, отвалами вскрышных пород, отвалами промывки, технологическими водоемами, руслами водотоков (руслоотводами). Естественные речные долины преобразуются в техногенные грядовые озерно-речные комплексы. Согласно структурным изменениям, происходящим при добычных работах, техногенные территории подразделяются на несколько участков: русло водотока (руслоотвод), выработанное пространство, пруды-отстой-ники, отвалы вскрышных пород, отвалы промывки. При отработке месторождения в бассейне р. Колоромо размещение отвалов вскрышных пород производилось на бортах карьерной выемки. При разработке россыпных месторождений золота происходит изменение ландшафта, которое зависит от применяемой технологии разработки месторождений и приводит к образованию техногенных ландшафтов. Предприятия, нарушившие естественную структуру агроландшафта, должны предусмотреть мероприятия по сельскохозяйственной или лесохозяйственной рекультивации.

Abstract:
Background: Pott’s disease is a rare form of extrapulmonary tuberculosis that manifests in a variety of clinical patterns. Delays in diagnosis and treatment can lead to serious complications. About 10-40% of patients with spinal tuberculosis may have a neurological deficit. Urgent measures are needed to halt the progression of the disease and deformity, especially to prevent and overcome paraplegia. In regards to management, every case is different and has a unique procedure. It includes simple medical management, simple decompression and debridement, anterior approach, and posterior approach, etc. Surgical decompression of the cord and instrumentation are needed in many cases besides chemotherapy. Although the anterior approach is used for cervical Pott’s disease but this procedure is very time-consuming and technically difficult in the lumbar and dorsal spine, especially in compromised patients and morbidity is more. The posterior approach alone is enough for achieving adequate decompression, debridement, reduction, fusion, reconstruction of the body, and maintaining sagittal alignment in the dorsal and lumbar Pott’s spine. The aim of the study was to describe the treatment modality and observe the outcome of treatment methods and incidence rate of infection sites among the patients of Potts spine. Material & Methods: This retrospective study was conducted at the Department of Neurosurgery, Bangabandhu Sheikh Mujib Medical University, Bangladesh. The study duration was 7 years, from March 2016 to January 2023. During this period, a total of 30 cases of Pott’s disease were included in the study following inclusion and exclusion criteria. Results: 53.33% had been from the youngest age group of 15-34 years, and 80 % were male. Very few participants had been female in the present study. Back pain was the primary complication for 50% of cases, while spinal infection was observed in the cervical region for 16.67% of cases, 43.33% had infections in the dorsal region, and 30 % in the lumbar region. 10.00% of the participants had been treated with non-surgical methods, with only anti-TB medication for 18 months or more. Posterior decompression was the most common treatment method, with 23.33% having only posterior decompression, and 40.00% having posterior decompression with the use of additional instruments. Conclusion: The study observed that Pott’s disease was most common among young adult males, and the most common sites of spinal infections were in the dorsal and lumbar regions in the present study population, contradictory to the general findings. Decompression treatment, with and without additional instruments, was the most common form of treatment among the present study population.

After 1989, there were significant changes in food consumption, both in volumes and structure. These changes happened due to various factors. The most important factors with influence on demand and food consumption were: development of income levels of Czech inhabitants, development of consumer prices of food and non-food products and services, offer and availability of products on the market, advertising and promotion, health education, joining the EU. Besides the above mentioned factors, an impact on consumption also have such factors as quality development, extent of self-provision with food products, or the degree to which the needs are satisfied. The fundamental influence on consumption has the development of consumer prices of food and capital goods and services in relations to development of incomes, thus buying power. In the last few years, there was a visible tendency to decreasing influence of prices on food consumption. The paper focuses on the development of consumption and changes in consumption patterns, motivation and attitudes. Presented data are based on the marketing research conducted by the Department of Marketing and Trade, Mendel University in Brno, in fall 2004.

Diabetes and heart failure are mutually reinforcing factors. The treatment strategy and prognosis for patients with both diabetes and heart failure are inconclusive. This article reviews the current situation of ischemic heart failure complicated with diabetes, the pathophysiological relationship between diabetes and heart failure, and disease management. Especially, we highlight the latest result from CRISIS (Coronary Revascularization in Patients with Ischemic Heart Failure and Prevention of Sudden Cardiac Death) study, which finds that diabetes associates with greater ejection fraction improvement after revascularization in patients with reduced ejection fraction. This result implies the indication for revascularization in patients with heart failure who present with DM.

Introduction: A diaphragmatic hernia is a condition characterized by herniation of the abdominal content(s) via a defect in the diaphragm. It may be congenital or may be preceded by a history of trauma. Case Series: Here we report two cases whose diaphragmatic hernias were detected on evaluation of a difficult gastroscopy. Both cases were those of young males who presented with non-specific gastrointestinal (GI) symptoms which warranted further evaluation with upper GI endoscopy and imaging. The first patient had a history of abdominal trauma during a road traffic accident. When scope negotiation proved to be difficult, they were both investigated and found to have displacement of the stomach within the mediastinum. Surgery was done followed by uneventful recovery in both patients. Conclusion: Diaphragmatic hernias do not always present in the background of typical settings and may be asymptomatic in many cases. However when any undue resistance is faced during endoscope negotiation, a high degree of clinical suspicion should be kept for any anatomical aberration—either congenital or acquired. This may ensure early detection and prevent life-threatening acute conditions as an acute gastric volvulus.

Purpose. Asthenopic symptoms mostly occur during demanding near-sighted tasks and are related to binocular symptoms (e. g. heterophoria), among others. Correction of symptomatic heterophoria with prismatic glasses is one way to treat the symptoms. This study investigates the effect of wearing a horizontal prismatic correction for 6 months. Material and Methods. A total of 87 subjects were assigned to a heterophoric prism group (N = 32), a heterophoric control group (N = 31) or an orthophoric control group (N = 24) according to their MCH heterophoria. In the heterophoric prism group, the subjects were prescribed glasses with a prismatic correction for 6 months according to their distance correction; in contrast, the subjects in the heterophoric control group had to wear glasses without prismatic correction for the same period. The effect of the prisms on complaints due to asthenopic symptoms was investigated by comparing the total sum obtained in the CISS questionnaire at the beginning of the study and after 6 months (before and after wearing glasses) for the 3 groups. Results. A (long-term) prism effect was not apparent in the CISS total score. In both the heterophoric prism group and in the heterophoric control group, the CISS total score increased slightly and non-significantly after 6 months. When considering the heterophoric subjects with an increased CISS score at baseline, a nevertheless slight but non-significant decrease of symptoms was observed. All changes were observed in both the heterophoric prism group and the heterophoric control group. An additional analysis using binocular profiles showed a reduction in symptoms by numbers and specifically for subjects with reduced vergence flexibility. Conclusion. Wearing an individual, horizontal prismatic correction had no effect on the overall CISS-score for our test subjects. Further methods that allow a systematic recording of symptoms and optometric parameters are probably necessary to observe an effect. Los proyectos seleccionados, The museum of gravity, de Krijn de Koning; Color Jam, de Jessica Stockholder; Rockaway, de Katharina Grosse y la intervención en la empresa Flax Art & Design de Heather Day, amplían la arquitectura intervenida posibilitando maneras diversas de experimentarla y percibirla. Para conseguir este fin, estas propuestas se materializan mediante composiciones abstractas (geométricas o gestuales-orgánicas) en las que el color detenta el máximo protagonismo, suponiendo un aporte adicio-nal a la tonalidad original del entorno arquitectónico sobre el que se aplica, generalmente neutra y sin ninguna función específica. Entre las principales conclusiones del estudio destaca la utilización del color en todas las propuestas por su valor intrínseco y por su capacidad para transformar la percepción de las propiedades formales de la arquitectura intervenida; la unión de pasado y presente en dos de ellas, al actuar sobre edificios en ruinas o abandonados; la reversibilidad o carácter efímero de la mayoría de los proyectos; el diálogo con el entorno; la aproximación al urbanismo táctico en diferentes sentidos y el alejamiento de un plantea-miento puramente decorativista.
