Abstract:
Although in Europe there continues to be a large degree of consensus that it is the responsibility of government to ensure that nobody who is poor, sick, disabled, unemployed or old is left deprived, there are mounting calls to roll back spending on the welfare state. Two main charges are raised: that it fails to achieve some of its main objectives, and that it is responsible for a decline in economic performance. Another charge is that it was conceived in a period very different from the present one and is not anymore adapted to the current realities. In this book, we intend to provide a balanced and informed analysis of these charges as well as some thoughts regarding the prospects of the welfare state in an increasingly integrated world. Written by two economists whose concern is both equity and efficiency, this book gives a set of answers to a number of important questions regarding the current social situation of European countries, the performance of the welfare states and the reforms that should be undertaken. It shows that the overall performance of the European welfare states as regarding its main objectives is satisfactory. There are differences across countries, with the Nordic countries leading the pack, but these differences seem to decrease. The book finally deals with an issue that is left unresolved and calls for some fundamental changes in social policies, namely the social divide that has been on the rise in Europe over the past decades and that hampers social cohesion.

Abstract:
This chapter discusses how the courts shaped protective policy from the 1890s to 1907. During this period, state and federal courts began a legal conversation about state protective laws. In court, challengers relied on the due process clause of the Fourteenth Amendment; they embraced freedom of contract and also cited the amendment's equal protection clause. Meanwhile, defenders gave wide latitude to the police power, the state's power to protect the health and welfare of its citizens. Throughout the era, the legal system imposed a discussion of gender. In cases that involved women workers, decisions that upset protective laws defended equal status for women. On the other hand, decision that upheld single-sex laws explored the role of sexual difference, mentioned women's reproductive capacity, and linked hours limits to the good of posterity and the welfare of society. Thereafter, judicial opinion steered states' attorneys—and the reformers who backed protective labor laws—into gender-based strategies.

This volume of essays addresses a wide range of issues in contemporary political philosophy, from the different branches of liberalism and their relation to capitalism, to the basic institutions of a liberal society that underwrite political and economic justice. Samuel Freeman is a leading political philosopher and one of the foremost authorities on the works of John Rawls. This volume contains nine of his essays on liberalism, Rawls, and distributive justice. Freeman organizes his chapters into a narrative arc: from liberalism as the dominant political and economic system in the Western world, to the laws governing interpersonal transactions in a liberal society, to the broad social and political structures that determine distributive justice. Freeman analyzes the primary differences between the classical and high liberal traditions; shows why libertarianism is not a liberal view; argues for the social rather than global bases of distributive justice; demonstrates why Rawls’s difference principle supports a property-owning democracy rather than welfare-state capitalism; and shows how Rawls’s liberal principles of justice and the difference principle are to be applied in both ideal and non-ideal circumstances, effectively responding to criticisms by Amartya Sen, G. A. Cohen, and others.
