Abstract:
As in much of Latin America, the Colombian president has historically been extremely powerful. The 1991 constitutional designers sought to achieve greater balance in the separation of powers, in part by weakening presidential power. This chapter considers the Court’s attempts to limit executive discretion and protect against excessive amalgamations of executive power. Even in areas where presidents have historically enjoyed almost plenary power, such as national security, the Court has attempted to place limits on presidential power. Most significant in this regard is the Court’s aggressive and successful jurisprudence limiting presidential use of states of exception. The Court has imposed jurisprudential criteria limiting states of exception to true and unexpected social and political crises, thus greatly reducing its historical role in day-to-day Colombian life and forcing political institutions to confront most problems under a situation of normality.

Abstract:
Chapter 2 presents the central research questions that drive the theoretical and empirical work of the book, outlines the “moments of social transformation” model used for analyzing human rights realization, and positions the book in relation to theoretical and contemporary policy debates. The chapter synthesizes the literatures on socioeconomic human rights fulfillment and the human right to water and sanitation. It introduces two key elements for implementing human rights: political will and state capacity, as well as some obstacles to rights realization, including lack of strong regulatory frameworks and accountability mechanisms. The chapter explores the tensions between markets and rights, finding that neoliberal approaches to water policy have a negative effect on rights fulfillment by weakening the state’s role, and it engages with critiques that the human rights frame is too narrow and vague to facilitate transformative change in the water sector.

Abstract:
Short Circuiting Policy examines clean energy policies to understand why US states are not on track to meet the climate crisis. After two decades of leadership, American states are slipping in their commitment to transition away from dirty fossil fuels toward cleaner energy sources, including wind and solar. The author argues that organized combat between advocate and opponent interest groups is central to explaining why US states have stopped expanding and even started weakening their renewable energy policies. Fossil fuel companies and electric utilities played a key role in spreading climate denial. Now, they have turned to climate delay, working to block clean energy policies from passing or being implemented and driving retrenchment. Clean energy advocates typically lack sufficient power to overcome electric utilities’ opposition to climate policy. Short Circuiting Policy builds on policy feedback theory, showing the conditions under which retrenchment is more likely. Depending on their relative political influence, interest groups will work to drive retrenchment either directly by working with legislators, their staff, and regulators or indirectly through the parties, the public, and the courts. Also, the likely effects of policies are not easy to predict—an effect termed “the fog of enactment.” But over time, federated interest groups can learn to anticipate policies’ consequences through networks that cross state lines. Examining US energy policy over the past century, and Texas’s, Kansas’s, Arizona’s, and Ohio’s clean energy laws in the twenty-first century, the author shows how opponents have thwarted progress on climate policy.

Abstract:
Globalization has opened up new avenues of investigation in many disciplines. Among these are political science and political sociology, where scholars have engaged in heated debates over issues such as the ways in which state sovereignty is changing, the role of new nonstate actors in shaping international social and political dynamics, and how globalization processes affecting patterns of social and political conflict. Scholars have extensively explored the impact of globalization on the nation-state. While some view the nation-state as increasingly constrained and weakening, others see it as the main actor in the international arena. Since the 1990s, the number of non-governmental organizations has grown significantly and increasing numbers are engaged in and form alliances with other civil society organizations across state borders. Some are engaged in long-term development work, others in humanitarian assistance, yet others focus primarily on advocacy. The extent of their influence and its consequences remain topics of often contentious debate within the literature. The debate on how globalization shapes conflict processes has also been contentious and deeply divisive. Some analysts view globalization processes as contributing to the emergence of new cultural and religious conflicts by challenging local cultural, religious, or moral codes, and imposing Western, secular, and materialistic values alien to indigenous ways of organizing social life. For others, the link between globalization processes and ethnic and cultural conflicts is at best indirect or simply nonexistent.
