ZusammenfassungDer Dermatovenerologe Samuel Jessner (1859–1929) erhielt im Jahr 1921 einen Lehrauftrag für „Sexuallehren“ an der Universität Königsberg (heute: russ Калининград, Kaliningrad). Im Reichsmedizinalkalender wurde er aber auch als Urologe geführt. Dieser Beitrag zeichnet seinen Lebensweg und sein Wirken nach und fragt, wie Jessner in der Peripherie der deutschen Sexualwissenschaft und ohne enge Anbindung an deren Netzwerke dieser akademische Erfolg gelingen konnte. Sein geringer Einfluss in der Forschung, seine fehlende Anbindung an eine „Schule“ der Sexualwissenschaft im deutschsprachigen Raum und seine jüdische Herkunft waren Faktoren, die sowohl die Wahrnehmung seiner Arbeit unter Zeitgenossen als auch das Vergessen seiner Tätigkeiten in der Geschichtsschreibung präformierten.

Abstract:

Cel badań: Artykuł miał na celu opisanie zewnętrznych i wewnętrznych warunków nauczania w odniesieniu do studentów prawa, akcentując, że na wymogi te wpływa dodatkowy warunek dotyczący specyfiki przedmiotu. Wymogi te zostały odniesione do odpowiednich metod nauczania. Metodologia: W artykule przyjęto metodę dogmatycznoprawną co do opisanych aktów prawnych oraz obserwowano kilka grup studentów prawa i studiowano literaturę pedagogiczną, a także wykonano analizę badania jakościowego czynników, budujących wysokie standardy nauczania z perspektywy studentów prawa. Wyniki: Do zewnętrznych warunków nauczania niepochodzących od studentów należą warunki wynikające ze specyfiki przedmiotu, z aktów prawnych dotyczących nauczania w ogólności i nauczania studentów prawa, ustanowione przez władze państwowe i władze wewnętrzne uczelni, a także polecenia przełożonych oraz reguły moralne. Do zewnętrznych warunków nauczania pochodzących od studentów natomiast należą wiedza, warunki psychiczne, w postaci nastawienia do przedmiotu i do nauczyciela, potrzeby wolności, bycia prowadzonym i akceptacji oraz motywacji, stresu, agresji, postaw osobowościowych a także chorób psychicznych, warunki fizyczne dotyczące możliwości pamięciowych, związanych z koncentracją, myśleniem, notowaniem, ze sposobem uczenia indywidualnego, warunki społeczne, rodzinne, zawodowe i kulturowe studentów. Wewnętrzne warunki zależą od samego nauczyciela i są lustrzanym odbiciem warunków zewnętrznych pochodzących od studentów. Wnioski: Uświadomienie warunków dotyczących nauczania studentów prawa wraz z odniesieniem do odpowiednich metod nauczania jest krokiem w kierunku idealnego nauczania i przeciwdziałania wypaleniu zawodowemu nauczycieli. Ponadto wszystkie te wymagania dotyczące nauczania wpływają na proces oceniania.

Abstract:

La professione religiosa, cioè il voto dei tre consigli evangelici: castità, povertà e obbedienza, è uno degli elementi essenziali della vita religiosa, a tal punto che senza di essa non si può parlare di vita religiosa. Oltre ad avere una grande rilevanza teologica, essa è un atto giuridico, costituito da vari elementi. Può, dunque, succedere che uno di essi non sarà adempiuto o sarà mancato, per cui i voti potranno essere considerati dubbi oppure invalidi. Il diritto universale della Chiesa definisce perciò le condizioni che garantiscono la validità degli atti emessi. Il Codice di Diritto Canonico del 1983 offre elementi che, al momento dell’emissione dei voti sia temporali che perpetui, sono richiesti per la loro validità. Il presente saggio considera le questioni relative alle condizioni richieste dalla Chiesa per una valida e lecita professione religiosa, nonchè le questioni concernenti la sua convalidazione, la scadenza del tempo per il quale fu emessa oppure l’eventuale dispensa da essa.

Abstract:

The research purpose was to determine the optimum fermentation time and SBM.3D LAB concentration on the physicochemical of modified Warumbia brown rice flour. This research uses a Completely Randomized Design with a factorial pattern consisting of two factors that are the length of fermentation and the concentration of LAB. The results showed that the interaction of the fermentation time treatment and SBM.3D LAB concentration had a significant effect on the characteristics of physicochemical properties of the viscosity and pH variables. However, it had no significant effect on the swelling power and water solubility index of the modified Warumbia brown rice flour. The best fermentation treatment was obtained at 48 hours of fermentation time with OD 0,75 of SBM.3D LAB concentration. The treatment had viscosity value of 25.00 cP, swelling power of 9.15 g/g, water solubility index of 31.73% and pH value of 6.10. The proximate content Warumbia brown rice flour are water content 8.37% wb, ash content 0.66% db, protein content 5.65% db and glucose content 16.57 % db. The results showed that the interaction between fermentation time and SBM.3D LAB concentration had a significant effect on increasing physicochemical properties and proximate content of the modified Warumbia brown rice flour.

Publikacja koncentruje uwagę wokół próby odpowiedzi na trzy zasadnicze pytania: 1) Czym jest odpowiedzialność i kiedy staje się trajektorią – prowadzącą w świat dobra? 2) Jakie warunki są niezbędne, aby taka odpowiedzialność zaistniała? 3) Jak jest rozumiane samo dobro i co kryje się w pojęciu szeroko rozumianego „świata dobra”? Odpowiadając na podstawie analizy reprezentatywnej literatury przedmiotowej, autorka przybliża samo pojęcie odpowiedzialności, jak i dobra oraz opisuje warunki niezbędne do ich zaistnienia. Wśród warunków niezbędnych do zaistnienia odpowiedzialności szczególne miejsce przypisuje integralnemu wychowaniu osoby.

Abstract:

Autor ujmuje literaturę ukraińską XX stulecia jako część historii literatury. Wskazuje na specyfikę tworzenia kanonu literackiego, a także analizuje przerwy w rozwoju literatury. Niekorzystne warunki społeczne spowodowały zaniedbanie tradycji. Kolonialne i totalitarne okoliczności przez długi czas spowalniały poszukiwanie właściwej formy i tylko w okresie niepodległości Ukrainy udało się zrekompensować straty z przeszłości. Przezwyciężając pęknięcia i kryzysy, literatura ukraińska wykazała się niezwykłą żywiołowością i odpornością. Pod koniec XX wieku stworzyło to warunki, aby osiągnąć nową jakość i ten proces trwa do dziś.

<p>W turystyce obecnie dominuje rynek nabywcy, zróżnicowane są potrzeby, motywacje i aktywność turystyczna, wzrasta samodzielność turystów w wyborze programów i ich realizacja, spada znaczenie pośredników, a usługi kupowane są bezpośrednio u producentów. Coraz częściej motywami podróży staje się czysta ciekawość i aktywny wypoczynek w czystym ekologicznie środowisku, wzrasta również świadomość zdrowotna wypoczywających osób. Preferuje się turystykę nieszkodliwą, która dąży do asymilacji z ludnością miejscową, wchodząc w interakcje, chroniąc tym samym to co najcenniejsze dla obszarów (koncepcja rozwoju zrównoważonego rozwoju turystyki).</p><p>Dolna Austria, która mimo, że jest wewnętrznie bardzo zróżnicowana pod względem atrakcyjności turystycznej i przydatności do uprawiania różnych form turystyki, stara się poprzez różnego rodzaju działania osiągnąć sukces na rynku turystycznym, zmieniając przy tym stereotyp turystycznego postrzegania Austrii jako państwa gór i dużych miast. Sukces ten może być osiągnięty tylko wówczas, gdy pomiędzy poszczególnymi jednostkami przestrzennymi, nawet najmniejszymi - przykładowo Eggenburg, istnieje współpraca w oparciu o spójną wizję rozwoju i przemyślana strategię, zgodną z szeroko pojętym zasadami zrównoważonego rozwoju, bazująca właśnie na regionalizacji produktów turystycznych.</p><p>Chcąc właściwie zarządzać turystyką, należy postawić sobie pewne cele i zadania. Dolna Austria, jest tego doskonałym przykładem, lata doświadczeń, obserwacji i analiz rynku turystycznego pozwoliły wyodrębnić w przestrzeni landu sześć regionów turystycznych, z których każdy ma odmienny charakter i daje szanse rozwoju różnych form turystyki.</p><p>Turystyka jest zjawiskiem tak dynamicznym i złożonym, że trudno małej jednostce wybić się na tym rynku, dlatego, aby osiągnąć zamierzony efekt należy się nawzajem wspierać i wspólnie kreować produkty turystyczne danego regionu.</p>

Międzynarodowa koprodukcja to coraz powszechniejszy sposób realizacji filmów. Szczególnie popularna jest w Europie, gdzie unijne programy od lat zachęcają kraje członkowskie do współpracy. Rozwój kinematografii narodowych w dużym stopniu zależy od efektywnego poszukiwania nowych źródeł finansowania oraz zdobywania zagranicznych rynków filmowych. Na tym polu toczy się także bój między największymi przemysłami filmowymi świata – hollywoodzkim i chińskim. By pokonać Amerykanów pod względem zysków ze światowej dystrybucji, Chińczycy musieliby zdominować rynki państw trzecich, przede wszystkim europejskie. Walka o widza toczy się na różnych obszarach, a jednym z nich jest koprodukcja, mająca na celu przede wszystkim spopularyzowanie chińskiej kultury, a jednocześnie dająca kinematografiom europejskim możliwość rozwoju i czerpania zysków z chińskiego rynku filmowego.

Abstract:

W artykule został przedstawiony Urząd Patentowy RP, jako organ, który ustawowo jest upoważniony do przyznawania zgłaszającym praw wyłącznych na przedmioty ochrony własności przemysłowej. Autor zaprezentował genezę i warunki, w jakich tworzono podstawy działalności Urzędu, jego organizacji i zadań. W dalszym ciągu omówiono rolę i zadania ekspertów UP, którzy zostali powołani do orzekania w sprawach własności przemysłowej. Jednocześnie przedstawiono warunki uzyskiwania kwalifikacji na stanowisko eksperta, ich naboru, szkolenia i uprawnień. Ważnym aspektem zadań Urzędu, oprócz postępowania zgłoszeniowego i rejestrowego, jest działalność kolegiów orzekających do spraw spornych, które rozstrzygają w sprawach istotnych dla wielu współczesnych przedsiębiorców.

Abstract:

Transformacja do Przemysłu 4.0, której wynikiem ma być nie tylko wzrost produktywności, lecz także poprawa warunków materialnego i psychospołecznego środowiska pracy, wymaga odpowiedniego zarządzania zmianą, a ta wiąże się z wprowadzaniem nowych technologii. Dzięki rozpoznaniu czynników wpływających na warunki środowiska pracy podczas transformacji można uwzględnić w procesie zarządzania zmianą dobre praktyki, skierowane na wzmocnienie pozytywnego i ograniczenie negatywnego wpływu tych czynników. W artykule przedstawiono czynniki o potencjalnym wpływie na warunki środowiska pracy w przedsiębiorstwach wdrażających technologie Przemysłu 4.0 i dobre praktyki, które można wykorzystać w procesie zarządzania zmianą w celu osiągnięcia poprawy warunków środowiska pracy.

Abstract:

Since the criminalization of the use of marijuana in Poland, introduced in 1985, various controversies and understatements have been taking place, as a result of which it was punishable to use this substance also for medical purposes. Th subject of the article is the analysis and assessment of administrative and legal solutions adopted by the legislator, in particular changes from November 1, 2017, formally permitting the legal marketing of marijuana as a pharmaceutical raw material, as well as its use in the treatment and alleviation of symptoms accompanying specific diseases. Th issues discussed were presented on the basis of European law, current legal regulations contained, among others, in the Pharmaceutical act of September 6, 2001, and in the act on counteracting Drug addiction of July 25, 2005, as well as regulations issued on their basis. In the final part of the article, de lege lata, proposals of factual and legal solutions are presented, aimed at actually facilitating the medical use of marijuana to patients.

Abstract:

<p>Oczekiwania społeczne wobec wychowawców placówek edukacyjnych są duże. Mają oni stworzyć uczniom maksymalnie dobre warunki rozwoju. Wychowawcy, niczym ogrodnicy, dbają o to, by podopieczni mogli doskonalić własne umiejętności poprzez zaba-wę. Prezentowane rozważania ukazują rolę nauczyciela w aktywizowaniu uczestników zajęć plastyczno-technicznych. Korzystając z założeń konstruktywizmu, w artykule wskazano nie-które możliwości wspierania podopiecznych w ich twórczych działaniach. Dokonano również przeglądu metod (projektów, niedokończonych rysunków, puzzli, improwizacji, swobodnej ekspresji), dzięki którym uczniowie w sposób samodzielny wykonują zadania, zdobywając kompetencje emancypacyjne. W podsumowaniu przedstawiono najważniejsze warunki sprzyjające aktywizacji i zachęcono nauczycieli do przyjęcia w codziennej pracy postawy refleksyjnej.</p>

"Das Rechtssystem geht davon aus, dass der Mensch – und nur der Mensch – eine natürliche Person ist. Das sei ein Irrtum, argumentiert Malte-Christian Gruber, denn die Rechtssubjektivität wird keineswegs alleine mit dem bloßen Menschsein begründet. Es ist die sittliche Autonomie, die den Menschen zu einem »Subjekt, dessen Handlungen einer Zurechnung fähig sind« (Kant) und mithin zur Person macht. Personen werden nicht mit dem Menschsein als solchem identifiziert, sondern durch die Zuschreibung von Handlungs- und Rechtsträgerschaft. Eine solche funktionale Vorstellung von Rechtssubjektivität ist prinzipiell auch dazu imstande, neben Menschen noch weitere autonome Agenten als Träger von Rechten und Pflichten ein- zusetzen, z.B. technische Artefakte und andere nicht-menschliche Agenten. Christoph Menke macht dagegen darauf aufmerksam, dass die Erfindung neuer Rechte das eigentliche Bewegungsgesetz der politischen Emanzipation in der Moderne war. Das begann mit den bürgerlichen Revolutionen und ist immer noch das generelle Modell, mit dem Politik und Theorie operieren, die neue Rechte für nicht-menschliche Lebewesen und Artefakte einfordern. So wie im 19. und 20. Jahrhundert die rechtliche Emanzipation zunächst über die Grenzen bürgerlicher Subjektivität hinausgeführt hat und soziale und kulturelle Rechte erfand, so sollen wir nun den weiteren, konsequenten Schritt tun und auch noch die Bindung der juridischen Anerkennung an die Kategorie menschlicher Subjektivität aufbrechen. Auch Bio- und Artefakte sollen als eigenständige Rechtssubjekte rekonstruiert werden. Es fehlt ihnen allerdings etwas, das in den emanzipatorischen Kämpfen der Vergangenheit schlechthin grundlegend war: Ein Träger von Rechten zu sein, hieß, ein Fordernder von Rechten, ja, ein Kämpfer für Rechte gewesen zu sein. Man konnte keine rechtliche Person als Träger von Rechten sein, ohne ein politisches Subjekt als Kämpfer und Denker von Rechten gewesen zu sein. Wenn die Bindung der rechtlichen Personalität an die menschliche Subjektivität aufgelöst wird, damit es Bio- und Artefakt-Rechte geben kann, löst sich zugleich auch diese Einheit von rechtlicher Personalität und politischer Subjektivität auf, die die moderne Idee der Rechte definiert hatte. The legal system assumes that human beings – and only human beings – are natural persons. That is erroneous, argues Malte-Christian Gruber, because legal subjectivity isn’t founded in humanity alone. It is moral autonomy that makes man into a “subject whose actions are capable of attribution” (Kant) and thus into a person. Personhood is not identified with being human as such, but by the attribution of actions and legal ownership. Besides human beings, such a functional concept of legal subjectivity can in principle also be applied to other autonomous agents as holder of rights and obligations, e.g. techno- logical artifacts and other non-human agents. Christoph Menke in turn points out that the invention of new rights was the actual law of motion of political emancipation in modern times. This began with the bourgeois revolutions and is still the general model with which politics and theory operate to claim new rights for non-human creatures and artifacts. Just as in the 19th and 20th centuries, the legal emancipation initially led beyond the limits of bourgeois subjectivity and in- vented social and cultural rights, so should we make a further consequent step and break with the dependence of juridical recognition on the category of human subjectivity. Also bio- and artifacts are to be reconstructed as independent legal entities. However, they lack something that was absolutely fundamental in the emancipatory struggles of the past: to be a subject of rights meant to have demanded rights, indeed, to have been a fighter for rights. One could not be a legal person and holder of rights without having been a political subject as fighter and thinker of rights. To suspend the dependence of legal personhood on human subjectivity so that there may be bio- and artifact-rights also means to dissolve the unity between legal personality and political subjectivity that once defined the modern idea of rights. "

Juli 2021 Jeff Bezos mit der New Shepard von Blue Origin erfolgreiche suborbitale Raumflüge absolvierten, liefen die Kommentarspalten der Medien heiß. Es war von „Milliardärsspielzeug“ und „galaktischen Größenwahn“ die Rede. Tatsächlich löste die Inszenierung dieser ersten kommerziellen Suborbitalflüge Abwehrreflexe aus, denn sie erscheinen als nur „Superreichen“ zugängliche elitäre und nutzlose Ressourcenverschwendung. Wagt man aber einen weiteren Blick, sieht die Sache ganz anders aus.

Zusammenfassung Die Systemtheorie gehört zu den Eigenwerten moderner Intellektualität, die die Bedingungen des Sich-selbst-Erzeugens und damit die Kontingenz ihrer Beobachtungen selbst noch reflektiert. Die frühe Systemtheorie mit ihrem Konzept umweltoffener Systeme hinterließ zunächst die unbeantwortete Frage, wie Systeme sich gegenüber ihrer Umwelt erhalten können. Diese Theorielücke wurde erst durch Kombination der Konzepte von Autopoiesis, operationaler Schließung und struktureller Kopplung selbstreferentieller Systeme geschlossen. Damit entdeckt die Systemtheorie zugleich ihre epistemologischen Konsequenzen, die sie ganz in die Nähe der Husserl’schen Phänomenologie des Bewusstseins führt und die es ihr ermöglicht, sich als autologischer Beobachter (in) der Gesellschaft zu begreifen. Für alle Weltbeschreibung kann dann keine privilegierte Position mehr behauptet werden, die Realität selbst erschließt sich nur noch auf der Ebene der Beobachtung von Beobachtern.
