This chapter focuses on two particular questions relating to the role of reputation and violence. The first is whether a reputation for past violence on the part of a state influences the onset ofnewviolence involving that state.This is the first stage of militarized conflict, the initiation of disputes. The second question is whether a reputation for escalating violence to full-blown war affects the likelihood that future disputes involving that state will be more likely to escalate to war as well. The results indicate that the hostile reputational histories increase the likelihood of conflict, and that conflict will escalate to war.

Abstract:
This chapter considers the relevance of international law within the U.S. legal system to the United States’ initiation and conduct of war. After briefly reviewing some of the most relevant treaties relating to war and warfare, the chapter considers the Constitution’s distribution of war authority between Congress and the President. It then discusses how international law, including the provisions in the UN Charter relating to the authority of the Security Council, as well as collective self-defense treaties, might affect the President’s war authority. The chapter then shifts to the “war on terrorism” and discusses the relevance of international law, including the Geneva Conventions, to issues concerning the scope of the military’s detention authority in that conflict, with particular reference to the Supreme Court’s 2004 decision in Hamdi v. Rumsfeld. International law and other issues relating to the use of military commissions to try terrorist suspects are also considered. The chapter concludes by discussing legal debates relating to coercive interrogation and targeted killing.

Abstract:
This book challenges traditional and contemporary just war theorizing, by taking seriously the role of social practices and institutions in decisions to go to war. It argues that which substantive moral principles regarding the initiation of war are valid can depend upon the institutional processes within which the decisions are made. Traditional and mainstream contemporary just war theorists proceed as if institutions don’t exist or as if existing institutional resources for influencing decision-making are so negligible that they may be disregarded. They fail to consider the possibility that institutional innovations could improve recourse to war decisions and that the fact that this is so has important implications for the morality of war-making. The first six chapters of the book lay out the case for institutionalizing the just war—for rethinking just war theory with due regard for the fact that institutional realities and possibilities shape the morality of war. The last two chapters advance concrete, feasible proposals for much-needed institutional innovation.

By late 1912 Britain’s naval leadership was sufficiently perturbed by the situation it faced to petition the government to address the issue of home defence afresh and to confirm the Army’s role therein. This precipitated a new CID inquiry into the issue, during which the two services reprised the decade-old debate over how best to conduct a future European war. The Admiralty was placed in a delicate position during the proceedings by Fisher’s absolutist rhetoric on the impossibility of invasion, but was obliged to extract some commitment from the government to retain regular troops in the country due to a growing acceptance that the Fleet could not prevent an invasion. This chapter traces this debate down to the outbreak of war, stressing the extent of its effect upon naval strategy.

Initiation procedures were determined by the need to maintain secrecy, and this led to repeated testing of new members, gradual admission, and gradual teaching of secrets. Annual reassessment was often performed within certain groups. The dynamic engendered by the secret knowledge begets the hierarchical structure. Both features are prominent in the Qumran community. In some cases, secrets and knowledge were kept by only a select handful of people or just one person. Details of hierarchies and different levels of ascension and knowledge are discussed. Similarities and differences in practices among the different groups are examined. We also look at the ancient texts and what they reveal about these groups.

Abstract:
Modern deterrence theories were conceived in the aftermath of World War I. Given the human and political carnage associated with the Great War, it was natural for historians, military strategists, policy analysts, diplomats, and politicians to try to understand why the breakdown occurred. The standard interpretation of the coming of World War I provided the intellectual foundation for classical deterrence theory and its variants. This article traces these developments in the literature of war and conflict initiation and evaluates recent theoretical, empirical, and policy challenges to mainstream realist theory. It summarizes two synergistic variants of the classical specification of deterrence and contrasts them with competing explanatory frameworks, then examines the empirical literature on deterrence, recent theoretical developments in deterrence theory, and debates about deterrence policies. It concludes with a discussion of how the study of deterrence fits into the study of international conflict more broadly.
