Abstract:
One of the foremost objections to theological voluntarism is the contingency objection. If God’s will fixes moral facts, then what if God willed that agents engage in cruelty? I argue that even unrestricted theological voluntarists should accept some logical constraints on possible moral systems—hence, some limits on ways that God could have willed morality to be—and these logical constraints are sufficient to blunt the force of the contingency objection. One constraint I defend is a very weak accessibility requirement, related to (but less problematic than) existence internalism in metaethics. The theological voluntarist can maintain: Godcouldn’t have loved cruelty, and even though he could have willed behaviors we find abhorrent, he could only have done so in a world of deeply alien moral agents. We cannot confidently declare such a world unacceptable.

AbstractTwo interpretations of Hobbes's theory of morals dominate the subject: the Egoistic Reading (ER) and the Naturalist Reading (NR). According to ER, all of Hobbes's moral concepts are self-interested at their core. According to NR, Hobbes's Laws of Nature set down genuine moral obligations/virtues both inside of the state of nature and out. This article rejects both of these interpretations in favor of a Voluntarist Reading (VR). On this reading, morality is an artifact of human endeavor, specifically covenanting. Unlike both ER and NR, VR takes seriously Hobbes's claim that there is “no obligation on any man which ariseth not from some act of his own”.

AbstractThere are three ideal types of revolutions: spontaneous, planned and negotiated. The role and importance of structural factors versus human agency vary according to the general category to which a particular revolution belongs. In spontaneous revolutions, both the transition and conslidation phases are heavily conditioned by prevailing structural factors, especially those that result in the weakening of ruling state institutions and the political mobilization of one or more social groups. By contrast, in planned revolutions self-declared revolutionaries take the lead in both mobilizing supporters and weakening the state, in fact often having a highly elaborate ideological—as well as tactical and strategic—blueprint for the acquisition and consolidation of power. Negotiated revolutions see the greatest coalescence of forces involving both structural developments and human agency. The seeds of the revolution have germinated, but the prevailing structural developments are not by themselves sufficient to bring about the revolution's success. Actors representing both state and society must step in to negotiate, and only then might the revolution succeed and be consolidated.

AbstractMany studies criticise John Duns Scotus (c. 1265–1308) for reducing the atoning sacrifice of Christ to a merit of finite worth and making its atoning power completely dependent on the accepting will of God, such that if it pleased God, even a purely creaturely sacrifice of an angel or a saint would have sufficed to redeem the elect. This article discredits this sort of criticism by demonstrating that Scotus situates his argument for a finite worth of Christ's merit within the framework of his larger argument for the infinite sufficiency of Christ's merit. A cogent examination of the ways in which Scotus posits a merit of finite intrinsic worth and arrives at its infinitely sufficient atoning power reveals that only the merit of a God-man can achieve this sort of sufficiency and that the nature of Scotus' voluntarism that underlies his concept of divine acceptation is nowhere as radical as it is usually portrayed.

Kant’s relation to Hobbesian voluntarism has recently become a source of controversy for the interpretation of Kant’s practical philosophy. Realist interpreters, most prominently Karl Ameriks, have attacked the genealogies of Kantian autonomy suggested by J. B. Schneewind and Christine Korsgaard as misleadingly voluntarist and unacceptably anti-realist. In this debate, however, there has been no real discussion of Kant’s own views about Hobbes. By examining the relation of Hobbes’ voluntarism to a kind of conventionalism, and through a reading of Kant’s most explicit discussion of Hobbes, in “Theory and Practice,”1 I argue that Kant’s criticism of Hobbes is much more limited than it might first appear. Rather than rejecting Hobbes’ voluntarism and conventionalism entirely, Kant ends up criticizing only Hobbes’ understanding of the relation between these doctrines. The essay thus defends Schneewind’s and Korsgaard’s histories of modern moral philosophy, and raises doubts about realist readings of Kant’s practical philosophy.

According to the view Rik Peels defends in Responsible Belief (2017), one is responsible for believing something only if that belief was the result of choices one made voluntarily, and for which one may be held responsible. Here, I argue against this voluntarist account of doxastic responsibility and in favor of the rationalist position that a person is responsible for her beliefs insofar as they are under the influence of her reason. In particular, I argue that the latter yields a more plausible account of the conditions under which ignorance may serve as an excuse for wrongdoing.

I take up the question of what argument, if any, Hobbes has for state legitimacy, which term I stipulatively use to mean the general, exclusive permission to enforce compliance with their directives or laws that states are standardly taken to have. I will argue that, contrary to what one might imagine, the ground of state legitimacy for Hobbes is not to be found in the social contract or the authorisation of the state’s subjects, but rather in the sovereign’s simply not being subject to the kind of laws that rule out enforcement for subjects. The sovereign’s right to enforce is based in exactly the same sort of right that all have when not subject to any higher sovereign power. Though this must be nuanced (the sovereign does not literally retain its right to all things from the state of nature, since no sovereign existed in the state of nature), the permissibility of enforcement for Hobbes is to be found simply in the lack of anything that might make it impermissible.

El propósito de esta memoria es tratar de dar una visión de conjunto a través de las distintas fuentes jurídicas y literales de la jurisdicción denominada voluntaria de diversas épocas. Como es sabido, continua siendo un tema polémico hasta nuestros días por cuanto no se ha podido determinar en forma indubitada cuál es el origen, contenido y naturaleza jurídica del instituto que nos ocupa. De la romanística han surgido distintas opiniones acerca de la naturaleza misma de la jurisdicción voluntaria: Por una parte, ha sido considerada como una verdadera actividad jurisdiccional ejercida por los magistrados competentes; desde otro punto de vista, se le ha atribuido un carácter administrativo y, finalmente también ha sido tratada como una actividad sustancialmente administrativa desarrollada bajo formas jurisdiccionales y se ha afirmado, asimismo, que la jurisdicción voluntaria se encuadraría en una zona limítrofe entre la función jurisdiccional y la función administrativa. Se ha propugnado también, por parte de la doctrina, su individualización como categoría o actividad autónoma – como tertius genus” entre administración y jurisdicción -, caracterizada por la circunstancia de actuarse una función pública sobre relaciones o intereses jurídicos privados. Incluso se ha llegado a afirmar, en la doctrina italiana, que la jurisdicción voluntaria tiene hoy un valor sólo convencional, y que no cabe hablar, en relación con los actos que se encuentran dentro de la misma, ni de jurisdicción ni de voluntariedad.

Abstract:
This thesis represents a body of work developed over 10 years in the areas of management learning, organizational politics, and change and organization democracy. It focuses on the role of hierarchy in balancing the need for strategic coherence with the ever burgeoning plurality of organizational life. In recent years, there has been a variety of academic discourses that have illuminated this debate. Often coming from different epistemological traditions, each makes a helpful contribution to the debate. However, I argue that none provides, nor in some cases is intended to provide, senior managers with robust and practical methods of re-conceptualising the role of hierarchy in organization. Based on this analysis, four key requirements for the development of theory in the area are suggested. Using these principles as a starting point, this thesis makes a contribution to knowledge in three interrelated areas. Firstly, by developing the concept of voluntarism, derived from the field of political philosophy, as an alternative organizational binding mechanism that alters the rationale for the role of hierarchy. Secondly, this concept is operationalised as a form of ‘representative’ leadership. Research data are provided which explore the behavioural dimensions and cognitive antecedents of this approach to leadership. The findings are suggestive of a democratic orientation toward leading and organizing, and on this basis, the third contribution focuses on how such leadership principles may be more widely adopted through the vehicle of management learning.

El aborto voluntario o consentido es un delito en Chile que se encuentra sancionado en el artículo 344 inciso primero de nuestro Código Penal. Esta política criminal, que data del año 1875, no contempla consideraciones de género, lo que conlleva una negación de derechos, de autonomía, de libertad y a violencia de género, vulnerando los derechos humanos de las mujeres. Esta modalidad de discriminación de género, condiciona a las mujeres que quieren interrumpir voluntariamente su embarazo, a optar por alternativas que se encuentran fuera del sistema institucional de salud. La presente tesis tuvo por objeto investigar ésta modalidad de aborto , de aborto voluntario, entendida como aquel acto que causa la mujer o consiente en que otro se lo cause con la finalidad de interrumpir un embarazo, en relación a su persecución penal estatal, a través del análisis de casos. Lo anterior a fin de proponer modificaciones legislativas que permitan a nuestro país acercarse a los estándares internacionales actualmente vigentes. Chile, El Salvador y Nicaragua, son tres de los cuatro países que prohíben el aborto en todas sus formas a nivel mundial, no permitiendo ni aún el aborto terapéutico, transformándose en una de las legislaciones más restrictivas sobre autodeterminación reproductiva en el mundo. Si bien en Chile hasta 1989 se permitía sólo el aborto terapéutico, hoy en día no es posible interrumpir el embarazo ni aún con esa causal como justificante. A pesar de esta prohibición penal absoluta, los procedimientos de interrupción voluntaria o consentida del embarazo se siguen practicando de todas formas en nuestro país. El abortar no es ajeno a ningún tipo de mujer, puede tratarse de mujeres acomodadas o de escasos recursos, pero son éstas últimas las que se ven enfrentadas al proceso penal y a mayores riesgos para su salud, puesto que deben recurrir a modalidades abortivas inseguras e insalubres, donde la única ayuda posible es el sistema público de salud, que sin embargo, paradojalmente, constituyen el origen de la persecución penal

Volunteer actions have been widely defended as important for many areas in development. In fact, the involvement of people in such actions is increasing. Nevertheless, it has been shown that the volunteer s commitment to the action that he engages in is usually very low. There is a tendency to abandon the action after a period of involvement. The present work seeks to examine the points identified as being of great relevance in volunteering issues, such as unconscious motivations that lead the subject to volunteer actions, the volunteer's low level of commitment, the consequences that can arrive from deviations from a truly altruistic direction and, finally, to discuss the cultural idealization of doing good . This research stems from my experience in a Volunteering Program in a corporate environment, and is based on Freudian texts and others by contemporary authors of psychoanalysis. The text itself is intended as a tool for the elaboration of what my psychoanalytic listening has produced in four years as supervisor of more than eighty volunteers in the program called Social Mentoring, emphasizing how their work evolved, from the point of view of the psychoanalytic supervision taking place there. Thus, this dissertation supports the possibility of the contribution of psychoanalytic knowledge to Volunteering actions
As ações voluntárias têm sido largamente defendidas como importantes para as mais diversas áreas em desenvolvimento. De fato, é crescente o engajamento de pessoas nessas ações. No entanto, tem sido evidenciado que a fidelização do voluntário à ação a que ele se engaja normalmente é muito baixa. Há uma tendência ao abandono da ação, após um período de envolvimento. O presente trabalho procurou analisar os pontos identificados como de grande relevância nas questões do voluntariado, como as motivações inconscientes que levam o sujeito às ações voluntárias, a baixa fidelização do voluntário, as conseqüências que podem advir dos extravios de uma direção verdadeiramente altruísta e, finalmente, problematizar a idealização cultural do fazer o bem . A pesquisa parte de minha experiência num Programa de Voluntariado no ambiente corporativo e se referencia no texto freudiano e de outros autores contemporâneos da psicanálise para o desenvolvimento da argumentação. O texto em si se propõe a ser um dispositivo de elaboração do que minha escuta psicanalítica tem produzido, em quatro anos como supervisora de mais de oitenta voluntários no programa de voluntariado Mentoring Social, destacando como foi se delineando o trabalho daquelas pessoas, a partir da inserção de uma supervisão psicanalítica. Dessa forma, a dissertação sustenta a possibilidade da contribuição do saber da psicanálise para as ações de Voluntariado

Divine voluntarism (Divine command theory) is a series of theories that claim that God is prior to moral obligation and that moral obligation is determined by God's will. Divine voluntarism has to be formulated in a way that it does not have undesirable implications, e.g., that moral obligation is arbitrary and that God's goodness is trivial. Also, while it avoids these undesirable implications, divine voluntarism must not imply that God is, in some way, restricted by moral obligation which exists independently of Him. Divine voluntarism can admit God's sovereignty over moral obligation and avoid making moral obligation arbitrary or God's goodness trivial by admitting various aspects of God's will. Moral obligation is relevant to both God's will for human moral obligation and God's will for human moral good. After all, God's will for human moral obligation is God's willing that His own will for human moral good constitute moral obligation for humans.

This thesis comparatively evaluates three groups of volunteers working within the criminal justice system in the South West of England. The groups chosen - probation Voluntary Associates, police Specials and Victims Support Scheme Volunteers - incorporate parties working with the offender, the public and the victim, ie those most closely identified with the judicial process. To date, research in both Britain and abroad has chosen to focus on a single agency which has limited our understanding of voluntarismo Nevertheless, most have identified a number of issues pertaining to the use of volunteers. Through a consideration of the type of work undertaken, motivations, who volunteers, recruitment, selection and training, and the role of the professional, this thesis attempts to link and examine these issues, to illustrate that it is possible to theorise about voluntary activity in a criminal justice context. Via interviews with 164 volunteers supported by extensive observation it has been possible to gain a more detailed insight into voluntary activity than had previously been contemplated. The findings revealed that within each organisation there. ý exists a volunteer sub-culture, (abbreviated to volunculture), which conforms to the ideology of the agency. Where a volunculture is strong, as in the case of the Specials then commitment is high; where a volunculture is weak commitment is likely to be low. The study moves on to consider the ways in which organisational policy can and does affect not only the formationof-a volunculture, _ but also its degree of strength or weakness. It is shown that presently most organisations pay lip service to the notion of using volunteers, reflected in the low status they are accorded within agency priorities. It is argued that until this is realised the wealth of helping potential that exists within communities can never be brought to the fore. Recommendations derived from volunteer perceptions and organisational policies are offered as pathfinders to achieving this objective.

This work addresses voluntary geographic information (VGI) as an information system that facilitates organizations to achieve specific goals by outsourcing processes and activities to an online community. A definition of a voluntary geographic information system (VGIS) is proposed, identifying its core components (Project, Participants, Technology), then, crowdsourcing, the most relevant process for managing information within these type of systems, is analysed. We analyse several types of crowdsourcing models in the context of VGIS, and it is proposed a classification built around the different ways of organizing a community, which include different levels of participation according to the use of three processes: contributory, collaborative and participatory. Based on the study of the different typologies intrinsically linked to the existing levels of involvement and engagement, and the use of participants' cognitive skills, a continuum of participation is identified, presenting two opposite tendencies when designing VGI projects: crowd-based and community-driven, the latter with higher levels of collaboration or even co-creation. Based on the above, it is proposed a set of criteria for the design of the crowdsourcing strategy of a VGIS, as a roadmap that directs the project. This design and planning tool helps to characterize and define in a simple way the general requirements of the processes and activities of a VGIS that will be implemented through a crowdsourcing task, being the first step in the interdependent design of the project, participation and technological components. The design of subsequent strategies related to the other components of the system must be aligned and linked to the crowdsourcing strategy, and altogether will guide the development of tasks, functionalities and the specific technological tools of the system.http://dx.doi.org/10.4995/CIGeo2017.2017.6629

This article presents the results of two in-vivo studies providing measurements of human static ankle mechanical impedance. Accurate measurements of ankle impedance when muscles were voluntarily activated were obtained using a therapeutic robot, Anklebot, and an electromyographic recording system. Important features of ankle impedance, and their variation with muscle activity, are discussed, including magnitude, symmetry and directions of minimum and maximum impedance. Voluntary muscle activation has a significant impact on ankle impedance, increasing it by up to a factor of three in our experiments. Furthermore, significant asymmetries and deviations from a linear two-spring model are present in many subjects, indicating that ankle impedance has a complex and individually idiosyncratic structure. We propose the use of Fourier series as a general representation, providing both insight and a precise quantitative characterization of human static ankle impedance.

Abstract:
Este trabajo analiza la capacidad de uso de los colchones de capital voluntarios y regulatorios por parte de las entidades bancarias, aprovechando la experiencia de la pandemia de COVID-19. En primer lugar, se encuentra que la usabilidad de los colchones macroprudenciales está muy poco limitada en España por otros requerimientos sobre las entidades. Adicionalmente, se encuentra que los colchones existentes sobre los requerimientos de capital al comienzo de la pandemia han tenido efectos significativos en los mercados financieros, lo que ha afectado a la evolución de las cotizaciones bancarias europeas, así como a las tenencias de acciones bancarias por parte de los fondos de inversión. Por último, no se observa un efecto agregado significativo del nivel disponible de colchones de capital sobre los requerimientos de capital en la provisión de financiación a las empresas no financieras en España. Sin embargo, sí se identifican efectos negativos en la oferta de crédito de los bancos con menores colchones voluntarios a las empresas con las que tenían relaciones más recientes. Asimismo, cuando el análisis se realiza exclusivamente sobre las operaciones crediticias sin garantía pública, sí se observa que las entidades con menor margen de capital por encima de los requerimientos redujeron más el crédito.

Las obras de infraestructura son esenciales para el desarrollo y crecimiento económico de un país, en especial, en países con una limitada red vial como Paraguay. Sin embargo, el desarrollo de estos proyectos podría suponer un impacto considerado a ciertos grupos vulnerables. En ese sentido, el desarrollo del programa PR-L1075 detectó el impacto que obras tendrían a ciertas comunidades indígenas de las zonas lo cual requirió el desarrollo de un proceso de reasentamiento, en cumplimiento con las políticas sociales del Banco Interamericano de Desarrollo. El objetivo de este documento es presentar la evaluación del proceso de reasentamiento realizado en el marco del programa PR-L1075. El Plan de reasentamiento voluntario de comunidades indígenas paraguayas, fue desarrollado en el marco de la Fase II del Programa Corredores de Integración, Rehabilitación y Mantenimiento Vial (PR-L1075), más específicamente, en el proyecto de pavimentación de la Ruta Nacional N13. Este Plan tuvo como propósito mejorar la calidad de vida de las familias indígenas en el marco de la mitigación de impactos del mencionado Programa. Las comunidades indígenas con las cuales se llevó a cabo el Plan son entendidas como el grupo denominado inicialmente Joyvy, que está conformado por 4 comunidades del pueblo mbya guaraní: San Jorge, Joyvy Santa Librada, San Jorge Ypanar y 20 de Julio. Esta evaluación revisa las acciones enmarcadas en la etapa previa al Plan de reasentamiento como el cumplimiento de las normativas del BID y la legislación nacional del Paraguay, para adentrarse en el análisis de las partes que hacen al Plan de reasentamiento, que consistieron en: identificación y adquisición de tierras, traslado de las comunidades a las tierras tituladas y plan de apoyo a la consolidación del reasentamiento. Los datos utilizados en la redacción de este informe fueron proveídos por el BID y del Ministerio de Obras Públicas y Comunicaciones, además de testimonios relevados de miembros de las comunidades de referencia y de informes desarrollados durante el proceso de implementación del Plan de reasentamiento. Esta experiencia de ejecución de un Plan de reasentamiento voluntario de comunidades indígenas coteja los resultados para ofrecer lecciones aprendidas y recomendaciones a tener en cuenta en programas y proyectos de similares características.

Las disposiciones creadas han tenido un fin fundamental, como lo es la protección a la vida de la población en general, el no contar con las UCI suficientes para recibir pacientes COVID 19, es otro hecho que obliga a tomar medidas apresuradas. El estudio permitirá hacer un análisis de dichas medidas impartidas e incluso la afectación que estas han tenido en algunos sectores de la economía.

Las iniciativas de gobierno digital y control ciudadano han aumentado en los últimos años. Sin embargo, la literatura sobre su efectividad es escasa. En este estudio se busca presentar evidencia acerca del impacto generado a partir de la combinación de herramientas de gobierno digital e iniciativas de control ciudadano en Perú. En el análisis se emplea un diseño de regresión discontinua para evaluar los efectos del programa de Monitores Ciudadanos de Control (MCC), un programa de voluntarios de la Contraloría de Perú para realizar auditorías de bajo costo a las obras públicas. A partir de datos de herramientas tecnológicas como las plataformas InfObras de la Contraloría** y la Consulta de Inversión del Ministerio de Economía y Finanzas (aplicativo Invierte.pe)***, se examinan los efectos del programa en materia de costos y tiempos en la ejecución de obras públicas en Perú. Los hallazgos sugieren que si bien hay un impacto positivo y significativo en la reducción de los sobrecostos para las obras tercerizadas a firmas constructoras, no se encuentran efectos significativos en resultados relativos a la ejecución de las obras.
