Abstract:
This chapter studies the manner in which an owner of property can vindicate his rights if they are interfered with by another. An owner who has been wrongfully deprived of his property, whether that property is tangible or intangible, and whether the claim is brought as a claim in tort (as a claim in conversion) or in equity (as an ‘equitable vindicatio’), must frame that claim as a ‘following’ claim and/or as a ‘tracing’ claim. When an owner seeks to follow property, he is seeking to identify his property in the hands of another. Essentially, in order to follow property, an owner must show: that he was unlawfully deprived of property that he owned; that the person he is asserting his claim against holds that property; and that he has a better right to the property than the person holding it.

Abstract:
This chapter examines the possible basis for proprietary restitutionary claims to proceeds of unauthorised dispositions of assets subject to security interests and title-based interests. In particular, it considers the extent to which the nature of the legal relationship between the parties to the transaction might influence the basis of such claims by revisiting the Court of Appeal decision in Buhr v Barclays Bank. It also asks whether the creditor has an automatic right to proceeds of an unauthorised disposition, along with issues arising from proprietary claims to proceeds of unauthorised dispositions based on vindicatio and unjust enrichment. It shows that a secured creditor's automatic right to proceeds of unauthorised dispositions cannot be greater than what he had in the case of authorised transactions.

Abstract:
Ground offers the hope of vindicating and illuminating a classic philosophical idea: the layered conception, according to which reality is structured by relations of dependence, with physical phenomena on the bottom, and upon which chemical, then biological, and finally psychological and other phenomena reside. However, ground can only make good on this promise if it is appropriately formally behaved. The paradigm of good formal behavior can be found in the currently dominant grounding orthodoxy, which holds that ground is transitive, anti-symmetric, irreflexive, and foundational. However, heretics have recently challenged the orthodoxy. This paper examines ground’s ability to vindicate the layered conception upon various relaxations of the orthodox assumptions. It is argued that highly unorthodox views of ground can still vindicate the layered conception and that, in some ways, the heretical views enable ground to better serve as a guide to reality’s layering than do orthodox views of ground.

Abstract:
This chapter introduces the two main ways to think about the ethics of war. The first is to start by thinking about war. The second is to think about the ethics of killing outside of war, then apply those principles to the case of war. In contemporary just war theory, the first approach has most commonly been associated with those who broadly aim to vindicate international law, such as Michael Walzer and his contemporary defenders. The second approach is more frequently linked to the work of Jeff McMahan, and Walzer’s other revisionist critics. I show that this conflation is mere accident. Indeed, perhaps the richest terrain to be ploughed is in the combinations that have been relatively neglected—vindications of international law that start from cases based outside of war; critiques of international law based on the distinctive nature of war.
